Now h arrest was disclosed barely an hour after the online website the intercept published a story based on the nsa document that the government says she leaked. The document talks in more detail about the broad outlines of what we had known previously about russian efforts to get into local election systems on registration. Youll see the little black bars there on the document, things that were redacted. What the intercept says and the government says the same thing, that the intercept once it got the document, called the nsa and says, hey weve got this. Were going to publish it. What do you think. The nsa asked certain things be redacted and thats why theyre crossed out. That in part set off alarm bells at the nsa. They tried to figure out where this thing came from. They figured out that it had been printed out, they looked then at the systems and determined that only six people had ever printed it and that one of them they determined had been an email contact with the intercept. The government says, stephanie, that miss winner has now admitted she sent the document. Her lawyer says let the facts play out in court and she will be in Court Thursday for a detention hearing. I need my panel to weigh in on this. I got a good one today. Well, stephanie, i think you saw here what happened in this case. It had this individual gone about this in a less careless and reckless way, i think it would have been much more difficult to identify her and ultimately apprehend her. You can tell by the reference to fvey that this document was provided to not only the United States Intelligence Community but our four closest intelligence allies, so thousands of people had access to this document. But not thousands of people printed it. Six people printed it as we know and in addition to what Pete Williams said, the document was postmarked from the hometown of this individual so she made it incredibly easy to track down what she had done. This is certainly not a typical case when it comes to these leaks, stephanie. It was easy to find her. Should information this sensitive be given, you know, be this widely disseminated . Well, stephanie, i think this is one of the consequences of 9 11. We went from a need to know model, need to share model. Primarily in the realm of counterterrorism information but it has extended to other realms including Counter Intelligence and when it comes to russias meddling in our election and Malicious Behavior around the globe it is important we share it with our close allies. Not only in the United States russia was intent on interfering, it was in france as we saw the other week, its in germany later this year, it could be throughout europe. It is quite important that we share this information widely including with our closest allies. Colonel, while easy to catch this woman, is it a justified arrest or is she a whistleblower . Shes not a whistleblower. Im speak as a whistleblower. I was a wstleblow against the bush white house, enabled danger, an operation to go after al qaeda. She had methodologies available to her to whistle blow and theyre not always messen. The whistleblower becomes the issue as i was but you fight back and do the right thing. Another factor here she probably would have had allies on the political side in congress. Members of congress who are able to actually do the hard work of getting this to the right people if she felt there was an issue. So no, i dont believe she acted appropriately. Yes, i do believe this is going to be charged appropriately as an act of i dont know if its espionage or not but something severe and there are things she should not have done and clearly i think there are other leakers throughout who are much more sophisticated in leaking. The mike flynn issue, the unmasking issue, this is far from over. Steve, i want to talk about whats actually in the document that she leaked. I mean it basically says there is Single Source analysis that russia didnt just try to hack, but they tried to hack into actual election systems at a local level. How big of a deal is that . Yeah. Well and again, youre not seeing the raw intelligence here first of all. I think thats the key point to make. And also this what does that mean . Youre not seeing the details. Not watching them do the math. There were reports last fall during the campaign that russia was youre getting away from the propaganda side and more on to the technical side that russia had started to look into these areas. The thing youre talking about, this vendor in particular, this floridabased vendor when you say election systems what was the work they were doing. They were verifying the voter rolls. The job they had lists of voters people who should be voting and shouldnt be voting, the thing you crosscheck with the list. Not talking about any actual eviden here of tampering with vote machines or counts. Reports to this effect back during the campaign. This does take you in a slightly different direction than talking about more recently, but in terms of that question of when we use that term, you hear that term out there at least, hacked the election, a lot of times the thing you hear back is well, theres no evidence of any votes being changed technically being changed by this. There still isnt because of this. We got to move on to the president for a moment. Defending his use of twitter, tweeting not even an hour ago, look at this tweet, the fake main stream media is working so hard trying to get me not to use social media. They hate that i can get the honest and unfiltered message out. Well, i just want to point out, mr. President , and i hope youre watching, i dont mind your tweeting. In fact, i quite like it. Bring it on. But it does seem to contradict his own aides. Yesterday Kellyanne Conway said the media pays way too much attention to his tweets and weve heard from members of the gop who have said i wish he would tweet less. I know ive spoken to people inside the white house, desperate to take his smartphone away. Kristen welker you are live at the white house, please, weigh in here. I mean, the president saying likes to get his unfiltered messaging out there. We like tight. That can get him in trouble. Case in point the travel ban. Case in point. Weve seen a lot of mixed messaging around the travel ban, stef, and, of course, the travel ban right now held up in court. So lets just look at what he tweeted and analyze it on the other side. His latest tweet as it relates to the travel ban, the president says thats right, we need a travel ban for certain dangerous countries not some politically correct term that wont help us protect our people. Hes saying look, this is a travel ban. Yesterday he was tweeting about