Come in and thats it, they cant do anything. I went through congress. I made a deal. I got almost 1. 4 billion when i wasnt supposed to get 1, hes not going to get 1. I got 1. 4 billion. I could do the wall over a longer period of time. I didnt need to do this, but id rather do it much faster. I dont have to do it for the election. Ive already done a lot of wall for the election, 2020. So the order is signed and ill sign the final papers as soon as i get into the oval office, and we will have a National Emergency, and we will then be sued, and they will sue us in the 9th circuit, even though it shouldnt be there, and we will possibly get a bad ruling, and then well get another bad ruling, and then well end up in the Supreme Court, and hopefully well get a fair shake, and well win in the Supreme Court just like the ban. Could you tell us to what degree some of the outside conservative voices helped to shape your views on this National Emergency . I would talk about it. Look, sean hannity has been a terrific, terrific support of what i do, not of me. If i change my views, he wouldnt be with me. Rush limbaugh, i think hes a great guy. Ann coulter, i dont know her. I hardly know her. I havent spoken to her in way over a year. But the press loves saying ann coulter. Probably if i did speak to her shed be very nice. I like her. But shes off the reservation, but anybody that knows her understands that. Theres a lot of department of Homeland Security data out there that shows border crossings at a near record low. Thats because of us. Undocumented immigrants and crime excuse me, massive numbers of crossings. It shows undocumented criminals or undocumented immigrants committing crime than native born americans. Do you really believe that stat . Take a look at our federal prisons. Im asking you to clarify where you get your numbers, because most of the dea Crime Reporting statistics that we see show that drugs are coming across at the ports of entry, that illegal immigration is down, and the violence is down. So what do you base your facts on . Lets go and secondly no, no, you get one. You get one. The question is sit down. Sit down. You get one question. I get my numbers from a lot of sources like Homeland Security primarily, and the numbers that i have from Homeland Security are a disaster. And you know what else is a disaster . The numbers that come out of Homeland Security, kiersten, for the cost that we spend and the money that we lose because of illegal immigration. Billions and billions of dollars a month, billions and billions of dollars, and its unnecessary. So your own government stats are wrong, are you saying . No, no, i use many stats. Could you share those stats with us . You have stats far worse than the ones i use. I use many stats, but i also use Homeland Security. Next question. I believe he would have gone to war with north korea. I think he was ready to go to war. In fact, he told me he was so close to starting a big war with north korea. Now, where are we now . No missiles. No rockets. No nuclear testing. Prime minister abe of japan gave me the most beautiful copy of a letter that he sent to the people who give out a thing called a nobel prize. He said, i have nominated you or respectfully on behalf of japan. I am asking them to give you the nobel peace prize. I said, thank you. Many other people feel that way, too. Ill probably never get it, but thats okay. If you look at idlib province, i stopped the slaughter of perhaps 3 Million People. They dont talk about that. Russia and iran and syria were going to go in and perhaps destroy 3 Million People in order to get 45,000 terrorists. And i heard about it from a woman who had her parents and her brothers living there. She said, please, please. And i thought i said, no, it cant happen. What are you talking about . No, theyre going to i come home and i read a certain paper where the story was there that they were actually forming to go into really to really do big destruction. And i put out a statement that, you better not do it. And in all fairness to russia and iran and syria, they didnt attack, or theyre doing it surgically at least. Saved a lot of people. Yeah, the actual thing was a lot longer than that, we just tried to pick the best parts. That was President Trump unscripted just a little while ago in a wide ranging address in the rose garden announcing hes declaring a National Emergency to pay for his border wall using money from american taxpayers. Lets just be clear about this. Whether the money comes from a bill in congress or an executive action by the president , like a National Emergency, its still all your money. The president is issuing the controversial executive order while using the bully pulpit to boast about trade talks with china, the united kingdom, his relationship with north korean dictator kim jongun, his nomination for the nobel peace prize, how estopphe stopped the slaughter in syria. A lot of stuff. Joining me now is Kelly Odonnell who was there at the white house asking a question of the president , opinion Writer Jonathan capehart. Kelly, im going to come to you second because we heard from you in the mash up we just ran. I want to ask jonathan, you were like me, watching this and listening to this. What do you make of it . Wow, ali, is all i have to say. It was a president like weve seen before, somewhat rambling, going down his greatest hits. It had more of a feel of yet another campaign rally, an announcement of a National Emergency. We are used to well, we used to be used to president s coming into the roads garden declaring such things with a soberness and an importance with a keen focus on that particular issue. But in this announcement, yeah, he talked about the National Emergency, but he also talked about trade and tariffs and all sorts of fentanyl, and all sorts of other things that sort of distracted from what was supposed to be a very important announcement. And the other thing, ali, that i found interesting, is that he the president throws out superlatives