What we have to do as a country is roll back that debt to make college universally available with free tuition and fees and to put more money into pell grants so that students of color, so our poor students have real access to college. We have a dysfunctional health care system. In which 30 million american have no Health Insurance at all. Health care is a human right. Not a privilege. And the best way to go forward is my view is with a medicare for all single payer program. I am paying more attention now right now to foreign policy. I think i was rightfully criticized the last time i ran. I didnt pay as much attention as i might. Upon being elected, i will give the United States congress 100 days to get their act together and have the courage to pass reasonable gun safety laws an if they fail to do it, then i will take executive action. Well, first of all, im not going to get out ahead of Vice President biden and make any new us, so lets wait and see what he does. I can tell you this, stephanie. I cant imagine in history a closer relationship between a Vice President and the president. I know how much president obama and all of us relied on the wise counsel and advice of Vice President biden. I think our field has on the democratic side an embarrassment of riches and id be heartened to see more folks get into the race. Whats your sense of you know, everybody wants the know what president obamas going to do. Who hes going to endorse. Where hes coming down on these things. Obviously if youre running as the obama biden candidate, which are words that he said himself, what, take us into president obamas mind about these things. Well hes met with several of the candidates who are running. Ive had a chance to speak with him. I think that what resognates still is a message that unifies our country. Candidates who are authentic. Who have a clear vision and a e ability to execute and recognize as president obama did not once, but twice, that you have to go out there and earn it. Every single day. I think its very early in the season. I would remind everybody that when president obama was running back in the beginning in 2007, i think everyone would have said that Hillary Clinton was the inevitable nominee. So a lot can happen. This is a marathon and i think were all interest ed in seeing how each candidate does on the field. Bernie sanders is right behind joe biden in the battleground states. He supports, hes been clear about it, medicare for all. You were there. You were a part of it when obama care passed. Do you envision health care becoming front and center in this next election, especially given what republicans are doing to the Affordable Care act at this point . I think it should be front and center. I think that we did what we could do to try to crack the bipartisan bill one modelled after Massachusetts Governor romneys bill and it goes a long way towards ensuring that people have access to affordable Health Insurance. People are preexisting Health Insurance are covered. Women have preventive care, children can stay on their parents plan until their 26. The republicans have been and continue to take away those benefits and i think it is a fundamental right. It shouldnt be a privilege and i hope it is front and center in the campaign. One of the things youve learned and that was learned in the bill Clinton Administration is that there are things that are aspirational on the trail and things that have to get through congress. Particularly when its a divided congress. A number of things that your administration struggled with are being dealt with now. Gun control legislation. Senator harris vows to enact executive action on that. Theres student debt forgiveness. Senator warren is so prosing. Talk to me about the degree to which americans should be anyone to evaluate these as aspirational or actually do abl. I think they should be both. I think we look o our candidates to have aspirational goals and the saying is that you campaign in poetry and govern in prose. I think the key is taking those aspirational ideas and trying to implement them. I think what we experienced unfortunately were republicans who wanted to say no and didnt recognize in a big complicated wonderfully rich diverse county trip such as ours that you cant let perfect be the enemy of the good. And you cant simply say no. Thats not what the American People expect. And i think candidates have to recognize that when theyre sent here on behalf of the American People, they should try to do the best they can. You inch further along in that Perfect Union and sometimes it comes in a big burst the way Affordable Care did or dont ask dont tell or samesex marriage and sometimes you have to impbl along the way we did when we had to resort to executive orders because wouldnt take reasonable steps. Every american gets to evaluate the candidates by what they decide as the appropriate litmus test. As you look at the Democratic Party right now, what does it look like . The twitter universe would say its pushing further to the left if you watched the town halls last night. But in the midterms, where you saw overwhelming wins in those candidates who actually flipped states, were moderate. People had