Hospital Officials Say three of the wounded remain in intensive care this hour. The fourth is in fair condition. One Police Officer was also shot, but a bulletproof vest saved his life. Right now flags across virginia and the United States are at halfstaff on the orders of the president. And next hour, a prayer vigil will be held at a church a few miles from the scene. David gura is live in Virginia Beach all this morning. And as we look at today, of course our concern, one of them, is what is the latest with those who are injured. Reporter yeah, where he hearing from our colleagues there at the General Hospital here in Virginia Beach, there are still a number of individuals who are being treated in care at that hospital. We expect more updates on their conditions throughout the course of the evening. This press conference just wrapped up with the governor of the commonwealth of virginia, the mayor of Virginia Beach and police chief, and they nodded to the fact that those individuals are still under care at that hospital. At that press conference, which concluded just a few moments ago, a little new information. We did learn from the atf special agent in charge that two weapons were found at the scene, both of which were. 45 caliber. And the theme was praise for the officers who went inside when they got word of an active gunman. I spoke with the vice mayor of Virginia Beach, jim wood, and asked him how he is piecing together what is happening here and how he moves on from what happened. Here is what he had to say. I have to tell you, the Police Department did a phenomenal job and i cant not say anything about the fire department, sheriffs office, our 911 people and our ems people. They responded, they all train together. Unfortunately, we train for these things. But they train together. They are ready for mass casualties. They are ready for active shooters. But you never expect to occur in your city. Reporter the vice mayor telling me during that conversation that there is a real spirit of volunteerism in this community and in the ems part of this community as well, a lot of volunteers in that Emergency Response group. And the vice mayor telling me that there will be conversations Going Forward about the ability to access buildings like the one behind me, there is a need to have open and free access to government, of course a balance has to be struck. And those conversations will happen after this initial phase of mourning concludes. And right behind you over your shoulder, im sure youve been able to see and speak with some of those who have left there remembrances, flowers, notes during these spaces and places of a vigil. What are some of the note he s messages from friends, family and residents of the area . Reporter yeah,off the course course over the course of the day, people have been playing flowers just behind me. And something that many have said to me over the course of the day is this is a large city, a large community, the largest city in the commonwealth of virginia, because very Close Knit Community as well. And that is especially true of where im standing right now. Ive traveled widely in this country and few cities have this, that is to say a nexus where all of the government offices are here together on one campus. And that is what you really have here. So as the city manager read the list of the 12 individuals killed, there was a lot of recognition that these were people who were familiar with those who work here on a day to day basis. I certainly paused when the city manager mentioned that one of them was an employee of 41 Years Service to the city of Virginia Beach. So a lot of people who knew those who were killed and those injured, the folks that you mentioned as well. Those praying and singing. There will be more of that tomorrow on a sunday, another day of worship there in Virginia Beach. Thank you very much, well touch base with you a little later. Let me commend the officers, the people that ran into a building where the active shooter shooting. 45 caliber bullet s and saved many people. And there is no doubt that Going Forward that we will define ourselves as a city where love and compassion for those neighbors that we lost and their families. Lets bring in our next guest, Virginia Attorney general mark herring. Thank you for being with us as we look forward to what might be next, at the same time, you know this so well, sir, an overlap of still mourning and yet fellow virginians for you there wanting answers. What are some of the answers that you might be suggesting a week from now when were in the right place to be discussing such ideas . Well, obviously we just got an update, got the latest from the press conference. And it is beyond heartbreaking what has happened here in Virginia Beach. Virginia beach has now been touched by the pain and the senseless violence of a mass shooting. Virginia beach is a vibrant beautiful city. It is a strong tight knit city. And in the difficult days and weeks ahead, we are all going to have to do everything we can to support the families of the victims, the survivors, really this whole community. And you know, it saddens me that Virginia Beach has been added to the list of those places where there has been a mass shooting and sadly it is not the only one in virginia. The shooting mass shooting at Virginia Tech happened 12 years ago. And at the time, politicians and virginia and in washington all said the right things, you know, we wont forget, well remember, well have to do something. But 12 years later, nothing has changed. We still live in a country where this not only can happen, but does happen, and it is happening all the time. I remember Virginia Tech as you do so well unfortunately. I was on air that day. And as we got more and more detail, you hoped it never happened again. And so for those who are saying please give us a solution as we get more detail for instance on the firearms themselves, this in from reuters according to an atf special agent Sean Benedict saying two of the. 45 caliber pistols were found at the scene, one was purchased