This could be a sign of the intense effort by the white house and House Republicans to try to pull and peel off some democrats who might be wavering on impeachment for various reasons. The president also keeping up his public fight against impeachment with a series of tweets today. Some of them right there for you. Equally defiant. The president s personal lawyer, rudy giuliani, well, he is reportedly under federal investigation for possible Campaign Finance violations, but that has not stopped him from moving forward on his push for ukraine to conduct probes of hunter biden and others. Now, the wall street journal reports that giuliani actually met with President Trump at the white house yesterday. Thats the same day, as you might know, as the impeachment articles against the president were being voted on by the Judiciary Committee. Well, this morning, dr. Biden spoke about the scrutiny he faces at the hands. I know my sons character. Hunter did nothing wrong. Thats the bottom line. Bring in our panel, wall street journal congressional reporter sa ban hughes, washington correspondent, charlie savage, paul butler and republican strategist and msnbc political analyst, susan del percio. This is the Washington Post reporting. This, a moderate democrat from new jersey, were hearing from the Washington Post that potentially could be switching parties, this might indicate then that this particular member of congress, not going to be voting for impeachment of the president of the United States. What are you hearing . So Jeff Van Drew someone of 31 democrats in districts that President Trump won. Hes already come out and said hes not going to be able to support impeachment, but the Washington Post article suggesting that he might even be considering switching parties to become a republican shows how much pressure these democrats are under, if coming out against impeachment is not enough, what does that tell you about the situation for all of those other democrats . Charlie, youre right there in the beltway. What has been the strategy coming from the white house to try to, as i was saying in the introduction here, peel away some of the democrats, not only from the trump districts where they did win . Thats right, but you have to understand, there are lots of democrats who are in districts that trump won in 2016 because of the 2018 wave election in which democrats flipped a lot of republican seats. There are almost no republican moderates left. Trump has already lost one republican, justin amash, who had to leave his party after saying trump committed impeachable offenses. Theres only three others that clint one in 2016. All the action is on seats that are held by democrats, but trump four years ago and the more defections trump can peel away from that group, the better the look for him. I did the math and its like 18 defections is what republicans would need to defeat an article of impeachment, assuming that justin amash, now an independent, votes to impeach trump. Almost certainly not going to get remotely close to that but might get one or two and that would be enough for a muddying message, i suppose. Muddying. Susan, this is your the place that you would advise in, members of congress from the right, jeff andrew, what does this say about who else might go the other way . Lets look at that right now. He also got some polling back that said he was in a tight race, he would probably lose, in part, because of the impeachment talk. However, he also got really bad news that 71 of democratic voters would be less likely to support him if he didnt vote for impeachment, which means he was open to a challenge on his left which he probably wouldnt win especially given everything so far. Youre pretty desperate if youre willing to go into the minority. When you go into the minority of the house, its not a fun job. You get to do nothing, but the fact hes considering it, maybe hes looking for something else, a steppingstone down the road but this is a unique situation. We look at other people in swing districts like max rose who a lot of people thought was open to the talk of impeachment but recently doubled down on it and said, no, i will support impeaching the president and that district is a flip district, if ever there was one. And the numbers, 31, in swing districts, potentially, if all were to move from one column to the other in the vote, that would change the Impeachment Vote outcome. However, this leader, leader pelosi is not an individual that goes into a battle without knowing whos going to stand behind her. And this case, shes got the merit on her side. We dont get to say this behind democrats, but they could have not done a better job. Extremely effective case that President Trump abused his office. He put his own personal interest above the interest of the United States, and he obstructed congress. So in part, its a separation of powers thing. I get that polling matters, but at some point, put country first. And the constitution. Absolutely. Stand by, panel. Thank you so much for opening this settle. Thanks, richard. Well, what do you make of this reporting of representative van drew . I dont know whether its true or not. I hope its not true. In fact, i hope every politician would not decide how theyre going to vote on the impeachment based on polling. We took an oath to the constitution of the United States of america and that should be the defining purpose how we decide to vote and its clear how we should vote. We should vote to impeach the president of the United States of america, donald j. Trump. If you were in his position, what would you do with the polling information and potentially leaving congress on this issue . Thats a mistake. Too many people in congress have one