Right . And thats what were going to do. Were going to fill the seat. The people of this nation are choosing their future right now as they vote. To jam this nomination through the senate is just an exercise in raw political power. I dont believe the people of this nation will stand for it. Lets go straight to nbcs Peter Alexander live at the white house. And Shaquille Brewster following the Biden Campaign in eastern wisconsin. Peter, where do things stand in terms of strategy from this white house . Its a good question. We got a lot of this from the president just moments ago. He said that he wants that he expects to deliver his announcement for a Supreme Court nomination on friday or saturday. It was notable he said that because only moments earlier we heard from his press secretary saying it was coming by wednesday. Its not clear the white house has its strategy together on all of this. He wants the senate to confirm that pick before the election. He said, among other things, it would be good for the republican party, good for everybody, he went on to say. Better to get it over with because of its controversial nature. He had a serious of controversial and baseless comments as well that were striking, specifically on Ruth Bader Ginsburgs deathbed wish that was dictated to her own granddaughter that the next president get to pick her successor. The president challenged that. He baselessly blamed democrats saying that it was his suspicion that that statement was, in fact, written by adam schiff and Chuck Schumer and nancy pelosi. And specifically as it relates to what happened in 2016, on president obamas pick of Merrick Garland and Senate Republicans refusal to consider that pick for eight months, heres what the president said earlier. He didnt have the senate. So again, thats an election of a different kind. We had the senate. And the senate didnt want to do that. And mitch didnt want to do that. So theres a difference. When you have the senate, when you have the votes, you can do what you want as long as you have it. Now we have the presidency. And we have the senate. And we have every right to do it. We have plenty of time. So specifically to your question, stephanie, about the strategy here. As you just heard him say, when you have the senate, you can do what you want. And that appears to be President Trumps strategy going forward. He said his short list is four or five names. All of them women, including the frontrunner that were hearing from administration officials, amy coney barrett, who firmly opposes abortion rights. Steph . Shaq, how does joe biden try to turn this development into an advantage . Well, youll see him focus on battleground states today. Traveling to wisconsin, manitowoc, wisconsin, to have a speech later this afternoon. If you want to hear and focus on his direct message with the Supreme Court battle, you have to look back to what he said yesterday at the Constitution Center in philadelphia. Not only did he praise the life and legacy of the late Justice Ruth Bader ginsburg, but he framed this pick of her successor as a moral moment for the country. He made a direct appeal to gop senators. Some of his former colleagues, when he was back in the senate and asked that they not rush this pick saying that the winner of the next president ial election should be the person to nominate Justice Ginsburgs successor and he also repeated his pledge to nominate the first black woman to the u. S. Supreme court. But what you really have heard from biden is this focus on trying to hell have this pick be a bipartisan pick and thats been his focus with that. Thats the messaging youll hear from Vice President biden. As he continues his trips to these battleground states. Yesterday in pennsylvania, today in wisconsin. Weve got to dig a whole lot deeper into this. I want to bring in two Pulitzer Prize winners. Phil rucker from the Washington Post and jeremy peters, politics reporter for the New York Times. Any way you look at this, were going to be spending a lot of time over the next six weeks talking about this Supreme Court nomination. How does that change the 2020 election . Well, youre right, steph. This is going to be a huge issue of discussion for voters, for activists, for the elected officials in washington. It changes the campaign in that this is a galvanizing moment. A catalyst for activists on both sides of the political aisle. Republicans, of course, use Supreme Court appointments, judicial appointments to motivate the social conservative base thats been so critical for trump all these years. But the death of Ruth Bader Ginsburg and the possibility that this liberal icon on the Supreme Court would be replaced by a conservative jurist who opposes abortion rights, would seek to roll back so much of the social progress of the last generation is also going to galvanize democratic voters, progressives, especially women who were so essential to the democratic victories in the 2018 midterm elections and the strategists in both parties i talked to over the weekend said this is going to turn out. Its going to juice the turnout numbers from voters everywhere. And this is just such a