Their fight for the full unredacted version. We suddenly have a lot of news this morning. Our team is here with that and lets start with hans nichols at the white house and legal analyst and former federal prosecutor anita White House Correspondent for politico and ken political reporter for New York Times. Hans, this lawsuit accuses democrats of declaring an allout war against President Trump. Whats the deal . This is an aggressive, offensive lawsuit by the president s personal teern attorn attorneys. We asked the white house if theyre in agreeance with this. We havent gotten word back on that. This is essentially a defensive posture. What the president s personal lawyers are trying to do is set up a ring fence around the president s old Accounting Firm. Now, theyre the Accounting Firm that did all kind of things for the president including his tax returns. They are trying to ring all documents according to this document. When we talked to jay sekulow he indicated this had to do with other financial documents. The basic issue here is that the Trump Organization doesnt control the financial documents that may be in the hands of their old Accounting Firm. What theyre trying to do is have a force field around that Accounting Firm and prevent them from disclosing to the House Oversight committee on capitol hill that theyll share all of these documents. So, its basically defensive, even though this is an aggressive, legal move and i think well find out shortly here how sort of unique it is. The other thing happening about this is on the legal front, the political front the president repeating on twitter if there is no under lying crime, there cannot be impeachment. Him planning for the long term. A political strategist and also a legal one. Hallie. Hans, we have a statement here that were about to show folks that is from the Trump Organization from the president s attorneys. That the committees attempt to obtain years worth of confidential information from their accountants lacks any leg legitimate legislative purposes and is an abuse of power and is an another example of overreach by the president s political opponents. Stand by for a second. Leeann, it is early yet. Just 18 minutes into this thing. Has there been any response from House Oversight . Do you expect any and remind us what theyre trying to get. Hans points out this was not the tax returns but other financial documents related to the president. Thats right. No response yet from the House Oversight committee. We do expect one, im told, momentarily, it could come. This was news to them, as well. But the company, yeah, its not about his tax returns but about financial dealings of the president. And the company is expected to hand this information over to the committee. Theyve subpoenaed and theres no expectation that theyre going to defy this subpoena. So, thats assuming while the president and his attorneys are definitely taking this defensive posture, as hans said, getting ahead of that. Cynthia, let me go to you. Part of the lawsuit talks about how oversight and transparency and the view of the president s attorneys is not legitimate legislative purpose that can justify subpoenaing a private citizen. Theyre saying House Oversight doesnt have a legit legislative purpose here. Do you see it that way or no . No, i dont see it that way. I tell you this in the case law. The House Committee has very Broad Authority to subpoena information that affects any current statutes or future statutes. The courts have deferred and tried to stay away from judging the contents of subpoenas as sort of a separation of power issue. And we know in this case that cohen has testified before congress about financial improprieties both increasing and decreasing assets and submitting things to Deutsche Bank and things that he accused the president of violating current statutes. And so it seems to me that what will happen, well have a bit of a ballot and ultimately hell have to turn the information over. Quickly, ken. This is more traditional oversight of the sort that we have seen from past congresses of president s of the opposite party and this is, in some ways, a good fight for democrats politically to be in. Because they can turn the page from impeachment and talk about some of these potential improprieties in the documents that were used to obtain loans by the president which we heard Michael Cohen testify about. Speaking of impeachment that is conversations that members of congress are having. We understand there will be a call later today with House Democrats. Walk us through what we know. Yeah, sure, hallie. A call this afternoon with House Democrats to discuss the Mueller Report. Remember, congress is not in session right now. They have been out for a week and a half now. This is the first time that democrats are going to gather and to talk as a group via by phone, not in person. But this is going to be an opening conversation on what to do to respond to this Mueller Report. House democrats are having a huge debate internally right now on if they do move forward with impeachment or if they do to continue to investigate and opening these impeachment proceedings is a major decision. One democratic aide told me that the party is at a cross roads and what they decide in the next few weeks are going to really determine the 2020 election. Because not only is there a constitutional issue at play here that House Democrats or democrats in general are talking about, but its also electoral issue, as well. Do they start impeachment proceeding or try to beat the president at the ballot box . Theyll have this conversation and