goal and thats to get reelected. And whether they are in a red district, blue district or purple district, what we really should be doing right now is looking at the facts, and the facts are clear. The president of the United States has abused his power and has consistently obstructed congress. And not just in the ukrainian matter, we saw the obstruction take place in the mueller report. There was clear examples of that. And clearly, if he was a private citizen, he would have been indicted. And we have also seen firsthand in our Respective Committee work including mine on oversight, the continued obstruction of justice by not honoring subpoenas, by not providing documents, by not providing witnesses. Its time to take action. On that note, this week had a lot of different headlines here, representative. One of them of which was a withdrawal of a subpoena to get charles kupperman. Why was the subpoena, if the republicans saying were not hearing who we need to hear, on the democratic side, this is going to be a very essential decision coming down from the federal courts. Which, if youve been subpoenaed, who should i listen to, the white house or the house of representatives . Why was it withdrawn . Actually, i think thats where we see the most hypocrisy in the narrative pushed forward by the president , by the white house, and by the republicans, that witnesses havent testified that should testify, yet simultaneously, the president is preventing those witnesses from testifying, so, you know, its clear whats going on here, and its continued evidence of the obstruction of justice that the president and the administration continued to thwart efforts for legitimate subpoenas and document production. Representative, what do you make of the speed by which the Judiciary Committee did move forward . If you go back to may 9th of 1974, that is when the house Judiciary Committee at that moment did begin impeachment proceedings against the president then, richard nixon. It then took them about two months to say, okay, these are the articles that we would like to consider and put forward. In todays impeachment process, we were looking at a matter of weeks. Is that appropriate, you believe . I do and heres why. If you go back into previous impeachment inquiries, and the process that took place, what happened was there was questionable conduct by the president. That was submitted to the attorney general who then picked a special counsel to take the appropriate investigation forward. Here, the Democratic Party caucus put this forth to the attorney general barr who refused to take it up. So chairman shiff with other members of the Leadership Team began the process of providing the hearings and the depositions in a format that allowed the republicans to participate in as well as the democrats, so that process has been going on for a couple of months. So when we see a shorter process with the Judiciary Committee, thats due in large part to the hard work that chairman shiff did prior thereto. Let me ask you this first. Do you believe that the president will be impeached come wednesday . Yes, i do. And will you be voting for impeachment . Yes, i will. Do you think the articles held by the leader, should she push them forward or hold them . I think they should be moved forward to the senate. I briefly heard somebody say they would be held, but im of the opinion that this is a serious process and if certain members of congress in the senate dont believe it is serious and will continue to allow this president to do whatever he wants in office and even to his point, say he could shoot somebody on fifth avenue and have attorneys argue that in court, its time to take action and if those on the other side are willing to turn the other way, im not. Sir, how serious of a week are we about to see ahead of us . Its a serious week. Its a very solemn week. I didnt come to congress to impeach the president. I wish we were not here at this moment, but its the president s behavior, its the behaviors conduct, its the president s decisions that have brought us to where we are now. And he needs to be held accountable. We should certainly hope the president of the United States to a higher standard than how we raise our children, and the fact that this president blatantly violates the law as often as he does requires us to take appropriate action and im hopeful that members in both the house and the senate on both sides of the aisle can see clearly what has transpired here and take appropriate action. When i look at this poll, that is one of the questions and i was asking the representative here. She has the articles, leader pelosi. Whats the benefit of holding on to them . One of the points being made at the moment is, well, perhaps some of the republicans will stew on it in the senate. They may sway, they may waver. Thats not going to happen. So its true that the senate, since the jury has already made up its mind, its extremely unlikely that the president will be removed from office, no matter how strong a case the house prosecutors can make. I think this is about history and this is about an argument to the American People, and the constitution states its the senate that makes that decision but the house gets to present the case, and i think when that case is made, even if the senators dont get it, the American People will understand the concern about not only leaving the president in office but what might happen next, because this is a person who learns from experience and who learned that hes not restrained by congress, he can do whatever he wants. Shaban, two, a forgone conclusion theyll vote for impeachment and the senate will quit the president but there may be a surprise in between, some say. Might there be