Indicted. The president believes when this report, once it is submitted and becomes public, once it clears him, the president will use that to make the case that hes been vindicated to the entire thing, its been a ridiculous pursuit that amounts to a de facto coupe. You heard him say Robert Mueller wasnt elected the same way he was. It doesnt work that way. Thats the position the president is trying to make as he tries to shape Public Opinion through his tweets and public statements. Notable also the president when asked directly if the white house would cooperate with the investigations, and the requests for documents by white House Democrats, the president turned to an attack on as he has before, the investigations being conducted by the house. Thats right. And hes using the same approach with the criminal, the civil, and the congressional investigations to him and his family and his personal and business affairs. Casting it with a wide brush to call it a witch hunt, even though theyre separate investigations. And geoff, what would you characterize the president s mood as . He was chatty the last time on the south lawn. He wanted to stop again onnen his way to south florida where hell meet with caribbean countries. Thats right. Youre right. He did some months ago refer to african nations and haiti as shole countries. I have to imagine whether or not thats going to come up when he sits down with the leaders. One of the things theyre going to talk about is the crisis in venezuela this. A lot of them depend on oil and gas from venezuela. You asked about his mood. Its really hard to compare his mood today to any other day. He seemed to be in decent spirits. He again repeated that chorus of no collusion hes been saying for the past 20 months or so. Particularly when he talks about the guidance he believes the doj has as it relates to his potential liability, give us some of the fact check or reality check there. Well, if what hes saying is that theres been no indictments of anybody by Robert Mueller for basically the reason Robert Mueller was given his homework assignment, the facts speak for themselves. Nobody has been dwooit indicted for that, and everything points to Robert Muellers investigation being over. We dont know when the Mueller Report is going to come. Were on a day today thing here. It could come any day now. Every day we have reasons to think it might be today or it might not be, and were sort of at a 50 50 posture. It seems like that report will come within a matter of days. And that tells you that the Mueller Investigation is over and that this central finding is that there hasnt been any socalled collusion or at least none that led to criminal charges. I think those facts speak for themselves. The broader question, though, of what the Mueller Report is going to say, we dont know. We dont know what sort of narrative its going to have or what else its going to say about that question. And pete, as we took a live look, that was President Trump at joint base andrews getting on air force one ready to head down to south florida. Hes spending the weekend at maralago. I know you are our resident tea leaf reading expert. At this point its a matter of wait and watch with Robert Mueller . Right . Precisely. We thought it might come yesterday. It didnt. I suppose it could have come again today. Its just hard to say. I suspect that the Justice Department has some sense of when its going to come. But theyre just not saying one way or the other. Were left to kind of read the pizza boxology of are people staying late kind of thing. Thats what were reduced to. Its obvious that this stage is about over. Now, that doesnt mean that there arent other investigations going. You talked about the ones in the congress. There are other cases here in washington in District Court in new york. In federal District Court. So it doesnt it isnt the end of investigation small i. The capital i, Robert Mueller, its all over but the report. I want to see if Geoff Bennett is still with us. Were getting a gut check from the legal time from Rudy Giuliani, the president s outside attorney with new reporting this morning on what they expect to happen. And listen, i want to bring in charlie and alexi and jill and caroline. Sources close to the president s legal team that i spoke to are optimistic that this report is not going to be damaging to the president. Politico has a piece out this morning where they talk about how some democrats are starting to think hey, maybe this report is not going to be damaging and reconfiguring their expectation setting. Well, the president s lawyers, as you mentioned Rudy Giuliani, have a terrible track record of predicting whats going on. Its not worth paying attention to them until theres a document in their hands. To the point of what we havent seen indictments yet. I think a lot of the wisdom is were moving toward what pete said. If youre Robert Mueller and youre going to indict someone that might be close to the president , it might anger him like donald trump junior, youre not going to do that until the second you drop the report. So you go back, were out of here. So i dont think we can the facts have to speak for themselves. Did you hear anything different from President Trump today . This is about the expectation. I would have been surprise first down he said