In North Carolinas ninth district after allegations of election fraud. The republican candidate now conceding his unofficial victory was tainted. It has become clear to me that the publics confidence in the ninth district seat general election has been undermined to an extent that a new election is warranted. We begin today with the president and his legal team bracing for the special counsels russia report. Preparing their own report at the very same time. I have a great team to break it down. Theres a lot to get through today. First, i want to get you up to speed. This could be the final friday imagine that before Robert Mueller delivers his long awaited report to the attorney general. Rudy giuliani said it has been weeks since the special counsels team reached out at all. In the meantime, he says trumps legal team has been preparing a response to any findings that might be damaging to president trump. Giuliani said, if mueller clears the president , we walk away and say thank you. If its damaging, then we will respond. Last night one of the president s former aides said he believes muellers report is just setting the stage for the real main event. I cant imagine the special counsel is not going to release something that shows a road map for the house to investigate a conspiracy to answer it as a political question. Impeachment . Correct. For articles of impeachment. Yikes. As the country waits, there are new developments involving a bunch of the president s associates who got their own legal troubles. On thursday, a judge hit roger stone where it hurts, ordering him to keep silent after he posted an instagram picture of the judge and an image of crosshairs. Stone apologized and asked for a second chance. The judge said the apology rang hollow and told stone, im not giving you another chance. I have doubts whether you learned any lesson at all. She told stone, if he steps out of line again, he is going to jail. Speaking of jail, at some point today were expecting the special counsels latest sentencing memo on trumps former campaign chairman, paul manafort. We also found out this week that trumps former attorney, Michael Cohen, will now get an extra two months before he has to start his prison sentence. Cohen showed up on capitol hill thursday to meet with members of the Senate Intel Committee ahead of tuesdays closed door testimony. Next wednesday, he will be testifying publically in the house. Cohens attorney appeared on a podcast that aired earlier this week and talked about what cohen is likely to say. He needs to tell his personal story to the american people. When he does, what we all think we know about donald trump and all the negative reactions that many of us have to donald trump, you are going to hear in personal, front line experiences of memories and incidents and conduct and comments that donald trump said over that tenyear time period behind closed doors that to me when i first heard michael tell me all this, even as much as i knew about trump, that was negative, was chilling. I want to bring my panel in. Cynthia, to you first. Even if Michael Cohen cannot talk about the Mueller Investigation during his testimony, can his personal anecdotes about trump carry any legal significance, especially given who he is, who he was and all that he did for the president . He obviously has a credibility problem. It will be interesting to see if he can handle his anger problem. We heard tapes of him blowing up at people. I will guess the crossexam will be effective. He will have difficulty keeping his cool, which will affect his credibility as well, especially on television. Because he can be talking about funding things. He can talk about how those golf courses were funded, if he knows about that. He can talk about tax issues. He can talk about people who crossed trump and the manner in which they were dealt with. He can talk about other payoffs. Theres obviously a lot of things he can talk about that dont have to do with the russia inquiry, which may open up other avenues of investigation if theyre not already open. My goodness. I want to talk more about cohen. John dean tweeted that lanny davis said this, he will pull back the curtain and we will hear true stories of trumps complicity in crimes, his immorally vacant character, detailed personal anecdotes. Here is what doesnt sit with me. Those personal anecdotes about what an awful person donald trump may or may not be, Michael Cohen was his home boy. He was a guy who said he puts donald trump before list own familia family. What does it matter if Michael Cohen wants to gossip about what a person donald trump is when he is basically the same . We would argue you have more credibility the closer you were to the particular person thats being investigated. Personal anecdotes dont have anything to do with wrongdoing he is bigoted. But they dont matter. America knew that. They shubt mouldnt matter. What matters if they talk about the trump organization, the funding of properties, those things he probably had firsthand experience. The legal system loves eyewitnesses. It does. The former acting solicitor general, who is a regular here, says he believes that the Mueller Report is not going to be the final word. What it might be is a road map to a congressional investigation, presicisely becae he cannot indict the president but he is setting things up for congress. I dont think the president can mix and match apples and oranges. If he believes that he cant be indicted, then that information does have to be turned over to congress, not just muellers conclusions, but the underlying investigative threads and the like so that congress can perform its duty. Do you agree with that . You know, there are a couple of road maps. You have the road map with the Southern District in new york, which has been very aggressive. Its possible they may think the president could be indicted. Certainly, if