Senate Judiciary Committee will decide how and through which forum. Ive known him since 1994. I worked alongside him. This is so wildly out of character. This is unfair to judge kavanaugh. This is an allegation thats 35 plus years old. And now youre going to attempt to try to deal with this in a truncated period of time. Should the Committee Vote coming up . Im going to be talking with my colleagues. Do you believe the accuser . I dont know enough to make a judgment. This is a dire situation. That slow moving disaster that was florence is leaving behind a trail of destruction in her wake. Flood waters are still raging across parts of our state. And the risk to life is rising. Our roads are cut off. Theres no access to wilmington today. The Cape Fear River and the cross creek are over their banks and its only getting worse. Downtown fayetteville, portions of the city are you should water. Ive been through every hurricane since the 70s and never experienced anything like this before. Hopefully fema helps the citizens. And our coverage of florence will continue, but right now Supreme Court nominee Brett Kavanaugh is at the white house as cracks appear in the republican support for the Supreme Court nominee just days before the Judiciary Committee is scheduled to vote on his nomination to the Supreme Court. Over the weekend dr. Christine blossi came forward identifying herself as the woman who in july sent a confidential letter to Diane Feinstein where she alleges kavanaugh sexually assaulted her in the 80s when the two were in high school. Nbc news hasnt seen the letter or spoken directly to her, but her lawyer said this morning that she considers the act attempted rape. In a statement this morning kavanaugh denied the allegation adding because this never happened, i had no idea who was making this accusation until she identified herself yesterday. I am willing to talk to the senate Judiciary Committee in any way the committee deems appropriate to refute this false allegation from 36 years ago and defend my integrity. Lets look at how republicans are responding to the allegations against kavanaugh. Over the weekend senator jeff flake who sits on the senate Judiciary Committee, thats why this is important, told the Washington Post, quote, ive made it clear im not comfortable moving ahead with the vote on thursday if we have not heard her side of the story or explored this further. Bob corker told kasie hunt they should give her a chance to be heard. Its best for all involved including the come knee. And Lisa Murkowski was asked if the vote should be delayed. She said that might be something theyll have to consider, at least having that discussion. And when following swing vote Susan Collins, she was asked the same thing. She told cnn im going to be talking to my colleagues but i dont have anything to add at this point. Heres a bit more of her response to the allegation itself. Well, i obviously was very surprised, and its an issue that i brought up with him last friday, and he denied as he did in his written statement. Thats really all i have to say at this point. Reporter do you believe the accuser . I dont know enough to make sunday afternoon Lindsey Graham released a statement saying if the committee is to hear from misblasye it should be immediately to is hearing can continue as soon as possible. All ten members of the Judiciary Committee are calling for the vote to be delayed. Thats up from the seven democrats we heard from as of this morning. Theres been an issue as of the timing. It came five days before this thursdays Judiciary Committee vote on kavanaugh nearly two months after she sent her letter through a congresswoman to the Committee Ranking democrat Diane Feinstein. 1992 an affidavit submitted was leaked to the press a month after the submission. That news dropped just two days before the full senate was to vote on thomass nomination. The all male Judiciary Committee, it was all men back then, quickly called professor hill to testify at a hearing. Todays committee includes four women. But any decision on judge kavanaugh would be in the hands of 11 men, because these 11 men are the only republicans on the committee. There are zero women in the senate Judiciary Committees majority. The reporter who broke the story is with us, and also beth. Beth, the president was elected despite comments that he made on the record that would destroy any other candidate. I mean, do you remember the damage textbooks of women did to mitt romney . Lets share with President Trump said. I want to share this sound. Its like a magnet. Just i dont and when youre a star, they let you do it. You can do anything. Grab them by the [ bleep ]. You can do anything. When youre a star, you can do it. You can do anything. Remember, he went backstage at pageants with teenage girls because he could see them undress. Well, you know, donald trump is sort of the man of no consequences. Things that happen to him, he gets away with that other people dont. This is a slightly different situation. That information, we knew about donald trump and voters decided to go ahead and elect him president. Its not as though the information wasnt out there for voters who assess. This is a different situation. This is a lifetime appointment to the Supreme Court. This is not something