Administration, and that new book on this presidency called fire and fury has apparently torched its first victim. Steve bannon is out as the head of Breitbart News. Well have the latest on that just ahead, but also out tonight, 10 hours in all of testimony from the cofounder of the Company Behind that trumprussia dossier. That testimony came from glen simpson, that man right there, who appeared before the Senate Judiciary committee back in august, and the 312page transcript of that event gives us a much more detailed look at what the Research Firm fusion gps was doing and what u. S. Authorities knew and when. Its complicated, but lets get to it. The firms work has taken center stage in this partisan battle on the hill over the russia investigation, and this glen simpson has called on the Committee Senior republicans to release his testimony. Well, today the Judiciary Committees top democrat did that for him. Senator Diane Feinstein of california released the testimony against the wishes of Committee Chair republican chuck grassley. I think people are entitled to know what was said, and the lawyers also wanted it released. I see no problem with releasing it. What were trying to do is keep some investigation going on, and i dont think it harms it at all. I mean, were looking for information, and whoever can provide it, thats useful. Feinsteins unilateral move comes just days after grassley, without the full committees backing, referred the author of this dossier, the former British Intelligence officer named Christopher Steele, to the Justice Department for a criminal investigation. Today a spokesperson for grassley issued this statement about feinsteins actions, saying, quote, it undermines the integrity of the committees oversight work and jeopardizes its ability to secure candid voluntary testimony relating to the independent recollections of future witnesses. Fusion gps hired steele, this veteran investigator, to look into Donald Trumps background during the 2016 campaign. According to the committee testimony, Christopher Steele approached the fbi in the summer of 2016 because he was extremely troubled by his findings and, quote, said he was very concerned about whether this represented a National Security threat and he said he thought we were obligated to tell someone in government, in our government, about this information. He thought from his perspective there was an issue, a security issue about whether a president ial candidate was being blackmailed. When steele finally did make contact with the fbi a few months later, it turned out he was not the first person to do so. According to this testimony again, quote, they believed chris information might be credible because they had other intelligence that indicated the same thing. And one of those pieces of intelligence was a human source from inside the trump organization. Now, two sources close to fusion gps have told nbc news that human source was actually George Papadopoulos, the Trump Campaign aide who has pleaded guilty and is cooperating with Robert Mueller. Weve also learned that by the time steele sat down with the fbi, an australian diplomat had passed to u. S. Officials details of his conversation with one George Papadopoulos about the russians and hacked democratic emails. Here is how some of the senators on the Judiciary Committee reacted to this release today of the fusion gps testimony. Im actually okay with that. I want the public to know about the dossier and how it was used by the fbi. I want the public to see some of the things ive seen about mr. Steele. The bottom line is that there is a reason that mr. Mueller exists, and looking at the fbi and the department of justice in terms of the way they behaved is not an either or. I think its unfortunate that the majority, not a minority, on the Judiciary Committee have come to an impasse at making progress. I think this is a signal of the end of my cooperation in the Senate Judiciary committee in terms of investigating the russian matter. On that note, lets turn to Michael Crowley back with us, National Senior editor and correspondent for politico. Matt miller, a justice and security analyst. And Jennifer Rogers is back with us, attorney of new york and attorney for public integrity. Welcome to you all. Michael, id like to begin with you. While this is not the pentagon papers and there is a movie starting friday about that, for those who need a refresher on the story. Why did Diane Feinstein feel she had to do this and to you . What were the major findings . Well, brian, i think Diane Feinstein did this in part as a culmination of democratic frustration with republican with what democrats feel are republican mischaracterizations and even smears of the work that fusion gps and Christopher Steele did during the campaign. Among other things late last week, and i think it was a really precipitating event. The senator recommended that Mueller Probe the fbi who wrote this dossier for potentially lying to federal officials. And i think feinstein and Many Democrats were infuriated by the way the republicans handled that, so were seeing a bipartisan breach. I think the findings, brian, there really is not a bombshell that hastens our understanding of what the russian saga is about. It doesnt reveal any new information about Donald Trumps contacts with the kremlin or moscow in particular. If people are