Trumps remarks come as lawmakers are less than 24 hours away from gaveling in one of the most highly anticipated hearings on modern day politics. At 8 30 a. M. Eastern time tomorrow, Robert Mueller will go before the House Judiciary Committee and then before the House Intel Committee at noon. For democrats who are seeking to build a public case against a second term for the trump presidency, the stakes couldnt be any higher. As nbc first read puts it, the testimony represents their last best chance at selling the middle of the electorate that muellers report contains damaging information about President Trump and his team. As few as 10 of voters say theyve actually read the report. Democrats want mueller to bring his 448page investigation to life, particularly for swing voters who may not have paid attention to this. They hope mueller will make it clear he absolutely did not exonerate the president as donald trump himself insisted he did. But democrats are facing an uphill challenge on multiple fronts. Front one, mueller himself remember he was subpoenaed to appear before congress and hes made it clear that any testimony would stick to the confines of his report. Democrats, of course, would love to have more than that. Front two, attorney general william barr and his doj. The department of justice sent a letter to mueller demanding he stick to the report and only the report. And front three for democrats, their colleagues across the aisle. According to nbcs ken dilanian, republicans plan to spend their half of the two hearings attacking the premise of the investigation and highlighting what they and their base have come to believe without evidence is fbi misconduct at the heart of the probe. So todays big question is, will democrats be able to weaponize muellers testimony against President Trump . Joining me, nbc news correspondent ken dilanian, Columbia University adjunct professor and former federal prosecutor anne marie mcavoy, New York Times chief White House Correspondent and msnbc political analyst peter baker, and politico Senior Writer and msnbc political contributor jake sherman. Ken, lets start with this new news were just learning that Robert Mueller has asked that a longtime aide be sworn in as a witness during tomorrows hearing with the House Judiciary Committee. What more can you tell us about that . The aides is aaron zebley, Robert Muellers chief of staff. An accomplished counterterrorism investigator in his own right and Robert Muellers chief of staff during the mueller investigation. And they are asking that he be sworn in to sit next to Robert Mueller during the Judiciary Committee part of the hearing. Its not clear thats going to be able to happen because of congressional rules. And to do what . And to say what . Well, i mean, you know, Robert Mueller is 74 years old. He oversaw this sprawling investigation. Its conceivable he doesnt know the answer particularly with the details to every question and a guy like zebley could help him answer those questions and inform the public if only members of congress would let it happen. What do you make of this request . Its unusual but not surprising. There is a ton of information. The report telitself 448 pages. Hes not going to remember everything. He can have someone there that can switch to whatever page he needs to be on or write a little note next to him or answer a question if he doesnt know the answer. He was, in large part, the figure head. He ran the investigation but i think the daytoday operations were run by Andrew Weisman and folks doing the daytoday operations on the ground. In terms of the hearings itself, it seems like democrats are trying to manage expectations here, right . Given all the things that i just said. What are they telling you . They would love for this hearing to be a transformative moment and to really change Public Opinion about donald trump and russia, but they dont expect that to happen because they know the country is pretty much dug in. Their minimum hope is this information could affect the swing voters. People that are going to decide the election. Many of whom not only havent they read the Mueller Report. Half of the American Public had not even heard anything about the Mueller Report. Just to have Robert Mueller out there reading and discussing his findings while millions watch on television could be a victory for the democrats. Ginven the stakes, how is eah side preparing . Let me add one thing to ken said. I think republicans are going to use this moment that democrats are allowing or might allow what theyre calling a secret witness to come to the table to discredit the hearings by saying theyre playing games with the assistance of democrats. This is how republicans are going to play it. Theyre playing games and trying to rig the process to give mueller a doover to reframe the entire argument against the president. Youre already seeing the beginnings of that. But it provides a challenge for both sides because if there are two people there, theyll get far less from mueller who is the public figure. Democrats have hitched their wagon to Robert Mueller. If there are two people up there, theyll