T the other major story, Jeff Sessions forced to resign as attorney general now replaced by someone a whole lot more loyal to President Trump who already laid out his plan for the Mueller Investigation. I can see a scenario where Jeff Sessions is replaced and the attorney general doesnt fire bob mueller starve it to death. Were 35 hours out of democrats taking over the house and theyre already talking about new investigations into President Trump. We begin with breaking news. I cant believe im sharing another story of a mass shooting. This time in Southern California. About 20 miles north of l. A. In the Thousand Oaks area. 12 people were killed including a sheriffs sergeant at a local bar. There were ten others hurt. The shooter opened fire about 11 20 p. M. Local time. It was College Night at the borderer line bar and grill. The police have not released the shooters identity. They have confirmed he is now dead. Joe fryer joins us from california. The Ventura County sheriff described it as a horrific scene. What more can you tell us . The sheriff calling this a dynamic and tragic situation. There are a number of colleges within this radius. This was a popular College Night, a wednesday night tradition. A place known for dancing and Country Music. At this time we dont know the identities or ages of the victims who were killed. We know a number of young people were inside the bar when this happened. Witnesses say when the gunman came in many thought they were hearing fireworks then realized it was gunfire. Others saw the suspect start opening fire. They took cover. Some were hiding in attics. Some were hiding in restrooms. One man said he went out the very same door the gunman went in. Take a listen. We just had to get out, get behind a car. We tried to take cover. You heard the bang bang of gunshots. It started going crazy. All i remember was standing there with my friend. I heard the shots. A lot of gunshots. A lot of gunshots. A lot of people were jumping out of windows from what i heard. My buddy broke a window with a stool and just started fishing people out of the window. Now we know the gunman is dead. At this point its unclear exactly how that gunman died. Stephanie. Joe, when i close my eyes and i hear you say people at first thought it was fireworks, i can hear you saying those exact same words to me a little more than a year ago just after the Las Vegas Shooting at that Country Music festival. Its stunning were here again. Tell us what you know about the sergeant who lost his life, ron helus. We can tell you about that sergeant ron helus, he was just in the neighborhood when the 911 calls first came in. He was on the scene within three minutes along with the california Highway Patrol officer. When they got on the scene he heard the gunfire. The sheriff said Sergeant Helus went inside. He was hit with gunfire. That Highway Patrol officer was able to rescue Sergeant Helus and get him out of the building. He was taken to the hospital. We learned later Sergeant Helus did pass away at the hospital. The sheriff got emotional. He knew ron helus well. Take a listen. Ron was a hard working, dedicated sheriffs sergeant. Totally committed. He gave his all. Tonight as i told his wife he died a hero. He went he went in to save lives. To safe other people. He was the one that sacrificed his life to save others. He walked he ran into danger hoping he might be able to save someone elses life. He made the ultimate sacrifice, but he did it as a hero. Sergeant ron helus was a 29year veteran of the sheriffs department. He was planning to retire next year. He leaves behind a wife and son. Were told there will be a procession for him leaving the hospital later today. Thank you, joe. Joining me now to discuss this Jim Cavanaugh and anthony roman. Jim, you are the best business when it comes to covering the subject. I hate it when you come on. Walk us through this. This all unravelled in a matter of minutes. Its an ongoing investigation. What are investigators looking for . Its going to be a massive homicide scene. 13 dead, theyll take their time to process it all. The shooter is dead. Theyll go back and see if he had any accomplices or his motive. The reason for that is not only for the victims and the families, but to see if you can stop the next one. This one is over if he acted alone, but can you stop the next one . As a uniform cop ive been to bar shootings. It happens. Its a wild scene. This sergeant is a hero. He went in first. The trooper, as well. We call the doorway we call it the fatal funnel. When you come in, the shooter is inside. He knows youre coming in. He had a 45 glock automatic pistol. He unloads that and you can carry 10, 14 rounds in a pistol like that. You can unload on the sergeant and if he has a vest on, but he gets hit in the head or arm or in the lower extremities, a 45 you bleed out pretty fast. Roman, i have never been to a bar shooting. Ive been to a bar in the last 20 years. I would never think of it as a soft target. Alas, it is. People that places are going to to eat and drink and dance and theyre soft targets. What do we do to prepare . In the united states, most enterprises including clubs, places of businesses, office buildings, are ill prepared to deal with shootings. The Police Departments have done a marvelous job at updates tactics to get to the shooter within a minute or two upon their arrival. Any officer on the scene