In public we would be at a stalemate. I understood a stalemate to mean that ukraine would not receive the muchneeded military assistance. If you are keeping track at home, bill taylor is the fourth person to tell us that there was a quid pro quo. The president did on the phone call with zelensky on july 25th. Mick mulvaney did from the White House Briefing room. Senator ron johnson said it in an interview with the wall street journal. Starting at 10 00 a. M. Today, lawmakers were supposed to hear from Deputy Assistant secretary of defense laura cooper. She was expected to tell them about the decision to withhold military aid from ukraine despite the pentagons urging that it be released. It is 2 00 p. M. Now. She has still not started. Thats because House Republicans led by matt gaetz stormed the scif, or secure room, they refused to leave, and they brought their cell phones, which is a major violation of the rules. And some might argue National Security. Joining me from capitol hill, nbc news correspondent geoff bennett. Also with me Washington Post senior political reporter aaron blake. Former assistant secretary of state and former spokesman for Hillary Clinton philippe reinus. And from the center for American Progress kelly magzaman. She served on the nsc for the bush and obama administrations and worked with ambassador bill taylor. Everybody, thank you. Geoff bennett. Steve scalise ordered pizza for the press. I was just speaking with a democratic lawmaker who called the move the republicans are doing desperate. Regardless, it seems like this testimony from cooper is not going to happen anytime soon. It looks that way, katy. And heres whats happening. Days of process arguments from republicans. Republicans have been complaining about this closeddoor deposition process. They say it should happen in the light of day. Right . Thats been their number one talking point as a means of undercutting, trying to undercut the impeachment inquiry. Well, that escalated today. Florida republican matt gaetz leading dozens of republican members of congress, none of them on the three relevant committees that are leading this investigative work. They bumrushed the room according to members who were there and told us what happened. And as you mentioned, they brought their cell phones in, their Electronic Devices into a secure area. That in any other universe is a huge violation. So well have to see how democrats decide to deal with that. Last we heard, there are six members still in the room staging something of a sitin. These republican members. Jamie raskin whos a democrat came out of that room, told our colleague garrett haik that in his view this was a strategy cooked up in part by the white house to distract from and to take attention away from that sweeping and devastating testimony from ambassador bill taylor yesterday, who connected the dots of a quid pro quo that the white house and President Trump says does not exist. And then beyond that raskin says that taylor made the point that here you have ukraine, this democratic country, fighting for independence in the face of russian aggression. They reach out to america for a hand out and a hand up and the response they get from President Trump is i need you to do me a favor, though. Raskin says that was damning. Republicans know it. And that is why they have tried to throw a wrench into this entire process and upend todays position. Kelly, i was looking at a conversation or an exchange that senator cornyn had with one of our one of my colleagues here at nbc news. And he was asked about bill taylors testimony and said that bill taylor is a credible and respected diplomat. And cornyn said, well, i dont know him from adam. I know you better, speaking to one of our producers. You know bill taylor, kelly. Can you tell us about who he is and what his credibility is . Yeah. Actually, i used to work with ambassador taylor when he was the state Department Foreign assistance coordinator after the arab spring. At the time i was the National Security council director, leading the response efforts to the arab spring. And i have to tell you hes pretty much a straight shooter. Hes very much a capable diplomat. Hes one of the best we have. And hes a man who understands the importance of security and foreign assistance to advancing our national interests. Reading through his memo yesterday i wasnt surprised to see him assert so forcefully how much the security interest was in the National Security interest of our country. What was most glaring to you in that Opening Statement that was released . The one thing that stood out to me which im not sure many people have picked up on is he makes a direct through line from the president of the United States to the chief of staff and omb director Mick Mulvaney ought foreign assistance. He actually lays out and says essentially an omb staff person confirmed during an nsc civits that the president had directed the chief of staff to tell omb to withhold the assistance. That is a pretty important fact. Draws the quid pro quo directly back to the president. Aaron, weve now heard at least four people confirm a quid pro quo. Mick mulvaney from the White House Press briefing room. Donald trump on that phone call. With zelensky saying i need you to do me a favor, though. Ron johnson talking to the wall street journal through ambassador sondland. And now bill taylor. Republicans are still saying, though, that no quid pro quo was proven. Im