The bitter confirmation battle may be over, but with 30 days, thats less than a month until the critical midterm elections, republicans and democrats are both hoping kavanaughs confirmation will energize their bases. In kansas, last night President Trump celebrated his newest justice while urging supporters to block a blue wave at the polls. The past few weeks every american has now seen the profound stakes in the upcoming election. You now see it. We have been energized. If democrats are willing to cause such destruction in the pursuit of power, just imagine the devastation they would cause if they ever obtain the power they so desperately want. Lets start with you, danielle. Pulling off for a moment partisan politics. This, some are saying, has been a good week for donald trump. Well, its just funny to me that a good week for donald trump is a horrible week for our democracy and for the american public. The reality is he has called the vocalized anger and rage that weve seen in front of the Supreme Court, weve seen on city streets across the country, hes called them paid mobs. Him and the entire Republican Party have decided that we no longer have a voice and regardless theyre going to ram through their agenda. I tell people every single day the midterm elections, this is the most consequential moment in our history. This is about saving our democracy at this point. If this president is proud of a stolen seat and proud of now two sexual predators being on the Supreme Court, that is not a legacy that i would want. And so i hope that in 30 days we will see the blue, not a wave, but a tsunami coming for the Republican Party. No warah, comment on that, t who would say its a good week for him because of all that happened. He also had some good numbers because of the economy and jobs report. On the flip side, you are seeing the opposite view which has not gone without confirmation, not without validation this is a poll i want to show from pbs news hour showing that the gop during this very period has seen a jump. If you look at the question of november elections and how important it is. Democrats already high back in october. 82 going down to let me start the other way. July then going to 82. Republicans starting lower at 68 and then going up to 80. Thats a 12 percentage point jump for republicans. Again, the democrats already were high in july compared to october. Is this going to, and of course this has been the discussion all day, how long will this be sticking . Im skeptical this can they can maintain this kind of enthusiasm near the next 30 days. There are about 800 news cycles and this one is over. This justice was confirmed. What sentiment was yielding this kind of enthusiasm among republicans will wane. But at the same time this has been a very good week for donald trump insofar as republicans who were skeptical, who have been hostile towards him. Or not energized. Have been energized. When democrats have been performing well at the polls in off year elections, it has been because republicans didnt show up. Traditional republicans, maybe 20 , 30 of them have been discouraged. To the extent we can take this away from donald trump and make it more about conservativism, youre going to see those voters reengage. Let me bring up the poll compares september 27 to the 30, september 6 to the 9th. On the right a bit of a drop. About 3 percentage points. Still a delta difference. Seven percentage points. Question of stickiness and what might keep the stickiness for the democrats if they want to stay on top of that . I think that the focus of the Democratic Party since november, 2016, has been trying to pushback against an agenda that is antiwoman. Thats why you see women organizing across the country since election day. People that have not been involved in politics. So the kavanaugh confirmation actually is a moment in which its just an inflection point. It coalesces all of the folks and their Energy Around one fight and, yeah, in the short term, we perhaps lost the specific fight. But that doesnt mean that it ends today. That means that every single woman who was upset yesterday when they saw kavanaugh confirmed is going to wake up today, donate money, go knock on doors, go make phone calls, organize people in those states specifically the ten states where theyre running, those that democrats must hold to have a chance in the senate and the house is a lot better to reign. The focus is now going to be on the energy and the anger of women and how we push that through organizing into victories on election day. Youre reading my notes and i want to go to the wall street journal and one of their articles, how kavanaugh, the whole fight so far is actually helping the go prk ap and the s races but not necessarily the house races. Whats your thought here . We are only really 24 hours past what had happened, the confirmation of Brett Kavanaugh and how both parties are absorbing the new reality. The thing about making a deal with the devil is that the devil backs up his bargain. The devil does not welch. Trump has delivered for these people on the things that they care about most. He has delivered racism for these people. He has delivered ma soj knee for these people and now hes delivered the Supreme Court which is something theyve been trying to get for a generation. The question now becomes not so much will this stick for the republicans, this is what they want. Democratic turn outdoesnt mean to be high for a midterm. Several on the House Judiciary Committee are calling to discuss the allegations against him if democrats win the midterms in november. Lots of eyes on that. They will have the power to make it happen if they so choose. But some say the impeachment talk is a potential liability for democrats in the midterm, so most are treading lightly. Should Brett Kavanaugh