Congress and trump himself claimed the law was on his side. Thats up to whoever handles it. Im under orders. Thats up to whoever it is. From what i understand, the law is 100 on my side. Obviously democrats in congress dont agree with that. In any legal fight, theyll face trump allies in key positions at the irs. The New York Times reporting with a trump lawyer at the irs. Has ties to the Trump Organization. Not putting him in place was a key priority for the president. The probe into trumps finances extending beyond his taxes. His Accounting Firm will give ten years of trump documents to congress once they do get a subpoena. And the Capital One Bank saying theyll hand over trump documents as well. This is all veering into territory that trump once said was a red line for him. Mueller was looking at your finances and your family finances, would that be a red line . I would say yeah. I would say yes. Joining me now, the executive editor of above the law. The vice chair of the new York State Democratic Party and former new york counsel speaker, and howard fineman, an msnbc news analyst. Howard, ill start with you. Trump starting the week out saying he was exonerated from the Mueller Probe altogether because of the bill barr letter, four pages which turned out to summarize 300 plus pages. Still waiting on that one. Now it seems as if the president has tried to hide his finances. What has happened here . I think clear that the fourpage letter from barr dten and close the case. Far from it. I talked to one of the key leaders on the democratic side in the house right after the barr letter came out. They said it was going to be full steam ahead with the investigative and oversight committees that the democrats control in the house. Youve got five of them going after different parts of the trump story. The point here is that impeachment aside, the American People in the Congress Need to know in essence financially, and businesswise, who donald trump is. We still really dont know. That is key to understanding foreign influence, if any, it is key to understanding illegal contributions, perhaps. Key to understanding his business and so forth. And a full pardon of donald trump will come out one way or the other. At least thats what the house leadership intends to happen. Thats the tone of things right now as we end the week. Ten days or so after the barr letter. If we were having this conversation a year or so ago, we would assume barr had Donald Trumps finances in his hand. If he was hook into russian collusion or alleged collusion, if there were any ties between Trump Organization, russia, moscow, vladimir putin, he would be looking at any business in moscow. We cannot assume that mueller had any access to trumps taxes or his finances. Exactly. But the house judiciary committee, the house, ways and Means Committee will get access. When trump says the law is 100 on his side, he is 100 wrong. As jules from englewood might say, nobody asked donald trump a thing. All right in this is not his call. It is Steve Mnuchins call. The law is very clear. It says that the treasury secretary will furnish tax returns of any american citizen upon written request from house ways and means. So nobody really cares what trump and the Trump Lawyers have to say. And mnuchin could disregard that. He could read it differently, as they seem to read many things differently like the constitution in the white house, but at the end of the day, that is a case when taken to court by the House Democrats, they will win. Youre right. It is clearly stated in the law. It is not interpretable. Let me get to the nuts and bolts. It is based on the 1924 law. I know that you have this on hand. Tax law is very difficult to understand. It 1924 law. Anybody could see in congress, could see my taxes if they wanted to see it. Now youre saying the decision goes to Steve Mnuchin. The Treasury Department to actually make clear whether or not we can see the president s taxes. Why would steve am i wrong . Yeah. It is not that Steve Mnuchin has the authority to make it clear for us to see it. For congress to see it. For congress. Why would Steve Mnuchin do this . Why wouldnt he . It is the law. But hes a trump appointee. He could be held in contempt. They could go arrest him if he doesnt follow law. As complicated as tax laws are, this is very clear. Upon written request from the chairman of the chairman on ways and means, the chairman shall furnish such a committee with any return and return information specified upon request. Thats as clear as it gets. I was going to say that law sounds very antique. It from 1924. If it gets to the court, the legislative history will be important. The history is that grew out of the famous tea pot dome scandal in the early 20s that involved the administration at that time. So there is an argument to be made that far from it violating executive privilege, the law itself grew out of at leasto. We know and weve heard from the president over and over again. The reason he has not released his taxes is because he has been continuously audited for a decade. Not sure but he says that. I want to play a sound bite from the president talking about his audit. And then well follow it up with something that charles red hickory ic had to say. You dont release until the audit is complete. Its a long time. Theyre extremely complex. Nobody turns over until it is over. Im not