that is subject to voter well or whim. Thats why its got to be taken more seriously. And the republicans, when mark garland was put up. They said the voters the implication is voters should have input into what Supreme Court decisions will look like. I guess theres that, and that may influence at least the two senators who are not having to face an election because theyre retiring, bob corker and jeff flake. Jeff flake saying there should be a delay is monumental. I believe al franken was on the senate Judiciary Committee. Put into perspective the amount of people including Lisa Murkowski who called for al franken to step down. Well see. Weve seen a lot of republicans now, more than i would have expected starting to say maybe there ought to be a pause. Surprising. If you think about it senator grassley was out with a statement within an hour of the Washington Post article being published. Basically saying the whole thing was a democratic plot to thwart the nomination at the last minute. Didnt consider the substance of the allegation that much. Over the course of the rest of the day and today were seeing more reflection from republicans. Its up to Susan Collins at this point for her to put the brakes on this. This is on her now. The brakes or a pause are not withdraw your nomination. Theyre simply a pause. Right. We dont know what conversations are going on at the white house between kavanaugh and the president. But i am puzzled why we all back into corners on this sort of thing. We dont know what the truth is here. Theres an allegation. There is a refuting of the allegation. Lets go to emma brown who is at the Washington Post. It is kind of interesting. Youve been reporting on this about what the allegation is and about what Brett Kavanaugh has said back. We dont have any evidence of anything. We dont have proof. Why people are saying the allegations must be untrue is puzzling to me. Yeah. Well, i think, i mean, honestly this doctor ford came forward, and in a politicized moment. That probably has something to do with the strong feelings. What i can tell you is that she first contacted us here at the Washington Post before Brett Kavanaugh was the nominee. He at this point was on the short list. It was early july. And she was terrified. She did not want to use her name in the paper. She did not want to speak publicly but wanted to tell somebody the story of what happened to her, and so we spoke off the record which, of course, means ive gotten emails asking why didnt we investigate. I did investigate as much as i could without betraying her confidence at this point because i promised her i would not tell her story. She did the same thing, of course. She sent a confidential letter to senator feinstein, and she says feinstein also honored her request to keep that secret until stories started trickling out last week that there was a secret document and then it snowballed from there. Can we explain that in a bit more detail . Many are saying this is hyperpoliticized. Its two days before his confirmation. If Diane Feinstein was aware of this since july, why didnt she take action . Can you help us understand that a bit more . What she was doing was respecting dr. Fords wishes. Right. From dr. Fords perspective, she sent a letter to senator feinstein that clearly said i want this to be kept private and confidential. This is not to be shared. And so from dr. Fords perspective, feinstein honored that request. This is inherently, obviously political. Its a politicized process. The confirmation of Supreme Court hear sings are political. The same things were said when anita hill came forward. It was two days before the full senate vote back in 1991. And the same things were said about her and the same machines went into play to criticize her and to undermine her credibility. Right. I mean, there were a lot of things that were similar and a lot of things different. That was a republican president , george bush 41 who nominated Clarence Thomas. A republican senate. The Judiciary Committee was controlled by democrats. Joe biden was in charge. And there was an amazing hearing that we all remember, all men. The all male Judiciary Committee grilling her. Biden coming under quite a bit of criticism because he didnt bring forward some witnesses who could have corroborated her story so left anita hill there to be alone in front of this all male tribunal, and Clarence Thomas was confirmed a couple days later with the support of 11 democrats. The senate is much, much more polarized than it was back then. Back then there was a sense of advice and consent. The Typical Senate role. Thats what they do. Allow president s to confirm the judicial nominations they want. Theyre the president. That was still a bit in play. As we know now, its really very different. Everything is political. The Supreme Court justice nomination process is as political as it gets. Does that mean they can or cannot if youre for republicans, go the Clarence Thomas way and push this forward . Again, you could simply slow this down. Right . Matt miller on twitter earlier said this is black and white. You believe her or him. Thats not the case. Many people could say hold on. Lets hear what this person has to say. And Brett Kavanaugh could potentially even if he is absolutely innocent, could