Peter, if the president really wants to do it, he could just say yes. I mean, his legal take is working for him. So whats going on here . Yes, chris, you make a very good point. There would be one easy way for Rudy Giuliani and, frankly, President Trump, to wrap this thing up sooner. Giuliani saying he wants it to end within the next three weeks, by september 1st. He doesnt want it to interfere with the november elections. They would sit down with robert mueller. The president certainly could do that if he so chose. But instead what weve sort of witnessed is what appears to be a very sort of public stalling game, a Public Mudslinging Effort by Rudy Giuliani. And the president s legal team. Broadly, they are able to monopolize the air waves right now because Robert Mueller, the Special Counselor, his team, they are not speaking publicly. Instead weve heard from giuliani as a variety of occasions as you noted over the last several months doing whats sort of a delicate dance. Publicly negotiating, more often commentating. Describing in multiple occasions this investigation is illegitimate. Saying theres a lot of Bad Information about Robert Mueller here that hasnt gotten out yet without giving any specific details about it, effectively saying its going to blow up in Robert Muellers face. A lot of this appears to be an effort to really rile up some of the president s base of supporters here. In effect, inoculate him against whatever the ultimate findings are in this situation. But hes also said what appears witch hunt. His sense of let me stop you because it raises an interesting question. If the president really does believe, and i think most folks do buy into this, he believes he can convince anybody of anything. Its why, right, he went to sit down with leaders of authoritarian countries. Because he thought he could change the equation just by a facetoface meeting. Are his lawyers worried . Are the people around him who dont want him to talk to mueller worried that in a split moment, he can agree to something just because that part of his personality becomes dominant . Yes, the dominant part of his personality that worried his attorneys the most is his ability or his tendency to really stretch the truth. This is a person who has great connecti economic data, who has to go further and say its the best and record setting economic d a data. A guy who sold his building by saying it was ten stories higher than it was. When they talk about perjury traps, you dont get trapped into perjury. Thats rhetoric meant for the public to believe the idea that somehow theyre trying to trick donald trump. No one has to trick or dupe this president when it comes to getting him to stretch the truth. To go beyond the truth. The difference here is that the stakes for the president , for his family, for his associates, the legal stakes, are much higher than anywhere else. I think even though the president may have this belief in his ability to go and set things straight in person, his attorneys and the people around him are really concerned about him doing that. Let me go back to the Special Counsel and play part of what Rudy Giuliani had to say on fox news. Take a listen. He knows the answers to every question that he wants to ask. Hes going to ask them, did you teleco tell comey to go easy . No, he didnt. He wanted to get him under oath to trap him into perjury. Were not going to let you do that. What does Robert Mueller want from President Trump . Well, in this case, bob mueller wants to know what exactly President Trump was thinking when he said these things. I dont think theres any dispute about at least the thrust of what was said. Weve heard from jim comey under oath. Before congress. And mueller has heard the same thing presumably from comey and his team about what exactly President Trump said. What bob mueller and his team want to know is what exactly was going through trumps head. Was there some sort of criminal intent when he said these things to jim comey about michael flynn, when he was interacting with others that are central to this Obstruction Investigation . Unless there is a smoking gun email that is written by President Trump that seems to convey his deepest innermost thoughts, that says when i told jim comey to let this flynn thing go, i was trying to obstruct justice. I dont think the muller team is going to be satisfied because thats precisely what theyre looking for. They need to go beyond exactly what was said to determine exactly what he was thinking. So a. B. , let me go back to this whole idea of President Trump and what he wants and whats likely to happen here. This whole idea that he simply has to get somebody in a room and he can convince them of anything, where does that take him in terms of the Robert Mueller investigation . Well, i think what eli was laying out is theres two things. That is true that he does believe, as you said, if its kim jongun or Vladimir Putin. If he gets somebody alone, hes going to get his way, hes going to convince them of his truth. The other thing is, not only does he lie a lot, sometimes he tells the truth. Like to your own lester holt of nbc news when he said i was thinking about this russia thing, i was going to fire him anyway. His lawyers are afraid not only he might lie under oath, but that he might just give away the store. The bigger danger is he he makes up his own facts whenever he wants. But i do think the point that a. B. Makes is the most important one. Trump went on national tv, on nbc news, and basically to a lot of people admitted obstruction of justice. That he had the Mueller Probe in mind when he fired the director of the fbi. My view has always been that trumps lawyers will never, ever let him sit down with Robert Mueller and testify, no matter what he wants. He may want one day to clear his name and have this interview, the next day feel nervous about it and think hes going to trip himself up. But i never believe they would allow him to sit