And this is not intended to produce mass roundups or mass deportations. Still, critics, at least, say this certainly could open the door to exactly that. And White House Press Secretary Sean Spicer pressed this afternoon on whether todays guidelines could be the step toward mass deportations. No. I think what we have to get back to is understanding a couple of different things. Theres a law in. Place that says if if youre in this country illegally, we have an obligation to make sure the people are here legally. What the order sets out today is the ensures that people adjudicated already, that i. C. E. Prioritizes, creates a system of prioritization, and makes sure that we walk through that system in a way that protects this country. This is consistent with everything the president has talked about. Which is prioritizing the people who are here who represent a threat to Public Safety or have a criminal record. And all this does is lay out the exact procedures to make sure that that subgreat of people because of a conviction or violation of Public Safety or have a criminal record are adjudicated first and foremost. Thats it, plain and simple. Joining us now with more, pete williams, thanks for taking a few minutes, you heard sean spicers version of it there, hes basically saying look, this is basically about prioritization with people with criminal records, what exactly are we talking about here in terms of crimes that would be covered . Is it all crimes and how many people could this affect . Well, its more than just prioritization or maybe put it another way, its a broader set of priorities. The Obama Administration basically said weve only got so many Border Patrol and i. C. E. Agents, lets get the worst of the worst out here. This is trying to get at more people here illegally to fulfill a Campaign Pledge from president obama. So, subject to deportation now would be anyone who commits a crime or commits fraud in theory, even for driving without alines or a traffic offense. For people with more serious violations. There are not going to be mass deportations. They want to concentrate on people who commit serious crimes. Millions of people. Now this is going to take a long time to get fully up to speed. They want to hire 5,000 more Border Patrol agents, 10,000 more i. C. E. Agents, that cant happen overnight. This is going to take months, years, some will be subject to federal rule making. For example, they want to change whats called expedited removal or immediate deportation right now. That cant establish here immediately can immediately be sent back if theyre picked up under this new plan, it would be anybody whose been here for up to two years anybody in the country things like that would probably require a rule change, formal process of putting something in the federal register and so forth. Notably unchanged in this program is socalled dreamer program. That allows children who came here illegally to remain in the u. S. If they become productive members. In terms of requiring more agency or the money for that. Is that something the administration can come up to on its own. Theyll have to have congress appropriate the money. Pete williams, thanks for taking the time. Appreciate it. Now heading over to the white house. Kristen welker is there. So kristen, the white house communicating sean spicer at that press briefing trying to say, this is nothing to cause any panic, this is simply a matter of how we interpret the law as its already written. Talk about whats going on behind the scenes there. Now sean spicer pushed back against that character decision that this was going to be mass deportation. I followed up with some officials here behind the scenes who said, look, the bottom line is, were still not going to be targeting people who are here illegally who havent done anything wrong. At the same time, they could be subject to being deported, but they stress that was always the case. Theyre still looking at people who have committed crimes and trying to focus on those who have committed more serious crimes, but theres no doubt, steve, the bottom line is this expands the university of people who are going to be looked at seriously by i. C. E. Agents, for example, parents who pay ugglers to bring their kids across the border. And those who cross could be detained. So this is President Trump trying to fulfill his Campaign Promise of getting tougher on immigration. Now this all comes of course as we know this white house is rewriting that executive order that has been referred to as the travel ban. The initial executive order held up in the court. The administration trying to write something that will stand up to legal challenges. Based on our reporting, it is still going to target those who are coming from those same seven countries which includes iraq, iran, syria, somalia, yemen, but the key question is, will it include an indefinite ban on Syrian Refugees . Our sense is that it will not. I asked sean spicer about that specifically today, he wasnt prepared to answer that question and based on my conversations, theyre still writing that executive order. The president wants to get the second round of that executive order right. So it does withstand legal challenges, steve. All right Kristen Welker there at the white house, thanks for that. Lets try to put this in perspective here in terms of what the Trump Administration is now doing on these guidelines for deportations. How about past president s . How have they handled this issue . We can give you this chart right here, this is deportations under recent president s. So you can see actually there has been a significant uptick over the last few administrations, of course a key date here is during the reagan presidency. You see that on the left hand side there, 1986, thats the last time there was a major Immigration Law overhaul in this country. It was an amnesty, there was also a promise there from those who pass the law at that time. That there would be more enforcement in the future, of course there was an influx in more coming here illegally after that and you can see in the clinton administration, in the george w. Bush administration, and notably, in the Obama Administration you had the highest number of deportations. 