However, there are concerns among the president s allies that justice amy Coney Barrett pushing for her, would alienate suburban woman voters who the president needs and at the same time the president s base is energized by this, democrats are very energized by a pick like her because they think it puts the Affordable Care act and roe v. Wade in jeopardy. That is something energizing democrats. It is not clear how it will play out for the president politically. He is so far determined to try to get this through before the november 3rd election. Although there are some among his team that he should wait until afterwards to keep that hanging out to motivate his supporters to get out and vote. And Senate Republicans in tight elections. Carol, the fact that lagoa was confirmed with broader margins with amy Coney Barrett, was that as asset because she has bipartisan support for is it for Coney Barrett because it would energize the president s base . As motivated as we can be, will the infrastructure accommodate all of the people that are motivated to vote in the election . Will they cast their vote and will the vote get counted the way it should . I think it is a motivating factor. One important point to consider is this president , President Trump has reshaped the courts in ways that many recent president s have not. Almost 1 4 of the federal judges now active have been appointed by this president. Even assuming that joe, from the democratic perspective, assuming that joe biden wins, it is unlikely he will have the same affect on the court in the same period of time that trump has had. It is still important we have this conversation. Basil, nbc is reporting that democrats are coalescing the focus of health care and affo Affordable Care act and it has urgency as well as the Supreme Court takes it up after the election. Is this a smart strategy . Do you see that shifting to the argument of the Supreme Court instead of health care . No, i think it is. It is not just health care. Think about affirmative action and lgbtq rights. So many issues that this court, which is the most conservative since the 1930s. There are concerns the gains we had within the last eight years to a generation will get lost. Let me say this, justices in and of themselves do not motivate the left as they typically do the right. I think this nominee and this process may shift that a little bit so in future lengtelections will spend more time thinking about it. We will spend more time recruiting candidates to become judges. I think you will see a shift in how much justices will and judges will motivate the left and future elections. Right now, we are seeing in the new polling that President Trump is losing ground in states he easily carried in 2016. This New York Times college poll showing trump narrowly trailing in iowa. Tied in georgia. Barely maintaining a lead in texas. In ohio, a state that trump carried by eight points in 2016. Biden is leading in two new polls. If you were advising the biden campaign, what would you tell them to do to strengthen that lead . It is a couple of things. First, make sure they continue to invest in state party infrastructure. We have seen an increase of resources given to state parties across the country. Even this passing of judge ginsburg has increased democratic donations to 100 million across the country. States are getting more resources. Thats good for the bottom all the way down the ticket. That increases support throughout the democratic ticket. I also know people are talking about the lack of his public appearances. I dont mind that. I want to make sure is happening is he is focusing on the people his campaign is predicated upon bringing back. Some of the suburban white women which may be key with respect to the Supreme Court justice nominee. How does he do that . You are not bothered he is taking a low key approach. Respecting Public Health advice and doing debate prep. How does he encourage suburban women to vote for him if he is not as visible as trump with the airport rallies . It is difficult to have outdoor rallies when we criticize the president for the same thing. That is why im not concerned about him doing that. It is going to be on the policy. It is going to be on eliminating the chaos and focusing on governance. You have the parents concerned about sending kids back to school. More and more parents taking their kids out of school because of the pandemic. Trying to shore up that language and create a path forward in terms of the issues that cross both suburban and urban and rural america. I think joe biden is really good at doing that. You dont necessarily need to do that in person. You can do that virtually. It is talking to the issues that galvanized that brought people back to democratic. Morgan, what does your reporting tell you about the benefits for republicans . Confirming Coney Barrett before the election or after . Trump made clear he wants to have Coney Barrett confirmed before the election. It is clear that republicans are setting up a strategy quickly. Barrett is expected to meet with senators next week on capitol hill. I have been told we are expecting some confirmations within the next two weeks and setting up a vote for the end of october which is a very quick process. Josh, i want to turn to you now. We know barrett was a member of the federalist society. What can you tell us that group and its shaping on the court as we know it . This is the group over the last 20 years has been increasingly influential during republican presidencies in determining who will wind up on the Supreme Court. To focus on the role with the nominees is to sell it short. I would say across the board, the influence wielded in connection with huge numbers of Circuit Court nominees that President Trump has managed to get in as well as District Court nominees. It has become a kind of ideological Clearing