Day 447 of the Trump Administration and we have breaking news tonight about onetime white house chief strategist steve bannon who was pushed out of the white house last summer. The Washington Post reports tonight, hes back and he has a plan to derail the Mueller Investigation and protect the president. Robert costa who joins us writes bannon is pitching a plan to west wing aides and congressional allies to cripple the federal probe into russian interference in the 2016 election. According to four people familiar with the discussions, the first step these people say would be for trump to fire Deputy Attorney general rod j. Rosen stein who oversees the work of Robert Mueller and in recent days signed off on a search warrant of trumps long time personal lawyer, Michael Cohen. Bannon is recommending they cease operation with mueller reversing the policy of trumps legal team. Also tonight, the infamous access Hollywood Tape is back in the headlines. The video that threatened to derail candidate Donald Trumps campaign is rocking the white house. The New York Times was first to report that the agents who raided trump attorney Michael Cohens residences and office were looking for any records related to that video. The Washington Post also covering that story and standing by to join us. She reports investigator who is executed the search warrant sought all his communications about a 2005 access Hollywood Tape that captured trump boasting about grabbing peoples body parts according to a person familiar with the investigation. They also sought cohens communications with trump and Campaign Surrogates about potential source of negative publicity in the lead up to the 2016 president ial election. The post reports the warrant seems to indicate that investigators are looking into whether Michael Cohen played any role in suppressing negative stories like that video. The recording was an out take from access holly woo and nbc universal. This is part of what the nation first heard on october 7, 2016, a month before the president ial election. The cohen raid was not officially part of the russia inquiry, but triggered by a referral from mueller to the u. S. Attorneys office for the Southern District of new york and signed off on by rosen stein. This morning the president sent this tweet. Much of the bad blood with russia is caused by the fake and corrupt russia investigation. Headed up by the all democrat loyalists or people that work for obama. Mueller is most conflicted of all except rosen stein who signed fisa and comey letter. No collusion so they go crazy. Heres how the white house responded when asked about the investigation. The president has been clear that he has a very deep concern about the direction that the special counsel and other investigations have taken. This investigation started off as russia collusion of which there was none. That has been very clear that nothing has come up over the last year. One track of multiple tracks urging the president to fire Rod Rosenstein, the Deputy Attorney general. Its something the president has been talking about privately in recent days, but hearing from congressional allies and friends of bannon inside and outside of the white house to make a move on the Mueller Probe by firing the deputy ag. There seems to be more and more in a report that i believe up contributed to sbilthed trump chooses impulse over strategy. This paragraph caught my attention. Its like everybody wakes up every morning and does theafrg is right in front of them speaking on the condition of anonymity. Trump tower is on fire. Oh, my god, they raided Michael Cohens office. Oh, my god, we are going to bomb syria. Whatever is there is what people respond to and there is no proactive thinking. This is troublesome in the best of times, but after the president tweeted something we will be talking about later, the fact that there might be missiles flying towards syria, this is downright worrisome. Yes. When a white house is always in react mode, lets be clear. Every white house is drinking for a fire hose at all times. National security domestic policy and trips every other day. So much going on. Working congress, trying to get your agenda through. Hot spots around the world. Here we have a president who is basically boiling over with anger at the same time about a probe that just wont go away and seems to be getting worse. The Mueller Investigation has infuriated the president , but now had has a new wrinkle in its referral, at this point a referral to the Southern District of new york to look more closely at somebody who couldnt be more close to donald trump. That is Michael Cohen. Hes as close to family as you can get. He solved lots of problems for the president. The president confided in him and now this raid is searching communications between Michael Cohen and his most important client, then candidate donald trump. Michael cohen is somebody we have seen on tv for a long time. Hes long been associated with donald trump during the campaign. But its interesting the role he played with donald trump and what the attorney for the Southern District of new york is interested in. Donny deutsch was on at 4 00 p. M. About a conversation he had at lunch today with Michael Cohen. Listen to what he said about his relationship with donald trump. Michaels words to me, hes loyal and said i would rather jump out of a building than turn on donald trump. He is fiercely that might change overtime, but he has a fierce, fierce loyalty that is almost inexplicable. He has not