In his first interview since being sentenced, cohen says his former boss not only knew about the hush money payments made and Stormy Daniels but that he directed the payments. I did not do it to embarrass the president. He knows the truth. I know the truth. Many people know the truth. Nothing at the Trump Organization was ever done unless it was run through mr. Trump. He directed me to make the payments. He directed me to become involved in these matters including the one with mcdougal. He knew it was right . Of course. He was doing that to help his election . You have to remember at what point in time that this matter came about, two weeks or so before the election. Post the billy bush comments. He was very concerned about how this would affect the election. Cohen insists hes done lying but not cooperating with the special counsel. He might have given us a clue to what the cooperation is about. The special counsel did say youre doing your best to tell the truth about everything related to their investigation. Do you think President Trump is telling the truth about that . No. This has sources confirm that then candidate donald trump was in the room during an august 2015 meeting with Michael Cohen and National Enquirer chief david pecker during which the men agreed to plan to silence women who allege they had affairs with donald trump. The big question were asking today is what else does Michael Cohen know and what might he be telling investigators. Joining me now, nbc News White House correspondent kelly odonnell, tom winter. White house supporter for the daily beast and former assistant u. S. Attorney for the Southern District of new york and distinguished fellow at pace universitys law school mimi. Theres some news out of white house. One man is taking himself out of run fning for the chief of staf reporter governor Chris Christie has telephoned the president and asked to be taken out of consideration. That coming after he spent more than an hour meeting with the president last night in the resident to talk about the chief of staff job. The governor put out a formal written statement calling it an honor to have been under consideration. We dont know if he was going to be offered the job. This was taken himself out of consideration. Kellyanne conway was on the north lawn talking to reporters and she indicated she knows who is in the running and the top sort of pecking order of potential candidates but she wouldnt say anything further. We have been talking about a few different names that include a former Campaign Official david bossy, trade representative robert lighthouser. This job requires someone that can handle all the staff issues and also handle interactions with the president at a time when there will be democrats in charge of the house and subpoenas coming and lots of political and legal issues in the mix. Also when were probably likely to get Robert Muellers report. He will likely come out with something and they will be involved with that in donald trump. I felt the interview was compelling. Michael cohen placed himself in a convincing way. He came out trying to lay as many cards on the table as it seemed like he could. How much of a problem is Michael Cohen for donald trump . It seems to me that some of the things that Michael Cohen said indicate how much of a problem this entire investigation might be for the president. Specifically in that interview cohen talked about how a lot of things that he was asked about and a lot of things he told them they had evidence of. I think thats really significant. It says that cohens testimony is only helping to support the evidence here based upon what we have seen in Court Filings and problems for Michael Cohen and this interview and what else hes been in court. Michael cohen is the guy, the glue in between the major pieces that it seems that Robert Mueller is able to gather and somebody can say you can look at an email or a text message or have a recording of something but let me tell you the back story. It appears that Michael Cohen will probably be providing a will the of context that were going to see in the various components of the investigation. Hes very careful if that interview. Sounds like hes been given the Robert Mueller and do not talk under any circumstances. The fear of god. The fear of god. This is Michael Cohen being asked why people should believe him. You pleaded guilty of lying to congress. Yes. Why should we believe you now . Because the special counsel stated emphatically that the information i gave to them was kredsable a credible and helpful. Theres a substantial amount of information they possess that corroborates the fact im telling the truth. Youre doin wine with the ly . Im done with the lying. Im done being loyal to President Trump. My first loyalty belongs to my wife, my daughter, my son and this country. Sd. Mimi, what do you think . I think this is not going to come down to whether or not people believe Michael Cohen if were talking about charges that might come against people close to the president or the president himself or his companies. The prosecutors made clear they are not just relying on michael coh cohen. Theres recordings. Theres david pecker. Theres probably other recordings we havent heard. They did a whole search of his office that probably yields eyi lot of evidence. The way the Southern District is handling this case and the way it wrote its brief and the way they are handling Michael Cohen and sticking to this process of youre either all in or youre not as a cooperator is saying, to me, sort of exuding confidence. This is not a tepid case. Obviously, as tom said, a cooperator like Michael Cohen if he does fully keep cooperating and testifying, it can be very useful. Thats not something new to the government. The government is not afraid to put people on the stand who have lied in the past because the point is that you show why they are telling the truth now. Thats the only way to get inside that room that donald trump was in. None of them will be truth tellers. Were already seen once where Robert Mueller has used rick gates in a case they brought. Rick gates admitted he was involved with lying and a convicted felon because he pleads guilty. They still