Kelly, take me through the guilty verdict. You were there in the courtroom. You heard it it and you sprinted right back over to our camera, god love you and tell me a little bit about what the reaction was on the mcdonnells. Reports are that they were, in fact, sobbing. I heard the sobs myself, luke. The emotion really reverberated through the courtroom and there was a lot of tension today to begin with. The jury of seven men and five women and its been 17 hours working through this case after five weeks of testimony, evidence and witnesses and the conspiracy count and had Bob Mcdonnell and his wife made an agreement to engage in a conspiracy to seek out and accept gifts and loans from a virginia businessman in order to trade for some influence and when that guilty count were read for Bob Mcdonnell and his wife there were loud moans and gutwrenching sobs. I was able to see maureen mcdonnell, her head up and down. Our colleague who was able to see the former governor said he was shaking head in hands as the tears reverberated in the courtroom. I am told even two jurors be goon cry so that gives you a sense of the drama and the emotion. So what was behind this . 11 corruption counts for the former Virginia Governor all based on this arrangement with the businessman jonny will names who received immunity and his company that dealt with Health Products and seeking influence in the state to get Research Money and that kind of thing. Part of what was so difficult to see unfold was the very personal nature of the defense talking about a broken marriage between the former governor and his wife in the most personal of terms and how that would play into their public life. There were a couple of count, luke, where the jury did not find sufficient evidence and that really had to do with accusations they had made false staples about bank loans, but again, 11 counts guilty for the former governor, eight counts for his wife. The sentencing will now take place, we are told on january 6th. Theres substantial jail time that is possible. Though both of them, of course, have no prior criminal record and their lawyers say there are grounds for appeal and they intend to appeal. Now we waited for them to leave. They left separately part of a drama as a marriage described as broken. We saw the governor as he came out after he am coposed himself and he was being braced by family and supporters and then as they came out he responded to shouted questions. The the question was what do you say to the people of virginia . And he paused for a moment and said all i can say is my trust remains in the lord and then he knot in his car and left. It has been quite a drama. A case that could have ended quite differently and they offered a plea deal that would have been one felony count. No charges against his wife and mcdonnells rejected that some time ago and hence the trial that went out for weeks and the stunning verdicts today. Luke some. Kelly odonnell live for us in richmond and a stunning guilty verdict. Governor Bob Mcdonnell and 11 counts and thanks so much for joining us. Now we go to managing editor of the Washington Post and author of the fix, and on the phone is the professor of Political Science and the university of washington, stephen barnsworth and chris, let me start with you. Bob mcdonnell is somebody who for some time was thought to be a possible 2016 president ial candidate. He represented the purple state of virginia and had rather high poll numbers for some time pry aror to the scandal engulfing him. What do you whats your initial reaction considering how high Bob Mcdonnell once was and how far he has fallen . You know, luke, my initial reaction, one word, amaze am or amazed. I guess i shouldnt be. Ive spent basically my entire professional career doing this job covering politics and weve seen lots of these things. I mean, the john edwards saga comes to mind in terms of a politician that rises fast and is laid low and when you find out the circumstances, im appalled and amazed that a politician was able to justify whats happening as just helping out a donor, a businessman in the same way you do anything else. I would encourage people, the Washington Post has an amazing list of things that the mcdonnells took from Jonny Williams, senior, you cant look at that chart and think this seems reasonable. This is conceivable. Its just not possible. I think today was an affirmation that the jury looked at it and thought this doesnt pass the smell test or, frankly, come anywhere close. Not at all. Professor farnsworth, one thing thats important to note is virginia has rather lenient laws in terms of the gifts that can be given to politicians in office. Essentially it it can be unlimited. They just have to be declared. Talk a little bit to our audience about how striking it was because the prosecution did not have an easy any of it here to convict governor mcdonnell that he was guilty of conspiracy to defraud citizens of virginia of the right to honor services. It speaks volumes to me with this case because it it had to be brought in federal court because the state laws were so full of loopholes and there were so many