Elements. Fruits and instrument talt of contact for which cohen is under criminal investigation. Department attorney general rob rosenstein, the point man at the Justice Department and the mueller probe, and as relearned this week, the senior Justice Department official signed off on that search warrant for cohen is telling confidantes he is prepared to be fired. He seemed fully aware he may soon lose his job and was at peace with the possibility, confident hed don his job with integrity. If rosenstein is fired that always remains a big if with this president , one of his enduring legacies will be the appointment of bob mueller. The other, the search warrant that may undermine the belly of trumps professional life. Lawyers for donald trump was in court today arguing donald trump has an acute interest in the proceedings surrounding the cohen raid. The Washington Post with a good hadnt on why that may be. Trump allies worry that the post report quotes, President Trumps attorney, Michael Cohen sometimes taped conversations at the associates. Cohen who served for a decade was known to store the conversations using digital files and replay them for colleagues according to people who have interacted with them. Another blockbuster day of news. We have with us from the Washington Post white house sbu roe chief phill rucker from the new york times. Joyce vance, and john car len, former assistant attorney general for the Justice Departments National Security division is here. Let me start with you phill rucker and that fantastic reporting you and your colleagues had about why the president is so unhinged by mondays raid of Michael Cohen and perhaps paying closer attention to Michael Cohens legal exposure and ups and downs and even his own at this hour. Yes, it was a great story by my colleagues last night and it shows Michael Cohen recorded many of the conversations he had on the phone. In his office hed play it back sometimes to colleagues. And theres heightened concern in the white house and among the president s friends and close advisers that there may be incriminating and rather damages information on those tapes ceased by the fbi in mondays raids. Joyce vance take us through what sort of trouble Michael Cohen is in. If these are the proceedings and this confirmation from the u. S. Attorneys office, from prosecutors there, these undercriminal investigation there, take us how through that is separate and apart from whatever bob mueller is investigating. Investigator came across information that led them to believe that Michael Cohen had committed crimes that were unrelated to the core russia investigation. So, bob mueller, well told took that information to Rod Rosenstein, the Deputy Attorney general and presumably they had a conversation about whether the Mueller Investigation had the ba bandwidth to move forward. Cohen has a lot of exposure, the search warrant was approved by a federal judge indicates hes under investigation for among other crimes, bank fraud, wire fraud as well as for the Campaign Finance violations. He could be looking at a lot of time if convicted. One thing thats for certain, in a case with stakes that are this high, the prosecutors and the u. S. Attorneys office in the Southern District didnt go off with a half baked sort of a search warrant. They had the evidence in hand that they needed to tyco wen long before they went in. And its a good thing that our readers follows on twitter. As he sat down he tweeted this, trump called scoop trump called Michael Cohen friday to check in. Defense lawyer always caution witness and subjects not to talk during an Ongoing Investigation because it appears that may have been conspiring. You want to fill us in on the news when you sat down . Yeah. Also not the first time trump has tried to interact with witnesses in an investigation. He tried to talk to dahm mcgan two months ago about a report we had that trump has ordered mcgan to fire mueller back over the summer. Trump went to him and said, this isnt right, whats going on here . Most deference lawyers say this is a big problem. This is not something you should do because it has an appearance. Looks like youre trying to line things up together. All we really foe about the call is that trump was sort of checking in, reassuring cohen. Cohen is said not to be doing too well under incredible amounts of stress given what happens. The raids on hi offices this week. Beyond that we really dont know but for white house officials, another troubling thing the white house is doing while he himself is dealing with two investigations. Let me read a couple a little bit more. Some raids raven broader that have been previously reported. Prosecutors said the rave was part of a month long investigation. Prosecutors also detained warrants to receive materials from cell phone, tablets, safe deposit boxes. Results of a month long investigation, cohen. Seeks evidence of crime, many have nothing to do with his work as an attorney but rather relates to his own business dealings. What sorts of things do we think that the president would be checking in on him about the fall into that category . Obviously Michael Avenatti is a household name with his client Stormy Daniels who had an alleged sexual relationship with the president. Cohen is obsessed with his body of work than Paul Manafort or Jared