done anything wrong. Hes a smart enough guy to know in this world even if you havent done things wrong, he understands the fire. He understands hes in a very, very difficult position. Barbara, something thats interesting is the idea that there is executive privilege obviously between attorneyclient privilege between an attorney and their client. I heard criticism that this raid on Michael Cohens office and his residence is somehow breeching that. There is a very detailed protocall when you want to search an Attorneys Office because of the attorneyclient privilege is so well respected and so carefully guarded, but the attorneyclient privilege cant be used as a shield to hide illegal activity. You can search an Attorneys Office, but only if you go through very specific and stringent requirements. Have to get approval from warrant and probable cause and permission from a judge. You have to get a filter team, but a team of agents who first look at all of the material to identify that which is privilege and that which is not. Certainly there is lots of material in his office that is not privileged. Thats only communications between a lawyer and a client for purposes of legal advice. Anything beyond that can be shared and things within that, they will look at. If they believe it could fall under the exception, they can take it to a judge and order they should yield and be shared with the prosecution team. Robert, there is another matter and that is executive privilege. Thats a different thing all together and its what the president should assert with respect to anybody around the people and there are many people who have been interviewed by Robert Muellers team. Thats a long ball. Thats a real risk for this white house if they pursue bannons strategy. Ty is calling on him to be fired. You are seeing most legal experts that are dubious about bannons suggestion and saying there is no way to retroactively assert executive privilege and you cant take back interviews given voluntarily to the federal probe. Carol, there is another wrinkle and that is james comeys book is about to come out. If the country liked fire and fire, they will be interested in james comeys book. There is all sorts of publicity for the book and apparently its selling very well. If the president is angry this week, what happens after the comey interview and his book . It depends on what jim comey has to say. Its hard to imagine hes not going to make news, but its also hard to imagine he will throw down the gauntlet and share everything. Keep in mind he is central in some ways to two ongoing probes. One is the department of justices Inspector General and he is probing the Hillary Clinton email probe and finding a lot of things that are worrisome about the way certain matters were handled including the allegation that former Deputy DirectorAndrew Mccabe had not been totally honest about his communications with the media and then second, comby is right in the heart of this obstruction probe. I cant see the director or former director who cares so deeply about the Justice Department muddling up muellers work. Barbara, lets talk about the executive privilege, the idea of retroactively taking away this executive privilege or claiming executive privilege and sort of trying to nullify everything that Robert Mueller has from interviews with the trump circle. From a legal perspective, robert costa was saying lawyers are very dubious about the fact that this can be done. Whats your take . Its an absolute nonstarter. Once the privilege is waved, its waved forever. You cant unring a bell. Once they answered questions, you cant go back and assert the privilege and say mr. Mueller should strike that from the record. He know what is he knows and he followed up on the leads and i think thats just a nonstarter. And carol, to bring it full circle, the fact that these fbi agents who went into Michael Cohens office and residences looking for things and having to do with the acceaccess hollywo tape, whats the point they are trying to get at . What we have seen in the course of a lot of reporting and 48 hours, there have probably been 10 stories volleying back and forth between the major media organizations and different cuts of what happened in this raid. What you see is a pattern of activity that the fbi and the Southern District of new york is examining. That has to do with every effort in which cohen played a role, the president s lawyer played a roll in shutting down, silencing, tamping down, closing down anything that was bad publicity during the trump campaign. Remember as we reported the other day, the search warrant indicates that one of the things that Michael Cohen is under investigation for is Campaign Finance violations. If what he was doing during the campaign and if he was coordinating with donald trump the candidate, its very serious. If what he was doing was illegal contribution to help the campaign stifle and silence bad news. Robert costa, in the moments that the president is contemplating launching missile strikes, we hope everyone is levelheaded and calm. Whats the level of fear in the white house about this investigation that is closing in on them. There is a fear among some of the president s aides that he is isolate and has a limited legal team. He had dinner with Alan Dershowitz, the professor. He is trying to work with his lawyers, but his behavior when it comes to the russia probe remains unpredictable. They wake up and see the same tweets lashing out at the Mueller Investigation and as