will go through the doors right away and try to suppress the shooter. However, we are not preventing it on the commercial side. There are magnotometers that are discrete that allow people to go through at entrances. It doesnt allow for any lines whatsoever. We are simply not using this technology at this time. In addition to that, security guards are poorly paid and as a full disclaimer, we dont deal with security at all. Risk assessment is what we do. No one is being trained in human factors. No one is being trained in preventi prevention. No one is being trained in response on the commercial side. We have to stop that shooter before he gets in. We have to stop the bomber before they enter the premises. Multiple layers of detection, human factor analysis, security cameras and properly Trained Personnel will help with that. We have an abundance of combat trained and experienced, retired veterans from multiple campaigns in afghanistan and iraq who would be perfectly suitable to this. Jim, walk me through this, officers say they only found a handgun on the scene. An eye witness said the first shots were fired at a person running the front desk. When we hear these, its usually more serious of a weapon than a handgun. Does it surprise you that a handgun could do this much damage . The shooter at Virginia Tech killed 32 people and he had handguns. Handguns are extremely deadly at close range. Theyre deadly in the hands of a trained shooter. Theyre deadly in a crowded bar. Theyre extremely deadly if you have a round like a 45 which is a large caliber round that has a lot of knockdown power and makes a large wound. He has the shooter has everything on his side. Like anthony said he walks right in. You can have somebody manning a metal detector i have had cases at a courthouse where a shooter shoots the man at the metal detector and walks right there. You have to have that, but you need more security as well. You need better gun laws and better Mental Health. Lets see who this guy is and lets use whatever we find to stop the next killer. Shes hospitalized with broken ribs. Were told she fell in her office at the Supreme Court last night. She went home. Felt okay. After experiencing discomfort overnight she decided to check into the hospital. She did so early this morning. Were told the tests showed that she fractured three ribs on her left side. So shes been admitted for observe vacation and treatment. The court is in session today. Normally theyre not in session on thursdays. Today is the formal welcoming ceremony for the newest Justice Brett kavanaugh. The new acting attorney general Matt Whitaker will be there as well. Justice ginsburg wont be there with the other members of the court. When somebody breaks ribs, there isnt much you can do. They dont put you in a cast or anything like that. Jeff sessions out, out of the Justice Department. He wasnt exactly fired, but he resigned at the president s request. The man who will take over is Matt Whitaker. Whitaker not only replaces sessions as the head of the Justice Department, but he also replaces Rod Rosenstein as the man to oversee the Mueller Investigation. Rosenstein was only in charge because sessions recused himself from the investigation. The president never forgave him for that and punished him by privately and publicly criticizing the attorney general. I wanted to stay uninvolved, but when everybody sees whats going on in the Justice Department i always put justice with quotes. Its a very sad day. Jeff sessions recused himself which he shouldnt have done. He took the job and said hes recusing myself. I have said what kind of man was this. Withhat kind after man is th . What if it was a woman . Pete Williams Joins us. He could have fired Jeff Sessions at any time. He didnt fire him. He forced him to resign. Walk me through the significance. The main significance is the president from all indications wanted to do this earlier, but was told by people in the senate and by his own advisers that that would be a bad thing to do for the midterm elections. They waited until after the midterms, but not after. Certainly no. No. I think attorney general sessions expected this would happen at some point. He was aware he was nearing the end of his time. It reached the point that he an the president were incompatible. The president wanted him out. Theres no question that Jeff Sessions expected this and was prepared for it. He didnt expect it to happen this fast. The letter of resignation that was sent to the white house didnt even have a date on it which made us first suspect that maybe the letter had been written and was sitting around waiting to be used. Im told from the personal w wh handled the letter is it happened so fast they forgot to put the date on it. Why would Jeff Sessions voluntarily resign . Why not force the president s hand and make him fire him . A couple reasons. The first one is that this preserves a little bit of dignity for the attorney general. Hes allowed to resign. Really . It may be on the margins. Its one thing to be fired and its another to say i was fired. Ill go potato potato on that one. Fair enough. The second reason is this, this maybe a surprise, strange as it may seem Jeff Sessions remains loyal to the president and certainly to the president s agen agenda. Of all the cabinet members, i think you could argue he has been the most loyal soldier. He has never, including this