House Judiciary Committee voting on the rules and procedures for the impeachment investigation. This is real and written down. You can see what the plans are. Authorizing the staff attorneys to questioning witnesses, setting formal rules for how classified material would be handled throughout the probe and giving Donald Trumps lawyers their Due Process Rights to respond to the committee. This committee is engaged in an investigation that will allow us to determine whether or not to recommend articles of impeachment with respect to President Trump. Some call it an impeachment inquiry or an impeachment investigation. There is no legal difference between the terms and i no longer care to argue about the nomenclature. He doesnt want to have a talk about words. Look what the Top Republican on the committee says. This whole exercise falls far short of a real impeachment probe and the democrats are afraid to go there. This stays in the committee. This does not go outside the committee or to the house floor. They are covering for the moderates that dont want to vote for impeachment. Does not go to the house floor. Speaker pelosi doubled down on that dodging tactic today. Do you agree or do you concede now that impeachment inquiry into President Trump. Do i concede now . Have you not paid attention to what we have been talking about for months. We said we are doing three things, legislate, investigate, litigate. That is the path we have been on and continue to be on. I am not answering anymore questions on the subject. The speakerer says she supports what nadler calls impeachment investigation. But she would not say that. If the message about this sounds confusing it is. Speaker pelosi kind of taking what was the nadler position from right before Congress Went on this break. Do you believe President Trump will leave office impeached by the house . I dont know. Thank you very much. Will they impeach . We will see. I dont know. You can call that credit for canneder but if you are trying to get something done in law or politics, you need to say what you are trying to get done. The new moves are more emphatic but when we look at the facts and tell you what it seems like as we look at the rules, it is not moving by a whole lot. There is a lot here for democrats to try to figure out. Obviously they can investigate and decide what to do about Donald Trumps actions well beyond anything mueller found in his investigation which was authorized only through the Justice Department. Hush money to women, questions about whether donald trump is enriching himself through the presidency and if that is not a felony is that something the Congress Wants to act on. You cant do something as significant as move towards removing a sitting president from office if you cant even concede that is where you are headed and trying to do. Now, are there comparisons here . Is this all analysis from the newsroom bleachers . Well, there are precedents. We know about them and we remember them. Take stock of what it does sound like when the opposing party stands up to tell the nation they are trying to impeach a president. The president of the United States did commit impeachable offenses. The evidence is clear. There is no question he subverted our system of government and he should be impeached unfortunately. Boom. Right down the middle. That is what it sounds like when the Opposition Party is saying lets impeach the president. A Judiciary Committee on the republican republican side. He was saying what they stood for. That level of clarity is not what we are hearing from the democratic caucus. I am joined now by a member of the congress. On the Judiciary Committee as vice chair and someone on the committee during the bill clinton impeachment debate and the host of the make it plain daily show and podcast. Your view of what it means that the democrats are going this far, but not farther . I would say that nancy pelosi is showing real leadership. She has a divided caucus on the issue. She is right. The first thing that you do is investigate. You find the facts. The facts will steer you towards the conclusion. We are not there yet. The investigation is not nearly complete. We are looking for criminal violations and not bad behavior. This spirit giving bad behavior a bad reputation. The question is what type of criminal activity exists here. We are not there. If they get there they will file the articles of impeachment i would expect. I think we have an obligation to do that of the historically there is an obligation of the house to do this. I dont know of one senator that would vote for impeachment. The American People are going to throw the guy out. Congresswoman, bringing you in. You are on the committee where the action was. Before we get into what it means, do you think that donald trump has done things meriting his removal from office . I personally do, yes. But i think we are in a different situation than the clinton impeachment. In that case the special counselle gave to the Judiciary Committee all of the material. We have not been given access to witness statements. Every one has been blocked by the president. Can i push you on that a little . You make a reference because of the nature of what was handed over. Even before the material was handed over, i think you might agree, or tell me if you if you do. The leadership of the majority of the house was clear they thought they had enough evidence, not a court matter but evidence for their role in the house to say they wanted to remove bill clinton from office. Now we are in a position where Speaker Pelosi is holding you all back. Is that a fair distinction at what happened that you think matters in the committee today . I am not sure that we can go by the historical precedence in this case. First of all, we do not have many in impeachment, thank god. The big issue is that the rules of the house are different. We no longer have to get house approval for every subpoena, the republicans changed the rules several years ago. We are able to proceed in some ways more expeditiously. We have to have the facts. Think what would happen if we came out saying we are going to just impeach him and we dont care what the facts say. One the facts prove the allegations or disprove the allegations and the third is that the president has been obstructing all attempts to investigate his conduct. What are you hearing from Speaker Pelosi what comes next . I think she is relying on the Judiciary Committee to do their job. We have serious