Hes been on the phone, talking to and working with vladimir putin, trying to get a solution to the iranian deal. President trump has been pretty clear. This deal is very flawed. Hes directed the administration to try to fix it. If we cant fix it, he is going to withdraw from the deal. Whatever happens, happens. I may go in, doesnt work out, i leave. A megamerger in the u. S. Right now, a showdown at the u. S. Border with mexico. Asylum seekers clash with politics and policy. These are live pictures of the scene in tijuana, mexico, right on the mexican side of the border. The western most port in the United States. The caravan of almost 200 Central Americans that President Trump has angrily been tweeting about is now at the nations busiest border crossing, between the u. S. And tijuana. Immigration officials are saying the checkpoint is filled to capacity. More than 100 migrants left outside say they are going to be trying to get in today. The caravan, if you recall, set out march 25th from mexicos border with guatemala, with 1,200 people on board. On foot, by train and by bus. They slept in the streets and in shelters before finally reaching tijuana. Many of them are fleeing violence in their countries, including from gangs who rule the streets by threats, kidnappings and murders. Lets look at what is most likely going to happen for the migrants at the port of entry right now. Walk with me to the board. First off, according to u. S. Citizenship officials, to qualify for asylum, appnall lap muse prove they fear because of their race, religion or political opinion. The process. The migrants will speak to security guards to make sure they have the proper paperwork before going through the gate to the United States side. Theyll be held in temporary cells, where Border Protection officers are required to ask them if they are afraid to go home. If they answer yes, border officials notify ice officials, who will send the migrants to a Detention Center while they wait for a credible fear interview. The New York Times reports that families will most likely be split up. Mothers and children possibly bused to centers as far as texas. Men can be detained anywhere in the United States that holds undocumented immigrants. The migrants would continue the screening process in the facilities over the next several days. At some point, theyd be fingerprinted and have their pictures taken. If they pass the credible fear interview, the Asylum Seekers can make their case before an immigration judge. It is a process that can take several months, sometimes longer. At this time, migrants can then ask to be released from detention. If that release is granted, theyll pay a bond, or theyll be fitted for an ankle bracelet, so they can move around while they wait for their cases to play out. Last year, Syracuse University study found judges denied asylum to almost 62 of applicants. This is the fifth year in a row the denial rate has gone up. It is harder for Central Americans to be granted asylum. The three countries with the largest number of applicants, el salvador, honduras and guatemala have denial rates of 75 to 85 , steph. This is an extraordinary story. You have to dig into all sides of it. Miguel almaguer is liye out liv the border facility. Miguel, it is easy for us to talk about the it. Youre there on the ground. How many people are going through this processing . How many many are expected today . Reporter were expecting about 150 families who are going to try to get their way at least to present themselves to Border Patrol agents. This is literally ground zero, where all the families have been gathering over the last several hours and overnight. They spent the night on the cold concrete in cold temperatures. Many of them literally sleeping on the floor. Here, youll see mothers. Youll see their baby infant children, all sleeping here, waiting for asylum. All of the families here say they are trying to escape the violence. This is a case that is playing out over and over and over again. These are the faces of the human immigrant caravan. All of these people are seeking asylum. So many of them say they face dangerous conditions. They are gathering in this area. They are getting some services here. They are getting food handed out to them. Some are meeting with attorneys. Theyre looking for an opportunity to travel into the u. S. They say the violence they face in their countries is incredibly dangerous. They say there is no turning back now. Many of them have been on the road for four to five weeks. They have now arrived here, 3,000 miles from home. This is their best chance at a new life. They say they will not leave until their cases for asylum are heard. As you know, the president tweeted and held a rally over the weekend, saying Central Americans should not be allowed into the u. S. Who are seeking asylum. The folks who are now here say they have spent the last month trying to get to this point. There is no turning back. The conditions they face in their home country are so incredibly dangerous. These are the faces of the desperate, those looking for new life. They say now that they have reached the u. S. , they will not turn back. This is unbelievable. 