But for those hoping to see the full Mueller Report, im a pessimi pessimist. I think well process our way through months of debate, not weeks of debate. I think we can already see bill barr will have his interpretation and i think he is a very broad interpretation of what he should be redacting. And, obviously, youre going to have those in congress who believe he should have a very narrow interpretation and i think in some ways politically the president s getting what he wants and the attorney general that he got which is somebody that essentially. Think of it this way in legal circles. Sometimes youre in a tough lawsuit moment and you just say, well, bury them in paperwork. Bury them in discovery and bury them in stuff. This feels as if it is a way of burying the democrats and process so that they constantly have to nag almost the Justice Department to get them this. It will make them look like theyre a one note party. All they care about getting this and thats where i think this is headed and i think democrats feel a little powerless here. They have the subpoena. But, i think this is going to be a dragged out fight and politically, its a tricky one for the democrats. What happens when they find out what is in the Mueller Report and, obviously, the redactions could vary, chuck. Nancy pelosi is already taking impeachment off the table. She raised the bar so high that she would need bipartisan support that as we saw from the republicans, it doesnt seem likely that republicans will read this report and suddenly decide they dont think the president is fit for office. What is going to be the end game here . Well, what should be the end game is somebody ought to make sure they read the report for the russian interference aspect of this. You know, we talk about this a lot. We try to, to remind people. But this is an investigation into how the russians hacked this democracy. Not whether they did it. And the investigation was about whether americans helped and if they did, which americans helped. But there still is the larger issue. The democrats look at this and frankly, everybody should look at the Mueller Report as an opportunity to figure out how were going to safeguard the next election. That should be the public motive here at all times. And, jeff, how exactly are they going to go about trying to get all this information . We know that jerry nadler has the authority now to issue those subpoenas, but we dont know when he is dpogoing to do it or hes going to do it. Any more thought on timing . You heard he is going to continue to work with the attorney general, negotiate with him in the hopes that he turns over this full report to the committee. But that if he doesnt do that, then hell release the subpoenas in short order. No specificity what would be the trigger or what would be the timeline. Democrats have a real issue here because it used to be back in the olden days and administrations past, just the mere threat of a congressional subpoena is enough to compel and even shame an administration into complying. But this Trump Administration probably could not care less about a congressional subpoena. You could have the entire Judiciary Committee back subpoenas up to the white house and start dumping them out on the lawn. The department of justice is unmoved. The attorney general has already said what he will or will not release to this committee. He already made clear that he was going to blow through democrats first deadline which was yesterday. When he talked with Congressional Democrats on the hill, wait and see until what we do and we have the subpoenas and well reserve the right to use them. I think this will end up in the courts. This is a classic dispute or likely a classic dispute between the legislative and executive branch and wind its way up to the Supreme Court. Just to get your legal perspective on this. Four different areas that bill barr says he will redact, information that could jeopardize ongoing information and any intelligence information that might be deemed too sensitive and grand jury material and third Party Reputational damage. How successful will democrats be if they try to go after any of those redactions . I tend to agree with chuck, this is not going to get resolved soon. The attorney general and the department of justice does have a basis to say the federal rules of criminal procedure require seekeran secrecy and exceptions provided in that rule and a general Public Interest is not one of those exceptions. There is, there are courts that have ruled that the court has Inherent Authority to release or unseal grand jury material. But that authority is something that the department of justice has pushed back against historically. So, putting aside, you know, what their current political preference would be institutionally the department of justice over time has been protective of grand jury secr y secrecy. They have a basis to push back on that and that is why i would expect it to go to the courts. There is a go around. They could subpoena those documents or any documents they could think of from the various people who were summoned to the grand jury. Correct. I saw with interest that theyre subpoenaing or they plan to subpoena the report itself. But then also individuals. Because the grand jury rule does not apply to the witnesses. It applies to the government lawyers and