Good evening, im chuck scott here in washington. Were going to get to explosive developments involving the president after there was very serious discussions with people like Rod Rosenstein about removing the president from office amid concerns he was working for russia. We will unpack that story tonight. The end of one potential crisis and the potential start of a new crisis, the president planneding to Mitch Mcconnell took to the senate floor to announce finally that mr. Trump would, indeed, sign the bill, but that is not all that senator mcconnell had to report. I just had an opportunity to speak with President Trump, and he, i would say to all of my colleagues he is prepared to sign the bill and he will issue a National Emergency declaration at the same time. I indicated to him that i will important a National Emergency declaration. Just in the last hour or so, the white house confirmed an intent to sign a funding deal. Members of the president s own party warned him about using this potentially illegal maneuver to get his own way. I know the republicans have some unease about it no matter what they say because the president , if he can declare an emergency on something that he crated, an illusion, just think of what a president with different values can present to the american people. Lets dive right in and talk about those different values among other things. Plus we have here at the news table, don edwards, and to complete our maryland duo, an msnbc contributor. Before i get to everybody, lets, john cornine who was recently the number two leadership in congress, here is what he said about a week ago about the idea of a National Emergency and we will go from there. I think it is a dangerous step one because of the precedent it sets. Two the president will get sued and it wont succeed in accomplishing his goal, and third because i think mrs. Pelosi will come over here to divide republicans. It strikes me as not a good strategy. Casey hunt, the president heard all of those criticisms and he did it academy, did he have to do it to get the votes . No, in fact it was the other way, he had to give a concession to the president to get him to guarantee that he would sign the bill and do it today so that he could get the Comfort Level of his conference on board. I mean Mitch Mcconnell said he would support the president in this National Emergency declaration. Mitch mcconnell said it would do exactly what he was just talking about. It could divide the party and potentially embarrass the president. So what do the democrats do now . Theyre still working out that strategy, but this will potentially divide the party. And for that one sound bite you played there are so, 15, possibly 20 plus republicans on camera saying the same thing. Jacob, i assume it must be mand moan yum there, but that has been part of the you have been more than anyone covering this story saying where is the crisis at the aboborder . Yeah, it is preposterous. That is something that you can say for san diego, you can say it for south text and along the southern border and it got to the president. If look closely at it, it restricts fencing, not prototypes, but fencing only in the rio grande valley. Not in california, new mexico, arizona, and much of texas. This bothers the president. He is looking for a way to build the wall, but he will have to explain where the emergency is, i detainee see it up there. But it is not an actual emergency, it is a political emergency is, i dont think everyone agrees he has to cave like this to the right, what is in hit his head . Just this issue. A few cobwebs here. The president is looking at this first and formoeforemost, he pr this to people who actually wanted it. It was a wall, and he had no way to get mexico to pay for it. And that is why it did not pass the house or senate when the republicans had control in the last two years. So you had that big political calculation there. I think the president sees this much more as a win than a loss for him. He signs off on this thing. No shut down. I declare the emergency. My base is happy, and here is the tweet spot, when it gets to the courts and it will, he will say those courts are bad for you, theyre bad for america. John kennedy who is supporting the president s move on here, take a listen. Im not surprised. I think the president feels very strongly that we have a price at the border, his sin is that he is enforcing the law, if you dont like the law you ought to change it. Do you think they will pursue changing the National Emergency act . No, but i think what will happen is there will be a motion for disapprove that will come over to the senate that means the senate has to take it up immediately and it puts republicans, i think, in the worst possible decision and it will end up in a course. I think i sat at this table a few weeks ago and said the president would get 1. 3 billion for the wall funding. And that was the exact deal that he was offered the day before a shut down. So the president S Administration and what is happening around that sleepy border, is that the argument that under cuts his argument for a National Emergency. Its not going to fly. So there is always a tweet. Donald trump tweets that republicans must not allow press obama to subvert the constitution for the u. S. This i think i believe had to do with the decisions probably with immigration. Heidi, there is always a tweet, but im with michael here, is there a political downside to the president here right now . For him personally . For him personally, you have to sprat him out from the party. There is execs and balances, but for him personally, michael is right, right before i came here i talked to a leadership aide that said were weighing our options and probably, in terms of legal action, it would be easy to find someone along the border that has standing to file a suit. There is plenty of ranchers whose property would be served and they would have to file a