it will really start this afternoon with this Conference Call. And ill tell you what. I was sitting here at this set with chuck todd on meet the press and jerry nadler said something that stopped some folks in their tracks. I want to show you some of that exchange here. Do ai thiyou think this is impeachable . Yeah, i do. I do think that this if proven, if proven, which hasnt been proven yet, some of this would be impeachable, yes. Obstruction of justice, if proven, impeachable. Im not there yet, but i can foresee that possibly coming. Anita, do you get the sense that youre seeing an openness on the part of democrats to move towards this, even as House Speaker pelosi has said, hey, pump the brakes here for a second. Both things as they were just saying. First, they need more information or want a lot more information as we see the Trump Organization, the white house is responding to these investigations and theyre not giving the information they need. If they do not get other information, it will take them a while to get all the information they need to decide on impeachment. We are in year three already. A lot of people are saying wait for the election and were almost there. If this investigation takes months more, were already to the election. Cynthia, you have the president s attorneys going after, and, remember, the people who filed the lawsuit, the statement we got is from the new legal team is that brought on to represent the president in the tax returns and financial documents and his other attorneys are mounting a vigorous defense of the president , not just on this front, but also as it relates to the Mueller Report. One thing that Rudy Giuliani is talking about is the idea and im paraphrasing. Its okay if other countries interfere if the information that they give is accurate. Here he is saying that. There is nothing wrong with taking information from russians. Depends on where it came from. It is okay for political campaigns to work with material stolen by foreign adversaries. It depends on the stolen material. Cynthia, if youre sitting in the kremlin and youre in china right now and beijing, how are you hearing that and should americans be worried about that kind of language . Americans should be very worried about that language. It means its open season to interfere in the american election. Whatever was left of Rudy Giulianis reputation has now just swirled down the last bit of the drain. Thats just a shocking thing for a Law Enforcement person to say. I mean, he had a great reputation as a Law Enforcement officer and now hes just a pathetic excuse. Cynthia, i dont know where to go on that piece as you vividly put it. I mean, its so depressing that anybody would have those would say giuliani is doing what his job is which is get out there and defend his client. Im not taking a position one way or the other. His job is not to be a lawyer, i can tell you that. No lawyer would say such a thing. Hans, i know you want to jump in quickly. Yeah, just a quick point, guys. On the claims for the relief at the end of this suit, the president s legal team acknowledges that the president as a private citizen may have committed a crime. And this is sort of the interesting legal argument theyre putting forth. If he committed a crime which these Financial Disclosures and these documents withed show, it would be the purview of the executive and the Judicial Branch and not congress. So, in this back door way of trying to defend the Accounting Firm theyre acknowledging the president as a private citizen they have committed a federal crime. Hans, we have to leave it there. We want to get to breaking news this morning, more of it out of the Supreme Court. Involves the rights of lgbt. Pete, what do we know . The Supreme Court this morning agreed to hear next term in the case that begins in october a question that has divided the lower courts. Did the Civil Rights Act of 1964 that outlawed discrimination on the job based on sex, does that apply to discrimination against lgbt individuals . Now, some courts have said, yes. You cant discriminate against someone on the basis of Sexual Orientation without discrimination on the basis of sex and others have said, no, when Congress Passed the Civil Rights Act in 1964, it wasnt even thinking about the issue of lgbt discrimination. So, the Supreme Court is going to wrestle with this next term in three Different Cases that involve a man and a woman and a transgender individual. But heres the thing. Four years ago the Supreme Court said there is a right to samesex marriage. And Anthony Kennedy is the one who has written all the Supreme Courts in essence ruling. He is now gone, replaced by the more conservative brett kavanaugh. Now, normally you could sort of guess what the Supreme Court might have been thinking when it grants a case, but because these cases involve decisions both for and against this issue of lgbt being outlawed by the Civil Rights Act, you cant predict how they will decide this case. But the first hot button case that they will hear since kavanaugh came on the court. Pete, thank you much for that. Appreciate it. Just about two months up till the first democratic debate. That was another explosion on the streets of sri lanka this morning after officials found and detonated an additional bomb in the nations capital. The series of simultaneous explosions at churches and luxury hoteled killed nearly 300 people on Easter Sunday and another 500 people hurt. Officials are calling it an orchestrated attack. Several americans are dead, according to the state department. With the identity of one of the americans