Close to 82,000. The number of coronavirus cases is nearly 1. 4 million. On monday, the president claimed victory in terms of access to testing, a key aspect in reopening the country safely. He also repeated the claim that anyone that needs a test can get one. That claim is not true. In terms of sheer numbers, the United States tested 400,000 people yesterday. That is far short of the 5 million daily tests that the president predicted six weeks ago. He said 5 million tests, were getting 400,000. The president also claimed that the number of cases are, quote, coming down rapidly all over the country. But that statement from our president is also false. Nbc has obtained an unreleased white house report showing cases spiking in the middle of the heartland of our country, in metro areas like nashville, des moines and amarillo, texas. All of this will play into todays very big hearing. I want to go to Garrett Haake on capitol hill. This is one of the most unusual and consequential hearings we have seen in a very long time. Lay it out for us. Reporter unusual, consequential and probably most anticipated hearing of the coronavirus era. This will be a hybrid hearing in which half a dozen senators will attend in person. But the chairperson, ranking members and all four witnesses will be appearing remotely due to contact with people with coronavirus or concern of contact with people with coronavirus. We expect democrats in particular to try to separate the administrations spin from the medical realities in place here, on everything from questions about testing to questions about the future development of a vaccine. And late last night dr. Anthony fauci, who is probably the star witness today, sent an email to a New York Times reporter in which he laid out in very stark terms what his message will be today. He writes in part that if we skip over the checkpoints in the guidelines to open america again, then we risk the danger of multiple outbreak throughout the country. This will not only result in needless suffering and death, but would actually set us back on our quest to return to normal. So a stark warning there from dr. Fauci of the National Institutes of health. So i think we will hear him grilled today on exactly that and separating his beliefs about the crisis from what the president has been saying in the rose garden and behind that podium, steph. Garrett, thank you. Lets head to Shannon Pettypiece at the white house. The president is basically saying Mission Accomplished in terms of access to testing. We know that is categorically false. We have still only tested about 2 of our population. All of this is easily factcheckable and weve got lives and livelihoods at risk. Why would the president be declaring victory here . For whom . Reporter the Administration Officials say the prevailing message theyre trying to get out is that the Public Health crisis is behind us and businesses can start reopening. We want to shift the focus back to the economy where they feel the president is strongest, and by emphasizing the testing capabilities, that can give governors and businesses and the public the confidence they need to reopen. But of course, steph, as you note, we still have limited Testing Capacity in the u. S. Officials say that in most places someone who is experiencing symptoms or has been in close contact with someone experiencing symptoms, can get a test. But we are not at the point yet where we can be testing asymptomatic people regularly the way they do at the white house. So a cook in a restaurant isnt going to get tested before serving hundreds of people dinner that night. All the players on a Football Team are not going to get tested before taking the field at this point with the testing capability. So thats the concern here right now, steph. All right. I want to dig further into this. Joining me now, a woman i havent seen in a while that i would love to welcome this morning. Former missouri democratic claire mccass skill and president and ceo of the Robert Johnson foundation, and director of Health Policy at the obama white house. She was also part of senator edward kennedys senior staff when he chaired the Health Committee. So she knows exactly what a day like this is like. President trump says things are getting better, but we know that in many places theyre either the same or getting worse. What position does this put dr. Fauci in . Hes got to work for this president. Well, i think youre going to see dr. Fauci be careful, like he has many times, about how he communicates. But i am confident, and i think the American People are confident, that hes going to give them the facts. He is not going to make up stuff like the president does. Hes not going to lie about the severity of the problem. Whats really going to be interesting about this hearing, and its great that you have the doctor on, because she knows what this committee used to be like in the days that ted kennedy chaired it. And even what it used to be like before trump was elected president. And there was a lot of bipartisanship on this committee. It will be very interesting to see if the republicans defend trump or try to get to the heart of the problem. It will also be very interesting to see if the democrats are interested in trying to unify on this issue. It is going to be maybe the saddest commentary of all if this Committee Hearing turns into a partisan food fight. Dr. Patel, it should be apolitical, but in items of how weve prevailed in terms of testing, what position is fauci in . What could he say . We know the president is not telling the truth. Well, i think that its absolutely right that fauci has a reputation for telling the truth himself and i think hes just going to lay out the facts. And here is where the situation becomes tricky. Dr. Fauci runs an nih institute, which is not primarily responsible for testing, and youve got another witness thats technically the person two people, the head of the fda and