not sure what else i mean, how much more how much else can we get . Bill taylor certainly takes this into a different realm. In all four cases were talking about a quid pro quo. But when youre talking about what mulvaney and what ron johnson have talked about, they said basically that military assistance was being withheld because there was no investigation. They didnt actually say this was communicated. When you have the president s phone call with volodymyr zelensky, he talks about how he wants a fair and maybe suggests that these things are tied together but doesnt exactly say it in so many words, at least according to the rough transcript that we have. Bill taylor takes both of those and ties them together. He fills in the gabs that those previous three quid pro quo admissions essentially didnt include here by saying that this was directly communicated to the ukrainian government, that this aid was actually contingent upon them doing what the president wanted and that that was a politically expedient investigation. To the extent this is confirmed by other people including potentially tim morrison, who he said that he learned about this ore e from gordon sondland, who testimony, that is the kind of more explicit, more direct quid pro quo beyond what weve seen before which are pretty much in their own ways pretty significant admissions. Geoff, what was the reaction of republicans to bill taylors testimony yesterday, or to this Opening Statement being released . Is that why we saw matt gaetz storm the scif today in order to delay it . Was it a reaction to that damnidamn ing revelation . It certainly seems to be, katy. I can tell you the head of the Freedom Caucus getting some questions on reporters on the substance of the matter says basically i dont care. His response was unless bill taylor was deposed publicly, unless he was in some sort of public setting, a public hearing, that what he said, what he told house investigators behind closed doors does not matter. So that is sort of the convoluted and conflicted response that were getting from republicans who, by the way, still have not defended President Trump by and large on the merits. They have not defended his interactions with his ukrainian counterpart. Philippe, you used to work at the state department. Take politics out of it. I mean partisanship politics out of it. I agree with democrats more than republicans or vice versa. And just tell me what it says to you to have a diplomat go and testify in front of lawmakers to say that the state department was being cut out and there was a shadow campaign, an irregular correspondence led by Rudy Giuliani in order to influence politics in ukraine for domestic political benefit. Well, you know, kelly alluded to this. And you know, when i was there, i worked with hundreds if not thousands of Foreign Service officers and ambassadors, career ambassadors. These are folks that joined the state Department Years ago, sometimes decades ago. Some of them joined when nixon was president or when reagan was president or carter. They didnt sign up thinking that for the rest of their life there was going to be a democrat or a republican. So they know that their role is to execute the Foreign Policy of the United States as determined by the president of the United States. What they did not sign up for was Rudy Giuliani insinuating himself to basically break the law. And youre really seeing the character of the career Foreign Service when they wont brook it, when theyll no longer take it and they will go to congress and say this is what i saw, this is what the problems and here i am to help. And they would be doing that no matter who was sitting in the oval office. Philippe, do you see this as different than what was going on with robert mueller, that investigation . Absolutely. With mueller, first of all, it was very it was over two years. It was slow. But i think most importantly it was over something that had happened two years earlier. That happened before the campaign. Before the inauguration. Yes, there was the obstruction part but it had a feeling of in the past. What were seeing now is almost a crime in process. The phone call were talking about that the president had with the president of ukraine was only a few months ago. When youre talking about all these conversations between sondland and morrison and volker, et cetera, they were only six months ago. This is happening right now. And its happening in front of our eyes in a way thats very different because you know, when you watch the republicans storming the castle theyre not trying to open the process. Theyre trying to shut down the process. And the reason theyre doing that is because you start with the whistleblower, the whistleblower is handing the baton to george kent, to sondland, to taylor. Taylors handing the baton over to morrison. Its very clear. Its happening very quickly. And theres no no ones going down dead ends. Theyre being guided by the facts and the facts are right here. This isnt like watergate. This isnt like whitewater. Garrett haik, youre out there in front of the scif. Youre going to join us now. Thank you for that. I just want to put something up on screen that the daily caller did. They asked every single gop senator about impeachment. Seven ruled it out. The rest of them did not get back or didnt refuse td to say one way or the other. What are you hearing on capitol hill about how this is going Republican Party . This, how closely