down with mueller and potentially contradict himself, perjure himself, go off on some tangent. Theres way too much risk involved. They are delaying. They do want to get it closer to the midterm elections at which point he couldnt issue a subpoena because theyll be in this quiet period. I think they want to take it as close to november, not get a Subpoena Fight until after the midterms, and then e think you would actually have a Subpoena Fight which is a huge legal battle. Mueller has three choices, he can keep negotiations, he can issue a subpoena. Thats exactly right. On the part of Rudy Giuliani, this is classic rudy. In the sense hes saying one thing and doing another thing entirely. He and his team have been saying for months now, some nine months, they want to wrap this thing up. Remember, this was supposed to be concluded by christmas, christmas of 2017, christmas of last year. Were now in august. But i think theyve actually reached the point where theyve develop add new strategy and their strategy now is to say they want to get this wrapped up. Say they want to get this over with. But actually to extend it. To make it longer. Because they have found that its actually a winning issue with trumps base. They can portray this thing as a witch hunt. They can galvanize trumps most ardent supporters and actually use this to bring them out, to energize them, to make them thing, to dupe them into thinking that the government, that some sort of deep state kabal some deep state can save the president . They think its one. This is one they actually want to see continue through the fall. So that they can use this. And i do agree i think the most likely Subpoena Option is likely to come after the midterms, not before. I dont think that the special Prosecutors Office would risk that cataclysmic showdown in the midst of election season, knowing precisely what jim comey did and precisely how he has been raked over the coals ever since. There was another point last night that was interesting. Giuliani appeared to a lot of folks to be threatening Robert Mueller. The real story here is not that this case isnt going to fizzle. Its going to blow up on them. The real question is what we talked about before, theres a lot more to what they did that nobody knows about yet. And mueller is going to have a lot to answer for. What do you make of that . Its the typical projection that you hear from the president and the people around him all the time. You know, and its very vague. Youll find out the terrible things they did. I mean, if they had terrible things to say or allegations against the Special Counsel, they would just say them right now. This is all sort of, again, for public consumption and trying to bias the public to say to believe that the probe is somehow out to get the president and, again, as peter said, the Special Counsels Office Doesnt Comment on this stuff publicly so you have rudy and jay sekulow basically filling the airways and trying to respond in a political way to this legal matter and thats been their strategy. One of the things they brought up was how many times you met with Special Counsel before you started testifying. He said 20 times. Its kind of hard to believe. If he met with him 20 times, its clear why he couldnt just say yes, i lied to the fbi. That was a thing he bleeded guilty to months ago. Its unclear why he seemed kind of shaky. Then yesterday they both up this bombshell, saying did you have up to four affairs and did you talk to the Special Counsel . Before he could answer, he was then cut off, through an objection. We didnt get to hear the answer to that. Rick gates is now off the stand. Were moving into more of documen documentheavy part of the case. Well hear from more Tax Preparers and accountants we believe. We mentioned the irs agent. There was also an fbi Forensic Accountant. What was this back and forth about, about a manafort signature . Thats right. So part of the Paper Trail Argument is that manaforts lawyers were able to bring up two pieces to this Forensic Accountant had gone through, which proved the accounts had been signed by manafort. But he brought up two signatures that did look different. He even brought up third and fourth signatures. She kept saying, im not a handwriting expert, so how could i really know what whether or not this is a different person. I can sign my signature different from day to day. That was one thing they used not just to undermine gates but to undermine the paper trail, which is at the heart of the prosecutions argument. They have emails from innates ceo to collins, essentially saying their loan product what they expected to make millions and tens of millions of dollars on had failed. And then the prosecution after that then has phone calls that collins made to his son and and that video, i mean, its at the white house and theres a video and the timing there it is. Pretty much exactly when they say that those phone calls were happening, right . Yes, its pretty stunning this guy i mean, this is pretty clear cut insider trading case. He had material nonpublic information. He gave it to his son who then used that information to make a trade that he otherwise wouldnt have probably wouldnt have made. So when he says the charges are meritless, thats just not like my reading of the indictment and i think the government would say the same thing. I think for a lot of people, anecdotically, theyre, like, how is it possible members of congress could serve on a board anyway . Does this raise larger questions about exactly some of the outside stuff members of congress do . Yes, so, i mean, its interesting, in the press conference, he says he sort of touts himself as saying, you know, i didnt take any compensation to serve on this board. What he doesnt mention is the stock act requires members of congress if they do serve on corporate boards, theyre not compensated. Hes essentially saying he should get credit for following the ethics rules and then