say let this person speak by brushing it under the rug, thats what gives people discomfort. Right. And weve known Mitch Mcconnell wants to get this done so they can have that ninth justice on the court but hitch didnt pick him. Certainly not. And Mitch Mcconnell raised questions about the nomination to begin with because of the long paper trail. He does want its his mission is to have as many conservative jurors as possible out there. He wants the ninth justice on the court for when the court begins in october. Well see if he decides that yes, as you say, why not just give it a few more days and figure out if we can get more information to understand whats going on. All right. Thank you very much. Beth, senior politics editor. And emma brown who broke the story. Thank you both. Right now wilmington, North Carolina is completely cut off from the mainland due to record breaking flooding. Well go live in a zi that is now an island because of hurricane florence. But first, fema is set to test a new president ial alert system on thursday. A desperate situation is unfolding right now in the carolinas. Florence is weakening, but officials are saying the worst is still ahead. You hear what were saying in exhausting residents are bracing for more flooding as it continues to rain. The storm now a tropical depression is being blamed for a total of 19 deaths. By the way, great reporting. Welcome home. Thank you. This is what is happening. These things are more serious in the aftermath. Crews are getting ready to air lift food and supplies to wilmington. Theres sort of a intercoastal waterway that leads to a barrier island. The other side is the Cape Fear River. More than 30 Million People are under a flash flood watch. Florence is covering parts of six states as it moves up the coast. We have two reports beginning with Gabe Gutierrez on a boat with the coast caguard in North Carolina. Whats happening where you are . Good morning. This is one of the communities further inland that is now dealing with flooding problems. Its all that rain rushing down river. In this community the may Fair Community in lumberton about 200 homes. Lumberton, population about 21,000 people. It was hit hard two years ago but matthew. Its flooding again. We saw several people evacuated. A mother with twins was evacuated. Im joined by nathan cox with the u. S. Coast guard. You guys have been out here since yesterday. Right . How many people have had to be evacuated from this neighborhood . Close to 12 to 20 evacuated. Many families want to stay with their homes. Thats their choice. We urge them to come with us. Were doing wellness checks. Going through the neighborhoods, knocking on doors and ensuring the citizens are safe. They need water, food, anything like that. Reporter this is one of the areas further inland. This wasnt one near the coast that had any wind damage or any of that. But the rain recently stopped. There was rain here overnight. And now the concern is some of the rivers may be rising. What are you seeing today in this area and in the surrounding areas . There are some neighborhoods that are still rising in tide. When the tide changed we saw the water levels rise higher than yesterday. Its a little bit deceiving. I think some people look at the river totals. Whats happening is outside waterways are also collecting water and the water is being pushed into neighborhoods like this. Right. And the lumbar river crested about 25 feet or so. Thats at or near records compared to hurricane matthew. And ali and stephanie, theres a concern about the Cape Fear River just north of here in fayetteville that forced a mandatory evacuation. This is an ongoing disaster here in this part of North Carolina. Even though we kept hearing over the past couple of days, and ali, you were in myrtle beach and wilmington had damage. Now the areas further inland are having to deal with it as well. They may be dealing with a few days as the rivers crest in places like lumberton. Gabe, thank you for that coverage. Lets go to kal perry in wilmington. Reporter wilmington is now an island. This community is cut off from the rest of the state. This neighborhood look it hard. I want to bring in hunter who is here trying to help clean up and get people back into their houses. It seems like this neighborhood took it really bad. What are you seeing . Yes, sir. We see a lot of large trees on homes that require a 40 ton crane to lift the tree off the house. Once you do that, you leave a lot of holes in the roof and to keep the water out, we need a temporary br temporary barrier to keep the rain out. Reporter you came from florida . Yes. Reporter where did you ride out the storm . Outside of wilmington and whitesville. Once the storm weakens, we made our way to wilmington. We stationed our heavy equipment around it to keep us safe. Thank you very much. Reporter one of the things were learning here is people like hunter had to bring their gas with them. 150 gallons of gas. Yes, sir. Reporter thats a big problem. The gas stations opened yesterday. Quickly there was a run on the gas, and now the gas stations are running out of gas. Its going to be the focus in the next two days getting people out who want to get out of wilmington who cant get down the highways because the highways are rivers and