If hes right, what questions will she be answering today . If hes right, she shouldnt be stepping into a congressional hearing room. The problem is, stephanie, hes wrong. I was amused when i read the letters yesterday, the first one from pat cipalone saying shes absolutely immune, then the response from chairman nadler saying, no, shes not, and fred bates, a highly regarded jurist here in d. C. Actually ruled on this more than 10 years ago and said there is no such thing as the doctrine of immunity. If i could, steph, there is a money line in the second page of the letter from white House Counsel cipalone and it reads as follows. It says the president has directed ms. Hicks not to answer questions before the committee relating to time of service as Senior Adviser to the president. Now, if hope hicks has incriminating information to offer about the president , that could be viewed as obstruction of justice by the president. Greg, can the president instruct hope hicks, a private citizen . Shes not his personal lawyer, and while he has not asserted executive privilege yet, if he does that, is it game over and were getting nothing . That could be the practical effect in the near term, but legally its hard to imagine how that sort of blanket assertion of executive privilege could last longterm and protect or prevent her from testifying forever. As ive been saying throughout this process, the president really cant have it both ways. He cant, in effect, be immune from criminal prosecution according to the department of justice opinion, office of Legal Counsel opinions, and at the same time thwart congress in its need for all of the facts about the Mueller Investigation, about potential obstruction of justice, but by preventing witnesses from testifying or trying to, thats exactly what hes trying to do is have it both ways. I dont think thats sustainable legally long term. Charlie, set the stage for who hope hicks is in the trump world. At least through the Mueller Report, the rnc was paying her legal bills. The fact that she works for locklan murdoch, the Fox Corporation, President Trumps closest media ally, should people really believe shes trying to distance herself from the president . It is unusual that this person is choosing to show up where other trump ally people are accepting his instructions to stay away. She was one of his closest aides back during the campaign when he had this very unusual sort of shoestring campaign. If you wanted to get a quote from trump, usually you were emailing hope, and she stayed as a close ally and aide until she left last year. Its interesting she appears in a lot of things the Mueller Report covers. I think the most interesting one and hopefully shell answer questions about it is maybe when trump was telling corwin lewandowski to send a message to Jeff Sessions that he needs to recuse himself from the Mueller Investigation and then deny russian interference. Lewandowski told mueller that he had asked hope hicks to type up President Trumps instructions to Jeff Sessions and he was going to then give it to Rick Dearborn to deliver, which he ended up not doing because he was so uncomfortable about the whole incident. Weirdly in the report it doesnt have anything from hicks saying that happened or what she remembers about that instruction typewriting that she supposedly did said. Thats a huge thing the report itself doesnt answer that she could answer if she answers questions. Based on your reporting, is there any reason to believe that hope hicks is no longer an ally of the Trump Administration . Even after she left the white house, shes been seen with the president , even traveling with him. Yeah, i dont see anything that says there is distance between them except for the fact that she showed up today, where don mcgahn didnt, for example. And so its a crack in the wall. Maybe she just thinks that she can sort of get out of this problem and move on with her life, but that does require defying the white house here, so she has done that. Its very interesting. Glen, lets tick through some of the issues the democrats want to discuss. Hush money payments, jim comeys firing, the trump tower meeting as well as the president s dealings with don mcgahn, Jeff Sessions and mike flynn. You have been on this program with me before over and over, specifically talking about intent being a very key aspect of obstruction. Is that the true value of hope hicks here, what the president s intention was . I think hope hicks is a treasure trove of evidence regarding the president s intent. But glen, cant she say, i dont know what the president intended to do unless he very clearly spelled it out . Yeah, but intent is not gleaned from looking directly into someone elses mind and telling us what they intended. Intent is inferred from conduct and statements that a person makes. So if hope hicks talks about the statements the president made when he was directing the false narrative on air force i about the trump tower meeting or venting against bob mueller or Jeff Sessions, those words prove his intent. So hope hicks and i do think this represents a loosening of the iron grip that trump has had on these witnesses trying to tell them, do not testify because when pat cipalone says she has absolute immunity and she should not set foot