Stepped forward to accuse Justin Fairfax of rape. And Governor Northam is telling his staff that he wont resign. Well have all of that mess in a moment. Were also checking the fallout from the dramatic race, the administrations hostile probe. This featured some unbelievable moments, definitely quite the television show. Were going to speak with one top democratic that was in the room in a moment. First were going to begin with an unraveling bomb shell that involves allegations of extortion, the president , the National Enquirer, roger stone, foreign governments, and the Washington Post just to name a few. Amazon ceo jeff besos who isf t on twitter has gone public with threats he received from American Media incorporated. They publish the National Enquirer and theyre owned by a close trump ally david pecker. He will publish graphic images of jeff besos and he has to stop investigating how the enquirer got ahold of other Text Messages between besos and the woman he had an affair with. They say they acted lawfully and they were in good faith negotiations, but this story leafs us wi leaves us with so many questions. There are so many threads to pull on. Lets go through them. If this was indeed extortion, what was the motive . Was ami helping the president settle a score . This outlet admitted to making hush payments to help trump in the election. Then there is the intrigue after a reporter at the Washington Post said that besos private investigator suspects a government ententy may have gotten ahold of the intimate texts. Which government you ask . Could that be saudi arabia . Well explain that in a moment. Lastly, perhaps most importantly, where does the whole saga fit with the investigations that we know from trumps fortunate investment ties. We have gabe sherman, a media reporter that understands the world of ami and mr. Pecker, jim kavanaugh, a Law Enforcement analyst that has worked with his share of extorters. And mimi roker. I never thought i would have a quartet like this, but that is how strange this story is. Let me start with the legal aspect of this and the idea of whether or not this is extortion or not. I will ask you first, what is the definition of extortion and does this fit it because i will be honest, i certainly had my share of back and forth that has saidly leaf that out if youre going to leave me this. This is not your typical source they would be dealing with on a typical story. Where does this fit in the definition of extortion. I think reasonable minds and prosecutors could differ on whether or not the conduct that we know so far, what we know, fits within the definition of federal extortion and that is what i will focus on. Federal extortion is simply somebody, you know, asking in a demanding or threatening way for something from someone else of value. And usually, right, the quintessential case is a mobster that says i will hurt you unless you give me a bag of money. So here it is were going to publish these embarrassing photos and hurt your reputation, which is a threat, if that falls in the definition of the statute. The question is what were they demanding of besos. What they were asking besos to do for not taking that action they were threatening. Is that a thing of value . I think conservative prosecutors would say not really, they were getting him to not pursue an investigation. They were getting him to agree to make a certain type of statement. Thats horse trading. I think the more aggressive expanded view is that yeah, it is because that is something of value to besos. He was trying to investigate a link between trump and ami and if he had uncovered that, possibly something nefarious about how these texts were acquired, that could have been something of value to besos. So i think there is a good argument that it fits within the statute. In this instance, we dont even necessarily need to get that far because ami likely would be found in breech of their agreement based on this conduct. At least it sounds like theyre going to look into it. That is the potential connection to donald trump, then there is the connection to the foreign government, michael schmidt, it says mbs, as he is known, told a top aide that he would use a bullet on jama Jamal Khashoggi if he did not return and stop his reporting. The Washington Post reporter, easily the most aggressive at trying to get the United States to hold saudi arabia accountable. They have been kaubt or perhaps caught messing around with stolen emails from qatar, so how much at least is there toe this in this besos story. I dont know a ton of that, but we know the saidies have be saa sa seau i d saudis to have been aggressive. For that hacking to go on, it would have been an enormous deal, a big thing. Our big thing today was about the intelligence that the United States has about what happened. This is a text message that was sent about a year ago that the United States was able to see communication in which mbs was saying this and this was mbss words himself. This can all be confusing, but the president has been super ayeszive himself, knocking down the notion that mbs was behind this. They have really downplayed that as much as possible. What we reported today, my colleague, was that there was more evidence about why the Intelligence Community was so convinced they were behind this. That they had a direct hand in this and they knew about it. And they have just continued that. I want to put up full screen number one here. Gabe sherman, i want you to help me explain. The president on jan 12th, right after the nation naa nal eal en. So sorry to hear about jeff bo sfrks o being taken down by a competitor whose reporting, i understand, is far more accountable. It almost feels as if the president was a little too giddy and aggressive in trying to second the enquirers reporting there. Explain that relationship. It is a relationship that has gone on for years, donald trump has been close personal friends with david pecker through his time in palm beach in florida and during the campaign as has been reported over and over again. The enquirer is a free tomorrow of advertising. And david pecker and ami went into a nonprosecution agreement to avoid Campaign Finance violations. So this a raises the question that all of us are asking is why does the nation nal