He was motivated by personal greed and repeatedly used his power and influence for deceptive ends. Prosecutors say manafort lied about contacts with the Trump Administration. Why did he do that . We have two legal minds and two white house minds. I want to start with the legal aspect of this. Barba barbara, when you take all of these filings together, you get hints at donald trump as individual one. You get hints of the cohen filing talk about Campaign Finance. Hinting talking about the moscow deal. When you put it all together, what do you think . I think theres a couple things here. One is with regard to the finance violation, President Trump is individual one. The documents dialed filed say individual one directed Michael Cohen to break the law by making those payments. I think it is grounds for impeachment. The framers of the constitution envisioned high crimes and misdemeanors when a candidate procures the presidency by fraud. I think impeachment is part of the conversation. With regard to the manafort filings and cohen filings, i think they illuminate a Bigger Picture with contacts about russia. Russia was engaging in classic espionage by things they thought their target was interested in. It ate peeppears the trump camp pay have bitten. They now put themselves in a position to be blackmailed. That could be why trump has behaved to favorably to Vladmir Putin. Looking at one of the cohen filings by Robert Muellers team, they say he was helpful in a number of different manners. They talk about how russian officials or Russian Nationals were contacting Michael Cohen and offering political synergy with Donald Trumps campaign and the russian government during the campaign. One thing that i found really notable was this two sentence note from Robert Muellers team saying cohen provided the special counsels office with useful information concerning discreet russia related matters core to its investigation that he obtained by vir which yture regular contact with Company Gives during the campaign. Core to the investigation means robert mule ear eller is lookin russian interfeerence and did donald trump or anyone from his campaign collude with russia, conspire with russia. When you read that in one sentence, what do you take . It mentions Company Executives and corporations can be charged with crimes on the theory that if they have employees that violate the law under their watch they can be charged with criminal liability. They cant put a corporation in jail but they can be blocked from doing certain actions. When you talk a lot about whether the president can be indicted or impeached, i agree that i think were probably beyond the thresholds for considering impeachment at a minimum because you dont have to prove oo cria crime for i impeachment. Whether the president can be held accountable is one thing. His company can be held accountable and we know his family was involved. There were communications not just on friday but the one last week with respect to mike flynn with his family. Theres going to be pressure on the president , i think, in a political system to hold people accountable for what was obviously meddling, but koor coordination thats not good for democratic interest in the United States. I found that to be the case in the cohen filing where sdny prosecutors were saying theres no way that anybody in this country is above the law. Doesnt matter how rich or powerful you are or how many connections you have, theres rules put in place to make sure elections are fair. Cohen tried to work in the shadows to influence the election and try to do so at the directive of individual one. Again, thats donald trump. Looking at the mueller side of the cohen filing a little bit closer, we talk a lot about obstruction and how muellers team is looking at whether or not donald trump obstructed justice with this tweet or when he says this, what does that mean or trying to get in touch with the doj. They are still focused on this idea of collusion. Whether or not there was still collusion. Whether or not there was any collusion going on between the campaign or the organization and any russians. I think youre absolutely right about that. The substance of the areas that Michael Cohen is cooperating with all relate to russian interference. The great detail that youve talked about where a Russian National proclaiming himself a member of the Russian Federation offering political synergy seeing the guarantee is putins involvement. Those kind of representations going to the core of the investigation which is russian interference in the election suggest that robert mule eller looking at russian interference and not just obstruction of justice. Other things that are included in there suggest that obstruction is on the table. It talks about Michael Cohen circulating his system before congress. Causes me to wonder with whom he circulated since it related to the Trump Organization. I think its reasonable to infer its members of the Trump Organization. Was that an effort to get a story straight and does that portend obstruction of justice charges. Both areas are very much in play. Donald trump likes to say and you know this, that there was no collusion and because there was no collusion, thats why the angry democrats and thats his words, for the special counsels team, are looking at obstruction trying to get him caught with something because they havent found collusion. What is the strategy here . Is it just to deny everything no matter what and to constantly call this a witch hunt to defame it because they dont have a defense or is there a real defense . Theres no question that part of this is to undermine the credibility of the mueller probe. To suggest political bias even though most of the people on the team are republicans. This has been drummed up by democrats and suggest on the idea of obstruction, if you cant prove collusion then what is he obstructing. If youre covering up a crime but there was no crime. As twisted as the lodge basgic they are holding onto that. You