They say they acted lawfully and they were in good faith negotiations, but this story leafs us wi leaves us with so many questions. There are so many threads to pull on. Lets go through them. If this was indeed extortion, what was the motive . Was ami helping the president settle a score . This outlet admitted to making hush payments to help trump in the election. Then there is the intrigue after a reporter at the Washington Post said that besos private investigator suspects a government ententy may have gotten ahold of the intimate texts. Which government you ask . Could that be saudi arabia . Well explain that in a moment. Lastly, perhaps most importantly, where does the whole saga fit with the investigations that we know from trumps fortunate investment ties. We have gabe sherman, a media reporter that understands the world of ami and mr. Pecker, jim kavanaugh, a Law Enforcement analyst that has worked with his share of extorters. And mimi roker. I never thought i would have a quartet like this, but that is how strange this story is. Let me start with the legal aspect of this and the idea of whether or not this is extortion or not. I will ask you first, what is the definition of extortion and does this fit it because i will be honest, i certainly had my share of back and forth that has saidly leaf that out if youre going to leave me this. This is not your typical source they would be dealing with on a typical story. Where does this fit in the definition of extortion. I think reasonable minds and prosecutors could differ on whether or not the conduct that we know so far, what we know, fits within the definition of federal extortion and that is what i will focus on. Federal extortion is simply somebody, you know, asking in a demanding or threatening way for something from someone else of value. And usually, right, the quintessential case is a mobster that says i will hurt you unless you give me a bag of money. So here it is were going to publish these embarrassing photos and hurt your reputation, which is a threat, if that falls in the definition of the statute. The question is what were they demanding of besos. What they were asking besos to do for not taking that action they were threatening. Is that a thing of value . I think conservative prosecutors would say not really, they were getting him to not pursue an investigation. They were getting him to agree to make a certain type of statement. Thats horse trading. I think the more aggressive expanded view is that yeah, it is because that is something of value to besos. He was trying to investigate a link between trump and ami and if he had uncovered that, possibly something nefarious about how these texts were acquired, that could have been something of value to besos. So i think there is a good argument that it fits within the statute. In this instance, we dont even necessarily need to get that far because ami likely would be found in breech of their agreement based on this conduct. At least it sounds like theyre going to look into it. That is the potential connection to donald trump, then there is the connection to the foreign government, michael schmidt, it says mbs, as he is known, told a top aide that he would use a bullet on jama Jamal Khashoggi if he did not return and stop his reporting. The Washington Post reporter, easily the most aggressive at trying to get the United States to hold saudi arabia accountable. They have been kaubt or perhaps caught messing around with stolen emails from qatar, so how much at least is there toe this in this besos story. This can all be confusing, but the president has been super ayeszive himself, knocking down the notion that mbs was behind this. They have really downplayed that as much as possible. But i have plenty of encounters with the National Enquirer and im a strong defender of the First Amendment but i think its a stretch to call that journalism. And so i think they started to panic once the strings started to pull and bezos calls their bluff. We dont want to begin to give the government power or prosecutors power to decide who is and who is not in journalism. Because we have all of these new media. Bloggers . Are they journalists . Seshl they think so. I totally agree with you. I think theres soms things about this we dont know. Bezos has not called the police, hes investigating this, using his own private investigators who dont have subpoena power. Hes responding to the National Inquirers use of its First Amendment rights with his own very effective use of First Amendment rights so far theres not any coercive state role in this.