i heard about the mueller rot aeport. Mueller has remained silent as is appropriate. And no one knows when the report is going to come. No one knows whether there are pending indictments, whether there are sealed indictments already filed. We dont know. I agree if there was going to be an indictment of any of the president s children, that it would be the last thing you would do so as to not be there when the president erupts. And in order for us to have to read the tea leaves, we need tea leaves. And we dont have any. Theres no evidence right now for us to conclude whether or not the Mueller Report is imminent. Let me stop you there. I think we have some tea leaves. Right . Based on our reporting from our team. For example, the number of prosecutors, the number of personnel on muellers team has dwindled. Right . Youve seen people, for example, carrying out boxes. Indications that this is likely winding down. That is a possibility, and certainly i thought when weissman resigned and then the next day you had a delay of the sentencing of gates because he was cooperating in ongoing investigations. And so he couldnt be sentenced yet. Which sends the opposite information. The manafort case is over. That was what weissman was working on. His resignation may mean that manafort is done. It doesnt mean that Everything Else is done, and there are also the spinoffs to other jurisdictions that could still be going on. We just theres just no way of knowing until, for example, all the evidence seized during the search at roger stones home has been gone through, you cant wrap up the investigation. You have to review all of that. And his own trial, roger stones own trial has been delayed because of the volume of material was so much that it took them a long time to go through it. So i think we just have to be patient. It could be wrapping up. Everybody is on sort of hooks waiting. And i think that includes the president. Right . I mean, he is on air force one, the plane you see taxiing down the tarmac. The president will be landing in south florida in a couple hours where hes set to hold an event down there. Today it will be different. Carolyn, and then geoff. Lets drill down on what the president had to say about Robert Mueller this morning. Lets listen. Its just a continuation of the same nonsense. Everybody knows. They ought to go to work, get infrastructure done, and get a lot of other things done instead of wasting everybodys time. Swoowell see what happens. There was no collusion. There was no on suction. Everybody knows it. Its all a big hoax. I call it the witch hunt. I know the attorney general highly respected. Ultimately will make a decision. It wont be. If there is, it will only play to our advantage. Your reaction . How many times can you hear that perpetual refrain, witch hunt . Its all a hoax . I think whats actually astounding and we really should take a moment to pause, is the fact that this investigation has been given a chance to come to an end. It wasnt really a given that President Trump could allow this investigation to continue, because this is a unique situation. One that america has not been in before. Right . Robert mueller is part of the department of justice. He is subordinate to rod rosenstein. Its not an independent investigation where they turn to another body outside of the Justice Department. To a certain extent, President Trump could pick up the phone any second and call bill barr and say whats going on . When am i going to get the report . It sounds like he has more information than we do, but there could be a lot going on behind the scenes that were not aware of. Geoff, you and our team at the white house unit, Kristen Welker and others have new reporting now on the strategy inside the president s legal team. I was told a couple days ago they may not end up releasing that counterreport. That theyve been compiling it for months. And Rudy Giuliani is talking publicly about this. Fill us in. Thats right. And Charlie Savidge made a great point. Whenever you talk about something Rudy Giuliani said, you mention the fact that Rudy Giuliani himself says he has a dual role. Hes the president s attorney and the president s public spokesman when it comes to russia, and Rudy Giuliani has a track record of saying things that turns out not to be so, but hes the president s lawyer so we have to report on what he says. He says he met with the president yesterday for about 20 minutes. He describes the president as being prepared for the release of the report. He says once mueller transmits the report, the legal team, the outside legal team, will acknowledge that. Theyre making clear they reserve the right to make comment they reserve comment until they review the report. And then he adds if theres something factually inaccurately thats stated, well respond as appropriate. That speaks to the notion of a counterreport. They might do it. If they dont find cause, perhaps they wont. Alexi . The idea of a counterreport is the least surprising thing. I would imagine wed get tweets if they dont release the report. The other thing about Rudy Giuliani, i think its interesting. We reported last weekend that he sort of has this vanishing act. We havent seen him since january 20th. Thats when he made the ridiculous comment about the trump tower moscow deal talks lasting longer