Ive been consistent with that in this investigation. Im going to continue to be consistent with that in this investigation, but to confirm, she has not brought power tools into the facility based on our investigation. Meanwhile, an entire upstate community is on a virtual lockdown with the men still one step ahead of the more than now 500 agents hunting them down. Nbcs john yang joins me now from morrisonville near the search site. John we heard from authorities that mitchell did not provide them with those tools, so you now have people wondering, was there another person involved in this, and what kind of scrutiny do guards and contract workers go under when they enter, meaning a metal detector are they also searched . What do we know . Reporter there is no search going into this maximum security prison, which i find a little surprising to me but other former guards who worked there tell us that people can go in and out, their bags arent searched, theyre not patted down, there is no metal detector, so small things can be taken in and out of the prison by employees, by civilian employees like Joyce Mitchell all the time. They are continuing this investigation. Theyre talking to civilian employees, private contractors and other employees of this prison to see who else might have taken contraband in for these two prisoners. That investigation continues. You know officials tell us that Joyce Mitchell continues to be questioned continues to provide information. The District Attorney said her first information was not terribly helpful, but as the conversation has continued, she has been saying more and more and that the decision or anything to bring charges against her will wait until they feel theyve gotten as much information as they can from her. Tamron . John if she did not provide those power tools, what are Authorities Saying she did provide . What support, then did she provide them . Reporter they wouldnt characterize that. We asked the District Attorney what is contraband . He said contraband can be anything from toothpaste magazines, food candy to cocaine. And we asked if he could characterize what it was that Joyce Mitchell has said that she took in and he said well its not toothpaste and its not cocaine. So anywhere in between there is what were dealing with. Okay john thank you. Joining me by skype is sheila eisenberg, author of men who kill and takes a deep look for women who fall for convicted murderers. Also one who knew the both fugitives. Thank you for joining me. For this woman who believed she was in love and called these men manipulators and charmers, i suppose when you work in a prison, you go through some kind of course or training to prepare for these guys who may try to work you. Sure. Im sure you go through a training and a course as you say, but it doesnt really have any effect on the psychology of who you are as an individual person, and Joyce Mitchell may well be a woman who was susceptible to being sucked into a con mans con, and she may have had a background and a psychology that set her up to get ro mantically and i put quote marks around romantically involved with one of these men. Im not real clear on which one she was involved with since the story keeps shifting. She admitted to authorities she thought she was in love with at least one of them. With that said for her to even say that under this investigation, i believe that i was in love from your study with women who fall for these hard and dangerous men, is there a Common Thread . Is there something that they are seeking . There is a Common Thread and yes, there is something theyre seeking, but theyre not seeking it on a conscious level. The study i did for women who love men who kill which you say is now on ebook all the women i interviewed had several factors in common. First of all, the majority of them were catholic. I dont know joyces religious background. The majority of them 95 had been abused in their past by their parents, their fathers, their first husbands earlier boyfriends. They were victimized sexually psychologically or physically. So when they got into a relationship with a convicted killer, a man on death row or in for life, as strange as it may seem to the rest of us this is a relationship where they had power and control because they were the ones who could decide do i visit, do i take the phone call . In joyces case do i bring in the contraband . And these are women who had, in the past as i said been abused and been victimized. We dont know enough about her background if any of those apply to her, but in your research you found a Common Thread with the women you studied. Let he bring in emil. You found a number of things in common with women, including your exgirlfriend. Yes, and i want to interject that there is at clinton an amazing amount of interaction with the inmates, and i spoke to actually one person who used to be a supervisor there, and she was given a note at one point, and it was one time and she ended up having to immediately relay it to her supervisor to a co and that was where this is something where maybe its not so overt, it can be subtle like the dropping of a letter. And Something Like this this was at the clinton facility this was somebody who knew mitchell. This may not have been everyone may not have heard they were having coffee together on an ongoing basis. But back to Richard Matts background what youve learned about him beyond what we read from his Court Records and the awful crime he was convicted of. So what weve learned is that he basically liked to frequent canadian strip clubs, specifically one called platinum pure platinum. And there