200 feet from the border here. Theyve come this far. One last picture. You see this family right here . They have been waiting here overnight. Just over here is the border fence and the border crossing. They have made their way all the way from el salvador, nearly 3,000 miles on their journey to the border wall. The question now, can they get over the border fence . That remains to be determined, guys. I ask you this, we watch that clip of the president just a few minutes ago, and the president said, have you seen this caravan . Have you seen the caravan . I ask you, mr. President , have you . Yeah. This is incredible. Miguel, what sort of advice do these people have . Are there lawyers . We heard u. S. Officials have said that theres no space for them to come in, and theyre not letting them in unless they have space. Tell me how this works on a technical and legal perspective. Reporter there are volunteer lawyers here working with these families. The volunteer lawyers have told them to tell their stories, to be truthful, to be honest, to present their cases of asylum to the Border Patrol. Simply walk up to the agents, surrender themselves, start the process of their sasylum proces here. It could take months. It could take years. Many of the families could be detained immediately, even separated from one another, as they look to seek asylum into the u. S. Many of these families have been told by the volunteer lawyers that they may never get into the u. S. They may be held for months inside Detention Centers as their cases are waiting to be heard. Some could be flown back to their country of origin. All of these families say the opportunity, that risk, is still worth it. Keep in mind, they traveled over a month to get here. They faced dangerous and treacherous conditions. Now that they have reached this point, they literally call it the point of no return. They say they are here. They want to apply for asylum into the u. S. That is the conditions theyre facing in their home country. The Gang Violence from not only gangs but drug cartels in the countries are so incredibly dangerous. Particularly, it affects the young people here. They have no choice but to move forward and try to get refuge in the u. S. The very reason so many tens and hundreds of thousands of people have come to this country for a few hundred years. Miguel, thanks very much. Well keep the pictures up of what is going on around you as we continue the discussion. What would the statue of liberty say if she met them . Come on in. Let me help you out. The forgotten american who says, dont come into my country. I need help. We need to find out what help they need and help them. What help they may need in their countries of origin. They have real problems there that maybe we can play a role in, as well. Lets bring in an immigration attorney and former president of the American Immigration lawyers association. David, you saw miguel talking about the fact that theres volunteer lawyers there. We have heard things that suggest that some lawyers are being warned, or the government is being warned to not fully tell them what their rights are as immigrants or refugees . What . First of all, ever since the travel ban last year, the horrific travel ban, ive been proud of my colleagues, the American Immigration lawyers association, the lawyers at the American Civil Liberties union, and the National Immigration law project, who have volunteered their time. Thats what were seeing again today at the border. Look, if the Trump Administration is afraid of the law, is afraid of a lawyer explaining to a refugee about his or her rights, about the process, of how to do this legally, thats what i heard from the report. The lawyers are down there trying to explain to these folks, tell the truth. Explain your claim. Explain the horrific violence that you and your family or your child or your grandchild is suffering in one of the countries. Thats what these lawyers are doing. This is about entering the country legally. The narrative coming out of the Trump Administration is, somehow, these people are trying to break the law. Its a flat out lie. This is an interesting point, david. Theres been talk from the Trump Administration that these people are coming here to vote for democrats during the midterm elections. They cant vote, fyi. Butd distincti distinction, because there is a sense theyre illegally rushing the border. How do people show up to america and get in legally . There are several ways to do itlly. Fi legally. First of all, you could have a visa or entry permit issued by the United States government. You could have a green card. Or and what were seeing at the southern border today is you can apply an individual who is a refugee, that is fears persecution, like you pointed out at the top, on account of race, religion, nationality, membership in a social worgroup politics, they can aplipply for asylum at the border. If they show credible fear to the customs and Border Protection officers, they go through the process with an immigration judge. Its not an easy process. As you pointed out, many of these families, these children, the grandparents, the fathers, the mothers, theyre looking at separation. Theyre looking at months in detention. Just look at that. Were