evasions that a politician could use under state law to get out of this that the federal prosecution was really the the only way to go after the mcdonnells on this case and theres no doubt about it. This list of goodies that have been provided to the mcdonnells and their children really is an extraordinary list and when we live in a time of such high levels of citizen discontent with politics, with citizen frustration and government officials, this story is exactly what makes so Many Americans mad about the special treatment that they think that politicians are able to enjoy. This very public discussion of the ferraris and the vacation trips and the rolexes really speak to the extent to which money can corrupt politics, and there are challenges because they dont go in the same direction all that often. Especially in a year when being an incumbent is so poisonous. We are right across the river from virginia and we get a lot of the Virginia Political ads and a lot of the attack ads and there is always something discussed in the virginia gentlemans way dating back to Patrick Henry and Thomas Jefferson that no governor would ever try to mislead the public to this type of criminal degree. Talk a little bit about that for our audience. If in virginia, their citizenry is probably not as used to this as one in new jersey or illinois. Or louisiana. Right. Look. Its the cradle of president s, right . This is where the democracy sprung from. Whats amazing to me, luke, is you look at Bob Mcdonnell and i wrote a piece about this and i hope its on the internet at this point that just looks at two and a half years ago, i ranked the ten people most likely to be picked by mitt romney as his running mate and this was march 2012. Bob mcdonnell was number two on that list and the only person that headed him was marco rubio. The idea that someone that was that high up in the regard of people both in virginia because i had been hearing about Bob Mcdonnell for a long time when he was in the legislature and became attorney general in 2005 and once he got elected governor in 2009 and this was the guy who was supposed to have the it factor, charisma and common touch and could talk to social conservatives and not be able to businessminded republicans and could win on a jobs message and yet, im with the the professor and you look at the list of things here, and i just its remarkable. No other word other than appalling particularly for someone who was cast as this big rising star and had such good judgment who knew the right political weight. Just in terms of politics. Theres no way Bob Mcdonnell could have accepted having his wife and family and kids and was even close. The so brain dead. Thats whats amazing. You look at this and have a 50,000 check from Jonny Williams trust to the Real Estate Company owned by Bob Mcdonnell and his sister and you had 15,000 in catering for the mcdonnells daughters wedding. Lets take a listen to what he said as he was leaving the courtroom. All i can say is my trust remains in the lord. Professor, you heard that right there. All he says is his trust remains in the lord. What is the future for Bob Mcdonnell now presuming he will see some jail time, dont you think so . The first step is going to be an appeal by the by the mcdonnell team. There were a number of decisions that the trial judge made in this case in terms of the jury instructions, in terms of evidence that was permitted, pretrial motions and a lot of things. The judge made a lot of decisions that were in favor of the prosecution in terms of the jury was given this case. Some of those will lead to some questions in the appeals process to try to imagine all of of these countses overturned, thats a pretty high bar. In the short term, the question is what will happen on appeal . In the longer term, as your correspondent mentioned at the outset, were looking at years and years in prison if these charges stand. This is a devastating defeat not only for the mcdonnells and for the myth of the virginia way that you spoke out about a while ago. It was much more a gentlemans profession with proper behavior from all sides. Chris, well finish up with you. Do you think this has legs in terms that it could affect the Virginia Republican party at all because most players within the party have been going through Great Lengths to distance themselves and specifically ed gillespie trying to knock off mark warner of virginia. Does this have a large, lasting stink for the party in virginia . I think the the stink that exists did not help the party. This is not a brand gnaw thing and obviously the trial and the jury is new and this has been ongoing and it has hurt the Virginia Republican party. My guess here is what you will see the likes of ed gillespie rung against warner and you seal an attempt to break from what will be the mcdonnell era of the Republican Party to cast yourself as a reformer against that what Bob Mcdonnell now officially legally pending appeal, obviously, but legally represents. So i think whoever runs for governor in i guess a couple of years time now will be in some ways casting themselves as the antiBob Mcdonnell which given two