week, never given a speech or said anything in public where he did not praise the president. He has remained loyal to the president and the president s agenda. I think thats one of the reasons why were hearing that he is considering going back to alabama and running for his old senate seat. Then i guess thats where i separate the two. The difference between the president s personal agenda and legislative agenda. While session may stand with the legislative agenda, the personal agenda has been to get sessions out for months. He wanted whitaker in. Who is whitaker . Hes the former attorney general of iowa under the george bush administration. He campaigned himself for the senate in iowa. Wasnt elected. For the past year he has been the chief of staff to Jeff Sessions. Theres no conflict of interest for him to take this position given hes clearly on television voicing his views on the Mueller Investigation and how we would handle it if he were in the position . Thats something the ethics people are looking at right now. Remember, Jeff Sessions recused himself from overseeing the russia investigation because he campaigned for the president. Now, thats explicitly one of the reasons why in the Justice Department regulations a person has to recuse. If you campaign for someone who is under investigation. Whether there more broad lisa conflict of interest, thats another thing. The Ethics Commission is looking at whether public statements while youre not in office there he is up there with sam clovis. Well, thats a separate question. Im not sure that presents a conflict. As to what your fist question about his public statements, the ethics people are looking at whether that would require him to recuse. That would be an unusual thing if the president appointed him thinking he was more loyal and it turns out he has to recuse himself. Democrats on the hill are saying its a conflict and he should rekur recuse. One other point has to be made. Rod rosenstein appointed Robert Mueller. He wrote the road map for the investigation. Hes been following it day to day. Matt whitaker because hes been working for the attorney general, the attorney general is recused, the attorney generals staff is recused. Its going to be a speed bump for Robert Mueller because he has to bring whitaker up to speed on wehere the investigatin stands. Its going to be a period of adjustment for the special counsel too. Pete, thank you. I have to bring in kristen welker. What is the white house telling you . The white house is saying this shouldnt be a surprise to anyone. President trump was infuriated about the fact that former attorney general recused himself in the russian investigation. One of his earliest tweets about this called Jeff Sessions be leaguered. Its been a slow decline for Jeff Sessions. The fact that this happened so soon after the midterms, steph, the very next day, the fact it happened less than an hour after we cleared that feisty press conference yesterday when the president was asked directly if he planned to fire Jeff Sessions, he dodged those questions. Its just remarkable. Think about the politics of this and the fact that President Trump and the republicans just lost the house of representatives. Democrats are going to control the house. More importantly as it relates to the president hes going to have oversight from the other party for the first time and already of course bracing for what will be a blizzard of investigations and subpoenas. President trump was asked about the other piece of this, the Mueller Investigation. Is he trying to shut it all down . Take a listen. Going back to the rush investigation and the investigations from the democratic majority in congress. Some say you could stop all this. I could. I could fire everybody right now. I dont want to stop it. Its a disgrace. It should have never been started because there was no crime. Stephanie, notable to hear the president say again that he has the power to stop it he thinks if he wanted to, but politically he has no intention of doing it. He could speed it along if he sat for an inperson interview with Robert Mueller. No indication theres any urgency for that to happen. As always in these events theres multiple investigations happening. One will be to see what this individual is like on social media. There will be roll back investigations as to where he lives attempting to get evidence from friends. The lack of motive in these things is always problematic. Theyll try to ascertain what was the motive. Was this a domestic terror event . Was it foreign influence . Was there a grudge . Was he going after an individual in the bar . We dont know. Its not being called terrorism. Theyre trying to gather information. A bar, as surprising as it is to me, is known as a soft target. Is there a better way to prepare for these situations . When somebody opens a bar, theyre not focussed on how to bullet proof. You cant bullet proof. Thats the reality there 330 million of us in america and even though theres a frequency of these attacks, the reality is its not never going to impact on us other than the emotion aspect. You cant bullet proof every location in america. Do you worry that things like this support the arguments if only there was a good guy with a gun . When you go to a college bar, college kids dont carry guns. We dont want them to. If i understand correctly, the individual threw several smoke devices in