Less than one week to investigate the Sexual Assault accusations against Supreme Court nominee, Brett Kavanaugh, regardless, Senate Republicans are resolved to move forward with their president s court pick, despite the emotional and political fallout behind dr. Christi Christine Blasey fords testimony this week. The center of the drama were two senators, republican jeff flake and democrat chris coombs. I have the opportunity to speak with both yesterday. Take a listen. Do you feel that we can try to bring the country together . I think so. Senator coombs said what you did was he rowic. No, no, hes the guy. Do you hope theres a spirit as a Global Citizen that emanates it has to. It has to. We have to heal the senate. That was a good start yesterday. He hes a good guy. You did a heroic thing. Do you hope it works out in a bipartisan way . I do. Jeff flake is the hero. He made his party upset. At the end of the day, by having a week for further investigation, im hopeful there will be a different outcome and the people of america will realize we heard them. A great panel joins me now to take us through all the details. Aaron blake, senior political reporter for the washington post. Alicia, a White House Correspondent for pbs news hour and msnbc contributor david brock, founder of media madness for america. And, msnbc legal analyst, danny savalaos. It was quite a week. We are down to seeing a confirmation, a vote from the judiciary committee. All of a sudden, these two guys, one republican, one democrat, senator flake, senator coons huddled for a week. How unprecedented is this, unexpected is this, and what does it mean in terms of where we move forward in seeing if Brett Kavanaugh is going to be on the Supreme Court or not . Just when we thought the surprises were done, we got a new surprise. We thought Brett Kavanaugh is going to be confirmed smoothly. All these allegations come out. Then, at the end, with both testimonies, you get, jeff flake, a key swing vote saying im going to vote for Brett Kavanaugh. Through the hearing, he looked pained. He looked as if he was not ashamed, but disturbed of the things going on, not just of Brett Kavanaugh, all the things going on. Its unprecedented for a sitting senator to say, yes, im going to vote for the Supreme Court nominee, then walk out and talk for a while about kind of what really is at stake here and come back and say, im going to vote him out of committee only if this fbi investigation will go forward. I will say, this is government at work. There were two young ladies who cornered jeff flake in an elevator who forced him to look at them and say, look, im a Sexual Assault survivor and youre telling me i dont matter. That really moved jeff flake, is my understanding. That really is unprecedented and telling moment. So many times, you see people go in to talk and see them in the hallway thinking you are not making a difference. These protesters made a huge difference. Now, theres an open fbi investigation. Brett kavanaugh could be in for trouble if the fbi finds something. Now, aaron, nbc news is reporting the white house is limiting the scope of the investigation. Late last night, the president tweeted nbc news incorrectly reported, in parenthesis, as usual, that i was limiting the fbi investigation of judge kavanaugh and witnesses, only to certain people. Actually, i want them to interview whoever they deem appropriate at their discretion. Please correct your reporting. We did, mr. President. But they only have seven days, a week. There is some limitations. What can happen in a week . Yeah, this is, by definition, limited. It has to be limited because of the week. If you look at what the Senate Judiciary said about this, they said it is limited to current, credible allegations. Credible looms large there. According to what we know, that does not include julie swetnick, Michael Avenattis witness. They said they would have free reign and the scope is set by the senate. That means there is a scope of this, it is not free reign, as the president said. Whether thats because the senate set the scope or the president and the white house were involved in this. Thats a key delineation here. The fact this is a limited scope and the extent of it is going to be discussed, especially if this doesnt turn up anything and people who talked to the media before, for instance, have not been interviewed by the fbi. David, i really wanted you on this morning because of your background. You have been involved in calling it like you see it. I was very anxious because i have real anxiety about this. Are we being delivered or duped is really my concern here. At the end of the day, if we dont have enough time, with seven days, if there is a narrowing of the scope, are we sitting here next sunday morning saying he was confirmed but they got the investigation and the jeff flakes of the world can vote yes saying i got what i wanted, we wanted investigation and they just appeared to have been either purposely or not, but they appear to have been objective and they got the investigation, which really couldnt go so far. Are we being set up here . Its possible. Look at the backdrop of this. I never thought i would sit here and say you had a worse hearing than back in anita hill days. Ten Republican Trump yes men came in with their mind made up, with one wild card, jeff flake. They wanted to jam this through. They set up a false situation in the hearing where they limited dr. Fords ability to give witnesses. They never heard from the other accusers. The American Public didnt see the full story. Its good the fbi is looking at this, but there are two things ch. One is the scope. They could be in trouble if they do the investigation. There are other accusers, accusations out there. I looked at the anita hill file back in the bay. Its volumous. We got he said she said because we allowed it, not any of the other. It was a republican court. Thats right. The second thing is, what happens to the fbi report when its done . It cant be that a few senators look at the fbi report in a smokefilled room and the American Public never hears what is in there. I understand the 302s are co confidential, but how is that known to the public . We are going to reopen the hearings . That would be something that would be warranted when they find new