Legacy. This was a good day for america america. Obama care is here to stay. Today in a landmark 63 decision, the Supreme Court voted to uphold nationwide subsidies to help poor and middle class americans Purchase Health insurance under the Affordable Care act. The justice appointed by president george w. Bush chief Justice John Roberts wrote the majority opinion for the court. Leaving no doubts for his judicial the power to make the law rests with those chosen by the people. Congress passed the Affordable Care act to improve Health Insurance markets, not to destroy them. In plain terms, the decision means everyone who got Health Insurance through healthcare. Gov will get to keep their plans. Since most states operate through the federal exchange. Removing the subsidies would have kicked 6. 4 Million People off their health care plans. The decision seals the fate on a law in which president obama has staked much on his presidency. The president was thrilled following the announcement. We finally declared that in america, health care is not a privilege for a few, but a right for all. After more than 50 votes in congress to repeal or weaken this law. After a president ial election based in part on preserving or repealing this law, after multiple challenges to this law before the Supreme Court, the Affordable Care act is here to stay. This is not about the Affordable Care act as legislation or obama care as a political football. This is health care in america. This afternoon, i spoke to the official in charge of implementing the law during its launch, former secretary of health and Human Services kathleen sebelius. Secretary sebelius thanks for joining me today. I know its a big day for a lot of people in the administration and who are former Administration Officials for all the defense youve done on this law. Do you feel vindicated today . Well i think this law has always been about people who wanted and needed desperately Affordable Health coverage. Theres 6. 4 Million People who know the coverage that they have can continue on with subsidies and millions more who can take advantage of it. Ive been a lucky one, ive always had affordable Available Health care so i kneel great for the people who talk to me every day in the Grocery Store and on airplanes and stop me on sidewalks and tell me that this has changed their life forever. They no longer have to worry about affording health care if they get sick taking care of their kids and this is a very good day for those americans. Were you worried . Always. Its unpredictable. I thought the case was incredibly strong. I was confused why the court took it in the first place. Having said that there was no guarantee that the court would find against the plaintiffs i said the great news is that the Strong Majority of the court, including Justice Roberts and kennedy said this is what the law was intended to do to actually improve the insurance market. Help people get Health Insurance, not jeopardize the coverage that they had, so i was really pleased that the decision was so strong and with the 63 majority, hopefully it lays to rest a lot of the issues around is the law constitutional or not, it clearly is. What did you think of Justice Scalia calling this scotus care . Well unfortunately, i think Justice Scalia sees the world through a different lens has not been a fan of this law, in case anyone missed the first decision. And clearly that continues on. And seems to be frustrated by the fact that the majority is growing, not shrinking. Do you think this decision changes the Politics Around the law . When you look at the polling about americans opinions of the aca. 8 say the law is working well thats an nbc wall street journal from today. 40 believes it needs only minor modifications to be improved. Do you think this represents a change in Public Opinion . Well, i think that people are now saying this is the law. I Hope Congress stops relitigating the past i feel like were living in groundhog day. And starts looking toward the future. The president has said from the beginning if there are better ideas about how to ensure millions of americans, how to keep costs low, how to improve the care that people get every day, bring them forward, happy to work on them in 5 1 2 years, the republicans have never had a viable alternative. I think that it indicates the vast majority of the americans felt if the court were to rule with the plaintiffs congress should immediately act to restore the subsidies, they believe in the framework of Affordable Health care. Lets get on lets make Health Care Better for everybody continuing on with the delivery system. That will be good news for all americans. A major day for health care in the United States of america, big day for this Administration Big day for you. Secretary sebelius great to talk with you, thank you for your time. Thanks for having me. Joining me now is the president of planned parenthood ezra klein. It seems like the courts have had their say. Is the legislative branch done with this . Do you expect that this is actually going to be an issue in 2016 . I certainly hope theyre done. Thats what everyone is saying after 50 votes to repeal this now the Supreme Court has