Term and it has just managed to do so, coming in just under the wire for the deadline to have cases considered this term. So the court will hear the case in april and with a decision some time in late june, if the Administration Wins here, then the administration could begin to put the new rules into effect in the waning months of the obama presidency. But if the administration loses, then it goes back for another round in the lower courts and it would be another couple of years before the issue is finally resolved. Now the governments argument here is that the states have no right to bring this case in the first place. This he say that Immigration Law is uniquely a federal responsibility and the states should just bug out. But the states say, no, that they are stuck with part of the bill for this program. Texas, for example, argues that it would have to issue drivers licenses to maybe half a Million People who would be able to stay in texas and that would cost the government a lot of money. So the Supreme Court has to decide that question. That was the main question here. But the justices asked the lawyers for both sides to answer an additional question is the program unconstitutional . Specifically, does it violate a part of the constitution where it lays out the president s duties and says he shall take care that the laws be faithfully executed. The states had argued that this is unconstitutional because, in essence, the guidance tells the Border Patrol and other federal agencies to simply ignore the law and allow these people to stay. So the Supreme Court will hear all that in april with a decision by june. The lower courts, pete, what did we learn at least on how this argument may be set when the Supreme Court does hear from both sides . What did we hear in those lower courts . Reporter well, the trial court did suggest it was unconstitutional but the main holding of the lower courts is the government tried to put this rule into effect illegally. They argued that because it was such a change in policy, because it wouldnt merely allow people to stay, it would also give them additional benefits, like work permi permits, social security, medicare and that sort of thing. And to do that, the states argued, the government should have published this notice, asked for public comment. And by not doing that it violated the law. Pete williams live for us at the Supreme Court this morning with the breaking news. Meanwhile we are waiting for reaction from the campaign trail as both ted cruz and donald trump intensify their attacks against each other and their battle over immigration. Both men are spending the day trying to poach each others supporters in states where the other leads. Right now ted cruz is making the first of what will be six stops just today of his bus tour in New Hampshire. For his part, trump is appearing at multiple events in iowa today, including a rally at the John Wayne Museum. That seems like a very strange sight that you see on the screen but thats the museum and someone is standing in front of the statue of john wayne. This is to get under way within the hour. Trumps team is teasing a big announcement during an event this evening at iowa state university. There is growing speculation but no confirmation that this could be an endorsement from sarah palin who in the past has backed ted cruz in his 2012 senate campaign. Trumps campaign has not officially confirmed any of this. The gop frontrunner will have some company in the hawkeye state. Carly fiorina, Mike Huckabee and Rick Santorum are all Holding Events there. The nbc News Survey Monkey poll shows Donald Trumps lead is holding study at 38 while cruz trails at 21 . Nbcs Kerry Sanders joins me from winterset, iowa where trump will speak later in the hour. Nbcs Hallie Jackson is in New Hampshire where cruz will make his stop later this afternoon. Hallie, i want to start with you. You heard petes report regarding the Supreme Court now looking at these executive actions regardsing the obama administrations decisions on immigration. Ted cruz, interestingly, yesterday went after donald trump on immigration. Play what he said. We were on the verge of losing this fight and 12 Million People here illegally being granted amnesty. And yet, when that fight was being bout, donald was nowhere to be found. Granted, donald trump wasnt running for office or holding any office, but we see there ted cruz trying to hit him on the very issue that perhaps propelled donald trump to where he is now. Reporter you are absolutely right, tamron. This is an issue, significant in that this was the first time that we saw ted cruz bring up donald trump sort of unprompted in front of voters, not in front of the media and in front of voters without being asked about this. Part of cruzs what appears his rampup in trying to hit trump and distance himself as they head into both the Iowa Caucuses and the New Hampshire primary here. You talk about these executive actions on immigration. Thats something that senator cruz has been raling against throughout his whole campaign. When i was with him in iowa a couple of weeks ago he hit president obama again for those executive orders. So it is something that we could hear from him on the campaign trail. Hes on his New Hampshire bus tour. As you look at this restaurant here, not a ton of people here yet but we expect to fill up in just a little bit. Will be interested to see just how cruz goes after trump here in some of these smaller, more rural towns in New Hampshire, and what kind of impact that might have on voters. It is interesting also, hallie, as we wait to see at least from their social media feeds, both cruz and trump respond to the Supreme Courts decision to hear this case on the executive actions. Theres been pretty much silent but i think it is probably predictable what both will say. Reporter i think you are right, given especially ted cruz has made no secret of where he stands on this issue over the last six to eight months during this campaign. Let me bring in now Kerry Sanders. As we await this event for donald trump at the John Wayne Museum a little bit later, theres all this buzz regarding a possible endorsement from sarah palin. First up, it is curious where this came from and if youve