Morning. Found unresponsive in his jail cell at 6 30 eastern time this morning. The 66yearold was pronounced dead an hour later at a new york city hospital. Three officials are familiar with the matter telling msnbc news that epstein hanged himself in his control. He faced federal charges of sex trafficking minors. He was known for his connections to financial and political leaders including President Trump and former president bill clinton. And now attorney general says hes livid that epstein died in federal custody. Hes announcing that the Inspector Department will conduct an investigation into epsteins death. This probe is different than what the fbi is investigating. We have a lot of ground to cover with Team Coverage right now on this breaking story. Nbc news correspondent Stephanie Gosk is here with me. And Kelly Odonnell who is traveling in new jersey. And greg broward. Katie tang. And lisa bloom. First, lets go to our correspondent, nbc news Stephanie Gosk who is with me. What are you learning about all of this and how it played out . Heres whats really important. And people, william barr mentioning hes got serious questions about what happened here. Among them, why wasnt Jeffrey Epstein being watched and why, according to our sources was he not on suicide watch. It was just a few weeks ago that he found injured in his jell cell, by the way, this is a federal facility. Thats whied fbi is getting involved. And we were told at the time he was put on suicide watch. So that would mean at some point between then and now, he was taken off of suicide watch. Why did that happen . Who was behind that decision, is going to be a big focus of this investigation. And do we believe that he was in the cell by himself at the time . When he got placed from suicide watch . Its a little unclear. Although we were told at the time he was found injured in his cell, that he was then put on suicide watch and in isolation. What i have learned and speaking to a former warden at three federal prisons, one of the mvc which is the facility in brooklyn can is like the mcc where he was held. When youre under suicide watch, you are literally watched 24 hours a day. That could mean someone actually in your cell. When youre taken off, then its a matter of discretion how often youre checked on. Somebody as high profile according to this warden said he would be checked upon every 30 minutes, not regularly. That person would be checked upon during surprise times. Thats another question, if taken off suicide watch, how closely were they watching him. And the New York Times is reporting he did see a psychologist fairly recently to evaluate him. Kelly, to you, as we noted, the president at one time was good friends, by his own words with Jeffrey Epstein. They have a long history. Are we hearing anything from trump so far . No, theres been no response from the president or the white house. And none is really expected. This case has certainly taken a very different turn. Prior to the death of Jeffrey Epstein, we had as part of the press corps on a number of different occasions asked the white house, asked the president directly about his interactions and his relationship with jeffrey epstoein over the years. We had limited responses to that. At the time, the president saying he was not a fan. They had been friendly. Kind of falling out, he described that as 15 years ago, also described epstein sass a fixture of palm beach where they had interaction. Its unclear the degree to which they had a friendship or business or social relationships. Certainly now that its taking on a different character of the investigation of his death, the circumstances around this, its not a white house matter in any way, shape or form. It is certainly a curious situation in the sense of this figure who has dominated so much interest. And obviously, has the attention of many people, because of the abrupt end of his life and what that means for the Victim Community here. But it is not a political story in that sense. And it is not a white house story. But it is that strange intersection of donald trump who, as a businessman and himself a fixture of palm beach had at times some kind of relationship with Jeffrey Epstein. The white house is just not talking about this. And we dont expect that they would. In his official capacity, certainly, the attorney general has a role to play here as stephanie outlined that. So, we would expect there will be southeast sorts of inquiries. But it is the unexpected end of Jeffrey Epsteins life. And in some ways that means the president may not have to say anything more about this, and his relationship with epstein, whatever friendship, they may have had years ago. Kendis. Clerks lest we forget also that epstein had his tentacles in the relationship. Alex acosta was pushed to resign a few weeks ago after facing the backlash of sex Crimes Involving epstein. I cant imagine we expect to get any reaction from acosta yet, or have we . We have not. And again, hes no longer a part of the administration. Hes now a private citizen. Okay. And i dont think that the administration is going to imagine this, the Trump Administration has lots of issues theyre dealing with. This is not one where they will add their voice where is they dont need to. The department of justice, the fbi, the federal bureau of prisons, all of those areas, theres a legitimate area for them to be areaed abou eto be c about here. In terms of the acosta piece where the federal pressure was great upon his handling he was removed from the administration, so in many ways, thats sort of the end of the story when it comes to the intersection of the Trump Administration with this case. In a much more general sense, of course, in public conversation, its easier to see why these connections draw public interest. But in terms of expecting any official responses, i think that given especially the sensitivities here and the difficult subject matter, dont expect the white house to be talking about this. All right. Clerks appreciate it. Stephanie, back to you. What are we hearing about where the evidence goes from here . On epstein, you mean. Yes. So, obviously, theyre going to be looking into the questions of how and why. But there is also the larger issue of what happens now with these victims. And we are hearing a lot of anger from victims and victims attorneys that they effectively dont get their day in criminal court. They were looking forward to it. It was a long time coming. Too long, you alluded to that in mention ago coing acosta in tha controversial plea deal in 2008. This brings an end in the case of Jeffrey Epstein. But there are the possibilities, that his coconspirators, people involved with him potentially facing charges. We say documents that named ghislaine maxwell, an alleged associate of his that she took part in and recruited alleged girls to take part with Jeffrey Epstein. It really does, and quite striking that his death came within 24 hours of those documents being released. A lot of people reading a lot into that and maybe they should not. Stephanie gosk, thank you, and Kelly Oconnell traveling with the president. Lisa, lets start with you, with some of your clients, following the news, what are they saying . Whats the reaction . Yes, i have a brief statement from one