What do we know about the final week push for biden . Reporter you said it at the top. This is a campaign sending the message its very much on offense. Its got the foot on the gas pedal with the finish line in reach at this point. Were seeing that with the campaign schedule. Georgia today. Democrats havent won it since 1992. Florida thursday. Iowa and wisconsin on friday. Thats states we knew would be the most hotly contested but iowa and georgia folks thought would be beyond bidens reach at this point in the campaign. Were seeing it in terms of a closing message as well. The Biden Campaign previewing a speech in warm springs as the beginning of a closing message. Historical significance here, fdr came here to recover from polio. The biden message is about a country that while it faced a crises in the past under fdr, united, the country can do the same thing now. Michael bloomberg is going to be investing 15 million in new Television Advertising in ohio and texas. For the Biden Campaign, its still very much in play in all 17 states as it closes out the 2020 campaign. You have a different strategy for President Trump hitting three states today. All states he won in 2016. Hes doing the defense thing today. Right, and focusing on the rust belt states of michigan, pennsylvania and wisconsin. And when you look at the electoral map as we have been saying all along, the president must win these states. He can hang onto florida and georgia and north carolina. He cannot lose all three michigan, wisconsin and pennsylvania. Youre also going to see him going to nebraska for one electoral vote in this omaha congressional district. This is an indication of how close this campaign thinks things could get. Biden leads, and there are certain Electoral College scenarios where this race could come down to one Electoral College vote. You see him voting there. I would note here in michigan as weve seen in a lot of these states like pennsylvania and wisconsin, the big issue emerging in the final days is coronavirus. Thats something the president has struggled on in the past. Weve seen when the president s poll numbers or when the coronavirus cases go up, we see the poll numbers go down. Another factor weighing in on all of this as we reach the final days. And one more note, back in washington the president the other day was trying to squeeze a little more juice out of the Supreme Court nomination. Something we havent seen be a big factor in the election really widely among voters but trying to juice up his base with a Campaign Style event at the white house last night. Yeah. That was overnight. We also have today First Lady Melania Trump getting out for her first Solo Campaign event of the season. This speaks to the idea the campaigns are putting out their surrogates who showed that map of everybody out on the campaign trail stumping for both of the candidates. Youve got one of the big guns, probably the biggest for joe biden. Barack obama who is going to be where you are in orlando today. Whats the expectation of what he can do for biden that he couldnt do for Hillary Clinton in 2016. Reporter the hope is barack obama can help joe biden get over the top here in a state that is perennially one of the closest Battle Ground states. Right now look at the average of polling. Biden is up here about 1 poin. 8 points, not quite 2. Trump won it in 2016. The president cast his own ballot. Its the original of all mother ground states. The idea for the Biden Campaign is to try to get one of the big three, joe biden, Kamala Harris or barack obama into major media markets in florida to try to cut through the noise. Thats something that president obama can do in a way that most traditional surrogates cant. Youre in florida. Youre in a place where the air waves are saturated with campaign ads and local news isnt going to cover all smalltime sur gas. A trump Family Member who might come through. This is a former president of the united states. Im at one of the drive in rallies, and its the largest crowd for an event like that that ive seen in the middle of a workday. The Biden Campaign is hoping president obama can draw the eyeballs and compete in a diverse city in florida and get them the smidge, the tiny bit that florida might be decided by come a week from now. Because its all about the scooches and the smidges. The margins. Thats what this race is about. Thats what it comes down to, scooches and smidges. You sure have a way with words. Thank you. Shaq, let me talk to you about wisconsin. There, too, it could be close. This is a state that President Trump really is making a big play for. Obviously so is the biden camp. Youre the first to report this morning something interesting. That democrats there are now pouring money into digital ads to educate voters after the Supreme Court decision came down over night. That decision to catch up folks says that mailin ballots received after 8 00 p. M. After election day 8 00 p. M. Will not be counted even if theyre postmarked on or before election day. The implications go beyond wisconsin. Right now the court is considering similar cases in Battle Ground. Amy Coney Barrett could cast a decisive vote there. All that set up, take us inside with the decision