nal en kwia did they do this expose . She not a celebrity, not a starlet or an actor, and this raises the question of was the enquirer either doing the direct bidding of trump world, or was this an indirect form of trying to take out one of the president s rivals by doing this had sto story. And connecting it to saudi arabia. They have been looking for financing and saudi arabia is a big source of capital. So was it an effort to publish these messages and photos to get an investment . That is something i think federal prosecutors wills be looking at. And they published that bizarre welcome to america magazine when mbs made his first visit to the United States. You bring me to the investigator on our panel here. Mr. Kavanaugh, you have had to deal with your share of extorters, as famous as you might think she, she not fey those that tense. That the National Enquirer relationship would know who he is, the person, it is weird and odd. How would you go about investigate who do this and how confident are you that he has the resources to find this out . I would be go right to the motive. Right where i always went to because i want to uncover the reason for the crime and that leads me to the next step. Youre right, everybody doesnt know who he is, and if he wasnt the owner of the Washington Post, he was just a man that delivered packages, we would not be here, you would be covering Something Else on the hill today, but he is in the position that he is, being extorted, because he is the owner of the post. There is a very strong motive here. He said it had in his email that david pecker was a interested in the connection. So what is driving that side, you better do this or we be publish these pictures. Of course i agree with mimis assessment as well. If there was a hack of communications or a skeers, you have to look differently at this. You look at the private eye and my people have interactions with him, he has a tremendous reputation, a great guy. You have to look at him a little different. You have to look at him as a witness. The federal witness tampering statute is extremely strong. It is for somebody that corruptly persuades someone that may have information about a possible criminal investigation, if any, they try to persuade that person, that is witness tampering. So if you have a conspiracy for a crime, wire hacking, you could have witness tampering. There is witness tampering possible here. And i would say he has called the agency in l. A. , asked them to look into this. It needs to be looked into. That doesnt mean a crime has been committed, but you will have to talk to all of your legal analysts to get into those statutes. And the main question that we would hais how did ami get this afghanistan. Was it hacked, stolen . Was there a conspiracy to get it in was there other people involved . The last question to you, mimi, who will have jurisdiction of this . I heard jim talk about the other parts of it, are they just going to take a look first . Could it come out of seattle or l. A. . Who is likely about to open up an investigation here. The ourn district person me me said no, wait a minute. I think they have an interest in this in the form of this nonprosecution agreement, they may start looking into it. Is there a Cooperation Among different offices . Will they Work Together . But if i was still in the Southern District i would lay claim to this because we have interest in it and were well equipped to look at these connections, and what is behind that. Getting, jim is exactly right. It is not just about extortion, it is about why did ami engage in a very reck less and criminal action. It is a quartet i did not think i would put together, but the jeff brgs eesos story is ju that odd, great job breaking it down. Another woman has come forward in the last hour to accuse the Lieutenant Governor of a Sexual Assault four years earlier than the other one he was accused of. Well be back with that in a moment. Welcome back, well have more on the jeff besos National Enquirer story in a moment. Just in the last hour a second woman went public accusing Justin Fairfax in a Sexual Assault. She says she was raped by him in 2000 while they were both students. Mrs. Watson immediately told friends that he raped her. Were awaiting a story. He repeatedly denied a Sexual Assault allegation from 2004 that that came in this week. George is a syndicated columnist. I should note that Terry Mccauliffe has called for Justin Fairfax to resign. It is clear to me he can no longer effectively serve as Lieutenant Governor. I noticed that democrats in the last week are more confidentble on asking herring to go. It didnt seem like we would ever feel like we knew the story. A second accuser changes it. And backed up by people who can corroborate it at the time. I think that it will be very difficult for him to remain in office with a second person coming out. If democrats want to maintain a horl m moral high grand on these issues. We prosecuted Justice Kavanaugh in those hearings. It was the right thing to do. If we want to maintain that high ground, he has to go. Most of the democrats say you have to get on this . Yeah, i think if there are two people, assuming their true, and if the second person has people she told in realtime, what else is out there. This will end up with him resigning. Let me put up a statement from Justin Fairfax. I deny the latest allege. I have never forced myself on anyone, ever. I demand a full investigation. Such an investigation will confirm my account because im telling the truth. Ly clear my good name and i have nothing to hide. I passed two fbi background checks by the fbi. It is obvious that a vicious and organized Smear Campaign as developed against me. What do democrats do. What do you do in a situation like this . First of all the Lieutenant Governor used the word demonstrative. Which is demonstrative. That accusation pales against what were hearing and he may look like the last person to hold a ship together. There is a buzz feed story out about Governor Northam seeing if there is a way he can survive, and then he goes all in and becomes essentially a Racial Justice warrior. Is that something that the Democratic Party can accept . I think at this point when you know that Justin Fairfax has someone accusing him of