of my clients. She says, i will never have a sense of closure now. Im angry as hell that the prison could have allowed this to happen. That i, his other victims will never see him face the consequences for his horrendous actions. I hope whoever allowed this happen also faces some kind of consequence. You stole from us the huge piece of healing we needed to move on with our lives. I can tell you, we are not done. The criminal case may be done against Jeffrey Epstein. But the civil cases are only just beginning. We, initially, with my clients, we cooperated with the criminal authorities because we thought that was the most important thing. Now that thats done, we plan to file very quickly civil cases so my clients will be againcompens out of Jeffrey Epsteins estate. And im calling on the administrator of that estate to freeze the assets. Lisa, let me ask you quickly, how many alleged victims do you represent . I represent two currently. Two. When they first found out the news this morning, was did an emotional thing or what were they saying . Yes. What i just read to you was the text i got from one of my clients. Its very emotional and very upsetting to them that hes been allowed to escape justice. Why wasnt he being watched. Greg, let me bring you into this conversation. As we mentioned the justice departments probe will run parallel to this. What is the i. G. Looking for, and how this have, would you say, different than the bureaus probe . Kendis, i can tell you as a former i. G. And prosecutor, the fbi probe essentially will be aimed at what happened. How did epstein die. Is there any evidence of foul play. Whereaser the oig investigation will be aimed more at looking at the policies and procedures that govern the custody of prisoners like epstein. Whether blp followed or did not follow those procedures. That investigation, the oig investigation, is likely to take longer. And be probably more illuminating in terms of any deviations or violations of policy that may have led to or enabled this to happen. Yeah. Katie, in the meantime, you heard lisa there talking about the case will continue. And she will continue the civil case, indeed. But what do you make of the legal case, the criminal case against him . Is this the end . Is it over with . So, yes, sadly, the criminal case against Jeffrey Epstein from the Southern District of new york is done. In fact, hes dead, right, kendis . You cant prosecute him anymore. Could there have been nor evidence of conscious of guilt the fact that Jeffrey Epstein has now killed himself. We know there are going to be several investigations. Particularly all of the femur going g people are going to have investigations now that hes dead. The about the that they were cheated. And suddenly, theres a race to have all of these investigations because hes now dead, when, really, it should have been done 12 years ago, when he could have been brought to justice back in the Southern District of florida. And he could have been facing serious charges. 53 years in federal prison. The fact that he was able to escape that type of prosecution and justice 12 years ago, and now hes going to escape the ultimate justice because he is now dead is something for people to consider. But i think, kendis, whats also important is this, there is a possibility of criminal prosecution of coconspirators. We do know that there were photos that were being kept in a safe at Jeffrey Epsteins home. What were in those photos . We dont know specifically. Did it implicate other people . The pact within 24 hours he is now dead after all of that information comes out from a 2005 lawsuit brought goodness ghislaine maxwell, one of epsteins coconspirators is huge. And lets see what they have to review. I have two quick questions, lisa. As katie was saying a moment ago, there are many high profile names we expect to be named. During the civil litigation, do you imagine those names will come up as well . Absolutely. One of the advantages i have as the attorney, the discovery phase, that gives me as an attorney the power to issue subpoenas to get documents and force people to give me information and papers that they dont want to give me. I can force people to come into my os, raise their right hand to tell the truth and do a deposition in my office. The big part of compensation for victims at the end it, but its the whole process of transparency of learning what happened. And i can tell you that one of the civil cases thats already going on, the defamation case, thats what led to the treasure trove of documents released yesterday. All of the victims fighting for justice in their own ways are really contributing and helping each other. Okay. Greg, one more to you here. As a federal prosecutor, youre familiar with the sort of lockups. How does Something Like this happen . Yeah, kendis, its hard to believe that this particular defendant was not on a suicide watchtype protocol while in custody. And beyond that, if he had been on a suicide watch, its hard to understand how this could have happened. I mean, i think most you know, detention experts would tell you, if someone is on suicide watch, this simply does not happen. And so, all things considered. Trying to spur progress in washington. But there also have been moments where the frustration from the stage and the candidates speaking on it has been palpable, listen. Who in gods name needs a weapon that can handle 100 rounds . For gods sake. Let me get one last thing straight, folks, dont apologize at all about the Second Amendment. The Second Amendment says we can limit who can own a weapon. That can limit what kind of gun you can own. These guys will tell you the tree of liberty is water with the blood of patriots. President trump has told the nra, youve got a friend in the white house. That being the case, and you being the nra foe, does that mean your number one priority is to get donald trump out of the white house . Well, if you remember, i gave a speech in 2016 at the Democratic Convention in philadelphia saying i didnt think donald trump had the discipline and character to be president and abilities to be president of the United States. So theres no question about that. But he was elected. And we have to work with the president of the United States. So, i great hope is he looks in the mirror and he says, wait a second, its time to stand up. Leadership is about sometimes going against your friends. Leadership is above saying this is whats right even if its going to hurt my own political future. Sometimes i think it was jfk that said, sometimes, parties ask too much of their members. But could gun control be one of the top topics, its not right now, but could it be one of the top topics in november . No absolutely not. The only time we have these conversations is unfortunately when we have a mass shooting like we see in parkland or el paso and dayton. So, these conversations, yes, its important but were going to move on and this consistently happens so, i dont think theres enough pressure on the senate by the democrats to get things passed. Right now, senator Mitch Mcconnell has two bills on his desk right now that are not addressing banning assault weapons. Theyre more focused on background checks. And yet, you have candidates on stage talking about banning assault