People, and its unacceptable. I went through congress, i made a deal. I got almost 1. 4 billion when i wasnt supposed to get one dollar. Well, i got 1 hadnt 4 billion. Our electoral system is compromised and Climate Change threatens us all, the president says the even as his biggest hater, otherwise known as reality tons undermine his arrangement and his imagination. Well get into the border of it all in a bit. But tonight we start with the legal question, is the president abusing his power . Joining me now, sarah longwell, republican strategist, democratic strategist amara omar and president of the omara strategy group, and matt miller, former spokesman for the Obama Justice department. Matt, is it an abuse of power . You worked in the Justice Department. Before i get both of you from opposing party strategist, what is the legal question to this . Thats ultimately the question that the courts are going to decide. This is an area somewhat like the travel ban where the courts journal have given great deference in the president s ability to declare a National Emergency, but we never had a president who has abused that deference and abused the declarations the way the president is doing here. So i think the question that courts will confront is not just whether president s have this inherent power to declare emergencies, which they do, Congress Granted it to them, but when you look at the factual record and the fact the president said in his own remarks yesterday that he really didnt need to do this, he just wants to do it faster. He referenced the 2020 election in his announcement yesterday. And then you look at the actual facts about what happened at the southern border, the fact that migration has done down, you may see courts push back on his president ial power. Whats most concerning is im sure well see robust challenges and were already seeing some filing. But the president clearly thinks the Supreme Court is on his side. Its this problem we run into where wave Supreme Court where there really is no swing justice where its so far to the right, it leads to this real concern that the president can do just anything and the ultimately the Supreme Court will allow him to do it, which is what we saw in the travel ban. Sarah, youre a republican. Aside from the legal questions that are out there that matt has outlienld, what happened Republican Party that wanted limited executive power, that wanted us not to be spending all kinds of money. Hes talking about taking money from homeland security. This is about as unrepublican in the traditional sense as you could think of. I agree. This is actually hes managed to create a loselose situation for himself because when it comes to the spending bill, the base isnt happy. All you have to do is look at ana coulters twitter feed to see how unhappy there are with this compromise. For congressional republicans, hes got them boxed in where theyre going to have to make a choice. As Ronald Reagan would say, this is a time for choosing where they have to choose between the rule of law, checks and balances, the constitution, or supporting trumps border wall. If they go with supporting trumps border wall, this is not the Republican Party i know. The Republican Party in 2014 that was so upset with obama for his executive orders on immigration, you got lindsey graham, Vice President pence, ted cruz, theyre all on the record talking about how that made him a monarch, a king, this real abuse of executive power, for them to support this would be a total abdication of who we are as a party but the fact is that they have not verbally said anything, at least publicly they have not said anything. And this opens the door for a democratic president in the future to do what they would want with emergency powers, calling for Emergency Action, because if they get this through, the bar will be that low. Thats totally true. Right now weve seen about 14 of the republican senators come out and say they think this is a bad idea. I mean, they should be saying its a bad idea because they believe that this kind of executive power grab is wrong, its anticonservative, antilimited government. But if thats not enough for you, then it should be the fact that democrats could come back and use this whether its on gun control, Climate Change, any number of their priorities that they view as National Emergencies, where they could this opens a pandoras box of using National Emergencies to legisla legislate. I was in washington today spoking about Voting Rights. Democrats are saying this is outrageous. But what can they do . I mean, i think one of the things theyre thinking of doing is certainly looking into newsom had already announced that california would be filing suit on it. And i think thats going to be going up to the 9th circuit as the president is expecting. Certainly taking a strong stance on what we as party are not going to support, which has always been this wall, but there really isnt any sort of reasons for this National Emergency. Its supposed to be given for things like 9 11, pearl harbor, not drugs or immigration rising, which has gone down on the border. Its not a National Emergency. Matt, it would take what would you guess in terms of time for this to go through the courts . Were probably looking at a year and a half. So he would almost be in the midst of reelection if he runs. Thats right. One of the questions is in the interim to courts allow him to pursue it, even if theres a lawsuit that says he doesnt have the power, theres a stay grant that prevent him from proceeding with construction or is he allowed to proceed with construction while its litigated in