in wisconsin. The reaction from folks youre talking to this morning. Reporter im standing in the middle of 120,000 absentee ballots very returned in the city of milwaukee alone. But its not these ballots of concern throughout the state of wisconsin. Its about the 300,000 ballots across the state not yet returned. Because today the Wisconsin Elections commission is calling it the practical deadline. Theyre saying if you want to vote by mail and if you want to put that ballot in the mailbox, today is the last day to do that or else you risk especially after that Supreme Court order, you risk your ballot not being counted. Listen to what the former director of the milwaukee Elections Commission told me just this morning about what that ruling means for a city like milwaukee. Reporter the Supreme Court order yesterday, what does that mean in milwaukee. What it means for a large urban municipality like milwaukee is that a lot of people will lose their opportunity to vote. Reporter its that simple. Its that simple. That lawsuit was very much about recognizing delays with postal delivery, and affording municipalities the opportunity to count late arriving absentee ballots. Reporter thats a big statement that you just heard from the election official. You may be wondering where is he basing that on . It was the april 7th primary where the courts did give democrats the relief they were seeking by having clerks, by giving clerks the ability to count ballots up to six days after the election if they were postmarked by election night. That saved ballots across the state of wisconsin. Trump won in 2016 by about 23,000 votes. Things are different now. People have more heads up. You can see the potential impact of that ruling that we got last night. Shaq, that is quite a tableau behind you of all the ballots. Are they going to start to count the ballots where you are before election day or after or what . Reporter no. Here in wisconsin clerks are not able to start counting until 7 a. M. Election day. In that conversation with neil he said when you have so many ballots, more than 50 of the vote theyre expecting to come by mail or by absentee ballot. When you have that quantity of votes, its going to take the day after the election to be able to sort through all of them. Its not like going in and voting on election day. That makes sense. Shes set to take the official judicial oath today in a private ceremony with john roberts as Senate Democratic leader Chuck Schumer issues this warning to republicans. Listen. Any idea when shell hear cases and whats on the docket most immediately . No no and yes. I would add at another number, zero, the number of Supreme Court justices in her family right now. She that has take the second judicial oath taken by law. It will happen shortly. Well find out after it happens. The Supreme Court will take a picture of her giving the oath at the private court. When will we feel her influence . It could be right away. There are three big cases sitting right in her inbox when she gets there. She cant vote on any of the cases that have already been argued in october. But there are three cases up on emergency appeals from states two of them are from states from pennsylvania has come back again, the republicans there challenging the extension of the mailin ballot deadline. Another mailin ballot ballot case from north carolina. Those are just sitting there as papers. She can jump right in if she wants and act on those or recuse herself and wait. She certainly once shes a justice, can participate. Theres another important case for President Trumps efforts to stop the District Attorney of new york from getting access to President Trumps tax records. Theres an emergency appeal there now to continue a stay on a Lower Court Rulings that went against the president. And by the way, if the Supreme Court says no, were not giving you this stay, its game over for the president. His accountants will have to give the tax records to the new york grand jury. And then, of course, in november shell start hearing cases. Everybody knows the week after the election is the big obama care case. And thats the one, of course, that so many people are looking at. Pete williams live in our New Washington news room behind him this morning. Pete, thank you. And the city of philadelphia in crisis this morning after police shot and killed a black man in that city. Investigators say the man shot was threatening police with a knife. They say at least 30 officers were hurt in the protests after. Nbcs ron allen has more. Reporter overnight violent protests erupting in philadelphia hours after police shot and killed a black man. Authorities say they were called to a residential neighborhood in West Philadelphia shortly before 5 00 p. M. Monday. A report of a man with a weapon. When Police Arrived they say they found a man later identified as 27yearold Walter Wallace holding a knife. He was brandishing it, and waving it erratically. Reporter video capturing the chaotic scene. Nbc news cannot verify what occurred before or after the events in the video. Police say after telling wallace to drop the knife they opened fire. Shooting wallace multiple times before taking him to the hospital where he was