Theres no indication of the individuals involved. It also does not indicate whether any Administration Officials were aware of the scheme. But it does question whether prosecutors may review documents seized as a result of a search warrant that may have been protected by attorneyclient privilege. This Court Document shows the investigation may involve at least two individuals who and were quoting here acted as lobbyist tuesday senior white house officials without complying with the registration requirement of the lobbying disclosure act to secure a pardon or reprieve of sentence for someone whose name is redacted. The document also says the investigation involves an alleged offer by another individual to, quote, offer a substantial political contribution in exchange for a president ial pardon or reprieve of sentence. That indeed gets your attention. The white house has declined to comment on this development, but a few minutes ago trump sent out this on his own, quote, pardon investigation is fake news. The New York Times is reporting trump has apparently taken Sean Hannitys advice and has discussed with advisers whether to grant preemptive pardons for his lawyer Rudy Giuliani as well as three oldest children, don, jr. , eric, and ivanka and her husband, president ial soninlaw jared. Trump is said to be concerned his children might be targeted by the Biden Justice department. Nbc news has confirmed these discussions of pardons. There was also this development today, and what does this say about these past four years when the attorney general makes news because he told the truth . Attorney general bill barr among the most obedient of the supplicants in trumps circle actually said this to the Associated Press today and we quote. To date we have not seen fraud on a scale that could have effected a different outcome in the election. Before the election lets not forget barr was publicly echoing trumps concerns and talking points about Election Integrity particularly regarding mailin ballots. Im talking about a comprehensive rule where all the ballots are essentially mailin, and theres so many occasions for fraud there that cannot be policed. This is playing with fire. This method is very open to fraud and coercion is reckless and dangerous. My primary concerns are other things. The usual ones are fraud and coercion. Barr spent several hours at the white house today, said to have met with chief of staff mark meadows. They fell all over themselves saying it was a previously scheduled meeting. The administration has yet to react to barrs comments about the vote, but the Trump Campaigns hobbled legal team of giuliani and jenna ellis issued a statement that read in part, quote, with the greatest respect to the attorney general his opinion appears to be without any knowledge or investigation of the substantial irregularities and evidence of systemic fraud. That was right before lou dobbs went to work. For the attorney general of the United States to make that statement he is either a liar or a fool or both. He may be perhaps compromised. He may be simply unprincipled or may be personally distraught or ill. But in no way can he honestly stand up before the American People and say that the fbi has with any integrity or intensity investigated voter fraud in this country and then say it did not amount to anything. Lou dobbs, Harvard University class of 67. As if all that was not enough we also learned today that attorney general barr appointed john durham as a special counsel back in october. We are just now learning about it because barr says he didnt want to reveal the appointment until prior to the election. Durham is now said to be investigating the origins of the fbis inquiry into russian interference in the 2016 election as well as Robert Muellers work product. The appointment keeps durhams investigation technically alive into the biden late presidency. And theres this development. Nbc news has learned trump is considering launching his 2024 campaign to retake the white house on Inauguration Day while skipping bidens swearing in. Quote, regardless of the timing of a Campaign Announcement trump is not expected to attend the inauguration of president elect joe biden. He also does not plan to invite biden to the white house or even call him. Trump is quoted as having told a white House Holiday gathering tonight, quote, its been an amazing four years. We are trying to do another four years. Otherwise ill see you in four years. Then there is lets not forget the uncontrolled pandemic, which is right now killing an american every minute. Hospitalizations in our country have doubled since november 1st. Theyve tripled since october 1st. It is out of control. Today a panel of experts advising the cdc issued recommendations about who will get the first vaccines once theyre approved. Health care workers and longterm care residents would be the first to be inoculated. The same panel suggested some 40 million doses of the vaccine could be made available by the end of this month. More on that just ahead. Today the president elect formally introduced his team to help deal with the economic fall out from what weve been living through. Biden made it clear his focus will be about jobs. From the most unequal economic and job crisis in modern history we can build a new American Economy that works for all americans. My message to everybody struggling right now is this. Help is on the way. Biden and his economic advisers are pushing congress to pass a substantial relief package to