weapons. Why are we not enforcing and forcing Mitch Mcconnell to get those two bills through first and then get the ban on assault weapons. Yes. Let me ask you about the Republican Party and their play in all of this. A lot of people are saying that this could be a real problem issue for them. Come next year, because of those suburban housewives and suburban wives out there in pennsylvania and in other parts. Is it a weak spot for the rem can party, this issue . Oh, sure. Yeah, the politics of guns with the Republican Party are out of step with mainstream america. We see consistencies in election after election continue to speak on that. Look, elections are decided on a lot of priorities, the contrast between the two are strong . Why do we only have one republican congressman, the guy from dayton whose daughter happened to be across from the shooting last week who finally said hes in support of something happening . Because we have a generation of Republican Leaders who have been indoctrinated by the gun lobby. What i mean by that go back to bush 41 when he resigned from the nra. Because the nra adopted this absolutism. The confrontation with the government, that somehow the government was heavy handed that was going to take away guns. For generations we had republican generations that grew up in the big gun lobby and indoauoctrination of it. Congratulations, democrats for moving the bill, they did do it when republicans did not. It is far short. Even on background checks. It is simply trying to approach universal background checks in terms of transactions subjected to background checks. Its not comprehensive background checks in terms of the information we try to get on the person buying the gun. Those prosecutions that were never prosecuted. Domestic violence that was never prosecuted. Mental health records, none of that is in the bill. Its the expansion of transactions that are subject to those. But those transactions are very important, you have to think about this. Sure, of course. People are able to go to these gun shows, theyre able to buy guns off the internet so thats why its so important but just gun shows. Thats all it does. I agree fully with that. But my fear is, if republicans say, you know what, times have changed. Were going to compromise and adopt portions of that bill. And republicans declare victory and democrats declare victory. We have done nothing on weapons of war or on recorded searched before somebody purchases a firearm. Let me put this out, maybe this is why perhaps the republicans arent budging at all. Even with what happened last week. We asked the question whether last week was a tipping point. Lets take a look at this poll. In the aftermath of last weeks shootings, only 8 of people chose gun control as their most important issue. Thats after last week, going into 2020. So it begs the question, the most important issues there, health care, immigration, the environment is above gun control. Is this what the parties are looking at right now, rochelle . Why the Republican Party is looking at this and saying you dont have to do anything . Exactly. I think that they are looking at this as, you know, the Political Risk and the political gains. I mean, what do they really have to lose by not getting in bed with this whole Gun Legislation thing. Mitch mcconnell has the bills on the senate calendar. But he has not assigned them to any sort of committee which is why theyre not being debated. They have nothing to lose by not acknowledging the gun violence and legislation being pushed forward by the democrats. Thats why i say, right now, were talking about it. Next week were not going to be talking about it. If Gun Legislation was important in this country, we would keep having these conversations after parkland. After sandy hook. It would not stop but it consistently just stops. David, as you look across the aisle, so to speak, do you feel that democrats are going too far to the left when it comes to president ial candidates . No. You have only 8 in this poll saying that gun control is the number one issue. Sure, but on the policy itself, i think if youre going to realize 70 to 80 want what the democrats are offering, look, the raw politics in the election are you have to decide how to spend your marginal resources on what message. So the messaging will be around the health care and economy and those issues that poll higher. But to the question, what do republicans have to lose in their own silence . Its perhaps their own children. Look, what moved mike turner was the fact that his daughter was close to the shooting. Yeah. And i dont mean that to be graphic. At some point, who cares what the polls say, do whats right for the safety of the country and the safety of your own family. Republicans are out of step with this issue. Leave it there on guns. One last question, Jeffrey Epstein, your former congressman from florida, any reaction . Yeah, something stinking really bad. Well await the facts on the apparent suicide but something stinks. Why do you Say Something stinks . Do you not believe its a sue inside . By well, listen, i think we have to wait for more information to come forward. Strict percentages, the likelihood for suicide for this person are so slim that it would suggest something untoward has occurred. It does not say who that untoward suggestion may be. Do you think as it goes into the narrative, thats a little weird . Yes, i think well find out that Jeffrey Epstein was not sex trafficking but selling girls to very powerful men. Well, heartbreak has led to anger in mississippi, following the largest oneday immigration sweep in u. S. History. The Trump Administration directed raids across six cities at seven sites. Nearly 700 undocumented workers were detained. About 300 of them were released fairly quickly. And now hundred us of families separated. Kids without their parents. The scene, kind of reminiscent of the situation at the border. Government please put your heart. I need my dad, please. My dad didnt do nothing, hes not a criminal. I was so sad, i want my dad. He really works hard. Hes the important part of the family. Right now, my family is not okay. So, its really hard, because, you know, i never his call, but i really want to know something about him. And i dont want to be at school if i dont know anything about him. Reporter how scared are you right now . Im scared because im really scared because i dont know what to do. The people that they took over there to louisiana, and i want to know if hes over there or in jail. I love you, mom. I hope you stay safe. Kind of tough to watch and listen to all of those innocent kids who were caught in the middle of all of this, isnt it . The president addressed the issue before going on vacation. I want people to know that if they come into the United States illegally, theyre getting out, theyre going to be brought out. And this serves as a very good deterrent. E. About the 680 people detained. 780 detained. 303 were released. 