Mueller. This has large implications for trump in the russia probe, new signal that flynn may cooperate with bob mueller. Report explains why its ominous for trump. Met with people on Robert Muellers team, newest indication that both sides are discussing a possible plea deal. After the New York Times reported that flynns team took a step away from the white house. Telling trumps lawyers they cant talk to them more about the Mueller Probe which nbc has confirmed. Two headlines, flynns team turning up the heat on the white house. Back in march they publicly warned flynn who was seeking immunity and had a story to tell. Tonight moving beyond public announcements or posturing, whatever you want to call it. Tonight the story is private meetings. When you are given immunity, means youve probably committed a crime. Thats not always the case. But immunity for cooperation is first headline here. Alarming for the trump white house. Second headline is that trumps line to flynn is going cold. Remember donald trump went to bat for mike flynn, kept him on staff even after he was caught lying. Pushed jim comey to try to drop the criminal inquiry into mike flynn. Comey testified about that under oath. If flynns lawyers can keep in touch with the white house, you can bet they will. Cost them nothing, earns them potential good will from the press and potential information. Why cut off contact . Its intricate but important. Cutting off contact because they think they have to. New york times reporting that agreement to share information with trumps team terminated, lawyers are not supposed to Work Together if one client is cooperating with prosecutors and another is still under investigation. That is not proof at this moment that flynn has flipped. Theres no public confirmation hes flipped yet. But it is what the road to flipping can look like. It is evidence that flynns lawyers are close enough to negotiating some kind of cooperation that they thought theyd have to take this step. Knew this could leak, broadcast could be talking about it in days, they know all that. Felt they had to do this because those lawyers and mike flynn are talking would Robert Mueller with cooperation on the table. Senator chris coombs is on the Judiciary Committee and overseeing aspects of this. Flynn and your thoughts. Cooperation on the table . And best course going forward. Typically at this point in a federal prosecution in ongoing criminal separatiinvestigation, coordination to two potential targets and money like flynn, potential target of the investigation, his lawyers would come forward for a meeting with the investigators, and investigators offer the fruits of their investigation. Lay out heres what weve got on your client and would be expected to be a proffer from flynns lawyers, heres what weve got that might help you further your investigation. Then would be a negotiation about whether some immunity might be offered and what the scope of that immunity might be if flynn flipped and cooperated. As you said, theres no proof thats what is going on. But severing of agreement to communicate between defense counsels and following meeting between muellers team and flynns defense team is strongly suggestive theyre exploring or maybe negotiating an agreement. And thats new tonight, the meeting. One more question on flynn and turn to another issue youve been pushing on russia issues. Flynn, he has alleged legal exposure, doesnt mean anything is going to come out of the investigation. But public accounts showing failure to register foreign lobbying, misleading fbi agents in the russia probe and discussing bribery plot to nap a u. S. Resident. Are those the main areas of exposure . I think former National Security adviser flynn has exposure in areas where he failed to report, engaged in misleading investigators and number of cases where he has complicated relationships, whether with turkey, with russia, and conflicts of interests between his actions as member of the Trump Administration and senior National Security team and his actions on his own financial behalf. Both he and his son are at significant legal risk, which could force him to cooperate. Wanted you on the record there. But other big issue is something youve been leaning on, a set of questions youve been demanding answers from the trump justice department. Issue is this very powerful prosecutor, dana boente, who you said was forced to resign. Hes in the line of succession if trump tried to remove mueller, in the line beneath rosenstein. You wrote youre concerned about the timing given indictments issued by mueller. If any of this did go past rosenstein, its well established for everyone playing baseball cards at home, boente could be a key player. My colleague Rachel Maddow on this role. Theres a case to be made if anybody outside of special counsel Robert Muellers office knows whats going on from the very beginnings of the trump russia investigation, its probably dana boente, given his role in eastern virginia, ag, acting ag, National Security division. I dont want to make light of anything or if you remember the movie