used him any way in the testimony. They had a lot of other evidence. They had message, emails and able to corroborate a lot of things they said. Theyre clearly not afraid of using somebody who admitted to crimes. Michael cohen has taped the president. Hes taped him. We dont know what other evidence he might have in his presentation. Theyve already called him useful and helpful. Hes very honest about what he knows and what he does not know. I bet theres a lot of things they were able to seize in that swarn search warrant that Michael Cohen doesnt know Michael Cohen had with respect to different evidence and recordings he had. I imagine they would be more powerful and helpful to any sort of case. How is the white house rebasicir reacting to Michael Cohens interview. I know they have tried to say hes a liar. The president has said a lot of things that were not true. People would call them lies. The Washington Post has been keeping track of his misstatements and they are up over 5,000 right now. Anyone worried about michael koe he today and whats going on with the investigation than a few days ago . Is that one of the reasons Chris Christie might not want to be chief of staff or might be hard to find somebody to take on that role. I cant speak to that particular issue but no official channels are talking about the new comments from Michael Cohen. As you laid it out, it obviously adds a complicating factor when you have someone who is adding a m mega phone to his Court Involvement and cooperation. The white house has taken this position, if we talk about the president and his legal allies to try to diminish cohen by saying he was the lawyer in the interaction, not the president. If he committed illegality its on him, not the president. They have tried to really shift all of this to cohen. Cohen in his varied statements have talked about the fact he believed the president was knowledgeable about what was happening and he was making a choice to try to protect himself and the campaign at a critical time. The white house will try to discredit cohen in every way they can and use instances where hes admitted being a liar against him. Its a murky mess when you considers the president at many times earlier on talked about the loyalty and friendship and the goodness of cohen. Its a thorny thing for them to deal with. Mostly we see avoidance when it comes to that topic. Its not just Michael Cohen. Its ami as well. Ami admitted they made that payment. They were working with cohen and a candidate in order to help donald trump in the election. To find these stories and suppress them. Whats your reporting about ami and jared cukushners involveme in that . During the 2016 campaign, Michael Cohen and david pecker forged a tight relationship. Obviously the president and his lawyers are disputing that as aggressively as they can. When it became clear during the president ial transition that Michael Cohen would not receive a senior position in the Trump Administration and Michael Cohen was actually going around telling people he was expecting something as plum as chief of staff, that sounds incredibly hilarious today but thats what he was gunning for. David pecker and the top brass made a calculated decision to find a new point person in the west wing. The person they settled on was Jared Kushner who in our story today we report that kushner and pecker had several considerations and taconsideratn conversations and talked regularly. The conversations ranged everything from relations with saudi arabia because ami, mump like Jared Kushner and the Trump Administration were cozying up to mbs and petty and tabloids centric as the dirt that the enquirer had on your msnbc colleagues which was an issue that pecker and kushner had spoken on the phone about. There was a period of time where for pecker, ami and National Enquirer, Jared Kushner was their new Michael Cohen. Talking about exposure to Jared Kushner, are you hearing anything when it comes to him . I think thats something well continue to report on. Obviously, we know that, we were the first to break here, my colleagues at the white house that there was preliminary sort of inquiry or investigation into Jared Kushner. Thats something we will continue to follow up on and well bring more reporting as we have it. The president is trying to bury this saying he doesnt know if theres a payment but also saying if there was a payment, its not illegal and Michael Cohen is trying to embarrass me. His allies bring up john roberts as a way to try to defend him. John roberts case is a reason why donald trump should not be prosecuted or this isnt illegal at all and theres nothing wrong with it. John roberts case, a federal judge said that it was illegal what he did. It was a Campaign Contribution and it was a little less cut and dry than what donald trump did with the National Enquirer. The shifting strategies are telling of themselves. Every time they try to make an argument about the facts, the facts come back different from what trump says and then he tries to make a different argument and literally you have Rudy Giuliani saying, its not murder. No up with was killed, so no big deal. When theres where you are, youre not in good shape. The Southern District is confident in its case that it is building, whoever it is biltdsing it against. They have already, just in the Public Record established so many elements of this crime and knocked out so many defenses, including the so called edwards defense which would be because in the john edwards case is the judge said this is a permissible legal theory to proceeds on. The facts were there in that case. The government couldnt show the payment was to influence the election. The Southern District has proved that five different ways here. Rudy giuliani saying its not a big deal, nobody is dead is interesting. This is the same Rudy Giuliani who when he was mayor of new york decided to run his tenure on a broken window strategy. To prosecute even the smallest of crimes in order to clean up the city. Even the smallest of crimes. Now hes saying its not a big deal because nobody was dead. Interesting. We have more on what Michael Cohen may know and may not know and what is going on with this investigation. A 