the courts. You would think he would be blocked by some court. There will be multiple lawsuits, and i would expect at least one of the districts i mean, youre talking about emergency wall that theyre coming to get us, theyre coming over the border in droves. And none of this is going to even be decided for a year and a half. So the emergency is hurry up and wait if there was an emergency at all. But let me go back to you on this, sarah. One of the things that was disturbing to me, aside from the misuse of his executive power, in my opinion, that she seemed all over the place. I mean, ive ban public speaker all of my life. I watched his speech and im like, where is this going . Let me show you something. I never did politics before. Now i do politics. I use many stats. I use many stats. Let me tell you, you have stats that are far worse than the ones i use. I use many stats i want to wish our new attorney general great luck and speed and enjoy your life. Rush limbaugh, i think hes a great guy. He can speak for three hours without a phone call. Try doing that sometime. Ann coulter, i dont know her. I hardly know her. I havent spoken to her in way over a year. I like her. But shes off the reservation. Youre cnn, youre fake news. You have an agenda. This administration does a tremendous job and we dont get credit for it. He had rocket ships and he had missiles flying over japan. And they had alarms going off. You know that. Now all of a sudden they feel good. They feel safe. I did that. My button is bigger than yours and my button works, remember that . And people said trump is crazy i mean those are some of the real gems that he dropped the other day. Hes like, all over the place. I have to ask you, are republicans thinking of giving him a primary . I mean, dont some republicans say that his of any kind moving in areas that republicans dont usually agree, deficits going up, up, up, as well as the abuse of executive power in the judgment of many, as well as all these investigations, many of his closest people have been indicted, some pleading guilty, convicted, and then hes erratic. There is no messaging. Hes like from ann coulter to Rush Limbaugh to stats to fake news all in one speech, in one press conference. Is anybody going to challenge him in the Republican Party . Im not sure whose idea it was to let him do that without a telepromter, but its a relatively important speech talking about National Emergency. But yes. Yesterday we lost in all the news around this was that governor bill weld announced an explore Story Committee to challenge the president in a republican primary. What was also in the news was john kasichs aides came out and said they too were strongly considering a republican primary. Former governor of ohio. Thats right. And now weve also seen governor larry hogan of maryland who won in a blue state by 13 points, has also put himself out there a little bit. And so, yes, i think that after the shutdown and after hes been bested by nancy pelosi and seen his numbers drop even with some of the white workingclass voters, even if they cant win, they can lay down a predicate for the future of the party. When Ronald Reagan challenged ford, he didnt win but he laid the groundwork for a future Republican Party and a future reagan revolution and i hope somebody does that in this case because otherwise trump may not last. You as a republican hope he does have a republican challenger in the primary . Absolutely. Im 38 years old. A future responsible Republican Party that i can support and be enthusiastic about. I could be very enthusiastic about Governor Hogan or about john kasich or bill weld, but im not enthusiastic about donald trump. Democrats, theyre all over the place today that has announced. We are told that there are a few more announcements. Its a crowded field. Yeah. The tension is whos the most progressive, whos the most moderate in the lineup. You can win the primaries as progressive, but can you win the general election . How does the democrats figure this out where they have one that supports where the party is and is, according to most analyses, has moved left of center, but may not be viable for a general election . I think the good news is that donald trump is a great sort of uniter of a lot of folks in the party. And so i think what people are looking at one, someone who can speak to a base that is largely africanamericans, younger white liberals, the new american majority, right . Women. Yeah, women. Who can do that, bring that coalition in, but can also speak to sort of uniting america. Kamala harris and cory booker had interesting announcements. But also talking about the potential for us to come together, that they as people of color, much like obama, can be elected to the presidency because we actually dont expect as much as we can from americans. Having sort of that tenor while also being able to talk to issues that are of concern to the base is going to be the way. But donald trump definitely is a uniting factor. Matt, ill leave you out of this, but who do you think the republicans ought to fear most of the announced candidates so far . I would say kamala or Amy Klobuchar i sort of like. I thought the image of her standing in the snowstorm was good. But kamala has the ability to unite that progressive base with your more potentially moderate democrats. Some things that will be a problem for her in the primary will be a strength for her in the general election. The question is, how to get by the primaries. The panel will stay with me. President trumps National Emergency declaration has House Democrats vowing to block him at every turn over what they