This as whistleblowers have come forth alleged faa employees involved in certifying the max jets were not properly trained or certified to even do the job. It is a big day in news and were going to begin with democrats upping the ante in a potential legal battle with the attorney general. Youre looking inside the House Judiciary Committee room right now where theyre preparing to vote on a subpoena that would demand the Mueller Report in its entirety. I have a great team here to break all of it down. As get started, weve got to keep an eye on the hill. The vote in the house is expected to start at any moment. Assuming it passes, it will put a whole lot of new pressure on attorney general barr to hand all of Robert Muellers findings over. Msnbcs ari melber talked to jerry nadler about the purpose of the subpoena. Watch this. The subpoena is sort of a planned leverage to see what he does with the redactions . Its to authorize us to negotiate with him and not just negotiate with him but to work with him and minimize redactions. We will use the subpoenas as necessary to make sure we get the whole report and all of the underlying documents. President trump, who has dialed back his early claims of complete exoneration, expressed his frustration about the whole exercise calling it a, quote, waste of time. I will tell you anything we give them will never be enough. We could give them, its a 400page report, right . We could give them 800 pages and it will never be enough. They will always come back and say its enough enough. Start with 400 and see how it goes. I want to bring in Peter Alexander at the white house, Geoff Bennett on capitol hill and nbcs intelligence and National Security report, my friend ken dilanian. Ken, to you first, tell us where exactly this fight over the Mueller Report goes he next. Issuing a subpoena does not necessarily make anything happen. Look how the white house is handling things. Youre absolutely right. Maybe this ngoepgoes to the cou and we will see a fuller version of the Mueller Report leased long before it goes to a court on a subpoena. But it could cause a jury to rule grand jury material could be turned over to congress. You need a court to rule to turn over grand jury material, like a judge did in watergate, and so far none has done that yet. Big questions that lures over the Mueller Report, we know mueller didnt find a conspiracy with russia but what did he find as far as russia contacts and lying about it . Secondly, the huge question is why didnt mueller make a call on obstruction . Did he realize the attorney general william barr was going to step in and clear the president . Was that coordinated with mueller or not . President trump and the republicans have a different view of this whole thing. Theyre looking at what they call origins and beginnings of this investigation, although the president had a difficult time spitting that out yesterday. Lets take a listen to what he had to say. I hope they now go and take a look at the origins, the origins of the investigation, the beginnings of that investigation. The Mueller Report i wish covered the origins of how it started. The beginnings of the investigation. How it started. It didnt cover that. And for some reason none of that was discussed. As you know, stephanie, the republicans believe there were politics and corruption at the center of how this investigation started. We see no evidence of that whatsoever. This was a lawful investigation the entire time, and now we want to know the results, stephanie. Right now we know jerry nadler is speaking specifically about the Mueller Report. But i know last night, jeff, House Democrats approved a different subpoena. This one was in connection with the White House Security clearances. What can you tell us . Youre right about that, stephanie. Im speaking to you from outside the House Judiciary Committee room but it was a separate committee, the House Oversight committee, that democratled committee, that authorized and last night served a subpoena to a former white house official named carl line, who kline, whod of improperly overturning security clearance denials. This follows the testimony of whistleblower Tricia Newbold mishandled that. You have the testimony that they cherrypicked and gave a partisan game. Check out what Elijah Cummings and the Top Republican on that commish said. I have been on this commity ten years and i have never seen anything like this. Oh, please. I havent. I think its my time, mr. Chairman. Youre out of time. You didnt run. We didnt run the time. You will get listen to me. So to set aside the partisan bickering, cummings told me and other reporters that he views the security clearance process as a National Security threat, an imminent threat. He said he would not be doing his job, he would not be fulfilling his oath of office if he didnt fully look into it, steph. Peter, i have to turn to you. I know last night you spoke to that very brave woman who pushed this investigation forward, the whistleblower herself, Tricia Newbold. What did she tell you . I can only hope bigtime lawyers are helping her through this process pro bono. I think Jeff Sessions has some free time. Shes certainly working with strong lawyers on this but it is her bravery and courage that helped us have a better understanding of what was taking place behind closed doors inside the white house complex. She, according to Elijah Cummings, alongside other colleagues, sort of detail what they call the disqualifying issues about these 25 applicants who had recommendations that were unfavorable, overturned. Jared kushner was among those individuals. Those included foreign influence and conflicts of interest. So i did, i spoke with Tricia Newbold, this 18year veteran White House Security specialist, and she said shes speaking out because of in effect a sense of duty. Take a listen. Why is this issue so important that you felt the need to speak out . The protection of National Security is not a democratic oth issue or republican issue. Its an american issue. We owe it to make all of our recommendations in the best interest of National