zelig he was everywhere. You seem concerned. Walk us through what youre asking for now and why. I sent a letter to attorney general Jeff Sessions over two weeks ago asking for answer as to why dana boente was forced out. Long serving senior Law Enforcement official as you mentioned. Central role as acting attorney general, Deputy Attorney general. U. S. Attorney in eastern district. Rumored that he signed a number of early subpoenas and been involved in the investigation since its early stages. President has prerogative to dismiss u. S. Attorneys but not for improper purpose. Im asking attorney general so clarify. Theres a larger pattern here. President trump directly intervened with former fbi director comey, sat down with him and personally asked for his loyalty. Reported to have interviewed u. S. Attorney candidates for several jurisdictions where the president has significant real estate holdings, unprecedented and referred to as improper interference in the u. S. Attorney selection process. I think attorney general could address this promptly. Earlier i met with the chairman of the Judiciary Committee and he offered his assistance in trying to get answer in timely fashion. Asked chairman grassley if he would consider a hearing in matter of dismissal of the u. S. Attorneys, instead he offer, and i greatly appreciate, to communicate with the attorney general and simply encourage him to answer my questions. Interesting stuff. Senator chris coons, thank you so much. Brian weis, criminal defense attorney for tom delay and joyce bans vance, former federal prosecutor under barack obama. Dealers choice. From the senator and mike flynn. Not every day that former National Security adviser sends his to talk to him in personal. Thats the news tonight. Seems like watershed moment in the mueller investigation. Flynn, two of the key events that mueller has to be keenly interested in involves flynn. Hiring on the trump team. What did they know when hired him. And firing of comey. Flynn should be able to shed light on those. What the conversations were. If flynn says sure, i asked the president to protect me from the russia investigation and he turned around and spoke with jim comey, we have an easy case for obstruction. Could involve any number of individuals involved in this entire scenario. Brian, you have experience on the criminal defense side of things, walk us through how this works and i guess ill ask you the basic question, do you get an immunity agreement for free . Were heading into christmas, is this something they give out . Or hanukkah. Thank you. Or hanukkah. This is a watershed moment. Those of us who binge watch law order realize that being criminal defense attorney is more than motions and trial. When bob mueller visits and client is queen for a day with a proffer letter, talking about who, what, why, how, mike flynn can assist moving forward. Proffer letter . What i knew, when i knew it, advance the story. In this situation bob mueller knows hes got mike flynn and mike flynn jr. , powerful incentive for him to come forward. You think the way these things are negotiated, tonight theyre at or near a letter and talking about who knows what and what they would get for it . Could have been one of two things, meet and greet and have starbucks and take each others measure. But at that point in this, with the abrogate of the Defense Agreement theyre talking turkey. What they can tell bob mueller to advance so flynn can see grandson graduate from prek as opposed to high school. Those are the things that prosecutors push. Joyce vance, response from trump side. No one should draw the conclusion this means anything about general flynn cooperating. What was not entirely unexpected was that flynn may be discussing a plea with the especial counsel. As lawyers, you and i both note the use of the double negative and whether this was expected or not. Issue is not who was expecting what, the issue is whether mike flynn, National Security adviser, a high level post, has information that bob mueller believes is credible about crimes committed by other people at least equal if not higher level. The president and his team took a lot of steps to keep mike flynn in the fold. Repeated comments from the president talking about what a good guy flynn was, perhaps hinting at pardon for flynn. But end of the day what weighed on flynn was liability not just for himself and for his son. They were both around. We were told that flynn was the trump whisperer, on the plane with trump every day flying around. Had enormous opportunity to observe. Whether his observations will be valuable is up to the folks on bob muellers team. I dont think hell be around to watch his grandkids graduate from prek, in my judgment i think hell plead guilty to felony. Will be time involved but may be able to protect his son and to some extent himself by pleading guilty. Thank you for your expertise. First appearance in under 11 days and comes 15 days from the special election. Revealing new details about how donald trump came to the defense of moore, saying accusers may not be telling the