help the millions of americans who are unemployed. They may be difficult to achieve in the next few weeks left before Congress Leaves Town on their next richly deserved holiday recess. Today Mitch Mcconnell who has delayed and full on prevented action for months expressed caution about rushing to pass legislation as he seemed to finally recognize there will be no second term for donald trump. I think we all know after the first of the year theres likely to be a discussion about additional some additional package of some size next year depending upon what the new administration wants to pursue. With that lets bring in our guests on this first night of december. Phil rucker, pulitzer prizewinning White House Bureau chief for the washington post. Coauthor of the long time bestseller a very stable genius. Katey, and andrew wiseman, former lead prosecutor under the russia investigation working under bob mueller. Hes these days a distinguished fellow at the nyu scule of law. His recent book is where law ends inside the Mueller Investigation which is currently a the New York Times bestseller. Good evening and welcome to you all. Phil, id like to begin on your beat at the white house. Trumps end game after january 20 is up to trump. Its much more urgent to figure out his end game for the remaining 50 days. Do you have any better read on that . Well, brian, it seems the president s end game between now and the inauguration when hes going to be forced to leave office is to try to hold onto power as best hes able. We see the legal challenges from Rudy Giuliani continue. We see the president continue to be fixated on what he believes or at least says he believes to be a stolen election. Theres no evidence of that, of course, but thats what the president s been consumed be as opposed to governing. Thats been the case day after day and continues to be the case today. We also see the president issuing a number of pardons. We saw the first of what is expected to be many issued for the former Lieutenant General michael flynn. And the reporting from this case, we dont know a lot of details. But it certainly indicates there could be some bad practices have gone on in the white house before, and well want to keep an eye on what sort of pardons the president chooses to issue between now and inauguration. Keep in mind a number of his former associates including the former Campaign ChairmanPaul Manafort are seeking pardons and of course he could preemptively try to pardon his family members as you just alluded to. Over to your beat where you cover for the New York Times. A lot of people hadnt seen the attorney general for a matter of weeks. Some just assumed he had entered witness protection. So at minimum todays interview with the Associated Press is proof of life. Why do you reckon he said what he said today, was instantly branded an attempt at reputation repair having thoroughly trashed his reputation thus far in office . I dont know that attorney general barr really cares about his reputation at this point. I do think what you saw was a really carefully a carefully set of messages on the same day related on the one hand push back on the messaging that the election was stolen. I do think there are republicans and friends of bill barr who have said to him quietly and privately why cant you put a stop to this . Youre one of the very few people who can come out and say as the chief Law Enforcement officer in the land this is wrong. But at the same time he came out with other messaging that helps him thread the needle to continue to be part of the Trump Administration and continue to be part of trumps like inner circle of people who he still trusts in the waning days of his administration by saying, one, that durham will continue to investigate the origins of the russia investigation, which donald trump is obsessed with. And two, you know, also carefully after the fact after the ap story came utreiterating hes not yet seen broad through a spokesperson. Counselor, over to you and lets begin where we began tonight and thats this story about potential pardons. I know the subject of pardons youve written about hampered your investigation, just the hint, the promise, the threat of them being dangled. What do you make of this story . And whats the way to read the federal judge in this case revealing that it exists with all the proper redactions in place . Brian, the way i read whats going on here is to first ask myself does anyone say to themselves, thats crazy, who would think that by giving lots of money to the white house or Political Campaign that the president would issue a pardon . I dont think anyone has that thought because weve lived through the last four years. And here, although, the president can tweet out this is a fake investigation it comes from his own department of justice. And the decision that was issued today or really unsealed today by chief judge howell makes it clear there are emails that are explicit that there was somebody who went to jail who has sought help from an intermediary who was a substantial donor to intercede with the white house. And you have to ask yourselves why would you give that much money to try and get a pardon if you didnt have some confidence that there would be a receptive audience somewhere in the white house . Remember, this is a president who put to the side all of the processes that democratic and republican president s have here to for used which is to have a pardon attorney and career people scrutinize carefully every pardon decision