releasing the tax returns. Theyre under audit. Are they or are they not under audit . Heres what em. Would any experienced tax adviser advise him to publicly release his returns during the you had a it . Absolutely not. So hes lying. Hes probably not under audit. Michael cohen has said as far as he knows, Donald Trumps taxes are not under audit. And it is the longest audit in history. So a, hes lying. B, hes lying more. If you listen to what the irs guy is saying, hes talking about in a theoretical sense. If somebody was under audit, you wouldnt be advised to release taxes. Not trump is under audit and i am advising him not to release taxes. And b, nobody is asking trump to release taxes. Nobody cares what he thinks about taxes. Nobody is asking him to release them publicly. Were asking him to follow the law and to provide the government is asking the government to look at information that the government has already i want to play what Michael Cohen that. Go ahead. What he didnt want was to have an entire group of think tanks that are tax experts run through his tax return and start ripping it to pieces and then hell end up in an audit until ultimately have taxable consequences, penalties and so on. I presume that he is not under audit. And hell end up in an audit. And he said i presume he is not actually under audit. He would not, a, if he was under audit. B, he was probably in the room when they had conversations about how will we get around president ial candidates releasing their ten years of taxes. So if there is somebody who knew, he is the guy. There is little question about that. You certainly can. You have to step back a little bit. The hasnt of president s releasing their tax returns go back to Richard Nixon and it has been true every time since. The thing about donald trump, weve been saying, we dont know who he is really until we know who he is financially. This is the first person of this kind to ever be elected president of the United States. A guy with a global and local big, big business who on paper is worth billions of dollars. We dont know who the president is in a real sense until we know his financial profile. One way or another, we have to get it. Thats what theyre trying to do. With the accounting records, the whats in your wallet request to capital one. Thats what theyre going to get. Not endorsed by capital one. What is Congress Going to do with these taxes . If they to get ahold of them, the first challenge will be to keep them under lock and key if they do. Thats critical. If it leaks, then ball game as far as trump is concerned politically. Then they have to use that as part of the picture. With the work product of the accountant with. The bank records. With the no of money. The question is, there may not be a criminal conspiracy. There may not be a criminal conspiracy to collude or cover up. We have to know what influences there are that make this president , make the decisions that he makes. And thats really what were after. And also for the sake of history. We have to know whether impeachment is ever involved. And thats, hes right. Thats the fuller sense of who the president and the people around him are. Right . We dont know what is in muellers report. We know it looked at russia. And it probably looked at investments that the Trump Organization or trump has had. That we need to know. That has influenced. It has an influence to him as a person. We need to know that. You have been in new york politics for quite some time. You have known donald trump for a very long time. What could he, what do you think he is hiding . He was phony baloney developer. He never really developed much in this town. He just sold his name to things. Welcome back. Michael cohen out with a new pitch to congress. He says he has more dirt on trump and hell give to it democrats but he wants their help keeping him out of prison. Cohens lawyers say he just got access to his files back after the fed seized them last year and hes just started going through 14 million files including emails, voicemail messages and recordings. And guess what. He needs more time. With 30 days left before he surrenders to prison, time is no longer a luxury that escapable of. The lawyers submitting a memo summarizing, including his claim trump encouraged him to lie to congress by using code language. Cohens team hoping the democrats will tell new york prosecutors how helpful he has been. So theyve either cut his jail time or postponed the date he has to report to jail so he can keep helping investigators. Donald trump said hes not worried about anything that Michael Cohen has. No, theyve already got it. Old news. He lied numerous times during his last testimony. Theyve had that for many months. With me are two former federal prosecutors. Welcome to you both. Im going to start with you. Does Michael Cohen actually have anything . Its hard to say. We should note michael cohn no hero. He pled guilty to committing conspiracy to violate the election laws, to help donald trump get elected president. Well never know how much of an impact that had on the outcome of the election. But apart from any collusion with russia, this failure to may by the rules to get trump elected cast trumps presidency into the legitimacy of trumps presidency. And he also pled guilty to lying to congress. So it is hard to understand yes thinks that congress will give him a break now. He says