the fact that he actually supports the first version of the travel ban, he said the one not politically correct. Yesterday his Deputy Press Secretary Sara Huckabee sanders says i dont think the president cares what you call it, but we had that long protracted debate about what to call it. Sean spicer saying several months ago when we use words like travel ban that misrepresents what it is. So whats the problem with this mixed messaging . Well, legal experts say it could actually undercut the administrations argument in court. Kellyanne conways husband George Conway tweeted about that yesterday, effectively saying look, the president s undermining his own message and his own legal team. He later clarified he supports the president , supports his wife, but ultimately wants to see the travel ban upheld at the Supreme Court level and all of these tweets arent necessarily helping with that, stef. I dont think the president is going to stop tweeting, but it certainly creates a challenge for his communications team. Stef . All right. I want my panel to weigh in, Jason Johnson, whether or not you call it a ban, does it actually make a difference . It does. It does. Its sort of like what weve seen with Voter Suppression cases, right. You will have republican governors says we werent trying to screw over black people and poor people just democrats. If the intent is political, sometimes the courts will say its fine. If the intent is racial, then the courts will say thats against the constitution. The president by constantly calling this a ban, as opposed to discussg it as a National Security issue, as opposed to laying out some sort of pn or plot or saying these particular countries present a danger it makes it very easy for courts to say your intention is to discriminate against people because of their religion, because of where they happen to come from and it makes it impossible for his entire administration to substantively make this argument. He keeps doing it over and over again. I feel sorry for his legal team. This is his own Justice Department. When the president is saying, i dont like the watered down version of the travel ban, i want to go back to the original, he signed off on this one, but colonel, i want to read a part of a wall street journal editorial where they write, if this pattern continues, mr. Trump may find himself running an administration with no one but his family and the breitbart staff. People with talent and integrity wont work for a boss who undermines them in public without thinking about the consequences. The president undercut the people that said this wasnt a ban. He undercut the people that provided the rationale for firing james comey and he wants loyalty for people who worked for him. He has said over and over again loyalty is premier, but dont they deserve the same . I think about h. R. Mcmaster and gary cohn writing that oped in the wall street journal last week about how the president supported article 5 and then we learned that, in fact, he took article 5 at the last minute out of his speech to nato. Well, i think theres two things here at play. Look, ive worked for bosses i had to be loyal to that i did not agree with the way that they ran business. Its something every individual has to make a choice, do you want to support the man in charge or not. In this case, its all voluntary so people can walk away at any time. No doubt, mr. Trump has given his staff huge challenges regarding messaging. I kn for a fact based on my own conveations that people are always trying to keep up with him because his perspective is often different and often based on his personal perception of the reality rather than the legal. Hes not a lawyer. Hes not a politician. I think this is where the way hes done business in the past, as a businessman, being direct, is now in conflict with the way the city runs. But sir, being direct means your word is your bond. Being direct means having a point of view. The president himself said to John Dickerson of cbs, i dont stand for anything. And at this point, can we actually say hes not a politician . Hes becoming a politician by the fact hes now the president. Ill say this about the problem and whats going on. I do believe mr. Trump has to be much clearer about what hes trying to achieve. I always say as a military officer, begin with the end in mind. What do you want to achieve and try to figure out how to do it. I dont think hes figured out how to do that yet. Hes trying to learn how to use the levers of government and communication and his staff is caught in the middle. They have to decide to stick with the guy or not and mr. Trump ought to be more precise in the way he messages things. I want to share a part of what his son donald trump, jr. Said on Good Morning America around President Trump and his staff in the white house. Are you satisfied with the team he has around him right now . You know, i am. But the the immediateeam. Theres plenty in d. C. Probably enty still in the white house and holdovers, you know, that arent necessarily working in his best interest. Do you think theres people actively working against him . Without question. Okay. So don jr. Feels the immediate team. The president doesnt have to keep anyone there who is a holdover. That white house is filled this administration is filled with empty seats that the president could fill. So if don jr. And or the president so passionately feel people close to him are working against him, why not get them out . He certainly knows the phrase youre fired. Ned . Well, thats exactly right. Look, i think, you know, theres been a lot made of holdovers and the deep state, but terms like that what they really refer to, stephanie, are thousands, the tens of thousands, in fact, the hundreds of thousands of dedicated Public Servants who are not serving a party who are not serving an administration, but who have taken their career and have served the country, the United States of america. Look, it is not in our system, in our system of civil service, we are republicans or democrats. We are dedicated Public Servants. I think that when we hear this administration blame the deep state, blame these obama holdovers theyre using this as an excuse for their own mistakes. This administration, including on the issue of the travel ban, as weve seen, has been its own worst enemy. It is not obama holdovers that have torpedoed this travel ban, be it the first iteration or second iteration, it has been this president and Stephen Miller and others in this administration with their own statements including the president s own tweets. Matt, start with you, Committee Chairman republican richard burr says james comey pretty much can