in 2016, the other in 2018. Two other firearms found at the home of the suspect. And all being said as you heard during the News Conference, the guns that were bought were done so legally. Yeah, there are a lot of things that we can do to help make our community safer. It is incredibly easy to buy firearms in virginia even without a background check. We can reinstate the assault weapons ban, we can ban high capacity magazines, we can have red flag laws so people can protect their families and communities if they or someone close to them is in a dangerous crisis or the a risk of violence. So there are things that we can do. In fact there was a piece of legislation this past General Assembly session that would have banned high capacity magazines, it was defeated on a Straight Party line vote with all the democrats voting for it and the republicans against it. So these are tragedies and these kinds of tragedies are traumatic and that trauma ripples all through communities. So as we support the survivors, support the families of the victims, and this community, we also have to think about taking some real action because we are raising a whole generation of young people who are growing up with the fear that they could be shot in church, in their synagogue, anywhere. And very quickly, mr. Attorney general, motive is still out there. What are some of the considerations youre making . Well, that is something that obviously will be investigated thoroughly by the chief and the federal investigators to identify what the motive is. But right now, you know, our thoughts are with the families of the victims, with the survivors and supporting them. And again, we need to have some real solutions. As well as my heart and our hearts here are with you, sir, there in Virginia Beach. Thank you so much. Thank you. Joining me now, retired atf special agent in charge jim cavanaugh. Jim, where are we now . Well, you know, were in an america designed by the gun lobby. How is it working out . And just like the attorney general said, you know, all these bills and nobody wants to take any action. So it will take the voters i think ultimately to make the changes unless the politicians see that the voters want it and they will vote them out if they dont get it, then nothing will change. As far as the motive, that is a good discussion there. And it is very important i think. Looking at the totality of the circumstances including the targeting, i see revenge as the highest possibility in motive here. With a little bit of power, the guy went to his workplace, he knew the people and he killed them. You know, if he was on a power motive, in other words infamy, he wanted to be infamous, he could have gone anywhere for that. He could have gone to a restaurant, a public place, killed a bunch of people and then he could gain infamy. But why does he go to his workplace. That leads me to believe that it is more of the revenge motive. It is not greed, not hate, not escape, it is most likely revenge. Of course i reseven to change that if more facts come in, if he has a manifesto that says he wants to be infamous, it could be that as well. But i think more than likely revenge. So now that we have more data, how is that different than the other 149 attacks that weve had just so far this year if you were to make some distinction here . Id make three. Silencer, silencer, silencer. You dont see many with silencers. We didnt see many murders over the years with silencers. I saw a few. And some were registered, some unregistered, some suspected killings that we could improve with silencers. But for the most part people that register their silencers are not criminals. They give atf their fingerprints, the photograph, they make an application, they have to have their application signed off by the achieved of police or sheriff. And they are generally sports man hunters and shooters. So these are not used in crimes a lot. And it would be interesting to see is it legally or illegally possessed. It must have a serial number. What is your reflection on this announcement of emmet flood as you look at his relevance to the Mueller Report and his function to handling the Mueller Report as the president is saying here . What does it say . So richard, as we all will remember, emmet flood came on board to change the tide in terms of the attitude and the response that was coming from trump and his administration to special Counsel Robert Mueller and his team. The very last coup de grace of what we could call it is the letter recently sent to bill barr asserting executive privilege from donald trump for people like don mcgahn, maybe even hope hicks, to be able to testify to congress. So floods parting shot was basically to support donald trump, his policies, his position in terms of wanting to muzzle employees both current and former from being able to speak to congress. And Mike Viqueira now joining us running to the camera as we get the news. I always appreciate it. Why now . Why is it happening now . Reporter well, i think that katie pretty much covered this. This is not unexpected. Rerp th remember that flood came in taking over for the retired ty cobb but somebody that had experience in dealing with these ethical and political issues when it comes to potential investigations or real live investigations of the president and the presidency. After all, he had worked on the clinton impeachment on the clinton side. So he had that experience. Katie referenced the fact that he is a key player or key Decision Maker in invoking executive privilege after the Mueller Report has come out now in terms of people that democrats in Congress Want to hear from. He also sent a letter just after the Mueller Report was revealed or at least the summary was released by the attorney general bill barr that sort of criticized bob mueller for not coming to a conclusion one way or the other on obstruction of justice ironically enough. He thinks that mueller should have stated one way or the other. After all, that is what prosecutors do in the estimation of emmet flood. But he is going to go gently now