Months behind bars bringing his total sentence to 7. 5 years in prison. Notably judge jackson says the court is one of those places where facts still matters. She questions manaforts contrition and made it clear the question of collusion was not relevant in this case. She says the no collusion refrain runs through the entire defense memo is entirely unrelated to the matters at hand. The no collusion man ta is simply a nonsequitur. Charged manafort with 16 counts ranging from Residential Mortgage fraud to conspiracy, if hes found guilty of those charges because they are state crimes, he would not be eligible for a pardon. This is only part of our focus today, our big question is are state prosecutors trying to make sure the president and their inner circle cant gain the judicial system. Joining me tom winter and ken dilanian and yahoo news correspondent and the coarthur of right turn roulette, rick gates former attorney, anne mar marie mackeroy. We got a big story to get through. These are 16 counts that hes charged with specifically are tied to Residential Real Estate mortgage fraud as well as false f falsifying documents. A lot of the under line facts of this and a lot of documents isobare associated with this. A lot of the kind of technicalities and the real details of this, we heard of before and it is going to be familiar to those watching us. The specific charges were brought today are different at the special counsels Office Brought involving Paul Manafort. Manafort if hes convicted of the highest offense today, facing anywhere from 8 to 25 years in state prison for those charges. Those was handed up by a grand jury here in new york. These are very specific to new york city, real estate and specifically manhattan real estate charges and business charges. Thats the core of what we are looking at today. Hell not be eligible for a president ial pardon. Exactly right. Speaking of pardon, the p word. Quite a scene. When manaforts lawyer walked out and said the exact opposite of what judge jackson said. It was a remarkable statement. Reporter it is patently untrue. Lawyers and officers of the court are bound not to state complete falsehoods like what he did today. He said the two courts have ruled there had been no collusion. Thats not the case. Neither courts ruled any such thing. Collusion of russia was not apart of the charges they were tried in courts. Judge jackson says the jury is out on that because Robert Mueller has not finish his investigation or shown the public what he has found. A lot of people are saying as you suggest that this was yet another signal from mavericks lawyer to the president theyre interested in playing ball or a pardon. After he said that, he was shouted down by protesters who said it was a lie and protesters were right. Lets go to why we wonder if manaforts lawyer is asking not so subtly for a pardon. There is not just that moment that happened in front of court as ken pointed out. There is the fact that manafort maintained his joint Defense Agreement with the president while he was cooperating with the special counsels office, a lot of questions why he would do that and why he would not drop the defensive agreement and let the white house go in order to focus on and trying to help the special counsel and reduce his sentence. There is donald trump sympathizing with Paul Manafort last week after his initial sentencing. I feel badly foreman fo mana. It has been a tough time for him. If you notice both his lawyers they highly republicanespected. The judge says there is no collusion. There was no collusion. It is a collusion witch hoax. The judge did not say that and the judge today did not say that. Sarah sanders was asked two days ago whether or not the president is ruling out a pardon foreman fo Paul Manafort. Here is what she said. The president will make the decision when hes clear. I guess he has not made a decision that he has not made it yet. Clear. Joy vance, when you take all those things into the account, what does it say to you . Except where manafort was entering a plea agreement where it looks like hes going to cooperate with the special counsel. It seems clear that manafort has always played for the president s team. You know his lawyer could have walked out of that courthouse and said there was no evidence and my client committed a murder and he was a bad husband. There was no collusion. There is only one person who cares about the litany of no collusion in this country and thats donald trump, thats donald trump, the one person that can give manafort a pardon. I dont see any other way to read these conversations. If they were happening and if prosecutors understood that the the president and Paul Manafort were having these discussions under the cover of secrecy, it would be evidence of some kind of obstruction of justice. They continue to do it in public, maybe they think that protects them somehow. What are other people involved in this investigation thinking right now, the other people pleaded guilty or the folks that may be under investigations when they look at what manaforts lawyers have done publicly and the followup minutes later from the manhattan d. A. With state charges, if you were rick gates lawyers, which used to be, what would you be thinking . It raises the stakes. Not only you have to worry about the charges you may be face right now but you have to worry there may be additional charges and certainly the office are moving quickly on manafort that had to be in the works for quite a while. What do you think of the timing . They did it to make sure that there is no potential for a pardon but also they kind of waited until the other cases was done