messages more like amy klobuchar. Nancy pelosi said i think ocasio c cortez is fantastic, but all you need is a blue d by your name and well win. We need to be a more centered strategy to defeat President Trump. What do you believe the Democratic Party needs to lean in order to win this next election . I think one of the strengths of the Democratic Party is that we have a big tent. All ideas are welcome. And theyre debated and i think that thats a he wialthy part o the process. So i wouldnt say you know that there is a test that you have to be b expositioned. I think what you want is a leader who has a clear vision for our country. One that looks at creating opportunity, enlarging the pie. Making sure no young person is left behind. And then whaonce youre in offi can you surround yourself with a team that can effectively execute on that strategy and who is willing to compromise for the greater good. So i dont think you should have just one test and one position that reflects the Democratic Party. I think what we do is have a vision then move forward the best we can and sometimes its incremental and sometimes a burst. Let me just ask you to get a little deeper into that. Recent polling indicates that 41 of democrats think the party should be more liberal and 54 think that it should be more moderate. You really is in terms of understanding strategy. That to me looks like really difficult math. Even if youre a big tent. When you have you know more than half wanting to go one direction. A little less than half to go another direction. How do you moderate that discussion . Well i dont look at it as labels such as liberal or conservative or moderate. I say were all progressives. And so where do you stand on the issues, specific issues, health care. Keeping guns out of the wrong hand. Growing the economy. Reducing student debt. Making sure that every young person gets that opportunity. I think thats the way we should look at the issue rather than just labels. Lets where candidates fall on specific concrete issues that affect our lives. Thats what i would be looking for is whos going to make my life and the life of my children and grandchildren better. There are factions of the Democratic Party who believe the system should be blown up. They have actuallily similar ideal l to people on the far right. We know bernie supporters that stayed home or in some case, voted for President Trump. So this time around, do you actually think those voters could bring themselves to the middle in order to defeat the president or are they, are we going to fall into that same situation again. I think the last couple of years has been a real wake up call and to the 43 of americans who did not vote in the last president ial election, i would say to you we cant afford to have you on the sidelines. The stakes are too high. Elections do have consequences and we need you involved. Cant just say it doesnt matter or didnt get the candidate of your choice. What im hoping is is that whoever emerges as the nominee of the Democratic Party is able to galvanize and support the support from entire party. Thats what we need in order to defeat the president and that should be front and center i think if everybodys objective. If we look carefully at what has happened over the last two years in terms of attempts to dismantle the Affordable Care act, walking away from the iran deal, walking away from the Climate Change deal, separating families at the border. Clear evidence of values that are inconsistent with the core values of america, then i think the challenge is dont let perfect be the enemy of the good. Lets take a moment to walk through what it is. You can find it under article two section four of the u. S. Constitution which reads the president and Vice President and all civil officers of the United States shall be removed from office on impeachment for and on conviction of treason, bribery or other high crimes and misdemeanors. It was first brought up at the Constitutional Convention in 1787. Championed by alexandrer hamiltn where officials could be removed for mal and corrupt conduct. James madison saw the clause as quote indispensable for defending the community against the incapacity, negligence or prefty of the chief magistrate. By the way, prefty means deceit fulness of untrustworthyness. It is important to note that the president doesnt need to commit actual crimes. It can be done on the basis of political mistakes or offenses and doesnt necessarily mean that a president will be removed for, from office for offenses. For instance, president jackson was impeached on charges. Sorry, Andrew Johnson was itch peopled on charges of insulting congress, but just because articles of impeachment are filed, doesnt necessarily mean that the president will be removed from office. But its a system viewed as controversial. And political. Because the Supreme Court has no say in the matter. This is entirely up to members of congress. Articles of impeachment would require a simple majority to pass in the house which is controlled by democrats. The senate would then have the power to remove a president with a twothirds vote. The house alone reserves the right to impeach. So you could completely