a surprise . As we look back into the nixon years, surprise that happened during the Judiciary Committees deliberations was the supreme court, right . Saying president nixon, you must now provide the evidence. So i think its highly unlikely that there will be a surprise that the senate will change it mind but the wild card im personally watching is john bolton. There were oral arguments on december 10th in a case involved charles kupperman, the judge in that case that he would rule by the end of the year and adam shiff who tends to convey very big messages in subtle offhand ways was on kole bcolberkolcolb suggested he would but john bolton, privately conceded, could switch the dynamic here. Interesting, charlie . Id like to pick up on that. One of the debates the republicans are having is whether to have a short trial with no witnesses, or a long reality tv trial for trump to revel in, usually how its framed but the witness issue is a wild card. On the one hand, they could use that to try to drag the unidentified whistleblower into the light as they were unable to do in the house, since republicans control the rules and will control subpoenas and so forth in the senate. And it could drag hunter biden in and have a real circus around all of this but what happens if john bolton does want to testify and no one knows what hes going to say. It may be safer to have a short trial with no witnesses to foreclose that possibility without making it look like theyre trying to affirmatively not call people like mulvaney. Mcconnell has a problem because he does not necessarily have control of every member of his caucus, if it comes to bringing a witness. They need to vote at 51. I could see certain republicans voting against or with the democrats on certain issues to bring witnesses or prevent witnesses from going forward. And to something that paul said earlier, youre right, the democrats have played this really well and i do believe, however, that nancy pelosi shouldnt play politics now, i mean issue its a mean, its all politics but look so political. She has not done as of yet. But its been a question of if she should or shouldnt but i think it would be a mistake for how shes handled everything so far. Great points made by our panel. Then on thursday, lawmakers from both parties said that they had reached an agreement in principle to the end of the year. And that Means Congress voted on 1. 37 trillion in federal spending next week during the same time as the Impeachment Vote. Thats going to be happening on the same day and the same time frame. Then on huthursday moment, momentous victory. Boris johnson, did you see that, his conservative party in britain came away, for them, a landslide. They did not expect these numbers. Overwhelming victory drew parallels to trumps win in 2016 and some argue it could be an indicator for 2020 in the United States. And then to cap off the week on friday, there was an announcement that the u. S. And china had reached a phase one deal on trade, deal reduces some of the tariffs on chinese goods and delays the implementation of new tariffs. President trump who once called himself a tariff man called it one of the greatest deals ever. Thats going to be one of the great deals ever. Its ultimately going to lead to the opening of china, which is something that is incredible because thats a whole big untapped market of 1. 5 billion people. The tariffs will largely remain. 25 , 250 billion and will use them for future negotiations on the phase two deal because china would like to see the tariffs and were okay with that, but theyll be used as a negotiating table for the phase two deal. I think a lot of speculation on both sides has been perhaps this is a precursor for what we might see in 2020 but i dont think thats the case, richard, and heres why. First of all, keep in mind that Boris Johnson had a very well defined plan when it came to brexit. It was very well known where he stood on that. Other parties most notably the labor party with Jeremy Corbyn, all overt the place and Jeremy Corbyn was not necessarily a strong candidate. Youve got to bear all of those. Well seasoned, known by the left. They know hes an antisemimiantisemite is a problem. I dont think its a reflection but good warning sign that this is not going to be an easy win, if we defeat trump at the ballot box in 2020. A subheadline that potentially too far left, at least, when it comes to the labor party. See how it balanced off here in the United States. I want to go to a New York Times oped, as we try to drive some contrast and comparisons here. It reads that, clear rejection of labors Big Government socialism looks ominous for democrats who thinks the party can lurch left and then win. Did not buy rationalized railways and Water Utilities when they could stick it to some faceless bureaucrat in brussels. Susan, you noted Jeremy Corbyn, criticism, hes an antisemite. Thats certainly a notable point of this leader of labor, but whats a lesson to be taken away . If you look at labor in the uk and the more liberal side of the democrats or Progressive Side of democrats, the example would be medicare for all, and that is a fundamental sticking point. If you tell 166 Million People theyre going to lose their health care and the government is going to take care of you, that is a big deal changer and that is, or a game changer, and that is something i think would be associated more with the left, with labor on the socialist side. I think thats the type of comparison you can make, with some of these progressive ideas. So charlie, joe biden, he was watching the election, which his team probably was. Joe biden is saying, that looks good for me. Thats right. To the extent his argument, you need a centrist, someone