be impeached if democrats take control . Im much more focused on the here and now which is we have an election coming up. All right. Senator hir hirona from hawaii. Does this make sense to be talking about impeachment . No, i dont think so. Not because its not something that you should investigate. I think its perfectly appropriate to say if we take back the house, we can use our subpoena power to investigate not just this but all of the other allegations against this administration in terms of corruption and other things. But in addition, i think you have to understand the process. You need 67 votes to remove a justice or the president in an impeachment proceeding, so its not a realistic possibility. I think in the next 30 days you have to focus on turnout. You have to focus on winning back every single seat we can win on every level. The next fight thats going to take place, now that theres a serve majority is going to be on the state level. Antichoice bills are already introduced in states like iowa, mississippi, for example. So women are not going to be able to get Birth Control or plan b or iuds and the Necessary Health care that they need not just to prevent pregnancy, but just to take care of their own health care. There are a number of conditions where you need Birth Control to treat that. Are women in iowa going to be able to get that if a heartbeat bill is introduced and then brought up to the Supreme Court and upheld . Thats a reality for women and thats the next fight. Records and interviews show, records indicate that trump helped his father take improper Tax Deductions worth millions more. He also helped formulate a strategy to undervalue his parents Real Estate Holdings by hundreds of millions of dollars on tax returns. Sharply reducing the tax bill when those properties were transferred to him and his siblings. Now, the New York Times reviewed more than 100,000 pages of financial documents including confidential tax returns from trumps father and his companies, but we should note that nbc news has not independe independently confirmed the respecting itself and the president denies any wrongdoing. Well, none of this can be handled as criminal cases because theres a sixyear statute of limitations and the newest material the times has is from the turn of the century. That said, there is no statute of limitations on civil tax fraud and donald trump had two trials for civil tax fraud over his 1984 tax return and he lost both and was heavily penalized by one judge and the other one for a technical reason didnt penalize him. Just made him pay the taxes. So i fully expect that the state of new york and the city of new york are going to go after the trumps, not just donald, but his sister who is a federal judge. What about the feds . Say it again. Can the feds go after donald trump. Can and should, but the case would be brought by the Justice Department which surgeon tunder control of President Trump. All those investigations that youre reflecting on, the tax plan, did trump overhaul the tax code so he could benefit from it based on this reporting . Well, i dont think that was his purpose, but yes. Trump will benefit mightily. The top tenth of 1 of americans, those who make over 2 million a year, are going to get more than half the tax benefits from the trump tax law and this trump tax law was a huge subsidy to big corporations. Ive shown the apple should make a profit of 120 billion off the trump tax law. So lets look at some of the scope of what is being reported here. According to reporting, trump transferring 1 billion to his children, producing potential tax bill of over 500 million as you see on screen here, but in the end only paying 52 million. Right. Had this been known and spotted at the time, it would have justified criminal prosecution. The problem is that, well, automobile records are electronic, so if you give a car to a child or transfer it at a price that isnt proper, theyll send you a tax bill. Real estate records are not. And so real estate cheating is so rampant, the irs has said the lowest cheating rate in the United States is in ohio and its 85 . One of the points that were made pretty clearly in this report, 14,000 pages, was that the idea of a selfmade billionaire is not necessarily true based on what they said. What is it in the report that says well, selfmade billionaire, maybe not. Donald got repeated loans and bailouts from his father. The 1 million story is shown to be absolute nonsense from the internal records. Let me be very clear about this. There is not now and there never has been a scintilla of evidence that trump is a billionaire. In fact, he told voters he was worth more than 10 billion, pu h but his president ial statement says 10. 4. Where itdid they go. President trumps attorney is blaming the conduct described in this report on those that are the money folks, the cpas, the ac accou accountants, the factually is not experts in that. How does that story line make itself to the end . I quote donald trump in my biography as saying he is the greatest tax expert in the history of the world. He literally said that. If thats true, the defense is nonsense. But on top of that, you sign your tax return under penalty of perjury. It doesnt matter what was done by the professionals. Youre responsible for it under the law. If you do things repeatedly, then youre cheating knowingly. Very quickly here, how big a deal is this report . For those who arent tax experts like myself, it seems huge because they got access to, again, pieces of information that folks dont normally do and its quite extensive. Right. It adds to the evidence that the trumps are a crime family as ive been asserting for a long time and it will be a road map for the democrats if they get control of either chamber of congress to hold hearings, investigate, and