saw the president saying Michael Cohen was doing that on his own. It was a personal finance matter rather than campaign. Rudy giuliani said to me and others, if thats where this leads, they spent two years and tens of millions of dollars, quoting rudy giuliani, and all they can come up with is not collusion, not this smoking gun or International Intrigue but rather just Campaign Finance violation thats trivial. Its still a violation of the law. Its illegal. Its potentially a felony. Thats where the white house talking points seem to rely now. The white house is adopting a shrugged shoulder strategy for the mueller findings calculating that most gop base voters will believe whatever the president tells them together. Thats right. The president has this unyielding faith in his own ability to personally direct the narrative and set the terms of the debate on twitter with his messages, with his hour to hour reactions and the white house is largely going along with the cues from the president. They have not staffed up the kind of war room you would expect the white house to have heading into january when they will be facing this Mueller Report but the newly empowered House Democrats who will be launching a number of investigations and probes at the same time. The lack of preparation in the white house while the trump defenders say its fine because the president can handle it, look at how he ran his campaign, it has a lot of republican allies on capitol hill quite nervous. Some senators are feeling like they walking on egg shells here that the mueller findings are much more perilous and they were alarmed by the cooperation of Michael Flynn. Is there a breaking point for some republican lawmakers . I talked to one senator who said there would be if mueller were to produce evidence of an actual conspiracy between trump and the russians. If they were to document collusion, for example, of any kind, that could be a breaking point. They may not want to stand with him. Another could be if trump decides to pardon Paul Manafort. Does this show it wasnt just a Michael Cohen venture . There were more people involved or could this just be an innocent pass off of a contact . We dont know because of so much of the material that bob mueller is holding back. I would say that the prosecutors dont typically spend this much energy on a low level person who was acting alone. If the special counsel wants to give Michael Cohen credit for his cooperation, that cooperation involves other people higher than him. As what we can see in between the black boxes of redaction in these filings is Robert Mueller saying this has been critical to their work and corroborated by other evidence that they have. Are members of the family higher than Michael Cohen, barbara . I think people who are close to President Trump and people who hold high positions are considered higher. In addition to Michael Cohen to try to portray him as a solo operator here, youd have to disregard the connections of Paul Manafort and the emails received by donald trump junior. Also bringing in some connections to russia. I dont think it flies to say this was all Michael Cohen. You know the lies are also very significant. Up with of the things that always get a prosecutors attention are needless lies. People only lie when they are trying to hide something else. Its often referred to as consciousness of guilt. Its because you know youve done something wrong that you need to lie. If these were to talk about legitimate business deals and cool, theres no need to lie. Michael cohen, we dont know who else he coffnferred with, but Michael Cohen was hearing back from somebody in the kremlin about that deal and being promised certain things that havent been shared with us. There was question whether the russian money was going through the nra. It could bear some fruit down the road. There are two things we didnt hear about the filings. Looking back at corsi and roger stone, we did see a draft filing the other day. I know one of our colleagues was able to get a hold of that from jerome corsi from robert muel r muellers team. It looked at if there was a back channel between wikileaks a and roger stone and the Trump Campaign or trump himself. If it ends up thats the way that Robert Muellers team looking at corsi and stone, what piece of the puzzle would that fit into . Thats the theory that stone and corsi were a conduit between wikileaks and the Trump Campaign. That plea agreement suggested that corsi had advance knowledge that John Podestas emails had been hacked. He knew that before the world. Hes denied that. A lot of people say if robert mule eller has to rest a case f collusion for the Trump Campaign on the likes of roger stone and jerome corsi, thats not a strong case. Presumably hes got more than that. The other thing hanging out there is obstruction of justice. James comewas interviy was inte friday and an fbi lawyer let it slip that comey is a witness in muellers obstruction of justice. This was the First Official confirmation of that be. That was not in any filing on friday but it is something well hear more about. Should we expect to see all of these threads come together at some point in we have jerome corsi, roger stone. There was another separate filing that was a mistake that went out about wikileaks and julian assange. Do you expect that all of these things that were hearing drips and drabs of will be tied together in one place . Well, the report, i would assume would be heavily redacted. I think what is quite interesting with that we havent talked about is the fact that the president nominated someone who is highly respected and experienced to take over as attorney general. The concern that mr. Whittaker was put in place to upset the investigation hasnt come to fruition and i think it was a legitimate concern given that Rod Rosenstein is well qualified. This train is moving and as much as trump and his team wants to say no collusion, unless people want to deany tny the facts tha public thats not realistic anymore.