looking at these pictures as youre talking, david. We have the live pictures from tijuana. These are families that if things go the way they want them to go, these people are going to get separated. The mothers and children are going to go to detention facilities. Even if things go their way, life is going to be terrible. Theyre leaving the most dire situations. I want to share. Brandon judge, the national Border PatrolCouncil President , says these migrants here are already breaking laws by sitting on the fence and being in this crossing area. Lets listen to this. It shows that these people have absolutely no regard for our laws. Them sitting on our fence, theyre in the United States. They made an illegal entry into the United States. Theyre sitting on our fence. This is a fence that we have to maintain. They have absolutely no regard for our property. They have absolutely no regard for our laws. Is this kind of first, is it true . And, is this sort of thinking what the Border Patrol agents have across the board . You know, the department of homeland security, including customs and Border Protection, they dont have the facts on their side. What weve seen with this administration is that they resort to falsehood, half truths and lies. Thats what the clip was. No. Would i have told someone to sit on the fence . Of course not. It is not the best visual. Did they do anything wrong . No. These people did not enter the United States illegally. As i understand it, they all went back and were going to prepare to enter legally. What the u. S. Government did last night was refused to process these claims. Claiming, oh, well, we didnt know these people were coming, and we dont have the people power to process them. You know whats interesting, ali and stephanie, whats interesting to me, the department of homeland security, immigration and Customs Enforcement, customs and Border Protection, seem to have the people power to go all over the United States over the last year and arrest mothers, fathers, split up families. Thats right. Somehow, they dont have people that can process less than 200 claims of refugees. Children, grandchildren arrest and abort people with no crime, no felony, except the fact they may have used a Social Security number thats not theirs, which is how you work. This is incredible. What is our responsibility under international laws, as it concerns taking in people who are in need . Well, we are signators to the International Protocols on refugee. We also have our own law, the immigration and nationality act, section 208, and other sections, which require us to consider asylum claims. This is not, as Jeff Sessions, the attorney general, puts it, this is not about skirting the law. This is about applying the law. This is about following the rule of law. Sessions says those people on the left side of your screen, sessions had said, and im quoting, that this is a deliberate attempt to undermine our laws and overwhelm our system of justice. Does that look like that to you, stephanie . It doesnt. To that point, President Trump in his speech saturday night isnt saying that the laws are being broken. Hes saying the laws are so lousy, and the laws are so weak. What is it that the president i know hes big on rhetoric, but is there something that the administration is trying to do from a legal perspective to change the existing laws, to make them more stringent . Is that underway . First of all, for trump to say that the laws are weak, earlier in the segment, you pointed out that nearly 3 4 of these people are likely to be denied asylum. This is a very strong, very strict law. The president has declared that these people should not be allowed in the United States. During the travel ban litigation, many of the courts pointed to the president s tweets. The tweets that the president put out about antimuslim, dont let muslims in, in many cases, thats what lost the cases for him. Here, his tweet saying, dont let these people in the United States, is a prejudgment. Its an unlawful prejudgment, in my opinion, of their asylum claims. They have the right to due process. Thats what our law says. They have the right to apply legally at the border, at the port of entry, for asylum. Thats what theyre doing. What the administrations response to this is, what trumps response, what Jeff Sessions response, what kirstjen nielsen, the department of homeland securitys response is, is to intimidate and to bully these children, these grandpare grandparents, these mothers, these fathers who are fleeing horrific violence. It is worth noting that it is 50 degrees right now. It might rain today. The kids are not just wearing hats and coats for the fun of it. It is cold. Weve decided that we cant process them, to davids point, right . How many times have we talked about these ice raids across america . They raided a 7eleven. The ice raids, they raided the 7elevens. Im thinking, are they raiding 7eleven parking lots, where people are committing petty crimes . No. They were raiding 7elevens to arrest the 7eleven employees. Many of the 7eleven owners werent looking to hire illegal immigrants. For the shift from midnight to 7 00 a. M. , those were the people who are available and willing to take those