lawsuit. That would probably be the best way to go. It would be tied up for years and the president can say i did this for my base, for the long termfects on the party, listen to nancy pelosi today who says i will take this as a sign on the First Anniversary of parkland that when a democratic president gets in, well have lied latitude to announce national declarations of emergency. Could you have democrats saying why are we voting on anything . Why are we giving him a dollar . Then suddenly it is the democrats that shut down the government, but i have to think this is making the house vote trickier, no . Possibly, chuck, but i think the coalition here will be Strong Enough that there is not a lot of concern. We know that alexandria is voting against this. There is a split in the 2020 democrats in the senate on how they voted on this. You saw, you know, kamala harris, corey booker voting against it. So they can say, you know, i didnt vote for a dime for President Trumps wall. Now you saw amy klobuchar, and somewhat odly, Bernie Sanders as well, but you see her making that decision to take that governing late, essentially. I thought that was pretty interesting, but dont forget this is dhs, appropriations bills, there is old school buy in here, i think that is what assures and you saw this on the senate vote, too, i think you will see something similar in the house. Now the one thing that i wonder, this president is very mercurial, as we know, this commitment to signing the bill seems iron glad, but kcathy mcmorrisrogcmorrisrogers, she the same thing as nancy pelosi. What would president Bernie Sanders or Elizabeth Warren do with this power, so clearly the president got the idea from sean hannity and others like him that say you have to swallow this, but you have to declare this emergency, i think this problem will fester here for the president. How does el paso leadership fight this . Is there is campaign to stop this or will they work with the government or the Trump Administration until the courses tell them not to. Every step of the way he has been challenged. We saw the southern policy law cent center, it is a big part. I enjoy coming on to talk to you, but i would not be here if the president didnt do things that chasexacerbated this. You have thousands of mie grabts, thousands in tiajauna. You can talk to attorneys, immigrants, and every step of the way theyre saying what he is doing is illegal. You can bet he will see them in court. And there is one other way for court fighting. They reported on january 10th that one of the proposals that the president was putting together was this. The president could dip into projects for the river basin and dam in california. And money for puerto rico that is still recovering from hurricane maria. I wonder what that is. It might not be the first time that we saw a politically targeted policy proposal. But i think that eventually congress would challenge that, too. Donna can talk to us about how the mechanics of that would work, but that is super seeding their power of the purse. And the president cant just take away money from the pent gone or from disaster funds, that would be another thing that you would have votes challenging him. And there are hmms that really oppose this idea of reprogramming funds. Marco rubio and rick scott both fought hard. They have not gotten into the partisan politics of puerto rico. And this is why on so many levels this policy is problematic and i think democrats are going to challenge it. I mean there are appropriations authority, a constitutional authority, and they will have a lot of republicans right there with them. Not just for fear of an Incoming Democratic administration, but because it is the fund membamenf the relationship to congress. On that point can i say this, i think that whole aspect has been lost on folks in the white house. There is a rib driven between the house and the white house, the senate and the white house. I think this is something that republicans will rue. If any aspect, if this is allowed to stand, they cannot criticize any democratic president that says there is an emergency and were going to stop the sale of guns. They could make a case. I would just say we cant let this pass, the number one thing that got in the krau of republicans was issuing executive orders, this is that on steroids. That is the fundamental reason you saw so many republicans you had commentators on fox news warning the president against doing this. We will see where he ends up. He said that was the most stunning. Andrew mccabe is out with what looks to be an explosive book details the Justice Departments frantic attempts to figure out how serious of a threat the president was to the russia probe. Aaccordinged to scott pelly, the alarm belling grow so loud they were considering wearing a wire in the oval office. Mccabe also said he was to have described meetings at the Justice Department where they seriously discussed removing the president using the powers of the 25th amendment in the constitution. In an execerpt from mccabes book, they operated at times like they were suffering a russian maf ya boss. They are painting him as a liar and a threat to the fbi. They determined that he was not entirely truthful with james comey and that he violated fbi Disclosure Rules that lead to mccabes firing. Joining me now is ben whitaker. You read the excerpts, mr. Bren than in, and he sounded as alarmed in may as you have sounded at times. How familiar did his account ring to you . Very familiar. I have known and respected andy mccabe for many years and for a senior fbi officials and cia officials, our Counter Intelligence antenna for russian espionage is very sensitive. Is it too sensitive . Some could argue it was a conspiracy, but lets rep the spring of 17. We came off of an election where it was a the unanimous position of four intelligence agencies that the russians were interferes in tinterfer interfering in the