the room. They thought it was fireworks. Somebody else with a gun, it just complicates situation. The issue also in terms of going forward, its the training, if you will, for each of us walking into a place, no matter a restaurant or theaters, the first thing i do is look for the exits. Is it not a conflict of interest for Matt Whitaker to take this job after he very publicly said how he feels about the investigation and if he were in sessions job he would choke out the budget so it wouldnt exist anymore . Its worse than that even because he is also somebody who was the Campaign Chair of a person in iowa who is now a witness before the grand jury in this investigation, sam clovis. Look, the Justice Department has a process for this sort of thing. The ethics lawyers at the department advise senior officials when theres a question about whether they should recuse. That is of course exactly what happened with Jeff Sessions and sessions followed the advice of those lawyers and thats why the president hates him and removed him and replaced him with this guy. The question now is whether mr. Whitaker will behave in a similarly appropriate fashion. Eli, you covered this white house and this president for quite sometime. We would be foolish to think that the president didnt check that box beforehand. You dont think Matthew Whitaker said if we hear this from the ethics lawyers im still your boy . Its in conceivable he would have got this appointment without checking that box giving the fact that thats why Jeff Sessions recused himself. When sessions wanted to stay on a few extra days and the president said no and had john kelly call him and say youre out, were doing this today, this is something the president has wanted to do for a long time. Whatever the optics of this are, whatever the legal ramifications are, the president doesnt really care. The president is worried at the end of the day he views this entire investigation as a threat to his presidency and hes going to do what he believes he needs to do to protect himself. Hes tried to sort of disparage the investigation. Hes going to fight this battle as well in the court of public opinion. The president is right, it is a threat to his presidency. Doesnt mean it shouldnt go on. Peter, i want to play part of what new acting attorney general whitaker said about the investigation on cnn last year. I could see a scenario where Jeff Sessions is replaced with a recess apartment and that attorney general doesnt fire bob mueller, but he reduces his budget solo th budget so low that the investigation grinds to a halt. Its one of the reasons he should recuse himself. He isnt going to. Thats the reason he was a po appointed. My impression is this will be the latest link in an obstruction of justice chain. Its going to be the second act of the trump administration. Wheres the rest of the Republican Party that has nothing to do with this investigation and has nothing to do with this bad behavior. Theres a lot of people to choose from rather than a guy you know that doesnt support the investigation. This is the correction of the Republican Party. They ought to know better and ought to stand up to it. They wont. Mitt romney sent a tweet out yesterday that was encouraging. This is what happens, people and institutions and Political Parties that get in the orbit of donald trump are ultimately corrupted by him. Whats happening is a disgrace. Its not going to change any time soon. Theyre more trump after the election than ever been. It clearly says bob mueller is authorized to investigation russia ties. Now that whitaker is in charge can he change the interpretation . When you have a figure like Matt Whitaker hes going to do whatever he wants to do. Its not as if hes a legal figure who is putting forth that hes going to follow strictly the rule of law and abide by the law. I think that this is just boundless how badly this could go given that hes made very clear that he is a political hack to donald trump. That is his sole qualification for assuming this position. Mark, bob mueller knew this was coming. This is not a surprise. Not a surprise at all. Saturday night is the day after tomorrow. If i were him, i would get an envelope to nancy pelosi and the incoming house judiciary committee. They may pull the rug from under him come saturday night. Whitaker is i agree with peter. Were looking at further obstruction. If youre under investigation for firing the fbi director, how does it help you to fire the attorney general. For someone like whitaker to agree to participate in that, almost agree to be involved in the commission of a crime, he must have John Mitchell aspirations. Ben, heres a question, why in gods name is any of this allowed . The president isnt a king. Its allowed because people tolerate it for all of the reasons that everybody on this theres no check and balance here. I remember when Jeff Sessions went through a confirmation process. This guy doesnt have to go through any of that . President trump gets to lets bring my home boy in. There is eventually going to be a confirmation process for the permanent attorney general which may or may not be this individual. In the end if the political system tolerates this behavior from the president thats what they will get or we will get. The good news is that one branch of congress two months from now is in the hands of Opposition Party and the members the incoming