in that hearing room, hope hicks has defied that. Theyre going in there and theyre going to begin testifying, so i think this is something of a loosening of the grip the president has thus far had on these witnesses. Greg, do you agree with that . Just because hope hicks is walking into the building doesnt mean shell say anything. We rarely hear from hope hicks, but she did an interview with forbes just before the president took office in 2017 and i want to share what she said. On the politics of watching are two different things. So i think now being a novice is much more jarring to me than being a novice on a campaign, because there are so many people new to it, theyre also trying to figure everything out as it comes to you. Whether you know it or have experience in it or not. Fashion pr. Thats what hope hicks did before she joined the campaign. Weve heard this excuse before, were new to politics, i didnt know any better. If thats what we hear again, will that be an acceptable answer, or if she lies, what will the consequences be . Well, lying will bring potentially very serious consequences, including false statements of congress and other potential felonies that could really get her into legal jeopardy. Id like to think she wont lie if she actually answers the questions. Glen is right. By simply showing up, her lawyer, i would submit, is doing the right thing and following the right process by producing his witness in response to a valid request. But as you point out, stephanie, the real rub here is whether she will actually answer questions. I am confident that even if that doesnt happen today, if the committee has to litigate the issue, they will eventually get the testimony, but it could be it could be a while. So well have to see. But she knows a lot. She knows a lot, i think, about intent. As glen mentioned, the targets and subject investigations almost never express their intent. Its always inferred from what other witnesses have to say, what documents suggest. And so well just have to see what happens today. Charlie, why would democrats agree to allow hope hicks, a private citizen, to testify behind closed doors . Isnt their goal to get as much of the Mueller Report seen and heard by the public as possible . These hearings, having someone like hope hicks in is a perfect excuse for democrats to sit there with tv cameras and read line by line, page by page whats actually in the report. Well, thats right, and to the extent that they are wanting that televised spectacle, this is not going to give it to them. We suspect theyll put out a transcript later. I think this is a baby step situation. This is at least a witness showing up to talk to them, which is something theyve been battling for a couple months to have even happen. As glen and others have been saying, this is a crack in that stone wall, and theyre probably hoping to build on it. At the very least, we have this spectacle of her walking in the room, and well have the transcript later on to see what she said. Something is better than nothing. I guess thats what youre saying. He seemed to focus more on past grudges than a vision for the future. Reporter yeah, stephanie, i think youre exactly right. It certainly in many ways did feel a lot like the 2016 Campaign Never ended for President Trump, last night airing a lot of those familiar grievances, attacking those same familiar targets, his perceived enemies, Hillary Clinton, the media, the democrats, the establishment. One of the real challenges for the president this time around we saw last night who compared to being sort of an aging rock star, who was repeating those chants, build the wall, drain the swamp, all the familiar languages, reenergized the crowd going forward. Its true the 2020 campaign is less about persuading new voters, more about supercharging his loyal base. And there is a strong base. We saw it again last night, a capacity crowd of about 20,000 people here at the amway center, home of the orlando magic, but over the course of an hour and 15 minutes, the crowd even kind of grew a little bit tired. The seats were starting to get a little bit empty toward the end of his event. A lot of red hats out there, but the blue seats peering through as well. It was an important event for the campaign, though, in terms of its energy. They were able to fundraise. The rnc says more than 20 million was raised for donald trump in the last 24 hours. They vacuumed up a lot of that voter data, that critical data, especially as it pertains to florida voters. Also their intensity, so these are people they can engage as the election draws closer. But stephanie, youre right, exactly what struck me is what you were noting right there. The president not with a lot of new message and a lot of new material, still focusing on the same old themes. Jonathan, this wasnt red versus blue, it was us versus them. If the chants were build the wall, were the Republican Congress and the wall didnt get built. If its drain the waumpswamp, president is in charge of the swamp, and if its lock her up, Hillary Clinton doesnt have anything to do with the campaign of 2020. How is it us versus them . You can look at it as sort of a revival meeting. As peter was saying, a rallying of the base. What they were trying to do, stephanie, in a president ial