Kushner might have been involved in with the russians. Yeah. Heres the thing. Heres what trumps legal team, whatever size it is, trying to figure out how they see this. Theyve long understood the special counsels investigation. A lot of time seeing what happened with the campaign that the president did while he was in office. They allowed the officials to sit down with mueller. They understood what mueller wanted to question trump about. They kept on saying, not a lot here, nothing to see here. The new york thing is very troubling to them because they dont have a sense of what its really about. What are they really looking for . What did they get . What information do they have . Why is it that the government took such an aggressive move to go and take these materials . They see this far more problematic and now its an entirely new front. The president will now need lawyers in washington to deal with mueller and ones in new york to deal with the prosecutors. They go into court today fighting to get some of these documents back, hard to believe that will happen. The president s legal issues all of a sudden much for me. A former colleague of bob mueller tried to walk me through this saying that august 2nd from Rod Rosenstein was released in an effort to justify and defend the scope of a mueller makes clear on august 2nd, bob mueller was given more latitude that the scope widened. It seems like that may have been a point when he was made aware of more wrong doing and that he could have learned a whole lot of things before this referral was made to the u. S. Attorneys office that resulted in mondays raid. Couldnt you talk to bob muellers process, bob muellers attention to detail and the way an investigation work and what they would have gleaned from and taken before they handed it off for perhaps things unrelated to russian collision. Theres a very important filing today by the prosecutors in the Southern District of new york in response to the attempts by mr. Cohens lawyers to get the information back that was seized in the warrant. Based on that filing, i think we now know for a fact that at least several months ago, because i said this investigation, therefore the referral happened several months ago, that former director muellers team found information that they believed, and this is classic bob mueller because its by the book. His referral says, if you encounter information, that may be related to a crime but not related to the subject of your investigation, that you should take it to the attorney general, in this case its the acting attorney general, Rod Rosenstein, at which point the attorney general makes a decision. Looks like in this case they found evidence suggesting a crime and they referred it over to the Southern District of new york. Again, in this filing makes clear, Southern District of new york and investigators there had then investigated it for months. In that investigation they did a search warrant that has been unphone until today for emails readied to Michael Cohen. These are historical emails. I have that. Let me put that up. Youre getting in the waves and youre lucky our views have honorary law degrees. Let me put that filing up. U. S. Attorneys obtained search warrant, covert until this point. Multiple different email kentuckys mained biko wen. The results of that review indicate cohen is performing little to no legal work. The take away being one, the president doesnt use email. Two, to your point that these matters that were just learning about now have been under scrutiny for a very long time. Thats right, my kole. That shows that theres a significant investigation is taking place that led to this search warrant and theres been a lot of talk and noise about whether or not the special counsel was conducting this and exceeding the scope of the authorization, exceeding what theyre allowed to do. This shows, no. They did exactly what they were supposed to do by the book. They found evidence of potential crime. Here it looks like the bulk of this crime in the filing, link to allegation biko wen. It has nothing to do with him being a lawyer. Thats what theyre looking for in the search warrants that they executed. It also shows that i can see why hes lawyering up. I think its going to be difficult to quince a judge that they shouldnt proceed with the normal proceedings. Its going to be listening to the the scope of the documents and audio recovered and making a call. Does this have to do with representing a client and if so, were you committing some type of crime with that client or this just has to do with committing plain and simple fraud. Let me ask you, joyce if its plain and simple stupidity that Michael Cohen reported. The two went to court to block the Justice Department from reading doesnt sound like a very good move for himself legally or politically. You know, its such a terrible idea to call someone whose just been searched for the fbi. In addition to this whole idea it could look like you are colluding and coming up with a plan to avoid prosecution. Theres also the risk at this point that cohen could perhaps have been enlisted to cooperate with the investigation and could have been taping the phone call on trump on behalf of law enforcement. Its a perilous strategy. His lawyers would have told him not to pursue it. With his usual ability to listen