chairman of the relevant committees of that party have made clear that they take this matter extremely seriously. Maybe that provides a sort of little bit of check. Basically the president s got a lot of power here. He is actively abusing it. You know, the question is are we as a political culture going to tolerate that. Eli, americans have power too. They voted tuesday. Were seeing democrats challenging the president over firing sessions. If this is what democrats are being forced to do day one is there any hope of by paipartisap in terms of policy . Im thinking infrastructure, health care, education, things that matter to america, not the president personally. The prospects for that are pretty dim. You heard the likely speaker of the house nancy pelosi coming in and saying she wants to work with the president where they can. The president himself began his press conference yesterday saying the same thing. Both of them laid down markers here. The president threatening the democrats saying if you investigate me, im going to come after you just as hard. His behavior is going to force the democrats who are also trying to balance, you know, what they look like, how oppositi oppositi oppositional to be, not wanting to overreach. It seems the president will force the democrats hands and that will really define the next two years and the president ial election in 2020. I want to talk about the midterms. In the state of arizona its still a dead heat. In florida the governors race remains too close to call. Democrats around the country are celebrating big time even if the president is trying to distract them. Ours went down. The democrats in the house have to decide how much president harassment they think is good strategy. Im not sure it will work for them. You can look at it that way or the way that Mitch Mcconnell blocked president obama in every way he could and that seemed to work out for Mitch Mcconnell. How do you straddle holding the president accountable and getting to the legislative agenda that the people who voted for you care about . I find it interesting that Mitch Mcconnell used the words president ial harassment. The desire of democrats is to get to the truth period. That takes a look at whats going on. It takes a Mueller Investigation that can move forward unimpeded. Stephanie, there are such things as parallel tracks and well be able to do that. Its chewing gum and walking at the same time. Weve got very able gentlemen who will be the leaders, the new chairman of the house over site of judiciary, of intelligence committee. Theyre capable, charlottesvism reasonable. I have complete faith theyll do a great job and wont engage in overreach. At the same time we have to make sure were focussed relentlessly of bringing down the coast of health care and Prescription Drug prices and working on roads and bridges and americans. And then lastly, while i am standing in this beautiful capital right now, its beautiful here, but when you get outside and on the ground, weve got some self dealing that is going on. We have this money in politics that has just corrupt the system and we need to address that as well. Walk us through, can you, the work with republicans to get to these things, to help the people in your district. Because President Trump likes to say if i move forward with the middleclass tax cut, the democrats could block t what he hasnt done is explain to anyone how he would pay for said tax cut and what he would cut in order to do so. Absolutely, we can work with republicans. And that is the shout out in the center part of this nation. People in my district sent me back out here, even though donald trump won my congressional district. I ended up winning by 24 points in a trump district. Thats people, in my opinion, telling me go out to washington. Work with your colleagues across the river and get the nations work done. We can do that. There are many decent republicans, just as there are many, many decent democrats. We can work together, get the job done. We have to count on Mitch Mcconnell behaving a little bit better than making the kind of statements that he just did about democrats. You have run a very, very local race. You spent an awful lot of time speaking in Grocery Stores to every person in your district to try to help them live a better life and stay in touch. Right now, nancy pelosi, we heard her speak yesterday. She would like to be the leader of your party. Will you support her . Well, right now, nancy pelosi is the only person running for speaker. And im a person in the middle of the district that or middle of the country that doesnt always support all of the legislation that she supports, but she has accomplished the Affordable Care act, stephanie, never would have happened, never would have happened without her help. And while the rollout of that was widely maligned, it didnt go very well, the end result of the republicans trying to undo this is that we had 23 million additionally insured americans. She is smart. She is good to people. She keeps her composure, no matter what is coming her way. I guess thats a long way of saying i like nancy pelosi. I think shes been a remarkable speaker of the house and these election votes are on november 28th and well see what happens. How about you . Youre pretty remarkable. There may be various other people getting in these races but at the end i hope i can be part of a very good and