jobs. What were seeing across this country, ever since the president was sworn into office in 2017, in january, were seeing an outright war on immigrants. Were seeing an outright war on families. Were seeing it today play out at the border. Were seeing violation of the law by Customs Enforcement in every city and jurisdiction. Were seeing a tax on cities, on mayors, on local officials that want to abide by the fourth amendme amendment. Theyre calling those sanctuary cities. Theyre lying. Theyre saying that theyre harboring undocumented people. None of this is true. Whats true is, this is a country of immigrants. Whats true is, our law provides for people to apply for asylum. Whether they get asylum ultimately is going to be the decision of a judge. Not the decision of the president. David, thanks very much. When the president is trying to say, i care about you, americans, i want you to thrive, those forgotten americans who feel like they lost their jobs or opportunities to immigrants, what programs has the president green lit, has the president or this administration funded to go to those states and those counties, to those people, to help educate and train them for better jobs . Nothing. What were doing right here is amping up the hateful rhetoric. Blaming immigrants saying, they cant come in. Those in the United States saying, i dont want more immigrants because my life isnt okay, were not addressing that either or doing anything to improve it. Youre seeing suffering on both sides, ali. I think it is worth looking at the pictures once more and remembering. Give me your tired, poor, huddled masses yearning to breathe free. Send these, the homeless, tempest to me. I lift my light beside the golden door. Ali, these people are looking for a better life. Much like people who are suffering. Much like everybody who has come to america for hundreds of years. Without a doubt. Those people who are in need, people who are here who are in need, we need to figure out what ails them. Not accuse them of things that simply arent true. Irans president and frances president reportedly spoke by phone for more than an hour yesterday. They agreed to work closely to preserve the deal also signed, of course, by france, germany, the uk, russia and china. That as President Trump continued to bash the deal, which he called insane, in which he has accused iran of violating. The Iranian Regime fuels violence, bloodshed and chaos all across the middle east. We must ensure that this murderous regime does not even get close to a nuclear weapon, and that iran ends its proliferation of dangerous missiles and its support for terrori terrorism. The 2015 agreement between iran and six world powers, including the United States, does not eliminate irans controversial nuclear program. Instead, iran has agreed to eliminate 98 of its stockpile of enriched eu eed uranium. They agreed to hand over 14,000 centrifuges out of a total of 20,000, used to enrich the ukraiyo uranium. It can keep enriching up to 3. 5 , less than the iranians said they had before doing the deal. It is less than the 90 needed to produce a nuclear weapon. We know the iranians complied with the provisions because iran agreed to inspections from the Energy AtomicEnergy Agency as part of the deal. On that point, even the Trump Administration concedes. Because the provisions expire in a few years time, President Trump says iran can sprint toward rapid Nuclear Weapons breakout in the future, his words. Except, iran is banned from acquiring Nuclear Weapons under the deal, which is enforced, as i said, by inspections. President trump also claims the iranians were paid up to 150 billion to sign on to the deal, including, in his words, 1. 7 billion paid for by the u. S. In cash. The amounts are in dispute, but the president is talking about frozen assets held in foreign banks, which were released as part of the deal. By all accounts, the money belongs to iran. Oh, gosh. There are concerning changes in the first major update to a manual thats used by federal prosecutors. Sections on press freedom and racial gerrymandering have been taken out. Yup, you heard us right. Deputy attorney general Rod Rosenstein ordered the comprehensive review to update the manual for the First Time Since the late 1990s. The review changed sections on religious liberty and pr prosecuting power. Some were done quietly. Joining us now is nbc news justin correspondent pete williams. Ill go first. Ready, pete . Sure. Press freedom in the media content section. Why . What is the explanation for the changes . First of all, the u. S. Attorneys manual, what is it . If you print it out, twosided, this is basically what it is. Thats a beauty. One of the goals of by the way, there are two other volumes that interpret sections in the u. S. Attorneys manual. It is called the criminal resources manual. One of the goals the Justice Department says was to try to trim this thing down. Every successive Justice Department keeps adding stuff to it. The Justice Departments view was, its becoming so vague, a lot of these sections, they say. Theyre nearly stating things that are obvious. Constitutional values. That is their explanation for why this section called need for free press and fair