mueller turns over his report next week we heard that before and it hasnt happened. The house will ask for the original report, not the barr report which allegedly will summarize it. The house would need it. How else would they make a determination on whether to start impeachment proceedings . Cynthia, what do you think . The Mueller Report is the crumbs for congress to set up an investigation. I think that mueller will definitely not indict the president and that he will have a complete report and that it needs to go and that he has done his Investigative Section and it needs to go to the house for further investigation. The big question mark for me is don junior, before this report comes out. Presumably, his comments to congress were not true, according to adam schiff, who obviously knows. Then the question is, he hasnt been interviewed. Does that mean he has been interviewed and we dont know it . Does it mean he took the fifth . Thats the big mystery for me thats going to come out i hope in the next couple days. Certainly, a mystery. What do you make of Rudy Giuliani saying theyre going to be releasing their own report . Is that an effective strategy . It depends on what the final report says. If its not harmful to trump, why wouldnt they want the final report out there . If giuliani has been working on a longterm plan to contest the final report, obviously, they think it will be harmful to his client. I think also what stefanie was saying excuse me, what cynthia was saying, you have a situation here with trump junior and others where you have unsealed indictments in d. C. Its not clear what the unsealed indictments are related to. Could they be drug cases . What does that mean . Excuse me, you have sealed indictments. They could be unsealed this week, next week. They are within the purview of the court, of the grand jury. Just because mueller issues a report, it doesnt mean that these sealed indictments will not be unsealed in the future. It could be that the u. S. Attorneys office in the district will be handling these cases. Can you imagine what the life must be they could be drug indictments. They could be. There could be a couple of sealed indictments related to the Mueller Investigation. We also have the sentencing memorandum coming for paul manafort. Its expected today. Is there any good information that would come out of a document like that . From the defense or prosecution . From the defense you are talking about . Yeah. What they want do to do is pain the defendant in as good a light at possible. Talk about the great things he has done, how the crime isnt that bad. I expect they will refer to his age, because obviously the gout. Yeah. The guidelines call for between 19 and 24 years. That doesnt mean thats what the special counsel recommended. Thats a legal determination of a place to start. The court can go in different directions. The defendant will try to put the best foot possible. As we saw with Michael Cohen, that cannot be a good strategy if you say things that are not exactly on all fours. A new controversy surrounding the president s labor secretary and his involvement in the plea deal for convicted sex offender Jeffrey Epstein. A judge ruling thursday that federal prosecutors led by acosta broke the law with that 2008 deal by not telling his victims about it. Epstein was accused of assemb assembling underage girls using young female recruiters and then coercing these girls into performing sex acts. The plea deal concealed the full extent of epsteins dealings, the number of victims, the names of coconspirators and shutdown an fbi probe into the gcase whie epstein could have spent life in prison. He pleaded guilty to two charges and served just 13 months in a county jail. As part of the arrangement, acosta agreed, despite a federal law to the contrary, that a deal would be kept from the victims. As a result, the nonprosecution agreement was sealed until after it was approved by the judge, averting any chance the girls or anyone else might show up in court and try to derail it. This is a wow. Its money, power, politics. Tom winter joins us now. Tom, what exactly did the judge say about this deal . The judge established two key facts. The two facts are one, the federal prosecutors broke the law by violating what they should have done under the victims protection act. Prosecutors are supposed to inform the victims of the crime, the people that they are representing in prosecuting the cases, theyre supposed to let them know certain steps along the way and if theres in sort of adjudication that happens outside of the courtroom, a plea deal, an agreement, which is what we had in this case. They were supposed to let them know. In addition to that this is important the judge established that mr. Epstein committed crimes not only within the general miami West Palm Beach area but in other states and overseas. Its one of the slam dunk cases for the Justice Department when somebody is involved with sexual abuse or sexual contact involving a minor in that activity happens overseas. One of the few crimes you can be prosecuted as a u. S. Citizen for committing outside of the country. If i committed a crime in france, normally the u. S. Would not be involved. Thats between me and french authorities. But if you involve minors and you involve sexual abuse, thats one of the few things u. S. Authorities can go after you for if you commit them outside of the United States. A lot of people looking at this and scratching heads. I want to show for us we have a statement from secretary acosta that we can show on screen. I want to discuss it. Its really one of the great nonstatements we have had so far in 2019. He says for more than a decade, the actions of the u. S. Attorneys office have been defended by the department of justice in litigation across three administrations and several attorney generals. I guess that is