2. 7 million, in fact, there were critics of president obama from the left one including the head of laraza calling him the deporter in chief when he was president. And one of the interesting differences here with donald trump of course who wants to ramp this up even more, that was the title used by trump, president obamas critics, of course dwrump a difference between him and president obama there. Donald trump is very much advertising the fact that he wants to go out there and ramp up deportations. That was not something that the Obama Administration was eager to promote. Label the of context there, now lets bring in former Arizona Governor jan brewer she osks has been oupoken of immigration. Thank you for having me on. This lays the ground work for mass deportation basically saying, any type of crime, any type of accusation here could be the pretense for deporting somebody from this country. Its the groundwork, what do you say to that . I believe its about a Million People. Less than a Million People they are targeting. That have been requested to be deported public should have been deported, released on their own recognizant and never returned. So this is a good thing. Some of these people have been offenders, five, six, seven, many times, and they came in here and they are illegal criminal aliens. And they need to return to their country. Theres such a range when you open this up to all crimes. Theres such a range there. Obviously there are the horrible stories that can make headlines, people involved in violent crimes, rape, murder, Something Like that. When you also now theoretically, as this memo is written, theoretically opening this up to something as much less severe as driving without a license. Is it fair to lump those altogether as the grounds for deportation . I dont think so at this point in time. I think the administration is looking for those repeat criminals. Illegaaliens that are criminals that again, we have a revolving door. And we are fed up and tired. We are tired of them committing crime after crime after crime. And they have identified, at least, a little under a Million People and those are the people that theyre going to target. Majority of the people ought to be grateful. The people of the United States, they want to live in a civilized country where there is less crime, not more crime. And especially crime perpetrated by illegal criminal aliens. Heres a recent example that certainly attracted headlines, spooirs was asked about it today, theres a mother whose been in this country with her children for a number of years. She has now been deported, not for committing a violent crime, it was for misrepresenting her status at one point. As a result of that, she was deported recently. Spooirs wassed skz about that today and basically said i dont want to talk about individual cases, should there be consideration in a case like that . If the crime being committed is not of a particularly violent or even maybe serious nature and somebody has roots and has children and has a family here . The case is in arizona, mother of two children who indeed false if ied records and committed identity theft. And its illegal. Its a crime. You cant just come into our country and steal somebodys identity and cause all kinds of havoc. Bottom line, when they come, they ought to at least have, obey our laws and be good abiding citizens. We know why some come. Theyre coming to make a different life for them, but there are many of them that come as we well have seen, a million that weve got information on that are criminal, illegal aliens. And we want them out of our country and we want them rounded up, and we want them deported. Were fed up. You and i, we all live by the law. Let me ask you a question. Estimates vary on this, but theres an estimate of 0 to 12 Million Immigrants here illegally right now in this country. Theres also a government study from a few years ago that says those who are here illegally who have criminal records, committed crimes, that number is a little south of the million. Youre talking about those folks right now, the other, lets say 10, 11 million, do you have daycare what is your level of desire to deport them as well . Do you only want to focus on the other group. Its not a desire of mine. I think we need to address seriously ae comprehensively Immigration Reform and sit down at the table and discuss this exactly where were headed. What direction do we want to take that . I know theres a lot of concern about the dreamers, for lack of a better word. They are very concerned. They might not be high on my priority list, but i think first of all, we need to secure the border. With the executive order, you know, included 10,000 new ice officers and 5,000 new Border Patrol people. We need our border secured and we need those people out there so they cant get through. And then we deal with the illegals. And then, i think, once that is done, then we can address these other problems. Theres a lot of hisser it ka amongst a lot of people on both the left and the right. You look from the left wing people, all they want is open borders. They dont to want talk about anything else and they want to, you know, intimidate those of us that are lawabiding citizens that live by the rules by the way that were racist and bigots. We want to live in a safe country we want to keep our country, the country that we all know what it is. And thats why people come here. And then question deal with the dreamers. You know, thats not high on my list. All right. Former Arizona Governor but i want my border secured and i want the criminal, illegal aliens deported. Immediately, as quickly as possible. Let me ask you to respond to your states former governor just said. She believes you ought to follow this the law in the country. If youre here illegally and you commit a crime, you should be gone, whats wrong with that position . Well, first of all, lets be clear, if the Trump Administration wanted to prioritize criminals, dangerous criminals that are here illegal we, they should have just stuck to the obama