337 remain in custody in detention facilities both here in mississippi and louisiana. The i. C. E. Agents make a point of saying of those who were released they actually brought them from the places they were being processed back to their homes. I can sort of bring you over here. One taken into custody, young emily here, 15 years old, she was among those who was in the factory. She doesnt work at the factory. She was there selling food. Her mother was in another location. She says that when she was inside the factory, a woman came up and started yelling run. And people started going to the exits. Right now, she is with her family. Theyre meeting with an attorney, trying to figure out what can happen. She has been in this country for shes been in this country for four years. She and her family, three brothers and sisters and mother coming from guatemala. Among those who have helped set this up is an Organization Called lulac, the legal of latin american citizens. And theyre in the process of trying to help those. Theyre quite angry with what they say has happened. Heres a statement from element ulac so you can get an idea of what is going on. Look at some of the loaded words, which is they believe that lulac has completed 80 rescue missions in recent years, providing relief, legal guidance and other Critical Services for families devastated by these rash racially and politically motivated raids. This is complete terror that theyre raining upon these people. This is the United States and theres a human rights crisis right here in the United States today. Were here today to provide assistance. A senior Law Enforcement official tells nbc news that epsteins death is now being investigated by the fbi. This comes one day after newly unsealed Court Documents revealed disturbing new details on what was going 0 on inside of epsteins homes and also revealed plenty of names that may have been involved. Joining me now is nbc news investigation reporter tom winter. Tom, youve been following this all along, i know were stunned like this when we first heard the news. Your thoughts, what are you learning right now . I think a couple of things. We really need to figure out why he was taken off of suicide watch, this incident that happened with marks around his neck was a little over two weeks ago. So, it hasnt been that long since weve learned of this possible attempt by Jeffrey Epstein. So what was it that took him off of that . Who requested that . I think thats something that we really need to Pay Attention to. At this point, we need to figure out where does this investigation go forward from here. This does not stop prosecutors and federal investigators and the fbi from continuing their investigation into people that may have conspired with Jeffrey Epstein. May have recruited these girls. So, were going to wait and hear about that. So, i think theres more questions that need to be answered at this time, as far as a, how this happened, and, b, where does this case go. Do you think it gives those other investigations new life, considering the mystery of his death . Oh, i dont think so at all. I think this just keeps it going. These were very active investigations. This was a covert investigation undertaken by the fbi here in new york and federal prosecutors who kickstarted the case that led to his arrest barely a month ago. So, i think with that, you know, with that investigation, its just now been able to be out in the open. What does that mean . Theyve been able to send out subpoenas. Theyve been able to engage and kind of talk to more people, a larger group of people. And that type of investigation, eventually, becomes public. No, i dont think it necessarily does. I think that people are outraged as long as the news cycle is outraged. Its interesting to me to see some of these celebrities telling people to cancel their memberships. If you have ever tried to get a membership at equinox like i have its between 250 to 300, if you are canceling your membership, that means youre paying for the rest of the year. Thats 3,600 that youre going to have to pay to go and cancel your equinox membership. So im not surprised that celebrities have 3,600 or whatever lying around the bank to cancel their membership. I do think i would draw the line with elected officials beginning to identify specific donors. Were told it was an apparent suicide, and now the fbi is launching an investigation into his death. His death coming less than 24 hours after newly concealed Court Documents reveal disturbing new details of what was going on inside epsteins homes and revealed some of the powerful men associated. Plus, visiting corn country, 2020 president ial hopefuls are in des moines, iowa, today making their case before voters in the important bellwether stays. Last weeks series of deadly Mass Shootings sparking some protests as well as several funerals today. But we are going to begin right here with the breaking news out of manhattan and the death of Jeffrey Epstein, the wellconnected multimillionaire was found dead by an apparent suicide this morning in his manhattan jail cell. Not only is the fbi investigating his death, now the justice departments Inspector General is launching a parallel investigation. Attorney general bill barr with this very striking statement saying he is lived and ordering that investigation to probe the circumstances of epsteins death. Epstein was found unresponsive at 6 30 this morning, pronounced dead at a New York Hospital about an hour later, and three officials familiar with the matter tell us epstein hanged himself. He had been held without bail since july 6th while facing federal charges of sex trafficking minors. We have a lot of ground to cover right now with this team, Team Coverage of this breaking news. Nbcs john than deents is joining us, msnbc legal analyst Glenn Kirschner and former congressman david jolly. Lets begin with Kelly Odonnell, you are traveling there with the president in northern new jersey, the president knew Jeffrey Epstein from some years ago. Any reaction yet . Reporter theres been no comment from the white house on the death of Jeffrey Epstein, certainly the president had a social relationship, a personal relationship with him years ago. The white house has not commented on his passing, but it is certainly notable that the administration is taking this action. The attorney general talking about his frustration and displeasure about the circumstances around epsteins death while in federal custody and the steps he is going to take to find out what happened, why it happened, especially with the responsibility the federal government had in the care and custody of an inmate like Jeffrey Epstein. So high profile, so many questions around this. Now, the relationship the president has with his attorney general is among the most close in the cabinet, so certainly there would be an expectation that the president and the attorney general would communicate about this and knowing whatever next steps would come. This is certainly high profile for all of the obvious reasons, but beyond that, it is not typically a white house matter, and in fact, we have questioned the president on a number of occasions, journalists asking him questions in some of the exchanges weve had and also asking the white house about the nature of the friendship that they have had over the years, and the president has said that he had not spoken to epstein in about the last 15 years or so. He had described him as a fixture in palm beach, the president too also similarly in that social scene in palm beach and that they had a falling out. The