information. S thats where i want to go, danny, with you. If you are we have heard from attorney avenatti, his client has not been contacted yet. This is two days after they said the fbi had it. So, if we are told, as we have been by kavanaugh himself, during the hearings, that the fbi does not come to conclusions, the fbi just does an investigation, gives a report, but they dont really decide guilt or innocence or even suggest it. We may end up, at the end of the week with a, b, c, d and you make your own conclusions and its no different than people concluded going in friday to the Senate Session and the republicans take their stand, democrats theirs. Unless somebody has moved on either side, we end up with a week delay of the same vote we would have gotten. There are two things that are contrary. One is limiting their time. The other is limiting the scope of their investigation. The way the fbi and the doj does investigations is they take months, if not years. They are wide ranging. If you stumble upon something new, new criminality, that is a focus of the case. Months, sometimes years . Absolutely. We are talking they have to dig up stuff from 30managsomet years ago. They have to vet the witness. We have seen that in the last few months with other defendants related to the situation. They have to vet the witnesses. Once they do, they have to delay their sentencing for months, again, if not years, to continue their investigation and use that cooperating witness. The way that the fbi conducts investigations is designed to be as long as they need it to be. The way they conduct it is the scope can be as broad as they need it to be. To call it an investigation when you limit those two primal factors for fbi investigations makes it Something Different in the end, not really an fbi investigation. So, no matter what conclusion or whatever facts they collect, you know, it will not be, i suspect, special agents out there who wont say it publicly are frustrated they are limited because the machine that they are, the tools they have are designed to be used over a period of time and almost unlimited in scope, so if new evidence falls out of a tree while they are lawfully searching in one area, they can take the investigation and go in a new area. You cant do it with a time limit. Anita hill really talked about the time or the double standard. Listen to anita hill saturday on what she saw as a double standard in judge kavanaughs testimony and his temper. He also was able to express a real anger and aggression as well as a lot of emotion. There was, you know, i assume those were tears. I just wonder you know, what struck me is no female candidate for a Supreme Court position would have the license to express in that way. Yamish, isnt that central to a lot of peoples feelings . Whatever the evidence turns out to be, or not, the double standard. When you watch kavanaugh testify the other day, the anger, the tears, the almost arrogant kind of defense, if Sonia Sotomayer or any of the women on the Supreme Court acted that way, they would be dismissed as being out of bounds, hysterical, too emotional, not having the right temperament. He did everything a woman would not be perceived to be correct in doing and that is central to a lot of the reaction that we seeing from women and men about how people are treated here. People saw this, really as a performance of stereotypical gender roles. On one side, dr. Ford testifying in a method cal, logical way, almost an expert to her own trauma because shes so well versed in how emotions and Early Childhood things impact your adult life. Then you have Brett Kavanaugh who was unhinged, angry, crying. You had experts and advocates tell me that performance of white male privilege. Some saw Brett Kavanaugh saying a white man can do this. A black man would be seen as aggressive, out of order, uncomfortable. A black woman or white women, hysterical and too emotional, almost unbalanced and not able to confirm that person because they dont deserve the job of Supreme Court justice. They need to be someone who will look at the laws of our country and impact millions of lives. A lot of people watched that. A lot of people watched Brett Kavanaugh, republican women, included, who you saw a man fighting for his life and if he is innocent and feels his livelihood, his teaching, coaching of girls basketball, the family life he built for himself, he is fighting for his life. As a result, he got emotional. He knows, if he doesnt get the job, its not just Supreme Court nomination, its his career that is ruined. Theres a double standard in some ways. A lot of people saw that and thought this is a person getting emotional for real reasons. That is so. Even if a woman or a black woman or man were fighting for their lives, they would be expected to have a certain kind of decorum. We are going take a break. We established what this nation could see in the next few days regarding Supreme Court nominee, Brett Kavanaugh. What could be the political impact on the midterm elections in just a few weeks . Back with me is my panel, aaron blake of washington post. Yamish of pbs news hour, david brock of media madness for america and danny savalos, nbc legal analyst. Aaron, what is the fallout, politically, the president in West Virginia last night manchins home state and hes trying to use the kavanaugh nomination to rally up his base. Can this turn around, what appears to be the hemorrhaging of women, the soccer mom types that went for trump in 16 and vote democratic in the midterm elections . The president held a rally in one of the states where this could actually work in republicans favor, the longer this draws out. What we have between the race for the house and the senate are two very different battlefields. The race for the senate is very much going to be decided in red states like West Virginia, north dakota, indiana, missouri, where there are conservative electorates, but democratic incumbents. In the house, this is about suburban districts, which went for hillary clinton. Those districts could react to this negatively and swing against the republicans, while this could prove to be a difficult thing like heidi in north dakota and joe manchin in West Virginia, who, by the way, are the only two democrats who have not said how they will vote on judge