What we are hearing in the sixpaid letter released moments ago questioned the ground, the basis for impeachment. Theyre using Strong Language like attack on the rights of the American People to freely choose their president. They call it destructive, toxic the whole way through. This is the opening salvo from the white houses legal team. Well get a formal and longer brief about the merits of the case by monday so this is coming in two tranches. What we are hearing from the House Democrats is and case to have additional evidence and youre really starting to see this push from the house on the house side that you need to have more evidence and potentially more witnesses or more witnesses that will be called to the floor of the senate. We are getting a call and response. This is back and forth. I think one wild card in all of this and we heard this from some of the advisers of the president earlier today preserving the ability to call witnesses and if they win a vote because collins and murkowski and romney and other moderate senators or dont like the impeachment is going decide to vote for witnesses there may also be and i stress may also be enough votes to call someone like the whistleblower, like hunter biden, like joe biden so the battle is joined here. This is an exchange of letters but the letters have teeth and they will establish the framework as we go forward in the coming days. Richard . In black and white here, hans nichols, what theyre thinking and the early stuff if you will of what we expect this week as you describe here and in both of the cases hearing from the president s legal team theyre going to reject they say both articles of impeachment must be rejected. Lets go over to the democrats now and that was an even larger document dump that came in within the last hour. Hans, that was over 100 pages. Give us a quick top line on what we know about that. Reporter well, this is a summary. More of a summary and an escalation. And so, a lot of this weve known sort of they telegraphed what they will do here. What theyre also doing is taking this new evidence or these new bits of information come out, whether or not its the lev parnas photos or the Text Messages saying likely possibly be part of the body of evidence that the senate looks at and so theyve always preserved this ability but here its in black and white and theyre giving it their indication how they want this trial to go. The one person that we havent heard from in all this is Mitch Mcconnell and mcconnell establishing the almost the time line, the rules, how much both sides get and it seems as though and this is a little preliminary and seems it is going to go in two phases. An initial presentation of the evidence both sides and then you might have a vote for witnesses and it is at that point that theres a possibility this will be dismissed. Right . We dont know what collins and murkowski will do. They have hinted but never certain with eat of them and then if we have evidence and additional witnesses that will be an entirely different phase and at that point we get in unchartered territory because the whistleblower, the rules and protections for whistleblowers, i talked to senators saying they feel that the protection act clearly contemplates that the whistleblower could be made public in a criminal proceeding and so and that principle accused has a right to face accuser so i would suspect talking to senators over the last couple of days their indication is that they at least one senator was strongly indicating to me to call the whistleblower. Hans, stay with us. I want to bring in the panel. John hudson, Danny Cevallos and charlie savage. Danny, lets start where hans started this off and that is were hearing from the white house and not necessarily a surprise. No. In the six pages saying we must reject these articles of impeachment. We must not accept them but go deeper for us what you saw in that response basically to the summons. Two prongs of attack and consistent the whole time. First that the article 1 of the impeachment articles is no good because this was basically an okay call. Number one, the bilateral meeting took place. Number two, there was no aid withheld. Number three, this was totally above board and within the president s article 2 power. On the obstruction the white house consistently saying we were transparent. Released the transcript and to the extent to resist congress we have an executive branch right to do so. This is not a surprise. This is consistent with the defense the entire time and then you add to that their argument that the process was flawed, that it did not give the president due process throughout the house proceedings. But thats a bit of a dangerous argument because to the extent you wanted to call more witnesses in the house or have more evidence come in, thats a doubleedged sword that comes back in the senate trial when democrats want witnesses and more evidence. John hudson, any surprises as you were able to glance through this . We are just getting this in the last hour. Yeah. Not really. We have seen all of these arguments from the House Democrats an the white house. It is no surprise that the white house forcefully rejects that these are impeachable offenses. I think what it is going to come down to is how does the senate receive these arguments . How does the politics play out . We have seen some movement on that front from different senators and representing different constituencies who have different pressure points with the president , the popularity and ultimately what the American People feel happened with regards to the consistent allegations that the president abused his power by trying to pressure a foreign country to investigate his political rivals. Its really unclear how it plays out and the arguments pretty consistent from what we heard from the white house and the House Democrats and not surprises. Charlie, i know youre a fast reader here. As part of what was putt in this response to the summons, again, from the president s legal team here in part it said that at least his