he dated a girl by the name of corrina where he would go there sometimes three times a week. And he would throw money around he bought people drink he liked to flirt with some of the other girls. They would crash at a motel behind there and all the while, he was making good with another some of the people that he was committing crimes with and when he was doing that he was getting them to basically do his bidding by threatening other women. So the person we were able to speak with at the daily beast, we were able to talk to someone who was basically threatened un unbeknownst to her whose sizekick was committing terrible crimes. He had an incredible amount of charisma and power to lord over other people who you think would not be intimidated. Were looking at his mug shot right now along with the other man he escaped with sweat, and one does not instantly see a romeo. Granted, hes in his prison garb, but everything i read about him, he knew how to really work, and if the word is appropriate, and con people. I was told he could be a salesman. You have to understand he also was taking license with the legitimate job he had. He was ripping off rikers. He was selling with a network of people in canada. He had a way of getting in and out of canada not always legitimately, right . He was able to scale through the whirlpool grid the train only bridge, and he did it without being detected. This is somebody who has both foresight and skill to remain undetected and also was able to keep friends at a great capacity. Thank you for your information. Developing now, weve learned new details in the past hour in what Authorities Say was a chilling plot to kill Boston Police officers. That plot foiled last week. Now in Court Documents filed just this morning, the fbi says the plot was intended to support isis. Overnight the fbi arrested another suspect believed to be involved in the plot. The suspect, nicolas ravinsky is now scheduled to appear this federal court in boston this afternoon. Nbc news correspondent reports in washington. Reporter this had some detail of what law officials said was this plot they believe they foiled in boston. Overnight the third man was arrested, someone who had been questioned by the fbi, we watched his house being searched last week. His name is nicolas ravinsky he is 24 years old. Hell be in court at 2 00 this afternoon to face these charges. What the Court Documents say is these three men, usaana rahim, the one they questioned in a parking locality ast as he prepared to board a bus with a knife, and they had been talking about this broad plot since last month. As they said last week the initial plan was for rahim to use one of these knives he had ordered on amazon to behead Pamela Gellar the woman who created the drama in texas, but at 5 00 in the morning, rahim changed his mind and decided to instead attack Boston Police officers. They said ravinsky had actively uploaded material about isis on his computer and they believe he, in fact along with the other two, were doing this in order to support isis. A couple other things that are in these in addition to saying the new things about ravinsky, it also says that rahim had said that he wanted to meet allah and leave this worldly life. In other words, he said he thought the plot would end with his own death. They found a living will in his house, and they thought he was trying to erase files and get rid of any digital trail. U. S. Officials acknowledge the massive hack into government personal records was more serious than originally thought when it was revealed last week. Now it turns out some of the stolen data was from diplomats and other workers with security clearances who deal with nuclear and trade secrets. But a spokesperson for the Governments Office of Personnel Management denies claims now being made by a federal Employee Union that the hacker stole data on every single federal employee past and present. That would be up to 14 million people. Now, the office of Personnel Management tells nbc news that the numbers are no different than reported last week. Data was stolen on 4. 2 million present and former employees. The hackers are still believed to be from china, and that may have accessed a Government Data base undetected for more than a year. An ohio prosecutor is vowing it will still be left up to a grand jury whether to charge the Cleveland Police officers involved in the death of tamir rice. That is despite a judges ruling yesterday, finding probable cause to charge officer Timothy Loman with murder and his partner frank gambrak with negligent homicide. In a Statement Issued shortly after the judges ruling from Cuyahoga County said in part quote, ultimately the grand jury decides whether Police Officers are charged or not charged. Judge Ronald Abrams ruling is only an advisory and does not affect the second grand jurys investigation. He is acting on a rarely used provision of ohio state law invoked by activists. They independently sought charges after they lost confidence, they say, in the grand jury investigation. Its been more than six months since tamir rice was killed by officer Timothy Loman in that. This court is thunderstruck by how quickly his event turned deadly. Im joined by john birchurch. Hes been involved in high profile cases. Thank you for being with me. Thank you for having me. They said this decision will be in the hands of the prosecutor despite the strongly worded decision by this judge. Thats absolutely correct. Obviously the grand jury is the one who makes the decision but i do think the judges opinion in his analysis gives a clear road map for the prosecution that