be impeached in the house. Removal from office only happens once the senate convicts and this has never been done in history. Considering the senate is controlled by republicans, impeachment seems very, very unlikely. Joining us now is the president of the National Constitution center. Jeff rosen. I tried to not embarrass myself by laying that out as clearly as we can, but President Trump tweeted only high crimes and misdemeanors can lead to impeachment. R there were no crimes by me, no collusion, no obstruction. So you cant impeach. Thats not exactly true. Whats your interpretation of where the constitution stands on how to handle this matter . First of all, you summed it up extremely well and although as ub, you dont need a crime to constitute a high crime, if congress decided that President Trump did commit a crime in obstructing justice, that would count as an Impeachable Offense as itd dit did if the president clinton so they leave it as an open question and if the congress decided he did, this would be grounds for impeach m. Theres an interesting debate about whether the president can obstruct justice when he exercises his institutional authorities such as firing james comey. Attorney general barr said no. The mueller team reached the opposite conclusion and thinks the president can obstruct justice merely if his actions have the effect of stopping an investigation or obstructing it. So thats a debate congress can have and the question of obstruction is front and center as congress decides whether or not to impeach. Can you help me understand the consequences of impeachment . When i think back to bill clinton, besides reputational damage, what did it actually do . He kept his job if the he wasnt removed from office. Im pretty sure when he left office, he was probably the highest paid former president in terms of giving speeches, so whats the actual impact. If he actually went through this with President Trump, couldnt he say the next day, yep, still at the white house, still having steak and cherry pie . Absolutely. If anything, as you said, impeachment boosted president clintons popularity and maybe even helped democrats. It is an embarrassment in the eyes of history. Its significant that only two people have ever been impeached by the house. President nixon almost was, but there are other ways of embarrassing a president , too. Congress can sennture the president as it did andrew jackson. He was so upset about that he he got it removed after another congress came in. Even that, what would sentturing this particular president do . What would be the impact . It would be a stain in the eye of history. Right now, it may seem that the president or others are immune to embarrassment. But its really significant. That we have only had two president s impeached, one senntured in American History and it would be inscribed forever in the history books if he were. Lets talk about the process. The house can impeef. Peach. Senate convicts. The house is democratically controlled. Senate is republican. So conviction is just not sort of something that is on the books at the moment. So whats the purpose of impeachment . Not the reputational damage. But there are, theres an argument that is made that says impeachment is a process of investigating potential wrong doing and thats the process that congress has given. There are some arguing dont whether what the outcome is. Worry about the fact its a constitutional obligation on congress. As you said in your excellent introduction, its a mix of political and constitutional considerations. Congress could conclude that obstruction did rise to the level of an impeach obl fence, but because the president is unlikely to be convicted, it could decide not to impeach. It could decide that the hearings themselves are a way of opening the evidence up to the American Public so we the people can decide and there are impeachment is unnecessary. Theres no obligation under the constitution to impeach or not and thats why the democrats face a tough political and constitutional judgment right now. But if democrats do nothing, does this then reset the bar for acceptable conduct . It was just two days ago that Rudy Giuliani was on tv saying yep, no big deal to get information from a foreign government. Thats a really important question. Yes. And democrats conclude this is conduct that has been impeachable in the past. They might decide that they need to do something that could just involve hearings, which would lay out the charges. The reaching out to those students on campus and people at those restaurants, trying to narrow down when and where people may have been exposed to the virus, reaching out to them and telling them what to do next. Obviously talk iing to people w may be concerned about contracting the virus and just saying look, if you, the thing that has been most effective is this two state vaccine. There were several cases where doctors in some cases were sort of under the table giving them out to people who wanted them. So obviously theyre trying to cut that off as soon as they can by again introducing more legislation, but the problem is that people you know slip through the cracks and weve talked about this case