into that good night of sort of a punctuation mark, im sure the white house will spin it that way, as a matter of fact the president did in fact tweet this, emmet flood who came to the white house to help me with the Mueller Report will be leaving service on june 14th. He has done an outstanding job. No collusion, no okay instruction impeach the president says in his characteristic all caps. Case closed. Emmet is my friend and i thank him for the great job he has done. So certainly the president , the white house, getting out in front of this painting this as part of the plan, amicable parting. Probably from what we understand played an instrumental role in keeping the president from actually testifying in person and avoiding a subpoena from the special counsel. Joining our breaking news gang here, jill winebanks, as well. I believe we have scott long also. Jill, you heard the discussion about timing. You heard about the significance, these are all things that you know so well. What do you make of this announcement now and i guess the question might be doesnt the white house need more troops, if you will, in dealing with what is happening at the moment with the Mueller Report and what may be happening in the future given the number of investigations that are ongoing . Well, youve said it yourself. Given the number of investigations, not just the mueller russia investigation, but all of the other investigations, the white house should not be taking any breaks. And it will need all the lawyering that it can handle. It has so many subpoenas outstanding now, some of them are to the Trump Organization so they would be handled by the Trump Lawyers in the Trump Organization, but there are a number that relate to his service as president and the campaign. So there is still a lot to be done. I started making a list of the pending investigations. And i filled an entire page of my notebook as i was doing it. And i havent finished yet. So i think that there is a lot to be done and we need to just keep looking at how many lawyers he will need to keep this going. And that may be a list longer than the number of pins you have. Maybe. Maybe. It is a very long list. And that doesnt count impeachment which is definitely on the table i would say. It is something that there is a growing movement for. So that would be another element of expertise that he would have had since he had some impeachment background. So his departure seems strange with pending impeachment. Scott long, who covers the republicans for us on the hill, also with us. Feverishly looking at your phone i imagine here, scott, and reaching out to folks saying why now, what is happening, what are you hearing from the white house as the rest of our panel has already expressed this is not necessarily the best timing based on all of the other things that are happening. And we were putting on screen from the New York Times a partial count or what they were calling a count of about 29 ongoing investigations. Jills list probably including all of those and potential and probably other angles that we have not discussed as of yet. What are you hearing . Not much from the white house, but i was texting with some democratic sources on capitol hill, from their perspective, they think that this announcement is a strange timing, surprising. And they think that this is about emmet flood trying to jump ship before the ship starts to sink. So there is a concern i think among democrats, you know, how do we evaluate this, what does it mean, what does it mean in terms of trumps strategy in dealing with a lot of these investigations, you know, more than 12 at least investigations that are ongoing House Democrats probing president trump, his administration, his various business entities. And so, you know, we dont quite know, the dust hasnt settled yet and were still sort of evaluating this, but i think that another point i would also make is that lot of the white house folks, key white house folks, are moving to the campaign trail. And so there is not as many, you know, folks protecting the president in the white house, a lot are shifting their focus to the 2020 campaign that he will be launching in florida have i soon. So the president seems a little exposed right now. Katie, as we look at this debate back aforth about impeachment which includes some of the investigations whaed on screen, there is bob mueller that we cant forget even though it was wednesday and today is saturday, which is like three years ago, what is your thought after reviewing what he said in those ten minutes and what that might mean for those in america who are saying no, we dont want an impeachment. Is that ship starting to turn because of maybe what he is saying to america, look at this again . You know, richard, i think that i can speak for many people when i say that we were a little bit disappointed with the tone from Robert Mueller on wednesday. I think that we all were very excited to hear that he was going to maybe make a public speech about what he felt, although he didnt really say anything that was new news to us, but the comfort that we can derive from what Robert Mueller said was the following his reporter suggested many had not read it, which is true, i think a lot of people in congress havent gone through the 448 pages, but Robert Mueller stood by his report and he basically stood by the proposition that donald trump the fact that is he a sitting president of the United States, that the analysis would have been different. And so i think that the comfort again that you can derive from what Robert Mueller said on wednesday was that his report speaks for itself. It does suggest that he will not be inclined to want to go in front of congress and testify either publicly or privately. But i think that the ship and tide havent turned. I think the American People still deserve and want to hear and read the unredact eed muell report and there are several things that we havent learned and i think Robert Mueller could have been the actual source of that information. But in the absence of that, give us the