Security. Its americas National Security at stake here, correct . Absolutely. Newbold filed her own discrimination complaint against her former boss, that man carl line. His attorney said hes only acted appropriate at all time. But she, who has a rare form of dwarfism, says on multiple occasions after this, in fact, as a form of retaliation, that her boss moved files in her office to high shelves where she literally could not reach them. She told me, steph, that experience was in her words humiliating. My goodness, well, shes a very, very brave woman to come forward in the way she has. Thank you all. Now all of this is happening against the backdrop of now new tensions between President Trump and his own party. Im talking about fellow republicans who in just the last few days felt the need to go public with their opposition to some of the president s most public plans, lets just say. Shutting him down in ways we have not seen before. Im talking about health care for one. Just one week ago President Trump abruptly announced the republicans will be moving forward with a new Health Care Plan, but then on tuesday, republican leader Mitch Mcconnell shut the idea down, insisting that any Health Care Legislation would have to wait until after the 2020 election. I made it clear to him we were not going to be doing that in the senate. He did say, as he later tweeted, he accepted that. So we dont have a misunderstanding about that. Will not be doing comprehensive in the senate. And then theres the border. Over the weekend President Trumps aides signaled he was this close to actually shutting down the border to deal with the spike we obviously talked about in migrants arriving through mexico. But that has become more and more uncertain with each passing day. A big part of that, pushback from republicans like Mitch Mcconnell, Lindsey Graham and john cornyn, who have all suggested it would be a catastrophic mistake. Im talking economics here. The chamber of commerce said the move could undermine the economy. Remember, theyre our Third Largest trading partner. On tuesday the president appeared to give himself a bit of an out on that. If we dont make a deal with congress or if mexico and probably and or, if mexico doesnt do what they should be doing, were going to close the border, thats going to be it. Or were going to close large sections of the border, maybe not all of it, but its the only way were getting a response and im totally ready to do it. I want to bring in my panel, it is an excellent one. Pulitzer prize winner phil rucker from the washington post, fonl a former spormsman for hillary clinton, and i think the happiest man in america, john boehner, who dealt with issues as Communications Director for republicans on house ways and means. So were about to make him work overtime here. Mr. Rucker, i must start with you. Your paper called this policy whiplash. The president doesnt mind policy whiplash. Playing a game of chicken is how hes run his business which by the way it went bankrupt four times throughout the last decade. Whiplash is what we have seen from the president. The president brought up health care and created a new policy and now is punting that until after the election. It speaks to the broader problem the white house is having creating a cohesive and add heradd hernt policy agenda. Trump has not put on the table any policy ideas as he gears up for reelection and hes in open disagreement with Republican Leaders in the senate, especially Mitch Mcconnell on these priorities. Its a real problem for the president. Michael, a trump supporter would say his methods are unorthodox. Its so crazy, it just might work. As i mentioned, you specifically dealt with trade and health care for ways and means. How would you handle this now . His desires and its too generous to call him plans, are running in the buzz saw of reality. Democrats control the house of representatives. Theres no conservative Health Care Plan they will pass to repeal and replace obamacare right now. There was also no conservative plan when conservatives controlled the house that they were able to get through. They havent actually solved anything with they had control. They got it through the house and it failed in the senate. We ran into the severe problem in the 2018 midterms because of that plan and lack of protection from preexisting conditions. We learned from that mistake. I think we could get a conservative plan out of the senate but its not going anywhere in Nancy Pelosis house and Mitch Mcconnell knows that. This is why he told the president , you lost the house. We will have to wait until after the 2020 election at the earliest. Lets talk more about what the president said in his changing narrative about the border. Lets take a look. Are you worried about the u. S. Economy by closing the border . Sure, its going to have a negative impact on the economy. Its one of the biggest trade deals in the world. Trading is very important. The borders are very important. But security is what is most important. You have to have security. All you hear me talking about is trade. Let me give you a little secret, security is more important to me than trade. You did work at the state department. Security and trade are two things you have to balance. Put the president and the drama and all of that aside, it is a real issue balancing the two. Hes about to play a game of whackamole where he thinks he can hit one and not affect the other. I think its shaping up to be another one of the situations where completely doesnt understand the situation, dynamics, politics back in washington ju washington. Just watching that clip, this is feeling in the early days of the shutdown where he feels he gets an idea in his head and gets a lot of the right wing to say shut it, shut it. And when it practically comes time to shut it, it starts going badly and you will start getting the pictures of students who cant get across the border, people cant get to hospitals and it will start looking not so great. Any minute then ann coulter will emerge with one of her tweets calling him an idiot and Mitch Mcconnell