Were waiting to see not if there will be more indictments when and where. And right now there is one man at the center of all of the questions of what comes next. Folks, we talk about the potentially problematic business relationships in the president s life, cohen is at the center. When we talk about the personal relationships, cohen is at the center, and cohen could be at the center. We dont know what the feds were looking for when they raided the properties, but we know it rattled the white house in a way we have not seen yet. We also know he has been under surveillance by the feds, electronically, that they admitted to in a courtroom. And we know he facilitated a 130,000 payment to stormy dames. We know that sean hannity was one of his three clients, and that there is evidence of him being in prague in 2016. Cohen is addimently denied that he has been to prague, but all of these look odd, dont they . The president s very recent behavior has added more questions about whether or not there is something he is trying to pride. And then the post reports that he was furious that the administration was being portrayed as taking the toughest stance on russia and that he insisted his aids misled him into what do we have now . He has crapped new sanctions. It feels like were on the edge of something here. What is it, exactly and where do these pianos hanging over our heads dop . Take us behind what were waiting for next in the Michael Cohen situation which is that the judge ruled she will not let cohens lawyers or the president s lawyers what will be open to privilege or not. Explain what a special master is. It is kind of, as Rachael Madow said last night, it is a mini judge. It is a neutral third party appointed by the judge in this case who gets to make rulings but not final rulings. Only the judge can make those rulings, but makes decisions on things like the way the privilege process will work, is that the filter team will review things, pick out the things they dont agree with. Then they will consult and say this is what we think is not privilege and can go over the wall. If they agree, great. If they dont, someone has to decide that and that very likely sounds like that is the way it is going. So you say the judge picks a special master. So in this case, she looked for each side, cohens lawyers and the government to submit for names each. She will try to pick someone that is a retired judge or a lawyer. It could be she will try to find someone that does not late out as partisan. But it will be hard to find in this case because everyone will find something to say does she have to . J cant she trust herself to make the decision . That is a great way. She did you want have to pick a special master. Cohen is the one that asked to be allowed to review the materials or the special master. They say we dont need a special master here in the case of lynn stewart, a criminal defense lawyer in new york who was charged with terrorism related type charms. And she shared office space with other attorneys that were also criminal defense attorneys. That screams special master. That screams that you need someone on the outside because there is so many potential work con flecks. Michael cohen, that doesnt apply to any of these. That was part of the argument. He is not a full time practicing attorney. The main argument is that the materials that were looking for are not related to a real Legal Practice here. They said in open court were looking at his business dealings. There is likely clear cut privilege and nonprivilege decisions to make here. She is a very confident no nonsense judge. I think she recognizes that if she goes that way did is about a compromise and reassuring the american pup tlak it is being treated down the middle. Perception, but more concern i have to say it is more about the perception of fairness. Essentially the president is going to get better treatment here. They say in this case you would not use a special master if it was not the president , dont do it here. I get it, the political head of my head gets it that way. Im now confused about whether or not Michael Cohen is his attorney or not. To me is there anything that annty has now said that would indicate that he waived Attorney Client privilege . Even as a lawyer im confused, too. He said some conflicting things. So i dont know if that is a miscommunication or someone is not telling the truth or what High Pressure he is saying look, i paid him i think 10. I thought his legal advice. That is not what determines if something is Attorney Client pri lenl. You cant just say it no matter what you tell an attorney is privledges. That puts the cart before the hours and means that you, the privilege holder, gets to decide it whether or not it is legal or not. He has said though, right, he also said he did not represent me. You cant have it both ways and its not clear right now where the facts really are. What the truth is. Okay, very quickly. The issue of executive privilege, i have had not colleges of mine athey were surprised he did not send a member of the White House Councils office. Is that why trumps lawyers probably didnt make that claim . I think so. The executive privilege with respect to the russia and Mueller Investigation there was question about whether or not the president could properly invoke the decisions about how our country is being run. I dont know all of the facts, but it would be a real stretch to make that argument. And the president didnt even bother, he got a personal lawyer. Hannity said he never retained him, received an invote, or paid legal fees, but should he have been transparent about it before discussing it on his show . Is hannity a journalist . What is being sent, i feel like saying sean hannity is not accountable to any standard what so ever. Does it end the message that the professionals at fox news do nothing but cover