than the president said it lasted. We know that Rudy Giuliani when he talks about these things can implicate the president in things he doesnt want to be implicated in, but part of his role is to undermine public confident in the Mueller Report. Im not surprised hes making wild guesses. Mueller knows more than any of us know. The point of Public Confidence in the Mueller Report is interesting. Weve seen polling suggest lets pull up that poll. We have the recent polling showing peoples confidence in a pair and impartial investigation. Theres a huge divide. Between republicans, democrats, and everybody in general, as we get the numbers ready to go on the screen, 33 of democrats say theyre extremely or very confident. People overall, 50 of democrats say they are. 18 of republicans. Its consistent with i think where we see the country as a whole right now regarding this presidency and the investigation into the relationship between this campaign and russia in terms of meddling and just what people are going to believe based on what theyre consuming in terms of their media. What will be interesting is to see how it changes based on what the report reveals. As we say, we dont know what it will reveal. What we can rely onto your point earlier is even if the white house does not release a counterattack, they will consistently push back on anything that suggests that the president and his team did anything nefarious as they have been doing since day one. Theyre campaigning for 2020. Thats a central piece. And to that point, the trump team says theyre confident it will exonerate the president. Theyre ready to go with tweets, fundraising, blanketing air waves, campaign rallies. We know one thing for sure. Mueller is not going to indict trump. Because the constitution doesnt let him. Its easy to predict that team trump will jump on that. Claim vindication even if mueller found terrible things and was prohibited from indicting him. And i think building on that earlier point of will the president s children still face legal jeopardy or will they pull back from it . In one sense, even if theyre not indicted, this is the end of the beginning, not the end. Theres a big question about how much theyre going to make public of negative information they found, someone they chose not to indict, and you can imagine that with total confidence, i will predict that congressional accounts intend to spend the next two years trying to drag that information into the light accusing the president of covering up something and trying to get the underlying files. Pete williams is with us. Jump in. I wanted to say one thing. I have such respect for charlie and jill, and im constantly eating charlies dust when i read his stories in the New York Times. It doesnt seem likely to me, though, who knows. I say this with great humility, because i could be wrong. It doesnt seem right to think that Robert Mueller on his way out of town would drop his report and another indictment. This is a former marine. That would look like he was in retreat. It just doesnt seem plausible to me that there are other indictments yet to happen. But you know what . Pretty soon well know whether thats true or not. Yeah. And pete, to your point, i know there are those close to the president who obviously are invested in this and invested in trying to spin things a certain way but who believe there are not more indictments coming. And the grand jury hasnt met for a month and a half, i think. Heres the problem. Ill pull back the curtain. We dont know. This is kind of the i love this show. I love cable news. Were going to talk about this for the next ad nauseam until the sun goes down. We just dont know. There are some things that we do know. We know that contrary to what the president is talking about, this is not a hoax as we know. This investigation has led to the indictments and convictions of many people, russian nationals, for example, people in the trump orbit, et cetera. Mueller has been working for the last 675 days. While we dont know when exactly hes going to notify bill barr that that work is over, we know hes obviously been busy. Carolyn and jill, the last final thoughts here. Yeah. I think everybody sort of worst Case Scenario is the report drops and we maintain the status quo. For so long weve been wait a second. Thats not the worse case. Thats pretty likely. Exactly. Just to set peoples expectations. I think you seeing a lot of democrats trying to manage expectations. It looks like were heading more and more in that direction. But i think that a lot of people were hopeful that potentially the roger stone indictment was sort of dangling a potential conspiracy. That there could be a third round of indictments about this possible collusion, but i think we have to brace ourselves for the possibility that were just at the same place we were yesterday when this report comes out. Theres been International Reaction this morning from turkey saying the president s statement threatens a new crisis from syria calling it irresponsible. Iran calling it illegal and unacceptable. Of course, what the president has done doesnt practically necessarily change anything or not ground, but it is a symbolic move. Right . Absolutely. And its blatantly political by most accounts. Theres no reason to do it now except for the fact that the election