unredacted information. And one of the criticisms coming out is that maybe the report itself wasnt the best distribution method to get it out to america if bob mueller is asking america to read it. It is not the best way. I think that he should have used plain simple declarative sentences instead of using a very strange contorted way of saying if i could have an solved the president , i would have. He should have said the evidence hoes that there has been a crime but department of justicesolved the president , i would have. He should have said the evidence hoes that there has been a crime but department of justice will not let me indict him, that is the policy, so therefore i cannot proceed with this case. That is what it really says. It does not say anything about exoneration. In fact it says quite the opposite. It says he could not be exonerated. So there is definitely a case to be had. And i want to disagree slightly with what katie said because i dont think that mueller is the best witness. The best witnesses are the fact witnesses. The people that he interviewed. Not himself. He is only a summary of what he heard. And that is important. But it would be much more important as a trial lawyer for me to present the witnesses themselves. I want to hear don mcgahn say all the things that he is quoted in the report as saying. I want to hear Annie Donaldson con sfirm tfirm the notes she tt all of his conversations. I want to hear cory lewandowski. I want to hear the people who actually had the obstruction happen to them. Mueller can talk about barrs misrepresentation. That is something that he has direct knowledge of. So that would be one thing that he could testify to. But he is not the best summary witness. I dont want a summary, i want to hear and donald trump understands the power of television. The watergate hearings turned the people and turned congressmen around. The reason that he got indicted not indicted, why he got voted impeached was because people heard the evidence. And that is what people need to hear is the evidence. It is americas deadliest shooting of 2019, the 150th shooting in america just this year. And late this afternoon, officials revealed that the suspect had a second handgun with him on the scene. We identified two weapons used, both are. 45 caliber pist pistols. One purchased in 2016, one purchased in mi pistols were pu legally. In addition atf agents assisted local police with the search warrant at the shooters residence. Two other firearms were recovered from that location. One of the two has been identified and it also was legally purchased by the shooter. So far all the weapons were purchased legally. You put those two together, what can you do . Well, we heard people say that they didnt hear the shots, that they thought that they were outside. So that the danger of silencers and the gun lobby has been trying to deregulate silencers. And the other issue is that he had high capacity magazines. In virginia, there is no law putting a limit on the magazines. We work to make the limit ten rounds. So how do we deal with the same question here, matt, in terms of silencers and because these are as we understand right now they are all legal. Right. And they are regulated. But as shannon points out, the high capacity magazines in many places are perfectly legal as well. If you go back to the shooting at sandy hook elementary school, i sat on the board of sandy hook promise, the shooter there used high capacity magazines. When he paused to change the magazines, a number of children were able to escape the room where he was. So they are incredibly dangerous in the mass shooter situations. But unfwo unfortunately what you will hear from the gun lobby is that he had the guns legally and there is nothing that could be done about this. And that is absurd. So as you go back to your organization and you had conversations unfortunately at least a couple times this week, what is the conversation about . To move forward . It is so important to remember that we are dully winning this fight. Last year we passed stronger gun laws in 20 states. This fight is being fought and we are winning. We are just waiting for the right president and congress, that cathartic moment can come, it is only a matter of time. Matt, what is the third way on this . Well, look, it is very simple. The thing that we have to do is pass sensible laws that keep guns out of the hands of criminals. The most important thing we should do is shore up the background check system which has holes in it right now. You can buy a gun on the internet or at a gun show in many states without a background check. That is bananas. We have to make the high capacity magazines illegal. We have to make sure that we keep regulation on things like silencers. There are a lot of things that we can do. But there is about 350 million guns in private hands flight. And really what is resonating with this group of people in the room who as you know tend to be sort of the more left leaning folks in the Democratic Party is going right after trump. Just really hitting him on what they perceive as his unfitness for office, obstruction of justice, that comment from the set of comments from Robert Mueller this week which should have bolstered the case for Many Democrats that the house really ought to start pursuing impeachment proceedings. So that is really what you are hearing the 2020 candidates echo. That is definitely the red meat this crowd wants to hear. All three did touch on that issue. Kamala harris who is the hometown senator, she went first this morning and she was right there on that theme. Lets take a listen. Lets talk about this socalled commander in chief. He parrots russias lies over the word of american intelligence and Law Enforcement leaders. He denies that russia interfered in the election of the president of the United States. He obstructed justice and then hired an attorney general to clean up the crime scene. We need to begin impeachment proceedings and we need a new commander in chief. Reporter and like you said, richard, because of this moved up