president saying he was not a fan of epsteins. They certainly had some friends in common, some Real Estate Interests in common, but beyond that, we dont have much visibility into the depth or lack thereof of their friendship or relationship, and its been something that the white house has not wanted to talk about. We certainly saw how when alex acosta, the labor secretary for the first couple of years of the Trump Administration, when there was renewed interest in the epstein case and acostas role when he had previously been u. S. Attorney in florida and a plea deal involving epstein when because of the recent charges in epsteins case that brought a new light on the plea deal from years ago in 2007 and 8 that of course brought a lot of unwanted attention on alex acosta. And because some of the victims in that case had not been consulted, the political and public pressure on that forced the really quick resignation of alex acosta leaving the Trump Administration. And so that has been the overlay between the Trump Administration and this case, and now it takes a new turn with the attorney general taking the steps that he called for today. It does really take a mysterious turn indeed, kelly. Turning to jonathan dientz here in studio with me. A lot of people heard this news, they were shocked by it, surprised and are wondering how can this happen. Thats what the fbi and the Inspector General are going to look into. All indications are this is suicide by hanging, and the fbi normally doesnt investigate suicides in bureau of prison facilities, but because this is such a high profile and controversial case, theyre called in and taking a look at it. The Inspector General as you mentioned, is going to run a parallel investigation. Again, this is around 6 30 this morning, apparently during rounds that are done. Jeffrey epstein was found in his cell. He was in his cell by himself. He did not have a cell mate, and he apparently had hanged himself. He was taken to the prison infirmary. They tried to resuscitate him and work on him there. They called an ambulance, the Fire Department arrived with an ambulance and took him to a local hospital where he was pronounced dead. His body is now in the hands of the new york city medical examiner where an autopsy will be done to determine the cause of death, but multiple sources say death by hanging is what appears to be the cause and the Investigation Underway into how this could have happened. Youll remember there was an incident two weeks ago where he apparently tried to take his own life. There was some question whether it was a ruse so he could get a transfer or whether it was a serious suicide attempt. Nonetheless, he was put on suicide watch for a short time for five, six, seven days, and then he was taken off it, apparently after meeting with a psychologist and placed back in a cell in isolation with increased checks, if you will, but unclear how often he was being checked on, how long he had been in that cell until he was discovered around 6 30 this morning. You have been covering this stuff for quite some time, and youre well familiar with this facility, familiar with many of the inmates who have been there over the years, el chapo, Paul Manafort whos still there, have you seen anything like this, a turn of events like this . Look, we have seen suicide, Whitey Bulger committed suicide, the mob boss in federal prison. These things can happen, if someone wants to take their own life, it is at times difficult to stop. The question i think for the mcc and the bureau of prisons now is you were on notice. There was an incident two weeks prior, and were enough steps taken to ensure the inmate who was in your custody was safe. And the other question is for the defense side, which we have not heard from, theyve been protesting his conditions, his incarceration. They wanted bail. They were vowing to appeal, and the question is being on suicide watch, youre placed in a cell with no blankets, no sheets, a smock, if you will, not even regular clothing. How long is someone supposed to live under those conditions, and was a request made after the psychological evaluation to put him back in at least some sort of restricted but more loose conditions. Yeah. That is all part of the investigation. Were trying to hear from the defense. Were trying to hear from the bureau of prison officials, but again, what exactly he used to kill himself, was it a sheet, was it an article of clothing . That has not been that information has not been provided as of yet. It is just so weird to me. As somebody who is well familiar with Mental Health issues and people who have been suicidal in the past, the conditions didnt change when he was suicidal or not or deemed not suicidal, so for him to be placed back in that prison cell with material that where he could commit suicide is insane. There are questions about that. You also know that he was having a very tough time acclimating to the mcc. He was spending hours and hours at a time with his attorneys every day in the lawyer inmate visiting room because he didnt want to be up in his cell. He didnt want to be up in this special housing unit, so literally from 8 00 a. M. , 9 00 a. M. On through the entire day, hed be sitting in that legal room with his attorneys, not going to the gym on the roof, not going to his cell or the tv room, whatever social entities are available to the inmates in that housing unit, so there were certainly some signs. The question is what were the reasonable and appropriate steps that could have and should have been taken. Well leave it there with you, thanks to both of you. Now to the rest of the panel right now, and glen, well go to you. Youre a former federal prosecutor. How could this have happened . You know, kendis, 22 of my 30 years as a prosecutor i handled murder cases, and what i will say is that i dont think anybody should jump to conclusions. Ive seen so many homicides that look like one thing and turn out to be something else. For example, if we find a dead body in a house fire, we assume it was an accident until we find that the person may have been manually strangled, murdered before the house was set on fire to cover it up. Im not suggesting this was anything other than a suicide, but i was a little bit surprised when i heard ag barr jump right out there and make a snap decision saying this is an apparent suicide and im appalled. I mean, thats ordinarily not how Law Enforcement acts. What we typically say is Jeffrey Epstein was found dead in his cell, pending an autopsy and a full investigation we have no further comment at this time. So you know, and some might say a. G. Barr has been prone to making quick pronouncements without having all the facts previously and hasnt always been accurate. So i dont think we can say definitively what this was, nor do i think we should speculate that it was nefarious and it was something that was med to loade like a suicide. What we need to do is investigate. Importantly, we need the autopsy results to see, for example, if the hioid bone was fractured, which is a telltale sign of manual strangulation, but not necessarily a hanging suicide. I think there needs to be an investigation before the attorney general starts to announce conclusions. But the attorney general did come right out