rape, to keep the party going in that state at the very top they may have to figure out a way to accept that. I dont know if that i dont know if that will be seen as credible. I also think you know he doesnt he cant run for reelection so they can be rid of that problem at some point. It feels false. If you want it to be a Racial Justice warrior, then do it, but that is not how you repair this problem. He is the National Democratic primary that is happening just right now. Race, gender, and me too. It is a stain. Virginia is a giant tattoo. No doubt, and as long as three three men maintain their post at the top of the party every democratic candidate in 2020 will be asked about them and justifiably so. Virginia is a really important state. It is an important source of fundraising. They have been incredibly effective at essentially obliterating the Republican Party there in the last ten years. They have functionally eaten themselves. Now were seeing the party start to implode from the top down. The longer the scandal goes on the more it hurts the national Democratic Party. Is there nip that can take a leadership role in the state . Does president obama . I think that erin would hope that northam would do the right thing. But if he did that then what would you have had . Governor fairfax right now. Exactly, this is multiple pronged. It is great that he found the lugt on the issues but it is a little late. And probably as you said not believable at this point. I think that each of these three men have to make a decision whether or not theyre putting themselves first or the state of virginia first. And i think for voters, for the long term interest of the party, were better off with these people putting the state and their voters ahead of their own personal political interest. The thing that Terry Mccauliffe said is that they can go longer effectively govern. That means every time youre interviewed you will be asked if you wore black face or raped someone. Is it about politics or doing something and you have to be punished for it. If a republican has to run virginia for awhile, then okay. And if we dont i wish we had a recall provision here. It feels like the voters should have a say in this. But thaw dont. This is the Political Class that will source this out. This is occurring at the beginning of the Democratic National primary and we saw the ruthlessness and swiftness with which they moved against al franken because he was blurring their message. I would expect they will not sit still and allow their message to be drowned out by this distraction from virginia. The democrats cant look like their care more about Holding Power then what the point of attacks on Mitch Mcconnell and merrick gargarland. Right, a principal is not a principal if you sell it out because you might lose the governors mansion. That is not how those things might work. One thing about fairfaxs statement is his claim that there was a coordinated Smear Campaign. He is not just saying he is innocent. He is implying that multiple women are working together in a nefarious and organized way to damage his good name. That is very comparable to what we heard other men say and when they say things like this democrats scorch them. But Brett Kavanaugh is on the supreme court. So it worked. There is a hierarchy of offenses, he is not accused of a crime. And he is at least acting like he wants remorse and that suddenly matter were all a little skeptical of him but the more he does these things the better it looks. I think fairfax deserves an investigation. Im sure there are steps being taken to do that. I also think there are probably lots of conversations going on with the state legislature including the black caucus about what to do about northam. He might think that he will stay in office, but this story has a few more chapters. And even though there is no ability to vote him out of office right now, he will not have you dont want this, in the atmosphere in 2020. Its not what we stand for, its not what we run on. The its not the construction of this party. Okay, im going to sneak a break in here. We have First Amendment issues to talk about. Mr. Chairman, i see that your five minutes is up, and so i im here voluntarily, we have agreed to five minute rounds. Welcome back, the hearing room was heated right from the give upping today as Matt Whittaker appeared before the House Judiciary Committee and he insisted that he did not interfere with the investigation and he didnt know when it would wrap up even though he implied that the end was near just last week. Also we learned that any hearing could be partisan and ugly quickly. Sorry, i dont know if your time was restored or not. Were not joking here, your humor is not acceptable. Im confused, i really am, who are you . Where did you come from . And how the heck did you become the head of the department of justice. Can you say mr. President bob mueller is honest and not conflicti conflicting. Im not a puppet to just repeat what youre saying. I answered the question about what i think about the assistant council. Good to see you, sir. I will be honest, i didnt learn a lot, but you tell me what did you learn from the hearing . I think we learned first of all that he had no business being appointed acting attorney general of the United States. He should have accused himself. We learned that he would not answer questions about what information about communicated to the president by him or others, and we learned that republicans on the committee are very unfamiliar with oversight. For the last serl years they have not done oversight. For the last eight years there has been virtually no oversight. Republicans have to learn again that part of the responsibility is to do oversight and they were not comfortable with that. It felt like the mirror umage of the peter struck hearing. In that one it was republicans beating him up, there was ve venting of frustration on your side. Yeah, but he was an agent and it was a maide up investigation about Text Messages. This is the acting attorney general, he was plucked out. He campaigned for the job by going on television to say negative things about the investigation. He was put there and why was he selected and why did the president not follow the succession statute. Why was someone