spoken, its time to move on. And this was a great decision today as secretary sebelius said. A broad decision a decisive one, and this is a great day for american women. A lot of folks dont realize how much women gain in the Affordable Care act. Free access to all Preventative Care including mammograms Breast Cancer screening, birth control. Women dont have to pay more for insurance. And they cant be denied coverage. This is a huge revolutionary change for women and a wonderful day. You talk about the winners, its a big win for the administration, its a big win for low income and middle class americans, and specifically overwhelming women the ones that are shunted aside in this process. You have an interesting thees us, and i tend to agree with it which is that with this decision, obama care or Health Insurance, health care in america, has been made a right, and it is no longer a privilege. Explain and expound on that if you can. This is a fundamental change in americas social policy dynamics. And you saw it before this decision actually came down. Primarily what republicans in congress were doing, were coming up with ways many a lot of them were contradictory. But were coming up with ways where they could say, yeah were going to somehow keep these subsidies going, even though the Supreme Court got rid of them. They would promise in two years to completely replace obama care. What that was demonstrating, this is a xi familiaric weve seen before. You see it with medicare social security. Its very hard once a benefit is in place to remove it the politicians are very afraid of creating that kind of disruption. Now that there is a fundamental relationship between the government and low income americans who want access tole th care its going to be hard for any politician to unwind that. Imagine a jeb bush or marco rubio or scott walker coming in as president in january of 2017 and saying as our first act, theyre going to take Health Insurance away from 20 Million People. You would basically be detonating a bomb on top of your own presidency. Its not going to happen. After this this is here to stay. Do you think we are going to have feasible replacement ideas . No. Illustrated and articulated by this republican field of candy dates . I think if there were ideas like this we would have had them already. This is waiting for health reform. We began with repeal and replace, we have just waited and waited and waited and waited for what the replacement would be paul ryan said that before this Supreme Court decision came out, it was very important republicans had their replacement plan, it was clear, it was detailed, it was scored by the congressional budget office, he presented no details and no office scores. Its not an accident. Obama care took a bunch of their ideas, they cant have them any more. And they dont want to make the kind of tough tradeoffs, the often unpopular tradeoffs that are necessary to create a plan which the democrats did. You have the court weighing in a president who has spent years selling this law to the american people. And yet a poll in march, 83 of Americans Still hold the same opinion on obama care that they did in 2010. Why has the American Public remained unpersuaded of the benefits of this law. Even as they seem to like the benefits of this law . Right, i think what ezra said is right, now, and this is what were seeing of planned parenthood, women are coming in who have never been insured before. Women send in their receipts from the pharmacy saying i cant believe it i dont have to pay for these benefits. All the benefits theyre receiving are directly as a result of the Affordable Care act. Do you say this is obama care in action . This is actually messaging and information . Some residents dont realize theyre participating in obama care, and not say, connect. And i think that is the work to be done now. For women, they know the difference of going and not paying anything for their pharmaceuticals, for their coverage for birth control, for their mammogram. As long as we make that link for people, its absolutely, this is the biggest benefit for women that weve ever had in the health care in a century and i agree with ezra as well. They couldnt get this done for 100 years, this is here to stay and now we just have to make it make sure its enforced make sure everyone knows whats available to them. I want to talk about john roberts. Because a lot of folks, i mean the conservative base is accusing him of harassy. Hes being kicked out of some conservative circles. You guys have a really good analysis, which is that thank you. In fact we have to lure you back on somehow. In fact john roberts is actually followed very much in line with the tenets of what conservatives want from their justices, which is narrow rulings, not activist judiciary, but someone that believes very strongly in a smaller role for the courts and deference to the legislative branch. At least what conservatives say they want. Im old enough to remember when george w. Bush who said he wanted justices who would not be trying to reinvent laws or change social policy. Thats what he did here. He decided not to rewrite this law, he decided not to pretend this law wasnt something