wondering, there are some very sola cio us allegations in the dossier. It really is the portrait of glen simpson and his outlet. Especially Christopher Steele, the former British Intelligence agent, as being thorough professionals. As simpson being very open and forthcoming in my reading of the transcript, answering questions, not prevaricating, not dodging, not seeming to tell conflicting stories. The dossier portraying Christopher Steele of almost stumbling into something that seemed like a true security threat. The United States of america, where Christopher Steele and simpson felt there was an obligation to notify federal authorities in the u. S. , that in fact russia may have its hooks into donald trump in a deeply troubling way that really, for simpson out of patriotic duty, and for steele out of duty of a former official and one of americas closest allies obliged them to report this, and that completely runs counter to the republican narrative of this entire enterprise of having been essentially a democraticfunded, political smear hit job trafficking and fiction. The solacious portions of this were so gross, and the attack had been so unending, so unrelenting by the gop, Christopher Steeles name has been soiled in the Public Domain a little bit, i would argue. When you look at his behavior in this case, what do you see . You know, youre absolutely right. When you look at the way that they have portrayed Christopher Steele, its kind of as this mercenary, someone who is carrying out the bitter Hillary Clinton campaign. When you look at the portrait of him portrayed in this dossier, it is someone that is a National Security professional, formerly from the ni6, the British Intelligence agency, who started this work not with any goal in mind but to just find out what Donald Trumps business dealings in russia were. And in the course of doing interviews, he came across these findings that he alleges in his report were close russian ties or close ties between the russian government and the Trump Campaign with the intent to elect donald trump president. He was so alarmed as someone who apparently loves the United States very much, someone who believes greatly, wants to advance the National Security of the United States, that he took those findings to the fbi. And i would say that runs counter not just to the narrative republicans have painted of him, but it runs really counter to the behavior weve seen from the Trump Campaign. We know, of course, donald trump jr. Got information that the russian government wanted to help elect his father. He didnt take it to the fbi, he took a meeting. Same thing with jared kushner, same thing obviously with George Papadopoulos. You see someone here who is not an american citizen who i think was really acting to advance United StatesNational Security in a way we havent seen from the trump orbit. Jennifer, as the former fed here, what have you learned today about the extent and the depth of the investigation that we now know was going on all during the Trump Campaign . Well, its very interesting because, you know, we know that some of this information started coming out last summer. Of course, none of us heard about it until much, much later in the year. We know the fbi was really engaged in and looking at the Hillary Clinton emails, and this seems to have been on the back burner, with Christopher Steele saying to his revelations when he briefed the fbi on it, jim comey didnt even know about this stuff even though they supposedly did have an intel investigation going on about it. Its still a bit unclear what they knew, what they were doing last summer, and when they started sifting through this with purpose. But i agree that it sounds like the information steele gave to them was taken seriously. The fbi community knew of him and he was trusted. Once they started getting him going on this and shifted gears from the clinton stuff, they finally did, as we know, take it seriously in the end. Michael, as you know, grassley and feinstein are two veterans up on capitol hill. It would appear that their relationship is irretrievably broken for the purposes of this investigation. That leaves the warnerburr access at the other committee, and that leaves mueller, and in your view, does it really just leave mueller as the preeminent investigation . Brian, warner and burr have a better relationship than grassley and feinstein at this point. But really, on capitol hill, this has evolved into two separate partisan tracks. There is basically very little agreement, comedy, bipartisanship on the subject of russia. As we get closer and closer to the midterm elections in particular, this story will get increasingly politicized. The House Intelligence Committee has basically collapsed into partisan acrimony. The House Democrats want to start a probe and issue a report. Youre starting to get that sense on the intelligence side as well. Yes, i think youre right, that congress has sort of wound up in a predictable place where the two parties are in their political trenches. Its only getting worse. What happened today is only going to further inflame it. But Robert Mueller keeps on plugging along. Most of his work remains out of public view. These spats and going on television and taking shots at each other and acting unilaterally, none of that has to do with mueller. He is plugging along and we just