is on april 9th, and so far the president as is obvious, has done everything we can for his strong ally, netanyahu. Netanyahu last night was saying thank you, youve made history again, mr. President , thank you President Trump, this is the best relationship israel has ever had, saying first you got the embassy moved from tel aviv to jerusalem, tacitly recognizing jerusalem as the capital of israel. Theyve closed the palestinian offices in washington and the palestinian offices in israel. And then the Iran Nuclear Deal withdrawing from the nuclear deal against the advice of some of his National Security advisers at the time, theyre long gone, and our closest european allies. And mike pompeo going to the western wall with netanyahu. Nobody has done that. President trump went to the wall and so did pence, but not with the Prime Minister. That was very aggressive in a sensitive place where the palestinians have been shut out of negotiations ever since the embassy move, they have, themselves refused to meet with u. S. Officials . Quickly, when you talk about mike pompeo, i want to get your take to an interview he gave while you were in jerusalem. I want to play it. Could it be that President Trump right now has been sort of raised for such a time as this to help save the jewish people from an iranian menace . As a christian, i believe thats possible. Im confident the lord is at work here. What do you make of that . Hes an e vangelical. Hes a man of deep faith. Hes moved by the religious sites and he speaks often about that. Thats consistent with mike pompeo, the man and who he is, and its also, i think something that he really believes. But the fact is that just for context, this was the holiday a jewish holiday. A lot of music and dancing and parades in the streets. Alcohol consumed. You can kind of compare it, its kind of their mardi gras and queen esther saved the people. The analogy with iran was to that saying can President Trump be the queen esther . Thats an Old Testament reference. Iranian hezbollah is part of the government and the parliament. Theyve just sanctioned other iranian entities claiming they could be reconstituting a weapons program. The pressure is on iran from this administration. Jared kushner potentially using whatsapp to communicate with foreign officials despite the attorney pushing back on this. The president said i dont know anything about it. Youre right. Thats exactly what he said. He moved on to the next question. Of course, House Democrats want to know more. They want this white house to comply with their requests for documents. Im told the white house probably wont comply. They said this is under review and they expect to put out a statement later in the week. To the larger point about the president s attacks on john mccain, i have to tell you when you talk to people close to the president about what accounts for this, theyre reluctant to wager a guess. They say theres no strategy behind it. They dont think it benefits the president politically, but it speaks to what animates hip. Hes animated by grievances and score set. That said, you are seeing a hand full of republicans, a small hand full of republicans break with the president on this issue. You have dan crenshaw who subjected the attacks are beneath the office of the presidency. You have someone saying she spoke with the president to communicate to him how she and arizona feel about the late senator. She said the president heard her. And you also have Joe Lieberman who wrote an op ed in the Washington Post saying mccain probably wouldnt have responded to the comments but the person who suffers the most, from the strange attacks from the president is the president himself. The president this morning spoke to fox business news. They asked him if he feels a responsibility to bring the country together. He said yes. Do you feel a responsibility as president to bring the nation together . I do, i do, and i think i am in a certain way bringing it together. I can tell you that a big portion of this nation is united like its never been united before. Of course, it would have been news if the president answered that question in the negative. As it stands the president is uniting people in part it seems in criticizing him for his attacks on senator mccain. Thats for sure. Geoff, thank you, my friend. Mac, a lot going on here. A lot happening in the west wing these days with President Trump. Do you think its the Mueller Investigation getting under his skin . Theres been a lot going on in the Trump Administration from day one. But this can we just mac, understatement of the year. Thank you. But the Mueller Investigation clearly is a water shed event. But this episode with john mccain is just absolutely wrong. Its unnecessary. Its beneath the presidency. Its inappropriate. It was time to let this go from day one. Never do it. So talk through with me the thing that geoff discussed which was the idea that Jared Kushner and his whatsapp use could be getting him in hot water. I heard from kushners attorney when the story broke in the letter sent to Elijah Cummings in the House Oversight committee saying we have a difference of interpretation. I never told you Jared Kushner used whatsapp Elijah Cummings was like i want more information. What about his whatsapp . There are two issues here. One is when you