The debate vote, which we have this morning, that whole thing was a mistake. I believe that Brett Kavanaugh is a good man. I believe that she a good man. It just may be that in my view, hes not the right man for the court at this time. Senator jeff flake of arizona was thought to be a potential gop vote against kavanaugh but he ultimately fell in line with the rest of his party announcing his support for kavanaugh earlier this afternoon. He also appeared confident that the nominee would be approved. Did our best . Think he will get confirmed tomorrow . I would think so. Which brings us to todays big question. Will the Senate ConfirmBrett Kavanaugh . Joining me msnbc news capitol hill correspondent garrett and betsy woodruff. Welcome. At the top ocf the show we said that Mitch Mcconnell and Lindsey Graham might have an idea of where Susan Collins is headed. Here is what Lindsey Graham just said a moment ago. Shes done her homework. Shes always believed he was qualified but just want to make sure the allegations were seriously dealt with. Shes the first person wanted to make sure the fbi check our work product. Whether you agree with her or not, shes been really studious and took a lot of courage here. Mob rule is pretty hard to stare down sometimes. Lindsey graham, i dont know. Reading between the lines. He seems happy with where collins is. Hes calling her brave. Do we believe she will vote yes tomorrow . Reporter you dont want to count your votes before they are cast but Lindsey Graham is in a good position to know. He and a number of other republican senators including Mitch Mcconnell had lunch with Susan Collins. They will be among the last people she talks to before her 3 00 floor speech in which she expected to outline her decision up or down on kavanaugh. Lindsey graham is right about this. We know from talking to collins aide, she has taken this vote very seriously. Shes been going back through not just the fbi report over the last two days but kavanaughs previous judicial decision. Shes been very dialed in. Shes been the single most targeted by protesters up here. Remembered she was thought to be a swing vote on the tax bill. The other giant controversial piece of legislation up here and felt like she was someone whose ear they could climb into on this last vote. I dont know if that protest was as effective on Susan Collins as folks would have liked. Shes been under enormous pressure here. Let me ask you about why you dont think that protest was as effective as they would have liked. I guess a few weeks ago now, it feels like a long time ago, when she was getting threatened with somebody running against her if she voted yes on this nominee. She said something of feeling like she was being blackmailed. Does the anger on the other side, is she seeing it as not so much anger but as bullying right n now . Reporter every senator takes this differently. You saw jeff flake cornered in the elevator and it seemed to shock him to take a look at this. I just dont know if thats as effective. You look at Lisa Murkowski who met with alaskan who had come down here in private meetings. They were here to protest too. You could argue based on what we know that tactic was more effective in getting Lisa Murkowski to think about this issue the way some of her constituents were than getting jumped outside elevators as been with Susan Collins. There are interesting Favorability Ratings for Susan Collins in maine. We can put those up. Its a poll at 49 versus 31 . If you look at the independent in maine, his numbers are higher. While 49 may seem like a good number, its not quite as good as it had been the past or her colleagues is. I believe hes at 63 approval. Thats the number. Betsy, lets talk about joe manchin. Hes in a really red state. Heidi heitkamp said she was going to vote no. Hes up about ten points from his nearest competitor. Its something hes considered. Manchin is a very talented politician representing a state that doesnt usually support the party. Manchin and his operatives have to very closely have their fingers on the polls of where their voters are at. We know hes been one of the democrats thats built the best relationships within the trump administration. Hes been to the white house a handful of times. Hes very much been somebody who is open to the kind of trying to build bridges or make overtures to conservatives and the Republican Party because over the last decade or two, West Virginia changed from being a solid blue to being a purely deep red state. Manchin is the last democratic sta standing. The way he thinks about the kavanaugh vote is the something he is calculating. Things are looking much sunnier for manchin that heitkamp. He still doesnt have a lot. He could have a lot more to lose. I know were talking about a serious allegation and very serious circumstances but in order to understand whats happening on capitol hill, thats what you have to do. A lot of time it does seem like these decisions dont come down to personal beliefs or morals but cold political calculation. Nick, talking about that and whats going on with jeff flake. As somebody who has watched jeff flake be the moral voice of his party only to vote in line with his party right after that, i personally wasnt so surprised about todays announcement. Im interested in what that means for the race in arizona. He is not running again. He felt he couldnt win a primary there because he wasnt supportive of trump. Right now shes up two points in arizona. Does the vote that flake cast tomorrow, a yes, presumably affect