cdc, who really should be running point on some of these issues. So i think what youll expect from dr. Fauci is a lot of attention on the fact that we have not tested enough and that thats a cautionary tale for reopening, but look to all members, hopefully both democrat and republican, to really put both the cdc and fda under the microscope for this. Dr. Besser, the white house likes to say that the media preys upon fear monger, but now weve seen this unreleased white house report that clearly shows cases spiking in places that have not been hot spots before. Im talking kansas city, omaha, minneapolis and phoenix. What should we make of this report and the fact that its not being released . Well, i think what well hear from dr. Fauci and what this report shows is that cases in many parts of the country are still on the rise and that were not ready to open up from a perspective of Public Health science. Yes, from a political perspective, there are governors who are feeling a lot of pressure. But in order to open up safely, we have to have the pieces of an intact and strong and robust Public Health system in place. And i worry that the focus is just on the total number of tests instead of who is getting tested, who is getting hit hardest during this pandemic, and who is getting tested and who is not. There are only three states that break down their testing by race and ethnicity, yet we know across the nation black americans, latinos, native americans are getting hit hard. So im expecting, and i hope that in this hearing, there will be not just this question of whats the total number of tests, but how do you dig down and see who in your communities is getting hit hardest and what do you need to do to ensure that theyre safe as youre thinking about sending more people back to work. Senator, we all want to reopen, but the answer isnt tell the truth and we stay closed, or lie and reopen. Cant you open gradually and tell the truth at the same time . Why cant we get to this third lane . Well, i think theres absolutely an opportunity to open gradually. But to do that, youve got to have some competent leadership that makes it very clear and repeats it, what that process should be like, what the testing should be like, how we in fact contact trace, if in fact someone shows up positive. There is really just the president vas lates so much between weve got it under control, its not my problem, its the governors. By the way, the governors are in charge. By the way, were doing testing so well. And none of that is absolutely correct. There needs to be guidance, which is out there, but its not being followed. The cdc guidance, the white house guidelines are there, so there is a way to slowly reopen with caution, but this president is not very good at staying consistent in a chaotic messaging process about this virus. Dr. Patel, do we not run the risk today that we dont get to these answers that senator mccaskill is talking about . Instead we end up hyperpartisan and putting dr. Fauci in a position where he has to spend the day, as well as the others who are testifying, factchecking President Trump . That is not going to help us get closer to reopening or get us closer to getting safer. Its just going to create more headlines. No, youre absolutely right, steph. I think the more critical questions, and i fully expect many members of the Health Committee to ask these questions, is okay, so lets all accept that we dont have enough tests. Were just going to we now need to think about how we move through this as the country reopens, and as you pointed out that weve got spikes in certain parts of the country and we still dont know what the plan is, can you lay out all three of the witnesses, can you lay out what were doing to be better prepared for the next wave. The cdc director has already established that we could be heading into a bad influenza season which has traditionally killed thousands of americans. So you combine that with a bad flu season, what are we doing . What are we doing to fill the gaps on why we dont have enough tests and how can we ensure that more americans have this . As we learn about treatments and an approach to the vaccine, how can we ensure that americans wont have the same problems that we had in a Global Supply chain with getting swabs. And those are going to be incredibly important questions for every american to hear answers from the three witnesses. Dr. Besser, we are going to be hearing not just from dr. Fauci, but also heads of the cdc and the fda. Is there something you specifically want to hear from them that you havent heard yet . Well, you know, we havent heard from them very much. So im excited to be hearing from them at all. And what i expect to hear and would look forward to hearing from the head of the cdc is really more information about what theyre learning, what theyre recommending and why, laying out the Public Health case for what needs to be in place for opening. I looked at the draft guidance that the cdc had put forward and its really good. Its specific. It gives states information that they can work with. Its not one size fits all. It says that you need to be seeing downward trends in cases, you need to have excess room in your hospitals, you need to have protection for not just for health care workers, but for all workers who are going back on the job so that they know theyre safe. And thats what were hearing from people around the country. Everyone wants to get back to work, but they dont want to do it unless it can be done safely and based on the best Public Health science. So im looking forward to hearing from them what they recommend as the leaders of our Public Health institutions. Senator, as someone who is now watching this play out, what is your message to your former colleagues. Well, first of all, i think the questioning here is important. Making sure that the people who are watching this hearing understand what the facts are and how they can safely