later pronounced dead. The threat that caused the officers to discharge was toward the officers themselves. As far as the totality of what was happening out here, were under investigation. Reporter moments before police fired, eyewitnesss said they tried to get wallace to release be weapon. Im telling him and everybody else to put the knife down. Thats when it matters. Hes in our community. Were not threatened by him because we know him. Reporter the video shows wallaces mother trying to stop him. His mother tried to grab him. Reporter the incident sparking protests in the same area where police and protesters clashed earlier this summer in the wake of George Floyds death. Several officers sent to the hospital after being hit by bricks. One a 56yearold female officer struck by a pickup truck. Residents saying that theyre outraged and saddened police did not attempt to deescalate the situation in a different way. I believe they could have took the right actions and possibly shoot him in his leg. Shoot him in his leg. Or not shoot him at all. Thats the best option. Is now averaging more than 70,000 new cases a day over the past week. Cases in at least 42 tate states are up 10 or more in the last couple weeks. You have texas now neck and neck with california for the most confirmed cases. In el paso a curfew put in place. Auxiliary hospitals are being put up to deal with the surge. And theres an antibody regimen by eli lilly saying its not effective for the sickest patients but theyre keeping up the treatment for people not as sick or for people exposed to the virus. Gabe gutierrez and carla draxler are with us. Gabe, the governor in minnesota says the state is at a critical point. Explain that. Yeah. Here in minnesota the governor does say that, and he says it because hospitalizations in the state are up 70 over the last month. Now, hospitals like this one are busier. They have been for several weeks. And really throughout the upper midwest the last several days weve been seeing this rise in cases. The dakotas where we were at yesterday, they lead the nation in per capita new covid cases. In wisconsin late last week, we were at an icu that was seeing an increased case load. Here in the midwest while the cases are rising dramatically, the bigger concern is what will happen over the coming months, and as they see new cases and as the winter months come here, more people go indoors where the virus spreads more easily, theres concern that some of the hospitals can and will be overwhelmed. Now, here in minneapolis were not at that stage just yet. But still, hospitals are preparing. Theyre planning their capacity over the coming months. And Public Health officials are really urging people to stop this Community Spread. Since june here in minnesota, they have linked about 70 weddings to outbreaks in the state. Authorities are pleading with people to heed the Public Safety guidelines and so social distance and wear masks. The governor saying theyre reaching a critical point. A 70 rise in hospitalizations just in the last month. Gabe, thank you. I want to go to carla in el paso. Because of the spike in cases there, a curfew has been put in place. Right . Reporter yes. Good morning, hallie. Well, sunday afternoon el paso, a judge imposed a curfew after a Record Number of covid cases here in el paso county. Today were counting 1390 new cases with four additional deaths. Its very close to yesterdays record when we had over 1400 cases. This curfew will be enforced for the next two weeks having people stay at home from 10 00 p. M. To 5 00 a. M. Those who do not follow will be fined with up to 500. And under the order, people can go to work or shop for essentials, but theyre expected to stay home and not be out past 10 00 p. M. A county judge says this order is meant to help both the Public Health and the economy by keeping the business still open. Many el paso citizens are concerned this is not enough as we hit a Record Number of cases yesterday reaching over 1400 cases. And right now our hospitals are completely full. We are at capacity. We have recorded a 300 spike in the past several weeks. And Health Officials here are even building or putting an extended hospital in our Convention Center here in el pa paso. Were hoping in these two weeks well our Health Officials will be able to catch up with all these rising cases. Hallie . Carla, thank you. Gabe, i appreciate your reporting on the ground. Im joined now by a doctor who served as Health Policy adviser in the obama administration. Let me pick up with carla left off on covid hot spots. El paso, auk silxiliary hospita hospitalizations around the country are up some 40 . Whats your message here . What needs to be done to try to get a handle on this . Yeah. Good morning. And the message is very clear. We have to stop the spread so the hospitals can have time. Theyre getting better. Were getting smarter about getting people out of the hospital safely. The death rates inside the hospital which used to be as high as 20 in the intensive care unit are much lower now. But the county is that we dont want people to end up in the hospital. And the only way to do that is to prevent that Community Spread that were talking about. Weve got