whos not going to scare voter as too left wing, he can say argue by analogy that corbyn is Bernie Sanders or corbyn is elizabeth warren, so stick with me. I dont know thats necessarily persuasive to everyone in the Democratic Party right now, but its certainly an argument that his team wants to emphasize in the coming days. So we had the story of definitely two sides for this white house, siobhan, because getting the two key pieces of legislation might be because its despite President Trump being involved in the process but fill us in, because calling himself the tariff man and getting these two deals done, pretty good if youre looking at, im still getting stuff done. A couple of points on that. Number one, his u. S. Trade representative Bob Lighthizer is somebody who democrats and republicans give a lot of credit to, so its a matter of good personnel. Also, its worth noting a good team, right, yeah. Its a good team. Also, mr. Trump is probably going to score rhetorical points based on the china deal but if you listen to what analysts, lawmakers are saying about it, the word theyre using is underwhelming. A lot of the details havent come out. Some of the big structural changes that mr. Trump had really run on that people were hopeful he could achieve are vague, dont seem to be in this. What happens with stateowned enterprises. Thats something omitted. Its not clear exactly how the enforcement is going to work when it comes to a provision in which American Companies would no longer be forced to transfer their technology to china. So theres a lot of question marks about how significant the china deal really is. Well then, adrian, if theres some questions here and your leader pelosi, you have a decision, give wane to the president , flip side, you could say the leaders are saying, im about politics. Lets get some stuff done. Thats exactly where shes coming from and i dont buy this criticism that some in my party are saying where we should wait until theres a next democratic president to pass usmca or a china trade deal because weve got to get work done for the American People and i think it hurts both parties, both democrats and republicans if we cant get any Bipartisan Legislation going. Its also important, richard, to keep in mind that the democraticled house passed over 400 bills this cycle so far, this session so far. Everything from lowering Prescription Drug costs to dealing with the high cost of education. Its all sitting, and ill borrow a phrase from mccaskill, from Mitch Mcconnells graveyard. Theyve done nothing to address this legislation and its important for democrats and republicans to come together on key pieces of legislation, but its also important to bear in mind, this is not a sole trump victory. This is a bipartisan victory between nancy pelosi, donald trump, and his white house. Susan, is it bipartisan . It is a bipartisan victory, and it is a victory for the president. President gets to choose it. Hes the one or she hopefully will one day be the one to sit at the desk and say, i did this. But what im concerned about is, i believe that, and nancy pelosi goes into this in good faith and so does Mitch Mcconnell. Theyre professionals. My big concern is that when donald trump is impeached on wednesday, will he really go forward and do everything necessary to get these deals done, or will he just act like a screaming child . Because thats equally possible. Donald trump has backed down on many, many deals. Dont think he wont do it on this one. Charlie . Right, well, i just also want to point out that some of this stuff thats being pointed to here as a big win for trump is harmless, maybe its marginally good but its not like sweeping. Yeah, richard, well, as you can see behind me, were sort of the last ones standing here after a long day with seven of the candidates addressing the educators here in this room, and what weve seen over the past few years in protests in state capitals and city halls across the country is that educators, teachers have become one of the most powerful organizing groups, political organizing groups in the country. So this is an important opportunity for these candidates to weigh in on education broadly but as you heard from the montage of sound from the candidates today, education means a lot of Different Things for a lot of different people. It involves class sizes, resources for teachers, School Safety on the anniversary of the newtown shooting. There was a robust applause for the candidates. One of the most popular, not surprising, all the candidates vowing to get rid of betsy devos, the current education secretary and move away from the Trump Administration policies but as you heard the candidates talk about the education policy, you heard the real dividing line between the pragmatic moderate ways and some of the ambitious policies from more progressive candidates. You heard Bernie Sanders talk about debt relief, eliminating all student debt. When we heard former Vice President joe biden get on stage, he was one of the last candidates to get here. We heard him respond to that in part, his own plan to provide Free Community college for two years for all americans and he emphasized this point to the audience. And i can actually get it done and i can pay for it. We also heard from michael bennett, former superintendent from colorado. He talked about the fact that these candidates on the more Progressive Side are making hollow promises. Thats a real divide among the democrats when theres broad agreement about what needs to be done for students but it was an interesting ideological divide that was there, richard. As the full house gears up for next week on impeachment, lawmakers in the senate are now preparing for their trial. Lawma