House for anyone interested coming out of legal academia and other places in serving on the federal bench. A parallel government or parallel structure that you need to get approval for before you get a nod from a republican white house. And barrett is also part of the Christian Organization called people of praise. What do you know of that organization and is there any controversial surrou controversy surrounding it . There is controversy. It is known as a charismatic catholic group. It involves a lot of lay people. At one point, they refer to some women in the group as handmaids, which invokes the Handmaid Tale story. It is somewhat controversial. I think the pick is not as no notable for that group that Coney Barrett belongs to, but rather the issues surrounding the catholic on the court in general. Remember, when she was put on the seventh circuit in 2017, the Senate Hearing with her devolved into a fight is she too catholic and are they being anticatholic and raising questions of her catholic views. The Trump White House is gambling here and they will be seen as anticatholic and that will energy the catholic vote for the president in the midwest and down in florida. Josh, is this agreed upon that barrett will have the votes she needs and what does it mean how broadly the Trump Presidency has shaped the court . I think it does appear she last the votes. You never know what can happen in the confirmation process. Part of the reason people want to move through it quickly as they feel with brett kavanaugh, the stories moved through during. And now every day a nomination sits out there, thats another day something negative could come out. In terms of the court, it will be a dramatic shift. You have a conservative court. It was leaning 54 in the conservative direction. Now 53 with the passing of Ruth Bader Ginsburg. Now there have been moments when conservatives have been disappointed on issues like obamacare and issues like the program for dreamers where the court ruled against the Trump Administration by 54 margin. That will become less likely once the president has three conservative nominees on the bench. It will be a rare case indeed where liberals prevail in any controversy of National Significance that makes it to the Supreme Court. Lawyerori, lets talk about speed. 38 days is not unheard of, but on average, it has been longer. Maybe closer to 70 days for the justices that are currently on the court. Does it detract from the process when it is done so quickly . I think theres a risk that it could. The critical thing with the Supreme Court confirmation process is the nominees be vetted before the Judiciary Committee and before the public. We have a process which, by constitutional design, empowers elected officials. The president and senate, to make the nominations. That is the way the Supreme Court becomes part of the checks and balances that undergird or regime. The process has time to play out and have the nominee express her opinions and tell us the constitutional consequences of this choice in a way that is fully vetted and understood by the public at large. Thats the point of having a public confirmation process. If she is confirmed, what would this conservative majority mean for cases like the aca that is coming up a week after the election and roe v. Wade . I think she has a solidly conservative record in her time on the lower courts. I think that will give a pretty solid conservative majority for those opinions. I agree with josh. I think it would be a rare case that a liberal outcome comes out of this court after the appointment. What about the impact of all of the trump appointments to lesser courts . How does that change potentially the title or tilt of americas judicial system . The fact he is shaping the Supreme Court, but lower courts as well. Well, i think it will have an impact because the Supreme Court takes the cases that come to it in most circumstances. The lower courts can have a dramatic impact on shaping the range of possibilities that the Supreme Court has to work with. I think there certainly will be constitutional consequences for years to come from this round of judicial appointments. Morgan and josh and lori, thank you all very much for your time this morning. So its actually concerning that the governor chose this route to, you know, address the pandemic in his own state. Yeah. This World Health Organization official warning that the death toll could double if countries dont slow the spread. What are countries supposed to be doing particularly because in the u. S. We have more of a statewide approach. Well, yeah. As we know, you used a key word there, which is pandemic. This is not something thats localized to a certain community. This is widespread globally. As you look at that map, you know, initially states like in the northeast such as new york and new jersey were heavily hit. But because of stringent Public Health measures including shutdown, you know, the numbers have come down very, very nicely thankfully in the northeast. And thats measured by the test Positivity Rate being about 1 , if not less in new york. That is not the case in states like florida and other states around the country where the test Positivity Rate is above 5 . Some places like florida its as high as 10 . Again, who will be affected . Vulnerable populations. Mostly the elderly. People in nursing homes. People with chronic illness. People immunocompromised. So we need to we need our elected officials to follow the science and follow the advice of their health officials. Quickly, dr. Roy, my last question to you. With dr. He is set to make the announcement this afternoon. As with everything related to trump it could change at any moment, if confirmed the 48yearold barrett, who has clerked for the late Justice Scalia would become the youngest justice on the court and would cement a 63 conservative majority.