confirmed. An employee at pierson caught in a blast at a hotel according to a statement from the company. Officials are blaming a local group that many folks may not have heard of that a critical warning could have gone ignored. Janice joins us now on the phone from sri lanka. I understand a curfew may have just gone into effect. Tell us what is happening. This is a curfew for a second night and stepped up military presence and Police Presence on the street. Were on the phone because our live location was shut down. You mentioned that explosion earlier today it was the bomb squad discovering a suspicious van. They were trying to work to defuse the device that they found inside and it went off and also found a homemade bomb near the airport and found detonators at a bus stop. Secondary explosions are a known tactic of many militant groups. Its part of the reason that the government is imposing a state of emergency starting at midnight local time tonight to try to get a handle on Public Safety as we figure out who is behind the violence. The fbi is on the ground and interpole dispatched a team here. Several members of the government are blaming a local group but theyre convinced that they had to have help from foreign terrorist groups because what they find stunning about this is how coordinated the bombings were ripping through three churches and three hotels at almost the same time. The forensic analysis they have been able to gather at six of the sites show that suicide bombers carry out the attacks and training, equipment and planning. They arrested 24 people so far. And what is troubling about this, hallie, is that Security Officials were warned about this ten days ago of potential attacks on churches and other countries shared intelligence. The big question on this investigation is why nobody acted on it. The secretary of defense today told nbc that they knew certain things were going to happen and they didnt expect it to happen so soon and not of this magnitude and it really is staggering. The death toll hovering here 300 and 35 foreigners among the dead, including two americans. Hallie. Reports that the government moved to shut down certain social media sites and the apps in the hours after the explosions happened. This was almost a snap reaction which is quite extraordinary. Not unprecedented here. The government has made this move before. But they did see that as one of their first measures. To shut down social media. Facebook, instagram, youtube. They see social media as a way for misinformation or bfake new to spread. When this happened before, they havent believed that Companies Like facebook have done enough to put in controls to stop misinformation that could have violence so the government took this extraordinary measure and it is moving into a second day. Back in this country new problems for boeing and another one of their planes. The 737 dreamliner. That jet is being made with shotty manufacturing practices. This has been released, revealed, you could say in a new New York Times piece. Outside the boeing plant in south carolina. Gabe, not only the latest problem for boeing but pushing back on the reporting of concerns of the dreamliner. Yeah, thats right, hallie. Boeing is pushing back on this New York Times piece but the company is under major scrutiny after the two deadly crashes that claimed more than 300 lives. Those crashes involved another aircraft, the 737 max but now were talking about this dreamliner and the company broke ground a decade ago to build that plane and these new allegations are based on a New York Times investigation that looked at hundreds of documents and interviewed more than a dozen employees. We spoke with one of those former employees, hallie. Sean barnett retired after 30 years and boeing says that it has substantiated two of the ten claims he has brought up and are fixing them and one that the metal slivers created during installations were left dangling over crucial wiring and in his opinion that could be dangerous. The times reports that boeing determined that those wirings, that that issue did not present a Flight Safety issue and according to the times employees said still filed nearly a dozen whistleblower claims and safety complaints. Still no evidence that any of them turned into fullblown safety problems. Now in response to the times investigation overall boeing sent an internal letter to its employees saying the piece paints a skewed and inaccurate picture of the program and our team. But the idea of biden running for president maybe successful winning the presidency, thats another long time coming. You see here 2020 he may enter the race and we talked about this before. If he won he would be 78 years old on inauguration day. That would be the oldest president inaugurated. Look at this, you can go back to 1980. This is the first election that joe biden senator from delaware was constitutionally eligible to be president. He was 37 years old. He thought about entering the race in 1980 against jimmy carter and ted kennedy and the democratic primaries. He also thought about it in 84. In 84 he didnt file but signed paperwork to enter the New Hampshire primary. He gave it to his sister and he went and he thought about it and decided not to run. He did run in 88. A moment there when he thought it might emerge on the democratic side of thing. This was a career altering moment for him and that year ended in scandal a plagiarism scandal and thee thought about running in 04 and did run in 2008 and didnt get anywhere in the primaries and did impress some people on the debate and he had that moment in 2016, we all