to his lawyers advice and follow it, he has just proceeded to a tread where most people would not go in this situation. Mike, any indication of dangle to pardon in front of Michael Cohen in front of that call today . No. No. We dont know that or much about the substance of the call. Thats the problem, its the appearance. It leads people to raise questions like that. Why is it two subjects in an investigation are talking about it . What is it that they need to talk about . The thing about it is the lawyers can easily talk with each other. They can discussion and it can be protected by Attorney Client privilege. The president s lawyers had one of these agreements with Michael Flynn last year and it was only after flynn agreed to cooperate with the government that they pulled out of that agreement. That was the first sign flynn was going to cooperate. Now you have the president sort coloring outside of lines and creating a problem for himself. Phill rucker is Rod Rosenstein the departmeuty atto general right now . As far as i know, i havent looked at twitter since we started it had show, nichole. Well, you should. The rumors have been ranching all week about the fate of the Deputy Attorney general. Sarah sanders was asked about this at the briefing today this afternoon. She said look, the president has been voicing hi frustration but no Personnel Announcements tip. It is friday, these sorts of firings tend to happen on friday afternoon or evening. Theres no indication that the president s made any sort of decision at this hour. So, if the raid of Michael Cohens everything, phone, offices, home, has the president most triggered, this little black book has him second most triggered. Tell us, phill rucker how that briefing wen down at the white house today. I heard Sarah Sanders doing short of nothing of character assassination of countrys last fbi director. The president s allies, fox news and that the rnc engaged in a full scale war with these two men who served their country for decades, the same as they pardoned libby who was found to have obstructed justice. We have not seen the White House Press secretary speech with such we we rosty about one of the president s opponents. She attacked his character and conduct in office. Threw the Opposition Research book at him and said it was one of Donald Trumps great honors to be able to fire him as the fbi director in which he did in may of 2017 the white house is going to war with gjim comey, ad the president himself is going to war with jim comey. One last question, jim comey and andrew mccabe, both are witnesses in the Mueller Investigation into the possible obstruction of justice by the president. How do these attacks play into the president s state of mind . These look like the kind of care and character attacks that are in an effort of assassinating a witness before he is being cross examined on the witness stand. These are not the actions youd hear from the president of the united states. I dont believe president clinton when he had to fire his fbi for misconduct. Its hard to risk that both mccabe and comey will at some time take the witness stand against some folks who are currently part of this administration. All right. Jim comey is out with a despairing assessment of the president s conduct. Two officials tell me the most damning development for the president may be comeys retelling of trumps reaction to the news that russia meddled in the 2016 election. Also ahead, the president pardoned a former george bush employer he never met. Please stay with us. You wouldnt accept an incomplete job from any one else. Why accept it from your allergy pills . Cycling is my passion. First question was to confirm that i had no impact on the election. Then that conversation to my surprise moved into a pr conversation about how the trump team would position this and what they could say about this. No one, to my recollection asked, so whats coming next from the russians. How might we stop it. Whats the future look like . It was all, what can we say about what they did and how it effects the election that we just had. That was former fbi director james comey remembering the day he and his fellow intelligence official ps briefed president elect trump on russian interference. In his brand new book he talked about how inappropriate it was to talk been spin while there were intel people in the room. Writing, quote i should have said being then. Speaking up would have been crazy i didnt know these people and they didnt know me. And when im about to have a private session with the president elect to talk russian hookers, no, i dont think so. So, i said nothing and nobody else said anything either. The white house has already launched its response to koemys new book. This morning president tweeting quote, james comey is a liar. Everybody at washington thought he should be fired for the poor job he did. He leaked private information for which he should be prosecuted. He lied to congress under oath. Hes a slum ball. His handing off the crooked hilhill hillary case and it was my great honor to fire james comey. And just last lawyer, Sarah Huckleby sanders responded from the book from the press secretary podium. This is nothing more than a poorly executed pr opportunity biko my and enrich his own bang kentucky that heading a book that longs in the bargain