defense team was saying that democrats are trying to conduct a brazen attempt to overturn the 2016 election. Ill read a little bit of the conclusion. It says the articles of impeachment violate the constitution. Theyre defective in entirety. The product of invalid proceedings that flagrantly deny the president any due process rights. They rest on dangerous distortions of the constitution dotdotdotdot so the constitutionality of the very articles themselves. Thats right. As i think it sounds like an amplification of alan dershowitz, they argue the facts that trump didnt do it and even if he did do it, theres not a federal criminal law here violated. That is not actually necessary to be a high crime and misdemeanor. But, you know, seem to be throwing every argument they can to see what will stick to give republican senators in particular some reason that they feel comfortable to vote on acquittal. I just quickly would throw in an interesting observation i think in the democratic brief that just hit is that it brings up the Mueller Investigation and the russia investigation several times which, of course, they decided not to em peach of obstruction of justice in russia and sneaking it in by saying a practice and pattern of trump. Solicited russian interference in 2016 and doing wit ukraine in 2020 and he sought to obstruct the Mueller Investigation and now sought to obstruct the house investigation into the ukraine matter. And so, theyre sort of having their cake and eating it too not impeaching him over the mueller russia stuff and then bringing it in as evidence of the pattern, as evidence of a way of doing business that cannot be allowed to continue. Is the theme we see over and over in this report. And that is a second piece of breaking news this hour, we have got a copy of the trial brief from the house managers, the danny, react here to what charlie was saying. Ill read parts of what was in the 115 pages or so. Saying that the president has abandoned his oath and must be removed from office. That he must be removed as president to safeguard the integrity of the 2020 u. S. Election. Add into that the Mueller Investigation, as well. Can there be too much . I know we havent read through all 115 but dont tell me. I may have had a few minutes here. I can scan. But it might be too far afield, scope creep as some of what the critics saying of what democrats might have done in the impeachment process . Something House Democrats thinking about seriously for many months now. Do they bring in everything under the sun that was arguably impeachable or do they narrow the focus on a digestible set of facts for the American Public and seems look they have chosen the latter option and could have brought in things from the Mueller Investigation, key, though, is language you just read creating that clear and present danger, future danger for immediate and 2020 election and not a withinoff affair because there is constitutional historical argument to be made that, look, if it is a onetime thing, something in the past, its to be looked at differently than an ongoing concern. And thats exactly what House Democrats are driving home. One last thing to build on what charlie was saying is the addition of dershowitz, look for them to double down on an idea to have a crime to impeach and wrote a book on that premises but in the academic minority. Its a great point, especially about the scope of this and that reflects some divisions among democrats, especially in the house. The moderate democrats wanted this to be a very much focused impeachment process. Stick to the ukraine allegations. Dont go further afield, especially when it came to mueller which some moderate democrats including slotkin from michigan and others viewed adds more slippery territory, less cut and dry. Those mueller allegations were not sufficient for them to go forward on the impeachment process with the ukraine allegations, with the quid pro quo allegations they felt like that that was the winning argument and so interesting, i mean, the fact that they include that i think reflects the push and pull between members who invested a lot into the Mueller Investigation and wanted some of that included in these allegations. One of the Big Questions heading into the impeachment trial of President Trump, what kind of role will john roberts play as chief justice . Opinion piece in the Washington Post writes roblts attempted at times to position the administration of justice and the role of the judiciary as being above the fray of partisan politics. That desire argues for a more assertive role of the chief justice at the impeachment trial not less. Joining us now former federal prosecutor Cynthia Oxney and Danny Cevallos. Danny, we have talked about what the chief justice may or may not do. As we look at precedent, we say that hell be a rehnquist, going to be way in the background as much as possible. Do you believe that . Do you think thats the role hell play . I think so because he was a clerk for rehnquist. He has a respect for history. I believe john roberts almost in another world would have been a history professor and almost on that path in college and changed his mind so this is somebody who has a healthy respect for history and chief Justice Rehnquist took a minimalist approach and the constitution once again leaves with us a lot of gray area. In the same section it say that is the senate has the sole power to try impeachments but it also says in the only reference to the chief justice that the chief justice shall preside, whatever that means. But its important to know that even when the rules call for the chief justice to elect to rule on evidence or other motions that the senate can overrule him with a bare majority, 51 senators. Thats all they need. So the chief justice is an interesting political role. He can either choose to rule on motions and issues, risking or challenging senators to overrule him or he can kick it directly to the senators for a vote right away and avoid the controversy. Cynthia, say he does that and he throws it out to the senatorinsenators