getting the rescue workers in here to take care of houses like this. We were there together a few days ago. Shortly after the hurricane when everybody thought it was over, you could still get out. I think you had seen a couple of gas stations open late saturday night or sunday. And then as you say, they run out of gas. When you see the highways, when theyre not water logged, you see coming into the hurricane area convoys of those bucket trucks that cut the trees down and work on power lines. And convoys that are carrying gasoline. The roads flood and you cant get that stuff in right now. Are there ways to get out at all and get supplies and gasoline in or are we going to have to wait until the flood recedes . Reporter not this morning, and not today. But as you said, yesterday there was a window. And it was about a 12hour window. We saw people being moved from shelter to shelter on Public School buses. The authorities took advantage of the window. They got some supplies in. As you said, you have staging areas north of wilmington where people were waiting to come in. The window opened for a short period of time. Its shut again. As we hear, the river is still rising with another 12 hours to do so. Thank you very much. Its such an important report. Yesterday im hear in new york city and i overhear two women at a playground brushing it off going thats just a Tropical Storm now. I dont think people understand. I dont think Hurricane Sandy was a category one. I think it may have been i lost my new york city apartment for six months and i had other places to go. You were just there in this coastal region. These people are devastated. We have to learn different ways of doing thingsing. Its shocking to talk about categories of hurricanes up to five. Were used to talking about that. We used to just see the wind damage. After katrina, we need to learn water damage is dangerous. And it lasts and what it does. 85 of deaths from hurricanes are water, not wind. Think about the communities without power. Its a lot. Well keep covering it. Manaforts money. He has a lot of cash and property and expensive clothes. Were getting a better understanding of Paul Manaforts money grabs thanks to a friday court filing by the mueller team. The deal could cancel out one of the president s main complaints about the probe, how much it costs according to the Washington Post. In the cooperation deal struck last week, manafort agreed to give up several lavish properties the government said were illgotten gains including his hamptons house worth up to 7. 3 million. In brooklyn hes giving up his brown stone worth 4. 1 and in manhattan, three apartments in different building combined worth 10. 8 million. And his money. The Court Filings dont lay out how much money is in the three accounts they seized or how much of the money was owed on loans he took out, but there are potentially tens of millions of dollars there as well. His Life Insurance policy that could be worth up to 4. 5 million, all of that adds up to a whole lot. More than 42 million counting just the money that we know. And that number could help stamp out the president s recent tweets criticizing the cost of the investigation. With the tab of an estimated 25. 9 million last i checked, 424 million certainly cancelled that out. Thats one way to do it. Joining us now ken delaney. I want to ask you about whether or not this deal gets Robert Mueller any closer to his investigation of President Trump. Well, obviously we dont know the answer to that, ali, 100 . Look, Paul Manafort came to the campaign with more russian connections than anybody else who worked around trump. If there was a conspiracy between the Trump Campaign and the Russian Election interference effort, you got to believe manafort had knowledge, and donald trump was known not to have used email. While mueller has documents from the campaign, its unlikely theres a smoking gun document written by donald trump ant collusi about collusion. But manafort will be asked about meetings and the trump tower meeting and anything else related to russian connections. He was in the trump tower meeting. He has close ties to roger stone who was aware of wikileaks and they were part of the email hack and dump. Walk us through this. Robert mueller is no chump. If President Trump chooses to pardon Paul Manafort, what does that do to the deal they struck . Well, he would manafort would be compelled to come and testify. A pardon would remove any fifth amendment right he had against selfincrimination. He would have to come and tell the truth. People would say his incentive would be less because he wouldnt have a huge prison sentence over him. But if hes already proffered certain information to mueller and hes had meetings with the mueller team and told them things, he would have to testify truthfully and there would be the specter of state charges. If you evade federal taxes, it stands to reason youve also evaded state taxes. And the pardon doesnt effect those things. What happens to things the government seized . Well, theres an Asset Forfeiture fund. The government seized about 1. 