the democrat more favorably or the republican . I think in kavanaugh is approved, it helps democrats in the short term. Its bad news in the long term. Its hard for republican activists and voters to stay angry if they get what they want. Whats best for them in the short term is to have activists angry that kavanaugh is being denied his seat. I think it helps the democrat if he is approved. Phil, youre covering the white house. Who is the white house right now focusing on . Are they focusing on joe manchin . Are they focusing on Susan Collins . Are they focusing on trying to turn murkowski around . What are they doing . Its those three senators and jeff flake that have been the focus of the white house attention all along for these last few weeks. Theres a high level of confidence in the white house that this vote tomorrow will go their way for kavanaugh. H they had kavanaugh to write that oped to make his last pitch to senators before they begin the voting process that he could be an impartial and independent judge. Returning to some of the message themes he first had when he began confirmation hearings. They know social securiits a p calculation at this point. The one problem for the white house is President Trump is not personally very persuasive or effective with these particular senators. These are not senators who have a high degree of respect for him or personal loyalty to the president. There are limits to what the white house can do at this stage of the process other than try to put kavanaughs best foot forward. We should note hes given an interview to fox news. Those are two properties owned by rupert murdock. It was a marketed departure from what we saw last week when he s was angry and fiery and emotional at that hearing which is what donald trump liked. Its the audience of one he was talking to. Why write the oped now . He was emotional. He said i wrote this. I planned this. He was overcome with emotion in the moment. His behavior gave senators a reason to be against him that was apart from their views their idealology. I havent decide what his views on this are. That oped was an effort to take the excuse away from them. It looks like it. Remember the wall street journal editorial page is the most influential media property. Most read it. Take it seriously. Follow what shows up there. They know the editorial writers are. When it comes to print publications you cant compete for an audience in congress on both sides. Im so sorry. I jumped in too quickly. She talked about the hearing and the way he present eed himself d said thats not someone she could picture on the ben mp. You heard that in Lisa Murkowski too. She said she believes hes a good man but not the right man. I think if the white house, if the white house is calling anybody, they should be trying to call joe manchin. Turning Lisa Murkowski around after shes made a decision would be a fool errands. Donald trump is not the person who has the most cache with Susan Collins. If they want to get to her, it would be through the republican senators. Why would joe manchin listen to donald trump when hes gone down to West Virginia multiple times to campaign for his opponent . Because joe manchin faces the judgment of the people of West Virginia in a little over 30 days and donald trump is popular with those voters. Theres a political advantage for manchin in siding with trump on this one. You could see him saying yes tomorrow in this vote on kavanaugh and using that as his calling card for reelection to go to crowd after crowd in West Virginia and say i was the only democr democratic to stand with President Trump. He was charged with murder in the Fatal Shooting of laquan mcdonald. The decision comes almost four years after dash cam video showing the shooting prompting widespread protest. The verdict is expected to be read at 1 45 p. M. Local time. Thats 2 45 p. M. Eastern. About 30 minutes from now. What does the white house think now . Reporter the white house is fairly confident that Brett Kavanaugh will get confirmed. President trump and white house officials are left in a role of playing spectator because the ball is in senates court. We have seen to deploy the key tenent of trumpian policy. The president and mocking Christine Blasey ford in that rally a and he pass the protesters saying they are soros backed paid protesters. Hes painting it as a binary choice. Yes or no. Telling his Republican Base youre with us or youre with those democrats. It sort of crystallizes support for Brett Kavanaugh but it drives up the anger thats key to getting republicans out to the polls in midterm elections. I think jeff makes a good point. When you go to the rallies and the president goes on that path where he is claiming the democrats are out to stop him from doing everything. That the democrats are being funded by people like george soros which he brought up again today, he does start to generate that anger but does it go beyond the folks who show up for these rally who is are already angry in the first place . I dont know that it does. I think if it has animated a broader conservative base than those people who attend trump rallies, if Brett Kavanaugh is confirmed tomorrow, it remains to be seen what happens to that anger. Anger is probably the best driver to get people to the polls. If kavanaugh is confirmed that the democrats, their anger is going to up the anger of women will rise even more. Its hard to know what happens with republicans. This white house is less concerned about that. They look at everything as a win lose. Thats