truth. New york times reporting that trump sees echos of the access Hollywood Tape and told the senator the tape was not authentic. Asked about that. Does the president still accept the authenticity of the access Hollywood Tape he apologized for during the campaign . President addressed this. Was litigated and answered by the election by overwhelming support apologized for it, seemed to acknowledge its authenticity, that has not changed . President hasnt changed his position. If anything the president questions, its the medias reporting on that accuracy. As for when the tape originally surfaced, trump did not deny it was authentic. Ive said and done things i regret, and the words released today on this more than a decadeold video are one of them. Anyone who knows me knows these words dont reflect who i am. I said it, i was wrong and i apologize. Joined by former democratic senator from california, barbara boxer, pac for change, focused on defeating republicans in next midterms. Good to see you, appreciate the time. Thanks ari. Look at where this is with donald trump, seems to be trying to do something that republicans in washington have refused to do, thread a needle, making air quotes if you cant see me, thread a needle on accusations of predation by roy moore. And youre asking me if i believe that trump is wrong . Yes, trump is wrong. It is such a pity to have as president a grabber in chief and worse. And for him to say that that access Hollywood Tape is rigged or wrong when he admitted it at the time, it sounds like its a defense for perhaps a trial coming up, or perhaps impeachment where that tape could be used as evidence. But youre the lawyer, im just married to one, mom of one and daughter of one. Surrounded. Surrounded. I hope some of it got through, the good parts anyway. As you know, im not in office anymore. Ive always said what i thought but this is one great big lie, to say that that tape is not accurate, when he in fact admitted it before. And you make such an interesting point, that kind of lie, when someone has already admitted the opposite, looks really bad in public, so it makes you wonder whether its for some other purpose. May be another proceeding where he wants to fall back on challenging the evidence. Interesting point you raise. Yes. More broadly with roy moore, where do we go from here. Brand new report in Washington Post that fringe rightwing group, project vert as tried to do a sting operation and trick the Washington Post over the story. Failed and theyre reporting that and busting them. Some of the rightwing activists read it. Post reporters, walking into office of project verit as, designed to catch the Washington Post in false accusation. Thoughts on that . Its bizarre. Ive heard about it. Didnt shock me. Saw it done to planned parenthood, done a sting to try to get people to say certain things. Good for Washington Post, theyre so careful, not out to tell lies but get to the truth. I served for so many years and press made me crazy, ari, they did. Ever since watergate, the press is adversarial with elected officials. Thats just the way it is. You have to accept it, keep your eye on the prize, be direct and do the right thing. Press is very careful with this and im very pleased they exposed it. This is the story now, another factor for people of alabama to weigh. Do they want to stick with this man being supported by rightwing groups that are so desperate they would tell lies to try to hurt freedom of the press . Its just one more terrible situation. And i just hope that the people of alabama will do the right thing and not send this man to the United States senate. If they dont like the democrat, write in their own name, do whatever they want, but this man does not belong there. I can tell you as someone who was chief democrat on the Ethics Committee for many years, thats going to be a tough road for roy moore. Because they will turn over every stone and he will be expelled. Is donald trump publicly helping Vladimir Putin retaliate against western media as well as the u. S. Government . One of the questions raised after putin just signed a new law that takes kremlin power and label western media groups as Foreign Agents. Russian officials warning that outlets like Cnn International could make the list. Four hours later donald trump tweeted that Cnn International was a quote, major source of fake news and represent our nation to the world very poorly. This is pretty remarkable. This was the first time that donald trump had ever mentioned Cnn International as president or even as candidate. In business he mentioned the channel twice in 2010 to promote appearance and oped for website, new talk about Cnn International has inspired a lot of talk. Endangering journalists overseas. Focus on what is actually disturbing, a president attacking the free press, denigrating the work of reporters who go out every day across the globe, risk their lives. Trumps tweet reads like invitation to undemocratic roojims around the world to harass cnn journalists with the blessing of the u. S. President. Stunned with how attack seemed in