years ago the guy was seen he was seen as the prototype of what you want in a Virginia Republican. Trailblazing comedian and actress joan rivers passed away this afternoon at the age of 81. Her daughter melissa released the following statement, quote, it is with Great Sadness that i announce the death of my mother, joan rivers. She passed peacefully at 1 17 p. M. Surrounded by friends and clo friend family. Cooper and i have found ourselves humbled by the outpouring of love, support and prayers weve received from around the world. They have been heard. My mothers greatest joy in life was to make people laugh. Although that is difficult to do right now, i know her final wish would be that we return to la r laughing soon. Rivers got her start as a serious actress on broadway before finding success on the new york nightclub circuit. She was guest hosting the tonight show with Johnny Carson. When rivers got her own talk show years later her relationship with carson was irrep arably damaged and Edgar Rosenberg committed suicide, but rivers persevered. She continued her wildly successful standup career. Starting in 1995 she began hosting the preaward show for the Academy Awards and through it all joan rivers never lost the fearlessness that made her comedy so unique. Rivers was hospitalized last thursday after going into cardiac arrest during a routine throat surgery. She was in intensive care until today. Heres how rivers was was she moved to a private room from icu because her condition was improving . That was one question that they were asking and was she moved out of icu because they were trying to lower the amount of pain that she might have been encountering in icu and a day before we got confirmation from Melissa Rivers on tuesday that joan rivers was, indeed on life support although many had surprised that was the situation and over the weekend we knew that she was in critical condition. We had learned that from melissa, and so just within the last week that series of events and those small pieces of information that we had received had led us to this point and just by the number of people here and the folks that ive spoken with, many are very upset to see that unfortunately, joan rivers has passed away, again, about three hours ago at age of 81. Indeed. She was such a pioneer. Youre seeing these tributes coming in about how she was able to move forward in comedy which is such a maledominated business and hence why you are seeing such a large outpouring of support. Today the allinessa faces its grailest challenge since then. Anders rasmussen outlined it earlier today. To the east, russia is attacking ukraine. To the southeast we see the rise of a terrorist organization, the socalled Islamic State that has committed horrific atrocities. To the south we see violence, insecurity, instability. Here at the summit we will take important steps to counter these threats and to strengthen the defense of our allies. Although ukraine is not a member of nato, to the dismay of russia, president Petro Poroshenko was in attendance at the summit today meeting with president obama, Angela Merkel and David Cameron, but as nato members saw to demonstrate the strength of their alliance, yet another challenge was present as hundreds of of protesters were marching in opposition to new warfare, saying no to nato and no new wars. Joining me now to talk about all of this is deputy spokesperson from the u. S. State department marie harf. Marie, thanks for being on the show. Ill start you off with the question regarding ukraine. Is there a worry that ukraines presence at this nato summit that perhaps that the u. S. And our partners hugged them a little too close considering how fragile the the negotiations are going on right now between russia and ukraine considering the desire for ukraine to be into nato and that is something that russia does not at all want to see . Not at all, luke, i think weve been clear that well stand by ukraine as theyre facing a very, very serious security challenge not only in crimea, but in large parts of eastern ukraine. So the nato summit is a chance for us to come together with our nato allies and discuss issues of mutual concern. Ukraine is obviously a huge issue that all of us care a great deal about. So is the threat from isis. So is what happens in afghanistan after 2014. So wells a number of agenda items on the table for the nato summit this week and ukraine is a huge one and an appropriate one. I want to turn to isis which is the threat that king abkulla from saudi arabia said could come next month. There is a large, broadbased coalition to combat the threat, considering when we give so much armament to countries like saudi arabia and jordan and they themselves are wealthy. Should they not be part of this coalition and should they not be putting forward their own military assets to combat this threat to behest the United States. Absolutely. The countries that we are having constant conversations about and will be in the coming days about what role they can potentially play to help us fight back against isis. They arent just military tools that were talking about with these countries. Theyre