all have to wait for the next shoe to drop from his office which could be, really, any week now, another bombshell indictment. We just dont know. Well have to wait. Matthew, its been a year since we first laid eyes on this dossier, and people were reading it individually. In a group setting, though, you could hear people audibly reacting when their eyes reached that portion. Do you think we are better served as a government, as a society, as consumers, as taxpayers that the dossier came out . Its a very difficult question. I think were obviously better served that the fbi has it in their possession and is able to investigate it and run down any of those leads. We know that theyve interviewed Christopher Steele, not just during the 2016 election, but since bob mueller has been assigned as special counsel, theyve gone back and reinterviewed Christopher Steele. So i think its important the government has been able to take it seriously, and ultimately i think well find out whether any of those leads were true when bob mueller finishes his work. Whether we as a public are better off, thats tough. For all of Donald Trumps behavior, it does put the president in a difficult position when you have allegations put out publicly. He can deny them, but its very tough to push back on Something Like this when the sources are kind of hidden, kind of blind, and i do think thats a difficult place for the president to be. But look, hes not helped himself throughout this investigation. If he had behaved the way you would think most president s to do and made a statement about what his conduct was and what his conduct wasnt instead of trying to undermine the people who commissioned this information, i think he would be in a much better place. Jennifer, im curious. Will you view the results of the Mueller Investigation as the chief among equals, the preeminent investigation . I will, but of course i have my Law Enforcement bias. I never put a lot of stock into what congress is doing, because it is so partisan, and theyre not really trained to investigate the way mueller and his team are. I always thought that internal investigation which is more likely to reach it from here. In terms of getting to the bottom of what happened, i certainly thought muellers team would do that better than any other entity. To matthew crowley, Jennifer Rodgers, thank you for being here. A mueller interview with a mueller interview with this president. Plus, as we reported, steve bannon woke up this morning the head of Breitbart News. Tonight he is out of work. And donald trump has weighed in on his good friend oprah. That and more on a tuesday night when we continue. Would you be willing to speak under oath to give your version of events . 100 . We have a situation which is very unusual. Everybody said there was no collusion. If Robert Mueller asks you to speak to his committee, are you committed to doing that . Just so you understand, theres been no collusion, theres been no crime. But we have been very open. Were going to continue to be in full cooperation with them. As youve heard, Donald Trumps white house said its totally committed to cooperating with Robert Mueller, but they have limits on behalf of their client. As reported by the Washington Post, quote, the president s attorneys are reluctant to let him sit for openended, facetoface questioning without clear parameters. The fear is that donald trump could incriminate himself within minutes. On the other hand, refusing to testify could imply guilt. There is another option. Its no better for the president , and thats getting subpoenaed by mueller to come testify in front of a grand jury without his lawyer present. As Washington Post opinion writer Jennifer Rubin put it, quote, for all of trumps boasting that hes done everything right, 100 percent, and his lawyers ludicrous assertions that a president cannot commit obstruction of justice, the prospect for trump to be interviewed under oath presents the greatest risk to his presidency yet. We talked Jennifer Rodgers to stick around and join in this conversation as well. Jill, are there any good options for donald trump . There is no good option, because i think it has been laid out quite well in your opening. If he doesnt tell the truth, hes committed perjury if hes under oath. If he takes the fifth amendment, hes committing political suicide. His past behavior is such that hes very likely to incriminate himself by being careless in his answers, and he hasnt got a choice because all the cards are stacked against him. Mueller can subpoena him. If he doesnt come in voluntarily, then hes subject to subpoena and he will have no choice but to testify. I think the law is very clear on that, that hes not above the law, he can be subpoenaed, he can be required to produce documents, he can be required to testify. Jennifer, pick up on the extent of this mine field for donald trump. Think of the public statements and utteran ces he has made about this case. Think about the fact that he wont know what flynn has told. You have to assume if youre him that flynn has told everything he knows. In terms of the conversations trump had with flynn, he should know that information is now with mueller. Theres the lester holt interview, theres all the tweets, the recent revelations that an existing draft of the letter to james comey had the revelations, the revelations he