6 billion in criminal and civil forfeitures last year. They give properties to Real Estate Agents to sell. Sometime they use seized assets in a scandal in the 70s the fbi used a seized yacht. Interesting. Think theres a group of people like lets keep this stuff for a sting operation . If i was on the team, i would be trying on the ostrich blazer. I dont have one, but at that point you cant wear one. People say things like ostrich blazer, isnt that like manafort . I invite you to wear one. A serious story when we come back. The texas board of education voted to remove Hillary Clinton and helen keller from their history lessons. Texas board of education is raising eyebrows with a controversial decision to remove certain historical figures from the classroom but keep others. It eliminates figures like Hillary Clinton and helen keller. The decision will be finalized or amended in november. We are not talking about foot loose. Were talking about the United States in 2018. In the same vote they reinsert references to moses in a High School Government that highlights individuals who laws and government institutions informed the american finding. I dont think you need to take moses out. Im not going to comment. I dont understand why there are people who dont like donald trump, but you cant take him out american history. Stay with us. Officials say the move will be streamlined. Lessons for 5. 4 million Public School children. Joining us now to discuss this the texas government reporter who broke this very important story in the dallas morning news. Okay. Help us understand the criteria and reasoning for removing 2 public figures like Hillary Clinton and helen keller. Well, its a little complicated but first, just good morning from texas. Good morning from texas. Thank you for having me. They actually set up a rubric. The state board of education chooses these volunteer work groups that are made up of teachers and parents and really whoever they want to nominate. The volunteer people set up a rubric grading everything Texas School Children are required to learn and they gave them a number from 1 to 20 and if you didnt score well on the rubric, they recommended you be cut from the curriculum and both helen keller and Hillary Clinton did not score well. So they were recommended for deletion, and the board approved that on friday. So one of the things that i this has been controversial with the Texas School Board and textbooks for a long time. A lot of states dont develop their own textbooks. What texas publishes ends up influencing kids way beyond texas, because some states dont have the wherewithal to decide what the curriculum is going to be recreated. This is much more influential than just texas. It is. And, actually, theres an important distinction to be made. Were talking about curriculum right now which is what lessons kids are required to be taught, and then based on that curriculum, thats how they write the textbooks or the online instructional material. Theyre not changing the textbooks now. They did that in 2014. They also i remember that big debate. It was the same argument o ore over moses and whether he should be in the government textbooks and thats when it all started. This year they decided to streamline and try to make the curriculum and more compact. Thats when they recommended the deletions. Its important to note that billy graham, the evangelist was also recommended for deletion from that same section that Hillary Clinton was in, but the board decided to reinstate him and put him back in. In the score system, 12 points, keller got a 7 and clinton got a 5. In this hyper you dont have to say that you love her or hate her. She is part of american history. We dont like hitler. I think we all agree we dont like hitler. I think all of us can agree you cant write him out of history. Right . 100 . Its important. You could believe that religion shouldnt be taught in school, but if there was a religious aspect into the founding of the United States, it has to be part of it. So lauren, to what degree is this actually kind of political . In 2014 when the discussions happened and there were questions about creationism and all sorts of things, it does feel like its a bit of a conservative ideological push into the curriculum as opposed to just random people voting on stuff. Well, the state board is an elected body. Its 15 people. There are 10 republicans sitting on it and five democrats. It is a political board. And its been kind of a hot bed for dissension and disagreement. The culture war concepts have always been happening over and over it seems like every year theres a new controversy with something that the board chooses. It is highly politicized. And a lot of people dont know we hear a lot of talk act trump. We hear a lot of talk about clinton and the national politics. But this board is elected, and most people in texas probably dont know who their state board of education representative is, but they actually do have a say in who sits on the board if they get involved in voting. Is this a vinyl decisifinal . Is it reverse snbl. They can change it. In november theyll meet again and take a final vote on the curriculum. This board has complete control. They can put in any one they want before then. But in november the decision is final, and then in a few years when they write the new textbooks for social studies theyll base it on this curriculum. Lauren, thank you. I keep thinking of all the schools that are working