election and trying to advance the interests of donald trump. That was a fact in the fbi and the cia. Then you have things happening that mr. Trump was doing and saying, and then just the summary removal of jim comey who was pursuing the investigations, i think it raised concerns in the minds of andy mccabe and others. What is going on, here . What could the russians be doing with u. S. Officials. And initiating a type of Counter Intelligence initiative at that time i think was appropriate. What is your understanding of how there was an investigation launch in 16. I flow is separation of cia and fbi, but what is your sense of how big the investigation was when comey was running it. I would say low level buzz before a full investigation. Before then we were looking at what they might be planning to do in the election. Then it started to grow in intensity and scope. And the fbi investigators came upon various threads of individuals that were interacting with the russians. By the time spring of 17 came around, im sure that the fbi and cia were working together to try to uncover as much of this effort on the part of the russians as possible. Ben, one of the things that we noted this morning is this is may, comey it sfiered in may of 2017, the following things had not yet happened yet by that time. A month later, President Trump reportedly orders the white house county till to fire mueller. In 2018 he he revokes this mans security clearance citing wosh on the russia probe. January 2019, the intel chiefs disputed the president on issues like north korea, iran, and russia. And kremlin talking points about afghanistan. That is all fake news. All of this happened after andy mccabe and Rod Rosenstein had this panicked moment. We dont know that. I think the maniced moment you refer to is a really important thing. You know, it feels like ancient history to us. In this moment the people involved thought the president was coming into shut down an investigation and he worried it was on behalf of a russian adversary. In this period of time he led the fbi with a lot of dignity and a lot of class in the face of unbelievable president ial bullying. And remember at the end of the first week after the after this conversation happened where the president of the United States asked this man how does it feel to be married to a loser, he gives testimony where he contradicts the president on the fbi rank and file to jim comby. We will be debating this for a long time, but it is an important thing that this period of time that produces the mueller investigation, it produces a stable investigative climate, he gets a lot of credit for that. John, as someone that has been in counter investigation, what about his behavior after this, is it all damming . I think it is puzzling in terms of how he reacted to a lot of things. This is a perm attack on you that seems reflective, but it is part of the story. It is clear that he has a serious concern about what the investigation may uncover. I believe deeply that mr. Trump knows what he has done and he has done some things that were very unprincipaled and unethical to include, as he was campaigning for president of the United States, and his efforts to shut down this investigation is very clear evidence worried out and how his activities will be revealed. If you werent the sitting president of the United States, would you think he was a russian asset, an agent, or an unwitting agent . There are individuals that the russians have been able to manipulate and exploit because individuals are concerned about what the russians might expose that could embarrass, discredit, and hurt them. Those are individuals that are not assets or agents. They are ones who cooperate and collude because of the potential damage that the russians can do if the russians decide to come out against them. And that clearly i think is what a number of individuals in the Trump Administration have been doing in the past several years. Ben, how do you convince people not to read some of mccabes book as ven jegeance . There may be score settling in this, but is the material in it true, when the New York Times first started reporting these claims that, you know, for example that Rod Rosenstein offered to wear a while, or there was talk of invoking the 25th amendment, the Justice Department sort of denied it. You know, now there is a name associated with these claims, and he is making his case, and people can decide for themselves if they think the material is true. If they think it is true, people have his motives in coming forward at this stage, and to what element there is score settling is be side the point. Is he a new witness . I suspect if it turns out to be the case he will make use of executive privilege. How do you dwlus if it is not talking to the president. Cepstive material, pending investigations, but i think he is unlikely to want to walk up to capitol hill and tell his whole story. John, you outlined a scenario in one oped in the New York Times. This is the day after your clearance got revoked, that essentially made the case that soluti collusion is there, but everyone has a different definition, whats yours . Interacting with another party for a joint and common purpose. The distinction i made in that oped is between collusion that i think has taken place. When donald trump at the end of july of 2016 called for russian intelligence to find Hillary Clintons emails, that to me was collusion. Thats what bob mueller, the special council, is doing. And they are determining if that amounted to criminality. So the Senate Intelligence Committee Report that came out before this, to me the Senate Intelligence committee was not supposed to do any type of criminal investigation. Theyre looking at what the russians did, how the government, cia, fbi responded, how we can strengthen our defenses in the future. What roles and capabilities we need to push back, but lets leave it to bob mueller. I have