election maybe half the people eligible are going to vote. They know theyre not able to persuade a whole lot of people who disagree with trump to switch sides. Theyre trying to find people who agree with him who dont vote and get them out. One of the reasons they do that, they hold these rallies, they get a lot of people to sign up for them. They supercharge these folks and try to get them to spread the word, basically create reinforcement for the base. Thats why he went to the old familiar themes, the calls you were talking about, lock her up, drain the swamp, build the wall. Almost nothing new last night except from make America Great again to keep America Great. The New York Times said this. He extended his record as president. The growing economy, the tax cuts and the deregulation, but did not offer any new policies or a cohesive agenda for a second term that might expand his political term. Hes the one who got into the white house in 2016, why expand his game . Exactly, and he won out of nowhere, nobody really expected it. He kind of wants to relive that moment, so talking about these themes going back to 2016 is why he feels like hes so invig rat invigorated. Thats what people loved to hear back then, this is what they want to hear now. He loved doing this, hell continue doing this. You saw him attack president obama last night. If biden remains the frontrunner, he will continue to talk about obama biden and how bad biden is for the economy and everything else, and this is sort of where hes going, i think. Chris, youre a democratic strategist. For all of those running who watched the president last night, its a preview of what is to expect in his campaign. How did they respond as he is painting the democrats as far left loons . Well, i mean, it tells you a couple things. One, i would say its going to be a brutal, nasty race, even more negative than the last president ial. Second thing it tells you is that the trump strategy really is about energizing the base. Its kind of like the playbook bush used in 2004. Theyve come to the conclusion they cannot expand their voting support. Thats probably true, so they have to bring out as many republicans and Trump Supporters as they can. I think the democrats strategy is not to play into the trap to make this only about trump. Obviously you have to be the foil. You have to expose, i think, the f fallacies, the failures, the hypocrisies, everything hes done, but you have to focus on the middle part of the country, and im not talking idealogically, im talking about the middle part of the country where those voters are saying, do i have to come out and vote, im tired of this political game. In a weird way, the democrats have a little bit more of a challenge because they have to walk the line of energizing their base attacking trump, but also providing a more positive, inspirational vision where trump has given up on the inspirational vision, hes just going to attack, attack, attack. Then dont democrats have to focus more on the economy, jonathan . We heard from people who say, my life is better, deregulation helps me. I didnt vote for a preacher, i just want to be sure i can take care of my family. Isnt the democrats job here to unmask that, to show how the economy hasnt worked for everyone and how his promises have not been fulfilled . Its really a tricky bind for them, stephanie. As you point out, a lot of people feel like the economy is doing well in part because the president is doing well and the numbers they see are really good and unemployment is down, Economic Growth is good, different from obamas many months of executive growth. And the economy people keep hearing is good and feel is good, but a lot of folks dont feel the economy is good, and its a much more nuanced message. Unless the democrats are focused on making that case, they wont be able to do it. There is some history behind that, though. Donald trump ran against a reasonably growing and reasonably stable and strong obama economy to become president , and in 1992, bill clinton ran against a george h. W. Bush economy that was growing out of recession and set the economy stupid, but that was the message he ran out and was able to win against the incumbent george h. W. Bush, so its not impossible. Working for some, not working for others. President trump won, pointing out how broken it was. Can democrats now do the same . I want to hear what the president said. I heard about it yesterday for the first time. I didnt know about it. I heard about it yesterday and its very unfortunate, very unfortunate. You just heard about it yesterday . We have a very good vetting process. You take a look at our cabinet and secretaries, very good, but we have a great vetting process. I want to share what Jennifer Rubin of the Washington Post writes. One, pick someone qualified. Two, dont vet him. Three, let him twist in the wind until the press has it. Four, dont impress congress. Five, withdraw and look like a bunch of clowns. Repeat. What are your sources telling you . Because weve seen this time and again, people up for the jobs, the vetting prot inting processm to work out and then theyre out, humiliated. Everyone ive spoengken to i the last couple days say this is an embarrassment. It takes away from what they were trying to do. And now we know