you know over and over again. About immunity. Which is this 95 rate of people that are immunized and if they dont meet that, thats a big crack for people to slip through. This is only happening in pockets in northern california. Weve had some cases down here in southern california. Obviously certain communities that are more against the vaccine are more prone to constructing and spreading the virus u. So again, its these few pockets and loek loeks where people are more exposed, but it is extremely concerning when you have an outbreak this rampant. And you want sufficient funds to get them built, if you want the ambulances to be timed appropriately to get to people and pick them up and get them to health care. If you want the Fire Department to know where and how to place fire houses based on density of population, you want a full count. So if we dont count fully and appropriately, what were essentially doing is putting an eye patch over one eye. And deciding we have enough peripheral vision to see. Right. That was my next question. I totally get why we want the census to be the Gold Standard of measurement, so whats the best argument in favor of adding the Citizenship Question. Whats the best like ross, what do they feel they gain from doing so . Wait a minute, ross and the administration, theyre adding the question to the census not for any reason besides theyre trying to reduce the amount of political power, the apportionment of our congressional seats is tied to the full population in an area. Programs that millions of americans rely on for retirement and old age care. Well guess what. Theyre in deep trouble according to a new government report. Social security is a retirement benefit. Anybody who pays taxes out of their paycheck put money into the fund through their working life. Signed into law back in 1935, it was created to help Older Americans afford to live in retirement without growing broke and also provides payments to the disabled. Medicare for the general public was created three decades later was created three decades later. Currently, americans are eligible for early Social Security benefits at the age of 62. Full benefits dont kick in until youre 67. A new report issued every year about the status of Social Security and medicare. Shows payments to beneficiaries will exceed the emergency paid into the program next year, forcing it to dip into the programs reserve trust fund. 15 years later, Social Security will burn through that if nothing changes. And beneficiaries will be getting smaller payments. Unless congress acts, anyone born in 1968 or later who wants their full benefit, wont be getting it. Those who pay into Social Security and medicare now wont see the money on the back end. Medicare will run out of money in 2026. The same projection as last years report. Leaving seniors and the disabled in in a more financially vulnerable position for medical care if nothing gets done. Despite promising not to touch Social Security or medicare, President Trumps latest Budget Proposal calls for 26 billion less for Social Security including a 10 billion cut to the programs disability component over the next 10 years and 884 billion cut to medicare over the next 10 years. Congress has ignored this budget but it illustrates the difference between projections and priorities. The one bright spot in the report. Social Security Disability funds are not expected to run out until 2052, which is 20 years later than originally projected. Thanks in part to the Medicaid Expansion under the Affordable Care act. The fund will run out if nothing is done. Leaving the elderly and the disabled with less money and more vulnerability. Austin, to say this is entirely on the shoulders of the Trump Administration would be wrong. This is a gargantuan problem thats existed for quite some time. Help us understand. What is the real risk of running out of Social Security funds . Because when you talk to millennials, they dont want to pay into it at all. Yeah, look, one part of this theres no secret, weve known for decades theres a baby boom, and that they eventually theyre going to retire. Now they started retiring. As the population ages, stuff that is geared toward the elderly get more and more expensive. As a share of the economy. So that part weve known. Now, this whole circumstance is why a whole many people at the time we were debating first the bush tax cut in 2001 and then the trump tax cut in this administrati administration, people were saying, you remember when bill clinton was the president , if we have a surplus, lets save Social Security first. Because one day will come when were going to have to start spending money out of the trust fund and were going to want to support the retirement of the middle class. They didnt do that, they cut taxes at the top, weve done it again, another 2 trillion. If you want to extend the solvency of Social Security, stop cutting taxes for millionaires and big corporations. But it demonstrates a prioritization that doesnt make sense. Heres the problem, austin. A lot of people who have been ringing the bell about Social Security also do so and the rest of the sentence is, thats why we have to limit benefits or do things