financial tools and some of the private citizens of these countries are, for example, are funding isis. How can we cut off the flow of foreign fighters for countries that border syria and iraq and those are conversations that we want to have with these countries and we want them to contribute in any way they can because they recognize how serious this threat is to them, as well. Joe biden said yesterday that the u. S. Is going to follow isis to the gates of hell. Does that mean we follow them to syria . That means we will hold accountable people who hurt or harm americans and we have been clear about that and that also means that we will not be restricted by borders or boundaries when we talk about how to take the fight to isis. Weve done so in iraq against isis targets already, but we are having a conversation and actively looking at options for where else we can confront this group and how we can can degrade their abilities to attack there and also possibly to attack us and in the end, really defeat this organization. Can we pursue isis in syria without at least some sort of tacit agreement with Bashar Al Assad. To be clear, were not going work with Bashar Al Assad with anything, certainly not on this. We will make decisions about our actions based on the National Security interest and when the United States people or interests and assets are threatened we will make those decisions and Bashar Al Assad is not the issue and he is one of the reasons why isis is so large. Were looking at a range of options and i dont want to get ahead of that process, but the president has said, hes been very clear that we will go to any length and not be restricted by borders to make sure that we take the fight to isis and that our people are safe . Is there some sort of danger attached to that in case assad were perhaps to go after u. S. Troops that they invade that u. S. Plane if they were in that airspace or Ground Troops going after isis there . Well, i dont think u. S. Ground troops are going into syria. The fact is that Bashar Al Assad doesnt control syria. He controls the spine of syria which is a very small portion and its mostly a failed state which is why it is such a logical place for isil to organize and lets remember the l in isil, is levant. Its not just syria and iraq. Its also jordan, lebanon and the entire region and i heard you talk about saudi arabia and the uae. Its phis thnice that they are supporting us, but frankly, i think dennis ross who is a special assistant to several president s has it it right when he says that saudi arabia ought to be convening a regional conference to fight against isil because i believe that if isil gets more traction and more real estate its going to want to make mecca the capital of this faux caliphate that theyre trying to set up so its very much in their interest to get onboard. You talk to americans around the country and the question is always posed. We give all of this funding to saudi arabia, we sell them our arms and same thing for jordan, but when it comes to actually be a part of the fight they are almost always nowhere near the front and often reluctant to have their hands anywhere close to the battle or to be attached to the United States. What can president obama do to try to break through this hesitancy on behalf of the supposed allies in the region to help us out with a threat like isis. Well, jordan is a fragile state at this point. There are a let of palestinians and theres been unrest on that front. Jordans also been attacked modestly so far by isil and it has been our staunch ally with respect to israel. So i would go easy on jordan. On the other hand, saudi arabia is a very wealthy, very powerful center of the region. It is a sunni state and lets understand that isil wants to dominate the entire region, and saudi arabia has a lot to lose. So i anticipate that when Congress Comes back theres going to be pressure on saudi arabia, and by the way, Congress Needs to get into the act. A number of members now are talking about the fact that the authorization to use military force against iraq which passed in 2001 with my vote and with the vote of many people or 2002 it was iraq and 2001 was the one im talking about in afghanistan doesnt apply to action in syria, and the president has a 60day window as commander in chief to do whats necessary to protect u. S. Interests and after the 60 days expire well need legislative approval here. Its important for congress to exercise the constitutional responsibility to declare war and to represent the American People in the conversation. Theres a lot at stake for america and theres also a lot of cost for america and i think the American People need to be the ones to make this judgment. And were certainly hearing that from both sides and we have ben nelson from florida. Luke, this could be a chance for the president to reconnect to congress and for both parties of congress to get into this on a bipartisan basis which was the historic way congress did things like this. Ethnic people irish cry you say to an italian woman, your mother died and its a very emotional thing. And she hated her, but you say to a