applies to grand jurors, court reporters. But if youre a witness, you can walk out of the grand jury room and have a press conference if you want. So, thats a way to get at the information and, obviously, inefficient because it will require them to call witnesses and actually redo investigations. But its a way to get to the same information. What about third party and the reputational damage. What leg does the court have to stand on that. Or how successful could democrats be with getting barr to further define what that means . My sense is that is where they might be a bit more successful because theres no rule that says, you know, you cant release information that is sensitive or relates to thirdParty Reputational information. That is sort of a discretionary call. So, i think, theres a lot of pressure for as much of this report to be public for a good reason. The attorney general has said i plan to be transparent. If the department looks like its redacting too much on that basis, its not going to look good for them and not going to be a clear rule behind which they can support that decision. Chuck, republicans are already trying to make this an issue thats not about the now, but about the later. Lets listen to mark meadows on fox news this morning. This was not a transparency subpoena. This was a 2020 subpoena. Youre seeing all of this play out. Its all political theater. It has nothing really with getting to the truth. So, is it all political theater . Is this or is this just the way the republicans are going to frame it and try to argue their way through 2020 that the democrats didnt want to do anything. They just wanted to take down the president. Just reinforces the point i made at the start of the segment. We know what the game is. The game is, this is where democrats are powerless on this front. Is going to be to slow roll, slow walk the release of this and theyre going to have to drag it out of the Justice Department through various methods. And the attempts to do it are going to get politicized the way mark meadows just did it. Here they go, again. They are just trying to get information. Its all about 2020. Well, you can just say that about Anything Congress does, i guess, in 2019. Theyre just doing it for 2020. You can say that all you want. And it may be effective if, indeed, it does look like congress, the democrats, are having to constantly throw some, you know, subpoena at the Justice Department or something to get the Mueller Report. So, i think were seeing the strategy right now and mark meadows was just delivering. For a broader conversation, chuck. I mean after benghazi, after all the investigations weve seen from the republicans while president obama was in office. Go back farther. What does this do to the trust in our institutions . We have bill barr who has sent the president a long memo that voluntarily gave him his opinion on president ial authority. Now democrats are saying, you cant trust him at all because of that. A lot of people out there say thats a good reason not to trust him. Who do you trust now . Do you trust any political appointee . Do you trust any lawmaker if youre not on that side . This is the damage that donald trump himself has done. More so really than any other president ial candidate or president in my lifetime. Because he assumes everybody is transactional in how they govern. He has assumed this since he started get in, since his dad handed him a real estate business that everything is transactional. Every politician does it this way. Which is how he rationalizes being as transactional as he is. Thats what this is he is, he himself is saying thats the way it works. Justice department on the up and up. Its all about eric holder protected obama and i want my attorney general to protect me. My point is, youre right. We dont have this trust. But lets think about the person who is doing the most rhetorically to create this feeling of you dont know who to trust. It happens to be the president. As he projects on to democrats his beliefs, he acts the way he projects. So, he wants, he thinks holder protected obama. Therefore he hires an attorney general that he knows will protect him. Senate Majority Leader Mitch Mcconnell said he had a talk with trump on monday and let him know that republicans would not be moving forward on any health care legislation. We will not be doing a comprehensive in the senate. And thats not the only issue that mcconnell and trump dont see eye to eye on lately. Heres Mitch Mcconnell yesterday on the president s threat to close the southern border. Certainly have a crisis at the border. I think the president is right about that. Closing down the border would have potentially catastrophic Economic Impact on our country and i would hope we would not be doing that sort of thing. I think one of the Big Questions here is when the president tweets stuff like this, im going to shut down the border or party of health care, how seriously do you take the president and if youre just a voter, how seriously do you take him is the big question. Many republicans have adapted to the pandemonium suede trump by learning of the consequences of his policy declarations, many of which are launched in late night or Early Morning tweets. Obviously, this is a president who tends sometimes to move on his own. And then, obviously, has some of those conversations