to keep the cases down. As were going into colder season, its really tempting to go into peoples homes. Keep your gatherings small. Keep it tight to the people you know Wearing Masks and are distanced. And try to resist any of those larger settings. Certainly restaurants, rallies, anything that you see. Crowds, avoid. That will help keep us safe. Does that include, i wonder outdoor crowds as well . I ask because as you know my day job for nbc news is covering the white house, and last night, of course, the president held that event for amy Coney Barretts confirmation as a Supreme Court justice. Shes officially sworn in today. Interestingly as we reported here, masks were required in that setting. That was new. You can see people in masks. Thats not something that ive seen at all the events covering the white house over the last couple months. Is that something given the guideli guidelines, you would think could be appropriate . Certainly outdoor, being outdoors definitely helps, because one thing that weve learned is that this virus has the ability to kind of stick around in the air and if youre in indoors, those particles have a longer lifetime inside versus outside. Having said that, your point is spot on. Even outdoors, if youre within even six feet and maybe people are also reevaluating that six feet distance. If youre within six feet, certainly you should have masks. Even if youre outdoors. And the cdc is trying to keep up with that guidance, but you and i have talked before about how the cdc has been manipulated and the messaging interfered with. If youre outdoors, even if you know people, i would retain that six feet of distance, and consider keeping a mask on. Theres that important piece of news this morning about eli lilly. We mentioned it at the beginning of the segment. Theyre ending the trial of the antibody treatment on the sickest covid patients. The companys ceo on our Sister Network a few moments ago. I want to play what he said about the treatment having success with other kinds of patients. Watch. Were also studying and strong results in newly diagnosed patients. Reducing the viral load with an antibody appears to be making a significant different. Were also studying in prevention in nursing home settings. Whats your take away on that given that eli lilly has stopped that treatment that testing, if you will, on the sickest patients but seems to be moving forward on other patients . A couple things. Number one, only 13 of phase one trials overall, not just covid, in general, move on eventually to fda approval. Its hard to get past that first phase. And what eli lilly did in stopping the trial, and remember, this is an antibody drug. Its not the same brand that the president received. But same concept. But the by stopping the trial at phase one, they said this drug in this setting is really not much better than remdesivir which has the full fda approval for hospitalized patients. They have an emergency authorization for the nonhospitalized outpatient setting. Hallie, an important point to mention, giving this drug is not easy. It takes an infusion. It takes skills. Its not going to my Doctors Office and getting a pill. So i think theres still some logistic and probably reimbursement challenges, but it is promising. I want people to understand theres so much attention on all the treatments, we have many that are under Clinical Trial and in development. But the best way to avoid getting in a situation where you need the treatment, of course, is to prevent the virus from spreading. I would see the trial stop in the inpatient setting as a sign that this is this works. The fda and scrutiny of the data is working, and thats the point. Got it. Doctor, thank you for your expertise on the show this morning. We appreciate it. We want to turn to breaking news. This is a Justice Departments effort to defend the president in a defamation lawsuit brought by an author. Pete, whats the nooews . The federal judge in new york said the lawsuit cant be dismissed. She filed a libel suit against the president. She claimed he assaulted her in a department store. He said that was a lie. She sued him for libel. The Justice Department said sorry, were going to take this case to federal court, and you cant sue the president because he was acting in his official capacity, and theres a law that says you cant sue the government for libel. The judge said thats wrong today. He said thats wrong on two counts. First, the president isnt covered by this law because it only applies to employees of federal agencies and the president isnt one. Secondly, it only applies to employees acting in their official capacity. The governments argument had been that when the president speaking to white house reporters denied this, he was acting in his official capacity, because theres a Public Interest in knowing about the president s character. And the judge said today, nope, that has nothing to do with his official capacity. People might be interested in what happened, but thats not nothing to do with the governments business. Now, if the government had prevailed here, her lawsuit would in essence be a dead letter because you cant see the government for libel. This keeps the lawsuit alive. I would