The shadows here in the u. S. It is far from the last word. A federal Appeals Court is expected to hear an appeal from the white house in weeks. The fight would make its way to the highest court in the land. We have to look at this decision for what it is. It is a decision by one Federal District court judge. I expect i have always expected this is matter that will ultimately be decided by a higher court, if not the supreme court, a federal court of appeals. His decision has provided ample ammunition for conservatives in congress who are engaged in a battle over the president s executive actions and whether or not to fund the department of Homeland Security. Funding that is due to expire in less than ten days. The news today has riled up republicans, especially republicans named ted cruz. This afternoon cruz said the Texas Court Decision reached last night is a major step in the fight to stop obamas law for amnesty. As of this afternoon, those very same Senate Democrats appeared unmoved. Senator Chuck Schumer said the ruling is unlikely to be upheld but funding for the department of Homeland Security should not be used as a ransom by republicans, period. Can you walk us through the judges decision . It goes next to the federal court of appeals. The government hasnt yet filed its appeal. The attorney general said today theyre looking at it and deciding on the next step, but they will undoubtedly go there. The judge has not directly ruled on that question. He has imposed a stay, an injunction putting the law on hold, the executive order on hold, while the case goes through the appeals process. He said at the beginning it didnt follow the administrative steps. They didnt get notice or comment. He thinks that the states have a good case here. That its one thing for the administration to say this is a matter of prosecutorial discretion. The judge is doing more than that. It is not turning its back to them. It is affirmatively giving them benefits, Social Security numbers, benefits. A promise they wont be disturbed if they remain here for three years. That he says is beyond what the law permits. In terms of this challenge to the president s executive actions, given the high stakes the high profile nature of the president s moves, were both sides expecting Something Like this to happen . I think whether the states expected to get an injunction this quickly, i dont know. I think the Obama Administration did not expect a favorable outcome from this judge. There was some belief in the administration that there was form shopping here that they would get it before a judge who has been tough on the administrations policies toward immigration. One of the things the judge says here is there is a question about whether or not the states have a right to sue. He said, yes, they did. He thinks they have every right to bring this case. Pete williams always good to see you. Thanks, pete. With me now is ari melber and sam stein. Ari, the general consensus is this will ultimately favor the white house and its decision. Do you concur with that . I think it is fair to say the appeals judge will have a much more openminded and reasonable approach than what we know about this particular judge, which is not to impugn this federal judge. But one person at a district level versus what you get if you go to the aggregate. I think it is fair to say traditionally immigration policy has been the federal courts purview without a lot of judges questioning that. Having said that to be fair of the criticisms of the administration here traditionally you havent seen president s reach this far into their authority to tweak that policy. Sam, there are multiple sides to this. Theres the political. Theres the social and of course there is judicial. From the political standpoint theres the fight in congress that is headed toward a cliff, as all fights in congress seem to be these days. This would seem to be a shot in the arm for republicans. Do you think this means the dhs will be defunded come february 27th . It is tough to say right now because in part lawmakers are not here. To get a sense of the caucus you need to go out to the districts where they all are right now. Republicans feel alleviated by this decision. They think it gives credence to their argument that this is illegal action taken by the Obama Administration. We can defund dhs and let the courts take care of it. Thats not going to be an option for them. They want to have a political statement. They want to defund the program in addition to seeing it work through the court system because there will be different venues down the road so they want to pick their battle right here and right now. The dhs funding is not going to effect any of the things that republicans want to effect visavis immigration. Democrats dont want to set a precedent of allowing republicans to use appropriations battles either for agencies of government or for the government at large to extract policy concessions like this. They think it would set a bad precedent, and they dont want the next two years defined by standoff after standoff. This program is now temporarily suspended. It is already suspended. I want to get into the sort of root of the judges issue with the president s executive action. I think progress is an extensive sort of breakdown of just how the president has rationalized this and how it may be legal. One of the things i think progress points out is congresss decision to appropriate only a fraction of the funds that the white house would need to remove every single undocumented person in the u. S. Is itself a legislative judgment that most of these individuals will not be removed. There need to be decisions made as to who is going to be removed with limiting funding. This is choosing who to remove. I think that is absolutely true. When you remove some of the immigration immigration politics people will remember this is how it always works. You can prosecute jaywalking. They do enforce a lot and they do deport a lot, but they were trying to push further on a hierarchy that reflects their security priorities. Thats generally okay. The counterargument is if you like the law that is being suspended, you are probably more dubious. Enough with whats left of the Voting Rights act. Voting is important, but i can take off other things that are more important. My resources are going to go there. One can imagine the outrage. It does matter whether this is one of your favorite laws or not depending on some of the values you bring. Sam, i think there is rightly pointed out on vox the Chilling Effect this is. It is not a permanent measure. It could expire the next president , whoever he or she is could roll it back. Then you have