galvanizing moment for the election. Potentially independents whose votes are actually up for grabs. Jeremy, you wrote a piece this weekend about social conservatives and evangelicals. You said this is why they wanted trump in the first place. Evangelicals have ended up being trumps most loyal base. They were voting for him anyway. Why do this . Doesnt he risk alienating independent voters that he needs . Sure. He absolutely does, but thats not how he thinks. This is a president we saw just last week divide the death toll into red and blue states over the coronavirus. He is single minded in his focus on his people, as he calls them. So he knows that he owes his election to a large extent to the religious right, to religious catholics, to evangelical christians, social conservatives in these battleground states that help pull him over the edge in the Electoral College last time. They also know that, too, and are feeling a certain sense of empowerment as this the fallout from the death over death of Ruth Bader Ginsburg kind of plays out here. And they have been very clear about two things. One, social conservatives at the activists who are and who have deep ties to the white house. They want a vote soon. They want it before the election. They are not taking anything for granted. They saw what happened with kavanaugh last time and they realize that any passage of time here is potentially a missed opportunity. Number two, overwhelmingly, they want amy coney barrett. They feel like she is the kind of person they know will vote their way. They know is also crucially one of them. Shes a religious catholic. She has strong ties to social conservatives. And theres a kind of kinship they have with her because theres a sense that during her confirmation hearings, shes a federal appellate judge. During hur confirmation hearings in 2017, social conservatives felt that democrats beat her up over her faith and asked her inappropriate questions. There was a line in the confirmation hearing where Dianne Feinstein said the dogma lives loudly within you. And social conservatives took a lot of umbrage to that. So i think they feel like she would be this kind of symbol, this culture warrior they could rally around and thats exactly what President Trump wants and needs. He needs a culture war fight over religious freedom and, you know, the exercise of faith and politics. And he would get that with amy coney barrett. But, phil, i go back to the fact that President Trump already has those supporters. Hes got those votes. Look at all the judges in lower courts that have been put on the bench over the last three years. Thats got social conservatives and evangelicals over the moon. Over the weekend we saw democrats raise a ton of money. Are they going to use this money to appeal to suburban voters or to super progressives . We saw alexandria ocasiocortez say, i get it. Many people arent enthusiastic about joe biden. Get enthusiastic about voting for someone who is going to protect your rights and protect this Supreme Court justice seat. Thats exactly their strategy, steph. To try to use this moment to create more enthusiasm for joe biden especially reaching independent women and millennials. Young voters who have been so inspired by Ruth Bader Ginsburg over the years and might see this as a motivation to wait in line for hour after hour after hour to vote for joe biden. Were also seeing a lot of that money thats going to be spent targeting key senators. People like cory gardner in colorado, Susan Collins in maine. Senators who if they go along with leader Mitch Mcconnell and holding this vote early, may pay dearly at the polls with a lot of the suburban voters in their states. And so democrats are going to use their money to make sure that the voters in those states know the decisions that those republican senators are making. Then how is it President Trump believes that a confirmation vote would help Senate Republicans who are in tight races . How on earth does that help a cory gardner or a Susan Collins. Right. I think this is so hard to game out. He doesnt know this any better than the rest of us. This is so unpredictable, steph. I mean, look how its already splitting up in a state like north carolina. You have tom tillis who is facing a really tough reelection fight. He said, yes, i want to vote. I want it now. And in states like maine, you have Susan Collins saying, no, no, not so fast. I think that its really hard to predict which constituency this galvanizes more because we dont know who the nominee is going to be and its somebody that really doesnt energize the religious right, although i have a hard time imagining trump would do that. Then its a whole different ball game. I think, though, phil is right. You cant put a number on although you could. In excess of 100 million. What this does to the democrats. They are just really fired up about this. And its a question of whether or not that motivation endures until the election, i suppose. But, you know, you can see a situation where if trump holds off and doesnt have and the senate holds off and they dont have this vote until after the election, that that really revs up both