and they come back 50 50, what does he do . Theres a disputd about that in the law and depends on the Senate Parliamentarian tells him. Theres an argument to break the tie because hes taken the position of the Vice President in the senate with the opportunity to mabreak a tie. Some say it will be just defeated. We dont know the answer because we dont know the position the parliamentarian will take and the position hell take. Im of two minds on this. Im a head and a heart mind. In my head i agree with danny. I think he wants to avoid the politicization of the court and not interested in getting involved too deeply in this impeachment but in my heart i want him to take a more active role. I feel like we need an impartial judicial presence, somebody with the temperament he has to call the balls an strikes particularly on the relevancy of evidence and if he doesnt do that hes essentially allowing the republican coverup to continue so my heart wants him to play a more active role but i agree with danny he will not. Danny, if the parliamentarian says you cannot and he says, yes, i will vote and break the tie srks that a possible scenario . This is an exciting constitutional issue. First, chief Justice Rehnquist had to turn to the parliamentarian at least once when a motion or an objection to a question was shouted out by a senator. He said, well, essentially, i dont know what to do here and the parliamentarian offered that guidance because they know these rules very, very well. Now, the issue of a tie is intriguing because the constitution explicitly says that the only person who can break a tie is the Vice President. So a strict reading of the constitution suggests that somebodys going to have to hit up mike pence on the pager and ask him to come over and break a tie. Im not so sure that would happen but then the other fascinating thing of impeachment trial is precedent isnt precedent the same way as the Judicial Branch business chief justice salmon chase ruled twice in the johnson impeachment and one senator objected but whats the takeaway . The senate can remake the rules and have an entirely new impeachment trial every time it has a trial so that is not necessarily precedent. It is historical, interesting fact. We dont know the rules. Cynthia . Right. We dont know the rules but well get a tip of the hand pretty quickly because we may have an argument over the rules and we may have an argument over the motion to dismiss and we may have an argument over that. So pretty quickly within tuesday, wednesday, thursday were going to know what position the chief justice is going to take. Might we get the rules from Mitch Mcconnell, the resolution, tuesday . Like right before they start the process and make their arguments . Yes. I think thats what will happen. He seems to be trying to follow the clinton model. Thats the way the clinton model went. There was a resolution and laid out the number of hours, the arguments, the motions and were going to be allowed but not the motion on the extra witnesses. And there was a resolution that sort of laid everything out and should come on tuesday. But mcconnell isnt sharing it with anybody yet so we havent seen what it is but we understand that it will come on tuesday. Practical matter here. Im no lawyer here but if you got the rules of lot of improvisation moves i imagine to some degree here. I dont think you need to be a lawyer because this is really barely a legal process. It involves legal principles but it is purely a political process ultimately because the jurors are not unbiassed. Theyre very, very biassed and these rules are hashed out every single time. Lawyers you see them pose for pictures in front of these libraries of leather bound books, books often of procedure. We have so many rules existing over hundreds of years guiding us in what to do exactly down to the days and limits and time limitations. In the senate its recreated every time so there is built into the program essentially a fly by the seat of your pants rule making process because it all moves very quickly. The constitution and the rules require irrespective of leader mcconnell wants the trial must begin once the articles are presented so they have to come up with rules and in almost every instance very quickly. Cynthia, i was looking at what potentially might be the tick tock from our own kasie hunt and it could either go very quickly or very slowly it appears depending on when the senators decide to end the day. Long or short day and on top of that senator mcconnell could decide whether or not to have it available for us to watch at home or not. Right. And they could decide whether or not they go all day saturday or not. During the clinton trial they specifically said there were xamount of hours to argue things and we are waiting to see whether or not mcconnell follow it is rules an change it is hours or says it has to be done in a certain amount of days, all this up in the air and we dont know because this is really only happened three times. Maybe 15 times with all impeachments but president ial impeachments have only happened three times. And they were dramatically different. The chief justice played a very agr aggressive role in the johnson impeachment and reticent role in the clinton impeachment. We have to see. We will. We get something new every hour. More than 250 demonstrations planned nationwide as marchers are making an Election Year call for change and equality just days ahead of the impeachment trial in the senate. The first womens march took place just one day after President Trumps 2017 inauguration. That was thought to be the largest single day demonstration in the u. S. Since the vietnam war. Joining me now from washington, d. C. Where this all started, nbc correspondent dasha burns. Reporter hey, richard. The participants that showed up today had to brave the elements. We have seen everything from rain and snow and the mess in between but the people we did meet and talk to here were energized pointing to this political moment as especially important for an event like this. Of