they should hue to President Trumps line and what tactics of his that they should use or not. Now, look, some of that daily caller polling, if you will, of senators reflects the difference between the house and the senate. The senates going to take more time and one would hope at least review whatever the house produces more deliberately. They will ultimately be the jurors in an impeachment trial should we get that far. On the house side we have so many more members who have either come in with President Trump or ridden to prominence within the party on President Trumps coattails. They feel much more inclined to defend him more closely and this is how they have decided to do it, with the pictures you see on the screen. Using purely the force of them being 30 of them to work their way into the scif and to shut down todays proceedings in the name of opening it up more broadly for the public and for themselves to get involved. So far we have mostly heard republicans take this route. They have complained about the process and they have tried to demonize adam schiff and nancy pelosi primarily for running it. We have not seen, and this is really what im watching for, we have not seen republicans follow the president yet in trying to demonize the witnesses. We have not seen them repeat the same language about unelected bureaucrats, radicals who are out here trying to undo the president nap would be very telling for me if republicans decide they are willing to go as far as the president has gone in attacking the people who really form the bedrock of this investigation, the witnesses themselves. As weve seen before, the defense of the president among his republican allies has been evolving. It went from stern no quid pro quos. Now were hearing from sean hannity, were hearing from matt whitaker, hugh hewitt doing different things. Lets play hannity and whitaker now. And lets be clear, the term do us a favor, well, we all have goto phrases. You know, ill say you know a lot. The president uses them all the time. Kind of a verbal aside. The president said let me be crystal clear. There is no quid pro quo. Only to a liberal does that mean there is a quid pro quo or a media type. Thats the only translation a liberal understands of no quid pro quo. Which is just bizarre. Im a former prosecutor. And what i know is this is a perfect time for a preliminary hearing where you would say cri have . The constitution sort of abuse of power is not a crime. Abuse of power is not a crime. Do us a favor is just a verbal aside. And heres hugh hewitt this morning. Ill take quid pro quos for a thousand, alex. U. S. Acquired approximately 827,000 square miles of land west of Mississippi River for 15 million. What is sewards folly . Sorry, steelers fan, its what is the Louisiana Purchase. The Louisiana Purchase hashtag quid pro quo jeopardy. So hugh hewitt is saying quid pro quos are no problem here. Aaron, its evolving. I think the hewitt tweet is a good example of where these defenses are trending in the direction of the ridiculous. I mean, the idea that governments engage in quid pro quos with one another, of course they do. Anytime theres an exchange or an agreement, thats technically a quid pro quo. That has never been the question here. Its always been understood that military aid was withheld for a reason, that maybe a meeting was withheld for a reason. The question is whether that reason is corruption, whether this was a personal favor for the president that was being tied to these various investigations. The other thing that i think is important here is that as we saw in those clips a big reason why republicans are focusing on the process here is because many of the things they have said in defense of the president like no quid pro quo, eventually we get evidence that makes those defenses look ratherre looking might come out after bill taylor, after tim morris that ts that you say today are going to hold up over time. So thats why we dont have many people willing to actually go to bat for the president when it comes to the facts on the ground. Which is why youre not hearing from a lot of senators who are saying theyre going to hold their judgment. Again, quid pro quo in this case and why its a problem. Its not in americas interest. Let someone else fight over this long, bloodstained sand. He had done a Great Service for the kurds, the same kurds who have been killed, the same kurds, hundreds of thousands of them who have been forced from their homes, all because of the conflict the president allowed to happen. Richard, whats it look like in Northern Syria . The president told us what he thinks it looks like from the oval office. But you tell us what youre seeing. President trump the way he described it you would expect to see people on the streets holding up his picture thanking them for stopping this conflict, that there should be town squares named after President Trump here in Northern Syria. That is not happening. There is nothing remotely like that is happening. People think that President Trump b trump betrayed the kurds, that he allowed turkey invade, they would not have moved an inch without President Trumps approval and that a war was unleashed upon them and that they are now losing their homeland and they are just not sure who is going to take it over, whether its russia or the assad regime or some combination. But they are certainly not thankful for president obama President Trump for having unleashed this