which candidate will take center stage each night. But which issues will dominate the conversation we dont yet know. On his way to miami, nbcs vaughn hilliard. He stopped in forest city, arkansas, a town west of little rock where the trade war with china is on the top of voters minds. Vaughn, thats a surprise for most people. Why in forest city are they all talking trade war . Reporter stephanie, four cities in a town of 15,000, and most of the time when you drive across this state, youre drooif driving across Rural America. This is essentially the cotton industry in arkansas. Agriculture is a huge part of the economy here in this forest city area. But then another part of the economy here is back in johnson 7. Youll see to my right, this used to be an old san Sanyo Television plant that employed about 15,000 people. There is a textile Company Called rui that invested here just about two years ago. They plan to put in 800 jobs, take over this facility and turn it into a Textile Factory that would take arkansas cotton and turn it into yarn. But with the trade war kicking into gear a year and a half ago, suddenly that project is on hold and local leaders are waiting for this trade deal to come into fruition. How important is trade to this area . Its important. You talk about a factory looking to relocate here thats a chinese factory. Its very important and affects our particular area. These decisions matter. Were getting hit on all sides. Were losing funding on soybeans. Were losing funding on rice. Weve had a stalling industry for those reasons. For us its a big deal. For the candidates that maybe you havent heard before, what do you want to hear those candidates say on stage . I just want to hear them talk about things that affect Rural America. In Rural America we need job creation. Reporter the Median Household Income this this city is 30,000 people. When you go around, theres good people in this community. They say they need jobs, they need opportunities, and having those conversations with those local leaders and people on the ground, they say they want the trade deal wrapped up so they can have a very important industry come back here into town. Stephanie . Vaughn hillyard, thank you so much. I want to bring back my panel. Chris, vaughn was just talking about forrest city, arkansas. The trade war is major there, but you have a new polling. Whats the issue that really matters across the country . Top one for democrats is health care. Whats interesting is the top three issues were basically health care, the environment, climate change, womens rights. A lot of that i think is energizing the base. Thats where the focus is. You know, the economy and jobs, i think, is part of it, but you have to frame it the right way. I mean, its more about the inequality, its about the fact that there are tens of millions of americans that are still struggling even with the socalled booming economy and low unemployment. It actually hides the truth and reality. But those are kind of the core issues. Its really the bread and butter issues. Its the stuff that people wake up and wonder, how am i going to provide for my family if my child gets sick . Whats the world going to look like down the road if the planet keeps heating up . Those are the kind of issues that i think are defining at least democrats views. Does the trade war in a way help the president . Weve seen the numbers go up when he says, im going to meet with xi jinping. We know the trade war works for the president s base when he says hes working for the people. And thats a win for the markets. I talked to a farmer in duluth, minnesota last year at a trump rally who i think encapsulated the feelings of the trump base and a lot of farmers who said he was with the president on trade, willing to take some hits. He said he had lost tens of thousands of dollars already in the trade wars and he was going to stick with the president all the way through it. And i said, what happens if you lose your farm . He said, well, maybe then he would reconsider voting for the president. I think that the will among the president s voters in the Rural Communities is pretty strong to take some pain, as the president has suggested they should, and the president has a lot of tools. Twitter and certainly actually imposing tariffs and taking them off to try to adjust those things, and yet at the same time, i think its hard to not see the pain that has been felt by so many in this country because of these trade policies, at least in the short term. Amie, you and jonathan wrote about Hillary Clinton and why she lost. The president brought her name up seven times last night. For democrats who read your book, who watched the president , what should they take away . How should they be approaching the president . They should, a, take him seriously, because i think a lot of people last time around didnt, they just thought it was sort of a joke, and Hillary Clinton would ultimately win. But i think what youre hearing from a lot of democrats right now is they need to rally around someone pretty early. I think the biggest takeaway from last time is that everyone thought that Bernie Sanders supporters would come home for hillary and support her particular millennials, millennial women. They stayed home. They stayed home. Im seeing