another binary for them. They will do anything they have to do to win. We have seen that here. They dont care if they win dirty. If they get kavanaugh in court, they will continue to celebrate that as a major win and shift from the anger message to look what he did. Look what were achieving and hopes that carries them over the final weeks. Lets play donald trump last night in minnesota. You see whats going on in congress right now with one of the most respected people, potentially, hopefully, Supreme Court justice, Brett Kavanaugh. The dems are willing to do anything to hurt anyone to get the power they so desperately crave. So interestingly i know i asked the question does it extend beyond donald trump rallies. I guess theres some evidence that it does in terms of folks that are extraordinarily critical of donald trump most times. Brett stephens who is a columnicolumn ist for the new york times. Hes extraordinarily critical most of the time of donald trump. He had this column out for this week saying for once im grateful for trump. Here is what he said. Im grateful because trump has not backed down in the face of slipperiness, hypocrisy and dangerous standard settings of Brett Kavanaugh to the Supreme Court. Im grateful because even crass obstinacy has its uses in life and never more so the than in the face of moral bullying. Its a big fat hammer fending off a razor sharp dagger. This is the thing that really has divided even never trumpers. People who still have misgivings about donald trump say the fact he can cement a conservative majority on the court is a great thing. Its the reason they back him even if they have issues with the way he does it. Based on my conversation with white house officials that President Trump isnt really all invested in the details of this process. He hasnt been a full supporter of Brett Kavanaugh. Has no real personal affinity for the man. Hes referred to him as a bush guy in the past. He knows he needs a win come what may. For republican voters, the Supreme Court is so often that single issue. The way in which President Trump we have seen dispensed with that whole strategy not attacking the accuser and went straight to mocking Christine Blasey ford. Its at win at any cost. What happens if they lose . Thats something the white house will probably, the president , whatever something goes wrong for the president , he doesnt take the blame. He will say this is congresss fault. We have seen him at rallies and complain about john mccain. He will put this on the republicans. He will blame the people who brought kavanaugh to him. That will work with his supporters. The reason those supporters in rural minnesota and mississippi and red states are so invested in Brett Kavanaugh is because the president has invested in Brett Kavanaugh. Its not that they really relate to this blue blood prep school kid from maryland. Hes part of the president s efforts to change the courts and change the country. One of the things that resonates and long resonated with the president and his supporters is he does not quit. He fights incredibly hard. I think thats what they see here. They see him fighting hard and they want to win. I think thats the thing that binds the president to his supporte supporters. If they lose its a set back for this white house. Joining me is the editor and chief of law fair and New York Post columnist and editor at commentary magazine who is also an msnbc contributor. Guys, i want to talk about Justice Stephens because thats extraordinary. First i want to give the context to what this conversation is all about. Its most notable this moment from Brett Kavanaughs Opening Statement in the hearing last thursday. This whole twoweek effort has been a calculated political hit fueled with pent up anger and President Trump and the 2016 election. Fear that has been unfairly stoked about my judicial record. Revenge on behalf of the clin n clintons and millions of dollars and money from outside left wing opposition groups. This is a circus. Here is what Justice Stephens said on kavanaugh. Hes demonstrated a potential bias involving enough potential litigants before the court he will not be able to perform his full responsibility and the senators should Pay Attention to it. Its extraordinary for a former Supreme Court justice to come out and comment. I would say these are extraordinary circumstances. Were playing calvin ball. The baseball game that has no rules. All the rules have been thrown out and norms have been violated and one can say they have been violated in every possible realm except Supreme Court nominations and now they have been violated in Supreme Court nominations in both directions. We have kavanaugh going explicitly partisan and a last minute late hit with uncorroborated evidence and kavanaugh, i think, must have thought his team must have thought there was thats the thing. You say his team. Supreme court justice. His team should be the law and the constitution. Now lets return to the planet earth and say theres a 50 Million Campaign against him and almost a lot of mup speoney spent i campaign as well. Uniform deep skepticism deep hostility toward him. People may think this was a mistake. Why him . That didnt exist for justice gorsich. There were allegations that justice had been a sexist and mistreated women who had tried to seek clerkships from him and a filibuster had to be broken in other words to get him confirmed. I think theres a bit of historical rewriting going on. All i was going to say is this, its bad that all this is happened with