it wasnt. He decided not to believe a genuinely ridiculous argument. I was really reading the brief, the opinion on this was somehow it was cathartic. The world became slightly crazy, that there was this pretense that obama care was somehow unclear on this question of whether people got tax credits in nonstate based exchanged states. Which had been 100 clear through the debate. We were sort of forced to take this sort of ridiculous idea seriously, and in this decision they did not fwlinch at all, they did not give any quarter to this argument they did not do what they did in the individual mandate decision where they split on medicaid in these weird justification for the mandate, they just said this law is perfectly clear in what it does in how it works, and its not for us to reinterpret it and its not for us to pretend that there is another viable interpretation i honestly found that refreshing, it was a refreshingly nonpolitical judgment. You also saw that in the split by the court. Basically, congress didnt write a law to selfdestruct. And there you have it. We will have more on Justice Scalia coming up and his collarful language in his descenting opinion. Ezra klein, Cecile Richards always good to see you both. Republicans are lining up to bash obama care today, are they secretly happy they dont need a plan b. President obama secured two big wins this week. Will he complete the trifecta by securing a nuclear deal with iran. Before earning enough cash back from bank of america to buy a new gym bag. And mark my words, following the election in 2016 the referendum that we will have in 2017 this chamber will return and we will repeal every word of obama care. He will never stur render. The appeal lives on republican contenders weighed in. Within minutes, jeb bush rand paul, Rick SantorumMick HuckabeeCarly Fiorina all vowed to repeal the Health Care Law. Republican s republicans in congress have voted to repeal the law 50 times, for all the talk of behind closed doors, theres sighs of relief. More than 6 million americans would have been affected 2 3 of them in republican districts. After the decision came down bloomberg was reported as saying, thank god. Joining me now, host of msnbcs all in chris hayes and Joaquin Castro. Congressman castro give us the inside scoop from capitol hill. Did you hear quiet pops of shame pain . I think theyve got to be relieved, they really dodged a bullet the Supreme Court saved them from themselves. Even if they had a plan its extremely unlikely that they would have been able to get their own plan passed the Tea Party Members in the house of representatives and actually pass something through both chambers. What is ted cruise doing. Ted cruise is doing ted cruz thats his is stick. You keep saying this stuff, right . This is the way he does on capitol hill, for the rest of the party, they all we read that list of name ss. They all keep saying this and i just wonder is there the expectation that the republic electorate is never going to hold them to their word . Yeah i guess my question is, what how does this play once you have a nominee . Obama care is both a law, but also a symbol a symbol of the fact that the wrong people are running the country and were on the wrong side of the equation. I think its a really fascinating open question, if youre sitting next to the republic nominee, how you navigate this, i think, look approval of the law just ticked up. Its going to be above water, its hard to see how it comes down. In the primary, theres no cost to do the shtick theyve been doing since the law passed which is rail against it and say youre going to repeal it. The courts decision represents a fundamental shift in the social contract. Health insurance is now a right. It is except i think thats right, were optimistic, were looking toward a point when people actually have the coverage they deserve, theres many states where republican governors have not expanded medicaid, and thats huge were talking about january tors and School Bus Drivers who are independent contractors who are working class folks who cannot afford to send their kids and themselves to the doctor. And that is the kind of question that should be called in a president ial campaign cycle. Do we want to be the kind of country where people are working hard and cant afford to see a doctor . I think its still going to be a question, that parts of the law that are still very much not fully implemented. Im glad to see it i think its important for us to have that conversation and start Winning People over beyond the symbolism to what kind of country we want to be. I think also it will be interesting to see when they finally move away from the repeal language and on to trying to fix the law, it may be in the general election where they do that. But the chances for repeal get worse everyone worse with each year because most people are enrolling. This becomes a chronic political issue for them in the way the abortion issue is entitlements its something they can keep coming back to and not invoke the same furor youve seen over the last several years, something they can continue to stoke people with. If it is a straw man, chris, its something thats evident from todays