strong Leadership Team. We have remarkable people running for these leadership positions. I was out and about, we heard people saying we need a new generation of leader. What we can see now is that there is a new generation of leader candidate running in these various roles and on november 28th well see what our caucus decides, who will be our speaker, our leader, our whip, our caucus chair, and all those positions. Im confident well have a very good Leadership Team that can usher in legislation and policy that matters to people all over this country. Congresswoman, congrats again. Thanks for joining us. She lost her son to gun violence and has been a gun violence advocate. When you look at women like lucy, taking positions in our government, do you think thats going to change the way our lawmakers are governing what their perspective is, especially when it relates to gun control when we know nothing has happened . Especially after what weve seen happen overnight. I think it will. I think she will serve as an inspiration. Thats its own sort of justice. Her son, jordan davis killer was incarcerated. This is the second form of justice for her to win, in disclosure im very happy for lucy. On my radio show, which is not a music show, i played loud music on my show every friday in memory of jordan. Ive been doing this since he died. When she announced she would run, we did all we could to support her. This is very, very good news. Its not only an inspiration to women candidates. This was as much a pink wave as a blue wave, if you will, women candidates but an inspiration to those who have been victims of gun violence. Im very happy about this victory. How are democrats going to find a balance here with the president clearly, day one, doing that ridiculous press conference, firing Jeff Sessions, putting someone who, in my opinion, is clearly conflicted, in that position. How do democrats figure out which lane to take here . Americans voted for Better Health care, better education, two days ago. Its not going to be easy. The reason its not going to be easy is because donald trump is president and he has no interest in the policy side or working with the democrats. This is a president who has a depp investment in dividing the country. Weve never had that before. Weve had polarizing president s before, but we never had one who relishes the divisions and the acrimony. He didnt need to work with democrats over the last two years. Immigration, he could have gotten something done on daca, but republicans wouldnt support him. Middle class tax cut, republicans are going to make it hard. He can point his finger at democrats. He has a republican issue. He does, but he doesnt really fundamentally care about governing. Thats not what hes about. Hes about theatrics. Hes about conflict. Democrats, if they want to work with him, theyre really not going to be able to. We are entering a period of our politics, unfortunately i say this with a lot of regret which is going toi be more malicious, more thuggish, because donald trump wants it that way. That is his dna. Democrats wont be able to avoid it. They have an institutional responsibility to hold him accountable. Between the Mueller Report and the investigations that they have to do, that is going to make the landscape very, very difficult one. Elise, what does that mean to the American People . While we can talk about the president and his thuggish behavior, he has been successful at convincing Many Americans not to trust the media or that the Mueller Investigation is a witch hunt. If democrats focus on checks and balance and reigning in the president and we do remain in legislative gridlock, couldnt that hurt democrats two years from now when americans say we voted for you, we didnt get enough stuff . It will further the political segregation we saw play out in the way results surfaced from this past election where you would have pockets that fully rejected donald trump but other pockets that fully supported him. And i think that the recipe for stagnation is brewing already. And americans are so frustrated that their government isnt able to deliver and has gotten to be so huge and unwielding. That will further that because both sides wont come together to implement policy solutions that help americans. President trump didnt fire sessions before the mid dms terms because he thought it would hurt him. Could it hurt him now with republicans that he has done it yesterday . No. This is an odd thing that happened. The Republican Party, after the elections, is a weaker party than it was. And donald trump has a stronger grip on the party than he did before. It is, as i said before, a more trumpified party. And they are going to stick with him, come hell or high water. I think there will ultimately be a cost to that, but theyve thrown their hat over that wall, and they did it a long time ago. If you chart the arc of the trump presidency, you can see month by month originally there was some resistance, at least rhetorical resistance to donald trump. Take lindsey graham. He said if sessions was going to be fired, that would be a catastrophe for the trump presidency. What is he doing now . He said, in his words, there would be hell to pay. Obviously thats not going to happen. This is a constitutional crisis. You cannot fire the attorney general and appoint, as you said, your boy, to be attorney general. There will be hell to pay.