prioritization list. Nothing changed. That was what obama did given priorities. This casts a wide net thats going to grab people that we dont necessarily want to deport. Governor brewer is simplifying immigration. We have people here that have sons and daughters that were born in the United States but they do not have permission to be here. We have those that serve in the military that arent permitted to be here. In this type of order that donald trump has given, basically its going to stop the due process of many of these immigrants. Moving from two weeks to two years, and by the way, doesnt have to be floovn youve been here less than two years, they have to suspect youve been here for two years. You have to be charged with a crime. So all these people are going to be put through immediate deportation proceedings, and its not going to be potentially a million. More than a Million People that are targeted by this. When governor brewer was here in arizona, she understands a consequences of things of this nature. Celebrating families is never good. The fact that it is such a wide net that almost anything is considered a crime, basically is setting up a system for mass deportation. What about the point thats raised here that donald Trump Campaigned on this. Donald trump talked about taking those in the country illegal whove committed crimes, making it a priority to get them deported from the country. Say what you will about the controversy surrounding this, i cant argue its much of a surprise given what he said in the campaign. No, no, its not a surprise at all. But lets also make sure that we quantify what were seeing here. This is not a popular sentiment. He did lose the popular vote. He won the electoral college. He did carry your state. He did carry your state. Border state on this message. He carried the state by by the least amount from the most current in the most current president ial elections. So were a changing state. We have lost the other southwest states that have high latino populations. And in general populations that are used to, you know, immigration or immigration issues. As a matter of fact, our latest poll here in arizona shows that the border wall in arizona where weve been talking about the border wall for years is quite unpopular. And is not being supported by the general public here in arizona. So i think what we should really focus on is whether this is good Law Enforcement. Its not good Law Enforcement that casts such a wide net. All youre going to do is create a system where people are hiding from i. C. E. And from the police instead of working with the police to get rid of these dangerous criminals that are in the neighborhoods. And thats what happened after sb 1070. We had whole neighborhoods where nobody would call the police and unfortunately we had incidents where there was high levels of rape, molestation and nobody speaking to the Police Officers because they were afraid of deportation. We cant have that. Anybody that understands immigration, understands this is not the way to go. Congress Immigration Reform is the best way to do this and working with the community to identify who the true criminals are. In these areas. You hear this a lot. Open borders, your side favors open borders. What would you say to the idea, if you have more than 10 Million People who are here illegally, she says basically, if youve got more than 10 million here illegally and saying hey, unless you commit a violent crime, were not going to deport you, what would you say to that . I think we should start a process which is what many Immigration Reform where we bring these people out of the shadows. Make sure they are not criminals. Pay a fine and in the process to become legal residents and citizens. That will work both for those that are here in the country as well as into the future for our future labor work force. The extreme i think on the right seems to think if there is one person in the country illegally or without permission, there is an open border. Right now the boarder is as militarized as you can get, at the same time, adding 15,000 more bodies at the border is not going to help the situation. Creating a process where people can come legally to this country to work, to study, to do whatever, i think its going to be a better way to actually stop and stem the flow of immigration. The antisemitic threats targeting our Jewish Community and Community Centers are horrible. And are painful. And a very sad reminder of the work that still must be done to root out hate and prejudice and evil. President trump this morning condemning bomb threats called into 11 Jewish Community Centers Nationwide yesterday. Same day it was learned that vandals damaged 200 head stones just outside st. Louis. That apparently happened some time over the weekend. Police now hoping Surveillance Video helps them to find the culprits. Blake mccoy has the latest. Hes in university city, missouri, that is a suburb of st. Louis, blake, whats the status . Reporter steve, this afternoon cemetery officials have begun the process of repairing these damaged head stones. Were told up to 200 have been damaged or toppled by these vandals. Right now, authorities are looking at Surveillance Video from around the area to see if those responsible were captured in the act or perhaps coming and going from this cemetery. Theyre not yet calling it a hate crime, instead they want to figure out who did this and what exactly their motivations were cause of course the term hate crime comes with leg ramifications. Th comes during a time of increased antisemitism. Weve seen a rash of bomb threats against Jewish Community centers over the last month. More than 50 Community Centers across the country in 27 states have been have had bomb threats called in. Theyve been evacuated. All have turned out to be hoaxes, but its led to a height of increased concern among the Jewish Community about the increase cases of antisemitism. Many have been critical of donald trump, President Trumps slow response to speak out against these acts. And right now, that many of the ones we have spoke with here are happy that he is finally speaking out