my own views about whether or not there was criminal conspiracy, but what bob mueller determines, i will accept that. Okay, this mueller are report, is there a possibility that this report will not be what everybody thinks it will be . Yes, number one we have no idea when it is coming, we dont know what form it will take, it could be quite minimal, we have no idea whatever form it shows up in what parts will become public and number four we have no idea how much investigative activity it needs to encompass. I could go another half our on this, but i have other things coming up. Well talk about the political fallout about what Andrew Mccabe said that is not getting a lot of attention. Yeah, throw out the bright shiny object, it is irrespective of what you think about, the revelations in the last few weeks, the court now coming back saying dude, you lied in your working with mueller and company, they all fit into the narrative which is that it is problematic from the beginning. Disguise and create some other noise for you to lash on. Every single president president , when asked about weird russian contacts, but the pattern is the same. How offer did you get to the emissaries that were trying to get to you. This is the normal thing, the president always behaves like he is guilty of something. If you dont have anything to hide, top hiding and stop lying, and this president and the people around him, they lie and then their convicted, indicted, and investigated. But politically it has not had an impact. If you look at the poling figures though, it has not had an impact because people are expecting for there to be a fuel investigation and they hear what results of that investigation will be. Hey, that may not necessarily be the case. I think that is when you see the backlash in public opinion. If the American Public are not allowed to see the results of this investigation. I spoke with lawmakers on the Intelligence Committee in the house now and here is the problem, they will do their darnedest to creates points of contact. And they will also privately acknowledge to you theyre hamstrung and the president will claim executive privilege on things and they wont be able to get them even if they make a subpoena. When you negotiate and come up with a compromise, it means we dont get fg we want. Democrats didnt. Republicans didnt. The president is not going to. This is how democracy should work. Im proud of that process. What the president is trying to do now, he needs to fulfill his Bumper Sticker of build the wall and so is declaring a National Emergency in order to do that. Lets look at what the real National Emergency is. Its what donald trump is doing to our family farmers, this unnecessary cold war where we have corn and soybeans sitting there because we dont have the markets with canada, mexico and china because of this selfinflicted trade war. Thats the real emergency. Congresswoman, why support this deal then . Im going to support the deal because we came together and negotiated something that is a real deal. It is basically President Trump throwing a hissy fit at the white house saying this is now a National Emergency because i didnt get everything i wanted in this deal. The governor of puerto rico tweeted in response and noted, is it now puerto rico and california american citizens that will pay for the wall . If this is the case, well see you in court. That is the indication, of course, that weve seen that the white house was looking at, taking pots of money from california Recovery Efforts and puerto rico Recovery Efforts. I assume the legislative branch will have something to say about this. How can you stop him . He has to get that money from somewhere. Were hearing from the relief of the wildfires, the terrible Disaster Relief for puerto rico. I dont know how anybody who has any sense of empathy can think thats a good idea to take the money away. I dont know how you cant feel for people in puerto rico who are, by the way, american citizens, how you cant feel for the people who have gone through these wildfires and disaster after kissdisaster in californi. From the time we were sworn in on january 3rd in the majority, nancy pelosi has been running rings around donald trump, and shes doing it in heels. I can tell you that i have faith that she is the leader of the democratic caucus. We will do what we can to make sure we are fair to people, that we are doing the right thing. I have faith in her leadership that well get that right. Congresswoman, you and i talk quite a bit, i would say, and youve been somebody who says, look, i want to try to work with the president where i can. You represent a district that has quite a few Trump Supporters in it. Its not like youre from some super blue district in the fifth borough of new york city. Why should you work with him at all . How much does this poison the well that you cant come to a tough compromise that hell accept . How do you trust him on prescription drugs . How do you trust him on an obamacare fix, which you have made as a promise to get something done now before 2020 . How do you work with him on these things . I dont think hes proven himself to be trustworthy. Look, my congressional district, chuck, as you said, its truly a swing district. Theres not a whole lot of districts like that. But donald trump won my district and voters elected me by a 24point margin. I think thats people at home saying they have faith in me but they also think the president is somebody we should work with. Im going to live up to what people back home are asking me to do, and that is to try to work with the president of the United States. I think an area that we can Work Together will be we need to rebuild our country and we really do need a trillion dollar infrastructure package. The president talked about that. Now we have to execute on that from a policy perspective. Same thing with health care costs. I hope we can Work Together on that as well.