make Donald Trumps recent tax returns public and if they show criminal conduct, to indict the president of the United States. So are you saying, then, david, we may see Donald Trumps tax returns but not during this congress . Not during this congress and only if the democrats get control, but if they do, richard, im sure within a year you and i can have a conversation about whats in those recent tax return signed by donald trump. So the two major issues as our justice correspondent Pete Williams laid out for us a couple weeks back that might number front of Brett Kavanaugh and this new court that is the most conservative as we just noted in some eight decades, one is gamble versus the United States. Second is gundy versus the United States. Karen, lets start with gamble versus the United States. Describe why this might be important to the everyday american. Yoobviously you dont want t get tried for the same crime twice which makes the United States internationally where double jeopardy zadoesnt attac. I know that most people are saying with gorsuch and kavanaugh, because kennedy was the swing vote, that they were hoping that kavanaugh and gorsuch would be, again, taking the place of justice kennedy. But theres been a lot of controversy. I was talking to melissa and eli, is it going to be justice roberts, is gorsuch and kavanaugh going to be the swing vote . Remember kennedy took over from sandra day oconnor. This is going to be a wait and see type of thing. Some of the cases, lets bring up to date, in terms of the debate back and forth is the very jeopardy that Current TrumpAdministration Officials may face or will face both nationally on the state level and that would have some effect here when we look at double jeopardy in gamble versus the United States. It seems more like that were thinking about brotus. Gamb gamble versus the United States will be the Supreme Court service that Justice Kavanaugh can do for donald trump which does shield the president from being tried by two sovereigns, the federal government and then any state government. The state, for instance. Exactly. In addition to, that gun ddy versus the United States. The sex offender registry case prompting questions about congressional power. Again, were looking at this idea whof who has jurisdiction. Yeah and weve just put a person who has been accused of Sexual Assault on the court to decide that, to be the swing vote in that case. I dont think it looks good for to some of the specifics, its whether congress can say okay, federal agencies, you can make your own policies. Thats whats being debated here. Right. I think that the other big issue, though, that hasnt that we havent talked about in legal cases are all of the gerrymandering cases. Theres been a lot of action at the state level trying to force the maps to be kind of more fair and a lot of that is going to be up to the Supreme Court and now were in the situation where john roberts is going to be the quote unquote swing in those cases. The thing about roberts that i think people have forgotten is that he has been nothing but an enemy to minority Voting Rights ever since he stepped on the court. He authored the decision in shelby count which gutted the Voting Rights act, so one of Martin Luther king and the Civil Rights Era greatest achievements was gutted by john robert. He has always been on the side of the his view of Voting Rights which is very negative towards minority voters now holds sway over the entire court. Much more so than the sex offender case which i dont want to say is not important. Its important. But much more so than gundy. Im worried about the ability of people to vote, especially considering that voting is the way we only ever stop these people. I want to play a little bit, then you can react here. These are two current justices that were speaking on friday, justices that some on our panel know quite well. Lets play sotomayor and kagan. This is a divine team, people thinking of the court as not politically divided, as not an extension of politic. We have to rise above partisanship in our personal relationships. We were talking about Justice Stevens on the lead up to the vote yesterday when we were covering that news story. Your thought here, karen . Theyre saying that partisanship is there. They are missing now the theoretical independent vote is what theyre alluding to since we do have a retired justice at the moment. The issues that we have discussed at stake, pregnancy, senators in abortion, rights and religion, trumps travel ban, partisan gerrymandering which elie brought up as well. This probably means that congress should start legislating before if gets to the point, especially in the gerrymandering case. The Supreme Court has been pretty clear that congress should start legislating some stuff so it doesnt have to go up to the Supreme Court. That would be great. Theres a lot of issue, not just with, that but also the elitism. You have nine justices all graduated from harvard or yale. Only 5 have been heard. Theres a good argument we should add a couple justices. Theres lots of issues that are outstanding. Were paying attention to this, but the access to justice and only 80 cases being heard out of 10,000 means that large corporations and individuals like you and me cant get to the Supreme Court to have our ideas or our cases heard. Lets add on to that, and Pete Williams also saying this particular court, although they just started without that ninth justice, they did have a docket that reflected the fact that they did have an ongoing nomination process it would seem. So by choice and potentially by number. Theyve made a conscious choice to have fewer cases this term because they werent sure they would have a ninth member to join them, but they obviously do. They can take on more work. The larger point