about it, believes he could go further. That includes the antideaf Mission League who says this is just a very small part what have he needs to say that he needs to put actions in place to solve this problem instead of just giving lip service. It was an important first step to hear the president say on the record, for the first time, just how horrible and painful these incidents are. And that antisemitism is indeed a problem. Now he needs to go from saying its an issue to taking steps to solve the problem. What are the specific steps you want to see him take . Wed like to see the president announce a comprehensive Justice Department led investigation into this issue. Its ale civil rights violation and we need to put the full pors of the Justice Department behind it. Number two, the attorney general sessions lead an interagency effort to get dhs, doj, education, and every Relevant Federal Agency focussed on tacking this issue. Number three, the fbi has been doing a great job investigating these instances, but all Law Enforcement needs effective training and hate crimes. Its time for all 50 states to have the president , attorney general, they could push the additional five states that lack laws to get them on the books and get them on the books quick. Do you im trying to find the right way to ask this, with these individual cases and theres nothing in the situation in missouri that connects it directly to donald trump in any way, but the case thats made by some of his critics is that maybe he has helped in some way either with his apparent reluctance to give a Statement Like this before today, with some of the supporters, certainly online some of the online Trump Supporters that a climate has been created through donald trump, through the Trump Campaign that in some way encourages this. Do you think theres anything to that criticism . Well, what i would say is that we saw ove the political mpgn some of these white supremacist ideas finding their way into the mainstream. We found them in the public conversation through twitter feeds and through campaign speeches. And then after the election, weve seen a surge of hate crimes. The fact of the matter is we have lacked the statements on the record on the white house until now to shoot this down. And the extremists love a vacuum. Theyve inserted themselves and seen the lack of a forceful statement rejecting antisemitism as an invitation. Now again much what the president did this morning was an important first step. The question is what will be his next step . Just in terms of the reluctance, what do you think the root of that is . What do you think the reason has been . Its hard to define how donald trump feels in his head or heart. All i know is actions have consequences. And the lack of a statement created an environment that emboldened the bigots. It made them feel like it was okay to slander jewish journalists online, to use twitter to terrorize people to allow great feety to spread and swastikas to show up at schools and jewish institutions. And of course the bomb scares. The first step for all leaders is to show moral leadership. Donald trump took an important first step today and we hope the president will now take the next step and announce a comprehensive plan of action. Lucie, sounds like this was a private plane, not a commercial aircraft, is that right . Yeah, it was a small two engine plan well have to wait until tomorrow uil the preliminary findings to be aled to know what went wrong with the craft. Police say the pilot apparently radioed in a may day alert. He reported a catastrophic engine failure after taking off with the four american passengers. They managed to get into the air, but thats when something went wrong. The plane plummeting into the Shopping Center adjacent to the airport. Witnesses describing it as exploding on impact, erupting into a massive fireball. A dash board camera you see it there capturing the explosion, black smoke bill lowing from the crash site. All four passengers and the australian pilot were killed. And steve, this was supposed to be a dream golfing vacation for them. Four american friends. They chartered this small twin engine plane taking them to king island as you say, known for its golf courses. This was the trip of a lifetime turned into a tragedy. At least three of the men hailed from texas. They were all in or near their 70s. One was a cofounder of a law firm who just retired. Ootd was a retired ceo. The third was a former fbi agent. His sister confirming his identity on social media saying he was a great guy, three children, six grandchildren, huge loss for the families, but steve, this could have been much worse. That Shopping Mall was closed at the time of the crash. Had they taken off 45 minutes later, it would have been full of people, no doubt claim manager more lives, steve. Awful story. Lucie cavanaugh over there in london, thank you for that. Back here at home, Donald Trumps presidency entering its second month. The president signing a host of executive orders during his first days in office. He has been dogged by controversy, certainly as he was pretty much since the start of his campaign. Those controversies including these past few weeks questions about the actions of his former National Security advisor, Michael Flynn as well as the rollout of an executive order on immigration and refugees. Now, members of congress back at home this week, many of them facing tough questions about the president and his policies. Among them, Senate Majority leader Mitch Mcconnell who heard forcefully from some voters in kentucky. The last i heard, these coal jobs are not coming back and now these people dont have the insurance they need because theyre poor. And they work those coal mines and theyre sick, the veterans are sick, the veterans are broken down, theyre not getting what they need, if you can answer any of that, ill sit down and shut up like elizabeth warren. Joining us now, former republican congressman and Romney Campaign advisor, msnbc contributor, jonathan capeheart, thanks to both of you. That scene we just showed, Mitch Mcconnell back there in kentucky. A lot of people have