think the Justice Department unquestionably will appeal the decision for part of the reason that no judge has ever determined before whether a president is a federal employee. This law has been applied to president s in the past, but courts have sort of assumed the president s are covered by it. So this does seem to be a case of First Impression where the courts are actually trying to struggle with who this law applies to. Thats interesting. Pete williams with the breaking news for us. Its a number thats going to keep getting bigger as we get closer to november 3rd. 75 of voters say theyre interested in the race. Theres another group thats significant, a big group. Were talking about the tens of millions of americans who still have not voted. Many of them not even planning to vote. And they could make up this elections biggest voting or in this case, nonvoting block. Morgan traveled to West Virginia with the county with the lowest turnout in the country at least in the mainland u. S. In 2016. Morgan, talk to us about what you heard from people about what kept them from voting. In many instances, there are barriers for those folks. Reporter there is barriers, but theres also a feeling of desperati desperation. A feeling of being forgotten. When youre looking at the record early voting turnout numbers were seeing from some states, thats not really necessarily the case in others. Were still on track in 2020 to have the largest voting block be nonvoters. And back in 2016 its a pattern that we saw there, too. For example, 100 Million People who were eligible to vote simply chose not to cast their ballot for either candidate. Thats about 41 of people who could have voted. Were seeing that play out in West Virginia. This is a county with the lowest voter turnout and the county in the contiguous united states. We asked people in mcdowel county why they chose not to vote in 2016, and if 2020 would be any different. Take a listen to what they told us. I dont have tv. I dont have internet. I have internet, but nothing to get on the internet with. Im pretty far behind, and i bet a lot of us are around here because were poor. I aint heard about joe at all since ive been here. Donald trump, i dont know about him except the last couple years. Ill probably vote for donald trump. He keeps the people to the tv set. One, trump is good. Two, biden, however you pronounce his name, hes good too, but like i say, i cant judge either one of them. Its the same community. It aint never going to change. Because if its going to change, none of this would look like this right here. Here on welch. Welch aint changed in the last three or four president s. Reporter so what youre hearing, hallie, is this sense that people feel left behind. And honestly speaking, i spend a lot of time in West Virginia. Both of my parents are from West Virginia. And talking to voter there is, they feel this lack of hope. And for many voting is an act of hope, but they feel like politics doesnt matter because they dont feel like they matter to politicians. These are people spending their time trying to buy groceries, put food on the table. Making sure they houses arent fore closed upon. Theyre saying it doesnt make much difference in their communities. They havent seen or felt real change. And that sentiment was captured in a poll when you look at the people who identify as people who have rarely or never voted, they send to be under the age of 35. They tend to have less financial resources. They tend to have less education. They also are more likely to have been people who lost their jobs within the last year. They say they dont feel like theyre represented by either party, and thus, either of these candidates. Hallie . Morgan, thats a super interesting look at as we talked about what could be a Significant Group this election. Morgan, thank you for that. Theres another key voting block, black voters making up more than 12 of the nations electorate. New reaction about comments from Jared Kushner. Some call it disrespectful. One thing weve seen in the black community, mostly democrat, is that President Trumps policies are the policies that can help people break out of the problems theyre complaining about. But he cant want them to be successful more than they want to be successful. The white house says critics are taking the comments out of context. I want to bring in our Senior National correspondent Chris Jansing in ohio. Youve been talking to black voices for trump about their strategy. People talk about black voters. Its not a monolithic voting group and shouldnt be referred to as such. Talk to us about what youre hearing about in ohio in that town. Reporter columbus, with a heavily black population, im told this is the first time republicans have ever had an office in a black neighborhood. Black voices community center. The campaign has spent millions of dollars opening them in places like columbus and cleveland. I can read the quote. He said theyre complaining, but he cant want them, meaning the president , to be successful more than they want to be successful. And i think that is absolutely true. We have a major part to play in our own success in america. Reporter one of the things theyre watching closely is the that black vote here in columbus and across ohio. Hillary clinton had about 10 less than barack obama. That was worth a 2 movement within the black community can be the difference between winning and losing which is why black ministers, evangelical ministers are getting out and doing grass roots. Even though we have seen that in some polls clearly in ohio, more than in michigan or pennsylvania or wisconsin, black voters were trending toward trump, what were seeing in early voting, which is huge here, three times what it was in 2016, a lot of that is in urban areas. Analysts tell me that may mean the pendulum is swinging back toward joe biden j but the fight is on. More than 1. 