campaign against them. Richard, general mazloum who youve spoken with tweeted this today. I just spoke with President Trump and explained to him that turkish violations of the truce that would not have been possible without his great efforts. We thank President Trump for his tireless efforts that stopped the brutal turkish attack and jihadist groups on our people. President trump promised to maintain partnership with sdf and longterm support at various spheres. Can you explain that to us . Yes, i can. Ive spoken to several senior kurdish leaders exactly about that point. I asked, you all blame President Trump for unleashing this war. Why issue this statement thanking him as hes congratulating himself on television . This is the kurdish leadership, not the kurdish people. They are obviously the kurdish leadership represents the kurdish people. But the kurdish leadership is under attack right now. They are trying to survive the night. And they are trying to make alliances with anyone who will possibly help them, including President Trump who they fully believe betrayed them. But now they are looking at the options. They are trying to survive. They see that Vladimir Putin has designs on their area. And theyre saying anyone who can help us, including President Trump, please. And what is that thank you for . That was for specifically intervening to get the turks to slow down the assault in one particular part of the border region between two kurdish cities. So yes, they did issue that thank you. Weve confirmed that. But the context is you have to think of somebody who is drowning who will reach for any rope in the water. In this case they are reaching back hoping that President Trump believing that he betrayed them might be able to give them some sort of opportunity so they can at least survive for the next few days, weeks, months. Kelly, the president also said that isis has been recaptured. The isis members that have escaped. Is that the same thing that is being said across the administration . Whats your take . Well, its interesting. Secretary of defense esper went out yesterday and said that, you know, approximately hundreds of isis detainees had escaped the prisons that the kurds had been previously running. So hes at odds with what the president is out there saying. But as i watched the president s sort of victory speech today, the thing that i could think of to best encapsulate it was another Mission Accomplished speech. I actually feel like this is going to be Donald TrumpsMission Accomplished speech. I think its going to come back to haunt him. I think there is a number of second order effects that he has put into motion now that are going to probably include turkey trying to forcibly repatriate millions of Syrian Refugees into this buffer zone which is going to cause a massive humanitarian crisis. And i just think that this is going to come back to bite him, whether its on isis or whether its on refugees or whether its the fact that russia now has a foothold in the region that it didnt have before. Where i could stand in the middle of 5th avenue and shoot somebody and i wouldnt lose any voters. Okay . Its like incredible. Never mind his voters, today the president s attorney took it a step further. He argued in a federal courtroom that if the president were to shoot someone that the law couldnt do anything about it. Joining me now, nbc news justice correspondent pete williams. Pete, how did this come up . Why did it come up . Well, of course it came up, it was raised actually by a lawyer for cyrus vance. Now, this was a hearing before a threejudge panel of the 2nd Circuit Court of appeals. This is a fight over a subpoena issued by the d. A. s office for two things, for eight years of records in President Trumps Accounting Firm and about three years worth of records from the Trump Organization. The d. A. Is investigating whether any laws were broken in the hush money payments that were paid to the two women who claimed to have sexual relations with donald trump before he was elected, a claim that he has denied. So what the position of the Trump Lawyers is, he is immune from the criminal process. Now, a lawyer for the District Attorney said, well, that cant possibly be true. If the president were to shoot someone on 5th avenue, surely he could be questioned, he could be arrested, maybe he could even be charged. And this is an issue that no court has ever actually decided. There are many opinions by the Justice Department under president s of both parties that say a president cant be indicted while in office. And you may remember this was a big issue in the mueller investigation. And so this 5th avenue thing was actually raised by cyrus vances lawyers. And then trumps lawyer was asked, is that true . If he shot somebody on 5th avenue, there couldnt be a criminal ore couldnt be arrested . The lawyer said yes. Two things about that, katy. Number one, this is sort of an unremarkable position, that you cant indict a sitting president. It doesnt mean theyre beyond the law because there are two things that could happen. One, a president could be impeached and the second thing is when donald trump or any president was no longer president then that person could be charged. And they could be removed from office by impeachment and then charged and so forth. So theyre not beyond the law. But its not the point the lawyer is making is everybody seems to agree that you cant indict a sitting president. Heres