Another high Profile Defense firm declined to take on the lead counsel in this case writing a prominent chicago defense attorney said monday he declined an invitation to lead President Trumps legal Team Responding to special counsels Robert Muellers investigation. Tonight nbc news has received this statement from attorney dan webb, quote, President Trump reached out to dan webb and tom buchanan to provide legal representation. They were unable to take on the representation due to business conflicts, however, they consider the opportunity to represent the president to be the highest honor. And they wish the president the best and believe he has executive reputation in ty cobb and jay sekulow. One of the few conflicts could be that he also represents dmitri furtash. Trump is now down to two attorneys handling the russia case. The afor the mentioned jay sekulow and washington lawyer ty cobb. Yesterday joe digenova and his wife said they could not represent the president. The New York Times has reported that corallo has told investigators he was concerned that hope hicks may have been planning to obstruct justice about a meeting between a russian lawyer and don jr. During the campaign. Our colleague Nicolle Wallace offered this reporting of her own. According to four Senior Justice Department officials i spoke to over the weekend who are all familiar with the investigation is that the two clients in question, mark carollo and donald trump likely have diverging interest, two saying that corallo may be a witness against the president. The other saying we know who mark corallo was to investigate and we know why he left. That may be the conflict. Mr. Costa, you get to go first tonight. What is the status as you know it of this president and his legal team, his protests notwithstanding . The status of the legal team, lonely. You have jay sekulow trying to run the outside team with regard to the russia probe, ty cobb inside working at the white house but his influence has been fading for weeks. They keep searching for some highprofile lawyer to lead this team. We keep hearing about conflicts but theres more to the story. So many of the major law firms do not want to take the risk of being associated with President Trump. They think it too much at the moment to enter such a highly charged case. Sometimes the phrase business conflicts could just mean in their business as law firm it would not be a feather in their cap for this particular client at this time. Mimi, talk us through what nicole wwl wallace was saying there. Usually a lawyer cannot represent two clients if the clients interest are materially adverse. She used the term divergent interest. If one client could testify or has potentially damaging information against another client, the lawyer cannot represent both. Thats sort of the simple way to put it. So we dont know here exactly what corallas information is but we know that his information is about the trump tower meeting. And we know that there are questions relating to trumps actions with respect to that meeting. So one could infer, i am not saying this is exactly what hes told them because obviously we dont have that information, but the inference seems to be that corallas information about that meeting may be of the nature that it could be adverse to the president and that is why if there is such a conflict, thats the reason why this reputation couldnt happen. That boils it down to his information might be adverse to the president s. Jeremy bash, what does this tell about the mueller case if anything at all . Has Donald Trumps status moved to more important than it was a month, two months ago . I cant say that. Robert mueller could be proffering information saying i am prepared to make the following statements about what i observed inside the Trump White House, inside that air force i effort to fashion a statement to spin what happened at trump tower. If Victoria Toensing and joe digenova are working on with the special counsel, they cant import that information over to the defense of their wouldbe client donald trump. They may have information that they wouldnt be able to use in defending trump and therefore they couldnt, if you will, put their best play on the field in defense of the president. Its kind of like the parable of the blind man and the elephant. Its true some have spoken to mr. Mueller but they dont know what pieces they know what they answered when asked by the special prosecutor but they dont know where it fits in. Right. We heard that mark corallo was willing to waive his but he cant see the full picture. The people who can see the full picture are mueller, the agents, the investigators, people who know what all the different witnesses have said and how all the different pieces fit together. Corallo may not be able to see that and it may be why he was so willing to waive the conflict if that is accurate. So we cant see the president today. We know only from his schedule he had lunch with Vice President mike pence. Why can only imagine what that was like on the day after Stormy Daniels on 60 minutes. It falls on you to tell us what machinations are going on for friend and the faithful down at maralago where he was for part of the weekend. Hes been paying attention to cable news, im told by white house officials, of course watching the fallout from that interview on 60 minutes, hes looking to reshuffle his cabinet and delegated to ty cobb. But whatever happens and the conditions are still being worked out inside of the white house. This is a president who knows the midterm elections are coming, knows more confrontations with Robert Mueller are likely coming and he knows its also a tenuous moment personally as he has all these allegations made against him by ms. Stormy daniels. That bring us to another question. This presidency has not been known for its steely diligence and determination yet. Are you telling me the only real discipline hes exerting is not commenting on these women, to name one subject area that apparently has been walled out from twitter and his public utterances . Every time i talk to sources familiar with the president s thinking, they say hes angry. Hes unhappy with the spending bill in congress, hes unhappy with Media Coverage daily and hes really working with his network of friends more by phone, talking to longtime associates, including as the New York Times first