This is a Serious Investigation. And who might the target of that Serious Investigation be . Benghazi, the new investigation, are you satisfied with the answers and are you content with what you know what happened . Absolutely. I mean, of course there are a lot of reasons why despite all of the hearings, all of the information thats been provided some choose not to be satisfied and choose to continue to move forward, thats their choice. And i do not believe there is any reason for it to continue in this way, but they get to call the shots in the congress. Benghazi has been the subject of 12 hearings, about 50 briefings and 25,000 pages of documents. As this latest political who done it plays out, the real work of protecting americans goes ignored. But the other big gop investigation this week may have a lot more substance. House republicans vote the wednesday to hold former irs official lo is learner in contempt of congress for refusing to testify about the targeting of conservative groups applying for tax exempt status. He said he hasnt seen a vote like this since the 50s. This is unprecedented and even in that era, it failed. Im wondering where were going here. My argument was not that i dont want to hear what miss lernor had to say, i do want to hear it. Theres something more significant than that. And that is upholding the Constitutional Rights of every single american. Joining me now is democratic congresswoman jackie spierer, dealing with the lerner investigation and the House Armed Services committee. Thank you for joining us. This question of whether lois lerner is about whether she said too many when she pro claimed her innocent and then waived her fifth amendment rights by doing so. Did she . No, she did not. In fact, 30 legal experts from around the country and different persuasions and law schools opined she did not somehow ab ro gate her rights under the fifth amendment by professing her innocence. There are cases on point that have come before the courts before that have obviously come up with the same conclusion. If thats the case, would is it that house lawyers did approve that contempt charge . Thats what really kind of interesting. That didnt happen until after the actual actions by the chair. And whats supposed to happen is the chair is supposed to then force her to answer questions and when she refuses to, then she can be held in contempt. He never did that. So it is procedural in nature. But what is miss beingiing in a this. She was willing to testify if she was given one more week because her attorney had to be out of washington, d. C. And chairman issa refused to give her one more week. So there was this unwillingness to just give her some extra time and she would have testified. So this is all about the circus and the side show. And the fact that the speaker says this is not going to be that, i think is sending sub limb lally the message will be. Lets talk about the underlying issue. The house voted to urge the department of justice to appoint a special counsel to investigate the irs scandal and targeting of conservative groups in 2010. What kind of safeguards would you propose to prevent that targeting from happening again . Lets first address the issue of targeting. Progressive groups were targeted and conservative groups were targeted. But how were they targeted . They were targeted to determine whether or not they were spending 51 of their time on Political Activities and if they were, then they would not have been eligible for a 501 c4 designati designation. Ironically any of these groups could have selfcertified under the law and allowed to move forward with anywhere activities but congresswoman, in fact when lois lerner was asked whether liberal groups were targeted in the same way, she declined to answer and said theres no evidence of that. The Inspector General actually found that there were progressive groups along with conservative groups that were targeted but they were targeted for purposes of trying to evaluate whether or not they were more political than they were social well fare. It doesnt seem at the very least the preponderance of groups being targeted were tea Party Affiliated groups. Now the rationale behind that may have been innocent. And you make a good point earlier, the explosion of those 501 c4 groups is a problem, but dont you think it is an issue when the targeting of groups skews in one direction or another politically . I think the real issue here is, are these 501 c4 legitimate social welfare entities and the truth is i dont think they are. The law provides they should be exclusively for social welfare purpose and the irs in the regulations changed to world to primarily which is different from exclusively. I would like to see 501 c4s would be Educational Social welfare in nature and political arms dressed up differently. Do you think anything needs to change in terms of protections in place to prevent political targeting . The political targeting . What is the political targeting . It means the difference of having to disclose who gives you money. Thats the only difference now. If youre engaging in some kind of political communication and communication that is in fact trying to persuade voters one way or the other, dont we want to know whos providing the money for that particular position . I think the using is using key words affiliated with one party or another. As we move on to benghazi, democrats have proposed sitting out the committee entirely. Do you think thats a smart move politically . We need to understand one thing. This is select committee will not have any more power than the oversight and Government Reform Committee under daryl issa, it is being done to rev up the base and fund raise from the base and try and wound secretary of state Hillary Clinton if she decides to run for the presidency. If they want to move forward with what i believe will be a circus, i think theyve got to do a couple of things. One is theyve got to make sure that all information is shared between both sides and that depositions that are held are held together, that they are joint depositions. Theres a big reality here, i think, and that is that the Republican Party especially in congress doesnt have anything left but the politics of investigation. They cant get their act together to pass Immigration Reform, cant get their act together on the minimum wage. Obamacare strategy is falling apart. They had a hearing with a republican dominated committee with insurance executives who said people are not they are not only signing up, they are paying their premiums and insurance executives refuse to agree there would be a spike next year in premiums. So were going to have a whole year of investigations. Didnt work