precisely so that there was equal justice being provided. And this kind of thing was not possible. So really the president here has brought this on himself by scrapping that kind of process to allow this kind of investigation into true political corruption. Phil rucker, back to your beat and coming off kateys answer. What do you think this does to barrs standing with donald trump who presumably would think nothing of further personnel changes inside of 50 days . Well, brian, you have to assume it would weaken barrs standing, but we should keep in mind barr has already in the past couple of months been in a somewhat fragile state in terms of his relationship with president trump. And thats because in the waning weeks of the campaign barr was unwilling to do some of the things trump wanted done politically, to announce certain investigations into trumps political opponents, to speed up the outcome of the durham investigation in a way that might publicize some negative material that trump could use to his advantage on the campaign trail. You know, trump very much wanted this attorney general to serve as a political instrument for his Reelection Campaign never more so than in the final two months of the run when he was behind in the polls to joe biden and looking for some game changi changing moment that could shift the momentum in the race. And barr simply did not provide it to the president. That angered the president. The president had thought about getting rid of barr. You know, at this. 50 days left im not sure hes actually going to make that kind of move although it certainly wouldnt surprise me because keep in mind shortly after the election the president chose to remove the defense secretary, mark esper, even though he was a lame duck president and knew that the new defense secretary would only have a couple of months to serve. Trump made the change nonetheless. So certainly he could remove barr, but well have to see. Katey, you remember when barr was named all of our counsel television lawyers said hes a straightforward guy, hes an institutionalist. And then when barr named durham, the connecticut based u. S. Attorney everyone said of durham hes a straightforward guy, hes an institutionalist, certainly looks the part. What do you make of barr continuing to wall off the durham investigation absent any evidence that weve seen that there is a there there . Sure. Ill start with durham first. I do think he is a respected prosecutor, he hasnt made any moves to reveal to make the sort of announcement that would have made trump happy. We know there was discontent on his team and push back. We dont know what hell actually say after january 20th as special counsel. Barr himself i think is interesting. Youre right many people did say when he say appointed he would be a straight shooter. He is that. But i think the idea he was an institutionalist sort of erased history. If you look back at an interview barr did with the Mueller Center about the bush presidency under which he served as attorney general, its very clear he felt bush did not adequately use his powers of the president , that he could have done more, he could have been more imperial president , and thats something he supports. So were in a situation barr has a president in many ways he wishes he had, he believes the country needs and he thinks is right. So in many ways hes actually able to now be the attorney general hed like to be serving the president in a way that explicitly serves his needs for no separation from the white house. Havent seen anything like this since watergate. And barr himself believes the reaction to watergate was an overreaction. And in some ways i think he feels hes restoring the Justice Department in a way he thinks it should be in a subordinate role to the president. Counselor, you get the last word. And its a serious question. Is there an innocent explanation for someone to seek preemptive pardons for family members . Would you do that if you knew you were innocent and just worried about outside forces . The answer to that is going to be no. And, you know, if you havent done anything wrong you sit there and go what do you need a preemptive pardon for . The president will say its because hes worried about all these witch hunts and bogus investigations. But just remember in order for someone to go to prison a jury of civilians needs to be convinced beyond a reasonable doubt unanimously. So this isnt a question of a Different Administration just being able to lock somebody up. So that other thing thats worth noting that im sure as im sitting here there will be those pardons. But it doesnt apply to state charges which im sure many people who get pardoned could face. And also doesnt apply to future crimes. And the reason i raise that is that the president and his family are going to have to file future federal tax returns. And thats going to pose some issues for them if they have been fudging on their taxes here heretosmz for. So this is a storey worth following if it plays out because i dont think a federal pardon will be the end of the story. The tax returns we assumed are sitting on mr. Muellers desk. The tax returns i know you expected to at least glance at as part of the investigation. Thank you so much for starting off this first day of december with us. Its hard to come into work some days knowing that youre short and knowing that youre going to see people die. I have seen more people die in the last seven days than i have talked to my own family members. Things were