all the time. Its the biggest, its the greatest, its whatever. Ive come to view them as a bit of an invisibility cloak for what the truth is. So when he says, i barely know ann coulter. Take the opposite. He knows ann coulter. He knows all these people. I was very surprised by the fact that he i had not seen this reported before, that the Prime Minister of japan, shinzo abe nominated him for a nobel peace prize. Thats news. Certainly news to me. Right. And then the other thing, you played that clip where the president said, i didnt need to do this. I want to do this faster. George conway this is important. George conway tweeted out, this quote should be the first sentence of the first half of every complaint filed this afternoon. I didnt know to do this. George conway is important because he is the husband of kellyanne conway, one of the senior advisors to the president. So, kelly, lets pick up on that. The president said he didnt need to declare a National Emergency to get the funding for the wall. He just needed to do it faster. Worth noting. November 20, 14 when barack obama was president , donald trump tweeted this. Repubs must not allow president obama to subvert the couldnt institution of the United States for his own benefit and because he is unable to negotiate with congress, which sounds like exactly what donald trump just did. Well, and our colleague Peter Alexander asked that. I tried to get at that in one of my questions to the president where i asked him about how he acknowledged he had been new to politics and he thought this could have been done earlier in his administration. I pressed him, are you talking about speaker ryan sort of letting you down as he seemed to hint . And this is a president who, while he kind of put lyrics together for a tune about the coming court case of trump v. Whatever attorney general or stakeholder it will be, as you know, he had that singsongy answer about going to the court. The president didnt seem to recognize this was a presentation that would, in fact, be cited. I was also struck as jonathan was, this was not a teleprompter event. It seemed like a bullet point moment for the president where he had a lot of things he wanted to talk about and there were many other things that seemed more important to him than the reason we had convened in the rose garden to begin with. The president sometimes is quite transparent in that whats on his mind comes out of his mouth, and he wanted to talk about other matters. He also talked about a plan to have Speaker Pelosi and leader schumer together with him to talk with president xi of china for the trade march deadline discussion about tariffs and so forth. He also talked about in the next 24 hours, there will be announcement that a caliphate held by isis land area that they have controlled would be no more. There were so many head points this this that get away from even the reason we were there together, a National Emergency. Right. And he seemed to refer to it as a tool, knowing that its going to court almost, ali, he knows where this is headed. Go to the 9th circuit. Wont go well, go to the Supreme Court before he even fully announced it. So, jonathan, part of the thing that i think is important for people listening to remember, whether youre part of Donald Trumps base or whether youre ann coulter, Rush Limbaugh or sean hannity whom he named specifically, or whether you dont like donald trump, its still the same pot of money, right . People need to understand its all the same pot of money. The president has talked about taking money from disaster relief, puerto rico, california, theyll sue over that. The money has got to come from somewhere. He had asked for 5. 7 billion for a wall we knew was going to cost, for what the president wants, well over 20 or 25 billion. Now hes talking about this, getting him about 8 billion which still wont build him his wall. Its still taxpayer money. Right, it is. And from the reading that ive been able to do, the money that had been threatened to be taken from disaster relief, that is not happening. However, there appear to be money that they have identified that they can take from Construction Projects from the department of defense and other places. Its the equivalent of the white house diving under the couch cushions trying to find money so the president can come up with the 8 billion he says he needs to build this wall, although as weve been reporting all week, especially since that rally in el paso, that the wall is already being built. Despite evidence to the contrary. Ali, to go back to the court thing and kellys comment about the president s singsongy answer about how he thinks this is going to go and he is anticipating the court case comes out of the 9th circuit, which is known as the most liberal circuit in the federal judiciary, what happens i think Michael Steele made this point. We have to keep this in mind. What happens if the court case doesnt come out of the 9th circuit, but the 4th circuit based in richmond, virginia . This is the kind of case where you have a president declaring a National Emergency, which under other circumstances say if it were president obama, republicans would declare this an overreach of executive power. They said that when president obama used executive actions on things for immigration and other things, saying he was using that power too much because he was subverting the power, the constitutional powers of congress. Now we have a president who is using a National Emergency to the democrats mind, subverting congressional authority. And there are republicans and there might be conservative federal circuit courts that might agree that what the president is doing is an overreach of executive power. How will the president respond when its not the 9th circuit that slaps him back. That changes the narrative just a little bit if that were to happen. Kelly, thank you for your great reporting today. Im going to break down exactly what constitutes a National Emergency, what is it, what is it not, and how much