and now they get all the attention for this case. They wont have to share the attention with the folks in the mueller probe, now everybody will focus on the manhattan d. A. s office is doing. Not only you have the new york state a. G. , the attorney general is making it clear, shes looking into the Trump Administration and business and family and whatever they may have. There is a good chance that he may not be the only one to have state or local charges brought against him. Michael, what do you think of the message thats being sent by state prosecutors and what do you think of the idea that this is an effort potentially by state prosecutors to try to make sure that Donald Trumps inner circle cant just gain the judicial system. It is absolutely about an insurance policy against the pardon. I dont think a pardon is in the works any time soon but donald trump will have a last day in office. It may be january 20, 21, it may be four years later or well before that. It is traditional for president s to issue controversial pardons on their last day in office, i may remind you thats exactly what bill clinton did on his last day in office in addition to pardoning large susan mcdougal. His long time Business Partner who was convicted in the white water investigation and had refused to cooperate in ken stars investigation. I think thats the play book that manafort wants the president to adopt and i think that, you know, hes going to serve some time in prison. Hes waiting for that last day in office when theyll make the pitch for the pardon. Joy, what do you think the message is send ing to the president directly about what may happen to him after his last day in office, the next day . Prosecutors across the border are not so much sending a message as they are carefully investigating. Prosecutors dont worry too much about what targets are thinking about or what theyll ultimately do. Prosecutors focus on what the facts are and what they can prove and it looks to me like both federal and state prosecutors across the country are very diligently focused on that inquiry right now. Michael, one more to you, in the question of no collusion, i know manafort certainly wants to say it. The judge made it clear that those two cases manafort was tried on had nothing to do with collusion. What are the ones that are still being investigated by the special counsel . Well, there is a lot of stuff we still dont know, most predominantly of the meeting that Paul Manafort has with kilimnik and in the cigar room in new york and august when he supposedly shared polling data from the Trump Campaign and filings and data been redacted and the washington post, i know has moved to try to get the judge to unredact those filings. If she does we can learn a lot. The judge made an interesting point in court today. Manaforts refusal to cooperate and be truthful prosecutors did frustrate the mueller investigation. What he did say they cant take stock in because she has shown himself to be an unreliable witness and what he did not say theyll never know. While this is in one sense, a victory for Robert Mueller. This was the one case that went to trial, the most prominent. It is also something of a setback because Paul Manafort was a witness who the mueller people i am sure hoped would give them deliver more information about others than might go to the collusion question and they did not get it from Paul Manafort. Anne marie, the one person they do have other than manafort is rick gates. Rick gates testified against ma manafort and his financial crimes. Rick gates have been cooperating with the special counsel now for some time ton heart on the hear matter where they are investigating. The additional case against manafort does add additional time and pressure on him if he has further information to share it. Is that the advice you would be giving him if you were still his lawyer . It is the one way to cut down on jail time if you have a witness who does have valid information to cooperate with. There is a chance for redaction of the sentence. Thats the only ticket to get out of jail at this point assuming if he gets found guilty or not. The president would take that and say thats pressure to force somebody to lie. Thats one of the problems. It could be that they have genuine information or the problem is and there is a fine line if you squeeze too hard, people come up with stories because they want to get out. That hopefully, any decent prosecutors, theyll get Additional Information to verify whatever thats said. Theyre not going to go hopefully just by what cooperators said. He said it to somebody else trying to convince and come along with his program, thats a lot of people and thats a lot of families. We saw 50 people charged but some of those were husbands and wives. Thats much less than 50 families. Katy, we have to look at it and say are there going to be other charged. The u. S. Attorney also is also clear that the students are not out of the results. Some of the students had no idea, they were excited they got the test scores that they got. Other instances, the kids definitely knew whats going on. Especially the athletic scholarships. When you look at that it certainly you look at the kids who are complicit. Do we know theyll be able to stay at their colleges . We have not heard any of the kids expelled. If you are committing fraud and your parents have been charged with this federally, you have to assume that the schools will look at it and say you dont belong here. Thats what Law Enforcement are looking at. 761 other kids according to this wiretap information that got into schools that did not deserve to get into. Na natas natasha, in