discuss anything. Take a look. Has mueller urged him not to talk about the russia investigation or stay away from certain areas . Theyve talked but i understand that the special counsel has not fenced him off in any way, shape, or form from the items he intends to talk about. Unshackled what does it mean Robert Mueller gave james comey permission to speak on everything . It means comey will be able to come in and talk about the biggest question in american politics which did the president of the United States commit obstruction of justice either a criminal act or at least a major abuse of his power by asking comey to back off on the flynn investigation, by asking for his loyalty and then firing him when he wouldnt comply. And i think well see jim comey testify about those interactions but remember, the New York Times when it reported about the existence of the comey memos he wrote a memo about every conversation he had with the president that he thought was inappropriate. Weve heard about several conversations but i wouldnt be surprised if comey walks into the hearing room and not only gives us more details, more damaging details about the ones we know, but tells us about others we havent heard about yet. You were one of the first to say as soon as james comey got fired watch were going to see memos. If we see those memosn thursday what could the mifications be . Could one make the argument its still he said versus he said. Well, you could, but i think there are a couple things. One, lets remember that the president of the United States as youre pointing out answered a question on the record and said no, he never asked jim comey to back off on the investigation. So were going to have jim comeys word under oath and that begs the question will the president be willing to go under oath and testify. President s can be called to testify before the grand jury and thats where the special counsel will take this eventually. The other question is, were there other witnesses, obviously jim comey wrote these memos but did he share his concerns with other people in the Justice Department. He shared them with people at the fbi. For example, was Jeff Sessions aware of jim comeys concern about his intera actions with the president , rod rosenstein, if they were, remember those are two people who signed off on jim comeys firing they would potentially be obstruction of justice as well. Maybe not a criminal act but they sacrificed their integrity and the department of justices independence when they signed off on that firing. Thats a big separate story line to watch for this hearing. Nbc has learned theres been a change of plans as it involves how the white house is handling the russia investigation. The idea that there was going to be this war room, possibly headed by jared kushner, or steve bannon, that has changed. Now all russia directed inquiry is going out of the white house into the president s longtime personal lawyer marc kasowitz. What do you think . What happens when donald trump sees something during the hearings and wants to tweet about it. Well, he might want to but senior advisers have made it clear some of them they dont want to talk about russia this has been the central tension this administration, it was the central tsion of Donald Trumps campaign, can he take direction from the career professionals around him. Can he take direction, you know, when lawyers step in in a situation like this and say this is different than, you know, being sort of in politic on a matter of policy can he take that direction. Thats going to be something thats interesting to say. One of the things i keep thinking of with the comey thing, how comey handled himself last summer when it was sort of fell to him to make the decisi decision whether to charge Hillary Clinton in the email case. He didnt just come out and say im not going to charge her no evidence he all but indicted her in the court of public opinion. That is a good point. He has a fine line to walk this week in his testimony. Hes previously said no, i wasnt pressured, i wasnt the victim of any pressure from the administration, from the white house, but now hes going to be answering questions about these memos. Is he going to dance the same dance with Hillary Clinton. Does he everything to lose or nothing to lose . Matt . I think he has nothing left to lose. Once the president fired him, he set jim comey free. For a while when jim comey had the first conversation with the president when the president started asking about the russia investigation he could have done he could have said to the president , mr. President , these conversations are inappropriate for us to be having, on investigating members of your campaign, associates of yours and he didnt do that. One of the reasons he might not have done that at some point he realized the president is committing potentially obstruction of justice here, im going to continue to collect evidence. And while he was leading the investigation, it would have been, you know, irresponsible of him to go public about that information. Thats not what investigators do in the middle of an investigation. But hes no longer the investigator. He is now a witness in this case. And so he has a very different obligation than when leading the investigation. I have to share a bit more of that conversation don jr. And eric had this morning on Good Morning America specifically about the russia investigation. Its the greatest hoax of all time. I was there throughout the campaign. We have no dealings in russia. We have to projects in russia. We have nothing to do with russia. I mean to me, its without a question, you know, reads and smells like a witchhunt. From who guys who previously said they do do business with russia. This makes no sense. If they were honest about this and said look, this is about approachment we want a better relationship with russia all of this would end. The reason it feels like a witch hunt because you keep boiling the water in the middle of the room and fly around on brooms and claiming you dont remember. Its also been learned that he had a job in a train tunnel. He was a London Underground worker and he was actually based in the station closest to britains parliament. The third man we know about is rachid redouane, another moroccan or moroccan libyan, he had lived for some time recently in ireland, so irish police also involved in this. Then if this anger towards hate is coming from a place of passion, so youre saying we should applaud that anger, why didnt the president have that level of immediate passion and anger and upset when that same level of hate happened on a train in portland, oregon, when a white supremacist killed two men .