power does the president wield when he invokes it. President trump signalled he would extend the deadline another 60 days if the talks are going well. Thats why youre seeing a strong market today. President trump announced a National Emergency to build his wall on the border. Lets take a look at what it means for the president to declare a National Emergency and what congress can do about do about this . Accord together law, congress wrote need to pass a joint resolution, getting the agreement of both chambers of congress, to terminate a National Emergency. Now, like any other bill passed by congress, it would go to the president s desk. If the president were to veto the termination of a National Emergency, congress would then need to override that veto to force a termination and that would typically require a twothirds majority. With Mitch Mcconnell announcing that he would support the president s Emergency Declaration a declaration an override of it seems unlikely. What is the president planning to do with this one . Hes authorizing 8 billion for border wall contraction, notably thats more money than he was asking for before, 5. 7 billion. Whether its 5. 7 or 8, it doesnt come close to building the amount of wall he wants to build. But it comes from several sources and were going to dig into the issue of money coming up. The declaration can be challenged in court like we were discussing likely making being its way to the Supreme Court fairly quickly because none of this money is appropriated for a border wall. Lets talk about this a little more. Joining me now is michael waldman, president of the Brennan Center for great to. Were looking around the country for people who have studied these National Emergencies and the power that it gives the president. We certainly talked in the last several years about executive authority, you know, president executive actions that they take, that to a lot of people who grew up understanding how bills and laws are made, seem unusual. This is a different version of that. Its something the president , him or herself, can do. Thats right. President s, all president s use executive orders. This is a more dramatic exertion of executive authority with much greater, i think, constitutional problems. But as you showed, congress in many years has given this president and all president s correct. As it turns out, pretty vast authority to declare an emergency. But even sew, it mo, this goes. The courts may find this goes too far. The National Emergencies act doesnt define what an emergency is. Emergencies declared before, things like hurricanes or things that feel like they might be an emergency. Yeah. Ann coulter doing an unpleasant tweet about a budget deal does not actually count as an emergency. And so the question is will the court say, this is too much of a pretext. You cant just as the president start moving money around because you dont like the way a budget negotiation the Brennan Center has an article out today saying the president s declaration is an abuse of power. One of the things that Jonathan Capehart was pointing out was in the president s declaration or his, whatever it was in the at the white house today, he said, i didnt know to do this. I just did it so that we can do it faster. One of the interesting novel questions the courts have having to deal with these days is what do you do with the stuff the president says or writes or tweets . Yeah. My view is hes standing in the rose garden announcing this act of a National Emergency. Its important to take that kind of thing seriously. This is not just some guy spouting off. Right. Even if there is an emergency or that power is allowed, then the question is there are 123 specific laws that must be followed. They need to do this under some legal authority. And the question is, is this, in fact, military spending, for example, is it really the case this is something the military legally can do, especially since hes also signing a budget deal that treats it as a civilian matter and not an emergency. Right. So this will go to the courts. It will be challenged maybe by the house of representatives, maybe by some rancher who has a wall built through their property or some state. Right. But even sooner than that it becomes a real political issue and a challenge, i think, for the republicans in the senate. There will be a resolution they only come down on one side of this or the other. They generally dont come down on the side of imminent domain and peoples land being taken away, Emergency Declarations that confuse civilian activity with military activity. And it cant be bottled up the way the senate always is able to bottle things up. The house will pass this presumably and then senators will have to vote on the record, not just oh, what do you think of Border Security, do you like the overall balance in a budget bill. Do you agree with donald trump declaring maybe a fake National Emergency to build the wall with taxpayer money . Yes or no . Thats going to be the wall will be a ball and chain around a lot of that will be the election commercial used for every single one of them. Then it will be a test for the Supreme Court. Because Supreme Courts very often give deference to president s. There is also a strong record when it really counts of Supreme Courts standing up. Thats the question. There is another principle at play. The president talks in admiration for the leader of turkey or philippines. Whether turkey or venezuela or iran, this mixing of things that are civilian with military, which americans seem to take more seriously, right . We love having the National Guard go in when theres a hurricane or National Disaster or core of engineers when a dam is going to break or something is going to flood. We dont generally look at the military as a replacement for civilian activities, particularly construction activities. We really recoil from that. There is a law called posse coma tatis that prohibits them from doing something on the soil. We understood from the founding