remember. Would he run, wouldnt he run. He decided not to and i dont think he expected. Hillary clinton loses the general election and an open democratic nomination in 2020 and heres biden well into his 70s with an opportunity he didnt expect to have. So, if he does go forward in running, you could say this is somebody who has pin eyeing this for a long time and probably figures this is the last shot he is going to get. Longer literally for you and i have been alive, steve kornacki, to put that in perspective. Mike, what is the deal now . Will wednesday be the day . What are you hearing about this roll out and announcement from biden and sources you talked to on his team . One thing i learned from covering joe biden over the team. Always take a plan with a grain of salt. His team around them have been looking for an announcement some time after easter and wednesday is the date that has been most talked about. The thing about joe biden, he wants the announcement to be authentic to who he is. In the last few days as they are working through various contingencies he is weighing in now at a late hour and that may change things. Im going to have a bag packed and be ready to go wherever i need to go whatever day it turns out to be. The clearer point he is in the race and to steves point i was looking back as you often do in the moments before the official announcement of a candidate. In 2012, i was the Pool Reporter on election day when joe biden voted for himself for reelection as vice president. I said is this the last time youre going to vote for yourself on a ballot. He said, i dont think so. Now it looks like he will have the chance here in 2020. I want to bring adrian and michael into this. One of the things that steve mentioned is bidens age, something to talk about here. Mid70s and younger Democratic Leaders have been gaining more and more recognition inside the party and i want to talk through some of this with the sound bite from ocasiocortez. She said she will support whoever the nominee is. Here is a piece of that. I can understand why people would be excited by that. This idea that we can go back to the good old days with obama, with obamas vice president. Theres an emotional element to that, but i dont want to go back. I want to go forward. She is talking there how a biden candidacy doesnt particularly excite her. Do you see that as something that is extrapulated to this group of young voters that are looking for more change . I do, hallie. I dont think joe biden is going for the wing of the party where he is seeking votes and looking to build his coalition. He is going to do very well with White Working Class voters and do very well with africanamerican voters and two blocks where we need to have somebody who can generate excitement along those two bases. That is very critical Going Forward. He has deep roots in some of the early states. In iowa and south carolina, he has performed decently well in those states before and he also has a broad group of support in those two states which will carry him well in a crowded primary. For joe, for him less about age and more about fighting off this establishment candidacy stigma. Democratic Party Primary voters are not always friendly to the ist establishment candidate. We had to fight that stigma and fight it to an extent in 2016. I ink tthink joe will do well. Can he raise money and hold on to the support he has so far . He has 99 , probably 100 name i. D. , frankly. The question becomes, can he actually grow his base and succeed well in this primary under the Current Conditions that were facing. How is team trump eyeballing team biden . They see him as a real problem. When you look at the field, i suspect donald trump recognizes that joe biden is the only candidate on the democratic side that can pull independent and those republicans who are disaffected from his party building. So, yeah, i think if theyre smart, and they are, looking at biden and theyre seeing the potential fight ahead. As one that could be problematic for the president because of biden. Everything that adrienne said, of course, being the case that he can make the draw and the appeal. Across those lines that trump is going to need in those states like wisconsin, michigan and pennsylvania. And bidens going to come. I appreciate where alc is coming from but the idea that a joe biden represents looking backwards is a total misunderstanding of the political landscape. Somehow politics works that way. There is this interconnectedness that voters make between those that they think can best represent their interests and those who cant. Sometimes in the political environmen environment, that may mean looking at a joe biden versus mayor pete because who has the best opportunity to win the election. Who is electable against theis other candidate. How he started to take money for his 2020 campaign. Fundraising is never a strong suit for biden, particularly as you have senator Bernie Sanders and Elizabeth Warren saying were not going to take big money fundraising at all. Do you see that being a problem for biden . With the highdonor class that will serve him well if he runs. But other candidates that rir theyre also looking at. The litmus test has been Grassroots Fund raising. Raise a lot of money from small donors and theyre concerned about working on that as one of the final pieces of the puzzle this week. Ive been really careful about talking about what to do if an impeachment came before us. First, i want to hear from bob mueller. Im focused on replacing him the oldfashioned way. We should open proceedings in the house and then the house can