bin of the fixing session instead of being remembered as a dedicated service. Like so many other colleagues of his at the fbi, comey will be forever known who broke his secret trust with the president of the united states. One of the president s greatest achievements will go down as firing director james comey. Wow. Speechless. Joyce, go. Well, one thing jumps out at me, which is the director of the fbi does not have a sacred trust with the president of the united states. Directors are appointed for ten years, they serve a cross administrations because they owe their allegiance to the rule of law and not to any particular president. Its possible jim comey may have violated Department Policy and even he should have been terminated for it but whats wrong is this insistence on personal loyalty and that concept this president has that somehow the fbi serves at his pleasure as oppose to on behalf of the more than people and in conformance with the rule of law. So, i think im the only one here in this esteemed group who may have at one point in my career been described as a disgrace. How far away from reality is that, john carolin from who comey was . Put the whole body of his life up there. I think you can say more about it but it got isolated around the hillary email investigation. Theres scrutiny that the consequences are well beyond, perhaps what he intended. But disgrace part is in hack, you know. I dont know about that. Its a strange phrase to use for this most of his life republican, director of the fbi who, if hes been known for one thing, its been causing equal agitation to both sides of the partisan debate. And in some respect, when you consider his sense ofself and special mission of the fbi to not have a leeallegiance to any party, its fitting hes irritated both. When you think about his decisions being right or wrong, it was clear when he made them he was doing so considering what would be in the best interest of the country and law enforcement. So, let me play a little bit of why they may be so mad and ask you phill to respond to this. This is comey, the headline on my paper says comey on briefing. Lets watch this. Honestly never thought these words would come out of my mouth but i dont know whether the president pieeed on processtitu. I dont know. Phill rucker. Yeah, president s trump visit to moscow 2013 for the miss america pageant. Comey writes in hi book that President Trump was fix sated on this from the very first time the with of them met at that brief meeting. Trump called him a week after that to bring it up again and le brought it up again and again, four times where trump tried to quince comey that t wasnt true and ask comey to have the fbi investigate the allegations in order to prove to the public that they one true. Comey paints a portrait of a president obsessed with this. Comey writes, this whole thing was weird enough. As i spoke i felt a strange outofbody experience as if i was watching myself speak to the president about prostitutes in russia. Before i finished trump interrupted sharply. He was eager to protest the allegations werent true. These allegations were made in the dossier which in the moment it was First Published by buzz feed and covered by other news organizations, driven the president mad. Can you tie together comeys interactions with the president , that first briefing about the dossier and the subsequent treatment of comey. Yeah, that first meeting was june 26. That was the first time trump was briefed on details, biko my one on one. There was a big group of intelligence. All of trumps National Security team was there for a broader discussion about the classified intelligence. It was just koe my and trump together who discussed this dossier. A week later was when buzz feed reported the dossier politicly and a day after that was when trump called back to comey said he was irritated. He it rated to comey this wasnt true. He talked about how painful it was for First Lady Melania Trump and asked comey to have the fbi investigate the matter in order to try to put it to rest. Mike smith talk about comey as a witness. He writes in this book he doesnt know if the president obstructed justice. He acknowledges in the book he is a witness. Talk about where bob mueller is looking at the intersection of comey and donald trump. Seems as if he know not about his firing but asking trump to fire mike flynn, owner these actions and memos that comey took about the interaction. Talk about comeys interest and if you take a look at the larger ark of trumps time in office and comey and you start to look at witnesses have told mueller, there begins to be a narrow source. Why does he ask comey for loyalty 7 days into office . Why does he follow that up on february 14, asking to end the Flynn Investigation . Is there a larger pattern here . How does sessions play in it . Then after mueller is appointed, the president pushing sessions as hard as he can to get sessions to resign. What are these instances about . Is this about the president executing his powers as chief justice or is the president trying to obstruct the investigation, stand in the way of it . Thats to call if the president could be charged that a prosecutor would have to make. Is there enough there to show a larger conspiracy. And at the center of that it would be comey, his intersections and the