be tussling over who is going to answer the question, who is better prepared to answer the question. Democrats want to hear from Robert Mueller. Theyve been saying to us behind the scenes, people dont necessarily read the book but theyll watch the movie, right . Bob mueller is the main character here. And he is who they want to hear from, not his chief of staff. Not one of his top aides, but him himself. Peter baker, as the Editorial Board of your paper pointed out today, nobody should hold their breath this will be a turning point or produce any shocking revelations, but is there any concern from folks at the white house that people who didnt read the book will watch the movie . I think the white house feels really comfortable about this in the sense that the president is hes sowed the field and hes had three months basically since the Mueller Report was first delivered actually four months since it was delivered to the Justice Department. You know, he has every single day, including today, practically, given his framing of that report which boiled down to four words. No obstruction, no collusion, even though thats not exactly what it says. If Robert Mueller sticks to the four corners of this report thats already been out there, you know, the white house feels comfortable that that conversation has already been had. That people have already pretty much dug in to where theyre going to be on this issue. Either for or against or you know, concerned or not. They know where theyre at. They dont think theres a great middle that can be persuaded . Theres not a great middle in america when it comes to donald trump. People feel strongly about him one way or another. Doesnt mean their votes might change or minds might change. What they want to do at the white house and youve seen this in the last few days is make this election next year about who his opponent is going to be. The democratic socialists who represent an antiamerican view of what the United States will be. Ruin the economy trump has built and so on and so forth. The people who are concerned about the russia, you know, contacts that were made, concerned about the obstruction of justice elements laid out in the report, theyre already there. And thats not going to change a lot of minds. Thats the thinking anyway. Life is always different. Thats why we watch. Very late yesterday, a lot of people woke up to this, the doj setting parameters. They said he cant discuss redacted portions of the report. Cant discuss findings or conclusions regarding uncharged individuals. Cant discuss investigative steps or decisions that arent already public. Heres how the former fbi general counsel jim baker reacted to that news in an interview earlier today. Clearly they want to make a record about what mueller can and should testify about and what he cant talk about, at least in their minds. But the problem is bob mueller is now a former Justice Department official and the letter is not really binding on him. He can ignore it. Not binding. Anne marie, could Robert Mueller just say, youre not the boss of me . Potentially, but the letter from the Justice Department really points out, its a warning letter, but its actually written in response to a request from mueller to get clarification as to what he can talk about. You have grand jury investigation. And it points out theyre not waiving privilege in this case. So that may be part of why they have somebody now who may be alongside of him to kind of nudge him and say dont go into that. Thats outside of the report. But as you may recall, when mueller gave his little press conference he said im not going outside the four corners of the report. And thats essentially what the letter from the doj says. It also says theyre fine with essentially if he doesnt want to testify, theyd be okay with that, too, saying its not necessary that he testify. Hes got a little backup there . He does. Yesterday the president suggested hes not really interested but he might watch a little of the hearings. What do you imagine is going to be going on at the white house during those hours tomorrow . Oh, yeah, id be surprised if he doesnt watch a significant portion of it. First of all, hes a tv hes a tv aficionado. He watches big moments in part because i think he just sort of likes to grade and judge how other people handle big moments like this, even if he wasnt personally involved. Hes going to want to react to what is said there. Hes going to will he live tweet, peter . Probably not. We have often thought he might during previous occasions like bill barr or michael cohen. You can see him tweeting something in the morning. President ial harassment or whatever. But during the event he tends to wait until later. Get thoughts and see where he wants to take things. Watch fox news and see how theyre taking things. I wouldnt expect him to tweet during the testimony but maybe in the morning before. Today the president is stepping up his attacks on four freshmen democratic congresswomen of color and coining a new phrase that im guessing youre sure to hear again. Hes also aiming his latest political firepower during an event for