the Supreme Court. Its terrible. Its a terrible thing and the violation of our norms is a terrible thing. That said, it worked. I heard nick say this was sort of problematic. Gorsich rallied the right with a passion that was not there before he spoke. I think his nomination would have gone down had he not done what he did in that speech. What do you think . I dont think former Supreme Court justices should be commenting on pending Supreme Court nominations and i dont think Supreme Court nominees should be writie ining opeds endorsings themselves. I think its a salutary thing that kavanaugh appears to have felt the need to acknowledge that he transgressed a real set of norms in the overt partisanship of his testimony on thursday. I dont think an oped an organ of, sort of partisan organ is the right way to do that. I agree with john that norms are being violated in all directions here and i think its bad. I agree that its bad. I think its this is now like complaining about oxygen. Our political hold on. Let me jump in. Brett kavanaugh, if you believe the allegations, if you dont believe the allegations, if you feel like hes been treated fairly, if you feel like shes been treated unfairly. If the norms have been broken, fine. Brett kavanaugh is not the only person at the Federalist Society that the Federalist Society blessed to be on the Supreme Court that donald trump could have chosen from. The head of the Federalist Society was on cbs before he was nominated. He was asked who on your list do you think is the best. He said theyre all great. Throw a dart at any one and they will be fine. Hes not the only person that can sit on the Supreme Court. Given all the controversy surrounding him whether you think he deserved it or not, he did come out and he did say theres a left wing conspiracy against me. Its clintons revenge and he did make it clear to a lot of americans that he is not on their side. When you talk about the republican side, a lot of americans will look at him forever and see a guy who is a republican. Not a guy who is a Supreme Court justice and given that, my question to ben and to you is, wouldnt it be worth it for our country if everybody said, listen, lets find somebody else . Well, look, i wrote a piece this week saying in part for exactly that set of reasons if i were a senator, i wouldnt vote for him. Im largely in sympathy with that view. Your original question was about Justice Stephen and comments and judge kavanaughs oped and those strike me as a slightly different question. Look, i dont believe that nominees should be campaigning for the positions. I think if other people run campaigns for or against them, the problem them for them to do is dignified silence. I dont think any aspect of this process including kavanaughs own comportment in it has been dignified or appropriate. If you think that he is guilty, then, yeah, somebody else should be. If you believe that the evidence does not support a charge against him or is unfair, then the notion he should be thrown away like a Candy Wrapper and somebody else gotten if his place, it would be extreme injustice. If somebody said the standards should be higher for someone like this. I dont know youre angry and i understand your right to get angry. I get it. Clarence thomas was angry during his hearing in 1991. He did not dive into the, this is a left wing attack. This is revenge he did much more insicindiar charges. He said it was by left wing Interest Groups against a black man. Thats worst than what kavanaugh said. Brett kavanaugh said this is revenge on behalf of the clintons and revenge for the 2016 elections. He said this is revenge by the democrats. Chuck schumer said this was pay back for holding hostage scalias seat. That is acknowledgement to what kavanaugh said. If this was a democrat there, would you be making such an impassioned argument . Yes, i believe so. Honestly. I want to say i lost my magazine subscribers and donors because i was a heated opponent of the birtherist sugar la isist sland. Honestly, i would have preferred a different Supreme Court nominee the minute these charges came against him. What about the idea given that happened there will be a significant portion of the country who feels like whatever his ruling is will not be fair because hes doing it on a partisan basis. They will do that any way. I dont agree with that. Kagan was Barack Obamas solicitor general. A vast majority of american who is may not agree with the personal who is being confirmed but do agree that once that person is on the Supreme Court they will try to think the best of that justice and they are doing the best to uphold the constitution. I think kavanaughs judicial record as ben said in two pieces in the last week, his comportment as a judge, his comportment as a political official before his judgeship. This is the only thing that any one can point to in his personal comportment that seems out of character and he said that in the oped. He was angry and he said things when he shouldnt have said. I want to give you the last word. I would say i do make more of what happened on thursday than john does. It bothers me more than it bothers john. That said, if hes confirmed, he will take the oath of office and be treated like a justice. A lot of people will be issu suspicious of him. A lot of people will be deeply upset and for them it will erodes soerode some part of the Supreme Court. He will be treated as a justice and have a vote and because he has a vote, oral advocates will make arguments to him as though none of this has