the stock act too. He kind of does the same thing where he says, well, you know, i didnt trade on the inside information i had. Then he also says he was legally prevented by australian law from trading because there was a trading halt because of the announcement of the drug trial coming out. Whats his defense . Hes going to continue to run. Hes not stepping away obviously. Thinks he can get reelected. He is in a district where hes been leading democrats by a significant margin. Is this just a situation where he figures he cant be touched, at least in the political realm . I mean, i assume so. The guy was under investigation by, you know, the office of congressional ethics. When he make s the phone call from the white house, giving his son the Insider Information. He seems to think hes untouchable. The problem for voters in Western New York is if they reelect him and if hes convicted of these charges, hes not going to be able to perform these duties as a member of congress. Theyre going to be unrepresented if that happens. If hes really going to fight it and not eventually plead out, think the odds of the government winning this case are pretty substantial. Justin glawe, thank you. It turns out Michael Cohen might not have been the only Insider Taping Conversations with President Trump. Multiple people tell the daily beast that former president ial aide omarosa rolled on some of the conversations with the president and used them to shop around her soon to be released book unhinged. Yet another dramatic betrayal by a onetime confidant. The president of course suggesting without proof he was actually the one taped by barack obama and james comey. Daily beast reporter Locklin Markay joins us. What do your sources tell you about these supposed recordings . We spoke to three sources, one of whom heard these recordings and two of them had the contents described to them. They all described them as probably not as Increme Nating as the recordings that Michael Cohen made of the president , but i think it does point to a major breakdown in trust between the president and someone who was very close to him for well over a decade, through his career and reality tv and into the white house, who really tells anyone who will listen how much the president trusts her and now has decided to cash in, break with the president in a big way and obviously recording him without his knowledge would be an extremely significant breach of that trust. We dont want to project what might be on these tapes or how many they are, but would it be fair to say that what your sources heard may not or probably are not all the tapes that exist, and if she used them to shop the book, theres something on there. Im not saying thats criminal, but at least its going to sell books. I think its certainly possible that there are more recordings. We reached out to simon and schuster, the publisher of her forthcoming book, who essentially said they wouldnt confirm or deny she recorded these conversations but they said were confident that there is documentation or enough evidence to back up every claim that omarosa is making in this book. Obviously, they want to avoid a situation that resulted from, say, michael wolfs fire and fury book, where there was a lot of disputed information. That suggested to me at least there could be Additional Information in there that is backed up by recordings and if and when the white house attempts to challenge potentially some of the more damaging information in this book, that could be an occasion where they come forward with documentation or even a recording to show what they say is accurate. Does this bring to mind the old phrase with friends like this, who needs enemies . No, i think it brings to mind the phrase if you mess with the bull, you get the horns. Because President Trump knew exactly what he was getting by making omarosa a west wing adviser. She has a reputation of using any means to put herself first. She stabs in the back. She stabs in the front. And its not a problem. Its really sport. So i dont know what the tapes are going to reveal, but the fact is, he gave her this privilege and access and he knows her, he knew her reputation not only Behind Closed Doors but i guess on The Apprentice where this was her character. Im not at all surprised apparently she used to play it well, right . I mean, if the tapes exist, and it sounds like these tapes exist, i mean what does it say about life inside the west wing . Has everybody got to be looking over their shoulder . Because who knows whats on tape. Of course they do. We all know this is incredibly back fighting, infighting white house in which everybody is leaking about Everybody Else and out for their own agenda. A. B. s exactly right. What did you expect when you hired omarosa for the white house . Im thinking about this if you told me id be on television talking about Omarosa Taping President Trump in the white house, i would have laughed at you. I would never have believed wed be talking about this. But of course you hire her. Of course shes in it for herself. In it to make some money down the road. One way to do that is have tapes. Who knows what President Trump says on these tapes. Probably nothing terribly embarrassing. This is a white house filled with people who are constantly looking under their shoulders. Constantly worried about whos looking. It comes as no surprise that omarosa taped the president. An excerpt from her yet to be released book. This is what omarosa writes. Very lowkey, ivanka trump went around to the original trumpers, the loyal soldiers, and asked the team to compile a list of suspected leakers. Id already said my piece about katie walsh directly to donald and shed been let go. But ivanka wanted a new list and once she had it, she would give it to scarmucci so he could fire them all. The final list that was texted to me on july 22nd had ten names on it. So now we have a hit list, right . Yes. There were some names that a lot