call an unconstitutional use of executive power. And since the beginning of this administration, my next guest has been a leading voice on capitol hill trying to bring attention to President Trumps blatant disregard for checks and balances system, and has twice forced house votes to begin impeachment proceedings against the president. Joining me now is congressman al green, democrat from the border state of texas. He sits on the Financial Services committee. The four congress men going to the Financial Services committee and what can be done about the president moving money from one agency to another to pay for this wall, you are a congressman in one of the border states. Have you, getting away from politics, witnessed any emergency that warrants an Emergency Action to build a wall on the border of the state you represent . I have not. And ive been to the border, reverend. I was there about six weeks ago, not more than that. I had an opportunity to see what was happening there. When i saw quite candidly was a humanitarian crisis. I saw women and children for the most part who were fleeing harms way and trying to make their way into our country by way of a lawful process known as asylum a process that we have honored for decades, a process that if the president doesnt like, he can change by way of the law. The unfortunate circumstance is that he wants to use a wall to deal with the humanitarian crisis. And we have seen according to data that the number of people coming across the the Mexican Border has actually gone down. But let me ask you this. The congress voted, the congress rejected the idea of first 20 billion then to 5. 7 billion. There was a bipartisan agreement that gave 1. 4 billion to do some things, border or not, a wall. By him now saying, fine, you wont do it through me trying to get the legislation, im going to call an Emergency Action. Is this not really in many ways tipping the balance of power between the legislative, executive, and Judicial Branch . Reverend, you are absolutely correct. This would be an encroachment upon the powers of congress under article one of the constitution, section 8. Congress has the power to levy the taxes and Congress Also has appropriated funds appropriately. Once we do this, president s are not empowered to just move those funds willynilly, arbitrarilily and capriciously. This president seeks to do something that hasnt been done before with emergency powers. Usually theyre utilized to deal with foreign powers, foreign actors. In his case, he wants to deal with something thats domestic, and he also wants to take money from one program and move it to another. This is something that i think we will have to challenge in court, but with we can also challenge it with a resolution of disapproval. It can go to the president for his signature, he has the right to veto it, if he does, we would have to override that veto. But veto not stwhanwithstanding cannot usurp the power of the purse. The legislative branch made a decision in this area, and hes decided to go and do it anyway. That is what i dont think is being discussed enough here. In the history of executive action have we ever seen a president say, one has already rejected it so im going to do it anyway and im going to do it by just moving around monies that are already allocated in other areas. Well, this is what we are always concerned about, and that is an imperial presidency, a president who disregards the constitution, a president who assumes that he has the authority by virtue of being president simply to move money around at will. The constitution doesnt permit it, and congress will fight it. We will especially fight it when weve already acted in this area as youve indicated. Congress has said what its will is, congress has said you can have 1. 75 billion to deal with barriers on the border, and weve also allocated other funds for border technology. But we have not given the president the authority to make a decision thats contrary to this one. When he tries to do this, he will be challenged. Now, the Democratic Party gained a lot of seats in congress, actually became a majority in the house last year. If they cannot keep their word to the American Public, if theyre neutralized by this president , what does the Democratic Party say to the voters that put them there to keep a check and balance on where things are going as a result of the outcomes in the midterm elections . What can the Democratic Party say if they cant stop something that has already been voted on, and the president does it anyway . Whats the use . Well, the Democratic Party does have a duty and obligation and a responsibility to take on the president when he exceeds his authority, which is what we will do. And i believe this, that people expect us to challenge the president. They dont know that well always win, but they do know this works that we should always fight, that we should always make it clear to the president that he cannot become the legislative branch of government as a result of his encroachment upon our powers. The congress of the United States under the curtain leadership is taking the president on. We have fought him when it comes to his deciding that he would simply shut down the government, take people away from their jobs and require them to work without pay. This is something that the president decided to do for 35 days. He has to bear the brunt of the blame for that. And many people are not being paid now who actually worked. You have some of these contract workers who worked alongside some of the federal employees. Theyre not being paid. They were laid off. Not going to be paid. Many