will create expectations for the prosecution to at least consider what has been said and will be difficult for them to just ignore it. From that point of view it is correct the grand jury makes the final decision. And of course the judge was only looking at probable cause. The d. A. In presenting this case obviously looks at probable cause, but he looks down the road to see if he has the kind of evidence available to him that proves the defendant is guilty beyond a reasonable doubt. He doesnt have to present to the grand jury but in terms of assessment of the indictment im sure its an exception. How does that decision or ruling from the judge specifically factor in . The prosecution right now, they know theyve seen the evidence theyve laid out a potential case against these officers here. How does the judges ruling lead to being a road map . Well the judge has given an analysis that leads to probable cause. And the d. A. Also has to review the evidence and he may also find likewise in terms of what has happened. So from his point of view, the prosecutors point of view does have an analysis thats laid out. The public now has that analysis and the d. A. Is put into a position to evaluate this analysis. If he comes to a different conclusion, hell have a public consternation about it. What the judge has done is kind of put pressure on the d. A. To say this is how it can be done this is what ive found. If you have something different, youll need to explain that to the public at large. The attorney representing officer Timothy Loman said in fact, the order issued by the Municipal Court does not and should not impact the investigation being conducted by the Cuyahoga County sheriffs department. We respect the authority of the cuyahoga prosecutor to investigate and review this case, and we all have the responsibility to respect our Justice System. Certainly we know the emotions and rightfully so involved with this case given that youre talking about a child, and also the climate, quite honestly was very close to this time last year when we were talking about ferguson and mike brown. Here weve had nearly a year of these kinds of cases where people believe theyre not getting justice, and you have this strongly worded ruling from this judge. If the grand jury chooses not to indict here john just from your personal and professional perspective here what does that mean . Well it certainly would undermine the integrity of the system itself and cause people to disbelieve and be disillusioned that the criminal Justice System will in fact not protect the lives of africanamerican men and women or anyone killed by police. This is a case where you have not only video cameras, you have a 12yearold boy, and as the judge said you have a very short period of time for a decision to be made. Did the officers act in a negligent way . Did they fail to employ proper tactics, et cetera . So the public can now see what can be done with this evidence. If they do then the question is how can you have faith in a system that ignores evidence if you will and gives undue credit if you will to Police Officers in this situation . Thats not to say police dont have rights, obviously they do but there is evidence here that would suggest to the judge that they have committed a criminal act, and there is probably more evidence in terms of the overall assessment that would support that. If you dont charge certainly i think the general population not only in cleveland but around the country would have a very poor impact and belief about the legitimacy of the criminal Justice System as it relates to africanamerican men being killed by police. Nationwide is on your side developing now, the last of the three highprofile louisiana prisoners known as the angola three could be set free this afternoon after spending more than four decades in solitary confinement. Albert woodfox is the only member of the infamous angola three behind bars. The case of the three in solitary confinement have been taken up by human rights activist groups saying the time in confinement is inhumane. A judge ordered earlier this week saying woodfox be released immediately, saying the state never proved that he was responsible for the stabbing death of a prison guard 43 years ago. But an Appeals Court stayed his release while deciding whether to hear an appeal from louisianas District Attorney who wants to try woodfox a third time. The stay expires this afternoon. Nbcs mark potter joins us now from st. Francisville louisiana where Albert Woodfox remains behind bars. Mark, what is the latest from there . Reporter we await the decision of whether woodfox will be released. After 43 years behind bars for a small murder he and his supporters say they never did. He was convicted twice. Twice those convictions were overturned. He was indicted for a third time. As you said earlier this week a judge said too much time had passed, too many witnesses had died. There was no way to have a fair trial again, so he ordered woodfox be released. However, the state is appealing that ruling saying woodfox should stay in jail for the length of that appeal so thats what were waiting for. Woodfoxs attorney also says another problem is that the states case is just very weak. There is physical evidence that was collected in this case. There is a bloody fingerprint. That bloody fingerprint belongs to somebody but we know it doesnt belong to Albert Woodfox or any of the other men who are charged in this crime. There is no physical evidence that links mr. Woodfox to this crime. Reporter now, his lawyer and supporters say they were falsely convicted of murders in the 1970s