will sit there laughing because he knows theres nothing he can do. Hes stayed away ten feet away from this thing. Its he end of the day, its republicanonrepublican violence. He can blame nancy pelosi all he wants but this has been going on two years prior to the midterms. Michael worked for jeb, paul ryan, speaker boehner. Im not sure if im missing any. Any of those people in this situation, if any of those three had been president , you actually would get the things done that trump is trying. So this idea that trying except none of those three people were able to become the president. Right. I noticed that part. So President Trump, if he was able to win, that is the difference. My point is whoever it is that voted for donald trump, they did it because he conned them into thinking only he could get these things done. I and i alone. The truth is what he accomplished without the commentary, hes accomplished tax cuts and two Supreme Court judges and fair amount of federal judges. Any other reasonable republican in that party would have done the same thing without all of the nonsense. And i think thats what is becoming clearer and clearer, the noise doesnt get anywhere. If donald trump says only i can do it and i can only do it this way and it gets done, okay. Or the noise gets too loud. You get all of the things republicans would get done and President Trump is somebody who actually won. He was very close to having a successful first year in congress. He lost repeal. Yes, he has the famous thumbs down from john mccain and he also lost Lisa Murkowski because somebody in the white house thought it was a good idea to threaten Lisa Murkowskis funding for alaska. Hard to believe they lost the first appeal vote in the house because the House Freedom of all people, his shield, voted against it. And its worth noting he missed the opportunity to have an immigration deal that would have traded better Border Security for protection for the dreamers, a bipartisan achievement that we would have all been very happy with and it would have prevented the current backlash on the border. Freedom caucus, last i checked, they cared a lot about deficits. I guess not anymore. I want to remind you, look at the right side of the screen, we are waiting for the vote on the Mueller Committee and House Committee. A moment ago jerry nadler was speaking about the time line for attorney general bill barr. I want to share that. If we cannot reach an accommodation, we will have no choice but to issue subpoenas for these materials. And if the Department Still refuses, then it should be up to a judge, not the president and not his political appointee to decide whether or not its appropriate for the committee to review the complete record. Thats aggressive but is it a threat . Its something of a threat there. It seems like nadler is buying a little bit of time here to see what it is exactly the attorney general produces later this month. Again, the Justice Department has said he will put out that redacted report to congress some time in midapril. I suspect nadler will wait to see what those redactions look like before issuing any final subpoena. But clearly this vote looks like its going to be passing the house or committee this morning. Thats a significant development. Its important to note also, steph, the shift in what were hearing out of the white house on this, when the bar letter first came out about ten or so days ago, the president and his aides were talking about total exoneration and they wanted the full report to be shared with the public. Now theyre talking about lets move on, lets move on. And thats because they know at least some of the 400 pages are not going to be pretty. Maybe they got to page five. Maybe that was it. Theyre set to vote any minute now, steph. We expect the democrats to be successful because the democrats do have a seveneat majority. So jerry nadler said today when these are authorized and he fully expects them to be authorized, its entirely up to him when they he will issue them. Will he keep them in his back pocket likely to use as a source of leverage to apply pressure to the attorney general as he will give the attorney general time to make up his mind, to see if he will find a way to issue the full unredacted report to Congress Much faster than the democrats want by this april deadline that attorney general william barr announced. Thats kind of the state of play. You have the attorney general saying he will release the redacted version some time midmonth. The catch there is that congress is taking easter break for two weeks in the middle of april. So theyre trying to get ahead of that and democrats on this committee dont see barr as a neutral force in all of this. They see him as a trump partisan. They want the full report and underlying evidence and five former white house officials who they believe might have received communications or documents from the white house related to the Mueller Report. They also want testimony from them, steph. I want to bring in Frank Figliuzzi in, former assistant director for counterintelligence at the fbi and msnbc National Security analyst. Frank, lets say this thing passes, if we go into the twoweek congressional break. Im just thinking more news, more tweets, more distractions. Thats exactly what this white house wants. The question is if thats a deliberate strategy or not and more important if the attorney general of the United States is part of a white house strategy which takes his neutrality out. Every day that goes by we dont get a full report, the a. G. Looks even more politicized inial of thin all of this. But cant he say, i dont care how it looks, i have the law on my side. Can he take this subpoena and blow his nose with it . He can throw it in the trash. But theres an oversight Rule Congress needs to play and even more importantly, the American People have spoken. We are seeing the polling results. They want to see the result in its entirety and the nation needs to see that if theyre getting closure at all is the attorney general focused on polling . Put yourself in the mind of bill barr and what