released to gann to try to get information on Hillary Clinton. They will all be understood by the prosecutors when they interview donald trump. I dont know how the details will round out, but its not a press conference to where he can deviate to another topic and ignore the people next to him. So this is one of the cases in the legal system, jennifer, where this is all balance of power on the part of mueller. He still has information that they want. He still has control if hes disciplined enough to what he has to say. He is under oath. He can try to equivocate and do language and that sort of thing. They have all this information. Theyre not dummies. Then other witnesses, too. Putting everything aside, they will have other things at their disposal that the president wont even know that they have. Stop this. This is going to be a necessary part of our investigation. Are you as surprised as it is. I think jennifer is quite right, he doesnt know what other documents and other testimony. Its not just comey, its not just flynn, its not just papadopoulos. For example, comey said he told a lot of other people contemporaneously with his efforts with trump said, drop the flynn investigation. He was upset and he called to overcome that. If he doesnt exactly what the prosecutor, the problem with the white house in the nixon mags, they didnt realize it happened a lot in water gate where. People said things thinking they could get away with it. Tho got people in trouble. Two terrific lawyers. Well have you both back. Another break for us, and coming up, you may pick one. That was President Trump today leading a rare public bipartisan meeting on Immigration Reform. As the cameras rolled, 55 minutes of it, the president and house tried to talk about daca that expires in march. Then the president went a step further. I think this sells itself. When you talk about comprehensive Immigration Reform, which is where i would like to get to eventually, if we do the right bill here, we are not very far away. If you want to take it that further step, ill take the heat, i dont care. I dont care, ill take all the heat you want to give me. Ill take the heat off both the democrats and the republicans. My whole life has been heat. Granted, its rare to witness any type of policy negotiations, and what made this display more notable is it comes amid these questions about the president s ability to lead and his ability in office in the wake of that bestseller fire and fury. The book leaned heavily on unflattering information by this man, chief strategist steve bannon. As we mentioned, he stepped down as chairman of Breitbart News today. Bannon had been expected to use his post in the midterm elections. That goal may still be alive and well, because a source close to bannon tells nbc news that it was politics or news for him and he had to choose. Anita, you look away for just one second, and bannon is out of the picture and the president is talking about a bill of love. What is going on here . Thats right, you saw a lot of conservative groups and conseratives outside the white house today really questioning what the president was talking about. The bill of love, talking about protection to dreamers, things they dont support. But yes, the president had this meeting, and he said he does want to deal in daca, and was very much showing that he wanted to get democrats involved, that he was saying that hell take the political heat and they should just make a deal. Darlene, i guess im asking what you we should think about this meeting. I know that some people inside the white house with a straight face said to some reporters, no, really. The president has always believed the shame of these meetings is the American People dont get to see the work that we do, and thats why we let cameras roll for 55 minutes. Some reporters reported that with a straight face. The other way to view it is this comes during a discussion of the book about the president s state of mind. How better to sthault than to show a guy seemingly on top of his game. How do we take what we witnessed today . I think you can look at it both ways. President trump came out of reality tv. He is his best investigator, so how better than to just talk about investigation and this freewheeling that i wonder about the release of this book last week that painted him in a very unflattering like. I think there is some truth to the fact that he is somewhat in command, mentally stable, and he can do the job. Hes showing that he can negotiate. Thats why Associated Press is under no constraints, so the question to you is, do you think it was a real meeting or the land of makebelieve on mr. Rodgers . No, for the president and the white house. This is a moment where the president demonstrated what we would know. It also turned into an axiom. Just because trump is dealing with dhaka, he gave away the store suggesting he would get daca. The great irony is this. Daca will be the one thing that truly is trumps legacy in these first 12 months. Everything else has gotten done from the tax bill to the individual mandate repeal. Those are red button. The Republican Base doesnt want, and the question is, how does the base swallow that . Well take another break. Well be right back. Who is going to pay for that wall . Mexico you Better Believe it. The white house today preferred to refer to it as a matter of