reported tonight rob porter, the former press secretary, rather than working through the usual chain of command. Hes disappointed with his cabinet. He feel besieged when so many people have left. What does it do to the mueller team when a guy theyve been dealing with, dowd, suddenly out of the picture . Suddenly back in private practice. Lets meet the new guy. Does that affect these situations . I think it may because of the interview potentially of the president weve heard so much about. It does not affect their rhythm in terms of the investigation. Think its most likely to have impact in negotiations because theyve been dealing with one lawyer, i suppose, or maybe three but now theyre dealing with one because the team keeps getting whittled down. So there is a sort of chemistry and history that gets built up but, you know, its not going to affect them in terms of the investigation itself. Jeremy, bob mentioned this earlier. Maggie haberman is on the record about this report,. President trump has told some advisers he hopes mr. Porter returns to work in the white house. The number of people he is close to in the white house as dwindled. People say mr. Trump has told people he believes mr. Porters departure was botched primarily but not exclusively by his chief of staff john kelly. Jeremy, its another one of these clips that kind of normalizes abnormal, doesnt it . Yeah, porter cannot get a security clearance and he should not be able to because of his past conduct. You see the president increasingly isolated. This is the incredible shrinking president ial staff. There are fewer and fewer people around to support the president and now he has virtually no outside counsel defending him in the most Significant National security and legal investigation of our time. And dont forget it starred with his longtime bodyguard Keith Shiller who he used to just hang out with in the absence of nobody else around hip. No more. Earlier today, danielss attorney talked to Nicole Wallace about the case. We are suing him for telling a lie about my client that the affair did not happen. We are going to prove that it did happen and his denial was inaccurately. Secondly and equally if not more important, we are seeking to invalidate the agreement not because it was assigned, but on a host of other grounds. The most significant of which for our discussions and this goes hand in hand with what mr. Potter said on 60 minutes, we are saying this agreement was designed to basically further a Campaign Finance violation. Here said the 130,000 payment came from his own personal line of credit and not the campaign or the trump organization. Daniels went on to say she was threatened to keep her silence about the alleged relationship with trump. That was back in 2011. I was in a parking lot going to a fitness class with my infant daughter with the diaper bag and the seat and getting all the stuff out and a guy walked occupy me and said to me, leave trump alone, forget the story. He leaned around and looked at my daughter and said thats a beautiful little girl, it should be a shame if something happened to her mom. You took had as a threat. Absolutely. I was afraid i was going to drop her. Did you ever see the person again . No. If di did, i would know it righ away. Did you go to the police . No. Why . I was scared. He sent a cease and desist letter to the person who addressed this alleged threat. Mr. Cohen had nothing to do with any such person or incident and doesnt believe such person exists or incident ever occurred. Daniels never named cohen as the person who threatened her and michael told Nicole Wallace it was not cohen in that garage. Earlier today the white house Spokes Person addressed this alleged threat. Was the president aware of a physical threat made against ms. Daniels when she was with her daughter in 2011 . The president doesnt believe that any of the claims that ms. Daniels made last night are accurate. He doesnt believe she was threatened . No, he does not. Whats his basis for that . He doesnt believe there is nothing to corroborate her claim. The Washington Post has new reporting about the president s behind the scenes reaction to the 60 minutes interview. Privately the president has lobbed sharp attacks of daniels and her media tour calling her allegations a hoax and asking conphi can dants fidants if it s poll numbers and said she was not the type of woman he finds attractive. 22 million americans watched the interview and asked staff in the white house if they watch and what they thought of it. The president said that he personally did not think daniels appeared credible, this person added. With us to talk about it, kimberly atkins, chief White House Reporter for the boston herald. Both are msnbc contributors. Reducing this down to the essence, there is new polling out that shows roughly two thirds of americans believe the women in this case. What do you think the lead story is right now from the stormy daniely matter including the interview last night . I think the biggest thing, more than the salacious details of an alleged affair the president had more than a decade ago is the legal aspect of this. You have fresh lawsuits being filed in this case and the more Legal Litigation there is over this, the more potential peril this could pose for the president and those around him because it just presents more opportunities for him to be on the record under oath making statements or even being deposed in these case. As you recall, some of the most high profile legal cases that brought down some politicians including bill clinton, what led to his impeachment was the paula jones litigation. What brought down john edwards was that he used Campaign Money to pay sbhon he fathered a child with and that was an Illegal Campaign contribution. Things like that could lead the president to trip up. He surrounded his own advisers are worried about him testifying in the mueller case for fear he might perjury himself. Thats a lot of land mines. This is what could get him. He may not rank this as highly as the mueller investigation. I mentioned this poll, two thirds of people believe the women. How do you think congress would poll . Think congress would poll pretty close to 80 to 85 . I spent the day talking to a lot of republicans, brian. Almost every one of them said wow, she seemed really credible. Really believable. To your point