trial was taken out. What it says is, careful weight must be given in each case to the constitutional requirements of free press in public trials, so forth. The explanation, they tell me, is they thought it was nearly stating what is already a constitutional value, and there is no point to have a separate section to retake what every u. S. Attorney should know. Does taking it out have a symbolic value or some does it make some symbolic point . They insist no. Whenever you take Something Like this out, itll get attention. In the past, i will say, ive sort of cited this language to the Justice Department on things like access to pretrial things and so forth. It talks about the needs of public safety, republicapprehen fugitives, right of the public to be informed. They insist it was hordetory language, and thats why they took it out. You are able to interpret these things. What about the section on racial gerrymandering . What happened there . Again, same question, why did they take it out . Whatd they say . What they say there, ali, is this talks specifically about the Justice Department intervening in cases that followed a Supreme Court decision called shaw v. Reno, that said a state can violate the Voting Rights act if it draws congressional boundaries in a strange way, in that the total purpose is nearly to pack voters of a Certain Party into a district. What the Justice Department says is, it is not intervened in a case like that, for precisely the purposes in the u. S. Attorneys manual in decades. They thought the law had moved on. Thats why they took it out. They have a rational explanation for each one of these. I think if you stand back and look at the totality of the changes, you get an idea of sort of the political view of the administration that makes the changes. Each one of these you could argue about. Sprint and tmobile, the countrys third and fourth largest wireless companies, announced a merger that would bring the market to three, opposed to four, National Wireless providers. The company said the combined company would provide Better Service and create thousands of jobs through more Stores Opened in rural areas and the creation of next Generation Network capabilities. The ceos of both companies practiced that pitch on cnbc. Take the competition and supercharge it. Put it on faster speeds, bigger scale, bring lower prices. My commitment is, if you like the competition before, youre going to love whats coming with this one. The u. S. Needs to lead on 5g. The only way you can go 5g is by combining sprint and tmobile. One thing john legere does, sell, sell, sell. Lets look at how the proposed merger would impact the wireless industry, and how the government might respond. As it stands now, tmobile and sprint each have less than half the wireless customers that verizon and at t currently report. After a merger, the new company, keeping the tmobile name, would have a similar number to at t verizon, but becoming the second Largest Network by subscribers. Tmobile would cover about 96 of the u. S. Population, putting it closer to verizons 97 , and at ts 98 . The new company would have a stronger signal in many areas. Thats important. It could retire about 35,000 redundant cell towers, saving money on maintenance and upgrades. These kind of telecom mergers faced Big Government resistance in the past. Back in 2011, at t tried to buy tmobile, which was struggling financially at the time. The Justice Department forced an end to that planned purchase, something it is trying to do now, of course, in at ts acquisition attempt of time warner. Closing arguments in that trial are happening today. Sprint and tmobile tried to merge three times in the last four years. During the first attempt in 2014, the effort was blocked by the fcc. At the time, thenchairman tom wheeler said four National Wireless providers is good for American Consumers, when the deal fell apart. New fcc chair has given no such limit on wireless providers, though it is not certain how the Justice Departments antitrust boss will react to the union. Itll likely be argued the Wireless Environment is different than it was in 2014. With more lowcost carriers popping up, including one from msnbc parent company, comcast. Theyll argue a combined effort is the only way for the companies to build a reliable 5g network, something the Trump Administration has labeledprior. The argument they are making here is, if you want us to compete, if you want to fwgive e American People a viable option, we have to have the money and the scale to do it. Heres the issue. Alex sherman from cnbc, a technology reporter, joins us now. The question people have, most people assume when you merge two Big Companies into one, it is less competition, which is going to mean higher prices. Heres the counterargument. There are always higher prices in cell phones anyway. The Airline Industry is a good example. There are so many competitors, everything was inefficient. Verizon is a big player. Does it help that sprint and tmobile partner up . Actually, if you look over the past couple years, there is an argument that cell phone prices have come down, to some degree, because sprint and tmobile have been scrappy competitors that need to undercut at