he has all these emails, voicemails, attachments, why didnt he show that to mueller . Why didnt the mueller team find it . We dont know thats the case, do we . If the sxagts investigators did not see the files, thats malpractice. And it was probably hidden somehow. If they did look at those documents, and now cohen is saying, hey, i may be able to shed some light on this. Then i think all mr. Cohen is doing is pushing back his report date of may 6 to the bureau prisons. If they did not peruse and go through the 14 million files, i cant believe thats in his computer and his phone, and they find any documents that corroborate, support, and buttress what Michael Cohen the perjurer says, thats bad news for the president of the United States. Do you think this could have been a strategy from cohens lawyers to roll these things out as he got closer and closer to reporting to prison . I dont want to secondguess defense attorneys. I am now a defense attorney. I want to say, im glad i got you laughing. I want to say this. If they go through 14 million files, and Michael Cohen now finds a smoking gun, or a gatling gun. And those documents corroborate what Michael Cohen says, this could add rocket fuel to the investigations in d. C. , edva, and the Southern District of new york. Possibly. Or it could be a nothing burger. So paul, you are also a federal prosecutor. Do you actually think that muellers attorneys, that the sdny, that the d. C. Courts, that nobody is going, has gone through these 14 million files . Do you buy that . That they havent seen every single thing that they got from cohen in that raid over a year ago . No. I dont buy it. In part because the Southern District prosecutors at cohens sentencing refused to give him credit for substantial assistance. Mueller was a lot more happy with how cohen cooperated than they were. And in fact, they said that he wasnt entirely forthcoming. He refused to tell everything that he knew. When i was a federal prosecutor, i interviewed a lot of witnesses from prison. Theres no reason that cohen cant kin to cooperate while he serves his time. This is a rule 35. If he continues to provide substantial assistance, even from prison, his sentence could be reduced. There is this question with regard to democrats and Michael Cohen. Do they feel as if they owe Michael Cohen something . If you look at the headlines today from the New York Times, House Democrats demanding six years of trumps tax returns from the irs, daily beast, Elijah Cummings seeking ten years, politico asking capital one for docs on the sprawling businesses. Much of this as we talked about in my last segment was with cohens 27th regard to trumps taxes. I worked for the department of justice for 30 years. 11 of those years i did 30 tax trials. And the thing about tax returns, you cant call them snitches. You cant call them rats. You cant give them a pardon. So when those tax returns are analyzed and perused and Michael Cohen did provide the committees some red flags and loud gongs as to what possibly on the returns is false. And i want to go back to july of 1974. The Watergate Committee of the house judiciary committee, they voted on impeachment articles involving president nixons alleged cheating on his taxes. They didnt approve them. But cheating on your taxes is a big deal. Just ask al capone. I want to circle back to this cohen thing. He has this looming deadline in three weeks or so and he did provide a lot of information in that testimony that gene is just referring to. What could actually happen here . Do we see congress granting him more time to provide more information . Because we do know that congress is certainly investigating the president and we know that Michael Cohen has a lot of documentation with regard to the president and a lot of history. So what Michael Cohen is trying to do, to stay out of prison. He didnt come clean until he got caught. Now what hes doing is asking congress to write a letter to the prosecutors asking the prosecutors to give him credit for substantial assistance. Even if congress is willing to write that letter, there is no guarantee the prosecutors would go along with it. So this is kind of a hail mary pass. You cant blame him for not wanting to go to prison. At some point he has to pay his debt to society. Okay. Thank you to you both. Ahead, trump at the border as 20 states sued to block his wall money. One of the attorney generals suing will be here live. First, joe biden on what his campaign might look like. Well be back in 30 seconds well be back in 30 second. The big news coming from someone who is not officially in the race yet. Joe biden appearing to go off script during a speech, making light of complaints from a growing number of women who say his close physical contact makes them feel uncomfortable. So today, a former white house director saying she saw biden showing physical affection for both men and women. And he wears his emotions on his sleeve. After the speech, biden dodging direct questions when hell announce but giving signs of what kind of candidate he would be. You said you were the most aggressive person in the Democratic Party. Theres a lot of candidates in this race. I said liberal. I didnt say progressive. The vast majority of the Democratic Party are still basically liberal to moderate democrats in the traditional sense. Everybody asks, what kind of democrat. Im an obamabiden