been able to get any new information on this. Reporter its an intriguing story because theres the announcement on twitter by donald trump that there will be a big announcement. Then of course, there was so the connected dots that maybe it is sarah palin. Then flight aware, which tracks planes, including private planes, yesterday shows a jet leaving anchorage coming to des moines. That 5 01minute flight. But remember, there are other fortune 500 companies here. Maybe it is just another executive coming. But with all the suggestion it may very well be sarah palin and now looking back there have been some very complimentary statements from sarah palin towards donald trump. Even though it was in 2012 that she endorsed ted cruz and her statements is thats what got him reelected to office there. There is a sense already growing there inside the Ted Cruz Campaign that theres some disappointment if indeed sarah palin is going to make this announcement. I have a feeling that what were going to see is, while the gathering is here, we see dozens of people filing inside to the Birthplace Museum here of john wayne. Its probably around 6 00 eastern, 5 00, that were going to see some sort of development, whether it is sarah palin or not, when donald trump is in ames, iowa and has an event there perfectly timed at 6 00 eastern to go straight in to the 6 30 National Broadcasts on the networks. Thank you. Turning to the democrats, Bernie Sanders has already hit the ground running this morning. In fact, he has four events in iowa today holding this town hall meeting just a short time ago. According to the des moines register, 14 of likely democratic caucusgoers are still uncommitted. Joining me now from des moines, government and politics reporter for the associated press. I want to get your reaction, it is interesting, Kerry Sanders was outside in the snow at that trump event. The point that trumps team is making is that if there are people who are willing to stand outside to see him, why is it being floated out there that these same people wont show up to caucus for him . Thats really the Million Dollar question when it comes to the trump campaign. He does have huge rallies. People are very enthusiastic. Yeah, theyre showing up on bitterly cold days and nights to see him. But caucusing is not like voting in a primary. It involves a certain amount of dedication. You have to show up pat a specific time. It takes some time to do it. So typically it rewards the more dedicated party activists. So certainly these trump people could show up, but it is still not totally clear if these people are really fans or if theyre actually going to come out on february 1st. Talk a little bit about Bernie Sanders ground game, especially as it relates to South Carolina. Yesterday you had a number of democrats saying that they have been surprised by his ground game in South Carolina which is seen as Hillary Clintons fire wall. Lets transfer that idea to iowa. Whats been the biggest surprise, at least in these last few days of this momentum, this push from Bernie Sanders . Well, certainly bernie has a real ground game here. Hes brought a lot of people in. He has a lot of paid staff. He has a lot of volunteers. Both he and clinton have serious, robust troops on the ground, so to speak. I do think some of the stuff with bernie is a little bit like trump in that he is looking to expand the world of people who caucus, he is looking to bring out new participants, theyre certainly courting independent voters. Part of what his folks on the ground have to do is really get new people out on caucus night. One of the questions right now is will the Hillary Clinton campaign go negative on Bernie Sanders, more than some of the push that weve seen as relates to health care and gun safety which was highlighted in that debate. Do you believe that the iowa democrats, some of those who are independent but may be leaning certainly to supporting the Democratic Party if they expect this to get ugly in the next few days . I mean it is politics. I think iowa voters are veterans of this so i think very little will surprise them. I saw clinton yesterday in iowa. She was kind of sticking to the tone of the debate. She didnt mention sanders by name but she did talk a lot about preserving the Affordable Care act and pursuing an achievable agenda. Her message contrasts with sanders whos talking more boldly about a political revolution. When you look at the polls right now, des moines register, 42 for clinton, 42 for sanders, just 14 saying that they are uncommitted. Those are different obviously numbers than what weve seen with some of the republican polling out there. But just 14 say that they are uncommitted at this point. I think increasingly people have made up their minds. Both clinton and sanders have been here a lot. They both have been sending out volunteers, theyve both been work, the game very vic russly. So i think you are getting down to the wire in terms of attracting in you or undecided people, absolutely. Also developing, were expecting to see 1 of the 5 americans freed over the weekend in that prisoner swap with iran. Washington post reporter Jason Rezaian is expected to appear soon before cameras at the American Military hospital in landstuhl, germany where he was reunited with his family and has been undergoing evaluations. Rezaian spent 545 days in captivity at the iranian prison after being charged with spying. Two other freed americans are also at the u. S. Hospital in germany, including evangelical pastor saeed abedini. He was in prison since 2012 for organizing churches in iran. Meanwhile, also marine corps veteran amir hekmati has been reunited with his sister and brotherinlaw. He was arrested in 2011 while visiting his grandmother in iran and was sentenced to death. Don levinson is still missing. His family is criticizing the prisoner swap that they say did not include him. I was shocked. I was disappointed. I was extremely angry and i felt betrayed. Hes given his life to this country for decades. Hes done over 30 years of work for the u. S. Government. Hes been abandoned. Hes a soldier that was left behind. Tell me a little bit about that 2 1 2year pledge that you made to amir, to his family, to not let the world forget that