t and verizon on price in order to convince customers to switch over to their networks. Tmobile got rid of the early termination fee. It was a standard in the industry. When you have these two competitors that sort of need to claw and scrap in order to survive against the big guys, thats the argument to have more competition rather than less. If these two companies do come together, you heard john legere talk about it, supercharging the competition. Put these two mavericks together, and then theyll have this better competitive third player. Theyll need to convince regulators they will, in fact, do that. Well follow it with you, alex. She burns facts and she uses that ash to create a perfect smoky eye. Like maybe shes born with it, maybe its lies. Last night, President Trump tweeted in part the president and White House Correspondents Association said the monologue was not in the dinners spirit of unity, but she didnt apologize. My only regret is that to some extent, those 15 minutes are now defining for hours of what was a wonderful, unifying night. So she talks about the four hours, the condemnation of wolfs act comes on a night that celebrates free speech. Many of us were wearing pins about the freedom of the press. So thats where this gets a little muddy. Joining us now is sarah im sorry. Kensior. Walk us through there. We were at the dinner, and you say that the dinner should have been done away with a long time ago. Yeah, i dont think theres a need for it. Whats important are lies and liars in the white house, including the president and Sarah Huckabee sanders, and those in the press who are more willing to back those lies, to not call them out openly, to practice this journalism that props up this administration, rather than deliver the truth and expose corruption. We dont have access to the white house. I have asked the white house for the last 305 days for an interview. They say no. We call them out on these very facts that you agree they should be called out on. We call out their facts every single day, so why is what we do, why is that being conflated to access journalism if we attend the white house Correspondents Dinner . Whos conflating it . This isnt just about you two or any particular journalists. This is about institutional weaknesses in our administration i mean in our journalistic system that the government has exploited. This is a time that all journalists need to be reflective on what their role is instead of defensive and look at the broader threat. The one thing that all journalists do have in common is they are under threat by this administration, which targets individual journalists and particular outlets, which targets the First Amendment itself. Thats something that should unify journalists, not this condemnation of whats happening to Michelle Wolf or any other comedian. Are you questioning the fact that journalists cant do their job if they attend this type of event . I see a lot of journalists every day, there are a lot of journalists every day in america who really make a point of telling the truth and getting that truth out there to American Consumers of news. Yeah. And i think thats great. Keep doing that. Its the other ones that arent doing that is the problem. Whether or not somebody attends the dinner is not a critical issue for the american public. The problem goes much deeper. I dont care whether anybody attended the dinner, but i care whether they feel intimidated by this administration, whether they have the right to free speech and whether theyre using that right. In a lot of countries, this is not a right they have, and trump and his Administration Want to al annihilate truth and push journalists into practicing selfcensorship. Thats not something that you should not give into. I watch those White House Press briefings every day, theyre very contentious and tense. Do you think theres evidence on a day in and day out basis that you think the president is succeeding those efforts to undermine the press . Do you think hes successful . I think he is with some people. I think there are willing collaborators. There are people more concerned about their career selling books, or maintaining that access that theyre willing to act as court stenographers. You know, the point of journalism is to serve the people, its to inform the people, to educate them, not to protect the powerful. So i encourage all the journalists who are willing to take a risk and whats become a politically heated environment and to continue doing that work. Its more necessary than ever. In your tweet this morning, you included the White House Correspondents Association president s statement about the dinner, in which they expressed some regret about Michelle Wolf as the comedienne. Are you saying they shouldnt have put that statement out and we should. Be saying neighbor she wasn m wasnt the appropriate person for that event . I dont think that they should apologize for having Michelle Wolf, because she spoke the truth. Sit a painful truth, but she did her job, shes a comedian. Often in repressive societies, comedy is a way to deliver those truths in a way that resonates. I think we see that resonating right now. Michelle wolf was there to do a job and she did the job.