teenagers. Beginning with his new favorite target, michigan congresswoman rashida tlaib. I watched just this morning this tlaib who elected her . Shes screaming like a total lunatic at one of her rallies. This is not a sane person, folks, when you look at that. And this is what were up against. And i call it aoc plus three. Just call her cortez. I dont have time to call her by the whole name. Its too long. She called our country and our people garbage. One of his attacks, who elected her . That would be voters in her Congressional District with 84 of the vote. But turning point usa, that group of teenteenagers, conserve teenagers, clearly his attacks were met with a receptive audience. This honestly, watching it here at the white house, felt more like a Campaign Rally from its length the way the president veered off onto a variety of topics, veering from the script in front of him to raucous and ad adoering applause from the crowd. The president spent a fair amount of time on attacking these socalled squad. One point calling them aoc plus three with his attacks on rashida tlaib, comparing her to a crazed lunatic, seeming to draw some attention. This is now, i think, day eight or nine of the president leaning in to these attacks on those four freshmen progressives starting with that tweet last sunday. This is clearly something he thinks is politically advantageous for him and so do the people around him. His allies, his advisers. Other branches of republican arms around the country and here in washington picking up on that and trying to link these four progressive lawmakers, make them essentially the face of the Democratic Party. The president sees this as a winning strategy. My prediction over the next year plus as well consider this a 2020 Campaign Rally, right, or similar to, you will hear this now thematically included in probably every one of the speeches President Trump makes from here on out, chris. He is known to say things around young people that other products would not have. Remember the annual boy Scout Jamboree when he talked about the swamp, the economy, the electoral college, the use of the phrase merry christmas, which he doesnt like when people suggest you shouldnt say merry christmas. And also, as i recall, the hottest people in new york. I mean, most of these folks, obviously, cant vote but they are of his political persuasion and im guessing theres going to be no criticism the way there was during the boy scout thing. That encapsulates it in a nutshell. The jamboree its called back a couple years ago was intended to be or always seen as a nonpolitical, nonpartisan event. Something president s would go to. The president then was going to and it was expected it would remain nonpartisan and nonpolitical. Thats very much not what this is. Turning point, the convention here and the gathering is explicitly and meant to be a gathering of people who are politically engaged. Who are sort of sievically minded if you will on the serve conservative side. You saw that on the president s side when he talked about how he felt like conservatives in high schools and colleges around the country were having their free speech be stifled. If passed, the bill would raise the debt ceiling all the way until january 2021, or the start of the next president ial term. It would also increase Government Spending caps by 320 billion. Yes, with a b. Well, the deal would stave off the looming fiscal crisis. Its pushing annual deficits toward a trillion dollars a year. So throw in more red ink at the total national kebdebt for the t of trumps term. It was during his campaign he vowed he would eliminate the entire multitrilliondollar debt over eight years. He has also promised not to run a deficit while in office. This is the latest example of the president changing his mind. The debt ceiling, the 2020 census threats, the i. C. E. Raids that barely materialized. As dana milbank writes in the washington post, not since the paleolithic period perhaps, as a man had quite so much daytoday caving experience. Dana milbank and former Florida Republican congressman and msnbc political analyst Carlos Carbello. I guess, dana, if we want to say this is another example of the president changing his mind, you might have stronger words for it. Im not so sure its that its a matter of him changing his mind but that hes forced to because he comes out and wants to do something. Hes basically saying this is his position, and hes forced to climb down whether its the Supreme Court or the democrats or china or mexico. So i think weve seen this as an increasing pattern in the last its been going all along but in the last couple of months. Weve seen it again and again. Hell come out with a big and bold position that seems to excite the base only to climb down at the end of it and this huge turn around is the latest. Not that im complaining. From where i sit, its a good thing that hes not following through on threats to deport millions of people from the country or attack iran. Carlos, the president calls this deal a big victory with no poison pills. Arent republicans the ones who were supposed to care about the deficit . Its ironic