much as they continue to say hes not moving towards firing Rod Rosenstein, they dont rule it out and they see contained comments from Huckabee Sanders at the podium. We can assume the president was watching because he tweeted big show tonight on Shaun Hannity about 10 minutes before it started. He spent a good deal of time attacking the russia investigation and he said no collusion so they go crazy. In the story of 21 sources reports the president has been particularly livid in the wake of mondays rate raids on the hotel room of michael cullen. He contemplated a shakeup in the hopes of curbing the expanding probe by special counsel Robert Mueller whose referral led to the cohen raids. He is considering firing Rod Rosenstein who is overseeing the probe. The times reporter who covers the special counsel investigation and former rnc chair min and my friend michael steele, also an analyst. Let me start with you. We know everybody know that is the president takes his queue in many cases from things he hears on fox news. Do we have a sense of how we react to two lawyers . They give him advice to either fire Rod Rosenstein or get him recused or get rid of mueller. He wanted us to watch the show. Make sure you tune into Shaun Hannity. Maybe he had a sense of what they were going to say and he had been talking to Alan Dershowitz. He almost hired him as one of his lawyers. There is a feedback loop. He has these people going in and they give him advice and he repeats it back. Hes a much more combative approach. Rush limbaugh has a different view of this. Listen to rush. The worst thing trump could do is start firing people. Thats what he is being goaded into doing. Many of you think thats what he should do and think its the just and proper thing. This is more than just and proper right now. This is about survival. Michael, its tricky because there are republicans and democrats warning against the president firing Robert Mueller or Rod Rosenstein and they dont find themselves on the same side as rush limbaugh. What do you make of it . Rush is offering wise counsel because rush is astute enough to know its not about the act of the firing. Its not about your peak with the subjects, but what happens afterwards. Its about what it would mean to the party and what it will mean this november. Its about what it means when the democrats take over a house. You can slip in and take the senate as well that put this is presidency in jeopardy. Rush despite the wise counsel from the two lawyers is offering wise political counsel that trumps the Legal Counsel here. It is about the survival of administration that it put itself on perilous footing to begin with. This is tricky because at some point the Congressional Republicans may have to act. Also its kind of a risk reward situation. We saw this last year when the president thought it was a good idea to fire comby that they are currently investigating. You have this sense of you may top the take a step. He may want to fire somebody. Does he think thats the best way forward . What happens next . We had a litany of republican senators today making comments about why the president shouldnt touch robert muler and why he should let this continue. Lindsey graham had this to say. Mr. President , if you are watching, i think you are going to be fine unless you screw this up. Let the process play out. These warnings meant to say we will actually do something if you take action to fire Robert Mueller . They are hoping thats going to work. The leaders at the white house tonight meeting with the president , we dont know what they are talking about, but might hope they are saying dont do this. They may be. I doubt they are. There is nothing indicated and public inclination that the leadership or caucus members in the whole are prepared to actually go and press back against the president on his desire to fire Rod Rosenstein or Robert Mueller. We hope the counsel is being given to him, but i doubt it is. The reason is they are still looking to their right and left and in their districts and seeing themselves surrounded by the avid supporters for donald trump and they dont want it to blow back on them and dont want the voters to turn out this fall because they are ticked off. I go back to the point, there is a greater danger if you dont check this president s impulses that could damage the party epirepably and make the last couple of years of this administration the toughest. As we have been reporting, President Trump is ramping up attacks on Robert Mueller and Deputy Attorney general Rod Rosenstein following the raid on Michael Cohens office and residence. The president is souring on the idea of sitting down with mueller. Although he said he wanted to be questioned by mueller, his stance changed since monday and the prospect of him willingly being questioned is far less likely according to two people briefed on the matter. A professor from harvard and Alan Dershowitz told chuck todd the president should not sit down with mueller. No more than who is a subject in an investigation should voluntarily speak to the prosecutors. They are not to help you. They are there to get to you hurt yourself. He may have to because he may be subpoenaed, but if he has the choice not to talk, any subject would be advised to exercise that choice. Here to talk about this is somebody who has experience in this area. First of all you have to have a goal. Everyone has to work on that. The goal should be as it was in president clintons case, that he would be reelected to