the question before the court. How far out does that immunity extend . The lawyer for President Trump says all the way to the beginning. You cant subject him to any part of the criminal process. What the d. A. s office is saying, well, surely he could be subpoenaed for documents. Maybe he could even be questioned. Even if he was never charged with a crime. So thats sort of the issue here. And undoubtedly its going to the Supreme Court. Do you think this is going to get decided one way or the other going forward, that this doj memo will no longer be a memo, the Supreme Court will have a ruling on the books that says the president either can or cannot be indicted . Well, its possible. This case actually doesnt raise that question. If you stick to the bare facts of the case, its can the president be subjected to a subpoena for things that happened before he became president . Now, the checks were actually made out to reimburse Michael Cohen after the president was elected. But you may remember in 1974 president nixon had to turn over white house tapes in response to a subpoena. So there is some precedent here to say that a president is not beyond the reach of a subpoena for evidence. There are other factors at work here. No one is asking specifically the president for nif his documents. These are subpoenas for the Trump Organization and to his Accounting Firm. As one judge asked today, it cant be intrusive on the president s time. He doesnt have to do anything. These arent requests for him for documents. But in any event, its headed to the Supreme Court. Heth they wou whether they would actually get to the point of ruling whether a president can be indicted or not given the court likes to take these things a little step at a time id be kind of surprised about that. I think it thats not where it would end up but it would end up on the question of whether theyre immune from even subpoenas. Pete williams. Thank you so much. We appreciate it. You bet. And two businessmen with ties to the president s personal attorney Rudy Giuliani were in court today. Igor fruman and lev parnas were arraigned on four charges including Campaign Finance violations. Both pleaded not guilty. They stand accused of funneling foreign donations to the campaigns of trumpsupporting candidates and Political Action committees. After their indictment last week giuliani admitted he hired the pair to help him dig for dirt on joe biden in ukraine. As he exited the hearing this afternoon, lev parnas maintained his innocence. Many false things have been said about me and my family in the press. I look forward to defending myself vigorously in court, and im certain during the time truth will be revealed and i will be vindicated. In the end i put my faith in god. Thank you. Today an attorney for parnas also raised his concerns that some of the evidence seized by investigators could be protected by executive privilege because parnas was working with giuliani, who was working with the president. And back in december of last year President Trump said hed be proud to shut down the government in order to force funding for his border wall. What followed was the longest shutdown in u. S. History, culminating in 35 days of furloughed and unpaid federal workers. With funding set to expire on november 21st, we could see government close again soon, this time over impeachment. According to nbc news, the Political Class in washington is beginning to plan for the possibility or the likelihood in the eyes of some that President Trump will shut down the government to try to turn Public Opinion against House Democrats and their push to impeach him. Joining me now, nbc news Digital National political reporter jonathan allen. So last time the president did this, jonathan, it didnt go well for him. He was trying to blame democrats for the shutdown. He had that faceoff with nancy pelosi and chuck schumer. And the president was blamed for the shutdown. It was politically painful for him. He was advised beforehand that it would be politically painful for him. During the shutdown republicans in Congress Told him they were suffering political pain. It dragged on for 35 days. And then finally there was a solution that removed that political pain. And what the president did at the conclusion of that was to move the money that he wanted for the border wall from another appropriations bill, which resulted in a series of court cases. So i think what youre seeing here with this possible shut peachdown, if you want to call it that, this coming potential cluster of chaos on capitol hill, is the president looking for anything that will break up the narrative of these depositions, of the sort of drip drip and maybe eventually a big anvil drop of the house actually moving toward impeachment and these senators who have been reluctant to say what theyll actually do come time to judge him. It is no coincidence that republicans stormed this secure facility to stop witness interviews literally the day after ambassador bill taylors devastating Opening Statement that indicted donald trump in a quid pro quo. They dont want to hear from d. O. D. Official laura cooper today because shes going to cooperate parts of that devastating testimony. Thats why theyre acting out. Thats why theyre acting like children. So what holes are you trying to fill now . You had bill taylor yesterday talking about omb. He was talking about john bolton. He was talking about conversations he had with