of viewers will know on there. Folks like raj shah, the deputy press secretary. Michael short who was a press aide who came in with sort of the rnc crew in the early days. Was donald trump on the list of leakers . He is not. I dont Think Scarmucci was going to march into the oval and try to fire him. It does go to the issue of sort of trust and a lot of this back fighting ben was talking about from the very early days of the white house and i think it speaks to why someone would end up taping conversations with the president. Theres just this immense lack of trust between colleagues in the white house up to and including the president. Its very hard to form a coherent policy agenda or a coherent messaging strategy when you dont trust the person sitting next to you and youre constantly looking, worried the next person is going to be leaking organize accusing you of leaking. That was a common way of undercutting rivals in the white house. So, you know, i think it speaks to the sort of larger dysfunction that americans see on a day to day basis. The Trump Administration is hitting russia with new sanctions for its involvement in the march poisoning of exspy Sergei Scrikripal and his daugh in britain. Pompeo signeded off on a determination acknowledging that russia violated International Law and by u. S. Law the administration has no choice but to act. The penalties will take effect in less than two weeks. Cutting off exports of some Sensitive National security equipment to russia which could cost the country hundreds of million also of dollars. And a second wave could ground russias National Airline from entering the u. S. Meanwhile, a cording to reuters, moscow is starting to work on retaliatory measures against new u. S. Sanctions. Russia continues to deny any involvement in the uk poisoni s poisonings. Joining me is ambassador chris hill. Also a professor of practice in diplomacy for the university of denver, one of the most beautiful parts of the country. Good to see you, ambassador. So these new sanctions are required. 1991 Chemical Weapons Law says thats what they have to do. But is this an administration, as you see it, really taking a hard line against russia in spite of what we heard from the president and if not, in any case, whats the real impact here . Well, first of all, obviously this administration has done quite the opposite with respect to russia and the president is constantly pleading for the idea that he can work with Vladimir Putin and otherwise sort of, you know, make the world a better place. But clearly thats not working. And i think the facts that the helsinki summit went as it did. The president and his administration had absolutely no choice but to follow up on these. Frankly, these are congressional these are mandated sanctions. There are some who say there is wiggle room here. He had absolutely no choice. But to go along with these sanctions. The former ambassador to Russia Mcfall said, quote, yet again, these new rounds of sanctions underscore that the Trump Administration has one policy toward russia, while trump himself has his own personal policy. Do you agree with that . Yes. Oh, absolutely. Look at north korea. You have Secretary Pompeo with a policy. You have a National Security adviser, bolton with a policy. You have the president who is still a third policy. So basically i think the history of this Trump Administration is to have, you know, four or five, six different policies merrily existing alongside each other where theres frankly no connectivity at all. Especially appalling to see his own National Security adviser whose offices are just a few feet away from each other and they cant coordinate. You also had a situation, ambassador, where these penalties werent even put in place until we saw the chairman of the House Foreign Affairs committee, ed royce, saying, hey, we got to do this, were required to do this. Yes, you got it. Those sanctions required a twomonth time period. And the administration was already into over time. Closing in on about three months and finally ed royce said something about it. I think it speaks to the fact that the Republican Party itself is very split on this. Most rank and file members are appalled by this russia relationship. Again this president either because he doesnt understand it, doesnt listen, doesnt understand anything, frankly, goes ahead with the idea that somehow putin is our best friend, which hes not. By the way, i would like to see some effort, some substantive effort from the president to work with russia, whether its north korea, whether its syria. But theres none of that. Its simply a promise that somehow he can have a better relationship with russia and, frankly, he has zero to show for it. Then you have this new interesting twist, which is senator rand paul. Hes been in russia during the senate recess. He put out a statement saying he was proud to be delivering a letter from trump to putin, which might lead somebody to believe hes like this emissary. But then the White House Deputy press secretary puts out a statement saying at senator pauls request, President Trump provided a letter of introduction. In the letter, the president mentioned topics of interest that senator paul wanted to discuss with putin. What do you make of that . Yes, it does sound like its rand pauls request. And we have to keep in mind that hes been an outlier on things like sanctions and policy to russia. Hes probably closer to the president then to the rest of the Republican Party. But it really was odd for him to bring a letter of introduction. Believe me, the russians know who rand paul is. And i dont think they needed that. So what he was trying is hard to say. Does he think hes got a future job in the administration . You get that impression sometimes when people do these sorts of things. I think its part and parcel about how senator rand paul conducts himself. Ambassador chris hill, always great to talk to you, thank you. Thank you.
