Attorneys office, from prosecutors there, these undercriminal investigation there, take us how through that is separate and apart from whatever bob mueller is investigating. Investigator came across information that led them to believe that Michael Cohen had committed crimes that were unrelated to the core russia investigation. So, bob mueller, well told took that information to Rod Rosenstein, the Deputy Attorney general and presumably they had a conversation about whether the Mueller Investigation had the ba bandwidth to move forward. Attorneys office in the Southern District didnt go off with a half baked sort of a search warrant. They had the evidence in hand that they needed to tyco wen long before they went in. Heres what trumps legal team, whatever size it is, trying to figure out how they see this. Theyve long understood the special counsels investigation. A lot of time seeing what happened with the campaign that the president did while he was in office. They allowed the officials to sit down with mueller. They understood what mueller wanted to question trump about. They kept on saying, not a lot here, nothing to see here. The new york thing is very troubling to them because they dont have a sense of what its really about. What are they really looking for . What did they get . What information do they have . Why is it that the government took such an aggressive move to go and take these materials . They see this far more problematic and now its an entirely new front. The president will now need lawyers in washington to deal with mueller and ones in new york to deal with the prosecutors. They go into court today fighting to get some of these documents back, hard to believe that will happen. The president s legal issues all of a sudden much for me. A former colleague of bob mueller tried to walk me through this saying that august 2nd from Rod Rosenstein was released in an effort to justify and defend the scope of a mueller makes clear on august 2nd, bob mueller was given more latitude that the scope widened. It seems like that may have been a point when he was made aware of more wrong doing and that he could have learned a whole lot of things before this referral was made to the u. S. Attorneys office that resulted in mondays raid. Couldnt you talk to bob muellers process, bob muellers attention to detail and the way an investigation work and what they would have gleaned from and taken before they handed it off for perhaps things unrelated to russian collision. Theres a very important filing today by the prosecutors in the Southern District of new york in response to the attempts by mr. Cohens lawyers to get the information back that was seized in the warrant. Based on that filing, i think we now know for a fact that at least several months ago, because i said this investigation, therefore the referral happened several months ago, that former director muellers team found information that they believed, and this is classic bob mueller because its by the book. His referral says, if you encounter information, that may be related to a crime but not related to the subject of your investigation, that you should take it to the attorney general, in this case its the acting attorney general, Rod Rosenstein, at which point the attorney general makes a decision. Looks like in this case they found evidence suggesting a crime and they referred it over to the Southern District of new york. Again, in this filing makes clear, Southern District of new york and investigators there had then investigated it for months. In that investigation they did a search warrant that has been unphone until today for emails readied to Michael Cohen. These are historical emails. I have that. Let me put that up. Youre getting in the waves and youre lucky our views have honorary law degrees. Let me put that filing up. U. S. Attorneys obtained search warrant, covert until this point. Multiple different email kentuckys mained biko wen. The results of that review indicate cohen is performing little to no legal work. The take away being one, the president doesnt use email. Two, to your point that these matters that were just learning about now have been under scrutiny for a very long time. Thats right, my kole. That shows that theres a significant investigation is taking place that led to this search warrant and theres been a lot of talk and noise about whether or not the special counsel was conducting this and exceeding the scope of the authorization, exceeding what theyre allowed to do. This shows, no. They did exactly what they were supposed to do by the book. They found evidence of potential crime. Here it looks like the bulk of this crime in the filing, link to allegation biko wen. It has nothing to do with him being a lawyer. Thats what theyre looking for in the search warrants that they executed. It also shows that i can see why hes lawyering up. I think its going to be difficult to quince a judge that they shouldnt proceed with the normal proceedings. Its going to be listening to the the scope of the documents and audio recovered and making a call. Does this have to do with representing a client and if so, were you committing some type of crime with that client or this just has to do with committing plain and simple fraud. Let me ask you, joyce if its plain and simple stupidity that Michael Cohen reported. The two went to court to block the Justice Department from reading doesnt sound like a very good move for himself legally or politically. You know, its such a terrible idea to call someone whose just been searched for the fbi. In addition to this whole idea it could look like you are colluding and coming up with a plan to avoid prosecution. Theres also the risk at this point that cohen could perhaps have been enlisted to cooperate with the investigation and could have been taping the phone call on trump on behalf of law enforcement. Its a perilous strategy. His lawyers would have told him not to pursue it. With his usual ability to listen to his lawyers advice and follow it, he has just proceeded to a tread where most people would not go in this situation. Thats the problem, its the appearance. It leads people to raise questions like that. Why is it two subjects in an investigation are talking about it . What is it that they need to talk about . The thing about it is the lawyers can easily talk with each other. They can discussion and it can be protected by Attorney Client privilege. The president s lawyers had one of these agreements with Michael Flynn last year and it was only after flynn agreed to cooperate with the government that they pulled out of that agreement. So, for mccabe he was able to claim he is the victim of the president , mccabes lawyers tweeting on twitter, they pay sue over there over defamation. For mccabe hes able to come out as someone thats been wronged by the president and people arent looking at the fact that it was an inspected general that was appointed by obama and a civilian that signed off on this. But it does come out in the climate in which you cant remove the president s twitter commentary about mccabe. You cant remove the insults toward his wife who ran for office and lied. There are some senior Justice Department officials who will acknowledge pulling out the andy mckind piece and litigating that and resolving that before the full report on the entire clinton investigation comes out does raise questions. Thats the criticism i heard frequently when this story was breaking. It feels like a lifetime ago when we found out mccabe was getting fired. The one issue they had substantively for his firing it happened before the full report was released. Theres a lot of criticism of mccabe within the bureau. Youll hear a lot of criticism the way he handled this. Hes viewed as no angel in many corners. You cant separate his firing from the way the president talked about him before and after his firing. One question i think that comey has to be asked as hes doing this blockbuster tour this week is what does he think of mccabe. He feel mccabe needed to be fired or lied to him . Lets remember, i know its friday the 13th, but this is the only president that would pardon libby and then write a text on twitter like he just did about somebody whose accusing in a similar matter in the same day. You got to remember what libby was convicted of is what theyre really accusing in a broader sense mccabe of.