the presidency and he would fulfill his term. What does that mean . That means that the political and legal aspects have to all be consistent. And not all over the place. The first thing is the president should not comment on the investigation at all. Should not comment and criticize the special counsel skpil mr. Rosmr. And his lawyers should not unless unless there is good reason to consistent with the goal of keeping him in office. And getting him out. There is too much talking going on. They should let mueller finish his investigation and make a report and if the very worst happens that the democrats take over the house and vote the articles of impeachment, he is going to have a trial before the senate that probably will still be republican. They will be sympathetic to him. The presiding judge will be the chief justice of the United States and it looks to me like this is the kind of case on paper that it may in realtime. A lot of these witnesses have made deals so they are open for impeachment. And to the extent that you depend on materials from russia or witnesses from russia, you are just not going to get it. You bring up an interesting point. Impeachment proceedings in congress is a trial before members of congress. And the more the president talks, the more there are things on which he can be impeached. He might be in trouble for small things as opposed to big things. You are right on. This could be a complicated case to prove. If he sits down with the special counsel and makes a false statement, thats one of the easiest charges the prosecutors can bring. All they have to show is they made a representation to the fbi or the special counsel and its false. He knew it was false. Thats not too hard to prove. He should avoid the risk and there are occasions when someone who was a subject should go in. He said look, one thing troubles me. They said a, b, c and im going to drop this, you might decide to bring your client in. Absent Something Special like that, i think the president would be very foolish to sit down and be interviewed. He doesnt have any real idea of all that mr. Mueller and his team have. He should stop this attacking no matter how this isnt about feeling good. Its about winning. Hes not doing things which will bring that result home. He hasnt tweeted about you being on the is show tonight. Have you been approached to advise President Trump . The bottom line of the comments not unlike comments he made just about 10 days ago about russia is there is no coherent policy there. He contradicts himself. Maybe the Trump Administration has a coherent policy towards russia and towards syria. The president himself doesnt seem to embrace that policy. Its all over the place. I think it makes him look very weak in the eyes of the kremlin and around the world as well. Whats the end game . Whats the reason for doing so . What does success look like . I think we are in a very complex and very dangerous situation. Third question, have we called in congressional leadership, both parties, both houses and consulted . Finally, what next . The day after the strike, we will have killed a lot of russians. They are manning 400 antiaircraft systems which are extremely dangerous and we will be able to take them out. F35 stealth fighters can get in there and tomahawk missiles can get in there and this will be a bloody operation and there may entail u. S. Losses. What next the day after the strike . Ambassador mcfall s there a danger that the tinder box that is syria which has iranian and russian and american and islamist interests. Israel is involved in some way. Is it possible this could become substantially more serious than a targeted strike . Yes. In particular when they repeatedly said all options are on the table. If those options includes killing russian soldiers, putin will respond to that. We should be very clear about that. They are not going to sit back and say well, we are sorry that we a lined with this guy. They may not strike in a symmetric fashion and they may well strike at Opposition Forces in syria where we have the soldiers up to 2,000 allegedly in the country. That i think is a very serious escalation. I think they should think hard about when they target russian soldiers in syria. I dont want to get ahead of myself, but its fair for the viewers to explore the idea that is there a danger of syria becoming a proxy war . The United States doesnt like iran and what iran is up to and we are adversaries with russia and those parties are involved in syria. It is a proxy war and has been for several years now. You have a minority government dominating a sunni muslim nation. When you look at the score sheet, who is fighting on the ground, kurdish allies, 4,000 killed in action helping us kill 65,000 isis fighters. Now the turks are aiming to eliminate the kurdish state. That was a big wave year. 33 retierementirements. When you start getting numbers that high and looked at 33, you got is awfully high for the party in power in the white house. That tells you something too. We got 45 seconds. Tell me about the story in the senate. Look, weve been talking about the house as if its the ball game this year because nobody thought the senate would boo ein play. The democrats have a lot of seats. Werer talking 10 seats. If the midterm climate goes in your favor and all of those if they could do that, they would need a net gain of four seats. If you could defend those and pick up the other three, the senate could end up in play. I could listen to you all night.