out too well for the republicans in 1998. Well see how it works out this time. They are certainly mobilizing for the long haul. Lets talk about the substance of the committee. Robert trayhnum, the chairman of the economy will be the only one able to issue subpoenas through the committee. Take a listen to how he characterized his role on morning joe. Would you suggest fellow members while this investigation going on they not use benghazi for Fund Raising Purposes . Yes, i will cite myself as an exam. I have never sought to raise single penny on the backs of four murdered americans. Never a single penny but take a look at this nrrc fund raising 7 40 a. M. Just yesterday asking for donations to help gowdy, we dont have the graphic but that email is incriminating stuff in light of that quote and people have been comparing how starkly the roads and actual fundraising emails differ. Does that damage the credibility of this initiative . It puts into question the credibility of what Speaker Boehner said and congressman gowdy said in question of getting to the facts and bottom of this. As congressman gowdy said, this is about four murdered americans. We owe it to their families and American People and we owe it to the Embassy Staff and to a Civilized Society to get to the bottom of this. You cant sweep this under the rug and say, thats unfortunate that happened. Thats not how it works in this country. We get to the bottom of things and hold people accountable. Number one so it doesnt happen again but secondly to hold people accountable if and whoever did this so we can go after them. This is not about politics, this is really about policy and making sure more americans are not murdered in the future. I couldnt agree more with you about the underlying goals. We saw Hillary Clinton talking about how it is about politics and wouldnt continue with the investigations. Why did Hillary Clinton allow that one strategically . I dont think shes afraid of this issue in the sense that its an issue that appeals to the base. It has already been thoroughly investigated and the Inspector General investigated it. And there have been all of these hearings held about it. Earlier today the Obama Administration announced Public Schools shouldnt ask the immigration status of the students. Do you think thats the right move . Absolutely, i dont think schools need to be intimidating parents or the students themselves. Their immigration status is irrelevant when they are in school. Take us inside your advocacy on this you met with secretary johnson and your group shared stories of those impacted, how did he react to you . The secretary was positive. The secretary was very curious to know the stories of the dreamers there. And i was very excited because there were seven leaders before the secretary saying it has been great, deferred action for childhood arrivals that gives them a work permit and temporary protection for deportation, giving dreamers a greater level of security and ability to contribute to the country in greater ways because it resources us but its not enough. Our parents every day live under the threat of deportation. We were very clear with the secretary that intentions are great but at the same time we will be judging this administration and its legacy based on their actions. So will the administration extend a program to our parents and give them temporary protection from deportations is critical. You want action. You mentioned that one action item. You proposed five things the Obama Administration should do. Walk us through those. One of things the Obama Administration can and ought to do immediately is an affirmative administrative program, so a program similar to the ones for dreamers for parents to come forward to talk about their status and to get a work permit and have that level of security. Another thing is expanding the program that currently exists for dreamers. Theres an arbitrary age cutoff date right now. Maybe they are 32 instead of 30 and no longer meet the criteria for this program and its truly arbitrary. Another thing is stop the deportation and stop deporting people who dont poes a serious violent threat to public safety. But not people who can be legalized by any type of Immigration Reform bill. Another thing we think is serious and important, for the administration to reunify the families it deported. Theres actually Statutory Authority that the president has to bring back people that theyve wrongfully separated from their families. When you talk about expanding these categories of people who shouldnt be deported, what do you say to critics who say they are muching off the american economy, taking resources that should go to mesh citizens. How do you react . I ask them to think about my mom who has been here for 15 years, a taxpayer, who has raised me to be this young leader and so if we are only thinking about dreamers because some of them go to school and graduate and go on to college, but were not thinking about the role our parents have played and the fsacrifices theyve done, m mom adds to the rich diversity of the country. Does it bother you secretary johnson also met with antiimmigration groups . I think the secretary has sted he is hearing from all sides and that i think that is fine as long as the administration understands that our demand is very clear. The president has the legal wide Legal Authority to do more than what hes doing and has hit 2 million deportations. There are serious human rights abuses that take place there, including arbitrary detention, torture, all political activity is banned. So here we have the rights to freedom of expression and freedom of assembly. Erica has a right to sing for whomever she wants. On the huge world stage. Exactly. Swazis do not have that right. There is no freedom of expression in swaziland or freedom of assembly. Do you think when we went through the long list of celebrities, presumably giving them the benefit of the doubt, 50 cent, hillary swampg, all of these people dont support torture and all these things. Do you think this comes largely from ignorance . I wouldnt go that far. I think as i was saying before, i think people like padu have the right to earn a paycheck. They have to realize that their stature, their celebrity brings along with it some responsibility. But its not ma lashs in your view, in other words . You think they just dont know the context . That would leave that up to the individual artists. What about badu, for instance . When she goes to swaziland or scheduled to go to gambia this week, since she has since backed out of, when artists go to these very closed dictatorial regimes, it offers legitimacy and gives credibility to these otherwise tarnished human rights abusers.