border security. This was one of the more interesting moments from this televised white house meeting on immigration today. Watch this as senator Diane Feinstein, the aforementioned senator from california, wanted to get daca as a standalone, standup bill. Thats until the number 2 man in the house, mccarthy, realized the president may have agreed to do something that is not the position of his party. Here it is. What about a clean daca bill now . I have no problem. I think thats basically what dick is saying. Were going to do daca, then we can start immediately on the phase 2, which would be comprehensive. Mr. President i think a lot of people would like to see that. But i think we have to do daca first. Mr. President , you need to be clear, though. I think what senator feinstein is asking here, when we talk about just daca, we dont want to be back here two years later. You have to have security, as the secretary would tell you. I think thats what shes saying. No, no. What do you think im saying . I think youre saying daca without security. Love the effort to dacasplain things to feinstein. After saying the daca bill ought to be fueled by love, the president appeared to toughen his stance. Saying tonight, as i made very clear today, our country needs the security of the wall on the southern border which must be part of any dhaka proovl. Quote, there was nothing more President Trump could have done to clearly illustrate the de immigration debate and the maddening way he manages. Phil rucker tweeted tonight that when we looked at the white house transcript of what happened today, phil rucker, Ashley Parker in posting their piece for the Washington Post tonight, trumps line agreeing momentarily with senator feinstein on the clean daca bill. We just saw this yeah, i would like to do it is missing from the white house transcript. Just further evidence this is a white line, anita. It sure is. The democrats and the republicans have been talking about the wall, border security, whatever we want to call it, but two other aspects as well, the lottery and chain migration. You could see the president actually contradicted himself a couple times. He was contradicting what he said before, so it wasnt clear cannotly what he was saying. But youre right, in a tweet from Sarah Huckabee sanders afterwards and in her press briefing, she made it very clear that what they are saying, regardless of what the president said, is that they want an immigration deal that has three components in addition to daca, so the three things i mentioned. And they were very firm on that. He has been saying that, its just that it was a long meeting, and i think when so many people were talking to him, he either misspoke or he just wants a deal. Thats something the democrats found before, is that i heard a lot of people today, republicans say theyre worried. If he got in the room with the democrats, he would try to make a deal with them just like he did last year. So was this a good day or a bad day for immigration as a whole, especially for dreamers in this country and the people who love them and care for them. Thats part 1. Part 2 is what is going on with Lindsey Graham . I think its good for Immigration Reform having a republican president saying, we want it. What you see there is cleanup control because they dont have the votes for it. Is this donald trump dealmaking or getting enrolled . That verdict would also go in the base. Whats going on with mccarthy. He said he believes more of what donald trump stands for than what barack obama stands for. He was so vociferous and his fitness to lead, not his politics, his fitness, that to have confidence in the president , it simply isnt believable when he says it. This is a little change of topic but youve written about it this week, and that is whats coming up on friday. The president goes to walter reed for his physical. Have you been able to ascertain in your reporting, is it flowthrough to the republic . What are the breaks on how much we will learn, how little we will learn. Is there any obligation to report the results, or is that all up to the president and his press secretary . There is really no obligation. Its pretty much up to the president and the white house and his advisers to decide how much information to release to the public after he has this physical on friday. Sarah Huckabee Sanders has said that the expectation they will release pretty much the same amount of information that other president s have released after theyve had their physicals, which blood pressure, weight, cholesterol levels and some other health statistics. The president today dismissing the suggestion that he might go head to head with oprah in the 2020 president ial election. For her part, oprah gave this emotional stemwinder of a speech at the Golden Globes sunday night before a National Audience which she might have suspected would stir talk that she was running for something. This morning her best friend gayle king didnt exactly say absolutely not. I absolutely dont think that her position has changed, i dont. You know, i was up talking to her very late last night. I do think this, though, guys. I do think she is intrigued by the idea, i do think that. I also know that after years of watching the oprah show, you always have the right to change your mind. I dont think at this point she is actually considering it. Heres