decision maybe the most important thing post 2016 is the court, and who sits on it. Right right . I want to talk about scalia and the language he used. Apart from thats pure applesauce, and not argol bargol. Which i know youre prone to use on your show. All the time. At one point he was like this is an unnatural interpretation of the law. I feel like the phrase scotus care, sort of revealed a deeply emotional partisan core that informed scalias decision making. And i wonder how much when you read that first of all, what was your reaction and then as we look atted core more generally, how terrified should people be . The scalia decendents does a few things. Its a must read. And scalia is great. Everyone wins when scalia is in descent. He doesnt run the country. Its like its a win win. Yes, i mean this could have been one of the things that weve seen is is that roberts and alito were in many minds in similar places. Yes. In terms of their judicial temperament. And theres been a real diversion in the two, alito looked a lot more like thomas and scalia as time goes on. Roberts looks not like anyone else really. Partly because hes the chief justice and managing the court in a very interesting way, we still have this epa case which after they find the constitutional right to gay marriage absolutely put a stake through the epas ability to regulate the air. Thats the plan. But for this court if they rule with the conservatives, they are very pro business and in fact this decision helps all the Insurance Companies that were being tossed by the wind waiting for the outcome. This was true in roberts confirmation hearings. Hes a very savvy political operator. Over and above being a jurist. Hes a very smart political operator and understands the stakes and maneuvering institution ali the court with respect to congress. The fate of the Republican Party, and theres a strong argument to be made as the congressman said roberts helped save republicans from themselves. He actually gave them the most favorable political outcome, even if its not the most favor otherable ideological outcome. Which he would do on gay marriage. We should not let this day go by without mentioning the other really big deal the big decision that came down from the court on fair housing. I think its great for you to remind us how much the rock erts court has been the corporate court. Throwing the National Insurance marketplace into havoc would have been an antibusiness move. The other hallmark of chief roberts has been the reaction airy colorblindness on trying to repeal the idea that the courts have anything to say to protect people of color from discrimination. That is why i almost fell off my chair today, when read inging that we were able to prevail. It is a case that could have said and the Civil Rights Community was concerned by saying against all cognitive science and the way they know people are discriminatory in fact carrying the legacy of Structural Racism in all the decisions we make. Its a big day. The Fair Housing Act is still there, can you still prevail as a plaintiff on the idea of disper ate impact. The folks who brought this case are going to say, we want integrated neighborhood ss. As interesting as it is to read scalia descents, the focus on the court sort of betrays the fact that the branches of government are not equal at this moment, it feels like all of the weight is in the judiciary, the legislative branch has effectively ground to a halt with the exception of certain measures like trade promotion authority. And i guess i wondered go think that we will restore that balance any time soon . I certainly hope so. It has been tough the last several years, the last two sessions of congress have been the least productive sessions in american history, the fact that the court can come in and make these rulings, i think is a testament to the structure of American Government and the checks and balances. You take Marriage Equality for example, thats something that we should have been able to do legislatively across the country but its going to take the Supreme Court to actually make it happen. Even though the court is carrying a lot of the water right now, i think it speaks well to our overall system of government. Dont take eliquis if you have an artificial heart valve or abnormal bleeding. While taking eliquis you may bruise more easily and it may take longer than usual for any bleeding to stop. That was president obama today on the rule inging upholding the Affordable Care act. I know theres an official response, we heard what the president said please pull back the curtain and let us know. What was president obamas reaction when he heard the news . Well alex the president was pretty enthusiastic about the response, he understand the stakes of this decision were high for millions of americans all across the country. Were not just talking about the 6 million americans who had their Health Care Tax credits at stake in this particular case were talking about another 10 million americans who got their Health Insurance through the exchanges. But also the millions of other americans, tens of millions of other americans across the country who benefit from any of the protections that