preparing r fotheir trial. Oh theres no place like home for the holidays. Last night, for the first time in more than a hundred years, the committee voted an article of impeachment against a president. For only the third time in history, the house Judiciary Committee has voted to send articles of impeachment against the president of the United States to the full house. Well, fast forward to today. History has repeated itself for the fourth time as we now await the full house vote. The senate is prepping for its trial. Todays senator juror, lindsey graham, said he expects a speedy impeachment trial in the senate. Y impeachment trial in the senate. Trump will come out of this stronger. I want this to end as quick as possible for the good of the senate, for the good of the country. And i think the best thing for america to do is get this behind us. Joining us now, josh letterman, susan del percio back with us. This reporting at the moment will be fast. Theres also a issue of Mitch Mcconnell saying he is lock step with the white House Counsel here. Some say, well, this is not a good thing to have been said. Yeah, theres been this division between the white house and the senate over how fast to move through this trial with the white house behind the scenes saying the president actually wanted to be able to have some of these witnesses called, be able to dredge up some of these things like hundredth biden, issues around allegations of the bidens and corruption, that they could do if they had a chance to have a more prolonged trial in the senate. But republicans in the senate thinking that its not politically a good strategy because it would allow democrats a chance to rehash a lot of what came up in the house impeachment process that didnt reflect particularly positive on the president. And they really want to just get this over with, acquit the president of the charges from the house, and be able to move on and into the 2020 election. So were seeing publicly now a united front with the white house working with the senate, with Mitch Mcconnell to try to figure out a game plan in the next couple of days, even though we know that behind the scenes there has been some disagreement on this. Susan, im going to play the sound from Mitch Mcconnell on fox news where he says he is coordinating, which i was alluding to on the senate trial details. And then ill get your reaction. Lets play that first. Everything i do during this, im coordinating with white House Counsel. There will be no difference between the president s position and our position as to how to handle this. Exactly how we go forward, im going to coordinate with the president s lawyers, so there wont be any difference between us on how to do this. All right. So two sides of that coin potentially here, susan. One is he is doing that and that hes trying to split the difference between what the president wants to do, as josh was reporting, versus what the senate needs to do and hes trying to signal, hey, president , i hear you, but you cant do that. I think thats the best way to communicate with the president is on television. Now, im not an attorney, so ill let paul get to the meat of even if thats ethically responsible. I have questions about it like a regular person saying were going to give you give this a fair hearing. What i think Mitch Mcconnell is concerned about is how many times the president is going to change his mind. Hes going to be in maralago for two and a half weeks. Hes going to speak to a lot of people. Whoever is the last person in his ear is someone he goes to. I think the fact that the president will be impeached and has three weeks before the trial starts. A man who is so unhinged and, frankly, just has no respect for the process will do. So Mitch Mcconnell here, paul, susan said youre going to answer this question, so here you go. Mitch mcconnell is going to be become a juror. Thats a difference obligation than being a senator of the United States, if you will, a political elected senior what does that in terms of jeopardy and whether its a good idea, bad idea. Senator mcconnell says hes going to coordinate with the lawyers. To be fair, during the clinton administration, bill clintons lawyers consulted with the democracies on the house. Theres nothing wrong with talking about how the process should work. We also you understand that like the president , the senator is a republican and hes got partisan issues. At the same time under the constitution theres a separation of powers, and so part of senators job now is to do his constitutional responsibility to determine whether the president is fit to remain in office. From the looks of it, the fix is in. His mind is made up and again, you would at least hope for the semblance, for the appearance of justice. Like they did in the clinton impeachment. Trent lock really cared about it looking like a fair process. At the end of the clinton impeachment, the entire senate, democrat and republican, stood up and applauded the people who made the process because they thought the process was fair. Quickly, paul, does the chief justice, who will be ruling over this go, hmm, what is Mitch Mcconnell saying. The chief justice has a symbolic role. He sits and decides issues regarding evidence, but the senate can overrule any of his decisions. The chief justice, William Lindquist said i did my job perfectly, i didnt say anything, and i said nothing beautifully. Josh, Say Something beautifully, 30 seconds. Well, were going to have to see how this goes forward, but, you know, a lot of republicans are not wanting to see a chance to relive all of this in front of the national media, and they just see no benefit in a prolonged, drawnout fight thats going to take place next year.