7yearold girl was taken into custody at the southern boarde border. Its not just where the money went and why its unaccounted for but also where that money came from and reports from the wall street and the New York Times theres questions about who gave that money and whether they were straw donors forforeifor foreign governments. Right. He was charged with purchasing two tickets to the inauguration for two ukrainian businessmen. That doesnt allege the Inauguration Committee made a mistake or they did something that was illegal but he was purchasing that directly on behalf of foreign donors. Thats illegal. Hes plead guilty in that case to charges related to that. You cant do that. Thats the first thing. Were they hoping to get access . Is that why you do that . Theres all sorts of reasons. You do to see who else is there. Who is close to the president. You want to see who is he interacting with. Who does he appear to be warmest with. Those are the types of things you want to see. You might see who is the power player. Who do i need to reach auout too get a deal done . My understanding is this is kind of a ticking stock moment for investigators here in new york and other investigators. They just wrapped this huge case about Michael Cohen. The special counsel has that i know investigation. The there a path forward. Are there avenues we may want to go down. Thats something prosecutors look at when these cases wrap up. The csam patton case is bein prosecuted in washington, d. C. Its not by mueller specifically. If anything is directly involved with russia in their efforts to meddle in the 2016 election, they mieg loght look at that committee. They took in a tremendous amount of cash. They might say does this anything that ties to our core mission which is investigating russia or if theres any coordination. In other words, i could say im going to take care of you in the next election or your next committee if you help me out right now. Where could that money go . That money goes to the platforms and the bunting and the seating arrangement and the pomp and circumstance and the concerts, et cetera. The pomp and circumstance that goes into an inauguration and the festivities surrounding it for that entire weekend. You have over 40 million that are unaccounted for, what sort of flags are raised in an investigators mind . Well, i think the flag thats raised is its so different from the amount of money that was spent on inaugurations in the past. Thats where an investigator will start. This was not that different from the past president ial inaugurations. Where did the money go . We use this phrase all the time but its so true. Theyre going follow the money. I think here, as tom was saying, sounds like they are in initial stages. They are following leads. They are probably starting to see both whether money that came in, one possibility here is that money that came in was used essentially as a bribe. Thats a very specific statute. You need more than just paying for access. You need the elected official to give the promise at the time of receiving the money of doing an official act. Thats a very high burden. I dont know that that happened here. Theres state law crimes like embezzlement mp where we are and what people should be thinking about in terms of this investigation when you have trained investigators looking at this kind of conduct and evidence, they are likely to find things. The other day Kevin Mccarthy was on fox news saying that if Campaign Finance laws were prosecuted then half of his or a good portion of his caucus would be out of a job. Whats the difference between a Campaign Finance law that puts you in jail and a Campaign Finance law that gives you a fine . Rich. I think that lots of campaigns make paper work errors all the time. The Obama Campaign and Mccain Campaign filed reports of expenditures a couple of days late. They paid their fines and moved on. Were talking about pattern of someone denying payment was made for over a year. Setting audiotape inting up a l company. Pretending this was paying a lawyer back. This doesnt look look like what members of congress are doing all the time. Normally and i said Campaign Finance law. I meant violation. Here is what we have come up. What can be prosecuted are violations committed knowingly and willfully involving at least 2,000 in the calendar year and violations that can be fined, do not prevent knowing and willful violations or involve sums below the statutory minimums for prosecution. How common is it for Campaign Finance violations to occur . They are pretty frequent. I think the statement is probably something that hard working men and women at the Public Integrity section and u. S. Attorneys office across the country are interesting in hearing. I think the core piece of this is what prosecutors are looking for is this notion of criminal intent. What was someones purpose. What did they have in mind in what they were trying to do. As it relates to Campaign Finance, it slouches a lot towards the technical. The what it ultimately comes down to is that concept of lying, cheating stealing and whether or not candidates or people who work for candidates are trying to game the system. The money that funds the system is often the easiest way to do it. Donald trump brings up president obama often when hes talking about Campaign Finance violations. Obama was fined for missing paper work on contributions totaling 1. 