with ten, 15yearold textbooks. Maybe we should just focus on getting kids new ones. I want to point out the group to recommended dropping helen keller is saying she does not best represent the concept of citizenship and instead military and First Responders do. Over phenomenon you want to make that argument, how do you take Hillary Clinton out of the books . First lady. Ran for president. She scored lower than helen keller. Ran for president of the United States against donald trump as secretary of state. Again, what do you say . I get the problem of theres too much stuff. I get that. Thats like this is me in a texas school buck book. A Border Patrol agent has been arrested and charged with killing four women. How one womans escape helped break this case wide open. The county, the city can rest assured that we have a serial killer in custody. First, the officer in these murders was off duty during the killings. Theres a long pattern of violence related to Border Patrol agents on duty. Custom and Border Protection agents have been responsible for 9 deaths along the border including six kids. Many cases have been settled in court after wrongful death claims. Theres a lot to go through here. The question is is this a few bad apples or more than that . Your brain changes as you get older. Welcome back to velshi and reuhl. A Border Patrol agent is under arrest in texas, suspected of being a serial killer. Authorities say 35yearold Juan David Ortiz killed four women in the last two week s alone, thei bodies were found in webb county. The arrest was made while they were at a gas station. Once in custody, police say he confessed to the murders and hes now being held on 2. 5 million bond. My question to you is, im sorry, why isnt he being held i mean why is there even 2. 5 million . First, what prompted the woman in his pickup truck to run . When my colleagues and i were reporting, we found that she was talking about a friend of hers that was actually one of his victims, he said she was missing, she didnt know where she was. She was able to escape at a gas station, she was able to get out. The documents we received said that he was pulling on her shirt and she was able to take off her shirt and get away and then she ran away and ran into a state trooper. How did they come to cross this guy . I mean why was she even in his truck . He was going after sex workers. He was targeting them, he found them at different places, they would go with him. Its unclear what his purposes were, but the m. O. Was that he would take them out of the city limits of laredo and he would shoot them in the head, unfortunately. And that was his doing. Its unclear what his motivations were to do that. But if Law Enforcement really wanted to emphasize to my colleague and i that he wasnt doing it under the guise of his uniform, he was doing this on his own free time offduty. What do we know about who he is . Hes an intel supervise with Border Patrol. His areas that he would patrol included the areas he would kill those women which was on the outskirts of laredo. Ortiz is the second Border Patrol agent accused of murder this year. In april, an 18yearold agent was charged with killing his girlfriend and her 1yearold son. Three other Border Patrol agents were arrested accused in sex crimes. Listen, i realize there are a huge amount of people that work in customs and Border Patrol. So we cant say that these individuals represent the broader mass. But do they have a setting problem here . You know, its unclear, when we talked to the d. A. Of webb county on saturday, we asked him some questions, and he wanted to that emsize this is a tragic thing thats happened, when hes worked with Border Patrol, this is not something on them, this is something that this Patrol Officer is doing on his own time, of his own accord off duty. So us unclear how this will affect the agency moving forward. He didnt do it while he was on the clock. But it is who the guy is. You think of Law Enforcement officials should be conducting themselves in a certain way around the clock. And up next, the latest on the new Sexual Assault allegation against Supreme Court nominee bridge Brett Kavanagh, Andrea Mitchell will be talking live to a senator that is set to vote on the nomination this week. Magazines like people and sports illustrated. Marc said as almost everyone knows, time is a treasure trove of our history and culture. We have deep respect for their entire organization. And if you know anything about marc benneoff, he sort of waves the flag for conscious capitalism, for rooted in success, they want to make a tremendous amount of money, certainly he has, but this is not dissimilar to what we saw jeff bezos do with the Washington Post. Jeff bezos bought the Washington Post as a personal investment and thats what here seeing marc benneoff and his wife here. He said this magazine is an american institution, hes enthusiastic to see what it will turn out like under benneoff. In the recent years, it felt a little bit more like a to somewhere somebody with means backing it and saying this is an important voice that needs to continue, i think thats really important. We say all the time how our culture is under attack, and there are some people with great intentions and very deep pockets h honoring our culture.