of the country there is great danger in that kind of thing. We understood from the beginning that these checks and balances are part of what makes us free and what makes us special. And youre right, look, there are real emergencies. There are all kinds of debates over policy. But we look all around the world and know that when leaders can declare an emergency and use the extra power that comes with that, it can be quite dangerous. So one of the things that i hope happens out of this, in any event, is that this National Emergencies act which honestly most of us had no idea existed we perhaps need to narrow that up a bit. It was intended to make it harder for president s to abuse power. As it turns out, it has been a green light for a lot of things, or at least the potential for it. The powers donald trump has, that he is abusing, he didnt make those up. They were handed to him. Archipelago that is a very good point. Were talking about an invasion of our country with drugs, with human traffickers, with all types of criminals and gangs. Last year 70,000 americans were killed at least i think the number is ridiculously low by drugs, including meth and heroin and cocaine, fentanyl. We want to stop drugs from coming into our country. We want to stop criminals and gangs from coming into our country. Thats the president of the United States conflating and mixing up things in order to defend his position. Explaining why he thought it was absolutely necessary to declare a National Emergency to build a wall at the southern border. The president says the main threats are criminals and drugs coming across. For facts sake, let us look at the reality on the ground. The president said this was, quote, an invasion of our country with all kinds of criminals. But less than 3 of immigrants stopped at the border either entering illegally or through legal ports of entry, less than 3 have a criminal history. That is according to customs and border data from august of 2017 to august of 2018. That is border customs under President Trump. The trumps own threat assessment points out while drug related murders in mexico continue to reach epidemic proportions, there is, quote, little spill over violence in the United States. This is the Drug Enforcement agency in 2018. As far as President Trumps claim the wall would stop drugs from coming into the country, well, according to the deas 2015 National Drug threat assessment, cartels, quote, transport the bulk of their drugs over the southern border through ports of entry. Big pieces of land that dont have a barrier that might have a river, that might have a canyon, theyre not actually the place where the bulk of the drugs come from. These are ports of entry. Ports of entry is a place you go up to and there is a human that checks your truck or your car or asks you questions. Customs and Border Protection shows in 2018, 90 of heroin, 88 of cocaine, 87 of meth, and 80 of fentanyl seized along the border was being smuggled in across legal ports of entry. Apparently the president doesnt have access to these statistics. So if any of you have them, well post this. And can you please forward it to real donald trump . Joining am joining me now, Julia Ainsley and nbcs Gadi Schwartz live along the san diego border. These are people who dig into this stuff very, very specifically. Julia looks at all the data she can find both official, anecdotal, from third parties. Julia, lets start with you. Can you talk about the president s claim that a lot of these people crossing the border are dangerous criminals . Yeah, ali, id love to. Its not just important today when hes making the case for the wall. They will continue to use these statistics to justify a lot of policies we may see Going Forward against Asylum Seekers who are coming to the border. So on that claim, yes, less than 3 , i did the math, of people who came to the border during the latest time period, fiscal year 18, had a criminal history. But the top, the far leading criminal charge of that less than 3 was illegal reentry. Those were people who were already deported and they came back. So that is a felony under u. S. Law, but it is certainly not a violent crime. Another piece of information is according to kato institute, a libertarian think tank, they took crime data from texas, because texas is one of few states that breaks out crimes by nonu. S. Citizens versus u. S. Citizens, and they found that per capita, u. S. Citizens commit more crimes than nonu. S. Citizens that are legal or legally here in the United States. So that is something that the president was confronted with today and he just completely dismissed. But that does not he specifically said i have different data than you have and i trust my governments data. You and i have had specifically this discussion. The last time you, julie and i, talked about d. H. S. Data, it was misrepresented data about the number of possible terrorists coming over the border where the president said, quoting d. H. S. Data and secretary nielsen, 755 on a particular list and the real number was 6. Thats right. It was 6 in the first half of fiscal year 2018. On a database. We were able to get that because thats the data that customs and Border Protection provided congress. So its really not a matter of picking and choosing your data here. The numbers speak for themselves, ali. But if you notice, he did not mention terrorists coming across the southern border. I think theyre starting to get away from the terrorist argument and focusing on criminals and drugs. Again, you pointed out how important it is to realize that those drugs are not coming through anywhere that a wall would be able to block. Theyre coming through legal ports of entry. And just last month, customs and Border Protection, some people who have ph. D. S and being able to detect biochemicals and drugs coming through the border, they detect these things very quickly, very well. And one thing they found, they found in record number, 254 pounds of fentanyl coming through in what looks like a