8 million. Donald trump brought that up as frequently or as recently as yesterday at a fox interview. Whats the different between president obama getting fined for that rather large sum and what donald trump is accused of doing with these hush money payments . I think that the big difference here is that obama km pa campaign was running almost a billion dollar operation. There was no evidence of wrong doing. As soon as they recognized their error, they fixed it. These are minor technical vie lag violations. Nobody is trying to evade the law. Thats not the same thing we see alleged in this case where we saw Michael Cohen saying he knew what he was doing was illegal. The president knew and they were trying to hide it for a long time from the public. Its not just Michael Cohen. Its also ami. What about the timing of when the payments were made. The affairs were not happening in 2016. The affairs happened years before but the payments happened to silence in month or so before the election. The issue of timing is significant. It goes to talk about the issue of whether or not money was changing hands for the purpose of influencing the campaign, the election. Thats what the issue is for purposes of Campaign Finance violations under the contribution limits law. In the case of edwards there was a much more e llongated period time. As is being alleged here in mr. Cohens guilty plea and the ami nonprosecution agreement, these things are happening much closer in time. Rich, what do you think of the republicans you just heard a moment ago coming out in defense of donald trump . Well, they are trying to defend the president. I understand that. If were talking about analogizing this as business it usual, it doesnt look like business as usual at all. It looks like the prosecutors have more evidence than i think that some of the republican senators have been admitting to. Gentlemen, thank you very much. Did you know about the 130,000 payment to Stormy Daniels . Why did Michael Cohen make that . You have to ask Michael Cohen. S youll have to ask Michael Cohen. Michael cohen admitted he lied on behalf of the president many, many times. The man doesnt tell the truth and its sad. I should take responsibility for his dirty deeds. You lied for him for a long time. More than ten years. Hes saying very clearly that he never directed you to do anything wrong. Is that true . He directed me to make the payments. He directed me to become involved in these matters including the one with mcdougal which was between him and daivi pecker and david peckers counsel. David pecker is the ceo of ami. Here is what ami told the wall street journal about the payments back in 2016 right before the election. Quote, ami has not paid people to kill damaging stories about mr. Trump. Except thats not what they told federal prosecutors when they struck a cooperation deal. Quote, ami admitted that it did make the 150,000 payment in concert with the candidates president ial campaign and in order to ensure that the women did not publicize damaging allegations about the candidate. There was another lie solidi solidified. Back in 2016 he laughed off the idea of Trump Campaign having ties to russia. Are there any ties between mr. Trump, you or your campaign and putin and his regime . There are not. Its absurd. Its no basis to it. That was proven untrue almost immediately after the president took office and it keeps getting more flagrant. They have told lies about the russian ties multiple times. The number of Trump Associates or family members who interacted with russians is now up to 14 individuals, including Donald Trumps own daughter, ivanka. Those interactions could be significant. An offer of dirt from the russian government to build a trump ptower in moscow. Sarah huckabee sanders, said she, the spokesperson for donald trump, always tries to tell the truth. What do you hope your legacy will be . I hope that it will be that i showed up every day and did the very best job that i could to put forward the president s message to do the pest job i could to answer questions to be transparent and honest throughout that process. Transparent and honest. How can you be honestly transparent when you boss is anything but . Its hard, if not impossible. We know there were times she hasnt been truthful when she said he didnt dictate don junior in that meeting. Except donald trump did. His lawyers admitted it in a letter to robert muleller or whn she said there was no acknowledge of payments to Stormy Daniels. We know thats untrue. Maybe she was mislead. The Guatemalan Ministry told the associate press this morning, this is a horrific story. This 7yearold crossed with 163 migrants on the border, looking at the map right there. We are the arizona border. After being detained there for a little time at 4 30 in the morning, they were put on a bus and headed to the lordsburg Border Patrol station 95 miles away. At 5 00 in the morning we were told by a cpv official, that girls father notified Border Patrol agents on the bus that she was vomiting and sick, and the girl did not receive medical attention until she arrived at the Border Patrol station at 6 30 in the morning by which time the father told the agents she stopped breathing. She was transported by helicopter around 7 45 to el paso, to a hospital where she died. The following morning this is a terrible morning that raises terrible questions. What did they know about the conditions in the Detention Centers for young migrants . He talked about the fact much more migrants were coming but did not mention he knew this girl died. Despite the fact Congress Needs to be notified 24 hours after an event like this takes place, dhs will not say if they knew she died or not. What is their response . Family numbers are increasing in numbers. Its important to keep this in a larger context, which is over the last couple of years, the crossing has gone down but the number of people dying while trying to do so has gone up, and people look at the strategies like a border wall and pushing people away into long lines to wait on asylum and they cross over to more deadly conditions. If you go back and you look at the policy of prevention through deterrence, and you look at people will try to cross in areas more deadly or not cross at all, and its the former that we are seeing happening. Whose responsibility is it, is it the responsibility of the u. S. Government and Border Patrol . Regardless of if a family crosses the border, once you take that child into custody does the the government have a responsibility to care for that child and make sure that child is okay and is alive . I would want my child to get care, and in this case it was an hour and a half before that child got medical attention and then she stopped breathing and then she was seizing. I have been out there and theres a border team that specializes in rescuing people, and i know theres a capability for Border Patrol to quickly rescue people and give them medical attention and we know it didnt happen in this instance.