sides. And in an election that appears its going to be this close, its really anyones guess how this could shake out. Gentlemen, youve got your work cut out for you over the next six weeks. We all do. A lot rcof reporting ahead. And in the next hour, what can Senate Democrats do to stop President Trump and Mitch Mcconnell from filling this Supreme Court vacancy. That was senator Mitch Mcconnell back in 2016 explaining why he blocked president obamas nomination of Merrick Garland to the Supreme Court a full eight months before the election. Now, just four years later, and six weeks before election day, a complete reversal. The majority leader releasing a statement that, quote, President Trumps nominee will receive a vote on the floor of the senate. But how soon could we see that vote . And is anything standing in the way. Garrett haake joins us from capitol hill to answer those questions. We could talk about what the white house thinks. We could talk about what the media thinks. What matters most is the hill. What is going on there . Well, right now its a bit of a waiting game to see who the president is going to nominate for this Supreme Court seat. Then its a matter hough fast can republicans move here . Remember, theyre in control here. They call the shots in terms of setting up the calendar. Historically speaking it takes an average of 69 days to move a nominee from nomination to confirmation. It can be done much quicker than that, but typically it takes about two months to get from the nomination to the confirmation hearing. Just a hearing in the judiciary committee. Theres only 43 days left until the election. So were looking at a very condensed timeline here. But the reality is, at least setting up that confirmation hearing, which would be the first step, that can be done largely at the discretion of the judiciary chairman, in this case, lindsey graham, who made it very clear he wants to move quickly on this. Were looking at a fast timeline to get this done before, the leks election or in the lameduck session. This same senate wraps up their business before they go home for christmas. Were talking about four votes here. If they get the four votes if democrats can peel off four republicans they could stop this. If they cant, republicans will get it done on a timeline essentially of their choosing. Heres who were looking at right now. Weve heard from Susan Collins. Lisa murkowski. They say they dont favor moving forward, at least not before the election. Maybe after the election is a different story depending on who wins. Today im looking for mitt romney who voted to remove President Trump from office, but he wasnt here in 2016 so he hasnt chased around by those troubling quotes about what he would have done then. Cory gardner, basically a blue state in colorado, and chuck grassley, the judiciary chairman in 2016. Hes got a whole lot of those quotes saying we ought not to move back on Merrick Garland. Nobody has heard what he has to say now that thats not a hypothetical anymore. Stephanie . Well, everybody is paying attention. Garrett, thank you. Joining us to discuss, somebody certainly involved in this game. Democratic senator from the important state of michigan, debbie stabenow. Thank you for joining us. Back in 2016, you met with Merrick Garland. You signed a letter urging to allow him to get a hearing. What is different this time around . Well, the difference is that Mitch Mcconnell and, frankly, a whole lot of bigmoney interest behind him are all about getting and keeping power and it doesnt matter what they said. I mean, hypocrisy really is not unfortunately a concern of theirs. Its about controlling the courts in our country and making sure that the folks that they want in there that will sign with those who want to take away health care and a womans right to choose and collective bargaining for workers to be able to collective bargain for their wages and benefits and so on, they want to take away peoples freedoms and rights that we know in america have been a foundation of who we are. Voting rights and on and on and on. And so let me make first, its always good to be with you. I have to start by saying that i continue to grieve over this loss and that, you know, we cant jump over what we have lost here, but we also know that in her name, we have to rise up and fight back and push to make sure that these corporate interests that Mitch Mcconnell and the right wing do not ultimately control the freedoms and the future of our country. Then what does rising up and doing whats right look like . Mitch mcconnell does have power and control. Is there anything you can do to stop this . I think theres two things, and i really keep emphasizing the one that i dont think were focused on enough. First of all, nobody has to tell the democrats in the United States senate, any of us, me, the leader, anybody, how serious this is. We know how serious this is. We take this responsibility to do everything we can with the limited procedural options that we have. And we certainly will use all of those. But i remember back in january of 2017 when the president and the Senate Republicans said they were going