and say that he was lived about it. It was a scathing statement. David jolly, i want to get Glenn Kirschner david, last hour we were talking. You were saying that youve been a former congressman from the florida area. You were well familiar with Jeffrey Epstein and the cases down there. And you said quote in here, it stinks. Expound on that. Yeah, something in it stinks and to glens point, we dont know what it is yet, but it has to be investigated. A high profile, federal inmate who clearly is key to an inevitable criminal conspiracy, we know that, is found dead in his cell. That is a statistical anomaly ha deserves an investigation. Its also important to remember why he is in custody. Its not because he had sexual relations with an underaged woman. Its because he ran a criminal conspiracy sex trafficking ring that involved young girls, and even if they agree to participate in sex acts, they were not of the age of consent to legally do so. What we also know through Court Filings is his associations and allegations of criminal sexual behavior touch on these are criminal Court Filings the sitting president , a former secretary of energy, a former u. S. Senator, it touches on buckingham palace, and it touches on men who represent the highest echelons of law, industry, and finance. We are going to find out that the Jeffrey Epstein case touches on wellknown people throughout our society. And so yes, something stinks and it needs to be investigated. Yeah, and the investigation is going to get underway. Danny, youve been listening to all of this. Youve been following this case for quite some time now. Many people are saying the case is over, the criminal case against him. Can you not prosecute somebody who has already passed away posthumo posthumously . You cannot. The criminal case against Jeffrey Epstein ends as of today. However, the criminal investigation that arises from Jeffrey Epsteins arrest and original investigation can go on if, in fact, for example, they executed search warrants on epsteins home and learned about other potential targets, those investigations will go on. The civil cases against Jeffrey Epsteins estate will go on. Those victims can sue his estate and go after that money and justice in that way even though Jeffrey Epstein himself is deceased, and thats exactly whats going to happen. Do you and really, really quickly, do you find it kind of just fishy the timing with those documents that were released yesterday . It makes it so ironic, and i understand why a lot of people online are saying what david jolly is that it stinks. Possibly, but inmates do commit suicide in custody. Pretrial detainees awaiting trial like Jeffrey Epstein statistically are much more likely to commit suicide or end their lives than those who have been sentenced and who are serving their sentence in prison. So these are folks, especially in the first few days and weeks when they arrive, the odds of them ending their own lives goes through the roof. Very interesting indeed. I appreciate it. A lot of them are focusing on gun control today, obviously a week ago that was not necessarily going to be the top topic for them . Reporter absolutely, hey, kendis, so just as you pointed out, a lot of times this is sort of an opportunity to seem relatable, to have some fun, to eat a corn dog, to ride the fair rides. This week it really sort of dealt with that serious undertone of the tragedies of last week. When i have had the opportunity to talk with some candidates i have been asking them about gun control because we know that its something here that people of iowa as you mentioned will get to caucus first on february 3rd, are concerned about. Yesterday tul ssi gabbard told its a priority for her. John delaney is in favor of universal background checks. I spoke with john hickenlooper. He was the governor of colorado at the time of that horrific shooting in a Movie Theater in aurora, colorado, and he was able to get universal background checks packessed. The thing about that is that no republican signed onto either of those pieces of legislation. I asked hickenlooper with what we have going on right now, divide and partisanship, what does he think could happen with Mitch Mcconnells senate. He did not sound hopeful. Take a listen. Im not sure Mitch Mcconnell has shown any indication that hes going to be reasonable. Hes only got to do this hes been a hand maiden to the nra from the beginning, and they provide him a huge amount of financial fire power in elections, and he makes sure that they can sell as many guns as possible. Thats a deal with the devil, if you ask me. So kendis, as you heard, hes not sounding that hopeful about whether hes going to be able to pass in Mitch Mcconnells senate. He said for him its about a lot of common sense gun reform. It makes it tough if theyre out there on top of that soap box saying were going to pass this, this, and this, and they know that they have Mitch Mcconnell in the senate just waiting for them saying come with it, bring it. One politician in iowa today whos actually not running for president , former new york city mayor Mike Bloomberg, a lot of people thought he would run for president. He decided not to. He spoke with my colleague stephanie rule today. What does it say about our country that after these Mass Shootings in dayton and el paso there were some people in the community that didnt want the president of the United States to come visit . What does that tell you about america right now . Well, number one, remember, when theres a tragedy people react in different ways, and while clearly i think the president s rhetoric stirs people up and for him to say that hes not responsible for some of this action is incorrect. You think he is responsible . Words have consequences words have consequences, stephanie. When i was mayor of new york, people listened to what i said, and they paid attention and tried to follow what i said, and they tried to follow the president of the United States. The president has got to say we will not tolerate racism. We will not tolerate the gang violence. We will not tolerate the dissent, the nastiness, and the unwillingness to listen to each other. But some say he is a racist. His words do matter. Well, you know, i can only say hes said some racist things, and hes said some nice things about racists. All right, there you have the new york city mayor, former new york city mayor Mike Bloomberg. Joining me is democratic strategist and msnbc contributor adrian elrod and Communications Adviser to paul ryan, bren bran buck here with me in studio. What kind of impact can this event have on an eventual president ial run, i guess . Well, its very important kend kendis, because first of all first real mass gathering in iowa of iowa caucus goers who will go to caucus on february 3rd for the first caucus in the nation. So its a significant moment for democratic president ial candidates. Its a fulltitime for them to their case for voters. Its also a time to go out and do what we call pressing the flesh, youre shaking hands. Youre talking to folks. Youre spending a lot of time with actual caucus goers. You have the National Press corps there and thousands of iowans who descend on the iowa state fair. Its a very important time for Democratic Candidates to get out there and