motivates him and the person he is, does he actual clai care what the polls say . Whats supposed to motivate the attorney general, who is peoples lawyer, not the president s, is justice and truth. Were about seeking truth at the Justice Department. The truth is somewhere in the details of that 400page report. If all were going to get is a redacted version of that, were really not getting to the truth of what muellers intention was, whether or not there was inappropriate coordination of a noncriminal kind with the russians, and then on the obstruction question which the president has not been exonerated on, we will never get to the truth if we dont see the report. Republicans and democrats on that committee are acting like the hatfields and mccoys. They dont like each other. They see the opponent as the enemy and its a sign of how polarized the country has become. We reached a point where 50 of republicans now say they would be upset if one of their children married a democrat. Polarization is going way beyond politics to affect social and romantic relationships. You write as often happens in politics, every attempt at a revolution stimulates a counterrevolution. Give me an example of this in recent politics we could point to you. My book is a 40year political history so when you look at each presidency, it seems like we go from one extreme to the other. I think its no accident we got donald trump after the first africanamerican president. Its quite possible donald trump will produce the most progressive president in american history. Tribalism has certainly taken over politics and taken over the media. But has it taken over america . At the end of the day when you actually speak to people, theyre just trying to live their best lives. They dont care about politics. They care about feeding their families, health care and jobs. I think they do care about politics. They dont sit around and watch msnbc all day or hear about the subpoena, but they care about health care being taken away or taxes changing or being told they will go down but in fact they got nothing or maybe up. So just because someone tanthably doesnt feel the actions of government, does not mean theyre not seeing it everywhere. And more importantly i think what donald trump is doing to us culturally to our society in terms of language with children, in terms of increased cases of bullying and school and domestic violence, everywhere in the country people are feeling that. I think we are more tribal than not. I think if i air spsz droppdrop alabama i could probably make new friends. But if i touched these issues and went around and said hi, i work for hillary clinton, i would get tribaled off fast. I think there are big challenges facing inadequate education, a need for a Foreign Policy to make sense and fits the 21st century. I dont think our politics is delivering and reform and changes we need now and polarization is a hiej part of that. As long as were channeling ourselves into separate categories and just talking to people who agree with us, that will not fix policies. You write tribal discontent reached a boiling point during the 2018 Brett Kavanaugh confirmation. I think we can all agree that absolutely was the case. Yes. That was just the most recent culture war we experienced. We have seen many in recent decades but i think the polarization results from a combination of geography and economics. My colleagues at berkeley did a study and found 15 of american economies generate 60 of gdp. What that means is all of the Economic Activities on the west coast, east coast and few mecht areas in between are being left behind. Theyre embracing more extreme politicians like donald trump. Unless we kak knowledacknowls the problem, unless you blow up the primary system, how are you going to address this . The whiff of a centrist candidate who said let me come together on comprehensive reforms gets blown out of the system. Yes, and i think there are real things we can do to help the people in the center of the country, rural broad band, better infrastructure and better education. Those are the things were not talking about because the president is fixated on the border or this chaotic effort to go after obamacare again. Were going to have a big election that will determine what the future of our country is and what choices were going to make. You diagnosed the problem. Do you see a reasonable solution, especially as we head into an election . The solution is to address the causes, which in my view is lack of economic opportunity, high cost of education, geographic disparities. Who will do that . Who has the political will and money to do that . When gm closes a plant, thats gms job that theyre not operating at the best of their capabilities. Its trump who said dont sell your house to people in ohio and now theyre screwed. The Trump Administration will force it because leaders are more polarized than the public. Theyre moderate and centrist in their orientations and less than 5 of congress is a moderate today. You have this stubborn static 35 that goes up and down by a few points that they dont want to get anything done. They hired him to blow the place up. I think we all thought in 2016 that meant blow it up and build it up, replace it. Thats not whats happening. Its blowing it up for the sure sake of blowing it up. That will not work. The four of us are here a year from now and were telling the truth, were trying hard. People watching and one of us tells the truth, you will read about it online. If youre donald trump and there are no consequences to lying, it will take out one of the most important underpinnings of next year. In 2016 people can look at him and say hes a blowhard, hes a showman but he will be okay when hes in office and hes a businessman. They had a person get inside the white house while the first family was there. In this case it looks like what they did worked, in other words they challenged this woman. They got her coming onto the property. They asked her for her credentials and then went to maralago security and said okay, you have a bunch of members that belong