looking at this, people who are wealthy and have influence and means, have a leg up in society and those who work really hard if they come from a poor station, they come from a lower class, it is much more difficult for them to secure better spot in life as somebody who worked as a professor, what is your take on this . Yeah, i think it is interesting. I think there is probably consensus and i think most people, everybody will agree what these families have done is wrong and it is morally wrong and legally wrong. There are ways in which the university ies defend what they do. If you take that example of crude for one example, that was fraud. You know if you can imagine what it would take to actually get recruited to row on the crew team, it would mean being in a place where you could learn crew. Most teenagers in the United States dont bare know what crew is or see it if they have any talent for being on a crew team and having the resources to cultivate that talent and then going to those summer camps that allow you to become an excellent and get spotted by a cult. All of these kinds of systems are baked into the way colleges do things above the table which are also, you know, ways that in equality gets perpetuated. How do you fix this . Whats the solution . I think it is complex. For me, we should stop playing so much, putting so much stress ongoing to these elite places and assuming these are the best of the best or the most fairw fairwfairwa fair ways for young people in the United States. No matter what we do, it is always going to be people left booinds. Thats the reality. There will be a lot of amazing young people who are left behind. There are not enough space on elite campuses for all the accomplished and talented young people that we have in the United States. Thats the reality and from my perspective. Is facing a lot of pressure to follow through the rest of many countries around the world saying they want to get into the safety concerns for this plane and figure out what was going on. Listen, i think what finally broke the camels back here, it started yesterday with the u. K. And austria and the entire European Union and today when canada decided to inform washington by the way, it informed washington midmorning, well be taking the 737 max out of service immediately. No planes can take couoff or la over the canadian aerospace. Similar to what happened in indones indonesia. We did not go into anymore details than that. Transport canada did work with the command center which is the base off of Northern Virginia which i visited last week. They compile of everything. It has micro second calculations on a planes particular performance. According to the canadians, they look ed at this data and became very concerned of what was seen five months ago. Canada says we dont fully understand that data but we are concerned enough that well also ground the planes. Now that left the United States as the only country that was not grounded the plane and it became unattendable and the white house needed to act with the entire world grounding the planes. Well tell you southwest and america and united all claimed they were not havingful any problems with the max 8 or 9. They believe they were safe planes and their pilots stood behind it. Worldwide is 370 in this fleet. Lets make a point that we are talking about both, the max 8 and max 9. United flies max 9, it is a longer version of the 8. Correct, it is maintained by nasa, the aviation reporting system. The report came through the faa, the faa says thats who they can be submitted anonymously without fear repercussions or punishments. And in that database, we found reports submitted by pilots of these flights. We dont know which airlines they were flying for or where it took place. They were voicing concerns about the system during take off during the plane. Which airlines in u. S. Were flying these planes. The two airlines that had the largest airlines, southwest and American Airlines which was based in fort worth. We dont know for certain that these reports came from these pilots because that information is redacted from the database. They were flying the largest number in the u. S. It seems that may be some of them over come from the pilots. Both of the union told us the pilot unions believe the planes are safe to fly. Let me read one the complaints that you found. This pilot says, it is unconscionable that the airlines would have us flying planes without adequate training or providing resources to understand the highly complex system. The fact that this airplane requi requires such to fly. It is inadequate and almost criminally insufficient. Thats a scary thing to read if you are a passenger getting onto one of these planes. The u. S. Is facing a lot of pressure and refused to it until the president came out. There are a number of these planes are on the air and once they get down, theyll be grounded, boeing 737. The president had a conversation with the head of boeing yesterday, how did that conversation go . Yes, the ceo of boeing have called and tried to set a call soon after the crash to sort of reassure the president and reiterate the companys position which these planes are safe and proven otherwise their means from a boeing perspective and indepth analysis by the faa and experts in the field, well, the president just now pointed the faa and say that the faa has looked at this and thats why they have reasons to believe there was cause for the grounding. So, you know, in some ways the system is working and there were some concerns about political interference and the president weighing in on behalf of a company that has courted him, the faa and the other