line with the kremlins announced strategy, asking why doing it same day. Washington post reporter, should help russias plans to muzzle media outlets. And former staffer on russia and Bush Administration official was even more blunt, asking why is trump so eager to do putins dirty work . Thats the whole point. Any president can have any opinion about any media outlet but timing suggests may not be his opinion but one he adopted to help Vladimir Putin. Is there a pattern of these two leaders trying to help each other out in the open . Russia, if youre listening, i hope youre able to find the 30,000 emails that are missing. I think you will probably be rewarded mightily by our press. Joined by acting director for cia, john mclaughlin, Shelby Holliday is here as well. Is this business as usual . Scary thing ari, these things come at you so fast and furious, weekend tweet and today the pocahontas business, i fear americans may become numb to this and think its normal behavior. What is really going on, president has ab dictated his responsibility as credible spokesman for american values. Just heard it from number of people. Gives putin a talking point in a country that already has no free media, journalists are essentially sink fantic to the president. It endarjs lives of journalists overseas and sends a message to dictators around the world that president of the United States, normally representative of free media, doesnt particularly care. Do you think he did this for putin . Its impossible to say, we dont know that. But in the realm of coincidence, its the kind of thing you almost cant make up. If you put it in novel, probably wouldnt believe it or think it was too fantastical. We just dont know. They had conversations during his asian trip that have not been revealed or reported, no one can say. But certainly hands putin a talking point. Trump is relatively if not popular in russia, someone they think of as benign figure. So that it hands putin a rationale for doing what he may choose to do here. He has not yet done it, i suspect the first targets, if there are to be targets will be voice of america and radio liberty. Oddly cnn is not wellrepresented from russia. Dont have russian language broadcasts and when ive been there, its hard to find them on a hotel channel. But russian spokesmen have railed against Cnn International among other targets. So they may be on that list. Yeah. Shelby, i dont know which hotels theyre on or not there, but mr. Mclaughlin raises serious point as former cia leader, its hard to explain as coincidence, and if its not, president of the United States immediately giving in. Crying uncle would suggest resisted but not even four hours, its givening putin pr. And possible collusion between the Trump Campaign and moscow, the wikileaks tweet you played comes to mind. And set off other alarm bells. Why is the president appearing to advocate for kremlin stifling of free speech and attacking for free speech. Sanctions, friends with russia, why cant we get along. He still casts doubt on the fact that russia meddled in the election. Thinking to the 300 pound man hacking on his bed or recently russias influence at all, saying he believes putin. Big question is why. Does the kremlin have compromising material on the president so he feels obligated to do this . Does he just like putin and kremlin and feels like backing him up . Kind of things set off major alarm bells. Also hes attacking free press. Investigation is huge part of this. Ambassador to russia under trump, jon huntsman was asked about this. And said the putin plan was bad and bad for the press. Take a listen. Well, its a big concern. And it isnt reciprocal at all. We think the principles of free media in any free society and democracy are absolutely critical to our strength. Freedom of speech is part of that. Thats why i care about the issue and embassy does. Hes offscript, criticizing the putin plan that trump embraced. So also undermines a trump official. But another thing thats very strange about this, rt, a Russian Media outlet, was forced to register as Foreign Agent under a law meant to prevent propaganda. Trump is saying Cnn International is just as bad. They spread fake news. Seems to be justifying in so many words why the russian law is okay. Brings us back to top of the show with mike flynn. U. S. Version of this law is for actual propaganda and what mike flynn could have legal exposure on, foreign registration act of the trump grabbing what is out there and flipping it around. Unusual that president of the United States meet up with putin in four hours, important story over thanksgiving if you missed it. Thanks. Donald trump is trying to install his own pick to run a key obama era agency that patrols wall street. Sued today over it. Went after the senator who started the agency using slur against native americans at a reception honoring native americans who served in the military. Welcome to 2017. We have a representative in congress who was here a long time ago, call her pocahontas, but you know what, i like you. Warren responded, telling msnbc today