One day after his former personal fixer was sentenced to three years in prison, the president is on a twitter tirade about Michael Cohen and that money. Hans nichols is at the white house for us. Its the first time weve seen the president respond to the sentencing of Michael Cohen. He has broken his silence. His old argument was there is no collusion, as it pertains to russia. The new argument is theres no crime as it pertains to these payments. And he seems to be blaming his old lawyer. Take a look at these tweets from the president. I never directed Michael Cohen to break the law. He is a lawyer and he is supposed to know the law. Its called advice of counsel and a lawyer has a great liability if a mistake is made. Thats why they get paid, despite that, Many Campaign lawyers strongly stated i have done nothing wrong with respect to campaign laws. This tweet goes on. You get the gist of it. Blame Michael Cohen and claim you didnt know what was happening in terms of these payments. The president s entire posture on these investigations was theres no collusion with russia. Now that it looks like these investigations, especially in the Southern District, are taking a slightly different tenor, were seeing, as youre mentioning on nbc news reporting, a shift in his private concern and hes starting to ask around about just how much trouble he may be in. One key thing to note is the erosion of support, potentially, of establishment republicans. Marco rubio was out the other day, talking about how the president could be in real trouble here. Legally the president has indicated in the past he is not at all worried about impeachment because he didnt do anything wrong. Lets refresh our memories for a second. You impeach somebody because he created the greatest economic success in the history of our country . Lets impeach him because the country is so successful. How do you impeach somebody who is doing a great job, that hasnt done anything wrong . It doesnt matter. We will impeach. This is what were going to have to fight against. And donald trump this morning, paul, is fighting this. Hes saying hey, i never did anything improper or illegal. The constitutional standard for impeachment is high crimes and misdemeanors. The president s own Justice Department has implicated him in two felonies. They say he directed and coordinated conspiracy to violate the Campaign Financing laws. And it would be one thing if this were only the word of a convicted felon, Michael Cohen, but now we know at least two other witnesses, david pecker and now weisselberg, will back up that evidence as well as all of these documents that they must have. You know, this agreement that they have with ami, that the Justice Department made with ami not to prosecute in exchange for dirt on trump, has been in place since september. We just learned about it yesterday but theyve been doing a lot of interviews. So, barbara, what do you think, then, this team, these prosecutors have learned from the National Enquirer . We have a list of all the covers going after Donald Trumps opponents. Ted cruz, for example, hillary clinton, of course, again and again. Close ties. We knew between these two entities, right . Now it looks like the National Enquirer might be flipping. Yeah. This piece could be devastating because the key element that is ordinarily very difficult to prove is willfulness, the intent that the person not only engaged in criminal activity but knew it was illegal. Thats one of the highest legal standards there is in criminal law, but if he had conversations with david pecker or Alan Weisselberg about these things, that could very well establish it. I think theres already evidence of willfulness that exists in the public record. One of the things that people look to is whats known as consciousness of guilt. That is proven when people lie and tell shifting stories. In the case of President Trump, you know, initially he denied that these payments occurred or he even knew about them. Now in todays tweet he said he knew about them but that Michael C Cohen said it was okay. What do you make of that, barbara, then, to your point, the president s tweet today that he never directed Michael Cohen to do anything illegal . Yeah, well, hes refuting what Michael Cohen has already told them, the fact that prosecutors put it in a filing suggest that theres corroboration for that. The key will come down to willful intent, which pecker and weisselberg can fill in. He also said in that tweet this would normally be a civil matter, its not even criminal and Michael Cohen is only pleading to it to get President Trump. I dont think anyone would endure three years in prison just to get someone. The judge thought it was illegal, the defense attorney thought it was illegal. Civil fine is for different kinds of violations, technical violations like a late submission or mathematical error and calculation. This is a very different one in kind. It goes to the very heart of Campaign Finance violations. The purpose of the laws is to promote transparency in the law so people understand why money is coming in and going out and that is the very heart of what is involved in this scheme here. Trying to hide the truth from the American People to influence the vote. And somebody who spoke about that, you might remember, paul, is Karen Mcdougal, one of the women who says she had sex with donald trump, something that the white house has said wasnt true. Here she is. He won the republican nomination and they were interested in the story again. Why do you think it was after donald trump was the republican nominee that they came back . They wanted to squash the story. How does that, if at all, play into this . Thats evidence of criminal intent. You can give money to somebody else if you want to help them out by, say, helping their hide a secret like an affair, like they have a mistress from their wife. Thats kind of what trumps defense is when he says im in the same situation as john edwards. John edwards also got charged with a Campaign Financing violation. His defense was it wasnt to help me win the election, it was to hide it from my wife. But again here, its not just going to be Michael Cohen, its going to be two other witnesses, who say the whole purpose of this money was to help trump win the election, and the timing, as you suggest, is key. Right after these access hollywood tapes come out at the end of october, right before the election, thats when this hush money gets paid to silence these women because they know that will be very damaging to the campaign. This is a big deal inside Donald Trumps orbit, based on my reporting, my