persons had to take out loans that they didnt want to take out with Interest Rates that they dont want to pay and cant afford. The president is being exposed. I think this exposure will continue. Now, let me switch to some democrats. You have been very vocal, as i have about Governor Northam in virginia as well as the attorney general who have admitted to using blackface and said that they ought to step down. The governor said he will not step down, hes going on a healing tour. I dont know how the injured becomes the doctor to do the healing. What should democrats do about Governor Northam and do you still hold the same view that what he did was such an egregious act that there outing to be some move to reprimand him and remove him . He did engage in the twin sins of blackface as well as klan regallia. That is not an indication of someone who wants to repent. He wants to remain in office at the expense of others. I dont think that we can allow him to do so. I think that the demand for his resignation is still in order. It means something to us and the people that we represent to know their Public Officials who will take a stand against this. We cannot allow this because if we allow it, then we allow other things that are equally as dastardly to take place. We dont want to see persons in nazi uniforms in yearbooks, we dont want to see persons with nooses in yearbooks. There are still things that are painful and hurtful, and this governor was not a person without knowledge because he was in medical school. This is in his medical school yearbook, not in something that happened when he was in grade school. I believe that we have to demand his resignation. I still stand by that. And i think that the good people of his state can look into the possibility of impeachment. I would leave it to them as to whether they would do so, but i would hope they would think through it and give some considerable thought to the constitutional permission to do so. Mccabe who said that when he began seeing some of the actions of President Trump in firing fbi director comey, he was very concerned about obstruction of justice, and there was even discussion of the 25th amendment to be used in removing this president. He said he felt the president was obstructing justice in a case investigating russian involvement. I mean, thats about as we say in brooklyn, as thick as you can get. Definitely is. I think what im looking to hear from that interview and when this book comes out on tuesday and we can all open it up and dive into it, is are details about that critical eightday period from may 9th of 2017 when james comey was fired and to when he was appointed. The fbi felt isolated and felt all alone. It wasnt that the president was coming off the investigation, but he had seen Rod Rosenstein write the memo justifying james comeys firing, they saw the attorney generals sign off on it. If you put yourself in Andrew Mccabes shoes, we have this critical investigation into whether the president s campaign interfered, helped the russians interfere with the election. We now have the president himself trying to end that investigation and we have leaders at the Justice Department helping him do it. What do we wont be to protect this investigation . They opened the investigation into the president for obstruction of justice and as a potential counterintelligence threat. What they were trying to do was put this investigation on such a sound footing that there was no way anyone could shut it down. And also to force Rod Rosenstein to appoint a special counsel, which he had to do put politics aside, sarah. We are talking about whether or not a foreign adversarial government in any way interfered in the elections of 2016. How do republicans stand back and watch even the potential of that not being fully investigated and thoroughly looked into and say that their patriots . I grew up in brooklyn, new york, during the cold war. Were talking about russia and were talking about whether they interfered with an election, and you have these road blocks to stop a real, thorough look at what happened here . Yeah, well, i hope they dont do anything to obstruct it. I actually run a group called republicans for the rule of law. And the whole goal is to protect the Mueller Investigation from political interference. And so far there has been some road blocks, but mostly hes been able to to conduct his investigation. And i think one of the things that you see is that most republicans agree that he should be able to continue his investigation to its conclusion without political interference. Obviously lots of republicans do believe its a witch hunt or politically motivated, but the most important thing right now as we assume were getting close to the end is we get to see the report. Everybody, 90 of the American Public wants to see whats in this report, republicans and democrats alike. I hope that the president didnt collude with russia, but we should be able to, because weve paid for this, we should get to see whats in it. As we wait to see whats in the report and we always keep moving the goal post, were at the end, were at the end and it never seems to get there. Weve already seen scores of indictments and pleas of guilt and convictions. Usually people dont lie about things unless theyre hiding something, and if this is centered around the election and russia, you would assume theyre lying about that and why would you create a lie unless you were protecting Something Else . Right. The funny thing is there seems to be things theyre lying out, Jared Kushner hasnt been convicted of anything yet, but a lot of things that hes omitted, his