supposed to make us feel like somehow that this is something that has been defended and multiple people have agreed with the defense of this. I want to let the viewers know and understand that really, this is something here where the government had to have this amount of time to defend it because it takes this long to go through the court system. Its not something that people have necessarily been standing up for. Its something the Justice Department, because it took so long to go through the courts, had to go through. Its something where i think when people point out the secretarys people point out that somehow this is something that has been defended across a number of administrations and a number of attorney generals, its just going through the court system. I guess i kind of just dont understand that statement. Appreciate them putting out a statement. I dont get it. I have a great panel. Stick around. Here to weigh in, a. B. Stoddard, philipp rinus, Jason Johnson and cynthia oxny, a former sex crimes prosecutor, back with me. Cynthia, legally, what does this mean for the victims . The judge didnt overturn the plea deal. Can they press charges . We will have to see. The judge said they have 15 days to come up with something under the crime victims act. He can rip up this agreement. Theres a couple of options. One is, he rips up the agreement and a new set sof attorneys loo at the case. The other option is to have the case looked at in other districts where the crimes occurred. I cant even begin to tell you how horrifying reading this order is. Were supposed to be the people with the white hats. In this case, the prosecutors essentially lied to the victims, they concealed what they were doing, they misled the victims. Secretary acosta was intimately involved in that. He was sneaking off and having meetings away from the office to get it done. Its somewhere im somewhere in between enraged and depressed. I want to scream about it. This is everything we do as prosecutors has been done wrong here. My goodness. We have to remind our audience, its not just epstein. Many of the people in his ring whose nape names were protecte among the most powerful people in the planet in business, entertainment and politics. Whats your take on this . I think, obviously, he has been associated with president trump. I dont know how much he might have known along the way. Anyone watching he being epstein . Epstein. He is associated with bill clinton. You dont know what is going on in their creepy private island. To say that he has been associated with donald trump, he is without a doubt associated with bill clinton. That has nothing to do with president capitol hill t clinton doesnt approve. You were making a comparison its habit. Stick to the facts. Its relevant. Donald trump is the one that put him in his cabinet. Im going to use proper pronounces. Take two. I think any sane person watching this is saying, how is he he being secretary acosta, who is responsible for the easy treatment and leniency that jeffr jeffr Jeffrey Epstein sought, how is this man United States cabinet secretary . Maybe the longest ever. They have been allowed to toil long after they should be. Cynthia is right, its so disgusting, its really hard to read about this. He ran a very broad sex trafficking ring, traumatizing and abusing minors. Its just so awful. A girl providing massages to him at maralago when she was 14 and becoming a slave. Its really unbearable. I hope the administration sees fit to do something very quickly about acosta. Acosta was asked about this in march of 2017. I want to play a bit of it. In this case, we deemed it necessary to become involved. We early on had discussions within the office. And we decided that a sentence or how should i put this . Mr. Epstein should plead guilty to two years, register as a sex offender and concede liability so the victims could get restitution. If that were done, the federal interests would be satisfied and we would defer to the state. I want to remind the audience, during that twoyear period, epstein only slept in the county jail. He would wake up and his private driver would take him to an office. He would go about his business during the day. He would go back there and go to sleep at night. What are your thoughts on that defense that acosta gave . I feel like fire is about to shoot out of your head. This is absolutely i cant we cant get desensitized to this. How many people in this administration beating women, attacking women, assaulting people, abusing children . These are the people who ran talking about pizzagate. You have someone in the administration right now who was part of protecting it and lying and keeping children in the dark and abused. This is to catch a predator and letting him go. How many republicans who have spoken out in large number about the president s executive action, how many of them will be willing to cross over and vote against the president . Even if you have congress sending this to the president s desk knowing he will veto it, thats a pretty strong action by this congress, a strong condemnation. A wild week of hearings down there. Yesterday, Election Officials voted unanimously to hold a new election in the states ninth congressional district. The november race came into question after allegations of ballot tampering in two key counties. While republican candidate mark harris went into the hearing arguing that he should be declared the winner, yesterday he decided to change his tune. Neither i nor any of the leadership of my campaign were aware of or condoned the improper activities that have been testified to in this hearing. Through the testimony i have listened to, i believe a new election should be called. It has become clear to me the public ace c publics confidence has been undermined to an extent that a new election is warranted. We have been following this from the beginning. What