make their case and to demonstrate the strong ground game that some of these folks have in iowa. Of course Elizabeth Warren, cory booker, some of the campaigns that have been investing heavily in iowa since the beginning of their campaigns, joe biden is hiring more staff. Its really a chance for folks to go out there and make their case. Yeah, and brendon, as you know they do have that corn poll that takes place there in iowa, and i believe joe biden was leading it as far as we can tell right now. Should they make any stock in any sort of poll numbers were getting, even if its something as simple as out there in iowa . Not that one in particular. Actually, a lot of the polls that we see at this point are national polls, and i think those are relatively meaningless. The ones that matter at this point are iowa, new hampshire, south carolina, and what were seeing, though, is in iowa joe biden is really strong, and he continues to hold about a 30 share of the vote and one of the issues that some people who are going to try to catch up to him need to worry about is that field of people who are not joe biden. I look at it as theres joe biden and theres a not joe biden segment. That needs to narrow pretty quickly. I think if it did narrow and it came down to someone like an Elizabeth Warren or joe biden, i think Elizabeth Warren might win that. As long as this drags out as a large pool of candidates, i think that only helps joe biden. Adrian, as i mentioned you went to that state fair there with hillary clinton. Are voters paying attention at this point . I mean, you have joe biden there who had a number of gaffes. Hes had a lot of gaffes recently. He had some pretty embarrassing ones this week out there. Should they be worried about that at this point . Or are voters not really that vested . Well, you know, traditionally kendis, voters, caucus goers tend to not get really invested in the primary until after Labor Day Weekend during the final push in the fall going into, of course, next year. But this is different because people are so focused on beating donald trump they want to do whatever they can to make sure he is not president , he is a oneterm president , and thats why i think you are seeing so many people who traditionally would not, you know, maybe be focused at this point in the primary process, be very focused. Be very engaged, and thats why i think youre also seeing joe bidens electability numbers so strong. Hes got such durability in this primary, and a lot of it has to do with the fact that right now democratic primary voters believe that he is the best person to take on donald trump in the general election. That could certainly change, and i think as we add more debates and the field winnows you will see that change a little bit. Right now this is joe bidens race to lose, and hes performing as brendon noted, exceptionally well in iowa. Elizabeth warren, of course, is incrementally closing the gap a little bit on that lead, but right now joe bidens in a very strong space. We have seen that those gaffes hes mentioned several times on the campaign trail have not had an impact on his polling results. I think the one interesting thing about the gaffe, this is the type of thing that in another era may have been a big deal. It is concerning because it kind of shows how hes not a terribly good candidate first time he ran, last time he ran he didnt do very well. I think the bar has been risen so high by donald trump as what can haves as a gaffe, the type of thing we get outraged by, its going to help joe biden. The kind of things were used to seeing him stumble on are hard for us to latch onto these days. A lot of people are saying you have donald trump bwho does have a number of gaffes, a lot of them on purpose. A lot of people are saying theyve seen joe biden over the years, and its clear that that fastball is not as fast as it used to be, and these kind of go to that narrative. Its the it goes to the old narrative that he has gaffes. Hes not very smooth on the stage, but it also reinforces that hes gotten, you know, he spent eight years or so, four years since he was in office. He looks older. He acts older. Hes actually, you know, aged. Has his day passed him by is the other question. It does appear to be a fourperson race, at least in iowa with biden on top, Elizabeth Warren as well as Bernie Sanders and Kamala Harris whos touring the state right now. Beto orourke is not in iowa, instead decided to stay in his hometown there and to join the marchers. There were many funerals that were held as well for those who died when a gunman targeted mexican people at a walmart. Nbc latino political reporter is in el paso, she was at todays march. Quite a showing there. Whats the feeling like suzanne, one week after all of this took place . Reporter well, people gathered here for the march and rally that was organized by lulac, thats the league of united latin american citizens. Its a 90yearold organization that has a long history of fighting against violence against mexican americans, mexicans, latinos and immigrants, and like you said, kendis, beto orourke is here. Hes been here all week. He led the rally, he led the march, and he was at the very front joining in the chants for gun reform now. He spoke at the rally, and he called for common sense gun reform legislation. We talked to people before the march, and i want you to hear what they had to say. I grew up in the 60s and 70s, the Civil Rights Movement and the Chicano Movement of that time, and here we are back to square one. Weve got racist tendencies as we did in the 50s and 60s and 70s. I did not think that i would ever see this again. We came here to show our solidarity and because what happened here in el paso can happen to any of us at any time. The atmosphere in this country is toxic, and it needs to end. It is likely to get worse unless we take action against it. I mean, i am trying to convince my friends who feel like their votes dont matter because i mean, yeah, its a small number of us, but if we all think that way and we all dont vote and there will be no change. Reporter so as you heard the young woman there would like very much to try to mobilize some young latinos, and that might be where we see some effect from these shootings, among younger voters, among latino voters who decide who have turned out against immigration policies that President Trump has put into place, but may decide to turn out now on the gun reform issue. I know that you spoke with several of the alleged victims. What was their gut reaction to this news . Well, shock, devastation, feeling sick. They have many, many questions. How could this have happened, and whats going to happen to me in my fight for justice . It was a pretty emotional response . Very, very emotional. I tried to get ahold of them so that i could share that with them before they saw it on the news. I will say i saw Jeffrey Epstein recently in court when i was in new york about ten days ago when he was brought in for a hearing, and afterwards i said its never too late. Still its not too late to seek justice, if you are a victim of mr. Epstein and i will say today, again, it is not too late to seek justice. Obviously he cannot be prosecuted anymore because hes no longer alive. However, there is still options in