similar patterns happening in my reporting that im doing where the party is not unified. The one big issue is donald trump that will unify everyone, but its very much a splinter s party. Its rearing its ugly head right now. Thats why you hear joe biden saying, its not good youre attacking me, its not good were going after one another, and its going to increase, im afraid, as this campaign continues. But chris, these democrats are the ones that want to be nominated. In your recent polling you found that 77 of democrats are still undecided about how they feel about who is in the field. That being the case, this debate stage is major, and dont they kind of have to knock one another out in order to get themselves noticed . Yeah, i mean, right now its clear in all the polling, biden is clearly ahead. But its built on a very soft foundation. When youve got 77 that are likely to change their minds, it puts a lot of pressure on these debates. These candidates have got to go in there, especially when youre talking about 10 people on a stage divided by the 90 minutes or so, whatever the time frame is, youre talking about five, seven minutes at the most where you have to stand out. Think about that. And you have to talk about your ideas, communicate some policies and make a contrast. And so and, by the way, make a media moment so the media keeps replaying it after that debate. That is a real tough balancing act for these candidates. But someone is going to have to do it, someone is going to do it, and i think thats going to propel them at least for some time, but what we saw in our polling, for example, with this large a field, people are just kind of tired, meaning democr s democrats. They want the field to kind of winnow down. This field will be pretty high stakes especially for those candidates already polling kind of low. Theres really no margin of error. No margin of error and they have to get noticed. Jonathan, does it matter now that we know who is on what stage and what theyre standing . Is that a big factor . Absolutely its a big factor. The first night Elizabeth Warren is expected to have the stage to herself in terms of being the sort of big marquee candidate alone there. There is a lot of expectation for that so its a doubleedged sword. She may be able to perform well and do well. On the other hand, if anybody else does well, it shows a knock against her. On night two, there are so many decisions these folks have to make. As chris was saying, they have to get their message out there for these folks who dont know much about them. These polls were seeing show a lot of democratic voters dont know these folks that we know about, buttigieg, Kamala Harris and others, a lot of democrats dont know who they are, and at the same time they want to get traction for biden supporters. They have to decide, do they want to do introduction or do they want to do contrast . If they want contrast, do they go after biden and prove theyre better at that, or do they go after trump and prove theyre better than trump . Some exciting new developments this morning in the ongoing trade war between the United States and china. Just hours after President Trump announced on twitter he will hold an extended meeting with chinese president xi jinping at the g20 in japan next week, he said this. Were going to have a good deal and a fair deal, or were not going to have a deal at all, and thats okay, too. Joining the conversation, felix salmon and Political Correspondent and host of politicos money podcast, ben white. Ben, your reaction to what the president said. He creates drama. When he said he was having that meeting with xi jinping, the market shot up. It did, because the market wants to see a deal with china and not see tariffs on everything, all the imports from china, and then he said its okay if we dont have a deal. Hes kind of talking out both sides of his mouth here. I think he wants to tell supporters at rallies if he doesnt get this deal, dont freak out, because hes going to reassure all the offshore trading that moved from china. But wall street needs a deal. I think he wants a deal, too, because he doesnt want a giant selloff of markets before a reelection. Six months earlier he said he never wanted to see a rate cut. Why would we in a booming economy. Six hours from now, ray powell may do just that. Its unlikely but expect one this year or maybe two. The economy looks like its running out of steam and there is a lot of pressure on him to do an insurance cut. Not start a whole ratecutting cycle, but cut rates a little because the inflation isnt there and he has room to do it and it might keep the economy growing for a little bit longer. The l. A. Times has an article titled a devastating analysis of the tax cuts shows it has done virtually no economic good. The tariffs have increased prices way more than the tax cuts increased income. So consumers are worse off. But is it premature to say that . Tax cuts happened just a year ago. Youre not going to get booming growth in six months. What they promised with the tax cut was they would increase capital expenditures. The company would take the lower tax rate and faster depreciation and pour a bunch of money into new equipment, new workers and stuff that would boost the economy. That hasnt really happened yet.