from sean hannity. I have taked to a lot of the reporters, not the first time such questions have been raised. He raised money for tea party causes. He was pulled back from high after his participation event was pointing there. You cant surpass what he did last month when he was pumping a Conspiracy Theory about the death of a democrat aid. He never apologized for it and didnt even say it was wrong. So you have in causing pain time and again and he is in sanction for fox. They have doubled down at a time of crisis and controversial. Rupert murdoch is a telephone correspondent if is painful to watch these antics. David, i cant help but notice you talk about the different times that he was slapped on the wrist. Every episode you recounted when he was flapped on the risk is when robert ailes was running it. I would not say he as a professional sense of journalism. He talks to the president on the phone, dines with him, counsels him, and tells him on his twitter feed. I think they would argue and push back and say the viewer knows what theyre getting with sean. They know he is biassed, in the tank, it is not a secret. He will find a way to be on the same side. The arch viewer has no ability to discern that. If you look back on his radio show yesterday, he said every time we talked i assumed we had Attorney Client privilege. Whether or not he fulfilled contrac contracts, he would say attorneyclient . Okay, good, attorneyclient. He is trying to say publicly they didnt have that kind of a relationship. I think you should always air on the side of saying i have informal dealings with the guy. They even say it is of a far different tenor and threat to the president , and so i think even if youre a conservative, you look at what is happening in new york and you say even if mueller doesnt get to trump, these guys might find something that does. I noticed it is a weird thing to sort of show you, it is almost, i noticed with republicans in the last a shelter in place attitude. Like you know im not going to go out and defend him too much any more, i will shelter in place. Yeah, trump put out his red line that is when he started getting really regret. I think they dont know what theyre going to fine. They dont get, youre not able to raid his office with a no knock warrant unless you prove there is evidence in there. The person will try to destroy it. They knew something already. This was not speculative. The fact they had permission to surveil him for as long as they did. I think they pride themselves on the division between the reporters that pursue the hard news and the talk show hosts at night. I think a lot of the reporters there work hard and do their job like any journalist do that there is a distinction. But i think they sent a tough message. I cant imagine that the more opinionated folks on msnbc at night that they would not have acknowledged it. It did, it went public, and we acted multiple times. We work to protect reputations first. Thats what a reputable organization. I know the Washington Bureau at fox news. Those are professional journalists over there. They are but theyre governed by people that dont feel the same way. You can call yourself an opinion host, a talk show host and not a journalist. You can have opinions and share them and still have them be your own convictions. And another sign of the switch to the democrats, in 2016 voters that disliked trump and clinton were more hikely likely to prefer republican control of congress. Where were they going. When we look at the same group of voters now, were reminded that being the party or the candid of change is really good. This will be, you fwhoeb the fifth or sixth election of change in a row. I think it mirrors the numbers we saw in 14, 10, and 6. Is that how you would read this . In 16 if you didnt like both and you were holding your nose, you voted for trump for change. In 2018 with t is the democrats and the party of change. It is not that simple. Look in the people that Department Like both in 2016 were republicans. There was a lot of republicans that did not like trump. They have come on board. Now the people they dont like this different levels. He has 80 plus approval. So i hear you. You think it is a totally different set of voters . Very different set of voters. We now have it 4740 in march. It, is our republicans coming home, is that accountaing for what is were not at blowout territory. If the democrats win, they are not at the margin of dropping. But seven points means that youre competitive. 20 to 40 range instead of 40 to 60 range. It is not like democrats were at 10, 12, 14, 16 points. So i believe that republicans are been encouraged by a good economy. Are you seeing a closing of sorts on some of these places . Or do you think it is noise . I think it is noise. I think a ten point lead that we had in march is noise, and i think when grow one level below, the numbers with independents, the democrats still have a strong lead. The shift with white women, those are what youre seeing where congress switches seats. We did well with both groups in 2006. Whats the line that says hold versus not. If he got to 45 , could that save the house . Is that for him . Is that enough to save the house . Under normal circumstances it would still mean losing control. You might find that what happens when people go vote, you could be easily at 45. We know from previous distances from polling and the exit polls that the president s approval is a few points away from what were seeing in the track. He will probably lose 90 of the people against him, if there is an eight or nine point gap, that is about seven points and the house is in play. So 45 may not be enough . That is very hard to imagine, it is hard to see a path we have him at 39, we had him at 43, i think it doesnt change, it is between 39 and 45 every week. And the numbers are consistent every year.