firing of comey. Why did the president fire comey, what was hi intentions . Did he think, look, im a new president i want a new fbi director or was he no good or something for nefarious . We will fine out hopefully. When we come back the Deputy Director of the fbi andy mccake who was fired after more than a year of consistent harassment on twitter. Thats next. Had a very minor fender bender tonight in an unreasonably narrow fast food drive thru lane. But what a powerful life lesson. And dont worry i have everything handled. I already spoke to our allstate agent, and i know that we have accident forgiveness. Which is so smart on your guys part. Like fact that theyll just. Forgive you. Four weeks without the car. Okay, yup. Good night. With accident forgiveness your rates wont go up just because of an accident. Switching to allstate is worth it. Testimony department of justice Inspector General released to congress the highly anticipated report that attorney general Jeff Sessions used to fire former fbi Deputy Director andrew mckind last month. In describing the report the Washington Post says it alleges mccabe quote, inappropriate authorized the disclosure of Sensitive Information to a reporter and misled investigations former fbi direct comey about it on occasions. On the full content of this case the termination of mr. Mccabe was unjustified and the rush to fire him was unwore think to the great traditions. The president doesnt police chief the reporting goes far enough tweeting, doj issued the mccabe report which is a total disaster. He lied, lied, lied. Mccabe was totally controlled by comey. Mccabe is comey. Lets bring in our panel joining me at the table, evan mcmiller, former cia operative. Most recently he ran for president as an independent. Alicia me minute dez. Michael and joyce are still being held hostage. Letic lets start with you evan. The president s con fleeting the russian investigation, the mueller and counsel investigate about how james comey and sessions handled themselves with the Hillary Clinton email. Wait wait, didnt he win because of the way jim comey handled the Hillary Clinton investigation . Absolutely. Clearly he isnt upset with comey and mccabe for the investigation of Hillary Clinton. If only perhaps maybe because they didnt do more against Hillary Clinton, it didnt go the way the president wanted it to go, that investigation. The president s upset with comey and mccabe because they were investigating him at the fbi. This is the issue. Hes con flating the two. Itll be a great fogger for conspiracy news and elsewhere but the two velez v no relation. Isnt it so easily undone when you have comey and mccabe disagrees in this report . Yeah, but facts never get in donald trump that is essential these two men are not in agreement. His friends said he doesnt read, its clear they didnt read the eig report. Lets talk about the substance about this. What andy mccabe did that came under scrutiny was how shape a story in the wall street journal that was bad for Hillary Clinton. What he got in trouble for was not being completely truthful about it. Was that an accurate description . Yes, yes. The interesting thing here though, mccabe clearly did something wrong. It was something that the Inspector General didnt like. The highest civilian nonpolitical person at the Justice Department signed off on his firings. What he did smartly, and the president played into his hands, was try to become like comey, cling on to comey, play the victim. The president did that exactly, comey by saying they are the same person and attacheding to. So, for mccabe he was able to claim he is the victim of the president , mccabes lawyers tweeting on twitter, they pay sue over there over defamation. For mccabe hes able to come out as someone thats been wronged by the president and people arent looking at the fact that it was an inspected general that was appointed by obama and a civilian that signed off on this. But it does come out in the climate in which you cant remove the president s twitter commentary about mccabe. You cant remove the insults toward his wife who ran for office and lied. There are some senior Justice Department officials who will acknowledge pulling out the andy mckind piece and litigating that and resolving that before the full report on the entire clinton investigation comes out does raise questions. Thats the criticism i heard frequently when this story was breaking. It feels like a lifetime ago when we found out mccabe was getting fired. The one issue they had substantively for his firing it happened before the full report was released. Theres a lot of criticism of mccabe within the bureau. Youll hear a lot of criticism the way he handled this. Hes viewed as no angel in many corners. You cant separate his firing from the way the president talked about him before and after his firing. One question i think that comey has to be asked as hes doing this blockbuster tour this week is what does he think of mccabe. He feel mccabe needed to be fired or lied to him . Thats a question i hope someone brings up with comey. Joyce, let me get your voice on this question. I dont think ill take issue with the Inspector Generals report. Someones always unhappy when the Inspector General investigates and reaches a finding. One of the things that the dodge reports accepts that