how politico reports the story. Quote, political operatives who know her, and those who dont, agreed. A woman as smart and savvy about the American Public and the media could not have given that speech without knowing how shed stir the president ial speculation pot. Now she gets to see how the reaction plays. And who comes calling and decide if it is something she really wants. With us is Matthew Nusbaum who happens to be coauthor of that story. I want you to tell us what youve heard for oprah running and the case against her running. Ill start with the case for her running which was surprisingly strong. I woke up in the aftermath aftermath of that speech and thought all the oprah 2020 talk was a little bit silly, but then as i reported out this story, it really did start to make sense and operatives, both democrats and republicans, said, look, she would be a very, very formidable candidate if she decided to run. And it would not be just in the wake of donald trump, anything is possible. But what people told me again both democrats and republicans was this is not someone like the rock or kanye west saying theyre thinking about running for president. Oprah is much more than just a celebrity. She came up in poverty. She built a major business, is internationally recognized and respected, has done a lot of humanitarian work. She would not fit in just the celebrity category. All she has going for her. I think the case against her running, which some of the folks i talked to brought up is why would you do that to yourself . Shes not nearly as divisive a figure as donald trump was when he started running, shes widely popular and admired. One of the best ways to tank your Approval Ratings is to run for office. I heard van jones say that we live in a world that oprah hoped to create but that oprah doesnt rule, and i think he is hoping very much she does run. Do you think a Trump White House, and we saw you there today in the briefing room, will take this talk of an oprah effort as a serious matter . I think they will take it seriously. I think we all learned the lesson in 2016 and i think the Trump White House would know it better than anyone that you have to take these sorts of things seriously. Not too many people took donald trump seriously and hes down the other end of pennsylvania avenue right now in the white house. And i candidate like her in a lot of ways is much more frightening than a generic democrat or a Bernie Sanders or elizabeth warren, who is a known quantity, who is already widely disliked by a lot of republicans, sort of a traditional republican versus democrat lineup, in a lot of ways works to trumps advantage, someone who would change the formula like oprah, thats what makes her such a scary candidate for republicans and such an attractive candidate for democrats. And theres no hiding the fact that democrats are the Wounded Party right now. They dont have control of the house, senate or white house. And as you write in the piece, democrats could use a little fairy tale. Thats right. Id say its a deeply Wounded Party. At the same time youve got a lot of democrats who would like to run for president. They see donald trump as very vulnerable in 2020. I think and my reporting indicated that Something Like that only works to oprahs advantage, the same way a crowded field worked to Donald Trumps advantage in 2016. Scott walker and marco rubio and ted cruz each had their followings but donald trump just sort of towered above everyone in terms of name recognition and could just dominate the field. I think youd see the same with oprah. Shed dominate the Media Coverage and leave the others lagging far behind. And Matthew Nussbaum found out if things didnt work out, he could make a damn fine news reporter. A political shock wave in North Carolina is topping our look at some of the breaking news were covering this evening. Panel of federal judges has ordered North Carolina to throw out its Congressional District map. They found the districts were drawn up, gerrymandered in ways that nakedly favor republicans and are designed to keep them in office. The judges told the legislators in North Carolina. They said there will not be a 2018 Congressional Election based on the old one and the judges have threatened to draw up a map of their own. But this has blown open state wide politics in the tar heel state tonight. Further south in florida, theyve been granted an exemption to the Trump Administration plan to open so many of our shorelines to offshore drilling because florida raised such a ruckus to its governor, to its two senators and congressional delegation, the interior secretary now says he wont grant oil and gas drilling leases off the florida coast because they are so dependent on tourism and made such a case. Think about the precedent that sets now for other states who are going to argue the same thing about their coastlines, from the outer banks to the jersey shore, to the hamptons, to the cape to down east maine. And the mean season continues for our friends in california. Heavy rains are now falling on the firescarred lands where the vegetation has been burned away and now 13 are confirmed dead in mudslides. After a valiant Firefighter Rescue effort today, look at this, a teenager was found and pulled out alive from the mud in a building collapse. You can watch these mudslides happen from the air.