go about their lives in a very gradual fashion over the next 60 days. I think if we get into the president is perfect or the president is really terrible, then the committee would be doing a disservice to the American People who need a hearing like this to hear from experts cleanly and clearly about where we are and where were going in a way that will protect them and their families. First, residents in wisconsin are preparing to head to the polls again amid the pandemic. And in new york where parts of the state are set to begin reopening on friday, reports of Racial Disparities as police make social distancing arrests in certain new york city parks. Weve got our team of reporters following the latest developments. I want to start with ron allen, live at domino park in brooklyn. Ron, this is a tale of two cities. You and i have talked about this over and over. We have seen people out in the west village on the river enjoying parks, while weve said gosh, maybe they should wear masks. Over in brooklyn, minorities are getting arrested for being in those parks. Whats going on there . Reporter well, exactly, stephanie. Warm weather. And there are those two very violent arrests that happened in brooklyn that involved social distancing situations, also drugs the police would say. And then thats contrasted by the images weve seen in other communities where people are lounging and enjoying a good time and not appearing to social distance. Then some statistics came out showing the number of summons that have been handed out by the new york police and they showed that, in fact, 81 of those summons for violating social distancing norms have been handed out to black and brown people in parks and across the city. That set off a lot of outrage. Here is new yorks public advocate saying that he thinks police are taking the wrong approach. We told the mayor very specifically that we had a plan that did not focus on arrests and summons, even though the governor had said we have to enforce this. Its going to lead to a problem. And about three weeks ago we started asking for the data. Ive got to tell you, i knew it would be bad. I never thought it would be this bad. Reporter of course there has always been some level of tension between the police and some communities in the city dating back for some time, and so it is emerging again in this context of social distancing. The city is now trying to send out socalled park ambassadors, city employees, other community leaders, trying to help with the guidelines of social distancing and to try to make this not such a confrontational matter between police and citizens, as more of just citizens trying to sort this out as we get through the pandemic, stephanie. The only way we can do this, ron, is if we do it together, and i know new york wants to try to reopen together somewhat on friday. Tell us about that. Reporter the governor says were on the other side of the mountain. There are three regions of new york, out of ten, so about a third of the state that has passed several metrics like hospital capacity, the number of cases and deaths going down, so that they are poised to reopen very, very slowly at first. Construction, manufacturing, Recreational Activities will be allowed like playing tennis. Landscaping, gardening, again in only three regions of the state. Its phase one. The plan is to see how this goes for two weeks and then another phase. But its a big step for new york. But again, these are upstate areas. This is not new york city at all, the epicenter of all of this. Here the mayor has said that he doesnt see any beginnings of any reopening until sometime in june. So weve still got a ways to go, because new york is not hitting on all of these metrics in terms of cases, hospitalizations and so forth. But yes, people in upstate new york are going to cautiously move forward with reopening. So as the governor put it, were on the other side of this big mountain. Hopefully well stay there. Lets hope so. Lets head now to wisconsin where the state is having another election. Shaquille brewster is live at a polling station there. Tell us about todays special election and what is being done specifically to protect both the voters and the poll workers. Reporter well, stephanie, youre seeing similar measures to what you saw in last months statewide election. At the door there are hand washing stations, portable hand washing stations that were brought in. Workers are Wearing Masks and enforcing social distancing with tape marks on the lines. Youre seeing this is a special election, so its much more confined. This is one congressional district. You have the state republican, the republican state representative tom tiffany going up against Tricia Zunker to replace shawn mcduffy who retired in the fall. This is the largest polling station in the city and youre seeing no lines, but youre seeing people going in and Wearing Masks and going ahead and voting. We saw absentee voting did increase. It matched what we saw on april 7th. And then youre also seeing that this is a much more rural district, a conservative area, a suburban district. But i spoke to the Democratic State chair here and he said that hes watching this closely because this is somewhat of a test case in how people can go and vote absentee. Hes saying hes watching this because his eye is on what happens in november when you have people from all across the state coming out and participating in that president ial election, stephanie. Youve also got people in wisconsin who do not want to shelter in place. Last week the state Supreme Court heard an argument against the extension of this safer at home order. Have we heard a decision yet . Reporter no, no decision yet. It was exactly a week ago when you heard the state Supreme Court hearing those arguments from the state legislature and the department of health. The republicanled state legislature is suing the department of health, trying to block the extension of