here. Is she somebody that should be allowed into the club . And through a series of discussions, including a nonanswer from this woman, they said well, she matches, as you said before, her last name matches another member here. Yes, she can come in. And it wasnt until another receptionist asked her why she was in the area that she was in, and smartly referred her to the secret service, anybody figure out why shes on the property . A but every indication we have here the malware on her thumb drive and she had several electronic devices, phones, laptop thats what you bring to a pool, multiple computers. Exactly. A little fishy. This malware was not something, you might pick up during the course of your travels if you travel or use different machines. This could have been something more malicious. But the secret service and we have a statement from them, the secret service here clearly saying, look, they dont determine whos invited on the property. Its up to Maralago Club management that determines which members and guests are granted access to the property. The secret service is clearly putting theyre throwing maralago under the bus. Faa whistleblowers are telling congress that some of the inspectors that certified the boeing 737 max for flight might not have been up to the job. Grounded after last months crash that killed 157 people and now there is new reporting from wall street journal that the pilots at the control of the plane initially followed boeings emergency steps to disable the 737 max system, but then they failed to regain control of the jet before it crashed. These are whistleblowers inside faa saying some people who should have been certifying the max for flight may not have been properly trained or certified. All of that as we have more information inside the final seconds of the ethiopian airliner. New details of the boeing 737 max jet that crashed last mumon. The pilots at the controls followed emergency procedures laid out by boeing. According to people briefed on the probes preliminary findings, the pilots turned off the control system that was pushing the nose of the plane down. When that didnt work, they reportedly turned it back on but still failed to gain control of the aircraft. Meanwhile, bloomberg isert roing that accident investigators in indonesia issic looi is looking maintenance shop. That shop did repair work on the socalled angle of attack sensor the day before it went down in the java sea. Its believed bad signals from that sensor contributed to the indonesian crash. Now with the global fleet grounded, congress is demanding answers about the faa inspectors who helped certify the max telling the acting head of the faa, congress has received information from multiple whistleblowers alleging insufficient candidate training. The concern that poorly trained inspectors may have led to an improper evaluation of the mcas antistall system suspected in those two fatal crashes. Last week the transportation secretary and the faa chief were grilled about why it took so long to ground the max. The faa did not feel that they had any information which would warrant the grounding. Reporter meanwhile, the max fleet is likely to remain grounded for weeks or even months. Boeing was originally expected to release a software fix for its mcas system this week, but it now says it will take several more weeks. A Software Flaw is suspected of forcing both the ethiopian and indonesian planes into a plunge that they they could not recover. But that alone wont be enough to get the max back in the air. Boeing will have to regain the trust of the fa, arfaa the worl airlines and the regulators. Back to the wall street journal reporting suggesting that the crew of the ethiopian airliner did turn off mcas and the electrical power. If thats true, they followed the exact boeing protocols that had been laid out and discussed for months. The question therefore becomes what was happening inside the cockpit that they felt the need to turn it back on. The evidence would suggest they were frantic to try to control that plane. Stephanie. Felix, walk me through how bad this is for boeing because at the end of the day, are they going to be able to point to the faa and say, well, they were okay with it . No, because the faa basically reporting from the Seattle Times which came out around the time of the second crash. The reporting shows us that what we have here is regulatory, that boeing was in a mad rush to get this plane out because it was competing with airbus and their new 320 and boeing kept on pressuring the faa to certify the max very quickly and the faa rushed everything and they allowed boeing to do its own certifications and they basically said, you know what, we trust you. But felix, heres the issue. Regulatory capture may be obscene, it may be foul, but its also, in many cases, legal. So then what comes of this . Well, as ever, the scandal is what is legal. Right. The point is that when the faa overruled its own inspectors and said, you arent allowed to do this diligently. You need to rush this through or push things back to boeing and allow them to selfcertify. The faa is allowed to do that. When the faa said we dont have any evidence to ground these planes even though two of them just crashed. That ir allowed to do that. It doesnt make any sense for a regulator to take those actions. It doesnt make any sense, but what is the punishment . You and i had a similar conversation after the financial crisis. This makes no sense, but technically youre allowed to do it and then people got away with awful things. Lives have been lost here. What will the real fallout be for boeing and the faa . Well, the fallout for boeing we have already seen and they probably wont be able to get this airplane back up in the sky for a good while. People are not going to trust a software fix to fix this problem. But are people really not getting on boeing planes . Theyre getting on any other plane, the max is the problem. Its a perfectly safe aircraft andpoi boeing introduces new aircraft 737 max which they pretended was not a brandnew aircraft and that was the problem.