democrat. Back with me, someone who knows the Democratic Party very well. Why did he possibly, for any reason, make both of those jokes . And i think Vice President biden had been responding to this controversy well. He was saying he was willing to listen. He understood the times had changed. And he was presenting himself, i thought, in a fairly contry it way that was genuine. And maybe he made those jokes because he was nervous. His first time out since all this. But they were mistakes that he should not have made and that are really not helpful to him moving forward. Weve been not necessarily hearing a lot from the democrat Everything Party on all. This everybody from Kamala Harris to the house speaker. It seems when everything went down with al franken, the democrats drew a line in the sand that they had a very low bar with regard to anything like this. Whether it be something that made someone feel uncomfortable with a hug, all the way to sexual assault, or sexual harassment. Now it seems like they are waiving. I think there are a lot of people who feel trigger was pulled too quickly. The truth is weve got a Lieutenant Governor and a governor in virginia right now that a lot of folks had said should probably leave office. What are they doing . Theyre staying in office. Theyre pretty resolute about that. People saying they should have made a different decision. So serve trying to be careful because of joe and who he has been for the party. I think kristine is absolutely right. Hell do something awkward. Then hell seem to connect with everybody and then do something awkward again. In all of those, thats joe biden. He runs from the embracing and empathetic person. And he is a guy who inserts his foot in his mouth all the time. Which we know well about. I think we look at that, why would you do that . That is a misstep. In the campaign parlance. The average voter is saying whats the opportunity connection here . Comparing him to the person in office . Unequivocally true. We have joe biden here struggling with changing times and a guy who is like weapon, a heart on his sleeve compared to the president of the United States who is on tape talking about grabbing womens genitals and being able to grab and kiss. Is he going to fight like that . Is he going back to the president , is he going back to the president and saying, look at you. Look, joe biden may put his foot in his mouth at times. He may be awkward but he is one hell of a fighter. Not a shrinking violet. As he working class democrat. I cant help but thinking, the way he stops all this is announce for president. Why is he waiting . I dont think it will stop. I think maybe theres a maybe the strategy is he waits a little while to see how all the other candidates have done financially. And bernie has 18 million. He has to figure out, can i even match that . If the former president of the United States, the obama biden candidate that he says he is. Waiting to see where everybody colonels out financially. Giving himself some time to raise the money. Maybe by the time he announces, one or two people fall out. What do you make of biden saying he is not progressive. He is a liberal. He is an obamabiden democrat. I think it is interesting. He is saying it is liberal like he believes most democrats. Are i think most define themselves as progressive. Thats him standing in the place of, im more of a general election candidate. I am a moderate will he liberal democrat. I can beat donald trump. Then to say hes an obamabiden democrat. It is leaning to the left, to the progressive side. I think necessary clever wording the fence. Weve been asking this so far as we cover the leadup toin . Or are they going to vote for someone who can beat donald trump or for a candidate who has both . Thats important. We cant assume they arent one and the same. Recent polling indicates that democrats more than anything want a candidate who can beat donald trump. Absolutely. Going back to the question about liberal. I think in his mind, he is a very liberal democrat. Based on an older coalition of White Working Class people of color. The progressive young Democratic Party. Is that what they want . If you go back to 2018, we talked about the growth of the Democratic Party and how we had such an expansive party. And it was a tremendous, we were doing much better than republicans in that regard. That we had depth. If you look at who is growing the party, to them, i think he is more of a moderate than a liberal. So do two things. Bring White Working Class back to the party. Theyve been leaving the party for a decade. And obama changed the coalition for a bit. He has to reform that. And bring in the new voters that got engaged in 2016. I think the obama reference, why wouldnt you mention president obama all the time, if you could. If you were his Vice President. I think thats a clever hit. In a way to bernie. Thats a way for Vice President biden to connect. And hes always done well. To remind the Africanamerican Community whose back he had, president obama. Bernie, we saw in the last primary, had terrible issues. Weve seen in the elections, in the midterms, who can put the party on its back . Africanamerican voters. Particularly africanamerican women. Why thats critical, south carolina, california. Huge africanamerican vote early in the process now. So engaging the Africanamerican Community had been paramount. Engaging the Africanamerican Community but we cannot forget about engaging the women as well. And how is joe biden going to address the female voter . Especially considering the gaffes he made. First he needs to stay words ill sorry more full throatedly than he has. I think he needs to be direct to say im listening, growing. He doesnt need to make any more jokes about it. I got it. Lets start with this. What is todays motion that you filed . So we filed a motion for a preliminary injunction to stop the president from hijacking 1. 