take a vote. So, adrienne let me start with you. On impeachment warren just stole the show from her dodging democratic rivals according to nbc news as 2020 game out this impeachment quandary. Is Elizabeth Warren holding the winning hand here or no . I think Elizabeth Warren is appealing to a part of the base that wants to see impeachment take place. You are seeing Kamala Harris that is more reserved here. The impeachment proceedings start in the house and then if impeachment passes the senate takes a vote. T to allow impeachment to come to fruition and to remove donald trump from office. Thats where some of the trepidation comes from and if you take a step back and say it is congress roll e to look int the Mueller Report and essentially hold the Trump Administration accountable and it makes things more clear. I think ill see candidates a little all over the map on this. If Congress Just does its job and exercises its Constitutional Authority to look into these matters, things with come a littles go to senator harris. She wants to see him come in. My question to you guys is we have 450 pages roughly. 448 pages from Robert Mueller. What else do you think democrats need to hear or should hear . I think there is a lot of redacted information they want to get their hands around and understand. Theres that piece of it. I still think that there are prior individuals who its not like Robert Mueller will talk about that redacted info. I think having mueller come in is another effort to put off this difficult decision. I think they can go to court and try to get the grand juray information. I think the impeachment at this point, i ink the youre beyond that. What do you mean . The reality is donald trump has done a very effective job from the very beginning of gaming the system where he controls the narrative on it regardless of what people want to think and feel on it. The no collusion has been the mantra from the very beginning and the public has bought that. That is what they believe the result is. So any additional steps at this point seem extra. It will play into his hand. Plays much more into his hand and trump, quite honestly, would open thats my reporting, actually. Telling sources over the weekend in and around the white house the president has been telling friends and ally look what happened after the impeachment proceedings. Another thing he can hold up to say, i have been vindicated. A drienne, we should note tht senator warren has rolled out another ambitious policy prop e proposal very detailed and she is talking about the plan to wipe out essentially student loan debt. This indepth proposal she is talking about. She has done this every week for six weeks. Does she risk stepping on her policy message by coming out and being the torch bearer at least for right now on impeachment . You know, hallie, i dont think so. She has done such a good job when it comes to rolling out policy and the deal with financial issues. She has led the charge on that for the primary candidates. I dont think her talking about impeachment the way she is talking about that impacts that. You will see more candidates address how they think congress should handle impeachment Going Forward and we heard from Elizabeth Warren and we will hear from more candidates and at more events soon. But the thing that i find interesting about Elizabeth Warrens candidacy so far and ill get off topic talking about how much money she raised in comparison to how much she spent. Her burn rate was 85 which is not a good sign for somebody at this stage of the game. She is still leading the way on key policy issues in the primary and that is what is really keeping her in this game. This Second Quarter is very critical to how her candidacy prevails moving forward. Thats a good point. As we talk about who else to watch, not just the 2020 candidates, its also people and certain leaders on the hill and i thought that playbook, i think it was playbook that had a nice laying out of this of who to look for. Pelosi, hoyer, com cummings and jeffrey, as well. I do think these are potentially impeachable offenses. Actually holding impeachment hearings are two different things. A lot of time that elapses in between those two thoughts. I think what nadler was doing was acknowledging to the base and the core of democrats out there who were like, yeah, lets go for it. Seeing the evidence and saying that is there and nancy pelosi will prevail in the end and taking a more measured approach to this and using investigations that the Committee Chairs have under their belt that they started as a way to go at this issue. Lets look at what steny hoyer said last week. They dont want to go there. They dont have the information to go there and he got criticized by members of his own party. He backtracked. That wasnt a mistake that he said that. Such a tricky line for them to walk. People on the base clearly do want to see donald trump challenged in a very aggressive way and no more aggressive way than impeachment. The Party Leaders say a Great Potential for it to backfire and play into trumps hands as we talked about. So, very deliberative and theyre putting up all these sort of benchmarks that they can say, well, were not ready to go there yet because we havent heard from mueller. We are not ready to go there yet because we dont know what is behind the redactions. At a certain point, maybe they wont have to make a decision. But at a certain point the base will demand and certainly reporters will continue to ask these 2020 candidates and the Party Leaders about it and i think the dodging will sort of come to an end at some point.