are included in the Affordable Care act. This is anything to make sure you cant be discriminated against. To make sure you cant be charged more for your Health Insurance because youre a woman. There are a variety of protections that apply to all americans. Those are protected today. The president was gratified by that. Was there quiet fist bumping . There may have been some congratulatory fist bumps in the oval office today. He also ended his remarks by saying lets get back to work. I think thats indicative of his approach here this is a decision that was good for millions of americans, theres a lot of work we have to get done and whether that is trying to complete this Trans Pacific partnership trade agreement, so we can open up access to markets from Southeast Asia for businesses and workers. Trying to raise minimum wage. Making additional investments in our infrastructure thats badly needed. Theres a lot of work the president has to do on his to do list. I want to get to your thoughts peter baker has a piece in the New York Times today, which contends while they would not say so outloud. White house officials found it easier to work with congress on trade, now that republicans control both houses. Is that true . Well alex i think the reason we may not have said it outloud, i dont think we agree with the statement. The fact of the matter is regardless of who is going to be in charge of the United States congress it was going to require a bipartisan majority in the house and senate in order to get it done. The fact is republicans could not have done this with just republican votes. The same would be true if democrats were in charge of the congress. They were pleased to make progress for the american people, and most importantly, to expand Economic Opportunity for middle class families. In this case were able to marshall the support of enough democrats to join with republicans, find Common Ground and do something good for the country. Thats what the legislative process is supposed to be all about. Hopefully we can see more of it. When you have john boehner and Mitch Mcconnell in support of one of the president s signature legislative priorities and you have john robert the cementing his legacy it feels like up is down and down is up. Were you surprised by Justice Roberts and his opinion . We were not that surprised. The reason is this is a pretty straightforward decision. As the president indicated in his News Conference a couple weeks ago in germany, this is the case the Supreme Court shouldnt have taken up. Because this is something that is so frankly, easily discernible just from reading the law. There was an attempt by the plaintiffs in a pretty creative and novel legal theory to basically suggest that they should take four words of this law, pluck them out of context and interpret the law in a different way, in a way that clearly congress did not intend for the law to be implemented. This is a straightforward case were relieved they didnt do anything, but not surprised. Kathleen sebelius said she was always worried. Was that same worry not shared at the white house. She was concerned at the impact that a potential add verse ruling could have had on the lives of millions of americans, we were concerned about that too but we had a lot of confidence in the legal arguments that the solicitor general was making before the Supreme Court this year. And ultimately we were right, that there was not just a majority of justices on the Supreme Court who agreed with the governments position. Actually, six of the nine justices agreed with our position. And considering how straightforward this ruling is not a lot of surprise here in the west wing by the outcome. Im reminded on this day of a tweet that was sent not long ago by the washington examiners this was the day the house defeated the trade bill. January 20th 2009 to june 12th 2015 ringing the bell as is it it was all said and done whats your reaction on a day like today. I think our reaction is the president has been very well served throughout his political career. By really taking the long view by keeping his eye on the goal even if the goal was somewhat in the distance. And this was a characteristic of his leadership style that served him extremely well during his First Campaign for the presidency, there are a lot of questions, when sarah palin was originally chosen by john mccain as his running mate a lot of concern about whether or not the Obama Campaign would be able to survive. And we were distracted by all those things. We were able to stay focused on the goal. Is the republican obsession with repealing obama care sort of the same as the republican obsession with sarah palin . The same obsession with what . Sarah palin . Well, i there may be some aspects of their views on those topics that may be similar. The point is simply that we dont get focused on the ups and downs of these political debates. Were going to run into set backs and snafus as we did with the trades legislation, by keeping our eyes fixed squarely on the goal we can be more successful and accomplish a lot. Thats served the president well, not just as a candidate for this office but in terms of running the country. I think that