5 million pennsylvanians have already cast their vote in this years election. Right now theres a line outside the Philadelphia City hall. Its the last day for people to submit their mailin ballots after applying in person. Weve seen this turn out like this for about a month. Pennsylvanians telling me theyre motivated by the confirmation of amy Coney Barrett, the racial unrest around the country. Theyre looking for change. Today the secretary of state is urging people to get out and vote today otherwise bringing in their mailin ballots over the next week. Hallie jackson will have more for you after the break. So there are two big things happening across the country right now. People are voting. Early voting is up in Record Numbers. At the same time, the number of people being hospitalized with coronavirus is also going up. In some parts of the midwest, that number is closer to 70 . Thats a lot of people, a lot of family, not just worried about their and their loved ones health, but also on how to cast a ballot and make sure its counted. Talk to us about how patient voting came to be. It was not sparked or put in place because of the pandemic, right . Patient voting is a Nonpartisan Organization to help patients vote using an emergency absentee ballot. This came to my attention in 2016 when i was still rotating in the Emergency Department as a medical student. When i tell somebody they need to stay in the hospital for their pneumonia, their heart attack, i often hear things like, i cant stay in the hospital, im the sole caretaker of my grandmother or theres no one around to help me feed my dogs. I understand that. But during the election, i heard a new reason which is i cant be hospitalized, i need to go vote. That really resonated with me. That really touched me. What i realized was i didnt realize there was a process in place for patients to vote. Thats the case in most states. You started this before the pandemic, as we talked about. You said 2016 inspired you. How have things changed . Well talk about how you get hospitalized patients to vote. How have things changed with the pandemic, with these coronavirus cases, during an incredibly intense president ial Election Year . Sure. The states are all handling this in a very different way. Baseline the states also have different processes for how they use these emergency absentee ballots, but theyre also responding to covid in different ways. Some states are canceling their inperson nonpartisan teams that the board of elections sends to the hospital to help them vote. Some hospitals are adapting and allowing patients who are maybe isolated in the icu to vote electronically where historically they havent allowed that. All sorts of adaptations made this year in 2020. You mentioned youve had families with a loved one on a ventilator saying what if they wake up tomorrow, i know theyre going to want to vote, how do i help them do that . How do you respond to that . Thats very emotionally intense i imagine. Families are our patients best advocates. I think of it like informed consent for a surgery. The patient has to understand and be really interested in that, but families are doing everything they can to make sure they have all the materials ready for their patients, for their Family Member, just in case they wake up and say what day is it, can i still vote . So talk through before we go, dr. Wong, what are the different steps . How do you help the people youre working with understand how that process moves forward . With students with regular absentee deadline passes in the state, that can be from one day to 21 days before the election. Patients can fill out an emergency application. Sometimes theyre available online. Sometimes you need to call your local election official to get that application and sometimes you can call in and say, hey, im in the hospital. The patient completes that application and then their Family Member or Health Care Worker will take the application to the board of elections and the county where that patient lives. Depending on the state, the ballot will either get returned to the patient in the hospital by election officials, like i mentioned earlier. Or sometimes the patient can nominate an authorized representative which is typically a Family Member to pick up their ballot and bring it to them at their hospital bed. The patient votes. Either that authorized representative brings it back or the board of elections takes it back to be counted. Dr. Kelly wong. That is a fascinating look at an incredible organization.