to take away the Affordable Care act. We didnt have the votes. We were in the same kind of situation as now. We could have just said we cant do anything. But we started rallies. I remember the biggest rally on health care was in michigan in january 2017. And 10,000 people outside. Bernie sanders, Chuck Schumer, myself and others. We started this effort to mobilize people. And we used what we could do to give people more time to speak out and mobilize. And then the surprising thing happened that we were able to stop the repeal in the United States senate. We should not overlook this. There are four senators, republican senators, who decide to step up and be the john mccain of this fight to stop them taking away health care and peoples right to preexisting conditions. And womens reproductive choice and everything else. We cannot skip that. People have already started voting. Its thursday. They started voting in michigan and across the country. People should have the right to vote for who they want as president and the next United States senate to fill this vacancy. And they are trying to take away that right for people. And people should not take this lightly. So we shouldnt just assume that theres no power in speaking up and pushing back. A lot of these senators are in states that essentially are majority prochoice states. They are in states where people want their health care. Where they may not have covid19 and may have a preexisting condition. In michigan, its about our beloved great lakes and whether well have a Supreme Court that sides with the polluters or protects our water. And so i dont want us to skip over that. While we know this is not easy. We know that. We know in theory theyve got the votes. Mitch mcconnell can call the vote any time that he wants to. But the reality is, he could have done that on the aca. And because people rose up and spoke up, they stopped him. Im not naive. Im not naive in the least, stephanie, but i do know what happens when people galvanize. So its the voting now and its speaking up loudly about not taking away the fundamental freedoms and rights that we have in the United States of america. And thats whats on the line right now. Then take us behind the scenes, as you look for the next john mccain. Mitch mcconnell cant be persuaded but he cant do this alone. He has already lost two republicans. Are you talking to any of your republican colleagues who you know well, who you have worked with for years and trying to convince them . Yeah, we have all of us have relationships. I work across the aisle all the time and get things done with colleagues and all of us are reaching out on, not only the process and what people said in the past. You know, i dont think, unfortunately, that will be enough to get most folks to change their mind. Its about the consequences. The consequences of what this means to our country. And every part of our lives. And its also the fact that people, as i said before, are already voting. Theyre voting. They will pick the direction of our country. The direction of our country will be set within the next six weeks. And theyre going to take away peoples ability to have a say on how they want us to go forward . Thats a pretty big deal. Oracle says it will take over tiktoks american operations to safeguard user information following concerns about user data being shared with the chinese government. But critics, and theres an awful lot of them, say its still not clear how the information of tiktoks 100 million users in the u. S. Will be protected at all or how this deal fixes any of the security concerns. President trump also says the companies will make a 5 billion contribution toward an Education Fund to teach children about, quote, the real history of our country. Joining us now, kara swisher, a New York Times contributor, opinion writer and host of the new podcast sway that features an interview with nancy pelosi. Care aweve got to get into this tiktok deal. Youve called it a sleazy backroom deal that protects nobody, benefits Trump Supporters. Elaborate. That says it all. This is not President Trump set out to protect american users from chinese surveillance. That is what he said. This just shifts vendors from google to oracle. It doesnt remove it from chinese influence. Byte dance remains the majority owner, in order to get china to allow the algorithm out of china because they slapped back the minute this kind of surface was started. And it doesnt do what he said he wanted to do and it adds on this very strange Education Fund that is a shakedown for something that sounds like propaganda. So i just no part of it do i understand. And then the two companies, walmart, i dont blame walmart for being in here. Why not . It just doesnt make any sense to have this lack of control over this company. Previously if you remember, grinder had to sell itself to an American Company fully and not do this kind of weird relationship that looks very much like a like giving supporters new business and doing nothing to protect the american consumer. Okay. And when you say supporters, were not talking about the american voter. We are talking about the likes of a