because the president avowed never to sign one of these big budget deals again because he said they include too much spending. I think most americans have probably figured out by now the party that cares about deficits is almost always the party that is out of office. So definitely republicans have added a lot of red ink. This is not a good path the country is on. At some point in the future, someone is going to have to pay for these bills and a lot of young people today are going to be wondering who piled all this debt on them. He didnt seem particularly enthusiastic about the bill. Heres what he said earlier today. I think its a deal that well get through. I think people are signing on, democrats and republicans. It isnt everything we hoped for but it got through the debt ceiling. Defense strength was maintained. No restrictions on border activity so its a pretty good deal under the circumstances. Thats the way id put it. Not exactly what id call a resounding endorsement. Thats the nature of negotiation. I think we have to understand, chris, thats the way our government is designed. Whenever there has to be a big bipartisan negotiation, people are going to leave and theyre probably not going to be enthusiastic. The problem a lot of members of congress have with these kinds of deals, though, is that they are cut by a very small number of people. Most have no say in terms of what the budget is going to be. This was cut by donald trump, chuck schumer, nancy pelosi and Kevin Mccarthy and that leaves out almost all members of congress. Thats one of the signs that our system is broken that individual members of congress dont really have a say in terms of our national policy. Yeah, i mean, dana, are democrats to blame here as well . Well, sure. This is isnt a new problem. Its been going on for decades and getting worse under each successful administration. This time you had a president who came in as you noted first saying he would eliminate the debt entirely and then said hed cut it in half. Of course, were going in completely the opposite direction. Im seeing no sign of anybody putting on the brakes anywhere into the country where you just implemented a huge tax cut. Its entirely going in the wrong direction fiscally. Carlos, fox news host Laura Ingraham tweeted her disapproval of this. Weve seen the president change his mind before, frankly, after speaking of danas column. Speaking of outside pressure, undoing the cave. I dont think anything thats going to happen here thats going to change the trajectory were in in terms of how much spending is going on. The president certainly going to hit a speed bump with his base on this issue. Number one, because he promised not to do this. Really . Do you think so . They seem to forgive a lot. I said a speed bump. A little one. Little tiny one. It will pass quickly. And also because of the deficit spending. There are still some republicans in this country that really are worried about deficit spending and that understand this isnt sustainable. And that understand that this government has to start making tough decisions at some point or anoth another. If we want to keep spending at these levels well have to raise revenue for our country. This bill should come to the floor, but until then, i will object. Stewart scorched the libertarian senator for that objection on fox. Its absolutely outrageous. Pardon me if im not impressed in any way by rand pauls fiscal responsibility virtue signaling. He stands up at the last minute after 15 years of blood, sweat and tears from the 9 11 community to say that its all over now. Now were going to balance the budget on the backs of the 9 11 First Responder community. Mitch mcconnell promised weeks ago to bring the bill to a full vote before the august recess. A vote that will now include some amendments. Joining me from capitol hill, nbc news correspondent geoff bennett. Lets start there. This house bill passed by a wide margin last week. How is the Senate Vote Expected to go, and what are these amendments . Chris, the senate is expected to pass this bill. You have 73 senators now sponsoring this legislation. Thats one indication of the wide support this legislation now enjoys. You see krifrten gillibrand there holding the floor of the senate. Shes marshalled this latest effort. Shes the junior senator from new york, but you mentioned those two amendments. One issued by senator rand paul. The republican. He said he was concerned about the impact the spending would have on the deficit. He wanted the money to pay for this reauthorization of this bill to be off set or paid for by cuts to things like medicaid. Also mike lee. He said this bill should be funded on tenyear cycles to line up with the tenyear congressional budgetary cycle. But heres the deal. This is important. For those First Responders, those men and women who rushed into the towers and who were there for weeks and months helping to clean up that pile, they, as theyve been going through treatments, have had to come back from new york. New york to washington, back and forth, to in effect beg members of congress to give them the money that they are entitled to. Ive