the safer at home orders, as theyre called here in the state of wisconsin. Legal experts were expecting that decision to come pretty quickly, but its a week later and we havent heard anything yet. The state Supreme Court leans conservative. Its a 52 conservative majority, so were still waiting to see what the Supreme Court has to say and if they make a decision, stephanie. Thank you. Breaking news, today is the day President Trumps taxes will go before the Supreme Court, and the big question, are we going to get to see them . That is what is being argued this morning. Joining us to discuss, tim obrien, one of the few people who has actually seen President Trumps taxes, and the former acting solicitor general and a professor of law at georgetown university. Tim, your latest piece is entitled ive seen trumps tax returns, and you should, too. Why . Because its salient in terms of the president s own financial transparency, his own business dealings, the extent to which his actions or his policies are informed by his own financial selfinterests, rather than in whats in the best interest of the country or what is in the best interest of good policy. Thats one of the things thats in play with the Supreme Court today. The other, obviously, is whether the president is above the law. And the cumulative efforts i think both by the Manhattan District Attorney and the congress is to test both of these issues, whether or not the president exists above the law, and how financially transparent the president should be. These are core constitutional issues. The framers were concerned that any president could be bribed by a foreign or domestic power, hence the emoluments clause, which is in two articles of the conservative stulinstitution, requiring president s to be above board regarding their finances. Unfortunately, the trump era has shown that the laws we have in place currently and the ethics guidelines for federal officials dont do enough to address those problems. Then is it is he above the law or is the law written in such a way that he doesnt have to show them to us . Neil, you know these technicalities. Explain whats going to go down here. Yeah, so were going to have two hours of arguments starting at 10 00 a. M. There will be three Different Cases jumbled into two different kind of oral arguments with six different advocates. Youll hear from President Trumps lawyers, youll hear from the solicitor general at the justice department, who is effectively representing President Trump in this case. Then youll hear from the house of representatives lawyer, as well as the Manhattan District Attorney. And i agree with what was just said. I think this is a question really about first order legal principles, is the president above the law. Do we have a system in place in which the president can say im different than everyone else. Hes already said you cant indict me. Thats how he got out of the Mueller Report allegations. Then he said you cant impeach me either. Thats a hoax. Now today hes saying to the Supreme Court you cant investigate me either. I dont have to turn over any information that Congress Wants or that prosecutors want, because im the president. Now, if that sounds unfamiliar to you as a student of americhi its because it is unfamiliar. Theres really no precedent for this. So his lawyers have a very hard argument today. Quickly, neil, i have to ask you, have you read all of those books behind you . This is actually not a real background because you dont want to see my office, man. Thats amazing, because i was going to say i havent even read that many book titles. Tim, the rulings for this will not be released most likely until late next month. That is right before the conventions. And i know this is information that is very important, but i do have to ask politically, how does this play out . We are in the middle of a pandemic. This is going to be just before the conventions. And think about it, the Mueller Report, even the impeachment, as importantly as they were, they did not have the impact that democrats were banking on. Well, i dont think the most important thing here is whether or not the actions today around his finances have an impact on the election. I think its what it means for the presidency Going Forward. Theres a criminal investigation going on in new york about whether or not the Trump Organization paid hush money to two women who said they had sexual encounters with the president. The d. A. Wants to get access to the Trump Organizations records to solidify that case. The Congress Wants access to his financial records so they can do a better job of overseeing the executive branch. Thats something thats important in a nanpartisan way Going Forward for the presidency and the longterm issues around this i think are whats most important. Neil, take us to the i agree with all of tharks b that, but the one thing i would say, stephanie yes. I was going to say yes, its important for the overall fabric of the presidency. These cases are incredibly important to President Trump himself. The only reason he hasnt been indicted was because hes sitting president and cant be indicted and thats his hope when it comes to all of the financial imp pro pry tees. So he needs to win this to avoid jail time and this case is an important precedent in establishing whether or not the documents will be revealed that ultimately may lead to the president s indictment once he leaves office. Neil, can you explain for us what the divide on the court is likely to be . Because theres a lot of confusion for your average person, going where does bill barr fit into this. And he doesnt. This is the Supreme Court. So can you walk us through it . Yeah, bill barr has nothing to do with the nine justices on the court. Theyre an independent branch of government. And some people, and ive been seeing this in my twitter feed a lot, are saying five are a pointed by republicans, four by democrats, therefore its going to be