safford katz, Larry Ellison. Major backers of trump. For the American People were going, who exactly does this deal serve . Oracle is not a consumer company. Theyre also thinking of moving the headquarters to texas from culver city. This is a media company. Why would you move a headquarters to texas . No insult to texas. They have Great Technology in austin especially, but its oracle, which is an Enterprise Software company. If you saw that quote by Larry Ellison about this deal it was incomprehensible. Texas doesnt focus in on media. That would be hollywood, which is where tiktok now exists. The whole thing just doesnt make any sense. Oracle has been Larry Ellison in particular has been a ser supporter of President Trump. He wants this deal. Theyre trying to expand their Cloud Business that lost ground to amazon and google and microsoft. And that was somewhat of an embarrassment for oracle because they have very Strong Technology in this area. They have zoom right now. They are looking for the deal to take it away from google which was the previous cloud provider. Everything could have been solved by selling this company or having it go public in the United States and moving over and protecting the data in this country. Its a convoluted deal. When you add the museum of propaganda on to it, it just doesnt make any sense. In fact, it makes very sense. It sounds very corrupt. You blasted okay. So if it sounds very corrupt, is there anything right now that can be done to stop this deal . You know, i guess the National Security experts looking at it have to sign off on whether this does actually protect american consumers. Again, this could have been done in a much different way than it has. And its so convoluted and very typical of a lot of the stuff that the Trump Administration has done around tech, like executive orders around 230 that have no teeth. Theres very serious issues. And i am in agreement with the Trump Administration about chinese surveillance. And chinese internet hedjemony. We have to give them some blame and liability for some of the damage theyve caused. But this is just this is all posturing and i dont know what. Id like to know the details of where this code is going and who is going to control it if a Chinese Company continues to have a majority ownership stake in it. But kara, its not just the Trump Administration thats worried about Security Issues and china. No. People always have. But the actions weve seen out of this administration, though theyve created the right headlines, havent done anything. Look at the trade war. One of the ideas behind the trade war was were going to get china. The trade war cost us 30 billion in farm aid. We had to give to our own farmers who were hurt. Our trade deficit is worse today. And our relations with china are worse. They didnt do anything to solve it . Im not an expert in trade but let me just say, the chinese still own this company and now oracles a vendor of it and has a piece of it. Walmart is getting in here because its important for them to have commerce a commerce outlet and things like that. This is a really great app that consumers love. And it could just go down the tubes because of this which benefits nobody but facebook in this regard. And it doesnt its not about innovation and making a better app and protecting american consumers. Its about anything but that. And so this is just a lot of, like i said, sound and fury signifying nothing. So well see. Well see. Of all the ways it just seems go ahead. Sorry. Of all the ways and all the businesses they could go after, which do create security threats, they decide to go after an app that gives millions and millions of people absolute joy. This was the scene at one polling place in fairfax, virginia, where a group of Trump Supporters chanted four more years at voters as they entered the building. I dont even understand what this protest is about. They could be standing in front of a bunch of trump voters. All eyes were on the state of minnesota which also kicked off early voting. Joe biden and President Trump visiting the stay on friday. Joining me, minnesotas secretary of state steve simon. Secretary, we saw that video down in virginia. Did you have any similar issues in your state . We did not. Fortunately, though, we had a lot of enthusiasm and turnout that first day our four times what it usually is. There was extra sizzle because both Major Party Candidates were in the state at the same time. No virginiastyle protests at least yet. So you said you did see a lot of enthusiastic voting, more than youre used to. What has your state done to prepare for this uptick in early voting, and do you think youll be able to count the votes by november 3rd . Absolutely. Well, so we have a new rule in place in minnesota where every minnesotan can postmark their ballot by november 3rd as long as it gets in a week later by november 10th. By definition we wont have everything counted for a week. But i suspect well know the vast majority of winners either on Election Night over shortly thereafter in most contests. I cant speak to the president ial contest but in most other contests, i feel we will. We