later. Senate majority whip john thune said tuesday of the recent push of health care and the border. Thats a dynamic that everybody up here deals with. It sounds like, erica, you have republican lawmakers saying, well, you know, we just kind of call him afterwards and tell him its a bad idea. Thats right. To some degree lawmakers have learned to really take it with a grain of salt. We heard from senator grassley yesterday basically saying he has been talking about this for weeks. Referring to shutting down the border and when he shuts down the border, ill believe it. They do have to take him seriously because he does follow through on his threats like with the government shutdown. That is something he had been dangling out there for months really more than a year and he finally did follow through on it. So, they know they cant just dismiss his threats. Put if they say they learned to kind of live with these curveballs that hes constantly throwing at them, adapt to them and, like you said, address them behind the scenes in private phone calls and as we learned yesterday, they sometimes are successful as senator was in walking him back from these plans. Its difficult for lawmakers and difficult for americans to figure out what the president wants to do and whats going to happen. A threat to shut down the entire border wouldnt just mean a crisis for people trying to cross the border, immigrants or what not, but commerce as Mitch Mcconnell just said. Economically impact the agriculture industry and the food industry. Look, two president ial trumps in the white house. The strategist and the salesman. And sometimes a salesman or the strategist are the same person. And the strategist is a very good salesman and vice versa. He likes to say, i will have the best health care, the Biggest Health care and he says im going to shut down the wall. It sounds good, sounds strong. He likes hes displays and hes not as good as thinking through the consequences himself or for his own party. Sometimes he plunges through anyway which is why the, mats in washington and politics have to. It seems like no one takes him seriously any longer. The stock market used to sway, depending on what the president says. It doesnt any more. Sometimes it does. Lawmakers dont necessarily go into panic mode because they, as erica has been reporting, call behind the scenes and tell him why hes wrong and a lot of people just dont listen or look at his tweets. I mean, what is the consequence of looking at the president of the United States and not taking him that seriously . Its chaos and dysfunction for the president s own agenda. Because normally what we see is one party pushes against the other, what we see in this contest is the president s own administration and his own party have to work against him and with him on his own ideas. Always this thing where the policy process in the admin strapgz has to catch up with the tweeter feed of the president. Sometimes it catches up and changes whats in that feed and sometimes it echoes it. I wouldnt make the mistake of othinki thinking he will never. Once in a while he goes force through and even if it is bad for his party. Republicans would freak out about that, erica, because economically speaking when you talk about 2020 and what it could mean for the president and his party, the u. N. Wione thingt if the economy falters. Right now the economy is doing okay. Wages are going up. You could argue theyre not going up enough. But at the same time, the economy is relatively pretty steady. So, if he decides to disrupt it, thats got to send panic down the spines of people on capitol hill. I mean, shutting down the border or even, you know, certain portions of the border, certain ports of entry could be catastrophic as we heard senator mcconnell say at the clips you played and thats why senators are working behind the scenes to try to talk him out of it. His own advisors, obviously, understand the implications. You know, we also have to think about the huge opening that the president is giving to democrats on these things. Republicans dont understand why hes not riding high on the Mueller Report outcome. Instead he pivoted to health care, which became chaotic andr Border Closure thing. Regardless what he says going forward, this is a court case if it goes to the Supreme Court will likely happen in the middle of 2020, making it a guaranteed political issue. What she can and cannot do in the weeks leading to a potential trial. She was joined by Felicity Huffman who arrived here earlier this morning and were hearing that both actresses right now, theyre not saying much at this point in time. Theyre not showing a lot of emotion inside the courtroom. But they are just two of more than a dozen defendants expected to show up today. What about the other defendants. And those are the names that everybody knows. But morgan, tell us about some of the others that will be in court today. Yeah, we do know that these were other parents, obviously, that had means to be able to help their children circumvent these rules to get into colleges. As for what charges theyll be facing, we do know likely fraud, however, the prosecution has said there will be additional charges coming against some of these individuals if they dont choose to cooperate in a sort of way as it relates to this College Cheating scandal. So, since