he was being held and in fact he was sentenced to death for spying. I got to tell you something. I would hate to give an impression to think i was in any way, shape or form responsible for him being released. I think what i was able to do was give a voice to and humanize someone who america had forgotten. America forgot about him and he needed a voice. Thats the reason why i got involved with governor richardson and others across the aisle. In this case weve had a congressman whos been just voracious at ensuring that everybody remember the fact that amir was there and there only because he wore the uniform of the United States of america. Thats it. Thats the only reason. So i was a moo reason, once a marine, always a marine. I was also in the navy but i served 22 years. I believe very strongly we dont leave one behind. Anything i can do to ensure he was hurt and we thought about him, we prayed about him. Thats one reason we had hashtag free amir now. Now it is hashtag amir freed. You mentioned congressman kilde who went to germany with amirs family. Amirs father has terminal cancer and i believe you shared the fact that his father really has been holding on in hopes of seeing his sons face again. The family its very personal for this family. His whole journey has been very personal. Ive been able to be a part of that family. I didnt want to go to germany because i really feel strongly about the fact that hes been gone for almost 4 1 2 years. My goodness, i want him to spend as much time looking in his sisters eyes, kissing her face, hugging his brotherinlaw before i even step in the middle of that. But congressman kilde who was instrumental every single day in ensuring he was freed deserves to be there. Now when they come home, im hoping that we dont all freak out and want to just get a camera shoved up a nose. Remember, this young man was in prison, tortured 4 1 2 years. We should give him a little bit of a break. When we do see him and the family, thank them for their service and remember all the other servicemen who would do the exact same thing. We dont want to forget. If you listen to all the rhetoric in all these debates and all the conversations, a lot of people are saying that they wlabt to do a lot for our military. Im going to tell you, there is a lot of smack being talked. Not a lot of action being done. You bring up the rhetoric on the campaign trail, the reaction from a number of republicans running for president. Really dismissed this deal calling it, as donald trump said, this all of deal despite the fact that these americans would be coming home and saying that it was a mistake to broker this deal that allowed iranians to return back to their country in exchange, in this swap here. Whats your reaction having been so personal and so close to the hekmati family . You know, i say this quite often and i apologize if it comes off incorrectly to some. But if you didnt put a uniform on your back, and you didnt serve this country, how dare you sit back and say that one who wore a uniform should be left in a prison and we shouldnt do everything we should do to get them out. Get politics out of this. We had four americans, five americans being held, in prison, wrongfully imprisoned. Whatever two take to get them out, we should do. Now we could talk about whether or not we should have traded are four, three, two, one prisoners, should they all be ones that had traffic violations, versus other ones . None of the prisoners swapped had any physical attacks against americans. They all violated rules that were against sanctions so they were probably monetary. They were middle aged. They arent going to be recruited to a fight. I say if i could give up seven or ten of them for one marine, id send them out today. Im not going to hold them if prison just to be politically correct. We are getting new information on the severity of the water crisis in flint, michigan. It started in 2014 when the city switched its water supply to the flint river to save money. Tests have now shown that the water corroded pipes causing lead to leach from them and children in flint have shown elevated levels of lead which can cause permanent brain damage. We are getting word of a new link now between that water and the medical condition of flints residents. Just as protesters are headed to lansing, michigans capital city in anticipation of michigan governor rick snyders state of the state address tonight. Msnbc reporter Tony Dokoupil joins us from lansing, michigan. Tony, start here with this admission from the governor. He was asked flat out is it your katrina . And do you think thats unfair . He said, no, he doesnt think it is unfair, it is a disaster here. Reporter he says it is a disast disaster, that its his katrina. Last week you may recall Health Officials in michigan announced a spike in legionnaires disease in the county that includes flint. 87 cases between june of 2014 and november of 2015. That was a tenfold increase and it included ten deaths. It was very serious. Legionnaires is a type of pneumonia from bacteria thats in standing water. Today just moments ago we heard from a doctor, the chief pediatrician at hurley medical ka center. She was the one that led the study that confirmed lead in the blood of the children of flint. She tells us the legionnaires deaths are totally related to the wider water crisis. We also reached out to a Virginia Tech researcher, mark edwards, another pioneer here who confirmed that lead was in fact in the water. We asked him about the legionnaires connection and he said there is is a very strong likelihood they are related. Health officials are still looking into it more deeply but two significant academics who have clashed with the administration in the past say it looks very likely that these ten deaths are part of the wider crisis. The governors speech here tonight just got a little bit more serious than it already was. To your point, it already was. You have, for example, Hillary Clinton on with rachel last night saying negligence, incompeten incompetence. You have a number of people asking will there be people charged . This has gone on. Again, it may just be in the headlines for many people but this has gone on since 2014. You had families forced to get the