security clearance and all the contacts that he had. What is he hiding . Theres smoke here, but where exactly is the fire, and that seems to be the case with a lot of these guys. And so im sure when mueller and his team goo into this they didnt expect it to be going on this long, but its going to continue. But i think with all the indictments and all things hes been able to find out, well get closer to the truth as we go further into this year matt, Sarah Huckabee sanders said shes spoken with mr. Mueller and she says it was voluntary. How feasible is that . You are the press secretary, spokesperson for the president whose whole team is under direct investigation. Will you pick up the phone and call and say, yo bob, i want to come over and talk . How does that happen . What they mean by voluntary is they didnt come under threat of subpoena. But they were probably called. Muellers team clearly reached out to sanders and her attorney and asked for an interview. Either you do an interview or you say no and then you get brought to the grand jury and you cant have your lawyer. There are two areas for Sarah Sanders. One are the repeated public statements shes made about the russia investigation, specific factual statements where she has said things that may or may not be true. Muellers team wants to know who told you to say that . Did the president tell you this so theyre trying to find out what instructed her, not really putting something on her herself . As far as we know. We dont know any direct criminal liability that she has, but you can see why if the president is orchestrating that coverup, part of it could be firing james comey and what you say in public. You want to know who instructed her to say things that werent true. Everyone whos around the president is a potential witness for his state of mind and his state of mind is so important because a number of the actions hes done, firing comey, pushing the Intelligence Community to shut down the investigation or lean on the fbi to shut down the investigation, trying to get mueller fired. The question of whether thats a crime or not often turned on his intent. Did he have a corrupt intent. The way you prove that, you cant get into his mind, but things he said to witnesses at the time. Economically were falling behind, most families arent seeing the benefits of the economy, the stock market, of the unemployment rate. Chinas breathing down our necks, were falling behind in 5g and all kinds of technologies and you get to a point where you fall behind so much it gets tough to get back bhahead. Thats why im considering it in the first place. Theres a talk about we cannot continue to see democratic leadership that only appeals to the west coast and the east coast and not the states and cities in between. You are a congressman from ohio, a very, very important state, and whoever is elected president. Do you think that of the present field that there are those that can appeal to Middle America that you represent, and Strong Enough to do that while they hold both coasts, and the reverse, can you who has proven with being elected to reelected to congress being able to to deal with Middle America, can you attract people on the east and west coast . Well, thats the art of politics. Who can that off, i think there is no one that can pull mid western votes like someone that is from the midwest. And no with can raise money like people from the coast. I think what will determine this election for who the democrats nominate. There is a level of exhaustion at the division that we have right now. You cant have the future, a divided country is a weak country. So i think the person that will have the best chance is the one that can pull the country together. Heal the wounds of the country, and speak to the Economic Needs of people who have fallen behind that didnt fwrint automation. Black, white, gay, straight, men, women, people are struggling. People with secure federal jobs, they lost one paycheck. That is happening all over the country and nothing is being done about it. We just saw a report come out that 400 of the wealthiest people in the country have more money than at bottom 150 million in the country. That is a broken economic system. They will vote for someone that can fix that, reform our education system, and say look we need everyone on the field with the jersey on because china is coming to clean our clock. There are those that have arguing that democrats need to get afwra identity politics, but why do i have to lose to put aside my identity for mane others. Black, or lbgtq, and youre not telling people to lose their identity, but theyre all things that we could all been arounds about that is not being dealt with. If were going to be a National Party from coast to coa coast, including the south, we have to fiercely defend those social justice issues, general justice reform, equal rights, i would say they should be fundamental to republicans as well, the issues of race. We have to have a National Conversation around race, were not even talking about it right now. We have to do that and talk about economics. You talk about criminal justice reform. At the end of the day that needs to be fixed welcome but what is another problem is that people cant get a job when they get out of prison. We want to make sure there is Economic Opportunities if you made a mistake there is still an opportunity to get back into that economic system, we had large swaths of the country totally left behind. The candidate that speaks directly to that issue it will be the candidate that i think the American People and the democratic voter wills look closely at.