hand were career Civil Servants who are experts in these fields. Interesting. We can put up a map right now that shows all of the boeing 737 max 8 or max 9 planes that are in the air right now. Again, once they land, sorry, these are all max 8, once they land theyll be grounded. One of the Major Players in Donald Trumps cabinet is his acting defense secretary used to be a boeing executive. Yes, boeing has a ton of cloud. They have people throughout former officials and lobbyist throughout the government and acting defense secretary, but also the staff director, the committee thats oversight. It has called for a hearing into aviation safety and prompted by these two crashes and the boeing 737 max 8 and boeing does a lot of lobbyists close ties to the administration and members of congress and played a ton of people throughout the country. You sooee some of the lawmakers representing some of those states calling for the grounding. This is not you know, these planes are grounded now but sort of political and Aviation Industry fight over this is really just beginning to give a sense of how long such a grounding could last. Well, the last time we had a boei boeing plane ground was 2013. It was grounded for an issue, a battery issue that did not result in any crashes but a couple of fires. That grounding lasted three months. Here you have far more serious issues that could have broad ramifications for not just boeing and its stock and their employees but Aviation Industry at large who knows how long this grounding could last. It did start to raise questions especially after canada today and after the e. U. And china and india saying theyre going to ground these planes. It did raise questions about where the priorities were for the United States where the priorities of the safety of the passengers or the priorities of the industry making money and protecting the industry. Carrie, you also reported in e the dallas morning ne news, i dont know if the faa Pay Attention is the correct word, you said faa does not correct or analyze or recording programs or data to identify safety lists, why would they not track that . Thats a fair question. Theyre like if you are not going to use this information and collect it for analyzing and you know kind of looking at safety issues, why are you collecting it . It does seem they want to take a hands off approach and letting it be a database where is there anybody viewing it . The faa says they take everything into account and they get those report and other reports and they have other safety reporting mechanisms, o o they look at the big picture and have supporting documentations. It is one of the reasons we knew about the database and we have been looking at it. Why does nasa have it and whos checking this . Again, you point out a number of complaints. It is not just one complaint. It is five. Theyre serious complaints about pilots being concerned about their planes and the safety of everybody on board. Well put this on hold for a second. The president is responding to questions about manafort and the newest charges. It is a very sad day. I feel badly for him. Say it again. Canada is grounding it we were coordinating with canada and giving them information and they were giving us information. We work in conjunction with canada. You will hear an announcement half an hour directed from the faa as to more details. We were waiting with boeing and other countries. Canada was one of those countries. Why have you not secure a date with president xi . Things are going along very well. I am in no rush. I want the deal to be right. We are getting billions of billions of tariffs paid in. I am not in a rush. It got to be a good deal for us and if not, we are not going to make that deal. I have to say that deal is going along very nicely. Very tough decision. It is tragic to all the people that we are talking about and we paid our highest respects to. But, it is a very tough decision from the standpoint of a company like boeing. It is a Great Company with a track record thats so phenomenal and they want this solved and they want it solved quickly. They dont know the problem yet, theyll have to find the problem. It could be a lot of Different Things so they have to find it and theyll find it. The United States has the greatest record in the world of aviation that we want to keep it that way. I didnt want to take any chances. We didnt have to make this decision today. We could have delayed it and maybe did not have to make it at all. I felt it was important both psychologically and in a lot of ways. Again, if you are working with carriers and other countries, we thought it is the right thing to do and speaking of boeing, speaking of airlines, i spoke with American Airlines and a number of airlines and speaking to the airlines, i think that we all agree this was the right decision to make. It did not have to be made but we thought it is the right decision to be made. They acted very quickly. Very much working with other countries and with the airlines, okay . Mr. President , will you pardon Paul Manafort . I have not given a thought as of this moment. It is not something that right now on my mind. I do feel badly for manafort. Did they go after him for state taxes . The new york state federal charges, right after the sentencing took place here in washington, d. C. , the Manhattan District Attorney filed state charges against him which would be a way to get around an effect of a pardon. I dont know anything about it. Yes, sir, go ahead. Are you in supportive of that . I have to take a look. We are in good shape in terms of the money and national emergency, ultimately we are in very good