this is essentially being called an initial appearance before a judge, this is the first of several meetings and, so, much more to play out here legal wise as it relates to every defendant in this case. And while we have had a lot of attention directed to loughlin and huffman, in the eyes of the law, they are very much the same as these other parents involved. Danny, lets talk about what you think is going to happen. Is there a chance youll see parents like these two actresses try to claim in court that they didnt know what was going on . If they decide to go to trial. The first major decision they have to make is whether or not to seek a plea agreement and maybe even a Cooperation Agreement from the government. But if they believe they have a defensive case and an example might be, hey, we paid a bunch of money and we dont know what was done with the money, our daughters got into college. Thats all we care about. If they can prove that and rebut the governments evidence, then maybe they will consider going to trial. Just looking at the statistics. First time offenders like these and we can assume they dont have criminal history. These are not the folks that want to undergo trial. A lot of guilty pleas in the near future. What kind of guilty pleas . They show that roughly threequarters of similarly situated defendants and by that i just mean sentenced generally under these fraud guidelines end up with incarceration sentences. Now, of those, they get substantial reductions in their sentence for cooperating. Somewhere on the order of 50 to 60 reduction in their sentence. So, the average sentences are measured really in the tens to 20s of months. Not years. So, these are not harshly sentenced offe sentenced. They can get to the government before the good deals run out. Maybe come out and say, listen, i messed up. I did something really dumb. I got caught up in this admissions process and i wanted my kid to go to the best school and im an idiot and please be lenient on me. That would be a refreshing thing to hear from some of these folks. Might at their sentencing. Might hear it. Thank you. Now, to another court case and a newly released deposition conspira conspiracy theorist pushed a lie that the sandy hook shooting was staged. Before we get to that explanation, lets look at what led the threehour deposition. Jones, the founder of infowars. Com has repeatedly called the sandy ho ay hook was hoax. I think as a pundit and someone giving opinion that, you know, my opinions have been wrong. But they were never wrong consciously to hurt people. The trauma of the media and the corporations lying so much, then everything begins. You dont trust anything any more. Like a child whose parents lie to them over and over again. Those products then would be shared with state and local Law Enforcement, local Law Enforcement would use the information that came from this branch to protect the people in the neighborhoods where they work. What ive been told by people inside dhs is that since this branch was disbanded, the number of products that dhs has sent out to state and local Law Enforcement inuvl volving the tt from domestic terrorism has dropped significantly. I have yet to get a clear answer on whether they dispute what my sources have said with a high degree of confidence about that. And i have yet to see any data from within dhs that would suggest anything other than what my sources have said. I mean, the reality is political leaders in dhs and in other executive Branch Agencies are always going to talk the talk when it comes to domestic terrorism. They will always say that its a top priority for them and that its a core part of their mission to prevent this domestic terrorist threat. Thats part of the reason its so important to look, not just at what they are saying, but as is always the case when youre covering politics and government, to look at what theyre actually doing, which is much more interesting. And in this case, a point that one former dhs official made to me is, it doesnt make sense for neilsen to say the department is prioritizing domestic terrorism when at the same time its shutting down a unit of analysts who focused on domestic terrorism. It all came down to ohio. A swish to 60,000 votes, kerry would have won the Electoral College and the presidency. And of course 2012, remember all of the headlines, all of the talk obama versus romney, if it was close would would save obama. The supposed blue wall. There was all of these states like ohio votes democratic since 1992 added up to 242 electoral votes. There was an idea that if romney won the popular vote the through wall would save democrats. Trump benefits from that split, it happened in 2000. People now assume it will hurt democrats, not as clear i think when you look at the last 20 years. When you talk about this there is a feeling among folks that the democratic vote look at 2000, look at 2016, youre reminding everyone of a little history. And when you look at 2016 and the pattern there, just the vote distribution pattern favored the republicans when it came to the Electoral College because he had strength in rural areas, places like michigan, wisconsin, pennsylvania. I think the question long term is that how our politics will stay or will they change and change again and and it will work the other way with the Electoral College.