happened and his colleagues will engage him as though none of this happened. At the end of the day, i do think we are at the point right now where it matters a great deal more than it will at any point after confirmation and after he takes the oath of office. That said, it really does matter. Gentlemen, thank you very mump. A red state democrat up for reelection says she is a no and republicans all but call the race. In the morning when shes brushing her teeth, she needs to like the person she sees. Heitkamp is down 12 points in the most recent poll to her republican challenger. It was about three to one of people that supported her choice and i have a very conservative listening audience. I was kind of surprised at the result. You believe still that despite the polling out there that shows her down quite a bit, she can still overcome it. I know she overcame a tenpoint deficit in 2012. She did. She overcame a tenpoint deficit. I dont believe its 12 points. Im pretty confident its not. Because shes my sister, i get to know things. Ed in m. North dakota, it doesnt poll well. Its a whole different philosophy. This vote probably didnt help. You cant really spin that it helped. People are proud of her. I bet you she put her cell phone away and slept really well for the first time in a long time. S s yesterday you said the kavanaugh vote did weigh heavily on folks out there. We were scouring local News Coverage in north dakota. We didnt find that much but we found this from the bismarck tribune. A professor was quoted and he said i doubt theres a lot of people who were conditioning their vote for heitkamp. It seems like something of an obscure thing for the average voter. This is Political Science wrong or right . I think they are probably right. This is a week long deal. At best a week long deal. Im sure the cramer camp will run some ads about how incredibly liberal she is when they know thats not true. Thats okay. They do what they do. Kevin cramer has turned down the debate. They got cancelled, i might add, because of this vote. The heitkamp camp has said time and time gweagain, well meet y anywhere, any time. If cramer wants to be chicken, he can. If he says im way ahead, i dont need to debate. If thats the kind of guy he is, thats the kind of guy he is. Last year the largest publication had her a week before the race was out down by ten points. You know what . You know what, she won. I want senator collins to vote no for so many reasons. Brett kavanaugh lied under oath. He has been very disrespectful to women and i think his temperament is not fit to be a judge. You think overwhelmingly she needs to vote no when she announces her vote. This is her legacy moment, her Margaret Chase smith moment, yeah. Wanda, how do you think the senator should vote . I think she should vote yes. I listened to dr. Ford and judge kavanaugh. I was moved by both of their presentations. I considered their presentations, and i have no doubt that something did happen to dr. Ford, but i truly believe it wasnt Brett Kavanaugh. You think that Brett Kavanaugh is in the clear and that even though you felt like dr. Fords testimony was compelling, it wasnt enough . Correct. So if senator collins in a few short minutes decides to vote in a way you dont like, women you still support her . Absolutely not. I am going to lead the charge to defeat her if she runs for reelection, and find somebody that i feel represents the future of maine, the maine that i know which is we need more young people, we need more women in office, we need more people who will protect those of us that are vulnerable. Explain something to me, wanda, before we go, why is this issue so important to mainers . I think it is important that people in to people in maine because maine is turning red, as much as some think it is not, it is turning red, and i like the question that you asked about would i continue to support collins. No, i will not. If she votes no, this will do it for me. I will not support senator collins. You can see, katie, how important it is on the ground, and it is important to note that crowd funding has already raised more than 1. 8 million for collins opponent in 2020, if in fact she decides to vote yes on kavanaugh. Thats how important this is, katie. Thank those ladies for me. It is great to hear the opinions of people who are on the ground in a state where the senator is making a decision. Garrett, lets talk about what we just heard. How much is this weighing on senator collins . You talked earlier about murkowski having meetings with alaskans. Has senator collins been having meetings with mainers about this subject . She has. Their phones have been ringing off the hook for weeks on this issue. Collins for better or worse since the Health Care Vote has been the senator in this congress that received the most focus from both sides. Shes seen as a swing vote on almost everything. It is interesting to hear one woman in morgans segment talking about the idea of maine as a state turning red. New england as a whole has been almost now completely blue. Collins is the last republican to represent any new england state in the senate. Used to be this whole separate breed of northeastern moderate republicanism that faded away in the last decade or so. You can see why that is and how challenging it is to be a republican moderate in this environment, so yeah. Collins has been very engaged, been coming to her as aggressively as they can as much as alaskans, but this is a senator in the cross hairs of the debate. Garrett, thank you so much.