whats your mother died. Who got her shoes . This was a routine surgery done in an endo center and i talked to one medical profederal building said this could have been prevented depending on what types of medication could have been available at the time. Theres more we dont know than we do know. She went for an outpatient procedure presumably on her vocal cords and maybe she had hoarseness, maybe she had ref x reflux, but something happened during that procedure. Its possible because of her age that she was more susceptible to the dose. Its possible that she had a drug reaction. Its possible that some gastric acid could have come up and caused spasm of her airway. Something happened where, i believe, she stopped breathing, and then had this sequely afterward. These events are very rare and most people who undergo outpatient end on skopy, one, come out just fine and theres Something Else here. When she had this event the doctors were able to admit her to mount sinai. So any time you go to an Outpatient Clinic you want to make sure that that doctor for even the slightest procedure has admitting privileges at a nearby hospital. So very important. Dr. Nancy, whats the next step in terms of all this. Obviously, there will be a fullon investigation because of her celebrity and that will obviously occur. How does that play out . This is a doctors Worst Nightmare and no physician anies through a whole career without having bad things happen, but when its a celebrity it plays out in public. So the end on skopy certain will be investigated by state authorities and i wouldnt be surprised if there is a lawsuit filed and pled cal records will be made public at some point and there are privacy issues here obviously because of hipaa, but just as we did with the Michael Jackson issue which i think was easier to see the the flflaws b we knew he was getting medicines he should not have been receiving at home. Until we see the medical records we dont know what went down and when we do see them it will be easy to put the pieces of the puzzle together. Nbc news dr. Nancy snyderman. Thank you so much. I mean, its hard to say, luke, with an 81yearold woman. She died way too young, but in joans case, she was intrepid. She was bounding back and forth across the country twice a week, telling jokes and doing stand up and taping tv shows and never stopped working. Amazingly, at 81 years old think of other comics at that age. So relevant today, res ilyebs and relevance. A relevance is not a word im hearing enough because she stayed on top on of pop culture and most of her zingers were stingers and she was just not afraid. You know this as well as anyone, we live in a pretty politically correct world right now. Joan rivers got a pass. She was grandmothered in, you know . She was not afraid to unload a bomb and she got a pass on it it. She was great. I think the world you say, you know, there could never be another joan. I dont know if there could be. Yeah. I dont think the societal times would allow that to occur and you talk about her relevancy and you always talk about a comedian in order to stay funny for so long you have to constantly reinvent themselves and that is not easy at all to appeal who was watching the Ed Sullivan Show in 1967 and to appeal to kids in their teens who are watching e, the red carpet show. That is not easy. Talk about how she was able to con santly reinvent herself and reach such a diverse audience regardless of age. She loved to beat up on celebrities. Celebrities come and celebrities go and joan always remained and whoever was the hot celebrity she would keep beating up on them and yeah. Shes, you know, on e s Fashion Police and the network. This afternoon attorney general eric holder officially announced a civil rights investigation into the ferguson Police Department. Separate from the Justice Departments investigation into whether shooting victim Michael Browns civil rights were violated. We have determined that there is a there is cause for the Justice Department to open an investigation to determine whether Ferguson Police officials have engaged in a pattern or practice of violations of the United States constitution or federal law. The Washington Post notes the investigation will represent the obama administrations most aggressive step to address the ferguson shooting. The doj will look at the ferguson Police Departments conduct over the past several years to see if there is a pattern of civil rights violations. Specifically, the departments history of stops and arrests. In 2013 fergusons black residents were the targets of 92 of of searches and 82 of car stops despite the fact that one in five black residents were found carrying contraband compared to one in three whites. It will look into the alleged excessive abuse by Ferguson Police officers after the Washington Post reported that at least five other Ferguson Police officers and one former officer had been the subject of civil rights lawsuits including allegedly killing a mentally ill man with a taser, pistol whipping a child and hog tying a child. I had the chance to speak with a number of local residents. I heard from them directly