the president cant even make it through a ceremony honoring heroes without throwing out a racial slur. This is the fight trump wants to have, but the fight that impacts americans tonight is over who runs the cfpb. One of the only agencies designed to combat wall street. Turns up being a joke. Thats what cfpb really has been in a sick sad kind of way. Do you still believe that cfpb is a sad, sick joke . Yes, sir i do. Thats trumps pick and current threat of american dictatorship resides in this bureau he says. Hyperbole. Says need a leader who believes in accountability and when warranted sending ceos to jail. Giant banks brought down our economy. We believe in tough rules, real accountability, and if a ceo breaks the law, they ought to go to jail just like anyone else. Im joined by lisa sayre vonnic. Board member of the Consumer Protection bureau. Says trump favors the coffers of mega banks. Thanks for being here. Thanks for having me. This is a weird today, two different bosses show up to work and fight over it. Donald trump wants to make it about the slurs. What is it really about . Think its really about whether the Consumer FinancialProtection Bureau gets to keep doing the good work its been doing since it was created by doddfrank act. Whether that work continues with next director or whether donald trump will basically miss mantle or kill the agency through other kinds of action as hes been promising to do since he was candidate. Look at some of the things theyve done. Elizabeth warren is speaking out, going to be on rachel tonight. 11. 9 billion in enforcement so far. Estimated 29 million americans receiving relief. But trump view, this thing doesnt work. Think it absolutely works. Numbers speak for itself. One of the things trump and some of his people say is, agency is killing off Financial Services agency when in fact the big banks last year had record earnings and profits, on track again this year to beat it. Doing fine after the financial crisis, but still millions of americans suffering from that crisis. Cfpb is the watchdog that consumers need in order to make sure the kind of things that happened in financial crisis, people sold mortgages that didnt work, designed to blow up, student loan providers who just last week city bank was charged with doing a poor job servicing student loan recipients. Those actions are what cfpb has gone after and fixed. What do you say to the argument, president is in charge, gets to pick the leader of the agency . Well the president does get to choose the leader, that person has to go through Senate Confirmation hearings, the same way that Richard Cordray did, in the meantime, the law, statutes are confusing but director appoints acting director until the president s choice is confirmed. Seems clear to me. Now in the hands of the courts, think thats probably the right thing. Lisa seven, thanks for your clarity. Youre welcome. Suspicious killing of a Police Officer roiling the city of baltimore tonight. No onduty Police Officer has been killed in baltimore in over a decade in homicide until detective was killed the day before he was scheduled to testify in a case against indicted baltimore officers. This killing done with officers gun in single shot to the head in the afternoon is drawing scrutiny and confusion. Audio suggests confusing scene. Dont know where the shots came from. We have officers on location. Everybody take cover. Very next day the officer supposed to testify in a case prosecuting other officers for stealing money and drugs as part of allegedly corrupt police task force. Rumor happened just one day before scheduled to testify before a federal grand jury against fellow officers accused of being in rogue unit. Shot with his own gun and at very close range. There is a legitimate suspect on the loose. John souter wasnt just a Police Officer shot and killed but also a federal witness against other cops. And Baltimore Police commissioner is saying theres no link here between the killing and souters planned testimony. Bpd and fbi dont possess any information that this incident, appears to be nothing more than spontaneous observation of man behaving suspiciously and spontaneous decision to investigate his conduct, as part of any conspiracy, the evidence in fact refutes that notion. Im going to speak with former prosecutor paul butler and u. S. Congresswoman dawn edwards who represented baltimore previously. Start with justin fenton, been on the story from the beginning. What happened here . Detector souter was doing a followup investigation on a homicide from last year in west baltimore, out there with a partner. A lot much of what else happened is unknown. Shot with his own gun in the head as you said. Weapon recovered from the scene. No video, no real suspect description. Authorities offered 215,000 reward and dont have any leads at the moment. This all came out right in going into the thanksgiving holiday. Why has the Baltimore Police been so slow to provide information . The Police Department said they only learned of detective souters role in the grand jury investigation the day