You take it together and trumps aides have been hit with more prison time than any other president in history. And continued, stones insistence that it doesnt, his belligerence, his pride and his own lies are a threat to our most fundamental institutions, to the foundations of our democracies. Backing up the convictions and a blow against those undercutting it. Which as mentioned, include the Trump Administration. She fact checked claims from stone and his allies. Stone had not been prosecuted by his adversaries, nor by anyone to gain any quote, political advantage. Now about that meddling by bill barr. This is case last week that everyone was freaking out about. That donald trump was intervening in, and bill barr was talking about. This is now happening with this prison sentence for mr. Stone. And tomorrow morning stone prosecutors, when they stepped down last week in what some called the tuesday night massacre, at a very procedural level, the doj replacements had to go finish this up. They told the court, that orange request which caused that whole firestorm for a tougher sentence, they said it was presented in good faith. Thats a type of legal compliment of those who left. Trump has been attacking them. Then they made a different argument. They said bill barr softened it because of a, quote, miscommunication. This is our top story for a reason. Has the big, important story and it is a rejection of what bill barr and the president is trying to do. And my job is to show that they saw this as a miscommunication. My job is to try to share with you the factual context that weve learned. Four prosecutors dont typically take career altering step of withdrawing from a case over a miscommunication. The Justice Department doesnt typically leave something this big open to any potential miscommunication. Everyone involved understands the high stakes, the scrutiny. This is last known case handing down a prison frerm the Mueller Probe. And of course, it involves the president s adviser. As for mr. Barrs he claim hes also fine going soft order stone, he just objects to donald trump tweeting about it. This is had looking thinner and thinner because oops, he did it again, tweeting about the case including making his top promoted tweet for his 72 million followers a fox news clip now advocating a stone pardon. President trump could end this travesty in an instant with a pardon and there are indications tonight that he will do that. And im joined by former federal prosecutor, john flannery. I begin with you, having handled tough cases. This is something that was just a huge clash across america from last week the resignations. Everyone saying, wow, all this posh judge jackson. Did it impact in any way you can discern . What do you make of the sentence of mr. Stone . First, i think it is bizarre that were listening to fox news say that lying to sxong threatening a witness with death and being convicted of that is a travesty. I think judge berman was able to cut through all that. And i think the sentence was certainly lighter than what the prosecutors had originally recommended what they recommended was completely consistent, not only with the guidelines. It was scarily within the guidelines. Not low, not high but squarely within the guidelines. And youre talking about rules that apply to everyone for the number of years you get. Exactly. Thats the problem. They did exactly what they were supposed to do and they were completely consistent with current Justice Department policy. What the second letter did was to step away from all those principles, all those rules without any level of transparency and say we wont do it. The lack of transparency is particularly troubling. Im going to press you on that. Do you buy bill barrs Justice Department defense today . This is new. That it was all a miscommunication . I dont buy it. If you look at the court transcript, i think it was the assistant u. S. Attorney crabbe, i think it is, who refused to really go into deliberations before the judge. He wouldnt explain what was behind that. And i think, look. Theres something to be said for not revealing deliberations of internal Justice Department deliberations. Here, youre confronted by a judge. Are you, why are you telling me to do what the guidelines tell you to do . They didnt really do their duty in terms of giving guidance to the judge. Heres the guidelines. We think you should be soft on them, were not saying why but do it with a wink and a nod. What do you think of the sentencing today . I thought the judge did a very good job in a very difficult situation. She upheld each of the enhancement thats got the first team to the first numbers they had. Seven to nine years. It was very interesting, when crabbe appeared, as david noticed, and he was asked, how did that second memo come about . It has your name on it. Did you sign it . Did somebody prepare you for it and have you sign it . Thats where he went silent. I think if we didnt have two kinds of lawyers in this nation, we would be nowhere. The same true in watergate. We have leaders who stood by the law and four resigned the case. One left the Justice Department. Then we have, apparently shea. He became the u. S. Attorney general in part to handle this case. You mentioned barr. Let me share. This was his did defense of why they tried to go in in this very unusual way and lower the recommendation. Take a look. They wanted to advocate for a sentence that was at the top between seven and nine years. I came to the view, as my colleagues did, i wouldnt support what i thought was an excessive sentence. I think the 2,000 lawyers that objected on, this was an intrusion of justice and an under fair and inappropriate and illegal way, had an effect on what he says. Because today, when the assistant u. Attorney general was there, and the judge mentioned, you probably dont know anything about this case, which of true, he upheld the original recommendation of those prosecutors, directly contradicting the statement you just played. I think what we have is these guys who signed that letter. And federal judges putting out a special meeting to comment on this. I thought judge jackson laid it out very carefully. That she wouldnt be bowed by political pressure. And trump himself is supposedly from the evidence at the, having a conversation that was the very thing that was the subject of this. The wikileaks information. He is implicated in this. The old law is that you cant be a judge in your own case. Here he would pardon them, pressure the Justice Department, and barr would do what he was told. I think we push back on a legal system and i hope we can push back even more. This is such a constitutional crisis in our country, at the top we have corruption, people doing and serving themselves and not the law and not justice. I would hope that we on see the same thing that happened to mitchell and to meese happen to this guy. He has no business doing this given the speech he gave in nevada wheflt gave that statement that you showed on theary. That was outrageous. He has no on business. It seems, especially in nevada, a fight for democratic activists. Not every random voter who may tune in later. Were seeing the signs that they liked her being that pugnacious. I want to put on Something Else. We keep an eye across the culture. The attacks on bloomberg actually went viral. A social media user saying warren going after bloomberg and setting to it a classic beat to the rapper, a reference to a rap battle he had with another rapper, jayz. All you need to know is it is about dising, bodying or ethering your opponent. Which is a what whatever this shows. And horse faced lesbians. Everybody wants to know, who will be in the lead and what happens heading into convention. You have people asking, what if nobody gets a full majority . Should they be the nominee . Take a look. Whatever the rules of the Democratic Party are, they should be informed. Let the process work its way out. Let the process work the process includes 500 super delegates on the second ballot. So i think that the will of the people should yes. Now this is where the whole thing could head. The whole enchilada. Sanders in 2016 took a different view. Some say it depends on how youre doing. What they fwheed need to kno that the court said you can stop and frisk people, but you have to have reasonable suspicion that a crime is being committed, about to be committed. Thats the only basis for stopping and frisking somebody. The frisk part is you have to believe you were in danger. That wasnt the case in these 5 million cases. It appeared to me that what we had was racial profiling, going after a target group which was young black males, 18 to 25. Thats what was going on. The police targeted themselves to those neighborhoods where they believed the crime was heaviest but they also believed thats where the criminals were heaviest. They went after the groups. The stops were mostly dry. 90 of the stops resulted in no further Law Enforcement action. The frisks produced very little of anything. 75 of 1 had anything, any contraba contraband, any guns. It was a failed policy that terrorized, not to mention humiliated hundreds of thousands of young minority of new yorkers. As policy, the mayor ran a policy in a way that you say terrorized people based on their race. Yes, but i want to say the policy started before this mayor. It started with mayor giuliani.