that actually hurt the people that receive it. Thats exactly what they say. Go ahead. And when they advocated the tax cut, as you know, widespread analysis from even nonpartisans said, can we really afford to start running trillion plus deficits during a boom when we know were going to have to pay for Social Security . And the playbook is cut all the taxes, then say wow look at how big 9 deficit is, we have to cut your middle class retirements and Social Security and medicare. And i just dont think people will stand for it, i think if asked, do you want to repeal some of the tax cuts for big corporations and high income people or do you want to cut Social Security retirement money, i think its totally obvious which is going to win. Is it that black and white, though . Are people really given that option. Thus far, you raise a good point, they havent been presented an option, they keep cutting taxes and now theyre going to try to raise the spector of, were going to run out of money, so were going to cut the benefits. Anyone who comes forward and says, we dont have the money to pay off the retirements of middle class americans who have been working thinking theyre going to get these benefits. Anyone who proposes cutting that is going to be in big trouble. And i think the fact that the Trump Administrations own budget proposes cutting those programs, i think theyre going to ring that around his neck. A federal grand jury here in manhattan has indicted former ceo of Rochester Drug. Hes charged with narcotics conspiracy, and conspiracy to defraud the dea. He allegedly distributed tens of millions of oxycodone, fentanyl and other opiods. We just heard from the u. S. Attorney from the Southern District of new york, take a look fp. Well get that information from tom winter who is at the federal court right now. Whats the update . 9 update we just heard from the u. S. Attorney today, it is a landmark case as you suggested. The ceo of this drug distributor, theyre the company that gets the opiates from the manufacturers and distributes it to the pharmacies, and so what we heard the u. S. Attorney describe sean allege is the person who ran this company essentially acting as a drug trafficker, this would be someone similar to a master drug dealer in a city, someone who is willfully ignored their compliance department. Theyre flagging orders from pharmacies, some of those pharmacies had been rejected in other distributors because they were dealing in selling various opiates, oxycodone, fentanyl, a really addictive opiate spray, they had been shut off from other distributors. The ceo of rochester cooperative would continue to sell to these pharmacies, the numbers are staggering. 8300 specific instances were flagged in their own internal compliance compartment. They should have turned those cases over to the dea and said, we have a problem here, someones being overprescribed or a particular pharmacy is doing the wrong thing with this order. They only alerted them to about four of those specific flags, in addition to that, we saw 200 increases. In some cases, a 2,000 increase in fentanyl orders that were filled by this Rochester Drug cooperative in a fouryear period from 2012 to 2016. A landmark case here today, essentially calling a drug distributor a drug trafficker. That is remarkable. Is the company being charged or the ceo . So theyve entered into a deferred prosecution agreement, basically, they sell a lot of other things besides opiates and medications to a whole host of pharmacies here in the northeast. Theyve entered into this deferred prosecution agreement. They have to have a monitor, theres all sorts of things they have to do from a compliance perspective, and the u. S. Attorney saying, if they had pleaded guilty and we put them out of business, a lot of people who had nothing to do with any of this, would have lost their jobs and would have created a lost economic pain fp the feeling is, lets get the right oversight on them. He thinks they can be rehabilitated here. So, yes, they are in trouble. But they are going to have an opportunity to get in better compliance and stop this overprescribing essentially. Is that why hes the former ceo . Why isnt he part of the company any more . Hes the former ceo. He had left and been fired. It was an example, stephanie, where one of his coexecutives went to him and said, we have a real problem with this pharmacy here and we may want to cut them off. Were just shipping them too many opiates, and he said kill them and die. Essentially threatening his executive oh, the executive hes saying with the primary offender here . Yeah. He wasnt saying kill the pharmacy, he was saying kill the executive . No. Yeah, hes saying, look, if you kill this account, dont turn off this account. This particular pharmacy in woodbury, new york, they refer to as pharmacy one in the charging documents here today. Theyre essentially saying look, this is such an important customer to us, we are shipping them so much opiates, dont kill that account. Go ahead and fill through, even though you have all sorts of red flags about this, yeah, just really shocking behavior by the ceo alleged in this indictment. Thanks for your coverage in this.