that view was that was really validated today. Its been a delightfully snafu free day. Thats a massive understatement. Josh ernest thanks as always for making the time josh. No problem alex thafrg you. Tell me about, for those who dont know how you ended up at the white house on the president s side as he signed the Health Care Act into law . Well ive been doing a lot of work with the Health Care Bill here in washington, doing a lot of activist work and giving speeches and going to actions they were having, telling my senator. Senator patty murray heard my story when i told it to her in march of 2009. She started telling my story, and barack obama heard about my story. And when he was signing the Health Care Bill they called my grandma and told her it would be amazing if i could come out and be there for the signing of the bill. When you heard the news today that the Health Care Law is here to stay how did that make you feel . It made me feel great, because i fell like its a victory for america, health care is a basic human right, everybody has the right to have health care and get the care they need when theyre sick. What would you say to folks that say this is a bad law, it needs to be repealed. Republicans running for president , who want to tear it apart. What would you say to them . Many bad people are coming, in youre going to have terrorists coming through the southern border, no question about it we have no security. The United States has become a dumping ground. That was donald trump moments ago, giving an interview to jose blart. Univision will not air trumps miss usa competition. Jose diaz this is a big interview, how remorseful do you think donald trump feels about those remarks . Not at all. He says the mainstream media, biess that would be you and me among others are simply misquoting and miscasting what he said. He said he has no problems with mexico or the Mexican Government, he says that they the Mexican Government are doing better deals than the United States is. He doesnt blame them. If he wanted to speak about what he said on the 16th of june if you let me quote what he said the u. S. He said has become a dumping ground for everybody elses problems. When mexico sends its people theyre not sending their best. Theyre sending, bringing drugs. Theyre bringing crime, theyre rainists and they come from mexico and latin and south america. He says simply what he was trying to say is that on the economic front mexico is doing better deals than we are and he loves mexico and the Mexican Government. I also asked him about this issue that univision was scheduled and had agreed to run miss usa and Miss Universe this year, told him he was fired. He said this morning, top un vision executives called him and like little lambs were asking for forgiveness, but it was something they had to do pressure from the Mexican Government. It was a wide ranging interview, alex, i talked to him about the fact that according to the latest fox news poll hes number two nationally in the republicans. And in new hampshire, number two. With 11 . Right after jeb bush. I get the feeling hes not a big fan of the bushs especially jeb bush. How damaging do you think those statements are when youre trying to reach out and embrace the Latino Community or have them embrace the Republican Party . Theres a difference between jeb bush and donald trum in a number of ways. Mr. Trump talked about it in our interview. He disagrees with jeb bushs opinion on immigration reform. He also mentioned common korbie the way, its interesting, because he doesnt i dont think he sees what he said specifically as being something that hurts hundreds of thousands of potentially millions of people. A lot of people feel slighted by someone who says that the u. S. Has become a dumping ground for everybody elses problems. And that theyre bringing in rapists, and then he said something newsworthy as well. He said he feels terrorists could be crossing the border any minute, and carrying out terrorist attacks. I also mentioned the fact that 9 11 were middle easterners many with visas that have come in. Theres been no mexican, and theres been no central or south america thats participated in an act of terrorism in the United States. He says wait until tomorrow. Wait until the future. Who knows what the future holds, that border is so porous promise to build a huge wall and make mexico pay for it. One thing is for sure, donald trump is a fascinating interview. What a great get that is. I cant wait to watch it in its totality. Its always good to see you. Make sure to catch jose week days right here 9 00 a. M. Eastern on msnbc. That is all for now, the ed show is coming your way next. Good evening, americans and welcome to the ed show live from minnesota, we have a lot to talk about tonight, lets get to work. Tonight the law of the land lives. The 63 decision. The Affordable Care act is here to stay. I believe obama care is bad for americans. Voting rights are under attack. Its very clear whats at stake here. Theres an effort underway to use these discriminatory state laws to deny an opportunity for americans to vote. And feel the burn. He is now within 25 points. Were gaining from that. Thank you. Good to