the battle in the courts, which i think makes people more fearful about raising their hand to say they are here illegally. To top it off, there is a processing fee you have to pay to apply for this. Something like 460. Would you be willing to put that money towards your application fee, not knowing if the law is going to be upheld . It can get refunded but that might be something you consider as well. This is a problem that Immigration Reform activists were talking about the day after the president announced the executive action. They know this. They are aware of this. A huge amount of resources has been going to the communities to educate people and alleviate concerns. There is frequently the cry of judicial activism from the right. Liberal judges are being activist judges but it feels like what is increasingly happening as the other two branchs of government are ham strung, more political decisions are outsourced to the judicial branch. Judges are increasingly are making political decisions or that politics is creeping onto the bench. In terms of the implications for that in the long term they do not seem to be good. It is a fact that many of this president s policies have been litigated repeatedly in the courts. What i will tell you about this is it is supposed to be only a very severe step for a judge to come in and say not only do i believe that they will lose this case, the president , but im going to suspend it entirely until it is litigated. That changes the default. That is extreme. The standard for that is irreparable harm. I think that is a heavy burden here that this judge has found, but that can be easily reversed on appeal. Conservatives have been successful at finding judges saying were going to put the onus on the other direction. Not that the president gets some leeway to do this but were going to stop it first and figure out later if it is legal. I think that is what you call throwing a wrench into the system. In terms of counter extremism, which is a huge global focus but specifically here in the United States does the u. S. Or any of the satellite cities that are piloting some of these antiterror programs have a sound method of combatting extremism at this point given how nebulous a lot of these extremists are . We need to give the program a few month, even a year to see if it comes up with positive results. In states like minnesota or places like boston where they have been effected by extremism and for the case of minnesota, we have seen a lot of individuals from the somalis join terrorist groups overseas. They have felt the problem a lot more than other cities, so they might have more success there. Understanding extremes it can be such a generalized term. We have to understand each ideology. One gets concerned when you look at the scope of geography that isis is sort of going viral, if you will the nature of their extremeist ideology that ranges from radical jihadism to being disenfranchised with governments. When one things about the sort of net that we are casting, is it inherently incredibly broad and dangerously so . Yeah. One of the problems is when you have a very broad set of targets. It becomes very easy to slip through the net. Almost a decade ago, the head of al qaeda wrote to the founder of al qaeda in iraq which is now the founder of isis. Half of this battle takes place in the media. This is something isis has been doing very successfully since they took over in june a third of iraq. They have done a very very good job at sort of piercing the media narrative and greating spectacle that allows them to jump from twitter and facebook and just paste in other social media applications to everybodys tvs, everybodys newspapers. Most people have actually never seen any other terrorist tv, but everybody all across the United States knows what isis has done and what they are capable of doing. To that end in terms of the administrations newly announced initiative to counter isis where it lives in terms of propaganda on social media, how effective do you think that can be given isis resources dedicated to this and ours . What we need to be concerned about is decentralizing the media, which is being run by its supporters all around the world. In a way, that strategy could be effective to a certain no way going to have a deep impact on the ground. This community in the middle east needs to counter that narrative of isis. Right. Then theres the question of how do you sell how do you combat sensationalism, which is what isis propaganda is . Fundamentally sensational pictures and video with a message of hope and peace. One of the state department slogans is think again, turn away. While i think thats grounded in sort of a good impulse, i wonder if you are talking to young disaffected young men around the world and whether that is potent. That is the tough nut that the United States is really trying to crack. If youre a young disaffected individual who wants to stick it to somebody and you want to join a terrorist group in far away syria and iraq youre not going to listen to a twitter feed of the United States government. The National Counterterrorism director said governments are not wellpositioned to attack n these organizations in social media because they dont have the credibility. It comes from different other communities, private organizations, and individuals who can take on this task. That said there are individuals you can actually take on. Earlier this year there was an individual who had the twitter handle shami witness. It was a 24yearold living in bangor india. When the cops arrested him, his network disappeared. Thats one way to take these guys off the virtual battlefield. Is actually target each one of them. We focus a lot the majority of our coverage here is on isis. There is very little discussion of bashar assad. He is in many eyes the root of the problem here. There is a photo rebels posted in syria of children in red orange jump suits in a cage. When we are combatting one form of terror, but we have ignored virtually another form of terror which is state sponsored in syria. We have spread ourselves pretty thin when it comes to syria. It is a place we have lacked intelligence gathering. We lacked any kind of legitimate if credible individuals that could give us information or we can deal with when it comes to the revolution but we have put the assad problem on hold to counter a much, much bigger problem that is not only a syrian problem at this point, but it is a problem across borders. Now we see isis expanding territorial in syria iraq and libya and even in nigeria. I think the isis problem is now becoming a true global problem, and it is not just confined to the syrian people.