primary, the march 3 primary, a lot of these candidates really made a point of coming out here to talk to these activists and delegates. The one who didnt come, most prominent, joe biden, who seemed to have decided that he wanted to stay away from the cattle call and kind of operate on his own plain as long as he possibly could. So that why were not seeing him. Good to be frontrunner, is it not. Reporter very nice. And cory booker just left the stage and each will come up and present their big idea that they think will improve the country. So for cory booker, he was focused on wealth inequality. And Bernie Sanders was the first speaker, and he talked about his focus on ending endless wars, the opposition to the war in iraq and said that he will do whatever he can to make sure that there is a war in iran. And it looks like senator Elizabeth Warren just got on stage. As shes getting on stage, i want you to listen to evelyn, she is activist here, listen to what she is focused on from these candidates. I want to know other than just talking, do you have plans in place to address the nights across the nation for people in general. I want those big ideas to be presented and not just talked about as a forum like this, but throughout their campaign, are you really saying what you think people want to hear, are you addressing the needs actually in the communities where people live. California for Democratic Candidates this year, not only because of the one quarter of all the delegates you need, not only because it is the most expensive state to campaign in, but because it really is the four states of california that democrats have to figure out what is the Democratic Energy this year. And when you talk about farming, immigration, fwruk infrastructure all of that resonates within the state of california. They presumably moved up their primary to help Kamala Harris, their favorite daughter there. And it will be really interesting to see how well she does. The party like other parties after 2016 with Bernie Sanders, a lot of his supporters sort of moved in to the Democratic Political machines there, to try to make them more small d democratic. So i think that there is a Left Movement certainly there. We saw that a little bit with the feinstein endorsement that they actually endorsed her opponent, the party did, last year. So it will be interesting to see where the candidates come out right now. But it is a hugely important state for a wide variety of policy reasons. And you have to be there, susan, because if you want and some experts when it comes to being a democratic strategist, it costs like, what, 5 million, 6 million just to jump into the game there because the media markets are so big. And it also depends how you tackle it. If you are a top tier candidate who has all the money, whether biden, harris, sanders, you can afford to you can afford to play potentially statewide. And you can also play strateg strategical strategically. With almost 500 delegates in play, you can make a play for maybe 50 or 100 because it is proportional to the congressional districts, it is tho not winner take all. So you can take your home state plus that. You can actually become a power player even if you are not going to be in position to get the nomination but going to the convention, you can mary ann awful lot. And you focus on a lot of day that that you cant say just immigration in california because it depends whether you are coastal, inland, north, central or southern. So many different ways of slicing this state. Absolutely. And there are so many big pieces of california. So if you look at what we call the inland empire, riverside and San Bernardino counties, you are talking about 1. 3 million democrat and no Party Preference voters. That is a lot of delegates that they represent. And so what i think well see is candidates of course will play the air wars game in terms of ads, but they have to have earned media. And they need to show up on the ground. They need to come out to riverside, San Bernardino, ontario, they need to go to the central valley, sacramento. They cant take those votes for granted. And especially if Kamala Harris and the progressives have a lock on coastal california, they have to be paying attention to inland california. Got to be there for the free stuff. And this is another data point. A million independent voters who can participate in this primary. This is a really good test understanding that this is a more leftleaning even when it comes to independents or the swing votes if you will. But you are still going to get data in terms of where is the Democratic Party if you want to get the center. I give you one better. How many seats did we pick up in reagan country in 2018. So it is a really fine line that lot of the candidates will have to walk. But i go back to the point i made before that this is it seems to be an electorate here that in many cases is really excited. As i said, they didnt go to Dianne Feinstein in the Party Convention occurring you now, but she did manage obviously to pull it out later on in the process. Because she was the institutional leader, she had the resources. So, yeah, i dont know that it necessarily today favors somebody going far left in terms of messaging. But it will be really interesting to see how they thread that needle particularly on the issue of impeachment. And impeachment and when we look at that data point on coming from Harvard Harris here, democrats specifically, six out of ten say this is what i want. Well see how it resonates there in california as they hit the stage. And it will be i mean, it is a big point right now. We dont know where it is going to be necessarily in six months. But what i think a lot of people are looking for in california is how many delegates does Kamala Harris have to get to be successful. And lets also Pay Attention to Asian American and latino voters. You will have about 2 mill mill asianamerican voters and 33 million latinos voters and that is huge. These campaigns need to get really smart and fast. And figure out their temperature this cycle.