colleagues reporting and what sources are telling us. On capitol hill its landing with a different noise. Attorneys office in d. C. Where maria butina has pled guilty to conspiracy to violate the Foreign Agents act. It could have been legal if she had been forthcoming about it. She came to the United States as a graduate student and american university. She used her positions within the gun Rights Community and at the direction of alexander torchin, russian official and central bank there to influence the Republican Party. She used it as unofficial capacity. Well see butina come into court where she will plead guilty and a key part of this is how she will cooperate. In the plea agreement it says she will cooperate in all matters that the government deems relevant. That could touch on Robert Muellers investigation, particularly if she had contacts with republicans before the campaign, through her work with the nra. Also we know alexander torchin, that man i mentioned, did reach out to Jared Kushner in order for a sideline meeting in 2016 at an Nra Convention in kentucky. Kushner rebuts that, said he didnt want it. But we know they were at the same dinner for the nra around the same time. Her agreeing to making this retroactive herself, i think, signifies we have some gains, house leadership in the Democratic Caucus is a really big deal and so its not certainly everything that we wanted but it is a lot. No, no, no. You never represent Michael Cohen in a legal capacity but still a Communications Adviser here. The case is over. Thats why im no longer needed as a lawyer. Let me start with the president s tweet today when he says he never directed Michael Cohen to break the law. Is donald trump lying . Well, no. Hes stating a legal conclusion that some lawyer must have written for him but hes not stating facts. Thats what he always seems to ignore, are facts. Let me stop you there. Are you saying that the president did direct Michael Cohen to break the law . Of course not. Hes stating a conclusion, a legal conclusion, but ignores facts. Fact one, its undeniable, you already played the tape, that he was aware of this payment. Fact two is that you have corroboration as of yesterday that we knew about that the publication owner collaborated in order to hush up bad news before the election and it was about the election. So those are facts. Now its up to a jury to determine whether those payments were made right before the general election, motivated by protecting and hushing up and corrupting the election or whether it was for another reason. But President Trump doesnt seem to understand, or he doesnt care the difference between facts and spin. And in this case, hes ignoring the facts. In addition to the two pieces of information you just laid out, does Michael Cohen have additional proof or additional evidence that the president did direct him to break the law . Well, he has the tape. He certainly has now corroborating he has one tape. Yes. Thats pretty compelling. I played that on air myself. Okay. Now according to the Southern District of new york prosecutors, he has an agreement with the publisher, a corroborating individual, as to the motivation of those hush money payments and we also have mr. Weisselberg cooperating, who is a witness to the motivation of making those payments to miss daniels and miss mcdougal. You have witnesses besides mr. Cohens word, which people can have a right to doubt, and mr. Mueller, in his own way, on the Russian Investigation is not relying on one witness. As weve seen, he relies on corroborating testimony. Mr. Trump doesnt seem to get that. Okay. So Robert Mueller, prosecutors have the word of these witnesses, including your former client, Michael Cohen. We heard that one tape. Are there additional tapes that Michael Cohen made of donald trump talking about this . Are there more tapes . I dont know the answer to that. I do have heard that tape. That tape is pretty compelling, that mr. Trump was aware of the hush money plan. He may argue it was motivated by protecting his wife but two weeks before an election, all witnesses are saying it was motivated about hush iing up an corrupting the outcome of an election. In my view thats a conclusion that a jury could draw. Okay. Theres Something Else that Michael Cohen may or may not know something about. There was confusion about this earlier in the year. I would like you to clarify, now that you can speak freely once and for all. Does Michael Cohen have knowledge that donald trump was told about that trump tower meeting with the russian lawyer on or around the time that it happened . No. I remember the terrible experience for me in thinking that he did, and it turned out i was wrong. And i did what donald trump has a problem doing. I immediately went on tv and owned up to my mistake. Other than the tape that we heard, that we played, that your client recorded and other than his word, what hes telling the special counsel, do you have other evidence or does cohen have other evidence that donald trump is not telling the truth . Because that is a point that you have made repeatedly over the last 24 hours, that cohen is ready to tell all. Does he have evidence, other than his word and that tape . I would say i cant answer any questions about mr. Muellers conversations for 70 hours and his team except to say that the style of this particular prosecutor, mr. Mueller, is not to believe anyone, but to have corroborating, irrefutable, hard evidence, such as emails, tapes and other corroboration from other witnesses. I cant tell you about other tapes from mr. Cohen. Were going to wait for mr. Muellers findings but then i believe mr. Cohen will have an opportunity before probably a Congressional Committee to answer every question and to tell the full story about what he knows about mr. Trump. So speaking of that, you told me yesterday that same thing. Michael cohen, you compared him to john dean. He will go and tell all before a Congressional Committee. Has any member of congress contacted you . No. Or contacted Michael Cohen . Nochlt quickly, hallie, the comparison to john dean is only in one respect. The facts are much different. John dean pled guilty to serious crimes, as admitted in a book called blind ambition, that he was obstructing justice, tampering with witnesses, authorizing hush money payments, helping Richard Nixon and people doubted his word. In history he has been looked upon favorably because he ultimately told the truth. How is Michael Cohens state of mind today . What kind of spirits is he in . What is he thinking the day after being sentenced to three years in prison .