course, this whole thing kicked off as a response to the election of President Trump and now he has been impeached. Take a listen to some of what we heard earlier today. You came here from california . What made you brave the cold and come out here today . Because i think that its extremely important that we get together to try and get trump out of office and its a Election Year. Its time more than ever for women to come together and speak up for our rights and what is going on in the world and without us there is no change. Definitely the lowest turnout of the marches so far but this year was really a moment for the movement to try to reorient itself and focus more on grassroots activism and inclusivity. We didnt see the big celebrity star studded speeches of the past and it was about the march and walking together and also including a lot of the international perspective, as well. We heard chants in lot of different lang wants, dances, songs and a smaller turnout but with a slightly different message this year than in years past. All right. Thank you so much. The issue of whether a woman can be elected to the white house an be elected was a flash point at this weeks debate. Anybody knows me. Knows that its incomprehensible that i would think that a woman could u not be president of the United States. This question about whether or not a woman can be president has been raised and time for us to attack it. Head on and i think the best way to talk about who can win is by looking at peoples winning record. So can a woman beat donald trump . Look at the men on this stage. Collectively, they have lost ten elections. The only people on this stage who have won every single election that theyve been in are the women. Amy and me. So true. So true. And oh, by the way, this year, 2020, it marks the 100th anniversary of the ratifiation kaigs of the amendment of protecting womens right the vote. Also in 2016, Hillary Clinton became the first woman to ever win a president ial nomination. Also won the popular vote with nearly 3 million more votes than her opponent then theres the 2018 midterm elections. Are you comfortable with a female president . And in this poll, 74 of respondents say yes. Your neighbors are comfortable with a female president. 33 . So not me, but my neighbor isnt comfortab comfortable. What does this tell us about the way voters are thinking about this question of a president thats a woman . Who is a woman. I think unfortunately it shows that we have a lot of subterranean sexism in our society still. I think a lot of people have anxiety about that. I think a lot of people say their neighbors are uncomfortable when they themselves are. That said, i think we can look at recent electoral wins and say that weve crossed a threshold where the number of people willing to have a female president outnumbers the number of people that arent. So, lucy, one of the ways that someone might understand the dynamic, dont have to go back too far, but it is plenty far back. California. Tom bradley. And it was much thought by the polls that he would win. But the outcome, one of them from the analysis there after, because he was an africanamerican candidate in k california, is that once folks got into the voting booth, they did something different. Is that the case here, too, potentially . I mean look, i often say that voting is one of the most illogical types of behavior that can occur and oftentimes, thats why polls are wrong. Once you get into that voting booth, it is just you and the ballot. And you do vote your conscious. Sometimes, you vote your unconscious. And to amandas point, i think there is still a lot of as she called it, subterranean sexism and look, sometimes we still carry those biases and sometimes you know, you just get in this and this could be men and women who say oh, gosh, i just dont know if i can do this. That being said, you know you have such an incredible momentum. You noted all of those records. The record amount of women who are run ining, winning. The fact that Hillary Clinton won the popular vote, et cetera. You have a lot of data that points to that we have a condition now and especially once you get into a general, where you have one choice or the other, where a lot of other factors start to come in. Its not just about gender. Youre saying okay, we got to go all in because the alternative is not something and certainly anyone that came out to the womens marches this day are willing to support. I want to read a little bit from Amy Klobuchar and what she was quoted as saying in the new imes and the question that was asked is would a 37yearold woman where Pete Buttigieg is and klobuchar said in her response to that, do i think we would be standing on that stage if we had the experience that he had . And she says speaking for her fellow female contenders, no, i dont. Maybe were held to a different standard. Amanda, its two ways of looking at it. Its the way klobuchar might see herself. Also might be the reality of what might be in the market space. The voters and what theyre thinking. What do you think . I think klobuchar was really insightful there. People want to talk about secretasexism like an on, off switch. Its much more of a gradation issue. Its not that women cant su succeed in politics, its that they have to be twice as good as men do to get half as far. So i think we see that in our president ial candidates right now. Where you know, warren and klobuchar are extremely accomplished women. Some of the other candidates are as well. The the male candidates, but not all. I mean, buttigieg is a mayor of a small city and i think that we have to acknowledge that women can win, its just unfortunately they have to climb a much taller here to get there. As a form rer legislator and former official, i can tell you were b absolutely treated by different standards. Were asked different questions. We are not entitled to the mistakes that the men are. What we are seeing over the last couple of years and frankly, an unintended consequence of hiring, hiring, thats what the American People did.