been covering this story since 2015. Back then it was called the zadroga act. Youve had the same reauthorization fight come up. And today, in the course of our reporting, i talked to a guy, hes a member of the nypd, now retired. But he was there on 9 11. And he now has cancer in seven parts of his body. He was there in the pile in the days later he was responsible for identifying the remains of his brothers and sisters in the police force. He now has cancer in seven parts of his body. Hes going through his 59th round of chemo. So when this bill is reauthorized, and we say its going to be permanently funded, its really funded for 70 years. And what that means is that these First Responders and their families no longer, once the senate votes on this bill, no longer have to come here and basically shame members of congress into doing the right thing, chris. Geoff bennett, thank you so much for that. I want to bring in the president of the International Association of firefighters, haro harold. Thanks for having me. This has not been a quick fight for this funding. Are you feeling hopeful now at least that these First Responders are going to get the help that they deserve . Well, im confident now that the vote will occur. The bill will pass. And it will finally become law. Hopefully the end of a 14year journey and the beginning of assuring that all of those that served our nation worked on that pile for the days and weeks and months that followed. Not just members that i represent, firefighters, emergency medical workers, but law enforcement, building trades, so many that worked over such a long period of time in a horrendous environment. Theyll finally be assured that theyll receive the benefits and the care and the compensation that they have earned. And not to be required to come back to washington, d. C. , again in five years and beg for this kind of protection and coverage. Just to give people some perspective, you and so many of us who care about it said goodbye to the 200th firefighter to pass away from a 9 11 related illness, on top of the 343 who died on 9 11. Thousands more are sick. So give us the big picture here. How critically important is this compensation . Well, first of all, the 343 fdny that were lost on that day and now the 200 that have been lost and died from 9 11related illnesses, this is just a measurement of the incredible sacrifice in new york, but this was a national effort. There were firefighters and First Responders that came from virtually every single Congressional District that worked in new york and worked at ground zero over the weeks and months and were exposed to these environments. And so that its really tens of thousands of those that have been subjected to the carcinogens and the toxins that they were exposed to. By the way, being told by our federal government that it was safe to work in at that time. So this is a this has a profound effect across the entire country, beyond just new york. Are you surprised by how hard this fight has been . Did you think there would be the kind of objections we saw, for example, from rand paul . Well, rejection the objection of rand paul and mike lee, just kind of the last of a series of stories unfortunate stories that weve had to face going back 14 years. This journey started in 2005. And it took until 2010 to finally get a congress to authorize and to finally pass the zadroga act. And then five years later it took another extraordinary effort against a lot of odds and opposition to get it extended, although the compensation portion was not extended. And now back in washington, d. C. , trying to get congress to do what it should have done in the first place. Everybody that served this nation that was on that pile, they didnt ask any questions about how long theyd be protected and when theyd be protected. They served their country. They served their nation. They served that city. Youd expect that congress would simply do the same thing without any fanfare. I think what mike lee and rand paul did is nothing less than theater. And i think its a shame that theyd use this proposal to allegedly make a point of principle which i view as just a theatrical stunt knowing theres overwhelming support for it. Now hes trying to distance himself from his vociferous support for that bill which critics claim exacerbated Racial Disparities in our Justice System leading to mass incarceration. Today hes unveiling a new criminal justice proposal, thats a far cry from his tough on crime policies of the 90s and releasing it before next weeks president ial debates, although, clearly, from what were seeing today, its not going to ward off criticism from some of his fellow democrats. Joining me now, leah wright and the president and ceo of the center for american progress, nira. So what do you think . Can biden pull off an aboutface on this . I think the issue really is that he has a variety of proposals. Those proposals to actually address a lot of the criticism of the 94 crime bill. The crack to cocaine differential in sentencing, mandatory minimums. But the people hurt by the crime bill or understand what that crime bill led to, are they