i think you made is that were seeing a court that has never been as conservative in history than it is right now. The last time we saw a court this deserve was in the 1930s and that court had basically been in place since after the civil war, the redemption court. This is going to be enormously important for questions of individual rights. You asked what Justice Kavanaugh will mean for questions of reproductive rights, same sex marriage, all of that. Will we see the court lurch to the right in ways that would be unconscionable. We are thinking about a system where the development of rights has been much more incremental and i think what we are going to see her is a solidly conservative court. John roberts is not going to be a swing justice in the mode of anthony kennedy. Hes a dyed in the wool conservative. And the center is really going to be right of center and we have to live with that. We have a lot to watch for many decades and i know youll have criticisms as well as suggestions. Thank you all. Just getting in on murkowski for a second here. Shes also said politics are different in alaska as well. We have the time of four years. We also have how politics are local always. But the president seems like hes saying im going to come after you because you are the sole republican to go against my nominee. Right. And hes going to make an example of her, right, by what he does which is anybody that goes against him he turns into a pinata of sorts and beats them down. Lisa murkowski voted how the people of alaska wanted her to vote. You know why . Because their Sexual Assault crimes or triple, double, they are so much higher than the national average. There were more women that are raped there. There are more women that have been victimized in a variety of ways in alaska that exceeds the national average. So Lisa Murkowski was not playing politics at that moment. I believe that she was actually looking at the statistics that the people of alaska, alaska, the women of alaska have been up against. And voting for her state and for herself and her constituencies. This brings the question of divisiveness. Are we going to see the left and right go back and forth at each other, thats been the criticism throughout this entire process of the confirmation of Brett Kavanaugh. I want to go to this one poll from pew research that says when we look at america divided, 20 agree during this poll that americans agree on facts, disagree on policy. 78 of the folks that answered this poll said americans disagree over facts and policy. So if you look at that number, you got to say, my gosh, this is really a tough time. Whats going to get us around it . I dont know. I think our media environment contributes to that. But i would imagine that probably contributes to that finding. I also am skeptical as to how much it will matter. Weve always been divided and had fractious politics. 8 out of 10 disagree over facts and policy. So theres nothing were talking about facts. I agree and we risk overstating it as opposed to disagreement. I want to add in on that because Mitch Mcconnell was also talking on the flip side about senator collins. I want to play this little bit for you. [ inaudible question ] shes my top priority too. Top priority, but on the flip side here, you know, im looking at crowd pac a group that is raising for the campaign against senator collins. And you can allude to who you might think would be going up against her or not. Theyve raised up to 2 million. Now up to almost 3. 5 million to go up against senator collins. Of course she had lastminute, a lot of people wondering how she was going to vote. How real is this response . Youre talking about real money. And money is how you win in politics because we have Citizens United unfortunately. I think one of the other conversations we probably should have been having in this debate over kavanaugh and the dark money that was funding and propping up his nomination, not that those organizations dont exit on the left and also on the right, but we have to understand that the nra used their noun back his nomination and also support candidates who voted in favor of his confirmation. So that demonstrates there is eagerness to do not money for agendas that protect citizens. One could also say, sinhow o side theres a lot of Grassroots Energy right now. I dont know who it is, but were going to go for that person as long as its not susan collins. D whats the solution . We talked about this throughout the many, many months and the many recent years. Do we need more parties then . Do we need something in the middle, ross perot, if you will. I had this conversation this morning on my show. And many callers said they want a multiparty system, that this twoparty system is clearly broken. Theres no such thing as real independence because we know the independents vote with democrats the majority of the time. The reality is we dont have representatives right now that are representative of the people. And thats why the midterms are so important. We need to be holding these leaders accountable, and the only way well develop a multiparty system is if people decide that these people dont represent me, im going to run and im going to run outside of democrat or republican. 30 seconds and then 30 seconds. Multiparty system, can it be done . It would be difficult. If youre going to be in congress and you want to have a committee assignment, you have to caucus with the party. Got to change the rules of the way they conduct business. Its not necessarily the longterm solution in the short term we need to focus on winning every single election all the way up the ticket because state house races are critically important. Once roe v. Wade is challenged, states are going to pass choice laws. Access to Birth Control, thats actually where the change will come.