feel really well prepared. Weve primed our voters for the opportunity to vote by mail, to vote from home. Weve been doing that since before world war ii in minnesota and minnesotans have taken to it. We have a million voters who have asked and applied to have absentee ballots sent to them at home. So were poised to have at least onethird, maybe as many as 40 vote that way this election. And that will make for a much calmer, more soothing and safer election in minnesota. At least we hope. You say its nothing new or radic radical, which its not. However, the president who has a major megaphone is spreading a lot of completely baseless claims about mailin voting and about voter fraud associated with it. Obviously, those claims have no truth to them. But do you have any concerns outside of his claims . Well, i always am concerned anyone with a large megaphone who spreads disinformation and misinformation, whether a foreign adversary or president of the United States is going to have an effect. People will listen to that person. They have a big megaphone for a reason. All i can do is fill in that void of misinformation and disinformation with truth and with facts. Ill tell you, what im probably more worried about than anything isnt anything leading up to election day. Its what happens in the days and weeks after election day. Its going to really be a responsibility for all of us to calmly fill that void with facts and truth so that conspiracies dont take hold. But we know those conspiracy theories are spreading day by day. Look whats happening on social media platforms. Given your concerns, besides just saying weve got to spread the truth and calm people, do you think thats actually going to work . People are fired up. Look what they were doing in virginia for no apparent reason. Well, well know in about 43 days. All i can say is that i think one advantage we have in terms of calling people in a perverse way is covid19. And i dont mean to be flip about it, but everyone knows the stakes are high in this election and then you look at, layered on top of it, a pandemic. And so we have been talking about voting from home in the context of public health. Look, weve got a 1,000 to 1 ratio in minnesota. 1,000 people per polling place. You dont have to be a Health Expert to say its probably a good idea if you can to get those numbers down. So were telling people that every person who votes from home this year is making the polling place just a little bit safer. So its not about a conspiracy. Its not about partisan politics. Its about metering things out, spacing things out so that everyone is safe. Both those who choose to vote in person and those who choose to vote from home. Both are equally as worthy as one another, and were just providing options to folks. So i think as long as we talk about it in that way, dont make it partisan, dont make it political, that can go a long way. But well see. There are other forces at play, obviously. We have been focusing on the latino vote over the last few weeks and this morning were learning more about how it could swing several important states this november. Joe biden leads President Trump 62 to 26 among registered latino voters in our latest poll. That is a much wider margin than the race overall, but his lead trails the advantage Hillary Clinton had with latinos at this point, back in 2016. Over the last four years, this is amazing, President Trump actually gained 10 support from latino voters. Vaughn hillyard is digging into the numbers for us in phoenix. Vaughn, i want to start with the age split. Younger latinos say theyre voting for biden by a massive 55point margin. That shrinks to 18 points with latinos over 40. Can you explain this to us and if any of these numbers could be influenced now that we have got a Supreme Court vacancy . Reporter i think the dichotomy of this that we have to look at is the conversation we were having in the spring when it was Bernie Sanders performing so well among particularly younger latinos. Now you see evidence from this data that joe biden is attracting this young latino population, which is reflected in a lot of the conversations that i had specifically out here in arizona. I think we have to distinguish here the difference when youre looking at this data between voters based on the origin of the country. Looking at florida, where joe biden is trailing among latino and hispanic voters to joe biden, most of the state puts roots back to puerto rico and cuba, as opposed to look at arizona. 90 of latinos in the state of arizona have mexican roots compared to 7 in florida. And youre seeing that difference, where here in arizona now, joe biden continues to hold a lead significantly by about 30 points over joe biden, the one concerning data point for the Biden Campaign that is important to point out from this is the fact that compared to four years ago, he is down by about 10 Percentage Points compared to where Hillary Clinton was among latinos in 2016. You spoke with latino voters in arizona yesterday. Do they think they could swing the election in the state of arizona . Reporter they do. This is more than a 2020 election for them.