steady and then all of a sudden, boom, were seeing Community Members coming in they cant breathe anymore. So they come into the hospital, and it just seems to be nonstop. These reports from the trenches are just devastating. With hospitalizations hitting yet another record high just today front line workers increasingly overwhelmed making the need for a vaccine all the more crucial. Again, we say this again hospitalizations are doubled since november 1, tripled since october 1. As we mentioned, Health Care Workers will be first in line and deservedly so. As to when that will be the head of the fda offered this assurance today. And we made a promise to the American People that were not going to do shortcuts here. No one at fda is sitting on his hands or her hands. Everybodys working really hard to look at these applications and get this done. But we absolutely have to do this the right way. Dr. Stephen han interviewed by abc news. For more we welcome to the broadcast dr. Ian lip kn, a physician with expertise in outbreak response. Back in the 80s he was involved in key research during the aids epidemic. Hes these day director for the center of infection and immunity for the Columbia School of public health. Its great to have you on the broadcast. Let me begin with this. Can government, should government make a vaccine like this mandatory . Or are folks like you left to hope that enough employers make it a condition of employment . Thats a very difficult question. There is precedent for making vaccines mandatory, and i think that there are very few people for whom you could make the argument that a vaccination would be dangerous. Were doing everything that we can to make sure that vaccines that are approved have been vetted, have been tested. And there will be ongoing surveillance to ensure if theres something we havent anticipated, that we will recognize it in time. But my own personal view is that this should be mandatory. Does scarcity help in your line of work does scarcity help to increase the number of people who want it . Theres nothing like the human nature of hearing something is scarce, something is a limited edition, running out to make you go out and get it. Thats an interesting approach. And i wish it would work, but there are many people who dont have confidence in these vaccines. This is something that were wrestling with trying to find ways to persuade people that weve done everything we can. And this is one of the reasons why the fda commissioner, commissioner han has said that we are leaving no stone unturned to ensure these vaccines are as safe as they can possibly be. So i think the scarcity argument is a good one, and it may work, but there are still many people who need to be persuaded. Were having difficulty persuading everyone to wear a mask as you know. Yeah, we sure are. I know youre in medicine and not in sales, but in a weird way theyre going to merge here in a couple of weeks. And there is a reason Elvis Pressly received his shot on the Ed Sullivan Show in 1956. It was the biggest message they could come up with that this is safe, you need this vaccine. Look at elvis, hes getting it, so should you. Whats going to be the marketing equivalent, and lets call it what it is. This is going to have to be a Marketing Campaign to get enough people inoculated to have that faroff, distant goal of herd immunity we hear about all the time. I think you called it correctly. That was an extraordinary marketing event as you said, and this is something we need to do as well. Early in the course of the pandemic in the United States we released some social media at the columbia website with the former cast members of contagion talking about hand washing, physical distancing, the need for ppe. We are intending to do something similar, and ive been working with the screenwriters trying to find ways in which we can do this. Our hope is that were going to expand it far beyond people who are considered media giants, moving toward every day people, others who are heroes in their own communities clergy people, teachers, people who are bus drivers, what have you. We need to make clear to everyone that this is something to protect not only ourselves but our larger communities, our families and our loved ones. Dr. Lipkin, im imagining your days are long these days and we sure appreciate you extending your day to take our questions tonight. Thank you very much for having us in and coming on our broadcast. Anybody who thinks that this election went well like that idiot krebs who used to be the head of Cyber Security oh, the guy who was on 60 minutes last night. That guy is a class a moron. He should be drawn and quartered, taken out at dawn and shot. That voice was joe digenova, formerly reputable attorney. Earlier today that former Cyber Security chief chris krebs responded to those comments by digenova. Its certainly more dangerous language, more dangerous behavior. And the way i look at it is that were a nation of laws, and i plan to take advantage of those laws. Ive got an Exceptional Team of lawyers that win in court. And i think theyre probably going to be busy. In a Statement Today digenova claimed he was just joking. And in georgia a top election official is speaking out with genuine emotion and anger after a Voting System contractor there received death threats. It has to stop. Mr. President , you have not condemned these actions or this language. Senators, you have not condemned this language or these actions. This has to stop. We need you to