6 billion of money that connecticut and many other states are depending on in connecticuts case, state police, equipment, training, operations. Hes taking money that Congress Said is for the states, for Law Enforcement. And hes spending on it a border wall for a National Emergency that doesnt exist. So from this motion that im looking at here. This preliminary injunction. It wont be seen in court until may 9th. That means we have about four weeks until then. Does that mean between now and may 9th, the president can begin to access that 1. 6 billion in emergency funding . Thats whats so dangerous. He is the president of the United States. And hes in control of the executive branch and hes doing something that hes not lawfully permitted to do. Thats why were facing a constitutional crisis. The constitution says that Congress Shall have the power to appropriate money and the president is saying, i dont care. Im going to go ahead and hijack the money that connecticut earned, by the way. Our Law Enforcement participated in joint, state, and federal Law Enforcement exercises. And so we earned this money from the treasury forfeiture fund, for example. It is thousands of dlarollars t keep our residents safe. After we went through shun, the president declared the state of emergency. He predicted this would happen, that he would get sued. We will have a National Emergency and we will then be sued and they will sue us in the ninth circuit, even though it shouldnt be there. And we will possibly get a bad ruling and then well get another bad ruling and then well end up in the Supreme Court and hope any well get a fair shake and well win in the Supreme Court. Very singsongy. It takes you back to that moment. It doesnt sound like a National Emergency. He is predicting all that dha. He said in this press conference, that he would go play golf and he didnt have to do it this way. One thing to keep in mind, congress agrees. This is going to federal court. Led by my friend, javier becerra. Well make our case and we feel very good about our chances to show this president is abusing his power. He has overstepped the constitution and the National Emergencies act and there is no basis for his building a border wall with money hes not entitled to spend. If this ends up in the Supreme Court, are you concerned about the president s two most recent appointees . I think it is xheer the National Emergencies act was put in place to limit president ial power so the president s dont just go off and spend money willy nilly whenever they feel like it. We feel very confident. Just this week four more states joined us. Massachusetts and they have others. Some of the money is coming from drug he said forgenc encforceme. The money hes taking with regard to build this wall is money that is used in Law Enforcement. He is tough on crime, drug abuse, and illicit drugs president. And yet youre right. Money. Drug interaddiction money and of course, military construction and military spending money that all the states depend on. They depend on people in america safe. And how many seven figure deal or whatever it is so he can come out with yet another way that he will use this opportunity that he has, when hes supposed to be in service to the American People, to make a buck for himself. He is so unethical and immoral. I dont even know why were shocked by this at this point. But none of this is a surprise. I dont think anyone is necessarily shocked by. This when he went into office, he already had some books. The art of the deal, the ultimate deal maker, as he says. So i dont think anyone is shocked by this tellall deal. He has made it sound like he rae wants to settle scores. It is unprecedented. Correct me if im wrong. With so many books coming out of the white house, especially staffers who have come out in the first two years of his presidency, omarosa, simms, theyve written books that the president has not been happy that. Then the michael wolf book as well. Talking about Steve Bannons role in the up to 2016 and what place in the first year or so of the white house with all of them in place. It seems as if this is very much about the president trying to settle scores. Of course this is what it is. Whats interesting is the precedent is so focussed on trying too take down people and bring out other peoples dirt that he is actually just looking like a fool and doesnt realize it. I am so interested to see what exactly dirt out of his own swamp he thinks he is going to be able to reveal. This is when he says its very, very bad and i have seen that person in a very compromising situation, you have to wonder if hes bluffing or if there is anything of substance behind his very, very and big big and huge hugs. The public is probably going to be intrusioned to see if there is dirt that excuse me that co. If he is black mailing folksory hes got something about it.