allegations of misconduct. It is congress job and the Judiciary Committees job to investigate and make a judgment as to that. Let me keep both of my congressional experts here with your experience and turn to Mark Thompson in new york. I want to play more of what we are hearing from the democrats. Take a listen. At some point we will introduce articles of impeachment and have the Committee Vote for those articles. I think it is no secret we are in the middle of an impeachment investigation. This will be a procedural vote. Do you agree with chairman nadler you are in impeachment inquiry currently . I agree that we are in the midst of an investigation. Jerry nadler does not do a single thing without Speaker Pelosi pelosi. Is this clear or muddled in your view . Christmas has come early. They are doing this. I had the chair of the party on with me this morning. I asked what he thought. He said that democrats are able to walk and chew gum at the same time. Policy issues, health care and et cetera. I believe she feels they can win 2020 as well. Thats true. The Democratic Partys reach and arms are big enough you can have members articulating impeachment while others there will be a segment in favor of one or the other. That is what governing is. The white house executive branch, republicans are not governing. Taking on the issues of policy and impeachment are necessary. You mentioned when you showed the party. She may not have been on the house floor but she said we are going to impeach the you know what. I think that speaks for itself. If it looks like impeachment and quacks like impeachment, it is impeachment. I appreciate the duck test. I think one of the question is it really quacking. The speaker is not quacking. The speaker as we played the clip said i am not taking any more questions on this. If a majority of your caucus support this is now on record and if this is a matter of constitutional dimension and the challenges of the trump presidency, dont you think the speaker should come out to take all of the questions so that you can move forward with the public understanding clearly what the next goals are . I just dont see where the debate is. Maybe i am new to washington but it seems like people get hung up on process. We have allegations of misconduct. The house Judiciary Committee is investigating the allegations. The speaker signed off on it. A lot of people want us to put the rabbit in the hat. What would happen if we find. I am only having this colloquy to understand it. I think what i would say back to you is that you are saying you cant do this without the facts. You told us earlier tonight and Many Democrats told us this that you do think the president has already done things meriting removal from office. I think that is the question for the democrats. The speaker, according to the Washington Post, told your colleagues that the president belongs in prison some day. If it is that bad some day and those facts have been found what else are you looking to uncover . I think congresswoman and then the senator. I think we are talking about scope. I think the obstruction of the investigation. His obstruction of the Mueller Investigation warranted impeachment. You mentioned hush payments to obtain his election, we talked about other misconduct. We have not been able to get the evidence yet. Just think what would happen. So the Mueller Report talked about don mcgahn, the White House Council being ordered to fire the special counsel and lie about it and create fake evidence. We have not been able to see his statement or question him. We cant just drag the country through it for the fun of it. We do have a job to do with investigation. We cant do it piecemeal. I think ari this is a tap dance around words. It is not unimportant at all. It is important. But the important issue is what is going on really. Not what they are saying but what they are doing. There is a really Serious Investigation going on and the congresswoman signature esugges agree there are criminal behavior. Investigate it. Find out what you can prove and then you go to articles of impeachment if you get to that point. I think i understand exactly what is happening. The speaker is doing the right thing. Move ahead. Push for the investigations and get them done and make a judgment about what the future will hold trying to make the president accountable. The voters will hold him accountable in a significant way soon. Simultaneously, stress and other issues the American People are concerned about. I will say this. I dont think it is muddled for trump and the white house and his attorneys. If anyone watching us tonight said the sec might be looking in to you, you get ready for it anyway and assume something is going on. I dont think he is confused about it. I think you need to get everything in evidence and push forward. I think they are doing it very, very carefully. I am very pleased. What i am going to do is thank all of our guests. New signs of a last minute push by Donald TrumpsJustice Department to indict james comeys former deputy at the fbi, the man that took over the russia probe after james comeys firing this. Is a bombshell from the Washington Post. The d. O. J. Has authorized prosecutors to indict his top former fbi official, Andrew Mccabe over a technicality over statements he made to other d. O. J. Officials and investigative colleagues as they probed his contacts with the press. This kind of an indictment would mark the retaliation or criminalization of Public Service critics were warning about in the trump era. Donald trump attacked mccabe personally, identified him repeatedly and attacked his wife and demanded they fire mccabe befo received his government pension. This was seen as a public way to put the pressure on and critics say maybe the pressure is working. He became, as you may recall, acting director after the firing of comey and he i was in charge of the fbis russia probe before bob mueller was appointed. At this point it is not clear whether mccabe will be indicted by the Trump Justice Department. Prosecutors recommended charges. The top federal prosecutor in washington, the u. S. Attorney from the Justice Department onboard according to the report. Mccabes team has been appealing the plan and they learned the appeal was rejected. Another clue that was new, the grand jury that was dealing with this and investigating mccabe was suddenly recalled this week after a monthlong hiatus. The panel was let go thursday. That timing piece could