gordon sondland. Who are you going to call in . What are you going to subpoena in order to fill some holes that bill taylor opened up . So bill taylor in his Opening Statement very clearly said a number of instances that the military aid as well as the meeting between the ukrainian leader and donald trump was conditioned on the ukrainian leader investigating the bidens, investigate the Democratic National committee, and that he had to announce it publicly. Laura cooper today is going to testify that she knew about parts of what bill taylor talked about. In addition, one of the fundamental lchlts u. Elements o Foreign Policy is pushing back against russian aggression. Uk vane at the tip of the spear. And the d. O. D. Did within 24 hours of being notified this aid was being withheld, an analysis showing this aid was critical and necessary. Laura cooper was involved in that analysis. Are you going to be subpoenaing anyone from omb . Are you going to be subpoenaing mick mull vaipy . Because bill taylor also said that on a video chat while he was in ukraine and video chatting back here at home there was an omb official who said off camera that they were told not to release the aid and that that demand, that directive went from the president to the chief of staff to omb. Im glad you brought up Mick Mulvaney. The other thing that bill taylors Opening Statement showed is that Mick Mulvaney was telling the truth during his press conference when he said there was a quid pro quo between ukrainian and donald trump and for us to get over it. In terms of subpoenas, i think we want to see if people come in voluntarily. If not i wouldnt be surprised if subpoenas went out. Who do you want to see . Id like to see anyone who can talk more about the quid pro quo that ambassador bill taylor laid out thats been put in a summarized call transcript that the white house released as well as the Text Messages ambassador volker put out. Theres already a huge amount of very damning evidence against the president. At some point were going to conclude this investigation and then move to public hearings just like they did in watergate. Well, he had this really lofty pitch that he came in with, saying that if you allow facebook to do libra with this coalition it will increase americans position in the world versus china, in terms of our financial innovation, it will also help address income inequality in the United States. And people have heard promises like this from facebook before. Remember connecting the world . I mean, that was the facebook mission. But it also brought us all these problems with facebooks growth like the spread of misinformation and election interference by russia and all of these other issues that have really caused facebook to lose trust with the public. They insist on calling themselves a platform even though they act much more like a publisher of content. Which is why i guess they think they can get away with allowing politicians to put whatever they want on facebook regardless of whether or not it is true. How do you respond when Lawmakers Said you cant do, that youre going to misinform millions of americans and negatively affect politics . Well, zuckerberg is talking about this like its a free speech issue when really its not political speech, its not about facebook is a private company and facebook has algorithms that give prominence to speech that is particularly outrageous or controversial. So in this world of allowing every kind of speech they are actually promoting the speech that tends to shock people. And so theyre really not addressing that. And overall i would say facebook talks about itself not just like a platform but like a humanitarian he has a hard time not coming off as pretty shady, frankly. And zuckerbergs having a hard time not coming off as if hes hiding something. I mean, it seems like theres an ulterior motive there because on the face of it allowing politicians to lie on facebook doesnt really make sense. On the face of it allowing foreign actors to influence people on facebook doesnt really make sense. On the face of it allowing child pornographers to more easily use your platform doesnt really make sense. Well, it makes sense if youre a business, right . Because the less you police on your platform then the less you have to commit resources to doing that kind of work. So as facebook moves to an encrypted platform and messaging in particular, as they try to build Artificial Intelligence tools to Police Speech on facebook, that is a smaller human investment. So its to facebooks benefit to say we want to be the platform of free speech. Its i feel like they have the upper hand because they have three very addictive platforms. Facebook, one. About being a man of your word. With what they say was the upbringing of donald trump. Biden said his father had to do the longest walk to talk to the family about having to move because they couldnt find work. The longest walk President Trumps father ever had to do was to deposit money in his bank account. So this was a contrast they always welcome much more about the general election than the primary election. But its also a primary election argument. They argue that joe biden is one of the unique democrats in this race, if not the only one, who can carry a state like pennsylvania which was critical to trump in 2016. He said hes listening to the people and acknowledged that chiles governments, including his own, have failed to see its problems.