the Civil Justice system for persons who are victims of Jeffrey Epstein, and there is and we are going to continue our fight for justice and accountability for our clients who are child victims of mr. Epstein, and we will pursue that in courts of law. I can assure you that, and i can assure you that will happen very soon, and i will be speaking to more accusers who are contacting me this afternoon, but i feel for them because this is a very disturbing day for them. I could only imagine. I should mention you mentioned that its never too late, and the manhattan attorney for the u. S. Attorney for the Southern District, in fact, just released a statement saying in part to those brave young women who have already come forward and to many others who have yet to do so, let me reiterate that we remain committed to standing for you in our investigation of the conduct in the indictment, which included conspiracy remains ongoing. So theyre continuing their investigation. Theyre asking other victims and potential victims to come forward as well. Yes. A few weeks ago you announced that you had evidence against some of epsteins associates. You were hired by several of epsteins accusers, what happens now . Well, first of all there are two things that happened. Again, the u. S. Attorney for the Southern District of new york will continue their investigation, and i want to say that when i was in new york recently, roughly about ten days ago for the hearing of epstein, also some of my clients did speak to Law Enforcement and share the terrible crimes that were committed against them by mr. Epstein, and more may be doing that in the future. That investigation will continue, were interested in making sure that anyone else who enabled mr. Epstein, who assisted mr. Epstein, who may have conspired with mr. Epstein so that he could commit his crimes against children, if they did that knowingly, then theyre going to be the subject of the criminal investigation. They may, in fact, be the subject of also civil cases. Because we want the truth to be known and we want justice. Another quick question. You heard that attorney at the top talking about doesnt make sense. We had a former congressman from florida saying it stinks. What do you think . Well, i think we all deserve answers. How could this have happened . How could somebody in custody who previously reportedly had tried to commit suicide suddenly be no longer alive while hes in the custody of the jail . We deserve answers, and especially the victims deserve answers, and we intend to get them. We want to get them from the Inspector General. We want to get them from Law Enforcement. We want those answers sooner rather than later because this is just adding to the trauma that the victims are experiencing and were going to assist them in getting therapy. Were going to assist them in every way and be supportive of them. But the victims are still alive. They need answers. They need answers and well get them from the investigations. There was Something Interesting that happened this morning overseas, north korea putting the peninsula, again, on edge firing two more rockets. The president once again appearing to defend his friend, his bff kim jongun tweeting that the leader has apologized for the flurry of recent missile tests and hopes to meet soon to continue nuclear talks. Joining me to discuss this new development and the major questions that are arising from all of this is former u. S. Ambassador to south korea, christopher hill. Thank you so much for being here ambassador hill. So kim jongun has repeatedly violated u. N. Resolutions with these launches. The president says hes apologized. You know this area very well. What do you make of the dynamic right now in our relations with north korea . Well, i must say i negotiated with the North Koreans for four years, and occasionally they would bring up the issue of u. S. Exercises with the south koreans, and always i would respond that thats not on the table. That is how we make sure that our alliance is meaningful, and we are prepared to defend south korea along with the south koreans, so its pretty clear that what the North Koreans want to do is by threatening by threatening these missile launches and by actually carrying them out, theyre hoping that the president will agree to not having any exercises. That is to the view that somehow we dont need them, we dont want themes and by the way, that theyre somehow expensive. So so far i think the North Koreans have made that point, and the president seems to be buying into it even though American Military leaders have always felt if youre going to have an alliance, you better be doing exercising with the troops of the other countries. This is very disturbing and the president seems quite enamored with kim jongun and less impressed by his by the u. S. Military. And you know this area very well, so in the meantime while all these letters, these love letters have gone back and forth between President Trump and kim jongun, have the north been continuing their Nuclear Program . They have not been testing major, major missiles, but whats been happening with their Nuclear Program . Yeah, there are a lot of aspects to a Nuclear Program and even a Ballistic Missile program without atmospheric without tests, so the North Koreans have in no way canceled any of their ongoing Nuclear Program. What theyve said is that they wont do a nuclear test and they refrain from Ballistic Missile tests, although these have been Ballistic Missile tests, but of a short range. I think the North Koreans, for them its been kind of business as usual, and theyve used as an excuse the idea that we have these annual exercises, which by the way have been going on for decades, and it was quite remarkable that they went after these summer exercises that are little more than a table top process. So the North Koreans are upping the ante, and the president doesnt seem to be pushing back in any way. He has been pushing back, but hes been pushing back on south korea tweeting about them repeatedly calling them out on twitter this week. What do you make of that . Heres one of the tweets. Well, again, yeah, the president goes after our allies a lot harder than he goes after our adversaries, and his view of all our allies and now it appears to be south korea as well, is that somehow theyre not paying enough for the u. S. Security guarantee and that this is a you know, that theyve been sort of allowing us to manage their security and not doing enough. South korea has one of the best armies in the world and spends a lot of money, including money on keeping our troops there, so its really nonsense. Well start this hour for you with more breaking news. Federal investigations are under way into the death of Jeffrey Epstein. Officials say he died by apparent suicide in his jail cell. He was in federal custody while awaiting trial on child sex trafficking charges. Multiple people familiar with the investigation are telling nbc news epstein was not on suicide watch. His death comes after he was found injured in his jail cell just in late july. He was semiunconscious at the time and had marks around his neck. Sources say he was placed on suicide watch in july but was taken off since then. Epstein was indicted last month on federal charges of sex