they have the ability to investigate. It was hurried, it was rushed. We heard allegations from mccabes lawyers he didnt have the am of time that one would normally expect to have to review and respond to the allegations that were in the report. Then youll recall that rushed weekend where he was fired. He was racing the clock to be permitted to retire with a full pension. The president was tweeting wildly that mccabe needed to be fired and the attorney general stepped up and delivered. Hes the one who made the decision to fire mccabe on this very unusual time lune. I think its that sequence of events thats giving former doj folks like myself pause here. When it comes to the president s broader war on the rule of law, youve even got republicans out with a new ad campaign, making republicans chose to be among those in the party who are for the rule of law or against the rule of law. Donald trump has created so many divide in this country but haez never been for the rule of law. No and hes never been consistent. Lets remember, i know its friday the 13th, but this is the only president that would pardon libby and then write a text on twitter like he just did about somebody whose accusing in a similar matter in the same day. You got to remember what libby was convicted of is what theyre really accusing in a broader sense mccabe of. This president has no i mean lets be careful with that though, mccabe is not charged he wasnt charged. Libby was accused of perjury and obstruction of justice. Andy mccabe was found by an Inspector General to not yeah hes not charged. What im saying is the president s language. Oh, i got ya. His language clearly contradicts how hes taking positions on two people that have been pardoned one by an Inspector General, one by convicted in court. Im not comparing the legal side. I got you. And motherover i think the elections thats my point. He pardoned him and this guy wasnt even charged with a crime. And hes a creep i think donald trump could think of that he hasnt already used against losers and liars. Yeah. Against comey. Hes running out of profane adjectives. Hell never run out. It says he may want me to investigate to prove that it didnt happen. And then he says, he distracted me because he said if theres a 1 chance my wife thinks thats true, thats terrible. And i remember thinking, how could your wife think theres a 1 chance you were with prostitutes peeing on each other in moscow. Im a flawed human being but theres literally zero chance that my wife would think is true. So, what kind of merarriage or what kind of man where your wife thinks theres a 99 chance you didnt do that. I go. So you have jim saying he wasnt i mean. That it was about the character of a man. Exactly. Whod want another man to investigate something to prove that it wasnt something true to his wife. Right. Thats a quote from the book thats being given credit for. Its given us a rare window into the state of his marriage that he felt it was necessary to have an outside agency prove to this to his own wife. It tells you something about the way the president thinks these agencies work. And let me read one more think he writes to put this conversation in better context. Comey writes about the circle of consent, the boss in complete control. The loyalty. The us versus the world view. In service to some code of loyalty. Put the organization above morality and above truth. Right, so james comey at the time thought the president was trying to set up a system of patronage. In other words he was trying to put it as the president but this will be a violation of the independence of the judicial system, the federal judicial system but also a violation of the public trust that the president serves at the peoples pleasure. Hes accountable to the people under the rule of law. We have since sin miace seem hi violate that time and time again and continue to. Im envisionening james comey in the scenario, it will be chilling to visualize the man sitting behind the oval desk is compared to a mob boss. It wasnt amaze you . No, because whether you look at the fact, when you read the book when he talks about how other president s, president bush, president obama wants to make you comfortable, trump sits behind the throne because he wants to play that role, you got to remember, comeys the guy who investigated moscow. This is not somebody using language, he knows what mobsters act like. Hes probably, you know, thousands of tapes. So, for him to make that analogy. Prosecuted crime family. He put crime families in jail. For him to make that analogy its not somebody writing something in a book. When you have donald trump, when you have a guy wholl look at a special prosecutor, fbi director, and say, look, i want you to use the government to clear up something with my wife. I mean, only someone with that kind of mentality would even think like that, best known actually say that. Additionally one tactic that is perhaps best known for being used against organized crime institutions and mob families is raiding somebodys lawyers office. Thats something we best know for being used to go after organized crimes. Bring us back to the news of the day. Obviously we know from a filing that the president s personal attorney is under criminal investigation that that raid on monday came months after rod i was texted by a friend.