a 54 decision. And ive argued 41 cases. I just dont think thats the way the court thinks about these things. And i would be very surprised if we saw a 54 decision in this case. I think the law is quite overwhelming against President Trump, which is why his lawyers have really struggled to make a legal argument in their briefs. And i very severely doubt this will be a 54 decision in favor of congress and in favor of the new york prosecutor. I think it will be much stronger than that. Put this in perspective. How big a deal is this and the impact it could have, tim . Well, i mean, the reason donald trump a litigant who has nothing to hide doesnt stonewall producing documents that reflect well on themselves. So the natural question that arises from this is what is donald trump hiding . And i think the reason he doesnt want his tax returns to get out into the open is in a narrow way it would show that his businesses arent as robust as hes always claimed them to be. But they also would Say Something about his sources of foreign income. And we have struggled, i think, to try to explain why donald trump had this peculiar catering to Vladimir Putin. And the taxes would make that apparent. I would think thats one of the main reasons he doesnt want that out there. I also think that what youll get out of this is a real check on his behavior in the oval office, something that will give traction, i think, financially around what motivates him. I think he has often put his own personal financial interests and his familys business interests ahead of the American Public and the law, in fact. And we have not had a president in the modern era who is as personally, i think, corrupt and unhinged as donald trump is around these issues. Gentlemen, thank you so much. It will be a big day on the Supreme Court. Were going to leave it there. Coming up, were going to go back to coronavirus and reopening america. The biggest worry experts are sounding the alarm over. The latest example of that, plandemic, a documentary that claimed dr. Fauci, bill gates and others are grabbing power and forcing people to vaccinate. It also has the claim that Wearing Masks actually activates the virus. That of course is an absolute lie. And as my colleague ben collins reports, these theories have reached hospitals where doctors are working around the clock to save lives and now those very doctors are getting blamed for being part of the problem. One of those doctors is a cardiologist in new york city. After he saw social media posts claiming that hospitals were empty, he decided to engage the conspira conspira conspiracy theoriesists and he was told he wasnt a really doctor and since then hes received Death Threats. He joins me now. Doctor, this is extraordinary and unfortunate. Explain to me what happened. Why did you engage these conspiracy theorists . First of all, thank you for having me on, stephanie. That is a question my wife asks me all the time, why am i engaging. But, you know, i dont usually engage with conspiracy theorists, but this one felt like it hit home. They were denying what i was seeing with my own eyes and they were saying things that were completely untrue about the new york City Hospitals. We as doctors, as frontline workers, were putting our lives on the line. Were on the front lines of this pandemic. And to hear that we are part of the problem and we are fake and we are they called me a sheep, it was hurtful. And i just felt that, you know, this one hit home and i had to correct them on what they were thinking. But unfortunately, it didnt go as i planned. So what happened literally . You were on facebook and you saw some articles. Like what happened exactly . So there was a video before the video of the plandemic. I forget what it was. A friend had of a friend had posted it and said this is all fake, 5g, bill gates, and the new york City Hospitals are empty. And i said what youre posting is wrong. Im a doctor in new york city and this is a very real virus. And she went on my then public Facebook Page and commented that im not a real doctor because i went to music concerts and so on and that im part of the problem, im fake. And then i actually gave her my credentials, told her where i worked, told her my education, thinking that that may convince her that im a real doctor, that this is happening in our city in new york. But she said that im lying and she said im a sheep, im fake, thats not true, and at that point i decided to disengage and then other people who were on her wall started attacking me as well. And at that point i just gave up. But youve subsequently received Death Threats. Youre going to the hospital all day and youre treating patients and then youre receiving Death Threats . Yeah, you know, so to put it in context, after i made a comment on the nbc news article, my comments were not controversial by any means. My comments were that these conspiracy theories and the people who are behind them can be hurtful to those of us on the front line. Its Something Else that we have to deal with other than the fear of getting the virus, were now having to deal with things beyond the hospital, which are people doubting what were doing. And so that was my comment to the nbc news article, and after it was published, to be fair, ive got a lot of positive a lot of positive feedback from so many people all over the country supporting me. But also last week started getting phone calls to my personal cell phone, people knowing my address, threatening to kill my son and my wife and, you know, its very you know, we dont go into medicine thinking were going to get Death Threats. Were not political. I do my job not thinking of what the person in front of me believes in. I treat everyone the same. Everyone is family to me when it comes to my patients. And to receive those Death Threats have been very disturbing for both myself and my family. Beyond just you, and obviously this is concerning for you and your family.