mean anything. Like they did already approve the indictment. It could mean they met and didnt go forward on the indictment or they did something else. These grand juries, they are pretty secret. What we are seeing in the report is news about a potential indictment of the person that literally ran the trump russia probe. If that is the talk of investigating investigators the Washington Post is reporting, the talk may be hitting now. I want to turn to Nick Ackerman who has been on this probe since the very beginning. Before we get to what you may think is wrong with this and many people say that there is something wrong, walk us through what it means to you to hear that the d. O. J. Has authorized charges against mccabe. And we learn that the grand jury met again. The optics on this are terrible. You have a situation where trump, as president of the United States has asked for the person to be indicted. That in itself, whether mccabe did anything wrong or didnt do anything wrong, trump has basically put the case in a position where it is super politicized. They singled the guy out so he would not get his pension and fired him the day before he would have qualified for the pension. Now whether or not what we are hearing about the grand jury makes any sense, to me if they want an indictment the grand jury will go along with the government. It is extremely unusual for a grand jury to not return an indictment if the government prosecutors recommend it. Can you think of an example in u. S. History where a president S Administration indicted the person that ran the fbi or investigation touching on the president . Never. Nixon did not try this. He was not that stupid. Now we get to the real question for you. If the Washington Post reporting is right and we credit them. This is their report. But if it is going in that direction, is that wrong and an abuse of power . It certainly reeks of that. The optics are terrible. Jeff rosen, the Deputy Attorney general is the same person to turn down the appeal and the one that arranged for paul man foaf to get a cushy time in jail rather than rykkers island here in new york. He has a track record of doing trumps bidding and political bidding. It does raise questions. We dont know the facts. We dont know what it is they would charge mccabe with. But this does not have a good smell to it. The other piece is the public and now potentially legal attacks on people exercising free speech rights to criticize the president. Mr. Mccabe, he did come out. He clearly said what bothered him the most about donald trump is the criticism and attacks and undermining of the d. O. J. And fbi. Something criticized by many, not just the people in the probe. He was on the program once. I talked to him about that. Lets take a look at that. In my view the worst thing that the president does is the same behavior and actions he engages in every day. Unrelenting assault on the fbi, men and women in Law Enforcement and having professionalintellig. I think it has an impact on those institutions. He is correct. That is the problem. You have the president of the United States constantly raising the issue and asking his political enemies be prosecuted and locked up, it undermines the entire integrity of the Justice System and makes people question whether the department of justice is acting fairly in the exercise of their duties. That is a terrible position to have our government in and have our department of justice in. I dont think that ever has been exercised by any president on any department of justice. Even when nixon fired the attorney general who would not fire cox and fired the Deputy Attorney general. Things went along as normal. Nobody was investigated because they were an enemy or investigated or threatened to be put in jail. When you put it like that, it is concerning. Based on the Washington Post saying the man that ran the russia probe is up for potential charges. They want to do it out of one office and now it is hanging in the balance. That can go into the minds of every Law Enforcement in america every time they have a case with the deal with this president s unusual governance. They are thinking the pressure, losing the job and pension and going to jail. It is a deterrent for a reason. I am going to fit in a break. Thank you for being here. Being on the stage and the dynamics of that with the pressure and all of the different layers. I am curious what you think of how joe biden, who may not be the frontrunner, nobody knows, but certainly a famous person on the stage. How he takes a punch. We talked so much about who can do the attack and get themselves in. But a lot of the great debaters, and certainly obama, knew how to take a punch and not get rattled. I wonder if you think joe biden struggled with that before and how that plays in to tonight where he is still a famous target . I think we have seen him rattled when senator Kamala Harris went after him on bussing. The second debate he did not seem as rattled. A boxing champion said you choose a champion by who can take a punch and not just throw one. If people start to throw too many punches they could turn what could be a contender that seems to be off in to a martyr. You dont want to look like you just came out to beat up on joe biden. You have to thread the needle to have something to say. These are my policies. I am upnot just here to beat upn somebody. They want to beat up on trump. He said warren transferred 10 million from her Senate Campaign to the president ial one. 6 million came from the big contributions, 1,000 and up. Get the upside from askewing donations from the high leverage donors and using that money in 2018. Do you think she needs to address that and is that a strong hit or does that look desperate because Elizabeth Warren, to many, seems like one of the cleaner candidates that avoids the big money . I think there is clearly the image she has been among the cleanest that we have seen. But she will have to address it so it does not look like she is ducking it. As she has grown in the polls she is the only one that has advanced every poll, just about. She is going to have to get used to the fact where she becomes a target. She is definitely going to face scrutiny she didnt face before. If you cant answer it in a succinct and effective way it will erode. I dont think she has been in that position yet. We will see it continue to have that scrutiny if in fact she continues to have a growing support. I know. I have been controversial.