with these well developed views put into that situation, and did he direct mr. Mueller not to take any steps, did he try to prevent him from moving forward, what did he share with the president or the legal council. He said that i dont know. I was impressed with how you basically said im not going to let you do the executive privilege trap, you tried to find other ways to elicit more information and it became no mans land. If youre trying to pin him down, and you cant, what other vehicle do you have . Is it worth subpoenaing him . It did you want matter, we need answers in the next five days. What he did, what he was told to do. What he shared with the president and his legal team matters, if he doesnt come voluntarily we will subpoena him and get answers. I asked did you share those questions that you were given . And he said no, so he could not invoke his executive privilege. So he basically is just saying i dont want to answer these questions, and you cant do that, so were entitled to get answers to those questions. So tom styer is threatening to beat up democrats if they dont start impeachment proceedings yesterday. When is the appropriate time and when should people like him get frustrate straited d with you. If they have to move forward, i think that is the case. We all believe that it is important that we allow mr. Mueller to complete the report. We have to make sure that we have all of the information that we need, that report will tell us if there is sufficient evidence to move forward. We ought to protect mr. Mueller, we need to make certain that he can finish the job he was charged with doing, and there is a number of ways to do that. Get that report and depending on what it contains continue that. Were hiring staff to fulfill our oversight, not impeachment. We have about 500 pages of oversight that we have been clambering with for the last several years. We have a lot of oversight work to do. We will be hiring additional staff for oversight and we will continue that if it arises. I think it will be hard for special council. We need to respect that process. We need that report, it will inform our work significantly, and we goat et to do this once, want to do it right. Quite the event, i imagine we will see it, too. George i want to start with you, theres something frankly whatever the story is, something refreshing about somebody standing up to the National Enquirer. And you cant sort of that part of this is sort of im sure theres celebrities and billionaires around the world that are like good for him. Well billionaires turns out have their uses, they not only keep the Washington Post afloat and therefore journalism better but they can fight in ways that other people cant. In this fight, let us stipulate as the lawyers say, that the world would be a sweeter place without the nationnational en. Somewhere in there theres a problem, which is however they got it, they got information and whether or not we really want to come down hard on journalistic enterprises, even unsavory ones that get truthful information. Shawna, this is the part of this where we say i understand that david pecker doesnt practice journalism. All of that is true, but he does have some First Amendment rights here and so does the publication. The question is when you look at the letters, the letters that jeff bezos decided to release. Were taking it on his word. Is there a journalist endeavor if you you say we wont print this thing that could be considered newsworthy, because jeff bezos is the richest dude in the world. If you stop doing what youre doing. I dont want to engage in too much back opinion patting here. My colleagues were the ones who broke this story that that, one experience they had was getting threats from lawyers for peckers company. So this is not something that he limits of course to billionaires. He uses this tactic with impunity. Even though in many cases it stops people from reporting. In the case of smith and lock lin, it didnt. Their reporting was cited in that threatening letter. That the lawyers for ami sent to bezos which kicked off bezos revealing the tactics and the really thuggish tools that ami uses to try to extract information from people. Stephanie, youre the one operative in this case, have you ever dealt with a situation where, where you had a client and a reporter that were in this, and it was probably you wished, just confront it but you didnt know what to do with it . Ive never had a situation where a media outlet was trying to extort information from me or to prevent me from saying something. Which is what the National Enquirer was trying to do. But i have plenty of encounters with the National Enquirer and im a strong defender of the First Amendment but i think its a stretch to call that journalism. And so i think they started to panic once the strings started to pull and bezos calls their bluff. We dont want to begin to give the government power or prosecutors power to decide who is and who is not in journalism. Because we have all of these new media. Bloggers . Are they journalists . Seshl they think so. I totally agree with you. I think theres soms things about this we dont know. Bezos has not called the police, hes investigating this, using his own private investigators who dont have subpoena power. Hes responding to the National Inquirers use of its First Amendment rights with his own very effective use of First Amendment rights so far theres not any coercive state role in this. If you have someone trying to extort from someone else, is there a responsibility for someone to investigate then . I mean, this, this could end up being litigated in court and theres a lot of legal, there have been a lot of legal challenges. I want to go to the saudi arabia angle. The saudis are being brazen. Weve caught them being brazen with qatar and caught them being brazen with Jamal Khashoggi. This would not end up be surprised if it ends up being more corrected to them. Theyve been acting this way. But yet the president says im not going to sanction him. Sanction mbs over saudi. I think it wouldnt surprise anyone that the saudi arabia regime is barbaric. They have friends across the world and one in the white house. An unbelievable day ends in unbelievable week. Betsy, george, stephanie, john, thank you very much.