step up and take a position of leadership, show some. After those remarks both senators perdue and loeffler released statements condemning violence. The Trump Campaign put out a statement on their part that reads in part, quote, no one should engage in threats or violence. And if that has happened we condemn that fully. Back tonight two of our returning veterans Jason Johnson, a campaign veteran, journalist, contributor to the greo and a professor of politics at morgan state university. Go bears. And tim miller, a contributor to the bulwark, former Communications Director for jeb bush, and a former top advisor to the antitrump pac, our principles. Gentlemen, and i mean gentlemen, welcome to you both. Tim, id like to begin with you. The name joseph nie welch comes to mind the man who stopped the mccarthy hearings saying have you no decency, sir. Sometimes the time calls for one person to step forward. Maybe its going to be that election official in georgia. But, tim, do you have genuine worries now about violence, of people tangently connected to the Trump Movement taking it out on innocent genuine Public Servants . Absolutely. I dont know why you wouldnt. It would only take, you know, one radicalized trump supporter to decide they want to take this in their own hands. And look, the digenova story came because of the bulwark i was watching, a full day of newsmax to try to understand what these trump voters are being sold. And all day every day theyre being told this election is being stolen from them, that the left is stealing the country from them, that were no longer a democracy. And so it wouldnt be surprising for one person after having to listen to that propaganda all day, every day that they might decide to take matters into their own hands. And the president s own lawyer says, you know, someone should be drawn and quartered, taken down and shot, brian, youll tell a joke every now and then. I dont understand what the joke is, i dont understand what the punch line is when youre threatening somebody for speaking truth, a Public Servant for coming out and speaking truth at risk to themselves. So i think theres a lot of reason to be concerned about genuine safety. And i think hopefully we get through the next 55 days without it. It does not excuse trump and all the enablers. Jason, you and have have had this discussion so many times. So much of this is done with ipunity a, as if no one is watching. The rule books have been thrown out the window on these rumored pardons alone. Youve heard everybody from tiger king to julain maxwell to rudy to the president s kids. And do you think a major name republican will say a peep in that instance . No, brian, and this is the chickens coming home to roost, right . This is what this administration has always been about. Its always been about fomenting violence, always been about warping the law to the personal needs and desires to the president of the United States. He will attempt to if theres one thing that we know drove donald trump in all his Supreme Court nominations is the idea down the road he would eventually not just pardon his family, not just pardon flynn, possibly manafort but he would try to pardon himself in the hopes he could have enough justices on the Supreme Court that allowed him to get away with this. I dont know why anybody is shocked. I dont know why anybody expects the republicans who sat back and allowed this to happen would be shocked. I will say this, the danger were seeing this in georgia an up until 30 days ago red state where youve got republicans in almost every single statewide office and theyre now the victims of this. Theyve now created this problem. And now getting all the trump extremists back together is like herding drunk cats. They wont say anything about it until it blows up in their faces. Tim, continuing on that theme. If the president blows through the last norm, if he doesnt invite the bidens over joe biden worked in that building for 8 years. He hardly needs a west wing tour. If he doesnt show up at the inauguration as the parting president same question will any named republicans make a peep . You know, the same five that are talking now. Mitt romney, adam cislonger, maybe youll hear from amanda cheney. It will be the first time in modern times we do not have an amicable and peaceful transition. But given the seriousness of these threats about stealing the election, the fact that none of these senators are speaking out when theyre saying there are dump trucks dumping in millions of votes, that the venezuelans are changing votes. And these are absolutely insane allegations that go to the heart of our democracy and theyre not saying anything. So why would they say anything if hes just rude to joe biden . Who knows if hell say anything if he pardons his kids as is possible as reported by the New York Times. All these have made a deal with the devil. You need to at best be silent and thats what theyre going to do. Both of these gentlemen have agreed to stay with us as we fit in a break here. Coming up, a look at his picks thus far, what they might reveal when our discussion continues. , what they might reveal when our discussion continues. No uh uh, no way come on, no no nnnnono only discover has no annual fee on any card. Save for being a new customer, for adding drivewise, and for driving safely. Whatever you drive, start driving down the cost of insurance. To the American People, this team will always be there for you and your families. To the United States senate, i hope