going to say, okay, well look forward, not back . I think theres a group of people who are going to look back, but i think there are a variety of people, Bernie Sanders voted for that bill. Hillary clinton, bill clinton. A lot of people had supported that proposal in the 90s. Its vital for the Vice President. Im glad he came out with this set of proposals today. Also investing in prevention. Its vital for the Vice President to say how hes going to address the largescale disparities we see in the criminal invest system. Weve learned a lot over the last several decades. Information we didnt have in the early 90s. A lot of people are going to look at what hes proposing, not some of the statements he made, you know, now 25, a quarter of a century years ago. So leah, the criticism from cory booker came very quickly. He tweeted this. Its not enough to tell us what youre going to do for our community. Show us what youve done for the last 40 years. You created this system. Well dismantle it. Do you think this has the potential to be another not so good moment for biden at the debate . Hes going to be on stage with booker and Kamala Harris who, of course, went after him on busing. And i also think that, you know, you have to throw somebody like bill de blasio into the mix who has shown himself to be a bit of a flame thrower as well. And will certainly be trying to go after joe biden as the frontrunner of the pack right now. But, you know, absolutely its going to come up in the debate. In a lot of ways this is joe bidens attempt to really test the waters on doing a redemptive arc. What can i do in the past or looking forward into the future . Here are concrete policies . There are also policies that are really aimed at disrupting this idea of mass incarceration but also not going too far. So it is a way for joe biden to both say im repairing the damage of the past but, look, im different from Bernie Sanders. Im different from cory booker. Look, im different from Kamala Harris. The interesting thing, though, is thats exactly the point upon which the other candidates are going to jump on. Are they going to ask him, have you gone far enough . And this is part of cory bookers point. What do you plan on actually doing . Beyond policy, what do these actions look like . So this is going to continue to be a point of contention. Ypd the point of contention, though, beyond it being a point of contention, is it a point that will make critical voting blocs, africanamericans, who we know are going to vote with the democrats, but will it make a difference to their vote what they hear on that stage, what they see in this proposal and who they ultimately decide to support . I think it may make a difference. We have to remember that one of the groups that is perhaps most perhaps most infected and particularly in terms of depressive turnout will be black men. Black men are going to be looking at questions of policy at mass incarceration, particularly with because they are within this affected pool. Black women who also make up the base of the Democratic Party are going to be looking at policy and theyll be looking very seriously at what kind of policies and ideas these candidates have to offer. So, really, as these things come out, and as these notions and ideas, particularly in these history comes out, the base is going to look and see who is ready to address them, who has the ideas. And, really, who is willing, you know, is biden willing to apologize for his past involvement. And then what is he going to do to rectify the situation . Do you see a situation where he apologizes, neera . I think this is a big question where voters are going to demand an apology. Lets remember a couple years ago in the last democratic primary, Hillary Clinton also put out new ideas on criminal justice reform. A lot of very similar ideas. And heres where i think maybe things are different, and i dont know. Im asking you. A lot of democrats that i talk to and im sure you talk to, one of the things that riles them the most is they have a president who never, ever says i was wrong. Never, ever, ever apologizes for anything. Would it be smart for a democrat, who has made a mistake, to say, i really messed up there. And heres what im going to do to rectify that . I think when you look at the suite of proposals, what the Vice President is obviously saying is the policies i championed 25 years ago dont actually work anymore. These policies, we should be clear, the policies he announced today are an almost entire full repudiation of the policies he took 25 years ago. I think this is a big question. Does the democratic electorate want an apology or will they say, you know, the early 1990s was a very different time. I think this will be the debate that they have literally next week and for some group of voters, i think some group of voters will really look to see what the Vice President does and how hes able to handle that exchange because it didnt work out so well before. He wasnt as nimble. I think he is getting prepared for next weeks debate in a way he wasnt last time, and it shows he sees these attacks coming. We didnt know its not coming.