water from their home, then send it away for testing after being ignored by city officials there. Absolutely. The big challenge for the governor tonight is explaining to the people of flint and to the people of michigan, and as Hillary Clinton mentioned, really this is a nationwide issue at the moment. How did it take two years from the time that people began to complain to the time a state of emergency was final will i declared and that resources were released . Waters and filters and finally a federal emergency relief. Why did it take so long . Thats the challenge hes going to have to address in the speech, convince a lot of very angry people who will gather on the lawn behind me looking for exactly that answer. Is there anything that this governor can say, anything the leadership of flint can say to you right now that makes sense as to why some of the first reports of concerns were 2004 and this emergency status only now coming to light and being designated by the governor in the last day or so . No. He got a lot of questions to answer. I mean pass a parent of three, and one child thats in school, i want to know why. Why it happened. And why is it being covered up and why it too so long. Theyre saying now water and filters have been delivered to 16,000 homes. There are 50,000 homes. Flint. Have you received anything that makes you feel like the water in your home is safe . No. I mean like they want us to go to the Fire Departments and get water. They only offer one case of water per family. One filter. I mean thats going there every day to get a case of water. I got a family of four. Thats not going to work. I still havent got a knock on my door. You know that Hillary Clinton and others have said if this were a white neighborhood, an affluent neighborhood, that this would not have been ignored. Do you believe that you and the families there have been ignored because of the color of your skin and your economic status . I personally do. I believe they ignored us because of the color of our skin. Took too long for us to get help. When did you first realize there was a problem with your water . The boil advisories. How we came up with the idea is back when i was 14, my friends were just starting to learn to drive. Right . So i was in the unique position to see some of the dangerous stuff that happens behind the wheel of a new car, both related to technology and also distractions that have been around forever such as eating while driving or sipping beverages and that sort of thing. I thought there must be a solution out there. This problem is so global. Its got to be something out there. But all we found were recording devices which are only effective after the fact. In other words, theyll tell you how fast youre going when you hit the tree. They dont actually do anything to prevent it. We set out to create the first device proactively that would avert drive alert drivers when they are in a dangerous situation ahead. Let me see it. Yeah. There are twists this morning to the backlash over the Academy Awards and the lack of nominations for any actors of color. Late last night, the academys president released a statement responding to the criticism and vowing the academy is quote, taking dramatic steps to alter the makeup of our membership. This as the shows host chris rock is facing pressure to bow out and as both Jada Pinkette smith and spike lee are saying they will not attend. This morning, smiths motives are being called into question by some. Nbcs Morgan Radford joins me now from l. A. So some people, although she has a great amount of support here, jada pinkett, they are saying its because will smith was not nominated for his role in concussion she is calling for this boycott. Reporter thats up for grabs but talk about oscar buzz. Tinsel town is really taking the academy to task. Frankly, the Academy President couldnt ignore this criticism anymore. She again is the first africanamerican president of the academy so she said she was heartbroken and frustrated at this lack of inclusiveness and she promised to do more. Again, this is after Jada Pinkett Smith and spike lee both vowed to boycott the ceremonies. This is after not a single actor of color was nominated for an oscar. But just to give you some perspective, this issue really isnt new for the academy. Back in 1996, exactly 20 years ago, Jesse Jackson took to the podium saying its time to boycott. There wasnt a single asian or hispanic person nominated this year. The criticism is really that the academies arent keeping pace with the diversity thats in america. All eyes are now focused also on chris rock, wondering what is he going to do as these black leaders, these black leading men and women are now leading the charge for this change. Notot only are they asking what he will do, but they are also saying if more stars join jada, join spike to boycott, what does that mean for the rest of the viewers . Will they tune in when its actually time to take the stage . It is interesting as well to see if actors who are not of color will also speak out. Jessica chastain last year did speak out on the lack of diversity. The conversation also, the lack of diversity when it relates to female directors has been discussed many times as well. But in perspective, this responsibility now thats placed on the shoulders of chris rock, you had Neil Patrick Harris last year who is white bring up the issue of diversity in this joking but very punching way to the academy, so i think you make the great point we are buzzing about this because of social media, but this is not as if this happened overnight. You make the point of Jesse Jackson. Reporter interestingly, tamron, this isnt a binary. This doesnt seem to be an issue thats black versus white. In fact, you are hearing a lot of allies come forward, a lot of white directors like for example, Straight Outta Compton which didnt nominate any of the black actors in that film but instead the oscar nod went to the white film writers. Thats why people are saying this is an issue that affects everyone. They brought up creed as well. The directors black, the leading actor black, supporting actress black but the person who was nominated was sylvester stallone, the one white star of the movie. Thank you so much.