kavanaugh. Thats telling given everything we have seen who have a couple democrats who are holding their powder on this. This is clearly not a clear cut decision for either of them. That shows how this could very much play differently in the battle for the house and the senate. David, bless aarons heart. When we see, with all this fury, two democrats not committing and they are in red states, theres two different races in the midterm. Theres the senate landscape, theres the house landscape, which are very different and tilted differently. How, as someone that knows the republican mind, how does the republican play this where they can try to hold the senate, even if they lose the house . People who act like this is one thing. This is a twotier political midterm with different factors. Thats right. What they are trying to do is, remember the first week after dr. Fords allegations came out, for their side, they were relatively restrained. Then they made a decision because the christian right was threatening to sit out the midterm. They were unhappy. They went all in, doubled down. You saw right wing media go out of its mind. That played out the wooek. What kavanaughs role was was to polarize the situation, which he did, effectively, i think. To bring the trump base on his side the way they were in Clarence Thomas days. Its geared toward the midterm in the fact that the house is up, the senate is up. It could work two ways. Fw they lose this, i think theres a real threat that a loss is a loss and has a depressive effect. I think they are very, very worried about that. On the other hand, they did gin up the trump base to come out. I think on the democratic side, democrats are excited about the midterm. Theres not a lot of room to go up. No matter what happens here, if they jam this through, the voters you were talking about, those white, educated, College Women are going to be really outraged. If somehow he is defeated, it will drive our Senate Turnout because we want to get that senate back. So, yamish, if they lose, they win politically, potentially. If they win, they could lose. Take where andrew gillhams democratic nominee appears to be doing well. If they ran this through, it may energize the vote and give the suburban, educated white women that were on the fence and theres the ramifications there. It could stop a very Close Senate Race there and save an incumbent democratic senator. Im using one state as an example. The politics of this is almost the flip side of what may happen in terms of a vote in washington on confirming kavanaugh . Thats correct. I think i have been saying for a few months, trump is on the ballot in every single state. I would say kavanaugh is on the ballot of every single state. I dont think people are going to forget if he is confirmed or not confirmed. There were images of stock exchange, bars, whole offices watching the kavanaugh and dr. Ford hearing. I think no matter what happens, people are going to the polls saying do i want to be with the party with dr. Ford or Brett Kavanaugh. I have been talking to a lot of sources. A former rnc official is very much in the know of whats going on in the senate said republicans are ready to die on political hill because they think Supreme Court justices are how things get changed or how you cement your legacy. Of course the choice question energizes voters in a way it doesnt for democrats. Theres so many other issues democrats take to the polls. Christians are going to the polls and thats why they held their noses and went with donald trump. At least the Republican Party is doing something for us. That is the point yamish just raised that a lot of people feel, i among them, that some are willing to sacrifice somebodys congressional seat or senate seat if they can get the Supreme Court for two or three generations, they think its a worthy sacrifice. You know, as a legal expert, whoever sits in that court with a majority can change generations of what we would call Civil Rights Community, voter rights community, we call progress. It can be turned around 50, 60 years. A lot of people on the right are saying, we could lose the senate and the congress if we can have that Supreme Court reverse roe versus wade. People underestimate the importance of Supreme Court nominations. Maybe im biased as a lawyer. They are one of the most important things president s do. Because there are not term limits, the effect is the tyranny of the young. If you appoint the youngest possible judge you can on to the bench and they get through senate, then you have controlled a bench for 40 to 50 years, given if they are young enough and healthy enough. Thats what we have seen with the past few nominees. Now, Justice Gorsuch sailed through. Not the case with Brett Kavanaugh. Again, one thing you see in common, they are relatively young for federal judges. With that seat on the bench, for life tenure, their power can be considerable. Im going to have to leave it there. These people, they have gone crazy. President trump, last night, attacking massachusetts senator Elizabeth Warren. Warren is one of, if not the presumed frontrunner among a handful of Democratic Senators speculated to challenge President Trump in 2020. And between the kavanaugh hearings this week and midterm elections in just about six weeks, they will have plenty to strategize over before final decisions are made. I talked about all of this earlier this week with senator warren, who said, at a town hall saturday, shes getting ready to take a, quote, hard look at running for president. Good morning, senator. Thank you for joining us. I really want to get your feelings about the occurrences, obviously this week with the kavanaugh confirmation. But, im also very, very interested in delving into your legislation to really deal with the housing problem in this country. Clearly, thats a concern to many that have been left out and really priced out of the housing market, so, i really want to get to that. I think a lot of people missed that with all the drama this week. And, certainly, im not making light of the drama. We are talking about a permanent seat on the Supreme Court. Yep. Let me ask you, as we wait to see where the final votes will go, what were your impressions of the testimonies this week, both of the nominee and of dr. Ford . I believe