before. Complicating things is rumors had been out in community for days of that. Thanksgiving eve they provided confirmation that this was going on. And i think its raised a lot of questions in the community. Police commissioner is trying to say they dont see any reason for a link. Primarily because he was shot with his own weapon, you know, in sort of a spontaneous they against any idea he was meeting up with somebody. But if they dont have a suspect if they dont have a suspect, they cant rule out that it wasnt spontaneous. Right. And theyve actually said many times that they cant rule a lot of things out. Thing is a medical examiners ruling of a homicide. But even there is some questions there. And theyre saying theyre not ruling anything out. Theyre also resisting urges for a federal takeover of the investigation. Some have suggested that the fbi should be taking a lead role in this. Given there was federal nexus with the problems surrounding the impending case, that would be one thing to consider. Justin fenton on the ground in baltimore, thank you. I now turn to paul butler, who is the author of chokehold policing black men clothe and Donna Edwards who as i mentioned represented baltimore. Donna, i begin with you. Does this look suspicious . Well, just for a correction, i didnt actually represent baltimore, even though maryland is a small state. My apologies. Thats all right. I think that the citizens and residents of baltimore certainly have reason to be suspicious given the circumstances. Im going to take chief davis at his word. Ive known him for many years. He actually used to represent the county that i live in. But there are a lot of questions raised here. Good thing that, you know, just a couple of months ago let me eask you this. I dont mean to interrupt. I dont know that its about taking him at his word or not. I think if this is an investigation of an unsolved killing and probably murder under the law, it seems suspect that he is already trying to rule things out when they dont have the information. He is not saying were going to go wherever the fax lead. He seems to be actively taking a view of the case that there wasnt any misconduct. Of course, this is a long side of indictments of police misconduct. I absolutely agree with you. I think that what chief davis, commissioner davis was trying to do was really to still the environment around that area. I mean, that area actually after immediately after detective suters killing was on lockdown there is a lot of suspicion in the community. Ive been reading online all of the various theories and stories. And so i understand wanting to quell the public and wait for the investigation to take them where it leads. But i have to tell you, given the history of some in the Baltimore Police department, given the history of the department, that its under a Consent Decree right now and just had a federal monitor appointed, i think there are a lot of reasons that people in baltimore need to tread very carefully and ask the questions that need to be asked to get to the bottom of this so that the community can be rest assured that there isnt just some random killer out there and find the person who murdered detective suter. Paul . Yeah, so there are some simple investigative questions that we dont know the answer to. But where was detective suters partner when this murder went down . Why does he have such a vague description of the assailant . They apparently engage with this suspect about 20 minutes before the homicide. And what happened within that 20 minutes . Most of all, ari, what is the motive . Its bizarre that the chief would exclude the fact that the next day this cop whose murdered was going to testify against other Police Officers in a Police Corruption investigation. Right, paul, lets pause on that point. Any time you have an unsolved mystery, let alone a rare onduty homicide, because as rough as baltimore is, the direct attack and shooting of officers on duty is rare, as i mentioned, once a decade. This would seem like a potential motive to at least investigate. And yet police are already ruling it out. Its almost the first thing that you would think about given that baltimore unfortunately has a long history of Police Corruption and a long history of blue wall of silence where Police Officers protect each other when theyre implicated in crimes. And so that leads, again, to having to ask, you know, is this related to his pending testimony. And congresswoman edwards is totally right that given the distrust between citizens and the police in baltimore, when police use aggressive tactics like they put this neighborhood on lockdown for almost a week, you had to show idea to get into your own house, that actually makes it harder for the police to do their jobs because folks dont trust the police. Baltimore is where the dont be a snitch movement started because of distrust. And again, that makes it harder for police to get to the bottom of serious homicides like this. Paul butler and former congresswoman Donna Edwards, my thanks to you in this important story. Well will stay on it. Thank you.