about this being the thing that brings President Trump down, that may very well be. The one hurdle prosecutors will have to get over and we dont know that, Campaign Finance laws are full of holes. They are full of holes because republicans have worked to make them full of holes. One of the republican who is worked to make sure that these laws are full of holes is don mcbegan, the white house couple who during the john edwards matter argued that this was not a violation. What john edwards did was not great, he cheated on his dying wife, but nothing that the government should go after him for. That gives you an idea of what prosecutors will be going up against if they decide to go after trump on this which we dont know. Kimberly, let me ask the lawyer and the journalist in you. People dont understand. Does this dove tail with the Mueller Operation . Does it become subsumed in any way and does it become a part or a whole . It could. It could overlap here. We dont know exactly what prosecutors are working on and what Robert Mueller is looking at. In a case if the president , for example, as i said is accused of perjury in the course of this litigation, that is something that Robert Mueller could look at the same way as the perjury charge was brought up with bill clinton in the investigation with him. If it is found that say, for example, Michael Cohen, trumps attorney did violate Campaign Finance laws or possibly violate Campaign Finance laws, the special counsel could use that as leverage to get Michael Cohen to cooperate in a way or give more information than he would have before we know Michael Cohen is loyal to the president. That hasnt worked in the case of paul manafort, but its something that the mueller team could try. There is overlap here even though we dont know for sure what they are looking at at this point. I want to read you a piece of work tonight from a prekwent guest on this program. Daniels was on trumps mind this weekend in palm beach, florida where he had dinner with cohen. Trump said daniels now owns him 21 million for breaking her silence and every time she talks she oh,s hwes him a million mor. Daniels will be bringing her making american horny again said the person. Is this going to turn out to be the one area of discipline in his that will be not saying a peep or writing a peep publicly about this matter, the women . I would say looking at his track record, probably not. When has he ever been able to exercise daily discipline for an extended period of time. He found a real adversary. I was thinking about this. The two people who really got to trump who have gone toe to toe with him in the media especially were the basketball players father and michael abinatti. They understand how to use the media to drive their message and get under trumps skin doing that. Thats how they are going get to him. Thats where we have seen him break down before. Im tough on russia. See what i just did, while keeping his arms length from any bad decision with putin. That remains as 34i69 mystery as to why he is aligned with putin. Based on his hunch, he thinks trump didnt demand this and choose to fwlok from happening either. Clint, often in these, russia then responds. He wants his cabinet members to twist in the wind and feel uncomfortable about their positions and doesnt like their conduct and their decisions. When he said the president may be making changes and the president did not give his blessing to go out there and say shull kin. He was careful with his damage. Different source, not the president. Unrest is everywhere in this west wing inside of the cabinet. A little bit of cruelty like pulling the wings off flies and its instantly traceable. When you look at the last three officials we showed, all have one thing in common. At some point before they were fired or departed, the president defended them and talked about the health of their great relationship on twitter. Exactly and then proceeded to torment them. This is what he does. Trump enjoys pet torments with staff. They are not gone until they are gone, but its like being a fifth year senior. They keep on hanging on until finally its time to go. Sometimes when you think they are gone, they are not gone because they are on auto dial and just as present. Sometimes they have more influence from the outside. Trump is somebody who despite his bra zado never serfs ties. There is a big misconception. He has thin skin and flies off the handle, but he forgives and forgets relatively easily as long as you reengage. Sometimes it doesnt even take that. His Attention Span is so short, she going from one grievance to the next. Thats what you are going see here. Just to build on that, there is a fascinating dynamic when you work for President Trump. People say he makes sure you are aware you are subordinate, but when you fadeaway, you seem to be more of an equal. When you call on the phone, that dynamic is reappearing weekend after weekend. She commanded that crowd and brought them to silence for what seemed like an eternity. The silence of that moment, the power of that whole day was broken for some folks by the comments of one man. At the end of the day, if you take a bullet from an ar 15 to the head, no amount of cpr is going to save you. You are dead. The actual photo from the photo shoot on the right showed g gonzalez tearing up a target from a shooting range. Last thing before we go tonight, it was back in 1954, the chief justice of the u. S. Supreme court, earl warren thought it was very important that the court rule unanimously in what he knew would be a landmark case for all of us and for all time. Thankfully it is still taught in schools today. The ruling by a Unanimous Supreme Court found the School Segregation was unconstitutional. The case did not solve inequality in education that. Goes on today. The case did send a clear and indelible message to our still evolving country not yet a decade after the end of the Second World War in the age of fdr. The brown in brown versus board of education was linda brown. It was her father who objected to his daughter being turned away from an all white school near where they lived. So while the case took on so much importance and represented so many other plaintiff plaintiffs, she lived out her life as linda brown as brown versus board of education until her death last night in her hometown of topeka, kansas.