dr. Ford. I thought she was credible. Look, what impresses me is dr. Ford kept saying, just do an investigation. Get the fbi to go check with the other witnesses. Get them to go out and interview people. Get people under oath on this. I felt mr. Kavanaugh looked like somebody who felt he was entitled to a Supreme Court seat and he was outraged that we would even investigate a claim like dr. Fords and he didnt, he just thought he could deny it, go on a political attack and be done. Deny dr. Ford, deny the two other women who brought accusations against him and roll straight on forward to a lifetime appointment on the United StatesSupreme Court. Is the issue, for you, senator warren, his character in terms of denial, ability of things or saying things that did happen or possibly happen, didnt happen or is it the act themselves . Because, the push back, as you have heard from republicans are, well, we saw you guys deal with bill clinton and these acts are definitely not where we have brought bill clinton. I think some of the pushback on the democratic side has been we talked about character. We talked about denying and we are talking about investigations to get to the facts and he is really not supported that when senator durbin asked him, outright, would you call for an fbi investigation. Right. You know, i think that really is the key to it, reverend. He doesnt want an investigation. Keep in mind, he also, mr. Kavanaugh served in government before. The republicans have hidden tens of thousands of pages that are part of his service in the government. Thats never happened before. When kagan was confirmed, they took everything and said, here it is. Its not because its a security secret. Its that politically, they dont want those papers out there. So, now, he says, look, what dr. Ford says didnt happen, but i dont want an investigation of it. I dont want anybody to go forward on this. So, what really worries me here, reverend al, what are they hiding . This is a man who does not want to be fully investigated. He wants to make his claims and wants no one to challenge him. Thats just not how it should work. This is a lifetime appointment to a job that will touch every human being in this country. We have to count on him to make decisions of judgment. Thats what the Supreme Court is about. Hes a guy who says, look, i dont expect anybody, ever, to be able to question me. I just cant go along with it, i cant. Now, let me ask you, one of the things that i, and many of those in the Civil Rights Community was concerned about is that, as we saw the recovery, when president obama and his administration brought us back from the economic collapse, homeowners, particularly in black areas and low income areas were wiped out and there was no repair. Yeah. You have come with legislation to really deal with that and to deal with the fact that people are being priced out, people are being pushed out. Theres housing segregation, classes. Explain this legislation and why its so important because, you know, i really think that this is one of the Critical Issues of our time. I agree with you about it being a critical issue. We have a housing crisis in this country. People cant afford rent, they cant afford to buy and, a big part of this is that we have government that has not been on the side of people who are trying to get into the housing market, who are trying to afford their homes. So, what ive done in this bill is, im working on expanding the number of homes available. Its about 3 million Housing Units that would be created, but also focusing, in particular, on the fact that the federal government actually advanced housing discrimination starting in the 1930s with red lining. When red lining was ultimately prohibited and africanamerican families started building housing wealth, the next thing that happened was that many Financial Institutions figured out, they could target communities of color, sell the very worst mortgages there and cost people the housing wealth they were starting to build up. Then, when the crash came, many of those very same lenders used the harshest foreclosure tactics against people in communities of color and in our poorest communities. The consequence has been that we have a wealth gap in this country, a black white wealth gap, but also an increasing wealth gap in this country, between those who have made it and everybody else. What this bill is about is expanding the number of Housing Units, about putting incentives on the table so we can change zoning laws to bring down the cost of housing to update that. But, also, to target particularly, the formerly red lined areas, and areas of official segregation and provide help to first time home buyers or people who havent owned a home for at least three years to help them get into homes of their own and begin to build some wealth. To me, this is about doing whats right for the american people. Thats the way you build wealth in this country is Home Ownership and there has really been a definite and clear racial divide there. What are the chances of this legislation passing . Well, you know, look, i know a lot of people say you cant do that. Let me be clear, we have a pay for on this. It will not change. It will not cost a middle class family a single penny. What we propose is put back in the estate tax where it was during the bush administration, the same families would have to pay an estate tax and that would affect the 10,000 richest families in this country. That means we could pay for 3 million Housing Units. Think about that. Give down payment assistance to first time buyers. Here is what i liked about this bill. It targets, specifically, the discrimination that the federal government itself advanced and says we have to do whats right here. We have to correct that. At the same time, it says we need more housing for everybody. We need more housing for poor families. We need more housing for the working poor. We need more housing for working families, for middle class families. The idea is, we all do better when we all do better. We make investments in housing, bring down the cost in rent by 10 . That lets families that are struggling to pay rent have a chance, catch up a little, put money aside for a down payment. So i always had a sense of purpose and why i was born and have tried to fulfill it.