happened yesterday . It was like we got two marks, before and after break. It was an incredible development. What happened yesterday was mark harris was running out of options. He had this damaging testimony from his son, testifying against him really. Then he was starting to perjure himself. His attorney said, i need to talk to my client. After they conferred for a couple hours, mark harris came back on the stand, retracted his statement about those conversations and that email and then he called for a new election. The fivemember board of elections agreed. Now theres going to be a new election in the North Carolina ninth congressional district. Here is my big question. Now we will have a new election. Who are the candidates . On the republican side, its unclear. Im told its premature if mark harris is going to run again. Really, he has tainted himself in this controversy. His health is bad. If you look at his federal election filings, he is broke. He is in debt. Its going to be very hard for him to be a viable candidate. On the democratic side, dan mckreedy will run again. One of the issues is the center isnt sexy. I watched her town hall the other night. When she was talking truth about how expense i it is to pay progressive ideas, she kind of got this. She was being realistic. Well, thats a fundamental choice theyre all going to have to make over the next year is do they want to bank on being realistic and telling hard truths to an audience. In her case, it was a College University where she was saying tuition shouldnt be free, or do you realize that maybe the primary voters dont want to hear you be honest if its that theyre not going to get what they want . And i would hope that her approach is the one that wins, not her particularly, but that full honesty. But i dont know. Because it really depends on what kind of purity hes laughing. When does someone go practical when running for president . Thats how people lose. You have to tell people about your fantasy. People want to know your dreams. Thats why they want these other people to get in. Every single one of them hold on. Theyre talking about the extreme left and saying how unamerican it is and its a threat to the country and wlrnt you agree with that, millions of people watch that at night, some of those people are tired of the president. Theyre disallusioned with him, and the votes are available. They are not available to the extreme left. Yeah but Kamala Harris isnt the extreme left. Cory booker isnt the extreme left. The only extreme left is probably Bernie Sanders, and the idea of saying the Democratic Party is antibusiness, most of these people take wall street money. They have no problem in getting billionaires more cash. Theyre not antiisrael or antisemitic. They dont see pushback from the campaign trail. But theyre reflecting what their constituents want. Thats whats happening in this campaign. At the end of the day you have a sitting president who only won 47 of the vote. The majority of america doesnt like this guy. They didnt like him four years ago. If theres a window for a democrat to come up with something crazy, now is the time. Theyre afraid democrats are going to sit the election out. Theyre concerned about this idea republicans are selling that the democrats are radical. It will make voters sit out. Voters stayed home on Hillary Clinton. I know a lot of them. Thats why she lost. I think a lot of never trumpers will vote on anything that walks. You think a never trumper is going to go all the way to the left . Theyre going to vote never trump. Theyll stay home. I dont think so. They understand as someone who has been on fox at 9 00 more than any human being should, i know and klobuchar deserves credit for trying to appeal to that crowd directly. Shes gone on the network. There are people who they need to hear that there is an alternative. Are they going to buy it . Probably not. But they need to hear there are people out there who say i think america can be this. Its not what we have now. Because donald trump is the bunch line. Hes not going to make them into punch lines. And you cant prevent him from calling them antisemitic. They have to say he is bonkers, a liar, a cheat, and were going to beat them, and im going to make sure everyone has health care and people can go to college but why cant you say these things about the president and then offer something more moderate in hopes of getting all the Democratic Party because none of them are going to vote im just saying if this panic wasnt real, youd wouldnt have seen durbin making fun of the green new deal. What is that anyway . Theyre in a panic. They have been wrong plenty of times. Im sure cory booker and senator harris are thrilled theyre suddenly liberals because theyre not. Most of the liberal base doesnt like them. The notion that they have to run afraid of how the republicans frame them is why they keep losing. We paid off to the extent that we got suburban women with College Educations. Thats how a lot of people won. In georgia, the winner won on gun control, a district lost to the democrats after 15 million last year. Gun control is not extreme. But a lot of people think it is in georgia. The idea youre going to take my guns and she still ran and won in a district that had been won by republicans the last year. The democrats i say this all the time. Im not a democrat, but theyre not wrong for once. For once, theyre not wrong in running on their policies. They have run scared for cycle after cycle, and thats why nobody trusts them. American voters would rather follow someone with believes rather than someone who is going to pander to them. Were out of time, but Hillary Clinton got 3 million more votes. Without getting into that whole thing, its not like the whole world stayed home. But they stayed home in three states. I know. I completely understand why im sitting here unemployed.