been saying, look, what were seeing now in 2017, the republicans taking some blowback at these meetings. Similar to what democrats faced in the early days of the Obama Presidency in 2009 at their town Hall Meetings. That a valid comparison . Yes, actually as i was listening to her, i was thinking that exact same thing, steve. You know, democrats made a mistake of going into their home districts, talking about a reform of Health Care Without an actual bill to talk about. And it made it possible for republicans and critics of what the president was trying to do to fill peoples imaginations with all sorts of things, like death panels and also, with the anger that was in those town Hall Meetings, i think democrats were a bit stunned and maybe some didnt quite take it as seriously as they should. And i think now, the shoe is on the other foot. Republicans cannot take whats happening in their town Hall Meetings as something that they can easily sort of ignore or not take seriously in that only once they get moving on the reform or repeal or whatever theyre going to do with the Affordable Care act, and once they see it and understand it, that the people will be on their side. Republicans are now discovering that its super easy to talk about repealing and replacing the Affordable Care act, now that people have it, now that people know what its about, or just the fact that they have insurance, the idea of that coress is going to take it away and not have aeady fix in place, so that people wont be insecure is going to be open up republicans to an incredible world of hurt. Well that question about whether theres a comparison between now and 2009 with the rise of the tea party was put to Chuck Grassley, republican senator from ohio, he faced some angry crowds back then. Hes facing them again today. Here was his answer. You faced emotional crowds before, but can you compare this to, you know, town halls that youve had in the past . Like maybe in 2009 . Its nothing compared to 2009. And, well, 2009 in the summer, 2009. You said that was more intense than this . Oh yeah, oh yeah. Vince weber, i remember Chuck Grassley at some of the town halls in 2009, of course at that point, the Obama Administration was talking about potentially partnering with him in some way on health care reform. It seemed back then that facing those tea party crowds sort of changed him strategically in washington. Hes saying hey, not a real good comparison here. Is he being too plaza about this . What do you think . No, i think hes right. I think the intent and the proof of it was the intensity of those town meetings carried on really through two or three election cycles. And gave the republicans ultimately complete control of the congress. I dont think that this can be discounted. I think what it shows is ownership of the health care rk is a very, very difficult position to find yourself in politically. But, i would emphasize, the republicans have not yet acted on health care, what a lot of demonstrators coming out are coming out to the extent that its about the Health Care Issue because they are afraid of what might happen. Theyre going to act on it. The house is going to act the second or third week in march. The senate will act some time after that. And then the voters will be able to see what theyve actually put in the into place. Thats different than the situation the democrats face. Republicans have to figure out an alternative, but once its put too into place, my sense is itll calm the waters a great deal. Let me try a psychological question. Youre a former member of congress, maybe youre well equipped to answer this. The average republican member of congress who last year watching that Campaign Play out thought donald trump was absolutely dead politically, was going to lose the election, was making every wrong decision. Does that shape how they think about his presidency right now when they see a low Approval Rating and hear protests, confront protest. Does it make them pause before saying theres a real problem here with trump . I think very much so. I think most republicans woke up on election morning thinking they were going to go to bed that night having lost the presidency, lost the senate, and significantly narrowed their margins in the house. Instead, they went to bed that night having taken control of everything, and the person they give credit for is donald trump. He was right about the election and those of us that were critical of him were wrong. So, i think that at least for the foreseeable future, republicans are going to bet that the trumps instincts and policies are going to be right throughout the cycle as they were in the last election. The fact that they saw so much in the campaign and turned out he won, how do they ultimately how do democrats succeed in peeling republicans off . By continuing to quote unquote, resist whats happening, whats coming out of the Trump Administration. Look, democrats lost the white house and the republicans are firmly in control of all three branches of government, but that doesnt mean that democrats dont have a voice. It doesnt mean that Senate Minority leader Chuck Schumer doesnt have ways of using senate rules to slow things down. I think if you go across the country and you look at sort of the energy and activism and resistance thats out there to whats happening whether its the travel ban, whether its whats happening with these immigration raids, the department of Homeland Security guidelines that came out today. I think democrats and people who dont like what the president is doing, they are they are energizing. The key thing for them to do is to keep, to keep marching, keep phoning, keep talking about what they see is wrong. I mean, you dont get policy changing, you dont get change period if you just sit by and say theres nothing that i can do about it. So it is imperative, i think, from the democrats perspective that the energy that we have seen since january 21st when the womens march took place, not just here in washington, but around the country and few cities around the world, that energy and enthusiasm and resistance has to be maintained for at least two years.