shape. So the president in talking about manafort if he would pardon him and he said hes not thinking about that right now. Thats happening across his mind and he has not heard much of what has happened with state charges against manafort for fraud. He did say he feels badly foreman fort a for manafort and called it a sad situation. He addressed a number of concerns of the faa and the time it took to ground these planes. He seems to be behind the decision that he wanted to make sure these planes were grounded because he was concerned about their safety and about the message it was sending to folks. He certainly took a lot of responsibilities for making the decision. Joining me now from the white house, is kelly odonell. Kelly, do you have any in signatusight into how this decision came to be . It was a surprise to us as the president made an announcement on this. The president talked about getting new data from the crash site that have brought so much attention to this issue and also as he outlined a bit further in the conversation we just play, he spoken to the head of boeing who he has a personal relationship with and in fact the president appeared in south carolina, a different part of the boeing company, he has a strong relationship there. Also speaking to the head of a number of airlines since he indicated and including American Airlines which is among those that fly those particular aircraft. The president is taken into account of the pressure that has been building from around the world and concerns voiced by many passengers making any change to american aviation has an enormous Ripple Effect in business, not only for boeing or various airlines but all other things that happens when there is a disruption. If there is not backup equipment to fill those flights. We dont know what the impact will be in terms of how it will affect peoples travel. Flights. But it is an enormous decision to make High Pressure so it did suggest that any new data outlined in an announcement today, some time when the president is still involved, the pool in the room still behind me here taking in whatever else he is talking about. We need more information, he also said the cause needs to be found. Apparently it is not sufficient to give us a smoking gun element to what the risks may be with this particular aircraft. The president leaning into this making it seem like this was a decision he felt very strong about. Unclear how long these planes will be grounded. Two things tomorrow chairman jerry nadler will be leading a resolution making it clear that the perspective of the United States house of representatives is that once this report has been completed, its contents whether or not it exonerates or implicates the president should be shared with the American People. We also have the ability, if appropriate, to use our subpoena power to make sure the report is presented to congress and congress can make that decision to present it to the American People. A lot of congressmen and women when they were asked about how they felt about impeachment, a lot of you said we need to wait and see what happens with the special council. That was the refrain from a number of members of congress. That refrain is now not really on the table any longer. Nancy pelosi said that impeachment is off of the table unless something overwhelming is off of the table. And that leaves some room, but it certainly raises the bar really high. What do you think, are you on do you agree with her . Do you think that was a good idea to take it off of the table for now . I strongly agree with Speaker Pelosi that we should proceed with kwaucaution with respect t impeachment. It is clear this should only be pursued where circumstances are brought to life by treason, brooib ri, and high crimes, i think she articulated an appropriate standard. She said that effectively the case for impeachment must be come pending, the evidence presented must be overwhelming, and the public sentiment with respect to impeachment must be participate bipartisan in nature nap is a high bar but it is also a normal standard. The president says i greatly appreciate Nancy Pelosis statement against impeachment, but everyone must remember the fact they never did anything wrong. Military and jets are great and many other successes, how do you impeach a man considered by many to be the president with the most successful first two years in history especially when he has done nothing wrong and impeachment is for high crimes and misdemeanors. Do you agree with the president s sentiment . He is happy about this. Of course not that is not a serious statement and much of what comes out of 1600 pennsylvania avenue is not serious. We were elected not on impeachment, we didnt run on impeachment, and were not going to govern anchored in impeachment. Were going to Lower Health Care costs, particularly as it relacrelac relates to driving down the high cost of drugs. Were going to focus on a Real Infrastructure plan. Were going to keep our focus there and clean up corruption and bring our democracy to life. We passed the consequential reform bill. How do you feel about the grounding of the 737 max 8s . It was appropriate. There are two questions that need to be answers. One is there a technical flaw in this model of aircraft that in two instances in the last six months as effectively caused these planes to nose dive . The faa and other experts will have to try to get to the bottom of that. The other question that needs to be resolved is do the pilots have appropriate information and have they been given sufficient training to navigate through the technical challenges that the 737 max 8s apparently present.