about the deep mistrust that has taken hold between Law Enforcement officials and members of that community. People consistently expressed concerns stemming from specific alleged incidents from general policing practices and from the lack of diversity on the Ferguson Police force. With me now is the executive director of color of change. Rashad robinson and you just got back from ferguson recently. Interestingly enough, the chief said the relationship with the community was excellent. You were on the ground. Of of the relationship between the Police Department in ferguson and the community excellent . Im not sure what community hes talking about. I was on the ground working very closely with the activists, working to sort of elevate their voices in this conversation and over and over again as weve had these conversations people talked about incident after incident of mistrust, also as the incident, you know, happened and then the weeks and the days afterward. We saw a demonstration by the locals that show that they were simply not ready for prime time. We saw the police chief have press conference after press conference that sort of underscored why the community couldnt trust the Police Department and how they were criminalizing Michael Brown in death. Over and over again, it was illustrated to me that the locals had no trust whatsoever. This is significant because i think an important distinction to make is this is not just doj reviewing the actual shooting death of Michael Brown and that will be an onanything investigation it will do about it and well expect to hear more about that in october and this is a fullscale review of the policing practices of ferguson going back over many years and looking at all those complaints brought forward by residents. For an organization such as yours, how important is it that the obama Justice Department is anything forward on such a largescale review of what is an issue until ferguson did not nearly receive the amount of Media Attention that many felt it deserved. We think its incredibly important, luke. You know, this is exactly why we have a federal government, when local and state officials cant sort of move the ball forward on civil rights, cant actually do the job thats necessary in ensuring equal protection under the law, our federal government has to step in and not just for ferguson. We hope this sends a powerful message across the country. Over and over again, we hear these incidents at color of change and we hear the voices and stories from our members and everyday people who send their incidents with police and Law Enforcement, the lack of trust, the breakdown of trust between community and urban and poor settings and Law Enforcement and that does nothing to create safe communities. It does nothing to build the type of trust that communities need to have in Law Enforcement to actually solve real crime and so we hope that this kind of moves the ball forward in ferguson, but also sends a powerful message around the country that we have a doj that will step up and will get involved when local author onities renege on the responsibilities of the community. In a broader sense one thing that is at issue here that does not get enough attention is that youre starting to see kids as young as 8 or 9, children of color who feel a sense of stigma attached to them by the Police Department, and i have a lot of friends who teach in inner city communities around the country and they always say that this is a huge, huge issue as the kids that young feel that they are being targeted by Law Enforcement or that they will one day grow up to be targeted by Law Enforcement. Talk about that for our audience about how that sits in the minds of children of color that they could one day be unfairly targeted and what that means for them to be full members of a community. The dehumanization that we see whether its from the media images that come into folks home and to the way that young people are treated in homes and we see studies around and implicit bias where you see young, africanamericans with third grade, second grade, first grade are not able to be children and are over punished and oversuspended and overdisciplined in schools for infractions that kids, that white kids would get a slap on the hand and theyre saying, oh, theyre just being a kid. The fact that young black kids are not able to be kids and that theyre moved into the present Industrial Complex and into the pipeline from the school house to the courthouse. We see this over and over again. It does nothing to sort of give people access and opportunity for the future. It does nothing to uphold Law Enforcement and maybe as a career that people want to go into in the future and it really damages and hurts the potential for us to be able to have sort of access to these great minds, to the future minds of our community and our society, to be able to be the inventor and to be the doctors and the Law Enforcement figures. A culture of distrust also permeates and is a very difficult thing to overcome when you start to feel that as young as 8 or 9 years old. Rashad, thank you for being on the program. We appreciate it.