come from business in the private sector, which i did to the white house, you have to be exceedingly mindful and careful to separate all your prior dealings and any ongoing dealings from the private sector from your government responsibility. Obviously in the case of Jared Kushner or my case as chief of staff, you have to be extremely careful. Secondly, perhaps we were fortunate that there was no email in whatsapp when i was in the white house. But technology has brought forth another level of care and prudence. It doesnt appear that was exercised in this case. Alexi . Kushner is a subject of interest for House Democrats. Thats why hes allegedly using back channels to communicate and conduct classified potentially or at least official business in ways that im not a tech expert, but i know whatsapp has some inkripg level, but its not a high enough level for him to conduct official business on his cell phone. And the fact that she was screen shooting it and sending it to his email, i think further brings up security questions and what hes doing. It speaks to what we know about the white house. They play by their own rules. They dont care about rules previous administrations have followed. They they theyre above the law. Alexandria ocasiocortez has become a lightning rod on the right and sort of a hero on the left for some tweeted and said whats about the whatsapp . Hillary clinton responded and said tell me about it. That shouldnt be a surprise considering everything the clintons have been through. The Trump Administration would be somewhat consistent its the fact that trump responded saying i dont know anything about that. Thats different than i know for a fact that kushner did not do that. Do we have that sound . We do not. Thats different from saying i know we did not do that because we follow the highest ethics of law and we made a big deal about that, so we would not violate that ourselves. Thats not what he said. I think thats a great contrast. Thats the point. It does suggest that theres just a casualness here, really a recklessness in this day and age. Hes talked a lot about civil rights and criminal justice issues. He did that today in the context of his own previous arrests including for dui. I think we have that sound we can play. Its interesting. Take a listen. Both instances i spent a night in the county jail, and in both instances i was able to post bail because we have the resources in our family to do that. I understand now how exceptional my experience was, and the fact that these mistakes didnt define me or my future or my options over the course of my lifetime. And how there are so many people in this country who because their families cannot post bail are unable to get out of jail. There are so many people i mentioned, nonviolent drug offenses who will check a box on every application and cannot vote in too many of the counties of our states right now. Theres an awareness different people are treated differently by the courts and law based on multiple things including some of their identities. One of the most recent conversations about that is related to Paul Manafort and the sentence he got compared to how a black woman who tried to vote in texas, got a longer sentence because she wasnt supposed to be voting based on her probation. Theres issues with the law that many voters have recognized and are bringing to the attention of these president ial candidates. What i think beto oroarke has understood is there are a lot of issues he was not deeply aware of before he ran for senate because of the kdemographics in his state. Once he got bigger, hes having to educate himself. Theres another issue thats come up recently. You heard the president touch on it this morning. This idea that with move on, this Group Calling on democrats not to go to a pac, Many Democrats in the race said they will. Warren is not going. Sanders, oroarke, harris, gillibrand, thats the list of people not attending. Who knows if schultz is going. How is this playing into a strategy for dems . I think some members of the house leadership for democrats are going. Its not a unified front. Right. I think democrats probably should go. Even if they totally disagree with netanyahu or how the president is treating israel right now. But i think its an important audience to communicate with. And it doesnt mean youre endorsing the policies. It doesnt mean youre endorsing netanyahus policies. But i do think there are voters, and i think democrats need to go everywhere. Why this is potentially significant for folks that have been watching these cases involving the president , particularly Michael Cohen, is that he had overseen that investigation because the u. S. Attorney was recused by the Justice Department. He was appointed by the president im speaking about Jeffrey Berman the u. S. Attorney. W when the investigation came up, they thought it would be best to recuse Jeffrey Berman from that role. We discussed it on your air earlier this week. His name is on those as the person overseeing that investigation. Hes going to be leave, but this had been in the works because this is a personal decision were told by mr. Kuzami because he has family in the washington, d. C. Area. Over the past 15 months hes been commuting every week, seeing his family on the weekends and spending time here in new york.