and were targeted because they were organizers of a black Panther Movement within the prison to protest harsh conditions within the angola prison. The lawyer also said woodfox is in very poor health right now. He needs to get out if he were to survive. He was also subject to decades of Inhumane Treatment to 23 hours of lockdown in that jail. The state, however, says woodfox is a violent criminal who twice convicted, and despite the fact those convictions were overturned he was never found not guilty evernever acquitted. We await the courts decision and if he comes out, hell come out right there. Tamron . We talk to someone who has written extensively on the case and met with Albert Woodfox yesterday. Thank you for your time. Thank you for having me. Can you tell me anything about the conversation you had with mr. Woodfox . Does he believe hes leaving that prison today . Hes developed an ability to survive this by not allowing himself to see past the moment. So hes not entertaining thoughts about anything past what hes able to see at the moment, but what i will tell you is that we talked and laughed and had a very relaxed visit. He is at peace because he finally feels the truth is being revealed to the public. What he wants the world to know is just purely facts so that people can make their own very reasonable decision based upon the facts of this case. And that has been suppressed for 43 years largely due to misconduct. There is not only a lack of physical evidence but the three inmates that they did use to testify against him were all habitual offenders with criminal histories that the state offered inducement. There is a serial rapist that they used to testify against mr. Woodfox who was permitted to actually walk free in exchange for this testimony. There was a blind man, a legally blind man that got under oath twice before two prior juries and said he saw mr. Woodfox do something when he couldnt even see. And then the third man later was released after his inducement only to go out and commit additional crimes in the state of louisiana. So when the state talks about mr. Woodfox being a criminal, they obviously have forgotten that theyve made deals with criminals in order to keep mr. Woodfox in jail. There is no evidence to keep him there, and there is no legal justification for these extreme conditions of solitary confinement. He is 68 years old. He has diabetes high blood pressure, he has panic attacks and a host of other health problems. And the only thing he wants at this moment when we talked yesterday, i said do you want to plan a dinner perhaps . What do you want us to do for you if you do walk out tomorrow . And he said the only thing i want is to see my mothers grave. He was deprived of that. They were so cruel, they wouldnt even allow him to attend her funeral. So hes right now very faithful very trusting in the ability of god to deliver him a miracle today. And he is aware that this is not just a local issue, this is not just a national issue, this is now an International Movement and this is not going to stop until hes released. This injustice has to come to an end today. To your point, there have been documentaries, at least three, about the angola three. Supporters have always maintained that these men were convicted because they protested the harsh treatment and harsh prison conditions that existed at angola and also were part of the black Panther Movement. You talk about the innocence factor here. His convictions were overturned. However, teeny rogers the widow of brent miller she believes mr. Woodfox is innocent despite being made a widow from someones crime, and let me play what she said. To know that they were there for all them years, it just it breaks my heart. It just breaks my heart. To spend time especially knowing that you havent done anything to deserve it. I cant even imagine it. Cant even imagine it. And many people feel that very way, but beginagain, that is the widow of brent miller saying she cant imagine it because she believes theyre innocent. With that said in addition to the cases, there have been reforms as a result of what happened to these three men. We should note that at least robert king will be talking with us on monday. Mr. Wallace was released october 1st 2013 and after those 41 years in prison he died just a few days later. But the spotlight, for lack of a better description, was put on what was happening in that prison and others regarding the treatment of individuals there. Yeah and the important thing to remember about angola back in 1972 when this crime was committed is that angola was segregated. First, angola had a system of actually using the caucasian inmates, giving them weapons and letting them serve as guards. Angola had also been under an order by the United StatesSupreme Court to reform some of the conditions because the Supreme Court said they were violating the constitution in a number of ways. So this was not a safe prison. It was run by sexual exploitation, and it was run by a number of constitutional abuses. And so what mr. Woodfox and mr. Wallace and mr. King did was very courageous. It had nothing to do with race it had more to do with human rights and making sure if they were going to be locked up, they were going to be done so humanely. They did what they did to protect other peoples children and that is why at this time people are responding in kind. They are getting now support from all over the world because people are finally seeing the facts. And its not just his team its not just his lawyers, its not just the widow, its actual federal judges who have gone on record to call this what it is.