truckful of cucumbers. Yep. Thats something that wasnt spoken about today either because he doesnt want to focus on people catching them through their day to day job. A remarkable success, by the way, of customs and Border Protection and the Border Patrol getting this stuff. Its actually pretty successful. Gadi, i want to be clear. We are not taking a position on the fact that there needs to be Border Security and a country needs to have Border Security. But on the issue of drugs, which you follow very closely, the president has said over and over again that the wall will stop the flow of drugs into this country. There is no debate there are some drugs that come over the southern border, most of it the vast majority comes through ports of entry. Maybe some comes otherwise. But the fact is of the 70,000 deaths from drugs that the president talks about, many of which are from heroin, fentanyl and other opioids, they come in not just through ports of entry on the border. They come in through airports. Yeah, so yesterday something happened that was really interesting. I havent heard Border Patrol necessarily be open about this. Usually when you hear from Border Patrol, theyre talking about those big drug seizures that weve heard about. But yesterday we were spending a little bit of time on the border with the Border Patrol chief here in the san diego sector, and he didnt tell us about those stops. He told us about something that happened a few weeks ago where they found a cut in one of the old legacy walls and they found tire tracks that led off into the desert. But his Border Patrol agents werent able to get there in time so they dont know what crossed over into the United States. And he says thats what keeps them up at night. And thats what theyre saying is a crisis. Theyre saying that what theyre seeing on the mexico side is a lot more family units, a lot more migrant caravans and that is diverting the resources to processing some of these family units, keeping Border Patrol agents and things like hospitals, he said there were about 40 different Border Patrol agents assigned to hospitals in the san diego sector on any given day and its keeping them away from these desolate stretches of the desert where sometimes human smugglers and sometimes drugs do cross, even if there is some sort of wall there. So what theyre saying is they want to see smart fencing installed, basically fencing that you see up here along the edge. Its fencing that has fiberoptic cables, thats the type of fencing they want installed. This stuff here, they say this isnt very effective. Its gotten to the point where you can cut through it in a matter after a minute, minute and a half. They want the secondary fencing stretching all the way through. California is an interesting place. While the president was speaking, we were talking to people crossing the port of entry, san ysidro port of entry. One of the busiest crossings in the world. We asked them, is there a state of emergency here . The majority said it doesnt feel like a state of emergency. Thats what weve heard on the california border. Some said that worked over here in the store it did feel like an emergency because this area was shutdown several times because of the migrant caravans and skirmishes that happened over here. When we broke that down there was a little bit of a disconnect. We started asking them about beto orourkes suggestion yesterday and his comments that he may be willing to see the border taken down in el paso. When we asked people that live around here what they thought would happen when the fence would come down in san diego, they said overwhelmingly, out of 27 people, 25 of them only two people said the opposite. But 25 of them said that it would be chaos, that it would be a disaster and we would see a flood of people crossing the boarder like they saw in the 1990s and 2000s. A lot of people saying there is no emergency, but a lot of people also pointing to these fences that have been up in california for well over a decade. Ali. And we have breaking news from the Supreme Court which has Just Announced it will take up a major case about declaring citizenship on the u. S. Census. Nbcs Justice CourtPete Williams is here with us. Pete, whats this about . Right, this is the fight over whether a census question will include citizenship. The commerce department, wilbur ross, the secretary, announced he wanted to do it. That led to a lawsuit by 18 states, some of the nations largest cities and many civil rights and immigrants Rights Groups who said if that question goes on the form, it will suppress the responses by hispanics and others in the United States and will under count the population, hurting those communities in two ways, because obviously the census figures are used to figure out how many seats a state gets, an area gets in congress. And secondly, those figures are used to help calculate how much money communities get under federal programs. So they won in federal court in new york and now what the Trump Administration has done is its gone to the Supreme Court and said, look, let this case leapfrog over the appeals courts. Take it now. Because weve got to get these census forms printed. We have to start printing them in june and youre the only one who can answer this questions. A short time ago the Supreme Court said it will do that, it will hear this case on a fast track in the second week of april. Now, the Trump Administration was defending this saying questions about citizenship or ore jor or origin have been on every census sense 2000 and its asked personal demographic questions, like relationship status, race and so on. And that this would not suppress the count. So, anyway, the Supreme Court is going to take up this very hot button question on a fast track hearing it in april. Ali. Pete, i dont know how you do it. I live in amazement. A piece of news comes out, pete appears on tv and gives you the clearest jigs of what happened. Youre a human encyclopedia. They let me do my homework. We appreciate it.