those outstanding these outstanding nominees will receive a prompt hearing and that we will be able to work across the aisle in good faith and move forward. President elect joe bidens Economic Team already faces obstacles in the senate, lets put it that way. As the New York Times puts it, quote, in the 11 years since president elect joe biden served in the chamber partisanship has intensified and nominations once an area dominated by courtesy, comity, a presumption of accommodation have become just another brutal battlefield. Youve got that right. Still with us for round two Jason Johnson and tom miller. Remembering the adage that republicans fall in line, democrats tend to eat their young, what do you make of the biden picks thus far . You know, i think when we look at this Economic Team today you have an interesting collection. I paid a lot of attention to cecilia rous. I like people who came out of academic environments. It means theyve been interacting with the real world and theoretical approaches as opposed to whats a problem or pragmatic. I think thats a great thing. I think thats a choice thats productive. I think its going to be an interesting test what happens to nee neera tanden. None of these things has to do with qualifications but who you can actually get past. Because of the work neera has been in the past and how critically shes been of republicans throughout the Trump Administration, that is going to be a very difficult person to get through the senate. Quite frankly, if joe biden isnt willing to go to the mat for the people he nominated for these kind of positions, hes not going to be a successful president anyway. So i look forward to him putting the entire force of his mandate, his power and any surrogates out there to make sure all these selections even someone controversial like neara tanden to make sure they get confirmed or at least get to be acting in their positions. Tim, as you well know donald trump took a young woman lawyer named cat out of jones day law firm. Eight years out of law school shes now on the federal bench. It was a reach, but nothings really a reach when you have Mitch Mcconnell. No such reaches for joe biden. Are you of a mind that just about every nomination regardless of what job that biden makes because pelosis only got five dems who can leave her on a losing side of a vote. The margin in the senate is going to be razor thin for years. Its just going to leave room for moderate selections. Look, i think so. And i think even if theyre moderate Mitch Mcconnell is going to find a way to make a couple of them famous in right wing media. One old tweet out of context or one old job they had, and i think thats the fight were in for nominations. If you wouldnt want i want to do a quick rant about the neera tanden controversy. This idea that john cornyn and rob portman are signaling they cant support neera tanden because she sent some mean tweets about senators is just absolutely ridiculous and appalling. And it should not be taken with any seriousness by any members of the media. I mean, these people pretended like they didnt see the president of the United States tweets for four years, and now were to believe they had their feelings hurt by Neera Tandens tweet. All ive seen so far is some hypocritical b. S. From them. As far as im concerned shes a person that is qualified and has demonstrated that shes qualified. And i hope that joe biden backs her up and that theres a really big fight to support her and make sure that she gets through and expose these guys for the hypocrites they are. Wellput. Thank you for taking the time to say that. Thank you to both of these gentlemen for joining us this tuesday night. To Jason Johnson, tim miller, both friends of this broadcast. Thank you so much. Instead of thinking in terms of the thanksgiving holiday and then the Christmas Holiday as two separate events i think were going to be looking at 30 or more days of a period of time of precarious risk. We are rapidly going to emerge into the season of people shopping, crowding, preparing, perhaps even the ill advised office parties. That was deeply depressing. Hes often deeply depressing but he knows what hes talking about. A warning the white house by the way appears to be ignoring. Theyve decided to go out in style. Theyre reportedly planning over two dozen indoor holiday receptions this season. That would be inside the white house, which, of course, has been its own coronavirus hot spot. Dr. Deborah birx says bluntly if you traveled this thanksgiving just assume youve been exposed. That has brought a crush of people wanting to get tested. And we have a testing guide of sorts tonight from nbc news correspondent sam brock. Reporter after millions of americans jumped onto planes for the Holiday Weekend theyre now jumping into line for covid19 testing. Im pretty sure i was exposed. Reporter in illinois some 40,000 new cases since thanksgiving. In miami these women hoping to protect hundreds in their Church Community after taking a trip with family. But a lot of people wonder do i come here after ten days, five days. Cdc guidelines say get tested after three to five days of returning, stay 6 feet away from anyone, and wear a mask in your own home if youre sharing space with anyone whos vulnerable. A second test also isnt a bad idea since the virus can present eight days after exposure. Believe me even if you get tested at four days youre going to want to likely retest to make sure youre truly negative. Reporter the stakes sky high.
